			</subsection></section><section id="HE4457FD1AE2F49AAB047701659C503C7"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H29AB9FB67F8B44CA9AB1FBBA96C1D5B7"><enum>(1)</enum><header>Agency</header><text display-inline="yes-display-inline">The term <term>agency</term> has the meaning given the term <term>Executive agency</term> under <external-xref legal-doc="usc" parsable-cite="usc/5/105">section 105</external-xref> of title 5, United States Code.</text>
			</paragraph><paragraph id="H82AEC95D2C0A4CC4B3B715C662B907B0"><enum>(2)</enum><header>Calendar day</header><text>The term <term>calendar day</term> means a calendar day other than one on which either House is not in session because of an
			 adjournment of more than three days to a date certain.</text>
			</paragraph><paragraph id="H0AF744C25B3E4BD98DEF2A7D0D2600FD"><enum>(3)</enum><header>State</header><text>The term <term>State</term> means each of the several States, the District of Columbia, each territory or possession of the
			 United States, and each federally recognized Indian tribe.</text>
			</paragraph></section><section id="H752756D87877446FB161FC2B2712E12F"><enum>3.</enum><header>Establishment of Commission</header>
			<subsection id="HCB3E18EB6B614A5AB439E2BBDF6DA973"><enum>(a)</enum><header>Establishment</header><text>There is established the Federal Realignment and Closure Commission (hereafter in this Act referred
			 to as the <quote>Commission</quote>).</text>
			</subsection><subsection id="HC651327ED797409BACE32939089D1441"><enum>(b)</enum><header>Membership</header>
				<paragraph commented="no" id="HA0E0D94D739F45F9B323C5097B873C17"><enum>(1)</enum><header>Number and appointment</header><text>The Commission shall be composed of 9 members, appointed by the President by and with the advice
			 and consent of the Senate as follows:</text>
					<subparagraph commented="no" id="H11989E78ADB8466B9B577BAD569ED275"><enum>(A)</enum><text display-inline="yes-display-inline">Two in consultation with the Speaker of the House of Representatives.</text>
					</subparagraph><subparagraph commented="no" id="H56F9D00D70294FD4ADEE9994234D1D4B"><enum>(B)</enum><text>One in consultation with the minority leader of the House of Representatives.</text>
					</subparagraph><subparagraph commented="no" id="HF71AD701AE9247178F849AA811D9C7C9"><enum>(C)</enum><text>Two in consultation with the majority leader of the Senate.</text>
					</subparagraph><subparagraph commented="no" id="H4A659441DEA74E52BBEE4035F123B909"><enum>(D)</enum><text>One in consultation with the minority leader of the Senate.</text>
					</subparagraph></paragraph><paragraph id="H00D5B1FD8ED64B76926BF1A75C53B192"><enum>(2)</enum><header>Member restriction</header><text>A member of the Commission may not be a sitting Member of Congress or a current employee of the
			 executive branch.</text>
				</paragraph><paragraph id="H8D4C3036A12649E7ABFDA2C7A6970A3F"><enum>(3)</enum><header>Chairman and vice chairman</header><text display-inline="yes-display-inline">At the time the President appoints individuals to the Commission under this paragraph, the
			 President shall designate 1 such individual who shall serve as chairman
			 and 1 such individual who shall serve as vice chairman. The chairman and
			 vice chairman may not be of the same political party.</text>
				</paragraph></subsection><subsection id="H3BB758E49CC945A6B0787BDC93480392"><enum>(c)</enum><header>Period of appointment; vacancies</header><text>Members shall be appointed for the life of the Commission. Any vacancy in the Commission shall not
			 affect its powers, but shall be filled in the same manner as the original
			 appointment.</text>
			</subsection><subsection id="HCADDF884DD1342D29332A73E8095A3EA"><enum>(d)</enum><header>Initial Meeting</header><text>Not later than 30 days after the date on which all members of the Commission have been appointed,
			 the Commission shall hold its first meeting.</text>
			</subsection><subsection id="H3924C545184748A7BB4CA3E184E65EF5"><enum>(e)</enum><header>Meetings</header><text>The Commission shall meet at the call of the chairman.</text>
			</subsection><subsection id="H178B7D757457459E80B6885D5477606E"><enum>(f)</enum><header>Quorum</header><text>A majority of the members of the Commission shall constitute a quorum, but a lesser number of
			 members may hold hearings.</text>
			</subsection></section><section id="HB4D97799DFAB4C8096AF2465B6FB7725"><enum>4.</enum><header>Duties of the Commission</header>
			<subsection id="H598F08F5E7204CADA123A0E1490FA988"><enum>(a)</enum><header>Systematic Assessment of Programs by the Commission</header>
				<paragraph id="H9D773A1A0A424017BC3F6568B8064160"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (4), not later than 180 days after the date of enactment of this
			 Act, the Commission shall establish a systematic method for assessing the
			 effectiveness and accountability of agency programs in accordance with
			 paragraph (2) and divide the programs into three approximately equal
			 budgetary groupings based on the size of the budget and number of
			 personnel of the agency program.</text>
				</paragraph><paragraph id="HBB3EA90BB16D4E8F9FEE5C7A3FAE7F09"><enum>(2)</enum><header>Method objectives</header><text>The method established under paragraph (1) shall—</text>
