			<section id="H59C2ABF4BDDC4F36AC836F5465139AD4"><enum>101.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">Funds are authorized to be appropriated for fiscal year 2015 for necessary expenses of the Coast
			 Guard as follows:</text>
				<paragraph id="H0B1F2C2303E24AA292DB203908E67D37"><enum>(1)</enum><text>For the operation and maintenance of the Coast Guard, $6,981,036,000.</text>
				</paragraph><paragraph id="HEE012509C1DA4837915C169F14731A8E"><enum>(2)</enum><text display-inline="yes-display-inline">For the acquisition, construction, rebuilding, and improvement of aids to navigation, shore and
			 offshore facilities, vessels, and aircraft, including equipment related
			 thereto, $1,546,448,000, to remain available until expended.</text>
				</paragraph><paragraph id="H36C9A9BF5C1A4AE89E72669ED9A3A47D"><enum>(3)</enum><text>For the Coast Guard Reserve program, including personnel and training costs, equipment, and
			 services, $140,016,000.</text>
				</paragraph><paragraph id="H6807A384130743E9B9024FC4D4A071B9"><enum>(4)</enum><text>For environmental compliance and restoration of Coast Guard vessels, aircraft, and facilities
			 (other than parts and equipment associated with operation and
			 maintenance), $16,701,000, to remain available until expended.</text>
				</paragraph><paragraph id="H2EE662A717564EC3823C6366B64CECC6"><enum>(5)</enum><text display-inline="yes-display-inline">To the Commandant of the Coast Guard for research, development, test, and evaluation of
			 technologies, materials, and human factors directly related to improving
			 the performance of the Coast Guard's mission with respect to search and
			 rescue, aids to navigation, marine safety, marine environmental
			 protection, enforcement of laws and treaties, ice operations,
			 oceanographic research, and defense readiness, $19,890,000.</text>
				</paragraph><paragraph id="HA872C42640BD44BA94C2A0CD7B30668F"><enum>(6)</enum><text display-inline="yes-display-inline">For alteration or removal of bridges over navigable waters of the United States constituting
			 obstructions to navigation, and for personnel and administrative costs
			 associated with the Alteration of Bridges Program, $16,000,000.</text>
				</paragraph></section><section id="HC26B1FF6AB2649F89A326235863E52D2"><enum>102.</enum><header>Authorized levels of military strength and training</header>
				<subsection id="H6EDFE6C124AB48DEB96234DE104ACEFC"><enum>(a)</enum><header>Active duty strength</header><text display-inline="yes-display-inline">The Coast Guard is authorized an end-of-year strength for active duty personnel of 43,000 for
			 fiscal year 2015.</text>
				</subsection><subsection id="H9518001831F849FD981DD7C545623DBC"><enum>(b)</enum><header>Military training student loads</header><text display-inline="yes-display-inline">The Coast Guard is authorized average military training student loads for fiscal year 2015 as
			 follows:</text>
					<paragraph id="H8717BC576FB54032896B685F5E316581"><enum>(1)</enum><text>For recruit and special training, 2,500 student years.</text>
					</paragraph><paragraph id="H22F2A65DAE5E47CFB1C0873620394678"><enum>(2)</enum><text>For flight training, 165 student years.</text>
					</paragraph><paragraph id="HDE752C58E4CA47A39581002843D493AA"><enum>(3)</enum><text>For professional training in military and civilian institutions, 350 student years.</text>
					</paragraph><paragraph id="HD3DD7A3D41D84729B55F07545972102C"><enum>(4)</enum><text>For officer acquisition, 1,200 student years.</text>
					</paragraph></subsection></section></title><title id="H4DF0FAA7A8894C729DADC53B4568E672"><enum>II</enum><header>Coast Guard</header>
			<section id="H6DBCA18627854455A84C0707940C3F0D" section-type="subsequent-section"><enum>201.</enum><header>Commissioned officers</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/14/42">Section 42(a)</external-xref> of title 14, United States Code, is amended by striking <quote>7,200</quote> and inserting <quote>6,900</quote>.</text>
			</section><section id="HB8341D279ED4460CADFA3CEBC896EE5F"><enum>202.</enum><header>Commandant; appointment</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/14/44">Section 44</external-xref> of title 14, United States Code, is amended by inserting after the first sentence the
			 following: <quote>The term of an appointment, and any reappointment, shall begin on June 1 of the appropriate year
			 and end on May 31 of the appropriate year, except that, in the event of
			 death, retirement, resignation, or reassignment, or when the needs of the
			 Service demand, the Secretary may alter the date on which a term begins or
			 ends if the alteration does not result in the term exceeding a period of 4
			 years.</quote>.</text>
			</section><section id="H4A75C4BCBF9A49A691A1049F2ED66400"><enum>203.</enum><header>Prevention and response workforces</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/14/57">Section 57</external-xref> of title 14, United States Code, is amended—</text>
				<paragraph id="HD0D31F74957A4287BC93A171CA917FBB"><enum>(1)</enum><text>in subsection (b)—</text>
					<subparagraph id="HB9540B8E82664234922CB156A10BD3D8"><enum>(A)</enum><text>in paragraph (2) by striking <quote>or</quote> at the end;</text>
					</subparagraph><subparagraph id="H90D879D8AE1D4834B478427BAB7E7221"><enum>(B)</enum><text>in paragraph (3) by striking the period at the end and inserting a semicolon; and</text>
					</subparagraph><subparagraph id="H0A1F996E77E5428390FFAB688F1B8DB9"><enum>(C)</enum><text>by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H59988E7939424850888F3C3FAA489AC5" style="USC">
							<paragraph id="H0170FCF52440465B8280C8438E439467"><enum>(4)</enum><text display-inline="yes-display-inline">waterways operations manager shall have knowledge, skill, and practical experience with respect to
			 marine transportation system management; or</text>
							</paragraph><paragraph id="HAAC07AEE17B440309716BEACC68D62C6"><enum>(5)</enum><text>port and facility safety and security specialist shall have knowledge, skill, and practical
			 experience with respect to the safety, security, and environmental
			 protection responsibilities associated with maritime ports and facilities.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HB664A5CD29F94D6E9AD3127CD41EF791"><enum>(2)</enum><text>in subsection (c) by striking <quote>or marine safety engineer</quote> and inserting <quote>marine safety engineer, waterways operations manager, or port and facility safety and security
			 specialist</quote>; and</text>
				</paragraph><paragraph id="H6F155ED6DD944C6C9FE9F36B3EC29F3C"><enum>(3)</enum><text>in subsection (f)(2) by striking <quote>investigator or marine safety engineer.</quote> and inserting <quote>investigator, marine safety engineer, waterways operations manager, or port and facility safety and
			 security specialist.</quote>.</text>
				</paragraph></section><section id="HF830774906BA4A55B9C3442249FE9FBF" section-type="subsequent-section"><enum>204.</enum><header>Centers of expertise</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/14/58">Section 58(b)</external-xref> of title 14, United States Code, is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H5AEACEBD04294812840490A6E5F167C1" style="USC">
					<subsection id="H33AB08CACB904A64A85D53072E6DA78E"><enum>(b)</enum><header>Missions</header><text display-inline="yes-display-inline">Any center established under subsection (a) shall—</text>
						<paragraph id="HB2A778EA5A2645A392CDD268D2C171A3"><enum>(1)</enum><text>promote, facilitate, and conduct—</text>
							<subparagraph id="H0AD01B8972624EA3978F755A28A3615A"><enum>(A)</enum><text>education;</text>
							</subparagraph><subparagraph id="H06960CC4977E4A92866CA27874128FCF"><enum>(B)</enum><text>training; and</text>
							</subparagraph><subparagraph id="HC32CDDC15437439E8BB96811EB5E55EB"><enum>(C)</enum><text>activities authorized under section 93(a)(4);</text>
							</subparagraph></paragraph><paragraph id="H996C6A7D7AB941FAB8F4B16711B69913"><enum>(2)</enum><text>be a repository of information on operations, practices, and resources related to the mission for
			 which the center was established; and</text>

			 navigable for purposes of the jurisdiction of the Coast Guard, the
			 Commandant shall provide notification regarding the proposed determination
			 to—</text>
								<paragraph id="H5FC9F8BEE30A4FD0999B412194708CA7"><enum>(1)</enum><text>the Governor of each State in which such waterway, or portion thereof, is located;</text>
								</paragraph><paragraph id="HAED808C521DF45528BD7D34564AD9FDE"><enum>(2)</enum><text>the public; and</text>
								</paragraph><paragraph id="HB41DD66ECACC40149D2888D38FF45ADC"><enum>(3)</enum><text>the Committee on Commerce, Science, and Transportation of the Senate and the Committee on
			 Transportation and Infrastructure of the House of Representatives.</text>
								</paragraph></subsection><subsection id="H59C3E00F8F0A4D4385EA7836DDB3718C"><enum>(b)</enum><header>Content requirement</header><text display-inline="yes-display-inline">Each notification provided under subsection (a) to an entity specified in paragraph (3) of that
			 subsection shall include—</text>
								<paragraph id="HB9B89E635D844B5F8272BBE5CED44DD0"><enum>(1)</enum><text>an analysis of whether vessels operating on the waterway, or portion thereof, subject to the
			 proposed determination are subject to inspection or similar regulation by
			 State or local officials;</text>
								</paragraph><paragraph id="H3C17A10F9E044184AA406C3688EA7A93"><enum>(2)</enum><text display-inline="yes-display-inline">an analysis of whether operators of commercial vessels on such waterway, or portion thereof, are
			 subject to licensing or similar regulation by State or local officials;
			 and</text>
								</paragraph><paragraph id="H6190072831624D80ACDB93E9824182D6"><enum>(3)</enum><text>an estimate of the annual costs that the Coast Guard may incur in conducting operations on such
			 waterway, or portion thereof.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

			 a member of the Board for 3 years, except that any such member whose term
			 of office has expired shall continue to serve until a successor is
			 appointed.</text>
								</subparagraph></paragraph><paragraph id="HAC4BBB54EB8F4684B8AFDF26D8DB6907"><enum>(3)</enum><header>Death or resignation of a member</header><text display-inline="yes-display-inline">If a member of the Board dies or resigns, a successor shall be designated for any unexpired portion
			 of the term of the member by the official who designated the member.</text>
							</paragraph></subsection><subsection id="H830E7DDC96D94DB38EBED220E8F4AB6E"><enum>(c)</enum><header>Academy visits</header>
							<paragraph id="H1CBC4FE2B82B4A69844C69BB00D9EDD4"><enum>(1)</enum><header>Annual visit</header><text>The Board shall visit the Academy annually to review the operation of the Academy.</text>
							</paragraph><paragraph id="H16419412740A4A7D810876B790F72B74"><enum>(2)</enum><header>Additional visits</header><text>With the approval of the Secretary, the Board or individual members of the Board may make other
			 visits to the Academy in connection with the duties of the Board or to
			 consult with the Superintendent of the Academy.</text>
							</paragraph></subsection><subsection id="HD87E623626D7448AB12A15A944C4E4D1"><enum>(d)</enum><header>Scope of review</header><text display-inline="yes-display-inline">The Board shall review, with respect to the Academy—</text>
							<paragraph id="H5136774747454326AB1D2A4019513B34"><enum>(1)</enum><text>the state of morale and discipline;</text>
							</paragraph><paragraph id="H6C2CDDA5DC4E4A7E923201A4779DBBCE"><enum>(2)</enum><text>the curriculum;</text>
							</paragraph><paragraph id="H14FE3581281D4667AC29EB2804BA0C56"><enum>(3)</enum><text>instruction;</text>
							</paragraph><paragraph id="H2DAFADD960664EF4B0E85E7D13D23366"><enum>(4)</enum><text>physical equipment;</text>
							</paragraph><paragraph id="H5CBA34F1754F48C68F9B1C555EA0F0B1"><enum>(5)</enum><text>fiscal affairs; and</text>
							</paragraph><paragraph id="HBF8A0B1F3E0C44F486AF97CC1BAA09B3"><enum>(6)</enum><text>other matters relating to the Academy that the Board determines appropriate.</text>
							</paragraph></subsection><subsection id="HB0607698ABD24CBF898719F720E86DA2"><enum>(e)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 60 days after the date of an annual visit of the Board under subsection (c)(1), the
			 Board shall submit to the Secretary, the Committee on Commerce, Science,
			 and Transportation of the Senate, and the Committee on Transportation and
			 Infrastructure of the House of Representatives a report on the actions of
			 the Board during such visit and the recommendations of the Board
			 pertaining to the Academy.</text>
						</subsection><subsection id="H6C81F1EFF0BD428095873BADD2C81BE9"><enum>(f)</enum><header>Advisors</header><text display-inline="yes-display-inline">If approved by the Secretary, the Board may consult with advisors in carrying out this section.</text>
						</subsection><subsection id="H527F44ACE0B54004B21DC8763DECAF2E"><enum>(g)</enum><header>Reimbursement</header><text display-inline="yes-display-inline">Each member of the Board and each adviser consulted by the Board under subsection (f) shall be

