		<section id="HFFD192D4975D405ABB33FC2C62FFD47C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Paid Sick Leave Act</short-title></quote>.</text>
		</section><section id="H78466D6BA51548D09185C63508F530F9"><enum>2.</enum><header>Requirement for paid sick leave</header>
			<subsection id="HFDCCB5C4424D486C9CB743E812EBEA24"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">An employer shall permit each employee employed by the employer to earn not less than 1 hour of
			 paid sick leave for every 30 hours worked, to be used as described in
			 subsection (b).</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HE754354DE995459BA41CCCF98145A1CF"><enum>(b)</enum><header>Uses</header><text display-inline="yes-display-inline">Paid sick leave earned under this section may be used by an employee for any of the following:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HA9D18B3099A746469586311E23C90AE1"><enum>(1)</enum><text display-inline="yes-display-inline">An absence resulting from a physical or mental illness, injury, or medical condition of the
			 employee.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H686F43B759BF4F8BA529688FE18B1226"><enum>(2)</enum><text display-inline="yes-display-inline">An absence resulting from obtaining professional medical diagnosis or care, or preventive medical
			 care, for the employee.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCAA15215E84341BD833BB745A8950808"><enum>(3)</enum><text display-inline="yes-display-inline">An absence for the purpose of caring for a child, a parent, a spouse, or any other individual
			 related by blood or affinity whose close association with the employee is
			 the equivalent of a family relationship, who—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H4935007DE04C4C53B94B284B9C2F0626"><enum>(A)</enum><text display-inline="yes-display-inline">has any of the conditions or needs for diagnosis or care described in paragraph (1) or (2); and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC4EA6E75015143AD95777748C8C222B4"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of someone who is not a child, is otherwise in need of care.</text>
					</subparagraph></paragraph><paragraph commented="no" id="H3DA18A30C83C47CB8C3B622885AED2CF"><enum>(4)</enum><text>An absence resulting from domestic violence, sexual assault, or stalking, if the time is to—</text>
					<subparagraph commented="no" id="HA52A3816E3514CF6970AA82AE57DB9E0"><enum>(A)</enum><text>seek medical attention for the employee or the employee’s child, parent, or spouse, or an
			 individual related to the employee as described in paragraph (3), to
			 recover from physical or psychological injury or disability caused by
			 domestic violence, sexual assault, or stalking;</text>
					</subparagraph><subparagraph commented="no" id="H243FDCDB78294DFCA6247873EE38F81E"><enum>(B)</enum><text>obtain or assist a related person described in paragraph (3) in obtaining services from a victim
			 services organization;</text>
					</subparagraph><subparagraph commented="no" id="HC2C229F47F2B4AC7A2FDDB7E1BADAE0F"><enum>(C)</enum><text>obtain or assist a related person described in paragraph (3) in obtaining psychological or other
			 counseling;</text>
					</subparagraph><subparagraph commented="no" id="HA094749A216D424690C0C9F9759F71CC"><enum>(D)</enum><text>seek relocation; or</text>
					</subparagraph><subparagraph commented="no" id="HA7D6D9F2B6D548DB87E1447E08028E4D"><enum>(E)</enum><text>take legal action, including preparing for or participating in any civil or criminal legal
			 proceeding related to or resulting from domestic violence, sexual assault,
			 or stalking.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HF516884CDC9C4AF78FC5C8A37E4788C8"><enum>(c)</enum><header>Definitions</header><text>In this Act:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H63473576EF0B45CBBEAC2216A8F4A6FB"><enum>(1)</enum><header>Child</header><text display-inline="yes-display-inline">The term <term>child</term> means a biological, foster, or adopted child, a stepchild, a legal ward, or a child of a person
			 standing in loco parentis, who is—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H38F8AB053D544566AD55E2366E521C2C"><enum>(A)</enum><text display-inline="yes-display-inline">under 18 years of age; or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC04EB2978A7445E2A5FD6D02037D4463"><enum>(B)</enum><text display-inline="yes-display-inline">18 years of age or older and incapable of self-care because of a mental or physical disability.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6B6FC1D244604D58AA69CEC1EECB5D65"><enum>(2)</enum><header>Domestic violence</header><text>The term <term>domestic violence</term> has the meaning given the term in section 40002(a) of the Violence Against Women Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/42/13925">42 U.S.C. 13925(a)</external-xref>), except that the reference in such section to the term <term>jurisdiction receiving grant monies</term> shall be deemed to mean the jurisdiction in which the victim lives or the jurisdiction in which