					<subparagraph id="HE28FE534B3274C5FA3E53B875F77DBBB"><enum>(A)</enum><text>recognize different types of Federal programs;</text>
					</subparagraph><subparagraph id="HB9A214218ABE47CFB9667F2B072356D2"><enum>(B)</enum><text>assess programs based on the achievement of performance goals (as defined under section 1115(h)(9)
			 of title 31, United States Code);</text>
					</subparagraph><subparagraph id="H91755FCB73774266BBEA17422531436D"><enum>(C)</enum><text>assess programs based in part on the adequacy of the program’s performance measures, financial
			 management, and other factors;</text>
					</subparagraph><subparagraph id="H8785A55E996C49C0B8A3E018FA534252"><enum>(D)</enum><text>assess programs based in part on whether the program has fulfilled the legislative intent
			 surrounding the creation of the program, taking into account any change in
			 legislative intent during the program’s existence; and</text>
					</subparagraph><subparagraph id="H07EB959A8126405596A799D5E9E747C7"><enum>(E)</enum><text>assess programs based in part on collaborative analysis, with the program or agency, of program
			 policy and goals which may not fit into easily measurable performance
			 goals.</text>
					</subparagraph></paragraph><paragraph id="H3A84339FE9704D52B9A9F07616718394"><enum>(3)</enum><header>Comptroller general recommendations</header><text>The Comptroller General of the United States shall—</text>
					<subparagraph id="HAC3BB67E7D1746E994E47FDBDDABE643"><enum>(A)</enum><text>assist the Commission, to the extent requested, in the Commission’s evaluation of agencies and
			 programs under subsection (b)(1); and</text>
					</subparagraph><subparagraph id="HED437F5EBC19440A9D8DBC7D7D1C762D"><enum>(B)</enum><text>by no later than March 30 of each year in which an evaluation is carried out under subsection
			 (b)(1), submit to the Commission a report containing the Comptroller
			 General’s recommendations for the agencies and programs that should be
			 realigned or eliminated within the grouping evaluated that year.</text>
					</subparagraph></paragraph><paragraph commented="no" id="HDB0C4480B40D406BB0235A9BF40616E6"><enum>(4)</enum><header>Department of Defense exemption</header><text display-inline="yes-display-inline">The Commission shall not consider Department of Defense programs.</text>
				</paragraph></subsection><subsection id="H23F2049093C94FE18891550BB0ABCD8B"><enum>(b)</enum><header>Evaluation, Plan, and Recommendations</header>
				<paragraph id="HDC5D47C91E9D4568A5C9CFEABF2EE689"><enum>(1)</enum><header>Evaluation</header><text>Subject to subsection (e), during each of 2015, 2017, and 2019 the Commission shall evaluate all
			 agencies, and programs within those agencies, in a grouping identified in
			 the assessment under subsection (a), with one grouping evaluated each year
			 over those three years, using the criteria under paragraph (3). In
			 carrying out the evaluation, the Commission shall consider the report of
			 the Comptroller General submitted under subsection (a)(3).</text>
				</paragraph><paragraph id="H5A6B1D46E6AE4530B3CE8E1552D7ACDD"><enum>(2)</enum><header>Plan and recommendations</header>
					<subparagraph id="H1659DAFF29034B9DB46F9487DEB6946D"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than June 30 of a year in which an evaluation is carried out under paragraph (1), the
			 Commission shall, with respect to the evaluation carried out during that
			 year, submit to the President and Congress a plan with recommendations of
			 the agencies and programs that should be realigned or eliminated within
			 the grouping evaluated that year.</text>
					</subparagraph><subparagraph id="H7384657E3EC241D0998DF30F5D9E46F1"><enum>(B)</enum><header>Implementation description required</header><text>The plan described in subparagraph (A) shall include a detailed description of the actions
			 necessary to implement the plan and complete the reorganization, including
			 a projected timetable for completion of the implementation process.</text>
					</subparagraph><subparagraph commented="no" id="H73BE8E97FB6640D6BE4D3D003D39B482"><enum>(C)</enum><header>Plan approval</header><text>The plan must be approved by at least 5 members of the Commission.</text>
					</subparagraph></paragraph><paragraph id="HBC60C0608F8848E59E1D03047D6A2BEF"><enum>(3)</enum><header>Criteria</header>
					<subparagraph id="H1A19FA40BA9341A2960D6276C315880D"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Commission shall evaluate the efficiency and public need for each agency using the following
			 criteria:</text>
						<clause id="H00FF40EB0BD5419280B8999318047F06"><enum>(i)</enum><text>The effectiveness, and the efficiency of the operation of, the programs carried out by each such
			 agency.</text>
						</clause><clause id="H4BC29A3BBA534E17AFDCD1653294C7BD"><enum>(ii)</enum><text>Whether the programs carried out by the agency are cost effective.</text>
						</clause><clause id="H59AFFFEE829E403EBBEB962A1B93724A"><enum>(iii)</enum><text>Whether the agency or program has acted outside the scope of its original authority, and whether
			 the original objectives of the agency have been achieved.</text>
