<official-title>To authorize the Director of the National Institutes of Health to design and enter into agreements for the implementation of prize competitions with the goal of improving health outcomes and thereby reducing Federal expenditures.</official-title>

<section id="H2B065AB9F538487E8C5A07D5B526E44F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Health Prizes Rewarding Innovation, Savings, and Effectiveness Act of 2014</short-title></quote>. </text></section> 
<section id="H80CFBAE8A9BE44709BFC34458EDCCF29"><enum>2.</enum><header>Prize competitions</header> 
<subsection id="HF68DFE4637D445AB90297D88188D0252"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Part B of title IV of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/284">42 U.S.C. 284 et seq.</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="HEF5AEA3F4DD84F2BA75E930826F31847" display-inline="no-display-inline"> 
<section id="H4906EA9924B64E54B0A47BF070B6B25C"><enum>409K.</enum><header>Prize competitions for improving health outcomes and reducing Federal expenditures</header> 
<subsection id="H819D7C1C81414CE7A00D782FF866F22E"><enum>(a)</enum><header>Goals</header><text>The goal of the prize competitions under this section is to improve health outcomes, thereby reducing Federal expenditures on health programs.</text></subsection> 
<subsection id="H28B2AB199342480C800E6E4F19851675"><enum>(b)</enum><header>Initial actions</header> 
<paragraph id="H9DEDD6AA54144CFA9668BB6921900A06"><enum>(1)</enum><header>Identification of diseases and conditions</header><text display-inline="yes-display-inline">Not later than 6 months after the date of enactment of the <short-title>Health Prizes Rewarding Innovation, Savings, and Effectiveness Act of 2014</short-title>, the Director of NIH, in consultation with the Director of the Congressional Budget Office, the Administrator for the Centers for Medicare &amp; Medicaid Services, and relevant health economists, shall identify 3 to 5 human diseases or health conditions with respect to which—</text> 
<subparagraph id="H08461E8A24294C8FA0699EFBEB1AB5D7"><enum>(A)</enum><text>the Federal Government, for such diseases and conditions, collectively spends a total of not less than $5,000,000,000 per year on prevention and treatment activities;</text></subparagraph> 
<subparagraph id="HD16D86015B5D459BA6803EB5E6620349"><enum>(B)</enum><text>public and private investment in research is disproportionately small in comparison with such investment for other human diseases and conditions for which the Federal Government has similar or greater expenditures on prevention and treatment activities; and</text></subparagraph> 
<subparagraph id="HA005AC4298754DFF819A6EB9EFF83248"><enum>(C)</enum><text display-inline="yes-display-inline">the prize competitions under this section would be appropriate for achieving the goal described in subsection (a).</text></subparagraph> </paragraph> 
<paragraph id="H3A8A9E4CDF2349B395D1E482909383AB"><enum>(2)</enum><header>Design of prize competitions</header><text>Not later than 12 months after the date of enactment of the <short-title>Health Prizes Rewarding Innovation, Savings, and Effectiveness Act of 2014</short-title>, the Director of NIH shall—</text> 
<subparagraph id="H73361B15DA014EC98DBB3119BE2E98C3"><enum>(A)</enum><text>design prize competitions—</text> 
<clause id="H32CE8FA00EC34816BDE80824A0746A25"><enum>(i)</enum><text>to cooperate with competitors to realize innovations to achieve the goal described in subsection (a) with respect to one or more diseases or conditions identified pursuant to subsection (b); and</text></clause> 
<clause id="H53C8B3610302412D97000B0FB97DEEA2" commented="no"><enum>(ii)</enum><text>to award one or more prizes—</text> 
<subclause id="H46E7DB12AED243B38C72F477A0FED636" commented="no"><enum>(I)</enum><text>if appropriate, at the beginning of or during the competitions, to the competitors whose innovations are most promising or demonstrate progress; and</text></subclause> 
<subclause id="HC3C1DC6270044147B2AEBFB014D28C4B" commented="no"><enum>(II)</enum><text>at the end of the competitions, to the competitors whose innovations prove to be the best solutions;</text></subclause></clause></subparagraph> 
<subparagraph id="HCD576A69B15D4B29BEA2343ED04A41AD"><enum>(B)</enum><text>ensure that the design of such competitions—</text> 
<clause id="HEC92B98C0CD6422699C7D5CD3610D321"><enum>(i)</enum><text display-inline="yes-display-inline">is realistic, given the amount of funds to be awarded as prizes;</text></clause> 