			 the employer involved is located.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H20196038CA024364B47D33BE0187D41E"><enum>(3)</enum><header>Employee</header><text display-inline="yes-display-inline">The term <term>employee</term> means an individual who is—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H1104D1A4A45E4E109BF3DDF9361D58FD"><enum>(A)</enum>
						<clause commented="no" display-inline="yes-display-inline" id="H5FE21FE53F17433BABA418C81912D5A9"><enum>(i)</enum><text display-inline="yes-display-inline">an employee, as defined in section 3(e) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203(e)</external-xref>), who is not covered under subparagraph (E), including such an employee of the Library of
			 Congress, except that a reference in such section to an employer shall be
			 considered to be a reference to an employer described in clauses (i)(I)
			 and (ii) of paragraph (4)(A); or</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H15EFDFA7360D4478A69B8E99AA01BB75" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">an employee of the Government Accountability Office;</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H87CCD49268C146138E486365D966F2D9" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">a State employee described in section 304(a) of the Government Employee Rights Act of 1991 (42
			 U.S.C. 2000e–16c(a));</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H20E450DE45244F978B19CF4031D18F4B" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">a covered employee, as defined in section 101 of the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301</external-xref>), other than an applicant for employment;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H90B8729802D74874BD42E633BFD12D7D" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">a covered employee, as defined in <external-xref legal-doc="usc" parsable-cite="usc/3/411">section 411(c)</external-xref> of title 3, United States Code; or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8040106481C14C39B488162A277E55D0" indent="up1"><enum>(E)</enum><text display-inline="yes-display-inline">a Federal officer or employee covered under subchapter V of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/63">chapter 63</external-xref> of title 5, United States Code.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0E83CD76AD79426CA9D51459F33EF1AA"><enum>(4)</enum><header>Employer</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="H5592012A157440768F0704CCC2CEDC34"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>employer</term> means a person who is—</text>
						<clause commented="no" display-inline="no-display-inline" id="H3E1738F6A8CA4919B442EBFA5B0C431C"><enum>(i)</enum>
							<subclause commented="no" display-inline="yes-display-inline" id="H398C2A7AE4EF407E98BF2474661F4833"><enum>(I)</enum><text display-inline="yes-display-inline">a covered employer, as defined in subparagraph (B), who is not covered under subclause (V);</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="H0055354C831D49888F4900B8162BDE2D" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">an entity employing a State employee described in section 304(a) of the Government Employee Rights
			 Act of 1991;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="HC839BC10736046FB988B90DCA6A74CA2" indent="up1"><enum>(III)</enum><text display-inline="yes-display-inline">an employing office, as defined in section 101 of the Congressional Accountability Act of 1995;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="H2E7D62A28E1045748F787FD5DE0F3DBF" indent="up1"><enum>(IV)</enum><text display-inline="yes-display-inline">an employing office, as defined in <external-xref legal-doc="usc" parsable-cite="usc/3/411">section 411(c)</external-xref> of title 3, United States Code; or</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="H1D41E6FEC4C145DD915438AF009B3638" indent="up1"><enum>(V)</enum><text display-inline="yes-display-inline">an employing agency covered under subchapter V of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/63">chapter 63</external-xref> of title 5, United States Code; and</text>
							</subclause></clause><clause commented="no" display-inline="no-display-inline" id="HC5C42EEBF1A646CB9E4E44A0AE1C0C0D"><enum>(ii)</enum><text display-inline="yes-display-inline">is engaged in commerce (including government), or an industry or activity affecting commerce
			 (including government), as defined in subparagraph (B)(iii).</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H42E24D6563B7406E85FDBC35641D61C3"><enum>(B)</enum><header>Covered employer</header>
						<clause commented="no" display-inline="no-display-inline" id="HBCD0D942B3CF4D86869DF7B85011E8E6"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">In subparagraph (A)(i)(I), the term <term>covered employer</term>—</text>
							<subclause commented="no" display-inline="no-display-inline" id="H69F76B879A3B427F965AE7FB5C3B9248"><enum>(I)</enum><text display-inline="yes-display-inline">means any person engaged in commerce or in any industry or activity affecting commerce who employs
