		<section id="H95D550A277884DDF904316A70143CBF7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Early Warning Reporting System Improvement Act of 2014</short-title></quote>.</text>
		</section><section id="HC3FC089780CE444AA63F26F437CA68E9" section-type="subsequent-section"><enum>2.</enum><header>Additional early warning reporting requirements</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/30166">Section 30166(m)</external-xref> of title 49, United States Code is amended—</text>
			<paragraph id="HAAA27D8B367F4E69BAF65786FCF6EC2D"><enum>(1)</enum><text>in paragraph (3)(C)—</text>
				<subparagraph id="H90608AEDD5DC4DE3A558EE528020DF00"><enum>(A)</enum><text>by striking <quote>The manufacturer</quote> and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="HAA5154F408D24A98A0BFA2055E5E2024" style="OLC">
						<clause id="H7F458EDC5A284E3199E01577DC7B1A25"><enum>(i)</enum><header>In general</header><text>The manufacturer</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block>
				</subparagraph><subparagraph id="HD82863D0AEDA48ACA7962BEB0C2E3E2A"><enum>(B)</enum><text>by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H5A7094D07D034D95BF8E3C7CE32EB7EA" style="OLC">
						<clause id="H3ACCB0A3586B48AA9C0B58F498CB2782"><enum>(ii)</enum><header>Fatal incidents</header><text>If an incident described in clause (i) involves fatalities, the Secretary shall require the
			 manufacturer to submit, as part of its incident report—</text>
							<subclause id="H10119646DAD34955A057A90D10DD9DC3"><enum>(I)</enum><text>all initial claims or notice documents that notified the manufacturer of the incident;</text>
							</subclause><subclause id="H1082F2ECBE8941CE9C4C20B9218CB41C"><enum>(II)</enum><text>any police reports or other documents describing or reconstructing the incident; and</text>
							</subclause><subclause id="H2DDD4DFEF7394B469A85B07FF84ABD4C"><enum>(III)</enum><text>any amendments or supplements to the documents described in subclause (I), except for—</text>
								<item id="H528C32AF390C414984C1DA9EE49FC254"><enum>(aa)</enum><text>medical documents and bills;</text>
								</item><item id="HDB77608D6B2F4681943387B2F70C1110"><enum>(bb)</enum><text>property damage invoices or estimates; and</text>
								</item><item id="H5523E017D26E41E8BD64E224C60F0ADD"><enum>(cc)</enum><text>documents related to damages.</text></item></subclause></clause><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="HE813649B885D48109B08661F4BA8E8BC"><enum>(2)</enum><text>in paragraph (4), by amending subparagraph (C) to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H68E96A92F0BE4118822188064EFA90E4" style="OLC">
					<subparagraph id="H88F83BE879BA4BAE810BFE589EE62021"><enum>(C)</enum><header>Disclosure</header>
						<clause id="H54FCCA6D5AC94D4BA5EB258A287C63B1"><enum>(i)</enum><header>In general</header><text>The information provided to the Secretary pursuant to this subsection—</text>
							<subclause id="H1EF38EEEAD3E4B0DABCB5FC0FCB9D036"><enum>(I)</enum><text>shall be disclosed publicly unless exempt from disclosure under <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552(b)</external-xref> of title 5; and</text>
							</subclause><subclause id="H45ACE5303C5D47848CB5CDF668211AEB"><enum>(II)</enum><text>shall be entered into the early warning reporting database in a manner that is searchable by
			 manufacturer name, vehicle or equipment make and model name, model year,
			 and type of potential defect.</text>
							</subclause></clause><clause id="H7906E3C7A99F4940821893651CE542F4"><enum>(ii)</enum><header>Presumption</header><text>In administering this subparagraph, the Secretary shall presume in favor of maximum public
			 availability of information.</text>
						</clause><clause id="H670120D6151A4311A08E02C8DE115DF2"><enum>(iii)</enum><header>Inapplicability of confidentiality provisions</header><text>In administering this paragraph, the confidentiality provisions under <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552(b)(4)</external-xref> of title 5,
			 shall not be construed to prevent the public disclosure of—</text>
							<subclause id="H14B0C4BA95BC4B3287278142574FAA4B"><enum>(I)</enum><text>production information regarding passenger motor vehicles;</text>
							</subclause><subclause id="HF4817F9F3EE14DD4A274A8F39C96F5C3"><enum>(II)</enum><text>information on incidents involving death or injury;</text>
							</subclause><subclause id="H9AECE01AA8C34565934D182A6A89F810"><enum>(III)</enum><text>numbers of property damage claims; or</text>