						</clause><clause id="H5A6F601B06084752BFD8399224D6168E"><enum>(iv)</enum><text>The extent to which the jurisdiction of, and the programs administered by, the agency duplicate or
			 conflict with the jurisdiction and programs of other agencies.</text>
						</clause><clause id="H140E244CCA9A4EC69C4E69E9878885B6"><enum>(v)</enum><text>The potential benefits of consolidating programs administered by the agency with similar or
			 duplicative programs of other agencies, and the potential for
			 consolidating such programs.</text>
						</clause><clause commented="no" id="HED848FC44A3D4AFCAD13E8ED64FB5A99"><enum>(vi)</enum><text display-inline="yes-display-inline">The extent to which the agency has complied with the applicable provisions contained in sections
			 1115, 1116, 1120, 1121, 1123, and 1124 of title 31, United States Code,
			 and <external-xref legal-doc="usc" parsable-cite="usc/5/306">section 306</external-xref> of title 5, United States Code, as well as recommendations
			 contained in the reports required by such sections.</text>
						</clause><clause id="H641622D3125B4B11B116519687B6BE7E"><enum>(vii)</enum><text display-inline="yes-display-inline">The extent to which State and local governments already collect information or perform services
			 conducted by the Federal program or agency.</text>
						</clause></subparagraph><subparagraph id="H46A75AE3D3264ED38CD6EF7A6EBB11BA"><enum>(B)</enum><header>Duplicative</header><text>If 2 or more agencies or programs are performing the same essential function and the function can
			 be consolidated or streamlined into a single agency or program, the
			 Commission shall recommend that the agencies or programs be realigned.</text>
					</subparagraph><subparagraph commented="no" id="H8A823662E00C477592629B6E13C3A976"><enum>(C)</enum><header>Wasteful or inefficient</header><text>The Commission may recommend the realignment or elimination of any agency or program that has
			 wasted Federal funds by—</text>
						<clause commented="no" id="H7328522D39A94FC2972C84F37AE12BA9"><enum>(i)</enum><text display-inline="yes-display-inline">spending funds on items outside the authorized mission or purpose of the agency or program;</text>
						</clause><clause commented="no" id="H929FF5231716453E8563732FFF50E0FA"><enum>(ii)</enum><text>mismanagement of resources and personnel; or</text>
						</clause><clause commented="no" id="H9F95964B54274740BC3972FC92995CA6"><enum>(iii)</enum><text>use of such funds for personal benefit or the benefit of a special interest group.</text>
						</clause></subparagraph><subparagraph commented="no" id="H3ECB5B8D56F94CC4BDB9FC23A0517D12"><enum>(D)</enum><header>Outdated, irrelevant, or failed</header><text>The Commission shall recommend the elimination of any agency or program that—</text>
						<clause commented="no" id="H494EF4E161F84DBF89A8BD39C48BD11A"><enum>(i)</enum><text>has completed its intended purpose, if such purpose is defined under the law;</text>
						</clause><clause commented="no" id="H8D685EC4A323494AA5D31409BB18B991"><enum>(ii)</enum><text>has become irrelevant; or</text>
						</clause><clause commented="no" id="H0B3E04D2593F4BEDA206E8C5DD233095"><enum>(iii)</enum><text>has failed to meet its objectives.</text>
						</clause></subparagraph></paragraph><paragraph id="H712E9BE5685E4D238DD4A876466A6C5E"><enum>(4)</enum><header>Relocation of Federal employees</header><text>The plan under paragraph (2) shall provide that if the position of an employee of an agency is
			 eliminated as a result of the implementation of the plan, the affected
			 agency shall make reasonable efforts to relocate such employee to another
			 position within the agency or within another Federal agency.</text>
				</paragraph><paragraph id="H5554E0EF08084D4489B6C6A7EE2826C0"><enum>(5)</enum><header>Use of savings</header><text>All funds saved by the implementation of the plan shall be used for deficit reduction.</text>
				</paragraph><paragraph id="HCEC09509E77B4B828B5D47236F4E74A5"><enum>(6)</enum><header>Limitation on recommendations in plan</header><text>The plan under paragraph (2)—</text>
					<subparagraph id="H8B7420BF62AC4678899657BC91F8A924"><enum>(A)</enum><text>may not recommend the creation of a new agency, unless such agency is the result of a consolidation
			 of existing agencies, the result of such consolidation producing an
			 overall reduction in amounts provided in annual appropriations Acts and
			 the number of personnel;</text>
					</subparagraph><subparagraph commented="no" id="H95406EDDEBAA494085B5782B9B58CF03"><enum>(B)</enum><text>may recommend the removal of part of an agency from an agency; and</text>
					</subparagraph><subparagraph id="H4A1FFDC46E6D4C8FB2C2890D752BDEEB"><enum>(C)</enum><text>may not recommend—</text>
						<clause id="HF6BAE0B5B44A4D00A5557531AD93F30B"><enum>(i)</enum><text display-inline="yes-display-inline">continuing an agency beyond the period authorized by law for its existence or beyond the time when
			 it would have terminated if the realignment had not been made;</text>
						</clause><clause id="H47AC0E75A4064AD2A8335F5D8600EFE5"><enum>(ii)</enum><text display-inline="yes-display-inline">continuing a function beyond the period authorized by law for its exercise or beyond the time when