							<subchapter id="H569115061B984D919E4854225607FFA8"><enum>I</enum><header>General provisions</header>
								<section id="H2C2882A9DEEF4D9C8AF6B0DF18A7BC83"><enum>531.</enum><header>Work-life policies and programs</header><text display-inline="no-display-inline">The Commandant is authorized—</text>
									<paragraph id="H0C644D098E4747569E02984EDA7EEF27"><enum>(1)</enum><text>to establish an office for the purpose of developing, promulgating, and coordinating policies,
			 programs, and activities related to the families of Coast Guard members;</text>
									</paragraph><paragraph id="H85446E0D53E74BD79B53B2477C246453"><enum>(2)</enum><text>to implement and oversee policies, programs, and activities described in paragraph (1) as the
			 Commandant considers necessary; and</text>
									</paragraph><paragraph id="H24E7CF5D225D4B58B36CD29A5E494513"><enum>(3)</enum><text>to perform such other duties as the Commandant considers necessary.</text>
									</paragraph></section><section id="HAB2C3521D4464A8BA61A50D2397F6CC7"><enum>532.</enum><header>Surveys of Coast Guard families</header>
									<subsection id="H373398F30F9F46B5B2CDBF934883F951"><enum>(a)</enum><header>Authority</header><text display-inline="yes-display-inline">The Commandant, in order to determine the effectiveness of Federal policies, programs, and
			 activities related to the families of Coast Guard members, may survey—</text>
										<paragraph id="H5CB712A0185A457DB838B48584018F95"><enum>(1)</enum><text>any Coast Guard member;</text>
										</paragraph><paragraph id="H68A45C8153DC4A05B3D6ABF0D5093E73"><enum>(2)</enum><text>any retired Coast Guard member;</text>
										</paragraph><paragraph id="HD3512721A9A54D50AC89825B9E0E9D69"><enum>(3)</enum><text>the immediate family of any Coast Guard member or retired Coast Guard member; and</text>
										</paragraph><paragraph id="H9C6052C22FD5437FBDE44966757918FA"><enum>(4)</enum><text>any survivor of a deceased Coast Guard member.</text>
										</paragraph></subsection><subsection id="HD329427CE4354AE28C85AC7C4B8C49E0"><enum>(b)</enum><header>Voluntary participation</header><text display-inline="yes-display-inline">Participation in any survey conducted under subsection (a) shall be voluntary.</text>
									</subsection><subsection id="H7B098B509C354E7F92370A072E5AA0BB"><enum>(c)</enum><header>Federal recordkeeping</header><text display-inline="yes-display-inline">Each person surveyed under subsection (a) shall be considered an employee of the United States for
			 purposes of <external-xref legal-doc="usc" parsable-cite="usc/44/3502">section 3502(3)(A)(i)</external-xref> of title 44.</text>
									</subsection></section></subchapter><subchapter id="H97B3EFF693664F30900F1A7E1B177DA3"><enum>II</enum><header>Coast Guard family support</header>
								<section id="H0107C045A56E429F9D54482859E9A9F3"><enum>542.</enum><header>Education and training opportunities for Coast Guard spouses</header>
									<subsection id="H4042AB3A5ABB498F988A1FA0CA09D07B"><enum>(a)</enum><header>Tuition assistance</header><text display-inline="yes-display-inline">The Commandant may provide, subject to the availability of appropriations, tuition assistance to an
			 eligible spouse to facilitate the acquisition of—</text>
										<paragraph id="H7C4DE6E85E014261869544F89E67F0EC"><enum>(1)</enum><text>education and training required for a degree or credential at an accredited college, university, or
			 technical school in the United States that expands employment and portable
			 career opportunities for the spouse; or</text>
										</paragraph><paragraph id="H27CB027C7B704618A6E332D2847D59CA"><enum>(2)</enum><text>education prerequisites and a professional license or credential required, by a government or
			 government-sanctioned licensing body, for an occupation that expands
			 employment and portable career opportunities for the spouse.</text>
										</paragraph></subsection><subsection id="H00C4D47B556741699EA822D091780A6E"><enum>(b)</enum><header>Definitions</header><text>In this section, the following definitions apply:</text>
										<paragraph id="H98254241E7AF4CA1AD41CA55A77BA90B"><enum>(1)</enum><header>Eligible spouse</header>
											<subparagraph id="H2DAA569290DD4C74845B8E9C101DAA4C"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>eligible spouse</term> means the spouse of a member of the Coast Guard who is serving on active duty and includes a
			 spouse who receives transitional compensation under section 1059 of title
			 10.</text>
											</subparagraph><subparagraph id="HA216B1B0C0B245AABABE6A3B56C0C5B1"><enum>(B)</enum><header>Exclusion</header><text display-inline="yes-display-inline">The term <term>eligible spouse</term> does not include a person who—</text>
												<clause id="HD5059A83B76545FE9B38E09BD64D1659"><enum>(i)</enum><text>is married to, but legally separated from, a member of the Coast Guard under a court order or
			 statute of any State or territorial possession of the United States; or</text>
												</clause><clause id="H93BA8E8F2C964E5FBDCF1199C93D598E"><enum>(ii)</enum><text>is eligible for tuition assistance as a member of the Armed Forces.</text>
												</clause></subparagraph></paragraph><paragraph id="H3B308B9684CF43BF9C08063195606B7A"><enum>(2)</enum><header>Portable career</header><text display-inline="yes-display-inline">The term <term>portable career</term> includes an occupation that requires education, training, or both that results in a credential
			 that is recognized by an industry, profession, or specific type of
			 business.</text>
										</paragraph></subsection></section><section id="HA48C1657D7E04AD682C35E2D719FCF20"><enum>543.</enum><header>Youth sponsorship initiatives</header>
									<subsection id="HE8C16006E7B54347B099B017A7EAF950"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Commandant is authorized to establish, within any Coast Guard unit, an initiative to help
			 integrate into new surroundings the dependent children of members of the
			 Coast Guard who received permanent change of station orders.</text>
									</subsection><subsection id="HC737E7D775B940E78BD642651DB7F136"><enum>(b)</enum><header>Description of initiative</header><text display-inline="yes-display-inline">An initiative established under subsection (a) shall—</text>
										<paragraph id="H18CE88384F614E25A6C92FB6EC46519C"><enum>(1)</enum><text>provide for the involvement of a dependent child of a member of the Coast Guard in the dependent
			 child’s new Coast Guard community; and</text>
										</paragraph><paragraph id="HEF4D62A6E13A482FB32162DA64333B25"><enum>(2)</enum><text>primarily focus on preteen and teenaged children.</text>
										</paragraph></subsection><subsection id="H0ECB2717EE624AAD91243F9795539694"><enum>(c)</enum><header>Authority</header><text display-inline="yes-display-inline">In carrying out an initiative under subsection (a), the Commandant may—</text>
										<paragraph id="H6ED9A0B5CC8A4EB08D47B6EA732003D8"><enum>(1)</enum><text display-inline="yes-display-inline">provide to a dependent child of a member of the Coast Guard information on youth programs and
			 activities available in the dependent child’s new Coast Guard community;
			 and</text>
										</paragraph><paragraph id="HA0CC4C11BEBB4FA2A0809BFADF5F66B4"><enum>(2)</enum><text>enter into agreements with nonprofit entities to provide youth programs and activities to such
			 child.</text>
										</paragraph></subsection></section></subchapter><subchapter id="HA859DEBF84C14628A9559CA4E12CF4EA"><enum>III</enum><header>Coast Guard child care</header>
								<section id="H83BD20C510794DE68668AF5ED10F241B"><enum>551.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subchapter, the following definitions apply:</text>
									<paragraph id="HEF3777B573814A7A8E3A896BB7451422"><enum>(1)</enum><header>Child abuse and neglect</header><text>The term <term>child abuse and neglect</term> has the meaning given that term in section 3 of the Child Abuse Prevention and Treatment Act (42
			 U.S.C. 5101 note).</text>
									</paragraph><paragraph id="HA5743F15D4284F2FAB60FC7B8A043697"><enum>(2)</enum><header>Child development center employee</header><text display-inline="yes-display-inline">The term <term>child development center employee</term> means a civilian employee of the Coast Guard who is employed to work in a Coast Guard child
			 development center without regard to whether the employee is paid from
			 appropriated or nonappropriated funds.</text>
									</paragraph><paragraph id="HE5086A539AFF4F0F9B2DF30B8C1348AB"><enum>(3)</enum><header>Coast Guard child development center</header><text display-inline="yes-display-inline">The term <term>Coast Guard child development center</term> means a facility on Coast Guard property or on property under the jurisdiction of the commander of
			 a Coast Guard unit at which child care services are provided for members
			 of the Coast Guard.</text>
									</paragraph><paragraph id="HFF5F75D49FA34FDDA01BEBCE647D95CD"><enum>(4)</enum><header>Competitive service position</header><text display-inline="yes-display-inline">The term <term>competitive service position</term> means a position in the competitive service (as defined in <external-xref legal-doc="usc" parsable-cite="usc/5/2102">section 2102</external-xref> of title 5).</text>
									</paragraph><paragraph id="H5ED2184E19D946BCA18B95D825E8ECAF"><enum>(5)</enum><header>Family home daycare</header><text display-inline="yes-display-inline">The term <term>family home daycare</term> means home-based child care services provided for a member of the Coast Guard by an individual
			 who—</text>
										<subparagraph id="H355F1427E14946AAAABE8F4DDCCF3CDF"><enum>(A)</enum><text>is certified by the Commandant as qualified to provide home-based child care services; and</text>
										</subparagraph><subparagraph id="H708B413B0DF447F7AF4FA04EE722BCC3"><enum>(B)</enum><text>provides home-based child care services on a regular basis in exchange for monetary compensation.</text>
										</subparagraph></paragraph></section><section id="H6F8AC15E59554B559A5D00B9BDB6C8B4"><enum>553.</enum><header>Child development center standards and inspections</header>
									<subsection id="H76384247EF484470B787CC0BDEC178CA"><enum>(a)</enum><header>Standards</header><text display-inline="yes-display-inline">The Commandant shall require each Coast Guard child development center to meet standards that the
			 Commandant considers appropriate to ensure the health, safety, and welfare
			 of the children and employees at the center.</text>
									</subsection><subsection id="H3065DC290410441FAC52EBD7D1C6064A"><enum>(b)</enum><header>Inspections</header><text display-inline="yes-display-inline">The Commandant shall provide for regular and unannounced inspections of each Coast Guard child
			 development center to ensure compliance with this section.</text>
									</subsection><subsection id="HA60787B52CFB4740A31D82169DE5AEBB"><enum>(c)</enum><header>National reporting</header>
										<paragraph id="H69D511B5381E4836AAE3752484B9C412"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Commandant shall maintain and publicize a means by which an individual can report, with respect
			 to a Coast Guard child development center or a family home daycare—</text>
											<subparagraph id="H9FA1DC32185C49F8964225CDCC763C0D"><enum>(A)</enum><text>any suspected violation of—</text>
												<clause id="H2F40929F5CF74525AC8BB145CE95863F"><enum>(i)</enum><text>standards established under subsection (a); or</text>
												</clause><clause id="H0D1EA6F0B332479D81C5CBA445B97FA8"><enum>(ii)</enum><text>any other applicable law or standard;</text>
												</clause></subparagraph><subparagraph id="H052120386FAE49538092835BEFD8F741"><enum>(B)</enum><text>suspected child abuse or neglect; or</text>
											</subparagraph><subparagraph id="H1CAA4B835C3642EBB14C2CB4F3AB6EA6"><enum>(C)</enum><text>any other deficiency.</text>
											</subparagraph></paragraph><paragraph id="H8956F6A780424AA1B88E1799E8D43036"><enum>(2)</enum><header>Anonymous reporting</header><text display-inline="yes-display-inline">The Commandant shall ensure that an individual making a report pursuant to paragraph (1) may do so
			 anonymously if so desired by the individual.</text>
										</paragraph><paragraph id="HC02B3CF0AA0D4850B3E4C90EEF48C58E"><enum>(3)</enum><header>Procedures</header><text display-inline="yes-display-inline">The Commandant shall establish procedures for investigating reports made pursuant to paragraph (1).</text>
										</paragraph></subsection></section><section id="H159AB840704943868AD4631637BA8C19"><enum>554.</enum><header>Child development center employees</header>
									<subsection id="HF9675C3A9497488F94285F52E2DBB114"><enum>(a)</enum><header>Training</header>
										<paragraph id="HE5DFD21689A643A8A2DFA6D619E9FD99"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Commandant shall establish a training program for Coast Guard child development center
			 employees and satisfactory completion of the training program shall be a
			 condition of employment for each employee of a Coast Guard child
			 development center.</text>
										</paragraph><paragraph id="H564FA289EFF54CFEB0D320F25A93DD01"><enum>(2)</enum><header>Timing for new hires</header><text>The Commandant shall require each employee of a Coast Guard child development center to complete
			 the training program established under paragraph (1) not later than 6
			 months after the date on which the employee is hired.</text>
										</paragraph><paragraph id="H5D131DA08FA74EBF8A5CD432D13016B0"><enum>(3)</enum><header>Minimum requirements</header><text display-inline="yes-display-inline">The training program established under paragraph (1) shall include, at a minimum, instruction with
			 respect to—</text>
											<subparagraph id="HA2EE1EF7F0D94EB58AFCCA604D51A6FC"><enum>(A)</enum><text>early childhood development;</text>
											</subparagraph><subparagraph id="HC741A22A60B84F61A3F4F444D2931DFA"><enum>(B)</enum><text>activities and disciplinary techniques appropriate to children of different ages;</text>
											</subparagraph><subparagraph id="HB7E8685A3B424E09924EF417E46266B7"><enum>(C)</enum><text>child abuse and neglect prevention and detection; and</text>
											</subparagraph><subparagraph id="HEA75FC14D0A243379109145E4E9D688B"><enum>(D)</enum><text>cardiopulmonary resuscitation and other emergency medical procedures.</text>
											</subparagraph></paragraph><paragraph id="H17F7E0C58C7444B0A73D72E840EE2836"><enum>(4)</enum><header>Use of Department of Defense programs</header><text display-inline="yes-display-inline">The Commandant may use Department of Defense training programs, on a reimbursable or
			 nonreimbursable basis, for purposes of this subsection.</text>
										</paragraph></subsection><subsection id="H3C928431A6764603B82F717F0331D3F4"><enum>(b)</enum><header>Training and curriculum specialists</header>
										<paragraph id="H56B9812461A34004BFCF2133079B0182"><enum>(1)</enum><header>Specialist required</header><text display-inline="yes-display-inline">The Commandant shall require that at least 1 employee at each Coast Guard child development center
			 be a specialist in training and curriculum development with appropriate
			 credentials and experience.</text>
										</paragraph><paragraph id="H1164D3305DAA44A0A9058B8893DD4405"><enum>(2)</enum><header>Duties</header><text display-inline="yes-display-inline">The duties of the specialist described in paragraph (1) shall include—</text>
											<subparagraph id="HBA8B0A7D5E584796BD1C362C0FE1C4F7"><enum>(A)</enum><text>special teaching activities;</text>
											</subparagraph><subparagraph id="H725B2158B6F4421CA8756274EE399F5A"><enum>(B)</enum><text>daily oversight and instruction of other child care employees;</text>
											</subparagraph><subparagraph id="H82A0144F589A4A5DABE87C7D28AB745B"><enum>(C)</enum><text>daily assistance in the preparation of lesson plans;</text>
											</subparagraph><subparagraph id="H24D5ABEEEF7E4C28A5D55E2406FE680A"><enum>(D)</enum><text>assisting with child abuse and neglect prevention and detection; and</text>
											</subparagraph><subparagraph id="HC759A220B67D4157A85510DE35053DD0"><enum>(E)</enum><text>advising the director of the center on the performance of the other child care employees.</text>
											</subparagraph></paragraph><paragraph id="HFC1D2C6C58044CD4A70B8D542131F911"><enum>(3)</enum><header>Competitive service</header><text display-inline="yes-display-inline">Each specialist described in paragraph (1) shall be an employee in a competitive service position.</text>
										</paragraph></subsection></section><section id="H34B1679FFF8F41A6A0D7FF187BCF38B3"><enum>555.</enum><header>Parent partnerships with child development centers</header>
									<subsection id="H0F25EC9F95AC4742990D3D97A2EA3946"><enum>(a)</enum><header>Parent boards</header>
										<paragraph id="HE614D3D0A80242F2A34332D6B2B926CC"><enum>(1)</enum><header>Formation</header><text display-inline="yes-display-inline">The Commandant shall require that there be formed at each Coast Guard child development center a
			 board of parents, to be composed of parents of children attending the
			 center.</text>
										</paragraph><paragraph id="H05FEE63CAB47460D966FC1DF56E58072"><enum>(2)</enum><header>Functions</header><text display-inline="yes-display-inline">Each board of parents formed under paragraph (1) shall—</text>
											<subparagraph id="H9FDFF65CB2C24F81A7DCDF223584A1D2"><enum>(A)</enum><text display-inline="yes-display-inline">meet periodically with the staff of the center at which the board is formed and the commander of
			 the unit served by the center, for the purpose of discussing problems and
			 concerns; and</text>
											</subparagraph><subparagraph id="H86638FB486D24E3C9166C8CCCB839DB7"><enum>(B)</enum><text>be responsible, together with the staff of the center, for coordinating any parent participation
			 initiative established under subsection (b).</text>
											</subparagraph></paragraph><paragraph id="H5B1C8E8FC8FB49A696F62097737C0E32"><enum>(3)</enum><header>FACA</header><text display-inline="yes-display-inline">The Federal Advisory Committee Act (5 U.S.C. App.) does not apply to a board of parents formed
			 under paragraph (1).</text>
										</paragraph></subsection><subsection id="H2D3D32755D0145B68BF558B2E804A12A"><enum>(b)</enum><header>Parent participation initiative</header><text display-inline="yes-display-inline">The Commandant is authorized to establish a parent participation initiative at each Coast Guard
			 child development center to encourage and facilitate parent participation
			 in educational and related activities at the center.</text></subsection></section></subchapter></chapter><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H118F0B23788A44A5B44951036EECEE89"><enum>(b)</enum><header>Transfer of provisions</header>
					<paragraph id="HD90812055C274DA09918C91DDCC4D470"><enum>(1)</enum><header>In general</header>
						<subparagraph id="H766AA755FE2140968911068A878023AF"><enum>(A)</enum><header>Reimbursement for adoption expenses</header><text><external-xref legal-doc="usc" parsable-cite="usc/14/514">Section 514</external-xref> of title 14, United States Code, is redesignated as section 541 and transferred to
			 appear before section 542 of such title, as added by subsection (a) of
			 this section.</text>

