		<section id="HB01EF387BDD344A3BE36D926D3CCA54F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>YES to Cures Act of 2014</short-title></quote>.</text>
		</section><section id="HD1FC0443CF734E79B39C6B48C9119E44"><enum>2.</enum><header>Funding research by emerging scientists through Common Fund</header>
			<subsection id="H422CD98EC52D436A8C5B7789971B5132"><enum>(a)</enum><header>Use of funds</header><text display-inline="yes-display-inline">Section 402(b)(7)(B) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/282">42 U.S.C. 282</external-xref>) is amended—</text>
				<paragraph id="HF4E7AB67FEA4486ABA449348F5C2D441"><enum>(1)</enum><text>in clause (i), by striking <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="H9AF7B9E1D04B4A62AEAADC5A57F4BDA9"><enum>(2)</enum><text>by redesignating clause (ii) as clause (iii); and</text>
				</paragraph><paragraph id="H05F78FB737B24999AAC47AE31D0152EC"><enum>(3)</enum><text>by inserting after clause (i) the following:</text>
					<quoted-block display-inline="no-display-inline" id="H7B24C0FA0A4E45DA9306DF02600896BA" style="OLC">
						<clause id="H55A7E1D7C0334915966D6775A439B7CC" indent="up2"><enum>(ii)</enum><text display-inline="yes-display-inline">shall, with respect to funds reserved under section 402A(c)(1)(C) for the Common Fund, allocate
			 such funds to the national research institutes and national centers for
			 conducting and supporting research that is identified under subparagraph
			 (A) and is carried out by one or more emerging scientists (as defined in
			 section 402A(c)(1)(C)(iv)); and</text>
						</clause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H175A5494210246C4B08A52D50C76495F"><enum>(b)</enum><header>Reservation of funds</header><text>Section 402A(c)(1) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/282a">42 U.S.C. 282a(c)(1)</external-xref>) is amended—</text>
				<paragraph id="H30A17303C36B467DB36E3DDB78EAE196"><enum>(1)</enum><text>by redesignating subparagraphs (C) and (D) as subparagraphs (D) and (E), respectively; and</text>
				</paragraph><paragraph id="HC72A583E3D4748F3BB74935975707C9F"><enum>(2)</enum><text>by inserting after subparagraph (B) the following:</text>
					<quoted-block display-inline="no-display-inline" id="H874A7300FD3742669BEC9F6DF908B5BD" style="OLC">
						<subparagraph id="HFA05DB1295A440DF9A67B9AE97366C69"><enum>(C)</enum><header>Additional reservation for research by emerging scientists</header>
							<clause id="H045BC64F57494AEF88B19E1C5CE881B7"><enum>(i)</enum><header>Inapplicability of tap for evaluation activities</header><text display-inline="yes-display-inline">Beginning with fiscal year 2015, funds appropriated to the National Institutes of Health shall not
			 be subject to section 241.</text>
							</clause><clause id="HBC7B11D3C0AF415486E4BBCDAF7A42D5"><enum>(ii)</enum><header>Reservation</header><text display-inline="yes-display-inline">In addition to the amounts reserved for the Common Fund under subparagraph (B) and amounts
			 appropriated to the Common Fund under subsection (a)(2), the Director of
			 NIH shall reserve an amount for the Common Fund for fiscal year 2015 and
			 each subsequent fiscal year that is equal to the amount that, but for
			 clause (i), would be made available under section 241 for evaluation
			 activities for such fiscal year.</text>
							</clause><clause id="H82D4997F524E4797822659CA5468B173"><enum>(iii)</enum><header>Purpose of reservation</header><text display-inline="yes-display-inline">Amounts reserved under clause (ii) shall be used for the purpose of carrying out section
			 402(b)(7)(B)(ii) (relating to the conduct and support of research that is
			 identified under section 402A(b)(7)(A) and is carried out by one or more
			 emerging scientists).</text>
							</clause><clause id="H5DCB1B12F9AD4D4586CC60399BEB3EA8"><enum>(iv)</enum><header>Definition</header><text display-inline="yes-display-inline">In this subparagraph, the term <term>emerging scientist</term> means an investigator who—</text>
								<subclause id="H860CE1EBB1F043BFAEE80C3C15697EE4"><enum>(I)</enum><text display-inline="yes-display-inline">will be the principal investigator or the program director of the proposed research;</text>
								</subclause><subclause id="H51CD1A5A2F8C40D1AD78AD62F083F384"><enum>(II)</enum><text>has never been awarded, or has been awarded only once, a substantial, competing grant by the
			 National Institutes of Health for independent research; and</text>
								</subclause><subclause id="H69F6C8DEDED14594B868D0259C478F86"><enum>(III)</enum><text>is within 15 years of having completed—</text>
									<item id="H84EF849D91A0411681746D08C549A159"><enum>(aa)</enum><text>the investigator’s terminal degree; or</text>