			 it would have terminated if the realignment had not been made;</text>
						</clause><clause id="H46A8619E22D544A78295FA13B02C0C10"><enum>(iii)</enum><text>authorizing an agency to exercise a function which is not expressly authorized by law at the time
			 the plan is transmitted to Congress;</text>
						</clause><clause id="HAD45D5B381054E6CAF69F56C46C4EBF5"><enum>(iv)</enum><text>increasing the term of an office beyond that provided by law for the office;</text>
						</clause><clause id="H4B20039DE969447F8875510AC78EF3C2"><enum>(v)</enum><text>the consolidation or realignment of any entity outside of the executive branch, including moving an
			 agency outside the executive branch; or</text>
						</clause><clause id="HF45C79884E1747DA91D6E57A7B58BA5C"><enum>(vi)</enum><text>the modification of any funding that is not an appropriation.</text>
						</clause></subparagraph></paragraph><paragraph id="H1EFB9CB8C701487ABE9C3DFF46A0C892"><enum>(7)</enum><header>Information to Members of Congress</header><text>After June 30 of each year in which the Commission submits a plan and recommendations to the
			 President and Congress under this subsection, the Commission shall
			 promptly provide, upon request, to any Member of Congress information used
			 by the Commission in making its recommendations.</text>
				</paragraph></subsection><subsection id="HA7642DED819B42D2855BD5432E9FA532"><enum>(c)</enum><header>Consideration of suggestions from public through website</header><text>In carrying out its duties under this Act, the Commission shall—</text>
				<paragraph id="H7365FC51A83C48788C6DCDAEFE3AEC5F"><enum>(1)</enum><text>establish a website for the purpose of allowing any member of the public to submit suggestions to
			 the Commission for its consideration; and</text>
				</paragraph><paragraph id="HC300348A909F4AC7838D4EF4E4A4B971"><enum>(2)</enum><text>consider each such suggestion submitted through the website.</text>
				</paragraph></subsection><subsection commented="no" id="H1E2FFDBEBDA84BACA97D234921DA391D"><enum>(d)</enum><header>Review by the President</header>
				<paragraph commented="no" id="HAE05239249A74874A915682906B675B7"><enum>(1)</enum><header>Evaluation required</header><text>The President shall, by no later than August 15 of a year in which the Commission carries out an
			 evaluation under subsection (b)(1), transmit to the Commission and to
			 Congress a report containing the President’s approval or disapproval of
			 the Commission’s plan and recommendations.</text>
				</paragraph><paragraph commented="no" id="H5317189805AB4DE180C9E688337DA80A"><enum>(2)</enum><header>Approval of plan</header><text display-inline="yes-display-inline">The President may approve the plan and recommendations of the Commission if the President finds
			 that the plan is in accordance with the criteria and limitation described
			 in paragraphs (3) and (6) of subsection (b), respectively. If the
			 President approves all the plan and recommendations of the Commission, the
			 President shall transmit a copy of such plan and recommendations to
			 Congress, together with a certification of such approval.</text>
				</paragraph><paragraph commented="no" id="H79B5E1791969406BA73834C76396FFD5"><enum>(3)</enum><header>Disapproval of plan</header><text>If the President disapproves the plan and recommendations of the Commission, in whole or in part,
			 the President shall transmit to the Commission and Congress the reasons
			 for that disapproval. The Commission shall then transmit to the President,
			 by no later than September 15 of the year in which the evaluation was
			 carried out, a revised list of recommendations for the closure or
			 realignment of agencies and programs.</text>
				</paragraph><paragraph commented="no" id="H0D84727B663B45C5A0E160FA638E0C51"><enum>(4)</enum><header>Approval of revised plan</header><text display-inline="yes-display-inline">If the President finds that the revised plan is in accordance with the criteria and limitation
			 described in paragraphs (3) and (6) of subsection (b), respectively, and
			 approves all of the revised plan and recommendations of the Commission
			 transmitted to the President under paragraph (3), the President shall
			 transmit a copy of such revised plan and recommendations to Congress,
			 together with a certification of such approval.</text>
				</paragraph><paragraph commented="no" id="H3E5E4836B31248BEB93DCDC58B72F784"><enum>(5)</enum><header>Termination of assessment</header><text>If the President does not transmit to Congress an approval and certification described in paragraph
			 (2) or (4) by October 15 of any year in which the Commission has
			 transmitted its plan and recommendations to the President under this
			 section, the process by which agencies and programs may be selected for
			 realignment or elimination under this Act with respect to that year shall
			 be terminated.</text>
				</paragraph></subsection><subsection id="H26CFD592D45345378CE983187088E5C7"><enum>(e)</enum><header>Carryforward of grouping and evaluation</header><text display-inline="yes-display-inline">If the process by which agencies and programs may be selected for realignment or elimination under