					</paragraph><paragraph id="HC520D812CAF8471B8027C536FF692D7C"><enum>(2)</enum><header>Child development center fee receipts defined</header><text display-inline="yes-display-inline">In this subsection, the term <term>child development center fee receipts</term> means fees paid by members of the Coast Guard for child care services provided at Coast Guard
			 child development centers.</text>

				<subsection id="HAC19134806F244FC986E83F88C3AB550"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/14/569">Section 569</external-xref> of title 14, United States Code, is amended to read as follows:</text>

							<subsection id="H1DA81FF0168F48CA8A27534634CD4C93"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">On the date on which the President submits to Congress a budget for fiscal year 2016 under section
			 1105 of title 31, on the date on which the President submits to Congress a
			 budget for fiscal year 2019 under such section, and every 4 years
			 thereafter, the Commandant shall submit to the Committee on Transportation
			 and Infrastructure of the House of Representatives and the Committee on
			 Commerce, Science, and Transportation of the Senate an integrated major

								<paragraph id="H0DEBCB7807744EF6AFF17070E3F78822"><enum>(1)</enum><header>Integrated major acquisition mission need statement</header><text display-inline="yes-display-inline">The term <term>integrated major acquisition mission need statement</term> means a document that—</text>
									<subparagraph id="H0957933E711C414899B014D181AFD70D"><enum>(A)</enum><text>identifies current and projected gaps in Coast Guard mission capabilities using mission hour
			 targets;</text>
									</subparagraph><subparagraph id="HA0E04A6B04314F37ABCF815332DB3D36"><enum>(B)</enum><text>explains how each major acquisition program addresses gaps identified under subparagraph (A) if
			 funded at the levels provided for such program in the most recently
			 submitted capital investment plan; and</text>
									</subparagraph><subparagraph id="H69C11468A5B34170AF2F5A442AE46750"><enum>(C)</enum><text>describes the missions the Coast Guard will not be able to achieve, by fiscal year, for each gap
			 identified under subparagraph (A).</text>
									</subparagraph></paragraph><paragraph id="H9F0AB4B9C86842EEBB1A120BC71B10C0"><enum>(2)</enum><header>Major acquisition program</header><text>The term <term>major acquisition program</term> has the meaning given that term in section 569a(e).</text>

								<paragraph id="H52E4CE8B2CA84195834E0398B5298D27"><enum>(1)</enum><text display-inline="yes-display-inline">recommends end strengths for personnel for that fiscal year, as described in section 661;</text>
								</paragraph><paragraph id="H92A1E1F810AD45AFBEBD07CD8A6EDBE3"><enum>(2)</enum><text>recommends authorizations of appropriations for that fiscal year, including with respect to matters
			 described in section 662; and</text>
								</paragraph><paragraph id="H79D9BD94DA914F0693F980729A84AFFF"><enum>(3)</enum><text>addresses any other matter that the Secretary determines is appropriate for inclusion in a Coast

			 property, including submerged lands, under the control of the Coast Guard,
			 which shall include—</text>
								<paragraph id="H384B7BF3D7C14C5B8F7520A7AD034EC0"><enum>(1)</enum><text display-inline="yes-display-inline">the size, the location, and any other appropriate description of each unit of such property;</text>
								</paragraph><paragraph id="H03B636ACB15B485DA964B6000CD87A46"><enum>(2)</enum><text display-inline="yes-display-inline">an assessment of the physical condition of each unit of such property, excluding lands;</text>
								</paragraph><paragraph id="H9081EDCF90DA4863970B3F45A37CE4C1"><enum>(3)</enum><text>a determination of whether each unit of such property should be—</text>
									<subparagraph id="H679A4AA479114178A5E1E96BE62299E6"><enum>(A)</enum><text>retained to fulfill a current or projected Coast Guard mission requirement; or</text>
									</subparagraph><subparagraph id="HDC71D1EC041B4B59AB3F1D680CDE15E6"><enum>(B)</enum><text>subject to divestiture; and</text>
									</subparagraph></paragraph><paragraph id="HB4B59D0039FD4A3D95730705738659AE"><enum>(4)</enum><text>other information the Commandant considers appropriate.</text>
								</paragraph></subsection><subsection id="H894571B9D15C4E64B71D44150D29287E"><enum>(b)</enum><header>Inventory maintenance</header><text>The Commandant shall—</text>
								<paragraph id="H88084BC206CF40A1AF030B6A793B596D"><enum>(1)</enum><text>maintain the inventory required under subsection (a) on an ongoing basis; and</text>
								</paragraph><paragraph id="HB4B6EC0060DB47309471609F95EBB75B"><enum>(2)</enum><text>update information on each unit of real property included in such inventory not later than 30 days
			 after any change relating to the control of such property.</text>
								</paragraph></subsection><subsection id="HD4B495D6A3214AA9BCE628849408C050"><enum>(c)</enum><header>Recommendations to Congress</header><text>Not later than March 30, 2016, and every 5 years thereafter, the Commandant shall submit to the
			 Committee on Transportation and Infrastructure of the House of
			 Representatives and the Committee on Commerce, Science, and Transportation
			 of the Senate a report that includes—</text>
								<paragraph id="H96DA3E1BA3B84685B14368F054A01404"><enum>(1)</enum><text>a list of all real property under the control of the Coast Guard and the location of such property
			 by property type;</text>
								</paragraph><paragraph id="H4A3D1AE8C08446638EFD4A1E10E8D43A"><enum>(2)</enum><text>recommendations for divestiture with respect to any units of such property; and</text>
								</paragraph><paragraph id="H2BEBAEBF2BF847FC99CD889FA25BAA42"><enum>(3)</enum><text>recommendations for consolidating any units of such property, including—</text>
									<subparagraph id="H4FF46F2EB0B649A09E3C1FAECDD35C34"><enum>(A)</enum><text>an estimate of the costs or savings associated with each recommended consolidation; and</text>
									</subparagraph><subparagraph id="H1C1318E005BD4181B27926F8C6D9687F"><enum>(B)</enum><text>a discussion of the impact that such consolidation would have on Coast Guard mission effectiveness.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H2FF2AE544E354994A6A625CCFAB5EC7D"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for such chapter, as amended by this Act, is further amended by adding at the end the

			 by adding at the end the following: “No report shall be required under
			 this subsection, including that no report shall be required under section