<clause id="HDD550054B1BC44A8B8804DE248340A43"><enum>(ii)</enum><text>does not reflect any bias concerning the type of innovations which will prove to be the best solutions;</text></clause> 
<clause id="H32D1AFFB64EA4743B7389B64844CF729"><enum>(iii)</enum><text>allows any person to participate as a competitor without regard to the person’s place of incorporation, primary place of business, citizenship, and residency, as applicable; and</text></clause> 
<clause id="H4A3879A923DA4EE6AA0AC1BF6BB2275B" commented="no"><enum>(iv)</enum><text display-inline="yes-display-inline">addresses areas of unmet need with regard to a lack of recent and pending innovations; and</text> </clause></subparagraph> 
<subparagraph id="HFBFE1577FAF344FB948C63A57E2B5659"><enum>(C)</enum><text>submit to the Congress a report on the design of such competitions.</text></subparagraph></paragraph> 
<paragraph id="H18F90235AD784F1ABFDDF83563D17680"><enum>(3)</enum><header>Consultation</header><text>In carrying out paragraphs (1) and (2), the Director of NIH shall consult with—</text> 
<subparagraph id="HF9D860A29DE84FC8AF4EEF63EA7D3A8F"><enum>(A)</enum><text>medical, economic, budgetary, innovation, and venture capital experts; and</text></subparagraph> 
<subparagraph id="H1A4CB8B9F5194038BADE330FB9882662"><enum>(B)</enum><text>the heads of relevant Federal agencies, including the Commissioner of Food and Drugs, the Director of the National Science Foundation, and the Administrator of the Small Business Administration. </text> </subparagraph></paragraph> </subsection> 
<subsection id="H6F8E77EA51554077B9CB30B39E3481A6"><enum>(c)</enum><header>Simulation</header><text>The Director of NIH shall—</text> 
<paragraph id="H63B7AE6EDDB14B9F81F3AB9D50A866A2"><enum>(1)</enum><text display-inline="yes-display-inline">not later than 14 months after the date of enactment of the <short-title>Health Prizes Rewarding Innovation, Savings, and Effectiveness Act of 2014</short-title>, award one or more contracts—</text> 
<subparagraph id="HD57217D9D2664B148ADD631B6B74A6E0"><enum>(A)</enum><text>to perform a simulation of the prize competitions to be conducted under this section, based on the designs developed under subsection (b)(2) and in consultation with the categories of experts and agency heads described in subsection (b)(3); and</text></subparagraph> 
<subparagraph id="HA310829DF89D47D0949119614F62BC91"><enum>(B)</enum><text>to use the simulation to assess the effectiveness of the design; and</text></subparagraph></paragraph> 
<paragraph id="H7A4EE71101E249EB924905764F3F2491"><enum>(2)</enum><text>not later than 4 months after awarding such one or more contracts, submit to the Congress a report on the results of the simulation and assessment.</text></paragraph></subsection> 
<subsection id="H4D99CFBB578B49F3BCDC49A72B8CACA3"><enum>(d)</enum><header>Adjustments to design</header><text>Not later than 21 months after the date of enactment of the <short-title>Health Prizes Rewarding Innovation, Savings, and Effectiveness Act of 2014</short-title>, the Director of NIH shall—</text> 
<paragraph id="HCA0C8F8E532F43589834037C0E727EF1"><enum>(1)</enum><text>taking into consideration the results of the simulation under subsection (c), and subject to the requirements of subparagraphs (A) and (B) of subsection (b)(2), make such adjustments to the design of the prize competitions under this section as the Director determines appropriate; and</text></paragraph> 
<paragraph id="HDBFEFD2A3A8E4ECDAFD39C14838A8816"><enum>(2)</enum><text>submit to the Congress a report on any such adjustments.</text></paragraph></subsection> 
<subsection id="HAD5CFC3BE8344228A9508A10559951A0"><enum>(e)</enum><header>Implementation of prize competitions</header> 
<paragraph id="H5C2A893AA567475FB69BA1FE4A4AC7E8"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Director of NIH shall enter into an agreement with one or more private entities to implement prize competitions based on the designs developed under subsection (b)(2), as adjusted under subsection (d).</text></paragraph> 
<paragraph id="H767690D419744A56BB279934FD0BE607"><enum>(2)</enum><header>Duration</header><text>The prize competitions under paragraph (1) shall require competitors to demonstrate the effectiveness of their innovations over a period of not more than 5 years.</text></paragraph> 
<paragraph id="HDBDC88B5F5BE4977A17C486FA0CFD7E2"><enum>(3)</enum><header>Guidance and access to testing facilities</header><text>The Secretary and the Commissioner of Food and Drugs may cooperate with qualified competitors in the prize competitions under paragraph (1) by providing guidance and access to testing facilities.</text></paragraph> 