			 this Act with respect to a year is terminated under subsection (d)(5) if
			 the termination occurs in 2015 or 2017, the grouping of agencies and
			 programs evaluated that year shall be included in the grouping evaluated
			 under subsection (b)(1) in the next year an evaluation is conducted.</text>
			</subsection></section><section id="H3DC00DB27F3340DA9CA0851615248DBA"><enum>5.</enum><header>Powers of the Commission</header>
			<subsection id="HADE2B72F4A414AD0986DA2461D147345"><enum>(a)</enum><header>Hearings</header>
				<paragraph id="H2F94CBE7F91047F1AD69A367522C3473"><enum>(1)</enum><header>In general</header><text>The Commission or, at its direction, any subcommittee or member of the Commission, may, for the
			 purpose of carrying out this Act—</text>
					<subparagraph id="H03DEAD305AA04708BD36106BC9FFAD01"><enum>(A)</enum><text>hold such hearings, sit and act at such times and places, take such testimony, receive such
			 evidence, and administer such oaths as any member of the Commission
			 considers advisable;</text>
					</subparagraph><subparagraph id="H16DFE068820C4F738EEA18A4DA78E763"><enum>(B)</enum><text>require, by subpoena or otherwise, the attendance and testimony of such witnesses as any member of
			 the Commission considers advisable; and</text>
					</subparagraph><subparagraph id="H496F523080864E9F8E570F9810F88C6F"><enum>(C)</enum><text>require, by subpoena or otherwise, the production of such books, records, correspondence,
			 memoranda, papers, documents, tapes, and other evidentiary materials
			 relating to any matter under investigation by the Commission.</text>
					</subparagraph></paragraph><paragraph id="H1B67C33C2A474A6FBA4EBE9809BF4B00"><enum>(2)</enum><header>Testimony under oath</header><text>All testimony before the Commission shall be under oath.</text>
				</paragraph></subsection><subsection id="H524B88E02A834E94BF9D2BDCDF3DAF61"><enum>(b)</enum><header>Issuance and Enforcement of Subpoenas</header>
				<paragraph id="H50B553B73E6B4D5A990FB45C0251EE58"><enum>(1)</enum><header>Issuance</header><text>Subpoenas issued under subsection (a) shall bear the signature of the chairman of the Commission
			 and shall be served by any person or class of persons designated by the
			 chairman for that purpose.</text>
				</paragraph><paragraph id="HB19069A4F1F947238330C0427EDA5F32"><enum>(2)</enum><header>Enforcement</header><text>In the case of contumacy or failure to obey a subpoena issued under subsection (a), the United
			 States district court for the judicial district in which the subpoenaed
			 person resides, is served, or may be found, may issue an order requiring
			 such person to appear at any designated place to testify or to produce
			 documentary or other evidence. Any failure to obey the order of the court
			 may be punished by the court as a contempt of that court.</text>
				</paragraph></subsection><subsection id="H623BCD2CADA842BDAA3CBD06BCB96C2E"><enum>(c)</enum><header>Information From Federal Agencies</header><text>The Commission may secure directly from any Federal department or agency such information as the
			 Commission considers necessary to carry out this Act. Upon request of the
			 chairman of the Commission, the head of such department or agency shall
			 furnish such information to the Commission.</text>
			</subsection><subsection id="HBD0F84AF72804B8BB6B3DDEB40D9E551"><enum>(d)</enum><header>Postal Services</header><text>The Commission may use the United States mails in the same manner and under the same conditions as
			 other departments and agencies of the Federal Government.</text>
			</subsection></section><section id="H938CD3B492CF4C6FA366A90F15571DC5"><enum>6.</enum><header>Commission personnel matters</header>
			<subsection id="H6E6253D4EADE4E6096C42C531FE5A068"><enum>(a)</enum><header>Compensation of Members</header>
				<paragraph id="H8C6C711E1E7145F8992E465E57F6259C"><enum>(1)</enum><header>Non-federal members</header><text>Except as provided under subsection (b), each member of the Commission who is not an officer or
			 employee of the Federal Government shall not be compensated.</text>
				</paragraph><paragraph id="HA763B8E866F9470EB80793E28BBF5D84"><enum>(2)</enum><header>Federal employees</header><text>All members of the Commission who are employees of the United States shall serve without
			 compensation in addition to that received for their services as employees
			 of the United States.</text>
				</paragraph></subsection><subsection id="H9410C219E5684843BB01D6A8DDF1EF69"><enum>(b)</enum><header>Travel Expenses</header><text>The members of the Commission shall be allowed travel expenses, including per diem in lieu of
			 subsistence, at rates authorized for employees of agencies under
			 subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code, while away from
			 their homes or regular places of business in the performance of services
			 for the Commission.</text>
			</subsection><subsection id="H282A42245BEA4BFA94C44F5453130238"><enum>(c)</enum><header>Staff</header>
				<paragraph id="H2542E3CE84814C01B8236C68FB93005F"><enum>(1)</enum><header>In general</header><text>The chairman of the Commission may, without regard to the civil service laws and regulations,