					</paragraph></subsection></section><section id="H8DF7368485C44F408CB225D9C76855DF"><enum>222.</enum><header>Technical corrections to title 14</header><text display-inline="no-display-inline">Title 14, United States Code, as amended by this Act, is further amended—</text>
				<paragraph id="H055712F3F5EC4B4A9ACC8B46D070091C"><enum>(1)</enum><text>in section 93(b)(1) by striking <quote>Notwithstanding subsection (a)(14)</quote> and inserting <quote>Notwithstanding subsection (a)(13)</quote>; and</text>
				</paragraph><paragraph id="H9AC310FC0AA148DFBD9909E02A50473A"><enum>(2)</enum><text>in section 197(b) by striking <quote>of Homeland Security</quote>.</text>
				</paragraph></section><section id="HA0D69043ECBF4262939CD6AEF2720890"><enum>223.</enum><header>Multiyear procurement authority for Offshore Patrol Cutters</header><text display-inline="no-display-inline">In fiscal year 2015 and each fiscal year thereafter, the Secretary of the department in which the
			 Coast Guard is operating may enter into, in accordance with section 2306b
			 of title 10, United States Code, multiyear contracts for the procurement
			 of Offshore Patrol Cutters and associated equipment.</text>
			</section><section id="HB4044D325C2A424DA82FE0DDF14B29C3" section-type="subsequent-section"><enum>224.</enum><header>Maintaining Medium Endurance Cutter mission capability</header><text display-inline="no-display-inline">Not later than 120 days after the date of enactment of this Act, the Secretary of the department in
			 which the Coast Guard is operating shall submit to the Committee on
			 Transportation and Infrastructure of the House of Representatives and the
			 Committee on Commerce, Science, and Transportation of the Senate a report
			 that includes—</text>
				<paragraph id="H9A39B1F2FF3547B29472BAD5FBA85761"><enum>(1)</enum><text display-inline="yes-display-inline">a schedule and plan for decommissioning, not later than September 30, 2029, each of the 210-foot,
			 Reliance-Class Cutters operated by the Coast Guard on the date of
			 enactment of this Act;</text>
				</paragraph><paragraph id="HA1D6190CFE764B42A01CD8B256D89DB7"><enum>(2)</enum><text display-inline="yes-display-inline">a schedule and plan for enhancing the maintenance or extending the service life of each of the
			 270-foot, Famous-Class Cutters operated by the Coast Guard on the date of
			 enactment of this Act—</text>
					<subparagraph id="H8F2DCC5050B846B2903310A6EE8803C3"><enum>(A)</enum><text>to maintain the capability of the Coast Guard to carry out sea-going missions with respect to such
			 Cutters at the level of capability existing on September 30, 2013; and</text>
					</subparagraph><subparagraph id="H6DC0E87450284D63B85B304818BFDCF3"><enum>(B)</enum><text>for the period beginning on the date of enactment of this Act and ending on the date on which the
			 final Offshore Patrol Cutter is scheduled to be commissioned under
			 paragraph (4);</text>
					</subparagraph></paragraph><paragraph id="HDDA550DBBF51421DA1915F1FC110019C"><enum>(3)</enum><text display-inline="yes-display-inline">an identification of the number of Offshore Patrol Cutters capable of sea state 5 operations that,
			 if 8 National Security Cutters are commissioned, are necessary to return
			 the sea state 5 operating capability of the Coast Guard to the level of
			 capability that existed prior to the decommissioning of the first High
			 Endurance Cutter in fiscal year 2011;</text>
				</paragraph><paragraph id="H8A6E304ACE084CA1910897D2E27FAA42"><enum>(4)</enum><text display-inline="yes-display-inline">a schedule and plan for commissioning the number of Offshore Patrol Cutters identified under
			 paragraph (3); and</text>
				</paragraph><paragraph id="H5A00EF206E014C5088485BFA8251862B"><enum>(5)</enum><text display-inline="yes-display-inline">a schedule and plan for commissioning, not later than September 30, 2034, a number of Offshore
			 Patrol Cutters not capable of sea state 5 operations that is equal to—</text>
					<subparagraph commented="no" id="H027EEBC97E244EA29FB91000A9BB476D"><enum>(A)</enum><text>25; less</text>
					</subparagraph><subparagraph id="H6F9DFE3858324A799A704BB1FE614D40"><enum>(B)</enum><text>the number of Offshore Patrol Cutters identified under paragraph (3).</text>
					</subparagraph></paragraph></section><section id="H2A7F969444E04969B6C34386C842CBF4"><enum>225.</enum><header>Aviation capability in the Great Lakes region</header><text display-inline="no-display-inline">The Secretary of the department in which the Coast Guard is operating may—</text>
				<paragraph id="H8614644F6AB144C9A2FB36EB72619F97"><enum>(1)</enum><text>request and accept through a direct military-to-military transfer under <external-xref legal-doc="usc" parsable-cite="usc/10/2571">section 2571</external-xref> of title 10,
			 United States Code, such H–60 helicopters as may be necessary to establish
			 a year-round operational capability in the Coast Guard’s Ninth District;
			 and</text>
				</paragraph><paragraph id="HA18993BACEA445AEBDC6EF846D8F73EF"><enum>(2)</enum><text>use funds provided under section 101 of this Act to convert such helicopters to Coast Guard MH–60T
			 configuration.</text>
				</paragraph></section><section id="H2F1B3ECFC83349B5883BC83E6D59426C"><enum>226.</enum><header>Gaps in writings on Coast Guard history</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, the Commandant of the Coast Guard
			 shall submit to the Committee on Commerce, Science, and Transportation of
			 the Senate and the Committee on Transportation and Infrastructure of the
			 House of Representatives a report on any gaps that exist in writings on
			 the history of the Coast Guard. The report shall address, at a minimum,
			 operations, broad topics, and biographies with respect to the Coast Guard.</text>
			</section><section id="H24D2AC8850EC4A4CA207AACA5FD1A682"><enum>227.</enum><header>Officer evaluation reports</header>
				<subsection id="H48EB8DB37715457D830FDED4CE4AFEB0"><enum>(a)</enum><header>Assessment required</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Commandant of the Coast Guard
			 shall provide to the Committee on Commerce, Science, and Transportation of
			 the Senate and the Committee on Transportation and Infrastructure of the
			 House of Representatives a written assessment of the Coast Guard’s officer
			 evaluation reporting system.</text>
				</subsection><subsection id="HAB69359A47D84E2899B5638733880E63"><enum>(b)</enum><header>Contents of assessment</header><text display-inline="yes-display-inline">The assessment required under subsection (a) shall include, at a minimum, an analysis of—</text>
					<paragraph id="H09A78074E7F64059BE2617FB9C9D1193"><enum>(1)</enum><text>the extent to which the Coast Guard’s officer evaluation reports differ in length, form, and
			 content from the officer fitness reports used by the Navy and other
			 branches of the Armed Forces;</text>
					</paragraph><paragraph id="HB53211FA363847E2A549E473CA3AA7EC"><enum>(2)</enum><text display-inline="yes-display-inline">the extent to which differences determined pursuant to paragraph (1) are the result of inherent
			 differences between—</text>
						<subparagraph id="H6CAEBB390BC74A75B0A5D393A05D1D87"><enum>(A)</enum><text>the Coast Guard and the Navy; and</text>
						</subparagraph><subparagraph id="H724A6DC658804779A5725D5E18346F76"><enum>(B)</enum><text>the Coast Guard and other branches of the Armed Forces;</text>
						</subparagraph></paragraph><paragraph id="HBEEFCBAA34E044538AFDBC0EE2C4408E"><enum>(3)</enum><text display-inline="yes-display-inline">the feasibility of more closely aligning and conforming the Coast Guard’s officer evaluation
			 reports with the officer fitness reports of the Navy and other branches of
			 the Armed Forces; and</text>
					</paragraph><paragraph id="H339575D87C6F45ED844265B649F17DF0"><enum>(4)</enum><text>the costs and benefits of the alignment and conformity described in paragraph (3), including with
			 respect to—</text>
						<subparagraph id="H2C10E5B24A8E49138CEB33548885C798"><enum>(A)</enum><text>Coast Guard administrative efficiency;</text>
						</subparagraph><subparagraph id="H1D459BA7F4A54212B7858D0D8D610294"><enum>(B)</enum><text>fairness and equity for Coast Guard officers; and</text>
						</subparagraph><subparagraph id="H2839840D7D094020B134B0DE7503762E"><enum>(C)</enum><text>carrying out the Coast Guard’s statutory mission of defense readiness, including when operating as
			 a service in the Navy.</text>
						</subparagraph></paragraph></subsection></section><section id="H572A07FC3F3949C7BA2D42C8D76A12DA" section-type="subsequent-section"><enum>228.</enum><header>Improved safety information for vessels</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary of the department in
			 which the Coast Guard is operating shall establish a process that allows
			 an operator of a marine exchange or other non-Federal vessel traffic
			 information service to use the automatic identification system to transmit
			 weather, ice, and other important navigation safety information to
			 vessels.</text>
			</section><section id="HE5ACEDF962DD46378621E4CAA26B73A3" section-type="subsequent-section"><enum>229.</enum><header>E–LORAN</header>
				<subsection id="H5920D57EB6B14224A680A7F83B3F0BB0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of the department in which the Coast Guard is operating may not carry out activities
			 related to the dismantling or disposal of infrastructure that supported
			 the former LORAN system until the later of—</text>
					<paragraph id="HB1A7848910BB474489AB45DDE4A323BC"><enum>(1)</enum><text>the date that is 1 year after the date of enactment of this Act; or</text>
					</paragraph><paragraph id="H16177111B915495CB6616A98CCDFD3B1"><enum>(2)</enum><text>the date on which the Secretary provides to the Committee on Transportation and Infrastructure of
			 the House of Representatives and the Committee on Commerce, Science, and
			 Transportation of the Senate notice of a determination by the Secretary
			 that such infrastructure is not required to provide a positioning,
			 navigation, and timing system to provide redundant capability in the event
			 GPS signals are disrupted.</text>
					</paragraph></subsection><subsection commented="no" id="HCF7D84C11A49433DAA936951A42932EE"><enum>(b)</enum><header>Exception</header><text>Subsection (a) does not apply to activities necessary for the safety of human life.</text>
				</subsection><subsection id="H33871AA4EC424CA488551106BAF31A91"><enum>(c)</enum><header>Agreements</header><text>The Secretary may enter into cooperative agreements, contracts, and other agreements with Federal
			 entities and other public or private entities, including academic
			 entities, to develop a positioning, navigation, and timing system,
			 including an enhanced LORAN system, to provide redundant capability in the
			 event GPS signals are disrupted.</text>
				</subsection></section><section id="H7F6405A210E344B7BCC8AF6B0DF2908B"><enum>230.</enum><header>Analysis of resource deficiencies with respect to maritime border security</header>
				<subsection id="H73E7A275EB684E75B9692367624675DF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 120 days after the date of enactment of this Act, the Commandant of the Coast Guard
			 shall provide to the Committee on Commerce, Science, and Transportation of
			 the Senate and the Committee on Transportation and Infrastructure and the
			 Committee on Homeland Security of the House of Representatives a report
			 describing any Coast Guard resource deficiencies related to—</text>
					<paragraph id="H28165917F4404F6CBC11E2C7F8DC6C00"><enum>(1)</enum><text>securing maritime borders with respect to the Great Lakes and the coastal areas of the Southeastern
			 and Southwestern United States, including with respect to Florida,
			 California, Puerto Rico, and the United States Virgin Islands;</text>
					</paragraph><paragraph id="H60F402E7FEEB411FA825DE6A1C6AE4A6"><enum>(2)</enum><text>patrolling and monitoring maritime approaches to the areas described in paragraph (1); and</text>
					</paragraph><paragraph id="HBEAFC74189E243838BB68D14233CA312"><enum>(3)</enum><text>patrolling and monitoring relevant portions of the Western Hemisphere Drug Transit Zone.</text>
					</paragraph></subsection><subsection id="H79206B88981C4E76BECE91D9836D9AFB"><enum>(b)</enum><header>Scope</header><text display-inline="yes-display-inline">In preparing the report under subsection (a), the Commandant shall consider, at a minimum—</text>
					<paragraph id="H6F0148972BB74E41836C2DCF96BC87C6"><enum>(1)</enum><text>the Coast Guard’s statutory missions with respect to migrant interdiction, drug interdiction,
			 defense readiness, living marine resources, and ports, waterways, and
			 coastal security;</text>
					</paragraph><paragraph id="H73918688BEE14D9D9A951635F7196BFB"><enum>(2)</enum><text>whether Coast Guard missions are being executed to meet national performance targets set under the
			 National Drug Control Strategy;</text>
					</paragraph><paragraph id="H277E65A48EE244EA8D394E8F0C3DB0B0"><enum>(3)</enum><text>the number and types of cutters and other vessels required to effectively execute Coast Guard
			 missions;</text>
					</paragraph><paragraph id="H4158DCA5F2A54D8C8AFDF182564E011B"><enum>(4)</enum><text>the number and types of aircraft, including unmanned aircraft, required to effectively execute
			 Coast Guard missions;</text>
					</paragraph><paragraph id="HF5F86DCD68BB403B99C9D0CC09560758"><enum>(5)</enum><text>the number of assets that require upgraded sensor and communications systems to effectively execute
			 Coast Guard missions;</text>
					</paragraph><paragraph id="H82B85D9200CC47D48377C2BDD362F3FB"><enum>(6)</enum><text>the Deployable Specialized Forces required to effectively execute Coast Guard missions; and</text>
					</paragraph><paragraph id="HA55E48BFC64944B29E5B0337C5FE2D50"><enum>(7)</enum><text>whether additional shoreside facilities are required to accommodate Coast Guard personnel and
			 assets in support of Coast Guard missions.</text>
					</paragraph></subsection></section><section id="H84BD02BCEF73461AA7576E543E32F051"><enum>231.</enum><header>Modernization of National Distress and Response System</header>
				<subsection id="HB4834638BE644D65841C7745D34F9AB3"><enum>(a)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 60 days after the date of enactment of this Act, the Secretary of the department in
			 which the Coast Guard is operating shall submit to the Committee on
			 Transportation and Infrastructure of the House of Representatives and the
			 Committee on Commerce, Science, and Transportation of the Senate a report
			 on the implementation of the Rescue 21 project in Alaska and in Coast
			 Guard sectors Upper Mississippi River, Lower Mississippi River, and Ohio
			 River Valley.</text>
				</subsection><subsection id="HA9F7D42360D94B649D19031BE4FC7E08"><enum>(b)</enum><header>Contents</header><text>The report required under subsection (a) shall—</text>
					<paragraph id="H1BA822681C1B41FFBF7302AE7542A800"><enum>(1)</enum><text>describe what improvements are being made to the distress response system in the areas specified in
			 subsection (a), including information on which areas will receive digital
			 selective calling and direction finding capability;</text>
					</paragraph><paragraph id="H8419DD7646BE4624B50C170CD1C708B7"><enum>(2)</enum><text>describe the impediments to installing digital selective calling and direction finding capability
			 in areas where such technology will not be installed;</text>
					</paragraph><paragraph id="H8E095BA6CFB64566BC0C124D0AA58355"><enum>(3)</enum><text>identify locations in the areas specified in subsection (a) where communication gaps will continue
			 to present a risk to mariners after completion of the Rescue 21 project;</text>
					</paragraph><paragraph id="HFBCF1392811A4F4D80E0A4FAB2A3218F"><enum>(4)</enum><text>include a list of all reported marine accidents, casualties, and fatalities occurring in the
			 locations identified under paragraph (3) since 1990; and</text>
					</paragraph><paragraph id="HFDEE38F929284D97ACBE054019C229B5"><enum>(5)</enum><text>provide an estimate of the costs associated with installing the technology necessary to close
			 communication gaps in the locations identified under paragraph (3).</text>
					</paragraph></subsection></section><section id="HD97420049B4E42F2B0A8B76426049D2F" section-type="subsequent-section"><enum>232.</enum><header>Report reconciling maintenance and operational priorities on the Missouri River</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, the Commandant of the Coast Guard
			 shall submit to the Committee on Commerce, Science, and Transportation of
			 the Senate and the Committee on Transportation and Infrastructure of the
			 House of Representatives a report that outlines a course of action to
			 reconcile general maintenance priorities for cutters with operational
			 priorities on the Missouri River.</text>
			</section><section id="H36E5B5E5A68146B29FF39D725F95DDA5"><enum>233.</enum><header>Maritime Search and Rescue Assistance Policy assessment</header>
				<subsection id="H8A05B6725EAE4DDC891C7DB038D79C7D"><enum>(a)</enum><header>In general</header><text>The Commandant of the Coast Guard shall assess the Maritime Search and Rescue Assistance Policy as
			 it relates to State and local responders.</text>
				</subsection><subsection id="H762E58611FC04C4CB66C66DE9FF4534C"><enum>(b)</enum><header>Scope</header><text>The assessment under subsection (a) shall consider, at a minimum—</text>
					<paragraph id="H7CBB5E6BD9544CBB8AD4FF4484C7B276"><enum>(1)</enum><text>the extent to which Coast Guard search and rescue coordinators have entered into domestic search
			 and rescue agreements with State and local responders under the National
			 Search and Rescue Plan;</text>
					</paragraph><paragraph id="HCA458A23189B47C585F739B8257ED93C"><enum>(2)</enum><text>whether the domestic search and rescue agreements include the Maritime Search and Rescue Assistance
			 Policy; and</text>
					</paragraph><paragraph id="HC50C7D44C8A64621BA3B6F23F26FE25E"><enum>(3)</enum><text>the extent to which Coast Guard sectors coordinate with 911 emergency centers, including ensuring
			 the dissemination of appropriate maritime distress check-sheets.</text>
					</paragraph></subsection><subsection id="H5CD1E0AFE57442E3A8D1A00AA5259F0D"><enum>(c)</enum><header>Report</header><text>Not later than 180 days after the date of enactment of this Act, the Commandant of the Coast Guard
			 shall submit a report on the assessment under subsection (a) to the
			 Committee on Commerce, Science, and Transportation of the Senate and the
			 Committee on Transportation and Infrastructure of the House of
			 Representatives.</text>
				</subsection></section></title><title id="H010C68470D02408DBF35DA69768C42A4"><enum>III</enum><header>Shipping and Navigation</header>
			<section id="H993DE68EB96742AA88040C97488A9568"><enum>301.</enum><header>Repeal</header><text display-inline="no-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/555">Chapter 555</external-xref> of title 46, United States Code, is amended—</text>
				<paragraph id="H57C2DB6A799142E69A11A537C1D10205"><enum>(1)</enum><text>by repealing section 55501;</text>

