		<section id="H3887B09EC8744C77BAA315A832B89355" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>State’s Choice Act of 2014</short-title></quote>.</text>
		</section><section id="H2F1FB3F998744C0ABF71673CA3039F5E"><enum>2.</enum><header>State option to impose a carbon tax</header>
			<subsection id="HC630A95CDA2643D5AEE47F83FC66F55A"><enum>(a)</enum><header>Applicability</header><text display-inline="yes-display-inline">This section applies with respect to any regulation to address climate change issued by the
			 Administrator of the Environmental Protection Agency under section 111(d)
			 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7411">42 U.S.C. 7411(d)</external-xref>) for emissions of any greenhouse
			 gas from an existing stationary source.</text>
			</subsection><subsection id="H31270AA9FE654C84A7AFA629871D9711"><enum>(b)</enum><header>State option</header>
				<paragraph id="H78B81507C0DA427F94268706584657BE"><enum>(1)</enum><header>Option</header><text>Subject to paragraph (2), a regulation described in subsection (a) shall allow a State the option
			 to impose a carbon tax with respect to greenhouse gas emissions from an
			 existing stationary source instead of, or in conjunction with, applying a
			 standard of performance for such emissions from such existing stationary
			 source.</text>
				</paragraph><paragraph id="H7B7329139BB646569DDFD8D42FDAE807"><enum>(2)</enum><header>Reevaluation</header><text>The Administrator of the Environmental Protection Agency shall—</text>
					<subparagraph id="H190909BB5E9B43A6BF26B0F13B626566"><enum>(A)</enum><text>in 2025, conduct an evaluation of any carbon tax imposed by a State pursuant to this subsection to
			 determine whether such tax, together with any other relevant measures of
			 the State, will, by the end of 2030, achieve the greenhouse gas reduction
			 goals of the regulations described in subsection (a) which the tax is
			 intended to replace (in whole or in part); and</text>
					</subparagraph><subparagraph id="H31B70931FF2945B9AB952493A7D7F78C"><enum>(B)</enum><text>if the Administrator determines that the tax, together with any other relevant measures of the
			 State, will not achieve such goals, require the State to increase the tax
			 by the amount determined necessary by the Administrator to achieve such
			 goals.</text>
					</subparagraph></paragraph><paragraph id="HB70F281BBCAA48129B2D56991D45F314"><enum>(3)</enum><header>Limitation</header><text display-inline="yes-display-inline">The option described in paragraph (1) shall not be available to a State if the Administrator
			 determines that—</text>
					<subparagraph id="H65DA21E5FDF74C23942ACA02D5F8497E"><enum>(A)</enum><text>such State is materially undermining the effectiveness of the carbon tax in decreasing greenhouse
			 gas emissions through other policy changes; or</text>
					</subparagraph><subparagraph id="H80E0238B20A44B2B8C996306065E4E38"><enum>(B)</enum><text>the Administrator has required the State to increase its tax, as described in paragraph (2)(B), and
			 the State has not complied with such requirement.</text>
					</subparagraph></paragraph></subsection><subsection id="H734B9110B7E94674A7228CC6CF0572DC"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this Act:</text>
				<paragraph id="H1D2B72C008144934A4E7B691220670EB"><enum>(1)</enum><header>Carbon dioxide equivalent</header><text display-inline="yes-display-inline">The term <term>carbon dioxide equivalent</term> means, for each greenhouse gas, the quantity of greenhouse gas that the Administrator of the
			 Environmental Protection Agency determines makes the same contribution to
			 global warming as 1 metric ton of carbon dioxide.</text>
				</paragraph><paragraph id="H7A18F0B8F30E4827A43A895256A7B634"><enum>(2)</enum><header>Carbon tax</header><text>The term <term>carbon tax</term> means an excise tax—</text>
					<subparagraph id="H7808D5AB811949E3B1550F61DDE7CCCC"><enum>(A)</enum>
						<clause commented="no" display-inline="yes-display-inline" id="H21A5579022F848A3BA7AB5F8E8AF81FE"><enum>(i)</enum><text>on emissions of any greenhouse gas; or</text>
						</clause><clause id="HDDCFFB73339647A1A9CFC8947971BE97" indent="up1"><enum>(ii)</enum><text>on a fossil fuel based on emissions of any greenhouse gas that will result from the use of such
			 fossil fuel;</text>
						</clause></subparagraph><subparagraph id="H7FEBBD7ADEBF4F868651244FA9DF3E2F"><enum>(B)</enum><text display-inline="yes-display-inline">that in 2015, is not less than $20 per metric ton of carbon dioxide equivalent; and</text>
					</subparagraph><subparagraph id="H89BEF2DDC4D8463588AF3906B24A2EC7"><enum>(C)</enum><text display-inline="yes-display-inline">that in each subsequent year, increases by not less than 4 percent above inflation, as measured by
			 the Consumer Price Index for all urban consumers (all items; United States
			 city average).</text>
					</subparagraph></paragraph><paragraph id="HEE8564B60684430DA2A57528E6ABBD1B"><enum>(3)</enum><header>Existing stationary source</header><text>The term <term>existing stationary source</term> has the meaning given to the term <term>existing source</term> in section 111(a)(6) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7411">42 U.S.C. 7411(a)(6)</external-xref>).</text>
				</paragraph><paragraph id="H493F47652ED4408BBA40A52AE569011E"><enum>(4)</enum><header>Greenhouse gas</header><text>The term <term>greenhouse gas</term> means any of the following:</text>
					<subparagraph id="HACA0BCDB28B343978F1F0CFB124F3536"><enum>(A)</enum><text>Carbon dioxide.</text>
					</subparagraph><subparagraph id="HD1426C4962954854A96E8EECFCE1D721"><enum>(B)</enum><text>Methane.</text>
					</subparagraph><subparagraph id="HD3A62F81580343B28CF64521E081C141"><enum>(C)</enum><text>Nitrous oxide.</text>
					</subparagraph><subparagraph id="HABF4794DD2A84ADF9F852A1FF2D88F69"><enum>(D)</enum><text>Sulfur hexafluoride.</text>
					</subparagraph><subparagraph id="H4D2D3F56AD4F496AA15C8D62EA7211D8"><enum>(E)</enum><text>Hydrofluorocarbons.</text>
					</subparagraph><subparagraph id="H667440ED52B942D08C1A70F75FEBB1AE"><enum>(F)</enum><text>Perfluorocarbons.</text>
					</subparagraph></paragraph><paragraph id="H8076EF694A23417298615AF444FD6438"><enum>(5)</enum><header>Stationary source</header><text display-inline="yes-display-inline">The term <term>stationary source</term> has the meaning given such term in section 111(a)(3) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7411">42 U.S.C. 7411(a)(3)</external-xref>).</text>