			 appoint and terminate an executive director and such other additional
			 personnel as may be necessary to enable the Commission to perform its
			 duties. The employment of an executive director shall be subject to
			 confirmation by the Commission.</text>
				</paragraph><paragraph id="H4CDC0220A7F7458E9E42D7B031CB1D89"><enum>(2)</enum><header>Compensation</header><text>Upon the approval of the chairman, the executive director may fix the compensation of the executive
			 director and other personnel without regard to chapter 51 and subchapter
			 III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/53">chapter 53</external-xref> of title 5, United States Code, relating to
			 classification of positions and General Schedule pay rates, except that
			 the rate of pay for the executive director and other personnel may not
			 exceed the maximum rate payable for a position at GS–15 of the General
			 Schedule under section 5332 of such title.</text>
				</paragraph><paragraph id="HCBBE3CD937F94A239779E067388B0512"><enum>(3)</enum><header>Personnel as Federal employees</header>
					<subparagraph id="H3AE3449956204C6CA02612402E0E9E3C"><enum>(A)</enum><header>In general</header><text>The executive director and any personnel of the Commission who are employees shall be employees
			 under <external-xref legal-doc="usc" parsable-cite="usc/5/2105">section 2105</external-xref> of title 5, United States Code, for purposes of
			 chapters 63, 81, 83, 84, 85, 87, 89, and 90 of that title.</text>
					</subparagraph><subparagraph id="HBC2897638255425BB39AF6F24530F687"><enum>(B)</enum><header>Members of commission</header><text>Subparagraph (A) shall not be construed to apply to members of the Commission.</text>
					</subparagraph></paragraph></subsection><subsection id="HA1CD81CA356745FC80C6B52B6BCE1EAF"><enum>(d)</enum><header>Detail of Government Employees</header><text>Any Federal Government employee may be detailed to the Commission without reimbursement, and such
			 detail shall be without interruption or loss of civil service status or
			 privilege.</text>
			</subsection><subsection id="HB27260C0618246479BF61304F2D16258"><enum>(e)</enum><header>Security clearance</header><text display-inline="yes-display-inline">As a condition of appointment to or employment with the Commission, the members and staff of the
			 Commission shall hold appropriate security clearances for access to any
			 classified briefing, records, and materials that may be reviewed by the
			 Commission or its staff and shall follow the guidance and practices on
			 security under applicable Executive orders and agency directives.</text>
			</subsection><subsection commented="no" id="H9E82996CB2AA4503B561D6E84FB6CC04"><enum>(f)</enum><header>Library of Congress</header><text display-inline="yes-display-inline">Upon the request of the Commission, the Librarian of Congress shall provide to the Commission, on a
			 reimbursable basis, administrative support services, research services,
			 and research staff necessary for the Commission to carry out its
			 responsibilities under this Act.</text>
			</subsection><subsection id="H92C7A1BEF3CE4FBC8308A3CEEE35FA31"><enum>(g)</enum><header>Procurement of Temporary and Intermittent Services</header><text>The chairman of the Commission may procure temporary and intermittent services under section
			 3109(b) of title 5, United States Code, at rates for individuals which do
			 not exceed the daily equivalent of the annual rate of basic pay prescribed
			 for level V of the Executive Schedule under section 5316 of such title.</text>
			</subsection></section><section id="H45564A8378B5411592F2D54471238D46"><enum>7.</enum><header>Termination of the Commission</header><text display-inline="no-display-inline">The Commission shall terminate 120 days after the date on which the Commission submits the final
			 plan and recommendations under section 3(b).</text>
		</section><section id="H128843FBE4B240829A1DEC61B00CD9A9"><enum>8.</enum><header>Closure and realignment of agencies and programs</header>
			<subsection id="HA42A5155B28744268F4EBC1C5E3E7957"><enum>(a)</enum><header>In general</header><text>Subject to subsection (b), the President shall—</text>
				<paragraph id="HB9D5443A368A48439E6DA86D6E27C027"><enum>(1)</enum><text display-inline="yes-display-inline">eliminate all agencies and programs recommended for elimination by the Commission in each report
			 submitted to Congress by the President under section 4(d);</text>
				</paragraph><paragraph id="H9B78ED0E57904DF8AE06A2D084ED8B23"><enum>(2)</enum><text>realign all agencies and programs recommended for realignment by such Commission in each such
			 report;</text>
				</paragraph><paragraph id="HBD15DF3B86FC4192BA9536BFE7EA55C5"><enum>(3)</enum><text display-inline="yes-display-inline">initiate all such eliminations and realignments no later than 2 years after the date on which the
			 President submits a report to Congress under section 4(d) containing the
			 recommendations for such eliminations or realignments; and</text>
				</paragraph><paragraph id="HA8E0FC55B5AF4864B2AABA1571C50AC8"><enum>(4)</enum><text display-inline="yes-display-inline">complete all such eliminations and realignments no later than the end of the 6-year period