					<subsection id="H85B6452F0D1246D093E2F6C013912B74"><enum>(e)</enum><header>Donation for historical purposes</header>
						<paragraph id="HC93A44235E3C4655930DF04F1C4EEE86"><enum>(1)</enum><header>In general</header><text>The Secretary may convey the right, title, and interest of the United States Government in any
			 property administered by the Maritime Administration, except real estate
			 or vessels, if—</text>
							<subparagraph id="HA39BF531A8A9480194412B8A0517C77B"><enum>(A)</enum><text>the Secretary determines that such property is not needed by the Maritime Administration; and</text>
							</subparagraph><subparagraph id="HC995D7451E5C45F58917EACA24613AEC"><enum>(B)</enum><text>the recipient—</text>
								<clause id="H10C508216DA94E8194AD81DFB00719F8"><enum>(i)</enum><text>is a nonprofit organization, a State, or a political subdivision of a State;</text>
								</clause><clause id="H0CA9E9A2D2FE464C856CFD511EBD4E81"><enum>(ii)</enum><text>agrees to hold the Government harmless for any claims arising from exposure to hazardous materials,
			 including asbestos, polychlorinated biphenyls, or lead paint, after
			 conveyance of the property;</text>
								</clause><clause id="H30B9C3F46F4A447FA2FADC8505BF6717"><enum>(iii)</enum><text>provides a description and explanation of the intended use of the property to the Secretary for
			 approval;</text>
								</clause><clause id="H9921A5A288984D2894D07B39DB0826E8"><enum>(iv)</enum><text>has provided to the Secretary proof, as determined by the Secretary, of resources sufficient to
			 accomplish the intended use provided under clause (iii) and to maintain
			 the property;</text>
								</clause><clause id="H98197919AE334758A945CBB7CB068298"><enum>(v)</enum><text>agrees that when the recipient no longer requires the property, the recipient shall—</text>
									<subclause id="HA96E5D54713E4C0B97590AAE73A15A13"><enum>(I)</enum><text>return the property to the Secretary, at the recipient’s expense and in the same condition as
			 received except for ordinary wear and tear; or</text>
									</subclause><subclause id="H9852852A9EFD4A839EECF4930DC871F5"><enum>(II)</enum><text>subject to the approval of the Secretary, retain, sell, or otherwise dispose of the property in a
			 manner consistent with applicable law; and</text>
									</subclause></clause><clause id="H237E26A0051E4FCAB44EDF70E61B2467"><enum>(vi)</enum><text>agrees to any additional terms the Secretary considers appropriate.</text>
								</clause></subparagraph></paragraph><paragraph id="HAD04B1C314F94682A606744FC0033855"><enum>(2)</enum><header>Reversion</header><text>The Secretary shall include in any conveyance under this subsection terms under which all right,
			 title, and interest conveyed by the Secretary shall revert to the
			 Government if the Secretary determines the property has been used other
			 than as approved by the Secretary under paragraph (1)(B)(iii).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HEFE450F5D6CB4EBD9ACA473D78BD0835"><enum>303.</enum><header>Small shipyards</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/46/54101">Section 54101(i)</external-xref> of title 46, United States Code, is amended by striking <quote>2009 through 2013</quote> and inserting <quote>2015 through 2017</quote>.</text>
			</section><section id="H56A502D93E524710B80ECA781F971749"><enum>304.</enum><header>Drug testing reporting</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/46/7706">Section 7706</external-xref> of title 46, United States Code, is amended—</text>
				<paragraph id="H6E157BD4B4134412A15A461C7A8DFB3B"><enum>(1)</enum><text>in subsection (a), by inserting <quote>an applicant for employment by a Federal agency,</quote> after <quote>Federal agency,</quote>; and</text>
				</paragraph><paragraph id="H9D3A8EFD6C7B47D5B23D72D33707AB4B"><enum>(2)</enum><text>in subsection (c), by—</text>
					<subparagraph id="H67CA7F4EAFA14531A68F467AE301BDC5"><enum>(A)</enum><text>inserting <quote>or an applicant for employment by a Federal agency</quote> after <quote>an employee</quote>; and</text>
					</subparagraph><subparagraph id="HEC17E00D95B543EFB2EEA40302D206B4"><enum>(B)</enum><text>striking <quote>the employee.</quote> and inserting <quote>the employee or the applicant.</quote>.</text>
					</subparagraph></paragraph></section><section id="H473829CFBA15461A80427855546DD18E"><enum>305.</enum><header>Opportunities for sea service veterans</header>
				<subsection id="HA962964917C948D19029621BD446AAE7"><enum>(a)</enum><header>Endorsements for veterans</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/46/7101">Section 7101</external-xref> of title 46, United States Code, is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H0FD5287F50404600B76FD002441DBE4E" style="OLC">
						<subsection id="HDC5F961BD014434AA47F20DBB2757F10"><enum>(j)</enum><text>The Secretary may issue a license under this section in a class under subsection (c) to an
			 applicant that—</text>
							<paragraph id="HF628C03F31F740A2BE5566F1A8CEF82E"><enum>(1)</enum><text>has at least 3 months of qualifying service on vessels of the uniformed services (as that term is
			 defined in <external-xref legal-doc="usc" parsable-cite="usc/10/101">section 101(a)</external-xref> of title 10) of appropriate tonnage or
			 horsepower within the 7-year period immediately preceding the date of
			 application; and</text>
							</paragraph><paragraph id="H35027F7200AE4BE0B435912145AFDD59"><enum>(2)</enum><text>satisfies all other requirements for such a license.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H163DD8416B1C439FA2BD863DB4F9E0BC"><enum>(b)</enum><header>Sea service letters</header>
					<paragraph id="H8D69771BDEA8461D89B85B572D89FE54"><enum>(1)</enum><header>In general</header><text>Title 14, United States Code, is amended by inserting after section 427 the following:</text>

							<section id="H67ED3C24C60B405CBDE3CA1E1D086A24"><enum>428.</enum><header>Sea service letters</header>
								<subsection id="HC20280BF83904DAD892D03A2A2BD3CC0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall provide a sea service letter to a member or former member of the Coast Guard
			 who—</text>
									<paragraph id="H12D0CC23699544E9AA108F2DA98887FF"><enum>(1)</enum><text>accumulated sea service on a vessel of the armed forces (as such term is defined in section 101(a)

									</paragraph></subsection><subsection id="H448EB94A22C14B4CB30DA0984FAD21C6"><enum>(b)</enum><header>Deadline</header><text>Not later than 30 days after receiving a request for a sea service letter from a member or former
			 member of the Coast Guard under subsection (a), the Secretary shall
			 provide such letter to such member or former member if such member or
			 former member satisfies the requirement under subsection (a)(1).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph id="H543FFD118386496492507F4E78C16409"><enum>(2)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/14/11">chapter 11</external-xref> of title 14, United States Code, is amended by inserting after the item
			 relating to section 427 the following:</text>

					<paragraph id="HE4683C6971FB45478B11C91C233D3D79"><enum>(1)</enum><header>Maximizing creditability</header><text>The Secretary of the department in which the Coast Guard is operating, in implementing United
			 States merchant mariner license, certification, and document laws and the
			 International Convention on Standards of Training, Certification and
			 Watchkeeping for Seafarers, 1978, shall maximize the extent to which
			 United States Armed Forces service, training, and qualifications are
			 creditable toward meeting the requirements of such laws and such
			 Convention.</text>
					</paragraph><paragraph id="HEFD6B0DF86F84BF6BD18EA1E930F4FBD"><enum>(2)</enum><header>Notification</header><text>Not later than 90 days after the date of enactment of this Act, the Secretary shall notify the
			 Committee on Transportation and Infrastructure of the House of
			 Representatives and the Committee on Commerce, Science, and Transportation
			 of the Senate on the steps taken to implement this subsection.</text>
					</paragraph></subsection><subsection id="H23F515643E2D4513BA88F99B4AF620C9"><enum>(d)</enum><header>Merchant Marine Post-Service Career Opportunities</header><text>Not later than 180 days after the date of enactment of this Act, the Commandant of the Coast Guard
			 shall take steps to promote better awareness, on an ongoing basis, among
			 Coast Guard personnel regarding post-service use of Coast Guard training,
			 education, and practical experience in satisfaction of requirements for
			 merchant mariner credentials under <external-xref legal-doc="usc" parsable-cite="usc/46/11">section 11.213</external-xref> of title 46, Code of
			 Federal Regulations.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="HE4DE3FBE260E4D1793B5E95394ECC6A7" section-type="subsequent-section"><enum>306.</enum><header>Clarification of high-risk waters</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/46/55305">Section 55305(e)</external-xref> of title 46, United States Code, is amended—</text>
				<paragraph commented="no" id="H7DF5BCD02D32435F972F8C8406AB0E6A"><enum>(1)</enum><text>in paragraph (1)—</text>
					<subparagraph commented="no" id="H6A4E955FB2934208A3C555A9FA39879E"><enum>(A)</enum><text>by striking <quote>provide armed personnel aboard</quote> and inserting <quote>reimburse, subject to the availability of appropriations, the owners or operators of</quote>; and</text>

						<paragraph commented="no" id="H9B3827C29FAC43FD8F3B86888884CBEE"><enum>(2)</enum><text display-inline="yes-display-inline">In this subsection, the term <term>high-risk waters</term> means waters so designated by the Commandant of the Coast Guard in the maritime security directive
			 issued by the Commandant and in effect on the date on which an applicable
			 voyage begins, if the Secretary of Transportation—</text>
							<subparagraph commented="no" id="H542FDC96782B4D9B8EE14AA5343DCE9E"><enum>(A)</enum><text>determines that an act of piracy occurred in the 12-month period preceding the date the voyage
			 begins; or</text>
							</subparagraph><subparagraph commented="no" id="H98005320741B49E2ACACF6B35628B5D4"><enum>(B)</enum><text>in such period, issued an advisory warning that an act of piracy is possible in such waters.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="H6566B889103742F388B80475A93F9A89" section-type="subsequent-section"><enum>307.</enum><header>Technical corrections</header>
				<subsection id="HCD329D88A3A242D699A3F3A18C7FA100"><enum>(a)</enum><header>Title 46</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/46/2116">Section 2116(b)(1)(D)</external-xref> of title 46, United States Code, is amended by striking <quote>section 93(c)</quote> and inserting <quote>section 93(c) of title 14</quote>.</text>
				</subsection><subsection id="H211D8131BDC848E69F0E27EAD8BE4776"><enum>(b)</enum><header>Coast Guard and Maritime Transportation Act of 2006</header><text>Section 304(a) of the Coast Guard and Maritime Transportation Act of 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/241">Public Law 109–241</external-xref>; 33