									</item><item id="H8FC09E766B3F4BC5BC2A2920C209205A"><enum>(bb)</enum><text>a medical residency (or the equivalent).</text></item></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HEFFCAD3FB14C4A4B9C7C83B943D280CA"><enum>(c)</enum><header>Supplement, not supplant; prohibition against transfer</header><text display-inline="yes-display-inline">Funds reserved pursuant to section 402A(c)(1)(C) of the Public Health Service Act, as added by
			 subsection (b)—</text>
				<paragraph id="HFAA3B2082866405EAC42188B853485AB"><enum>(1)</enum><text>shall be used to supplement, not supplant, the funds otherwise allocated by the National Institutes
			 of Health for young investigators; and</text>
				</paragraph><paragraph id="H0C684C474ABF4AAA891A4B7D330097F5"><enum>(2)</enum><text>notwithstanding any transfer authority in any appropriation Act, shall not be used for any purpose
			 other than allocating funds as described in section 402(b)(7)(B)(ii) of
			 the Public Health Service Act, as added by subsection (a).</text>
				</paragraph></subsection><subsection id="H8B415C585E3C410D947CA7E84F27B7B2"><enum>(d)</enum><header>Conforming amendments</header>
				<paragraph id="H2F147B481D7841FEB61232649499E543"><enum>(1)</enum><text>Section 241(a) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/238j">42 U.S.C. 238j(a)</external-xref>) is amended by striking <quote>Such portion</quote> and inserting <quote>Subject to section 402A(c)(1)(C)(i), such portion</quote>.</text>
				</paragraph><paragraph id="HBF1FC1190C994AF2A5040816B2472862"><enum>(2)</enum><text>Section 402A(a)(2) of the Public Health Service Act is amended—</text>
					<subparagraph id="HD12307F4096142FFAF48DFFC8AD5B0B8"><enum>(A)</enum><text>by striking <quote>402(b)(7)(B)(ii)</quote> and inserting <quote>402(b)(7)(B)(iii)</quote>; and</text>
					</subparagraph><subparagraph id="H58BFA007F55B4E61945A49026B730BC3"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>reserved under subsection (c)(1)(B)(i)</quote> and inserting <quote>reserved under subparagraph (B)(i) or (C)(ii) of subsection (c)(1)</quote>.</text>
					</subparagraph></paragraph><paragraph id="H19E7D3973F444A459E47C52264A20F84"><enum>(3)</enum><text display-inline="yes-display-inline">Section 3(c)(2) of the Gabriella Miller Kids First Research Act (<external-xref legal-doc="public-law" parsable-cite="pl/113/94">Public Law 113–94</external-xref>) is amended by
			 striking <quote>402(b)(7)(B)(ii) of the Public Health Service Act, as added by subsection (a)</quote> and inserting <quote>402(b)(7)(B)(iii) of the Public Health Service Act, as added by subsection (a) and redesignated by
			 section 2(a) of the <short-title>YES to Cures Act of 2014</short-title></quote>.</text>
				</paragraph></subsection><subsection id="H183FE05E43324E90ABB6025BDC51DE28"><enum>(e)</enum><header>Rule of construction</header><text>Nothing in this Act (and the amendments made by this Act) is intended to affect the amount of funds
			 authorized to be appropriated to the Agency for Healthcare Research and
			 Quality.</text>
			</subsection></section><section id="H78092B24E2A849B8AD41FC779310CC9C"><enum>3.</enum><header>Report on trends in age of recipients of NIH-funded major research grants</header><text display-inline="no-display-inline">Not later than six months after the date of enactment of this Act, the Director of the National
			 Institutes of Health shall submit a report to the Congress—</text>
			<paragraph id="H1D0B1E7AFFD948E78A175D4BAC205B03"><enum>(1)</enum><text>explaining why, over the 30-year period preceding the enactment of this Act—</text>
				<subparagraph id="H6F8C65869E454CBF836C69295844B456"><enum>(A)</enum><text>there has been a substantial increase in the age of investigators receiving their first major
			 research grant from the National Institutes of Health;</text>
				</subparagraph><subparagraph id="H2556C7D35E684E0D912C184C7FD602A0"><enum>(B)</enum><text>there has been a substantial increase in the average age of all recipients of major research grants
			 from the National Institutes of Health; and</text>
				</subparagraph><subparagraph id="HA24FAA5496E24F32ADE82048D3BF03FF"><enum>(C)</enum><text>there has been a dramatic drop in the number of investigators under 40 years of age receiving major
			 research grants from the National Institutes of Health; and</text>
				</subparagraph></paragraph><paragraph id="H193982394594475093412CF29D8CF863"><enum>(2)</enum><text>describing—</text>
				<subparagraph id="H8DAECF6BDA874FFC8AFCF4288C30E40B"><enum>(A)</enum><text>the steps taken by the National Institutes of Health in recent years to address the trends
			 identified in paragraph (1); and</text>
				</subparagraph><subparagraph id="H3734D8256E574A138F714D2C17B87C8A"><enum>(B)</enum><text>the impact of taking such steps.</text>
				</subparagraph></paragraph></section></legis-body>