			 beginning on the date on which the President submits the report under
			 section 4(d) containing the recommendations for such closures or
			 realignments.</text>
				</paragraph></subsection><subsection id="HC845712C7F744997A589AAE282673D6C"><enum>(b)</enum><header>Congressional disapproval</header>
				<paragraph id="H9E9E9C84B9F847BDBDF13C06756EC61C"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The President may not carry out any elimination or realignment recommended in a report submitted by
			 the President under section 4(d) if a joint resolution is enacted, in
			 accordance with the provisions of section 9, disapproving such
			 recommendations before the earlier of—</text>
					<subparagraph id="H18A8A039ED344805A5C66D053413C010"><enum>(A)</enum><text>the end of the 45-day period beginning on the date on which the President submits such report; or</text>
					</subparagraph><subparagraph id="H7BE986CC46A540668BF2260B9E1F0127"><enum>(B)</enum><text>the adjournment of Congress sine die for the session during which such report is submitted.</text>
					</subparagraph></paragraph><paragraph id="HECAD9C47C63A4229989A8FE7D35A58C9"><enum>(2)</enum><header>Computation of days</header><text>For purposes of paragraph (1) of this subsection and subsections (a) and (c) of section 9, the days
			 on which either House of Congress is not in session because of adjournment
			 of more than 3 days to a day certain shall be excluded in the computation
			 of a period.</text>
				</paragraph></subsection></section><section display-inline="no-display-inline" id="HF886B15FD5B249AEB7645BC015D0FB87"><enum>9.</enum><header>Congressional consideration of commission recommendations</header>
			<subsection id="H43A3FA375A4443E08E8DCE5F5B505336"><enum>(a)</enum><header>Terms of the resolution</header><text display-inline="yes-display-inline">For purposes of section 8(b), the term <term>joint resolution</term> means only a joint resolution which is introduced within the 10-day period beginning on the date
			 on which the President submits the report to Congress under section 4(d),
			 and—</text>
				<paragraph id="H54F663B1C6434CD1931D2D3087E79B4C"><enum>(1)</enum><text>which does not have a preamble;</text>
				</paragraph><paragraph id="H92D590A188F8451CBDB8FCF557ABC70C"><enum>(2)</enum><text>the matter after the resolving clause of which is as follows: <quote>That Congress disapproves the recommendations of the Federal Realignment and Closure Commission as
			 submitted by the President on __________</quote>, the blank space being filled in with the appropriate date; and</text>
				</paragraph><paragraph id="H3A26BFD87EDB4B768A7550B8FABB5619"><enum>(3)</enum><text>the title of which is as follows: <quote>Joint resolution disapproving the recommendations of the Federal Realignment and Closure
			 Commission.</quote>.</text>
				</paragraph></subsection><subsection id="H0901E53DB7324424BF8B8A9F67B5B662"><enum>(b)</enum><header>Referral</header><text>A resolution described in subsection (a) that is introduced in the House of Representatives shall
			 be referred to the Committee on Oversight and Government Reform of the
			 House of Representatives. A resolution described in subsection (a)
			 introduced in the Senate shall be referred to the Committee on Homeland
			 Security and Governmental Affairs of the Senate.</text>
			</subsection><subsection id="H888D6502870E48C0B0D699CFDB4E38C5"><enum>(c)</enum><header>Discharge</header><text display-inline="yes-display-inline">If the committee to which a resolution described in subsection (a) is referred has not reported
			 such a resolution (or an identical resolution) by the end of the 20-day
			 period beginning on the date on which the President submits the report to
			 Congress under section 4(d), such committee shall be, at the end of such
			 period, discharged from further consideration of such resolution, and such
			 resolution shall be placed on the appropriate calendar of the House
			 involved.</text>
			</subsection><subsection id="HBF294F14395941289BBA7B9D861BFC61"><enum>(d)</enum><header>Consideration</header>
				<paragraph id="HF1B44A99B9E948EF9CF391D62615C417"><enum>(1)</enum><header>In general</header><text>On or after the third day after the date on which the committee to which such a resolution is
			 referred has reported, or has been discharged (under subsection (c)) from
			 further consideration of, such a resolution, it is in order (even though a
			 previous motion to the same effect has been disagreed to) for any Member
			 of the respective House to move to proceed to the consideration of the
			 resolution. A Member may make the motion only on the day after the
			 calendar day on which the Member announces to the House concerned the
			 Member’s intention to make the motion, except that, in the case of the
			 House of Representatives, the motion may be made without such prior
			 announcement if the motion is made by direction of the committee to which
			 the resolution was referred. The motion is highly privileged in the House
			 of Representatives and is privileged in the Senate and is not debatable.