				</subsection></section><section id="HE8DF0C3BDA764B23940D94653D725F04" section-type="subsequent-section"><enum>308.</enum><header>Report</header>
				<text display-inline="no-display-inline">Not later than 1 year after the date of the enactment of this Act, the Comptroller General of the
			 United States shall submit to the Committee on Transportation and
			 Infrastructure of the House of Representatives and the Committee on
			 Commerce, Science, and Transportation of the Senate a report on the number
			 of jobs, including vessel construction and vessel operating jobs, that
			 would be created in the United States maritime industry each year in 2015
			 through 2025 if liquified natural gas exported from the United States were
			 required to be carried—</text>
				<paragraph id="H777FEE75B0AE444A951C0D464E00F95A"><enum>(1)</enum><text>before December 31, 2018, on vessels documented under the laws of the United States; and</text>
				</paragraph><paragraph id="HD66BF3E3C41648DFAC813654DF6AA28B"><enum>(2)</enum><text>on and after such date, on vessels documented under the laws of the United States and constructed
			 in the United States.</text>
				</paragraph></section><section id="H9F76C83661214674B35CCCB456BE2899"><enum>309.</enum><header>Fishing safety grant programs</header>
				<subsection id="H71C16E154CBC4EF7863FB42CE2FBED38"><enum>(a)</enum><header>Fishing safety training grant program</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/46/4502">Section 4502(i)(4)</external-xref> of title 46, United States Code, is amended by striking <quote>2010 through 2014</quote> and inserting <quote>2015 through 2017</quote>.</text>

				</subsection></section><section id="H3CE2562561AA478FBC4AB63DE3315E4F"><enum>310.</enum><header>Establishment of Merchant Marine Personnel Advisory Committee</header>
				<subsection id="H6A88C9FE184A4DD19C40B9F6EEC16AC0"><enum>(a)</enum><header>Establishment</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/81">Chapter 81</external-xref> of title 46, United States Code, is amended by adding at the end the following:</text>
					<quoted-block id="HD68677DE79AC4F4D94CD2319289BB8BE" style="USC">
						<section id="HEC61585264364BAF94E080C63728CDB9"><enum>8108.</enum><header>Merchant Marine Personnel Advisory Committee</header>
							<subsection id="H4CF2A84299FE490F82364479AD1C5DF3"><enum>(a)</enum><header>Establishment</header><text>The Secretary shall establish a Merchant Marine Personnel Advisory Committee (in this section
			 referred to as <quote>the Committee</quote>). The Committee—</text>
								<paragraph id="HCD6A47C0057B4D71B9361C1A94C634ED"><enum>(1)</enum><text>shall act solely in an advisory capacity to the Secretary through the Commandant of the Coast Guard
			 on matters relating to personnel in the United States merchant marine,
			 including training, qualifications, certification, documentation, and
			 fitness standards, and other matters as assigned by the Commandant;</text>
								</paragraph><paragraph id="H8593E58B50FE414583FA4AFEE53FEB77"><enum>(2)</enum><text>shall review and comment on proposed Coast Guard regulations and policies relating to personnel in
			 the United States merchant marine, including training, qualifications,
			 certification, documentation, and fitness standards;</text>
								</paragraph><paragraph id="HD72A71DA7D2840EE963D923CB58B60D4"><enum>(3)</enum><text>may be given special assignments by the Secretary and may conduct studies, inquiries, workshops,
			 and fact finding in consultation with individuals and groups in the
			 private sector and with State or local governments;</text>
								</paragraph><paragraph id="H6F3957F014824522BADDD1007A6ACEF2"><enum>(4)</enum><text>shall advise, consult with, and make recommendations reflecting its independent judgment to the
			 Secretary;</text>
								</paragraph><paragraph id="HC7FD75AEB63E46DEB9B007FD1F25951B"><enum>(5)</enum><text>shall meet not less than twice each year; and</text>
								</paragraph><paragraph id="HBFC9B57D5ED94C89A8EA6AB0EADD491C"><enum>(6)</enum><text>may make available to Congress recommendations that the Committee makes to the Secretary.</text>
								</paragraph></subsection><subsection id="H2FFF3825039A4C3B97DF2DB16D85A70D"><enum>(b)</enum><header>Membership</header>
								<paragraph id="H0F7D13B07F9C4564B9928879AE7FA751"><enum>(1)</enum><header>In general</header><text>The Committee shall consist of not more than 19 members who are appointed by and serve terms of a
			 duration determined by the Secretary. Before filling a position on the
			 Committee, the Secretary shall publish a notice in the Federal Register
			 soliciting nominations for membership on the Committee.</text>
								</paragraph><paragraph id="H3A3CE99CEC134B5FAF947A98896C4294"><enum>(2)</enum><header>Required members</header><text>Subject to paragraph (3), the Secretary shall appoint as members of the Committee—</text>
									<subparagraph id="H71503B01C67F4A61BA1B276F53631BED"><enum>(A)</enum><text>9 United States citizens with active licenses or certificates issued under chapter 71 or merchant
			 mariner documents issued under chapter 73, including—</text>
										<clause id="H7FB6A33CFE32423F8AB6C8B61C908B64"><enum>(i)</enum><text>3 deck officers who represent the viewpoint of merchant marine deck officers, of whom—</text>
											<subclause id="HD909801A878F43859D0A5F71A78E6CBC"><enum>(I)</enum><text>2 shall be licensed for oceans any gross tons;</text>
											</subclause><subclause id="H725E436A1B7C4E71807257653DBD9E75"><enum>(II)</enum><text display-inline="yes-display-inline">1 shall be licensed for inland river route with a limited or unlimited tonnage;</text>
											</subclause><subclause id="H8A1C263341E34C3F8D5CB7C185A229B6"><enum>(III)</enum><text>2 shall have a master’s license or a master of towing vessels license;</text>
											</subclause><subclause id="HA30367EB4C8941ACB9CF88E38763BA8F"><enum>(IV)</enum><text>1 shall have significant tanker experience; and</text>
											</subclause><subclause id="H59CAE3B48136470A82C6789EFACDC8CB"><enum>(V)</enum><text>to the extent practicable—</text>
												<item id="H012D9C5CFEAC4A7BBAC57B99854904A0"><enum>(aa)</enum><text>1 shall represent the viewpoint of labor; and</text>
												</item><item id="H5FE1F1F56C6B4E35AE7103780595F661"><enum>(bb)</enum><text>another shall represent a management perspective;</text>
												</item></subclause></clause><clause id="HF26C4DB40FF348F8BD2400BDDD1166A7"><enum>(ii)</enum><text>3 engineering officers who represent the viewpoint of merchant marine engineering officers, of
			 whom—</text>
											<subclause id="H8C410174F65545D49FE3EF9561728C87"><enum>(I)</enum><text>2 shall be licensed as chief engineer any horsepower;</text>
											</subclause><subclause id="H7AD97BAC19F74B12AC2174885A377DB8"><enum>(II)</enum><text>1 shall be licensed as either a limited chief engineer or a designated duty engineer; and</text>
											</subclause><subclause id="H92F93D8C43104F48A402C4EB35A4D6B2"><enum>(III)</enum><text>to the extent practicable—</text>
												<item id="H18A0308797E749C5B7F08BCD7607FD05"><enum>(aa)</enum><text display-inline="yes-display-inline">1 shall represent a labor viewpoint; and</text>
												</item><item id="H4601A78AEAA44B13AB2C5FD088E7E447"><enum>(bb)</enum><text>another shall represent a management perspective;</text>
												</item></subclause></clause><clause id="H99AC3296F3E640DD86481E0BA392DFAB"><enum>(iii)</enum><text>2 unlicensed seamen, of whom—</text>
											<subclause id="H8DB98EC166C34DA9BFDD57ADD3882390"><enum>(I)</enum><text>1 shall represent the viewpoint of able-bodied seamen; and</text>
											</subclause><subclause id="H7AF77148ACA64B949573DA54B0EC3740"><enum>(II)</enum><text>another shall represent the viewpoint of qualified members of the engine department; and</text>
											</subclause></clause><clause id="H0DE8E141E5F341D48AC2B32FBD66A1C8"><enum>(iv)</enum><text>1 pilot who represents the viewpoint of merchant marine pilots;</text>
										</clause></subparagraph><subparagraph id="H352060811D8847659D26845636D408E7"><enum>(B)</enum><text>6 marine educators, including—</text>
										<clause id="HDC0306A211454F7F805433E8760F1015"><enum>(i)</enum><text>3 marine educators who represent the viewpoint of maritime academies, including—</text>
											<subclause id="H3733E831A8AD4E32BF997B230A63F6A5"><enum>(I)</enum><text>2 who represent the viewpoint of State maritime academies and are jointly recommended by such State
			 maritime academies; and</text>
											</subclause><subclause id="H4D3773EE58564770AF6EC4DA900C8724"><enum>(II)</enum><text>1 who represents either the viewpoint of the State maritime academies or the United States Merchant
			 Marine Academy; and</text>
											</subclause></clause><clause id="HD898EFB88E894AD482D49ABF0EFCBE91"><enum>(ii)</enum><text>3 marine educators who represent the viewpoint of other maritime training institutions, 1 of whom
			 shall represent the viewpoint of the small vessel industry;</text>
										</clause></subparagraph><subparagraph id="H31B7F596A7E2440194F8D36FAEB1105D"><enum>(C)</enum><text>2 individuals who represent the viewpoint of shipping companies employed in ship operation
			 management; and</text>
									</subparagraph><subparagraph id="H435AAB06FB33434EA2392E71960F0AE5"><enum>(D)</enum><text>2 members who are appointed from the general public.</text>
									</subparagraph></paragraph><paragraph id="H272D8BB40CA74D8283A6B4A7A4AA26A9"><enum>(3)</enum><header>Consultation</header><text>The Secretary shall consult with the Secretary of Transportation in making an appointment under
			 paragraph (2)(B)(i)(II).</text>
								</paragraph></subsection><subsection id="H3DCBD44FD89D4DB9A35AEECD2120837A"><enum>(c)</enum><header>Chairman and Vice Chairman</header><text>The Secretary shall designate one member of the Committee as the Chairman and one member of the
			 Committee as the Vice Chairman. The Vice Chairman shall act as Chairman in
			 the absence or incapacity of the Chairman, or in the event of a vacancy in
			 the office of the Chairman.</text>
							</subsection><subsection id="H6185F623901545E6B414A0D60A8675DB"><enum>(d)</enum><header>Subcommittees</header><text display-inline="yes-display-inline">The Committee may establish and disestablish subcommittees and working groups for any purpose
			 consistent with this section, subject to conditions imposed by the
			 Committee. Members of the Committee and additional persons drawn from the
			 general public may be assigned to such subcommittees and working groups.
			 Only Committee members may chair subcommittee or working groups.</text>
							</subsection><subsection id="HAAD8EE7DF0214358BA96C8CA6B8BFD07"><enum>(e)</enum><header>Termination</header><text>The Committee shall terminate on September 30, 2020.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HAFC4DAC9137E4FAFA01A29EB4E3C345B"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for such chapter is amended by adding at the end the following:</text>

								</paragraph><paragraph commented="no" id="H3806101F3FD64565878324C2BFBBAF7D" indent="up1"><enum>(2)</enum><text>The value of in-kind transportation, travel, and subsistence accepted under this paragraph may not
			 exceed applicable per diem rates set forth in regulations prescribed under
			 <external-xref legal-doc="usc" parsable-cite="usc/37/464">section 464</external-xref> of title 37.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block>
					</paragraph><paragraph commented="no" id="HBAB3BF01A8F542AEBCF09AEC03635688"><enum>(2)</enum><text>in subsection (c), by striking <quote>subsections (a) and (b),</quote> and inserting <quote>subsection (a),</quote>.</text>