<paragraph id="H0C20C149918948F985D94A1CD0CB1A37"><enum>(4)</enum><header>Number of Prize Competitions</header><text display-inline="yes-display-inline">The Director shall conduct—</text> 
<subparagraph id="H2282760E61664B2C9C6E7BFD9D36F816"><enum>(A)</enum><text>a total of not more than 5 prize competitions under this section; and</text></subparagraph> 
<subparagraph id="HFCF2EBF1E9CC46D299E6618B2D8C0313"><enum>(B)</enum><text>not more than 2 such prize competitions with respect to any disease or condition.</text></subparagraph></paragraph> </subsection> 
<subsection id="H7120336275F349B0B3222F464CEAA344"><enum>(f)</enum><header>Tracking; reporting</header><text>The Director of NIH shall—</text> 
<paragraph id="H968BBFDEF28E4EBFBDF2F9B840D20071"><enum>(1)</enum><text>collect information on—</text> 
<subparagraph id="H26B030DFF87144FEA83CCFDEFC0F637E"><enum>(A)</enum><text>the medical efficacy of innovations funded through the prize competitions under subsection (e); and</text></subparagraph> 
<subparagraph id="HAAD0AA0AC3E54FF4988319C2F094F7EE"><enum>(B)</enum><text>the actual and potential effect of the innovations on Federal expenditures; and</text></subparagraph></paragraph> 
<paragraph id="H7AEE068F77D1417C85E801132856AC5D"><enum>(2)</enum><text>not later than one year after the conclusion of the prize competitions under subsection (e), and not later than the end of each of the 4 succeeding years, submit to the Congress a report on the information collected under paragraph (1).</text></paragraph></subsection> 
<subsection id="HAE45098AD796454EBEAD3F4A2D0673D0"><enum>(g)</enum><header>Intellectual property</header> 
<paragraph id="H429D821DB6BE45DE8E9D3789CD9DC487"><enum>(1)</enum><header>Prohibition on the government acquiring intellectual property rights</header><text>The Federal Government may not gain an interest in intellectual property developed by a participant in a prize competition under subsection (e) without the written consent of the participant.</text></paragraph> 
<paragraph id="H914F7CB54844487AAA5748B7CC084372"><enum>(2)</enum><header>Licenses</header><text>The Federal Government may negotiate a license for the use of intellectual property developed by a participant in a prize competition under subsection (e).</text></paragraph></subsection> 
<subsection id="HAAE7EF0A05DF4E67A89F32C30331218C"><enum>(h)</enum><header>Authorization of appropriations</header> 
<paragraph id="H972138CF18FB48CCB610B3D36EDA1DD1"><enum>(1)</enum><header>In general</header><text>To carry out this section, in lieu of amounts authorized to be appropriated by section 402A, there are authorized to be appropriated $50,000,000. </text></paragraph> 
<paragraph id="HCB567A4BB1C9487E86354A8812EBAC69"><enum>(2)</enum><header>Minimum percentage for prizes</header><text display-inline="yes-display-inline">Of the total assistance awarded to private entities under subsection (e) (including in-kind contributions and testing or other technical support) to implement any prize competition under this section—</text> 
<subparagraph id="H3344CE5BD6BD46FEB599E8213EE169E3"><enum>(A)</enum><text>not more than 30 percent of such assistance shall be for administration of the prize competition; and</text></subparagraph> 
<subparagraph id="H9F41AFE299C6456386A94065FA69B9D9"><enum>(B)</enum><text>not less than 70 percent of such assistance shall be awarded as prizes to competitors in the prize competition.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H7556F93DDD16467B8F6622BDED6952F4"><enum>(b)</enum><header>Prizes excluded from gross income of recipients</header> 
<paragraph id="H9DD5C24575A6486784AE3D34C77940EB"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/74">Section 74</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new subsection:</text> 
<quoted-block style="OLC" id="HEF4ACD5B14574C12B20E2D03572A86F3" display-inline="no-display-inline"> 
<subsection id="H23102E52AD0047748580B70F798B35C7"><enum>(d)</enum><header>Certain prizes for improving health outcomes</header><text display-inline="yes-display-inline">Gross income shall not include the value of any prize received by the taxpayer pursuant to a prize competition under section 409K of the Public Health Service Act (as in effect immediately after the enactment of this subsection).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H69719243033547B9915B8E15EFA86A41"><enum>(2)</enum><header>Effective date</header><text>The amendment made by this subsection shall apply to taxable years ending after the date of the enactment of this Act.</text></paragraph></subsection></section>