							</subclause><subclause id="H00EDECB73AC3474781B7AEFA246415A3"><enum>(IV)</enum><text>aggregated numbers of consumer complaints.</text></subclause></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="HB59B569C73A1417E9EC397FA84F076C7"><enum>(3)</enum><text>by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H01A5955EC8E24EE5A4E81F51F4FFFD16" style="OLC">
					<paragraph id="HC126E7D796CB4819960B6F07EFC52F6B"><enum>(6)</enum><header>Use of early warning reports</header><text>The Secretary shall consider information gathered under this section in proceedings described in
			 sections 30118 and 30162.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HEED81B8CA71B4F55ACB01B5AAB0A1261"><enum>3.</enum><header>Improved National Highway Traffic Safety Administration vehicle safety databases</header>
			<subsection id="H5DB77EF3F377438E9223F62A7824075F"><enum>(a)</enum><header>In general</header><text>Not later than 2 years after the date of the enactment of this Act, and after consultation with
			 frequent users of its publicly available databases, the Secretary of
			 Transportation (referred to in this section as the <quote>Secretary</quote>) shall improve public accessibility to information on the National Highway Traffic Safety
			 Administration’s publicly accessible vehicle safety databases by—</text>
				<paragraph id="H12078613A7024D16AE58E6FFA6E053FF"><enum>(1)</enum><text>improving organization and functionality, including design features such as drop-down menus, and
			 allowing for data from all of the publicly accessible vehicle safety
			 databases to be searched, sorted, aggregated, and downloaded in a manner—</text>
					<subparagraph id="H5671F5A552FD4AD097DE777CFA58F889"><enum>(A)</enum><text>consistent with the public interest; and</text>
					</subparagraph><subparagraph id="H97096FE4688A45D3932D952ADD98C826"><enum>(B)</enum><text>that facilitates easy use by consumers;</text>
					</subparagraph></paragraph><paragraph id="H63A42B36729842ACA280779143C1D11B"><enum>(2)</enum><text>providing greater consistency in presentation of vehicle safety issues;</text>
				</paragraph><paragraph id="H11F88712AFDC4B8BBAA814A3DE4A01C6"><enum>(3)</enum><text>improving searchability about specific vehicles and issues through standardization of commonly used
			 search terms and the integration of databases to enable all to be
			 simultaneously searched using the same keyword search function; and</text>
				</paragraph><paragraph id="H15A35185C83143BD82587E91C5E9E865"><enum>(4)</enum><text>ensuring that all documents, studies, investigations, inspections, incident reports, and other
			 materials related to an incident that are created or obtained by the
			 National Highway Traffic Safety Administration be made publicly available
			 in a manner that is searchable in databases by—</text>
					<subparagraph id="H83B096CBBA844D79BD1213B395A7CC67"><enum>(A)</enum><text>manufacturer name, vehicle or equipment make and model name, and model year;</text>
					</subparagraph><subparagraph id="H8B3A8ADF7B48450F8455746F4C0C8FDB"><enum>(B)</enum><text>type of potential defect;</text>
					</subparagraph><subparagraph id="H70CFD4953E9C493182B2FCAD2A9D75CC"><enum>(C)</enum><text>number of injuries or fatalities; and</text>
					</subparagraph><subparagraph id="HD241C0ED311A4E5F9AC42B32CE4A16EA"><enum>(D)</enum><text>any other element that the Secretary determines to be in the public interest.</text>
					</subparagraph></paragraph></subsection><subsection id="H40BE8FF856C14143A061598BEF9990EC"><enum>(b)</enum><header>Inspection and investigation information</header><text>The Secretary shall—</text>
				<paragraph id="HD7ECBA8F38AA480CB548EAB47F12DACC"><enum>(1)</enum><text>provide public notice of all inspection and investigation activities conducted by the Secretary
			 under <external-xref legal-doc="usc" parsable-cite="usc/49/30166">section 30166</external-xref> of title 49, United States Code; and</text>
				</paragraph><paragraph id="H7296805BAA7D45418E3171AF51300098"><enum>(2)</enum><text>make such notices, and notice of any enforcement or other action taken as a result of an inspection
			 or investigation—</text>
					<subparagraph id="HC707F45F0C0E4977BDA449342754BC90"><enum>(A)</enum><text>available to consumers on the Internet immediately after such notice is issued; and</text>
					</subparagraph><subparagraph id="HB67EB2E4FF9144D4B8E8075CEC31CAC7"><enum>(B)</enum><text>searchable by manufacturer name, vehicle or equipment make and model name, model year, system or
			 component, and the type of inspection or investigation being conducted.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