							</paragraph><paragraph commented="no" id="H0E244D2AEEC94235B0A83ECB30E00473" indent="up1"><enum>(2)</enum><text>The value of in-kind transportation, travel, and subsistence accepted under this paragraph may not
			 exceed applicable per diem rates set forth in regulations prescribed under
			 <external-xref legal-doc="usc" parsable-cite="usc/37/464">section 464</external-xref> of title 37.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection commented="no" id="H59F5B0D326CC4FB1BF7E9B44EE04B0C8"><enum>(c)</enum><header>Limitation</header><text>The Secretary of the Department in which the Coast Guard is operating may not accept in-kind
			 transportation, travel, or subsistence under <external-xref legal-doc="usc" parsable-cite="usc/14/664">section 664(e)</external-xref> of title 14,
			 United States Code, or <external-xref legal-doc="usc" parsable-cite="usc/46/2110">section 2110(d)(4)</external-xref> of title 46, United States Code,
			 as amended by this section, until the Commandant of the Coast Guard—</text>
					<paragraph commented="no" id="HC1ADACC7D5C5498F9578E167218BD236"><enum>(1)</enum><text>amends the Standards of Ethical Conduct for members and employees of the Coast Guard to include
			 regulations governing the acceptance of in-kind reimbursements; and</text>
					</paragraph><paragraph commented="no" id="HBBCA25CC12AF42A3B4CBB443DD6F34E4"><enum>(2)</enum><text>notifies the Committee on Commerce, Science, and Transportation of the Senate and the Committee on
			 Transportation and Infrastructure of the House of Representatives of the
			 amendments made under paragraph (1).</text>
					</paragraph></subsection></section><section id="H83C536B850DB49A1AE422A96E58956E2"><enum>312.</enum><header>Prompt intergovernmental notice of marine casualties</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/46/6101">Section 6101</external-xref> of title 46, United States Code, is amended—</text>
				<paragraph id="HDF08A57DFF7140FAB0B62E5CD128796A"><enum>(1)</enum><text>by inserting after subsection (b) the following:</text>
					<quoted-block id="H3DE182B510AB49DD8D6FC1624BC9A6B2" style="OLC">
						<subsection id="H9B62419A36DF4C54AA43CBEEA969FF02"><enum>(c)</enum><header>Notice to State and tribal governments</header><text>Not later than 24 hours after receiving a notice of a major marine casualty under this section, the
			 Secretary shall notify each State or federally recognized Indian tribe
			 that is, or may reasonably be expected to be, affected by such marine
			 casualty.</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H2F5A2F4CD17F4223BCDAA33953D930A4"><enum>(2)</enum><text>in subsection (h)—</text>

				<subsection id="H6D6B3285B45F4F1D8B7787A451241B43"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/803">Chapter 803</external-xref> of title 46, United States Code, is amended—</text>
					<paragraph id="H81E136DC87924CCBB0CE7F927AA014FD"><enum>(1)</enum><text>in section 80301, by adding at the end the following:</text>

			 section 80301(b) for the year preceding the year in which the data is
			 collected.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="HBB099BEB47FC415D9CC6FF7E30DF3409"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for such chapter is amended by adding at the end the following:</text>

				</subsection><subsection id="H097F1B3893B94974B569C00F751B3CCA"><enum>(c)</enum><header>Effective date</header><text>This section shall take effect on January 1, 2017.</text>
				</subsection></section><section display-inline="no-display-inline" id="HB8ABE9CF031F421B9ACE1C60DD141EB5" section-type="subsequent-section"><enum>315.</enum><header>Offshore supply vessel third-party inspection</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/46/3316">Section 3316</external-xref> of title 46, United States Code, is amended by redesignating subsection (f) as
			 subsection (g), and by inserting after subsection (e) the following:</text>
				<quoted-block display-inline="no-display-inline" id="H493683A0C343416185E3312B0AD78181" style="OLC">
					<subsection id="HFA843B3EA11043EA8F7FA5D2472A0478"><enum>(f)</enum>
						<paragraph commented="no" display-inline="yes-display-inline" id="H8FD297EE5CE14AC4B5E27D6A6F51AF9F"><enum>(1)</enum><text display-inline="yes-display-inline">Upon request of an owner or operator of an offshore supply vessel, the Secretary shall delegate the
			 authorities set forth in paragraph (1) of subsection (b) with respect to
			 such vessel to a classification society to which a delegation is
			 authorized under that paragraph. A delegation by the Secretary under this
			 subsection shall be used for any vessel inspection and examination
			 function carried out by the Secretary, including the issuance of
			 certificates of inspection and all other related documents.</text>
						</paragraph><paragraph id="H3E8C90EC3D7D4C7ABB7DCDCFDA2E5B54" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">If the Secretary determines that a certificate of inspection or related document issued under
			 authority delegated under paragraph (1) of this subsection with respect to
			 a vessel has reduced the operational safety of that vessel, the Secretary
			 may terminate the certificate or document, respectively.</text>
						</paragraph><paragraph id="H96EA2567E2D7414A853AADD41933F578" indent="up1"><enum>(3)</enum><text>Not later than 2 years after the date of the enactment of the <short-title>Howard Coble Coast Guard and Maritime Transportation Act of 2014</short-title>, and for each year of the subsequent 2-year period, the Secretary shall provide to the Committee
			 on Transportation and Infrastructure of the House of Representatives and
			 the Committee on Commerce, Science, and Transportation of the Senate a
			 report describing—</text>
							<subparagraph id="HA8BD75A04D2E4D11979E3D07FBD127A8"><enum>(A)</enum><text>the number of vessels for which a delegation was made under paragraph (1);</text>
							</subparagraph><subparagraph id="HC9FECEB3DA744D20BF18E9E6CDFBD3F5"><enum>(B)</enum><text>any savings in personnel and operational costs incurred by the Coast Guard that resulted from the
			 delegations; and</text>
							</subparagraph><subparagraph id="H236966F37F9E4999B123D97E3CA41C37"><enum>(C)</enum><text>based on measurable marine casualty and other data, any impacts of the delegations on the
			 operational safety of vessels for which the delegations were made, and on
			 the crew on those vessels.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section commented="no" id="H0B647421D8D74D27922BE3144ECE6169"><enum>316.</enum><header>Watches</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/46/8104">Section 8104</external-xref> of title 46, United States Code, is amended—</text>
				<paragraph commented="no" id="HBC44E8D4CAD04159ABD127574142C534"><enum>(1)</enum><text>in subsection (d), by striking <quote>coal passers, firemen, oilers, and water tenders</quote> and inserting <quote>and oilers</quote>; and</text>
				</paragraph><paragraph commented="no" id="HA5027E7F6D284FFCA83B4F584DCAF6EF"><enum>(2)</enum><text>in subsection (g)(1), by striking <quote>(except the coal passers, firemen, oilers, and water tenders)</quote>.</text>
				</paragraph></section><section commented="no" id="H3B11B719AF9E4D7ABDF45F92C2B268B6"><enum>317.</enum><header>Coast Guard response plan requirements</header>
				<subsection commented="no" id="H506DAE814281463BB78F5DE3A23ACF15"><enum>(a)</enum><header>Vessel response plan contents</header><text>The Secretary of the department in which the Coast Guard is operating shall require that each
			 vessel response plan prepared for a mobile offshore drilling unit includes
			 information from the facility response plan prepared for the mobile
			 offshore drilling unit regarding the planned response to a worst case
			 discharge, and to a threat of such a discharge.</text>
				</subsection><subsection commented="no" id="H22538A8C11BC45A8B48B99FD77475F4E"><enum>(b)</enum><header>Definitions</header><text>In this section:</text>
					<paragraph commented="no" id="H243BC5E3ADEE412A9478705AE6C106C1"><enum>(1)</enum><header>Mobile offshore drilling unit</header><text>The term <quote>mobile offshore drilling unit</quote> has the meaning given that term in section 1001 of the Oil Pollution Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/33/2701">33 U.S.C. 2701</external-xref>).</text>
					</paragraph><paragraph commented="no" id="H5A30F4DD01494018BE1897EE64E3DA71"><enum>(2)</enum><header>Response plan</header><text>The term <quote>response plan</quote> means a response plan prepared under section 311(j) of the Federal Water Pollution Control Act (33
			 U.S.C. 1321(j)).</text>
					</paragraph><paragraph commented="no" id="H0C41B298436E40F2B3837E9913E5FE62"><enum>(3)</enum><header>Worst case discharge</header><text>The term <quote>worst case discharge</quote> has the meaning given that term under section 311(a) of the Federal Water Pollution Control Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/33/1321">33 U.S.C. 1321(a)</external-xref>).</text>
					</paragraph></subsection><subsection commented="no" id="H291EDB02B08B4F23BC4B9C5839B117A2"><enum>(c)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed to require the Coast Guard to review or approve a
			 facility response plan for a mobile offshore drilling unit.</text>
				</subsection></section><section id="HFF32D7E15F7448D5A3D8C2D4FC5C7A23"><enum>318.</enum><header>Regional Citizens’ Advisory Council</header><text display-inline="no-display-inline">Section 5002(k)(3) of the Oil Pollution Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/33/2732">33 U.S.C. 2732(k)(3)</external-xref>) is amended by striking <quote>not more than $1,000,000</quote> and inserting <quote>not less than $1,400,000</quote>.</text>
			</section><section id="H875F2225FB0544B9B0FB0E6F9B7ED7F5"><enum>319.</enum><header>Uninspected passenger vessels in the United States Virgin Islands</header>
				<subsection id="HB8AF349208904E6D94C9F894E22B5105"><enum>(a)</enum><header>In General</header><text><external-xref legal-doc="usc" parsable-cite="usc/46/4105">Section 4105</external-xref> of title 46, United States Code, is amended—</text>
					<paragraph id="HA1C5A51DBD9845558BB4D267CB3C159C"><enum>(1)</enum><text>by redesignating subsection (b) as subsection (c); and</text>
					</paragraph><paragraph id="H9A60DE8502CC41A8BCAEC44DE379E127"><enum>(2)</enum><text>by inserting after subsection (a) the following:</text>
						<quoted-block id="HA38D859AC39049208BFE41C7B2692B5F" style="OLC">
							<subsection id="H54468E19240042F3AC2F45681B023DD6"><enum>(b)</enum>

			 length that carries passengers to or from a port in the United States
			 Virgin Islands, the Secretary shall substitute <quote>12 passengers</quote> for <quote>6 passengers</quote> each place it appears in section 2101(42) if the Secretary determines that the vessel complies
			 with, as applicable to the vessel—</text>
									<subparagraph id="H880E4827227E471BAA188935F27D78D7"><enum>(A)</enum><text>the Code of Practice for the Safety of Small Commercial Motor Vessels (commonly referred to as the <quote>Yellow Code</quote>), as published by the U.K. Maritime and Coastguard Agency and in effect on January 1, 2014; or</text>
									</subparagraph><subparagraph id="H1EF462DC9F5A44D2A2756EEB42544C97"><enum>(B)</enum><text>the Code of Practice for the Safety of Small Commercial Sailing Vessels (commonly referred to as
			 the <quote>Blue Code</quote>), as published by such agency and in effect on such date.</text>
									</subparagraph></paragraph><paragraph id="H3EDFA64F654143AAB84DD04E7F26E739"><enum>(2)</enum><text>If the Secretary establishes standards to carry out this subsection—</text>
									<subparagraph id="H45E3615F77774B3DAF5C85C6077D0DE5"><enum>(A)</enum><text>such standards shall be identical to those established in the Codes of Practice referred to in
			 paragraph (1); and</text>
									</subparagraph><subparagraph id="HFF0048153B834DB9AF7208D3C89CE05C"><enum>(B)</enum><text>on any dates before the date on which such standards are in effect, the Codes of Practice referred
			 to in paragraph (1) shall apply with respect to the vessels referred to in
			 paragraph (1).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="H656D6DAE4CBC4813A42EFD99524C9D60"><enum>(b)</enum><header>Technical correction</header><text><external-xref legal-doc="usc" parsable-cite="usc/46/4105">Section 4105(c)</external-xref> of title 46, United States Code, as redesignated by subsection (a)(1) of this
			 section, is amended by striking <quote>Within twenty-four months of the date of enactment of this subsection, the</quote> and inserting <quote>The</quote>.</text>
				</subsection></section><section id="H7452AF422533410ABB5D17853D34F7B9"><enum>320.</enum><header>Treatment of abandoned seafarers</header>
				<subsection id="HAE6293FF03E14E05A43CECD1ACB2AEDC"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/111">Chapter 111</external-xref> of title 46, United States Code, is amended by adding at the end the following:</text>