			 The motion is not subject to amendment, or to a motion to postpone, or to
			 a motion to proceed to the consideration of other business. A motion to
			 reconsider the vote by which the motion is agreed to or disagreed to shall
			 not be in order. If a motion to proceed to the consideration of the
			 resolution is agreed to, the respective House shall immediately proceed to
			 consideration of the joint resolution without intervening motion, order,
			 or other business, and the resolution shall remain the unfinished business
			 of the respective House until disposed of.</text>
				</paragraph><paragraph id="HC07DDB93F7304C2784EB93CD2C1040DD"><enum>(2)</enum><header>Debate</header><text>Debate on the resolution, and on all debatable motions and appeals in connection therewith, shall
			 be limited to not more than 2 hours, which shall be divided equally
			 between those favoring and those opposing the resolution. An amendment to
			 the resolution is not in order. A motion further to limit debate is in
			 order and not debatable. A motion to postpone, or a motion to proceed to
			 the consideration of other business, or a motion to recommit the
			 resolution is not in order. A motion to reconsider the vote by which the
			 resolution is agreed to or disagreed to is not in order.</text>
				</paragraph><paragraph id="H0614163A8F3B48A193E7C0A1754A95AC"><enum>(3)</enum><header>Vote on final passage</header><text>Immediately following the conclusion of the debate on a resolution described in subsection (a) and
			 a single quorum call at the conclusion of the debate if requested in
			 accordance with the rules of the appropriate House, the vote on final
			 passage of the resolution shall occur.</text>
				</paragraph><paragraph id="HFC7F02B8409B4A60A37A347564576BE0"><enum>(4)</enum><header>Appeals on decisions by the Chair</header><text>Appeals from the decisions of the Chair relating to the application of the rules of the Senate or
			 the House of Representatives, as the case may be, to the procedure
			 relating to a resolution described in subsection (a) shall be decided
			 without debate.</text>
				</paragraph></subsection><subsection id="H38AE4714FA1E4299B102CDDEF51DFFCC"><enum>(e)</enum><header>Consideration by other House</header>
				<paragraph display-inline="no-display-inline" id="H0D70C5E284494E53BD57179BA3C2CC1F"><enum>(1)</enum><header>Disposition of resolution</header><text>If, before the passage by one House of a resolution of that House described in subsection (a), that
			 House receives from the other House a resolution described in subsection
			 (a), then the following procedures shall apply—</text>
					<subparagraph id="H4F36C41F61594C24A4E37243777115A6"><enum>(A)</enum><text>the resolution of the other House shall not be referred to a committee and may not be considered in
			 the House receiving it except in the case of final passage as provided in
			 subparagraph (B)(ii); and</text>
					</subparagraph><subparagraph id="HE9AEB86132984187A97F84E7AD0441B3"><enum>(B)</enum><text>with respect to a resolution described in subsection (a) of the House receiving the resolution (i)
			 the procedure in that House shall be the same as if no resolution had been
			 received from the other House; but (ii) the vote on final passage shall be
			 on the resolution of the other House.</text>
					</subparagraph></paragraph><paragraph id="HF2D89DC17AAD41F798F69B62EFCD41DD"><enum>(2)</enum><header>Not in order to consider other resolution</header><text>Upon disposition of the resolution received from the other House, it shall no longer be in order to
			 consider the resolution that originated in the receiving House.</text>
				</paragraph></subsection><subsection id="H991863EA44634C60A246EF7178785558"><enum>(f)</enum><header>Rules of the Senate and House</header><text>This section is enacted by Congress—</text>
				<paragraph id="H5D8F12B9C92F4B5BA541675F102B1950"><enum>(1)</enum><text>as an exercise of the rulemaking power of the Senate and House of Representatives, respectively,
			 and as such it is deemed a part of the rules of each House, respectively,
			 but applicable only with respect to the procedure to be followed in that
			 House in the case of a resolution described in subsection (a), and it
			 supersedes other rules only to the extent that it is inconsistent with
			 such rules; and</text>
				</paragraph><paragraph id="H89D266FEB01146EFBB732C421FC61B1E"><enum>(2)</enum><text>with full recognition of the constitutional right of either House to change the rules (so far as
			 relating to the procedure of that House) at any time, in the same manner,
			 and to the same extent as in the case of any other rule of that House.</text>
				</paragraph></subsection></section><section id="H63E63F113F5A45F683F7B33A01772AAB"><enum>10.</enum><header>Offsetting rescissions</header><text display-inline="no-display-inline">Of the unobligated balance of funds available for each of the following accounts, $3,000,000 is
			 rescinded from each such account:</text>
			<paragraph id="H65E676FF48ED4396BE72BA8ACD355383"><enum>(1)</enum><text display-inline="yes-display-inline"><quote>Department of Health and Human Services—Office of the Secretary—General Departmental Management</quote>.</text>
			</paragraph><paragraph id="HD4FD489E8D814544A39230F87503676D"><enum>(2)</enum><text><quote>Agricultural Programs—Departmental Administration</quote>.</text>
			</paragraph><paragraph id="H98CD47F173E34AB7B9B5EA24F325A7A7"><enum>(3)</enum><text><quote>Department of Education—Departmental Management—Program Administration</quote>.</text>
			</paragraph><paragraph id="H66D8CA06CFCB485FB620BCD65EA3F4B4"><enum>(4)</enum><text><quote>Department of Housing and Urban Development—Management and Administration—Administration,
			 Operations, and Management</quote>.</text>
			</paragraph><paragraph commented="no" id="H2DFF7B2FED4F4FAD9EC1A91EACA387B3"><enum>(5)</enum><text><quote>Department of the Interior—Departmental Offices—Office of the Secretary—Departmental Operations</quote>.</text>