			 15 or more employees for each working day during each of 20 or more
			 calendar workweeks in the current or preceding calendar year;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="H149C0B1945B847E28C6E95FEC39BED28"><enum>(II)</enum><text display-inline="yes-display-inline">includes—</text>
								<item commented="no" display-inline="no-display-inline" id="HBFAE16A746744EDA9F3E4324447B0FD1"><enum>(aa)</enum><text display-inline="yes-display-inline">any person who acts, directly or indirectly, in the interest of an employer to any of the employees
			 of such employer; and</text>
								</item><item commented="no" display-inline="no-display-inline" id="H7EF840D5730C4B58A23E4040BB540B07"><enum>(bb)</enum><text display-inline="yes-display-inline">any successor in interest of an employer;</text>
								</item></subclause><subclause commented="no" display-inline="no-display-inline" id="H996FB3F32F6D47459BBD9766F4AA334B"><enum>(III)</enum><text display-inline="yes-display-inline">includes any <quote>public agency</quote>, as defined in section 3(x) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203(x)</external-xref>); and</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="H75232F81BF2C44C5942933BDE2556C4E"><enum>(IV)</enum><text display-inline="yes-display-inline">includes the Government Accountability Office and the Library of Congress.</text>
							</subclause></clause><clause commented="no" display-inline="no-display-inline" id="H8D6A7390500B4A70BC7AB2EF298341D8"><enum>(ii)</enum><header>Public agency</header><text display-inline="yes-display-inline">For purposes of clause (i)(III), a public agency shall be considered to be a person engaged in
			 commerce or in an industry or activity affecting commerce.</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="HCB1DD86F6B8441D6975ECE21943FA2AC"><enum>(iii)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this subparagraph:</text>
							<subclause commented="no" display-inline="no-display-inline" id="H7AA457E4822544489A0A2030655DE6E1"><enum>(I)</enum><header>Commerce</header><text display-inline="yes-display-inline">The terms <term>commerce</term> and <term>industry or activity affecting commerce</term> mean any activity, business, or industry in commerce or in which a labor dispute would hinder or
			 obstruct commerce or the free flow of commerce, and include <term>commerce</term> and any <quote>industry affecting commerce</quote>, as defined in paragraphs (1) and (3) of section 501 of the Labor Management Relations Act, 1947
			 (29 U.S.C. 142 (1) and (3)).</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="H5876FDC9A3454D759D3700DEBDF4AAFA"><enum>(II)</enum><header>Employee</header><text display-inline="yes-display-inline">The term <term>employee</term> has the same meaning given such term in section 3(e) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203(e)</external-xref>).</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="HBA878D3F03BA46B7ADC59C5880F9C07A"><enum>(III)</enum><header>Person</header><text display-inline="yes-display-inline">The term <term>person</term> has the same meaning given such term in section 3(a) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203(a)</external-xref>).</text>
							</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H70BCA7BA270141CF87D40E3016D7C796"><enum>(C)</enum><header>Predecessors</header><text display-inline="yes-display-inline">Any reference in this paragraph to an employer shall include a reference to any predecessor of such
			 employer.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H05B0BC5FC1854507B4441BAC4A1BC42F"><enum>(5)</enum><header>Parent</header><text display-inline="yes-display-inline">The term <term>parent</term> means a biological, foster, or adoptive parent of an employee, a stepparent of an employee, or a
			 legal guardian or other person who stood in loco parentis to an employee
			 when the employee was a child.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H252F451F4985496792B9188E89EFF919"><enum>(6)</enum><header>Sexual assault</header><text>The term <term>sexual assault</term> has the meaning given the term in section 40002(a) of the Violence Against Women Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/42/13925">42 U.S.C. 13925(a)</external-xref>).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFCFFDC716CC041E2BDD08D303172C891"><enum>(7)</enum><header>Spouse</header><text display-inline="yes-display-inline">The term <term>spouse</term>, with respect to an employee, has the meaning given such term by the marriage laws of the State in
			 which the employee resides.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF151EBE5698B409DB77521E93E218F01"><enum>(8)</enum><header>Stalking</header><text>The term <term>stalking</term> has the meaning given the term in section 40002(a) of the Violence Against Women Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/42/13925">42 U.S.C. 13925(a)</external-xref>).</text>