						<section id="HED788E6119EE4A51822C3E4E39BC5FDD"><enum>11113.</enum><header>Treatment of abandoned seafarers</header>
							<subsection id="HFA8C6E03B5674B4084B1D012FA5951C2"><enum>(a)</enum><header>Abandoned Seafarers Fund</header>
								<paragraph id="HA5FABF3887A94626915BF4FD6A0B38A4"><enum>(1)</enum><header>Establishment</header><text>There is established in the Treasury a separate account to be known as the Abandoned Seafarers
			 Fund.</text>
								</paragraph><paragraph id="H1CEC6159954E40F49DE57C1F800C6BF3"><enum>(2)</enum><header>Authorized uses</header><text>Amounts in the Fund may be appropriated to the Secretary for use—</text>
									<subparagraph id="H54A56E6F72734923B8D6D77499EFBC58"><enum>(A)</enum><text>to pay necessary support of a seafarer—</text>
										<clause id="H3BFD4EE3394D4127AB246DDFA5545CFA"><enum>(i)</enum><text>who—</text>
											<subclause id="HC2007637364942CE92E8B54D6EA18B1D"><enum>(I)</enum><text>was paroled into the United States under section 212(d)(5) of the Immigration and Nationality Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(d)(5)</external-xref>), or for whom the Secretary has requested parole
			 under such section; and</text>
											</subclause><subclause id="H48D920FEBAAF442A8E37EA5A02A0B0E0"><enum>(II)</enum><text display-inline="yes-display-inline">is involved in an investigation, reporting, documentation, or adjudication of any matter that is
			 related to the administration or enforcement of law by the Coast Guard; or</text>
											</subclause></clause><clause id="H2702A79B6E6D441286E1EA37E14F86C4"><enum>(ii)</enum><text>who—</text>
											<subclause id="H36087B1DC18549FEB95A2DD9610BA739"><enum>(I)</enum><text>is physically present in the United States;</text>
											</subclause><subclause id="H45DE8CDA98A349E98C381484A813F0C7"><enum>(II)</enum><text>the Secretary determines was abandoned in the United States; and</text>
											</subclause><subclause id="HEF4FD33F9AE04D929EC54AE942086E69"><enum>(III)</enum><text>has not applied for asylum under the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>); and</text>
											</subclause></clause></subparagraph><subparagraph id="H4A77FDF0FD1A491084316B1A45B20A50"><enum>(B)</enum><text>to reimburse a vessel owner or operator for the costs of necessary support of a seafarer who has
			 been paroled into the United States to facilitate an investigation,
			 reporting, documentation, or adjudication of any matter that is related to
			 the administration or enforcement of law by the Coast Guard, if—</text>
										<clause id="H53CBC65EF7C842D3B9F1027882DB1741"><enum>(i)</enum><text>the vessel owner or operator is not convicted of a criminal offense related to such matter; or</text>
										</clause><clause id="H5B66AE80D7BF48E298B3892275F7DA3D"><enum>(ii)</enum><text>the Secretary determines that reimbursement is appropriate.</text>
										</clause></subparagraph></paragraph><paragraph id="HF2283B78AE214B48A93AD61E61F316BF"><enum>(3)</enum><header>Crediting of amounts to fund</header>
									<subparagraph id="HF949C81309164969A712CC701B357EC1"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), there shall be credited to the Fund the following:</text>
										<clause id="H1FA495613DE1430C858A39D5CEE94B04"><enum>(i)</enum><text>Penalties deposited in the Fund under section 9 of the Act to Prevent Pollution from Ships (33
			 U.S.C. 1908).</text>
										</clause><clause id="H634368D51775404BBABBC66A17F143C6"><enum>(ii)</enum><text>Amounts reimbursed or recovered under subsection (c).</text>
										</clause></subparagraph><subparagraph id="H98C2213D8F6E4ADE85D0F40ECD084FFE"><enum>(B)</enum><header>Limitation</header><text>Amounts may be credited to the Fund under subparagraph (A) only if the unobligated balance of the
			 Fund is less than $5,000,000.</text>
									</subparagraph></paragraph><paragraph id="H83ECCADD6CF44052B10459D7EA9B6D76"><enum>(4)</enum><header>Report required</header><text>On the date on which the President submits each budget for a fiscal year pursuant to section 1105
			 of title 31, the Secretary shall submit to the Committee on Transportation
			 and Infrastructure of the House of Representatives and the Committee on
			 Commerce, Science, and Transportation of the Senate a report that
			 describes—</text>
									<subparagraph id="H2819C7B1C37440189BE7FE5733FE509B"><enum>(A)</enum><text>the amounts credited to the Fund under paragraph (2) for the preceding fiscal year; and</text>
									</subparagraph><subparagraph id="H250D8325B66D4E7B8681B7EB30BA234B"><enum>(B)</enum><text>amounts in the Fund that were expended for the preceding fiscal year.</text>
									</subparagraph></paragraph></subsection><subsection id="H50F8E8C26E9D430E92952C9A0442F8F0"><enum>(b)</enum><header>Limitation</header><text>Nothing in this section shall be construed—</text>
								<paragraph id="HEBB06DC9C10E4B0A969BFD37CDD51B0C"><enum>(1)</enum><text>to create a private right of action or any other right, benefit, or entitlement to necessary
			 support for any person; or</text>
								</paragraph><paragraph id="H06B2228E272D4B2F912168CF21251A61"><enum>(2)</enum><text>to compel the Secretary to pay or reimburse the cost of necessary support.</text>
								</paragraph></subsection><subsection id="HCE8F460DFD3C4BD790B2924B3A225E77"><enum>(c)</enum><header>Reimbursement; recovery</header>
								<paragraph id="HE38A859D17C34FB78EB9FEE24984C5E4"><enum>(1)</enum><header>In general</header><text>A vessel owner or operator shall reimburse the Fund an amount equal to the total amount paid from
			 the Fund for necessary support of a seafarer, if—</text>
									<subparagraph id="H3343D3FA143141BF833E650D6451DDD5"><enum>(A)</enum><text>the vessel owner or operator—</text>
										<clause id="H2DB4A4203B0542AA8D9EA0C52C942313"><enum>(i)</enum><text>during the course of an investigation, reporting, documentation, or adjudication of any matter
			 under this Act that the Coast Guard referred to a United States attorney
			 or the Attorney General, fails to provide necessary support of a seafarer
			 who was paroled into the United States to facilitate the investigation,
			 reporting, documentation, or adjudication; and</text>
										</clause><clause id="HF59B61DECBAE4E5A82622DB951D8D093"><enum>(ii)</enum><text>subsequently is—</text>
											<subclause id="H3E71602C4E4B4800BB575F02D526CB65"><enum>(I)</enum><text>convicted of a criminal offense related to such matter; or</text>
											</subclause><subclause id="H17AECA78BFC042739D477E1280D71468"><enum>(II)</enum><text>required to reimburse the Fund pursuant to a court order or negotiated settlement related to such
			 matter; or</text>
											</subclause></clause></subparagraph><subparagraph id="HE35C447F3EFA4A35BDF20BB0DFDD1473"><enum>(B)</enum><text>the vessel owner or operator abandons a seafarer in the United States, as determined by the
			 Secretary based on substantial evidence.</text>
									</subparagraph></paragraph><paragraph id="HA564CB3D26334CE4BCD55A9974B27B3E"><enum>(2)</enum><header>Enforcement</header><text>If a vessel owner or operator fails to reimburse the Fund under paragraph (1) within 60 days after
			 receiving a written, itemized description of reimbursable expenses and a
			 demand for payment, the Secretary may—</text>
									<subparagraph id="HF1036B3D774245FCB27976A205E308C2"><enum>(A)</enum><text>proceed in rem against the vessel on which the seafarer served in the Federal district court for
			 the district in which the vessel is found; and</text>
									</subparagraph><subparagraph id="H663AA95FE0854230A1ED60F5DCB1EEE9"><enum>(B)</enum><text>withhold or revoke the clearance required under section 60105 for the vessel and any other vessel
			 operated by the same operator (as that term is defined in section 2(9)(a)
			 of the Act to Prevent Pollution from Ships (33 U.S.C. 1901(9)(a)) as the
			 vessel on which the seafarer served.</text>
									</subparagraph></paragraph><paragraph id="HA6364ECA11AF4C33BC910BEF943179AE"><enum>(3)</enum><header>Obtaining clearance</header><text>A vessel may obtain clearance from the Secretary after it is withheld or revoked under paragraph
			 (2)(B) if the vessel owner or operator—</text>
									<subparagraph id="H6C8CF4FD58614428B84906823CE10DCD"><enum>(A)</enum><text>reimburses the Fund the amount required under paragraph (1); or</text>
									</subparagraph><subparagraph id="H75236C2D52C640BEB3AD101C708F11FD"><enum>(B)</enum><text>provides a bond, or other evidence of financial responsibility, sufficient to meet the amount
			 required to be reimbursed under paragraph (1).</text>
									</subparagraph></paragraph><paragraph id="H8F0A2C2D40F8417D962ED6E64C186EDD"><enum>(4)</enum><header>Notification required</header><text>The Secretary shall notify the vessel at least 72 hours before taking any action under paragraph
			 (2)(B).</text>
								</paragraph></subsection><subsection id="H6D0E7E0338094A7EAB0AF2AAADC86CC6"><enum>(d)</enum><header>Definitions</header><text>In this section:</text>
								<paragraph id="H1509C68F567B48BC8D5A2FBEBC1700E3"><enum>(1)</enum><header>Abandons; abandoned</header><text>Each of the terms <quote>abandons</quote> and <quote>abandoned</quote> means—</text>
									<subparagraph id="HD326E3AC7CC442E4AB00E66BB2AD7C04"><enum>(A)</enum><text>a vessel owner’s or operator’s unilateral severance of ties with a seafarer; or</text>
									</subparagraph><subparagraph id="H2431E31B400E40AB8593337FED4ADB3A"><enum>(B)</enum><text>a vessel owner’s or operator’s failure to provide necessary support of a seafarer.</text>
									</subparagraph></paragraph><paragraph id="HDF69A36087A44C74A379B9FD966499EA"><enum>(2)</enum><header>Fund</header><text>The term <quote>Fund</quote> means the Abandoned Seafarers Fund established under this section.</text>
								</paragraph><paragraph id="H18A8B5712F004B98895A4AD6B88D79FA"><enum>(3)</enum><header>Necessary support</header><text>The term <quote>necessary support</quote> means normal wages and expenses the Secretary considers reasonable for lodging, subsistence,
			 clothing, medical care (including hospitalization), repatriation, and any
			 other support the Secretary considers to be appropriate.</text>
								</paragraph><paragraph id="H46CBB4168273497CAFD3D5DDDA32ED64"><enum>(4)</enum><header>Seafarer</header><text>The term <quote>seafarer</quote> means an alien crew member who is employed or engaged in any capacity on board a vessel subject to
			 the jurisdiction of the United States.</text>
								</paragraph><paragraph id="HDFF778D93CA34525A76ECBCD19A1FB29"><enum>(5)</enum><header>Vessel subject to the jurisdiction of the United States</header><text>The term <quote>vessel subject to the jurisdiction of the United States</quote> has the meaning given that term in section 70502(c), except that it does not include a vessel that
			 is—</text>
									<subparagraph id="HB1ACF298421746929980CE2B374E56C3"><enum>(A)</enum><text>owned, or operated under a bareboat charter, by the United States, a State or political subdivision
			 thereof, or a foreign nation; and</text>
									</subparagraph><subparagraph id="H1F2C11A0D6354A24BE2186A016529991"><enum>(B)</enum><text>not engaged in commerce.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H05BE4F0F1C774C67B45AE7CB48556EDF"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for such chapter is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H903E8A8024D54095A4468FA64F5DD082" style="OLC">
						<toc regeneration="no-regeneration">
							<toc-entry level="section">11113. Treatment of abandoned seafarers.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H545B4391266B4E3E8DFDFE138BD4B77A"><enum>(c)</enum><header>Conforming amendment</header><text>Section 9 of the Act to Prevent Pollution from Ships (<external-xref legal-doc="usc" parsable-cite="usc/33/1908">33 U.S.C. 1908</external-xref>) is amended by adding at the
			 end the following:</text>
					<quoted-block id="H430B0CB352144C66B962E7F272CC0F37" style="OLC">
						<subsection id="H681DFF0ACBC74E1E913AD33C82F15EFF"><enum>(g)</enum><text>Any penalty collected under subsection (a) or (b) that is not paid under that subsection to the
			 person giving information leading to the conviction or assessment of such
			 penalties shall be deposited in the Abandoned Seafarers Fund established
			 under <external-xref legal-doc="usc" parsable-cite="usc/46/11113">section 11113</external-xref> of title 46, United States Code.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section commented="no" id="HF4E0E6D67F564511BB2FF9EF6A7E6F3C"><enum>321.</enum><header>Enforcement</header>
				<subsection commented="no" id="HCF302A4351D74CF18F708FF7091AF711"><enum>(a)</enum><header>In General</header><text><external-xref legal-doc="usc" parsable-cite="usc/46/55305">Section 55305(d)</external-xref> of title 46, United States Code, is amended—</text>
					<paragraph commented="no" id="H0F8E06CDB5B14C04B3F8CC9CF666C5A8"><enum>(1)</enum><text>by amending paragraph (1) to read as follows:</text>
						<quoted-block id="HB3F43B32326C49F8838D4DBAD0B03F26" style="OLC">
							<paragraph commented="no" id="HBF4AB7601011423799514B7B6FBDD6E0"><enum>(1)</enum><text>Each department or agency that has responsibility for a program under this section shall administer
			 that program consistent with this section and any regulations and guidance
			 issued by the Secretary of Transportation concerning this section.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</paragraph><paragraph commented="no" id="HA7C19648BF394865A68D12604B33B2CA"><enum>(2)</enum><text>by redesignating paragraph (2) as paragraph (3), and by inserting after paragraph (1) the
			 following:</text>
						<quoted-block id="HACF7A0CC81024A118B7EC57E1BEBA3E7" style="OLC">
							<paragraph commented="no" id="H7C6E6C4A13884B279EF82EC0463FCDF9"><enum>(2)</enum>
								<subparagraph commented="no" display-inline="yes-display-inline" id="HB406A4CEEB46483998293B8CAB79674C"><enum>(A)</enum><text>The Secretary shall have exclusive authority for determining the applicability of this section to a
			 program of a Federal department or agency.</text>
								</subparagraph><subparagraph commented="no" id="HB4319746CE3C4D638BBAE86D720A6073" indent="up1"><enum>(B)</enum><text>The head of a Federal department or agency shall request the Secretary to determine the
			 applicability of this section to a program of such department or agency if
			 the department or agency is uncertain of such applicability. Not later
			 than 30 days after receiving such a request, the Secretary shall make such
			 determination.</text>
								</subparagraph><subparagraph commented="no" id="H5BF823E4185A4B87B336309C7753C2DE" indent="up1"><enum>(C)</enum><text>Subparagraph (B) shall not be construed to limit the authority of the Secretary to make a
			 determination regarding the applicability of this section to a program
			 administered by a Federal department or agency.</text>
								</subparagraph><subparagraph commented="no" id="HBE57A309F7864D00AD9AD6468E3BE189" indent="up1"><enum>(D)</enum><text>A determination made by the Secretary under this paragraph regarding a program shall remain in
			 effect until the Secretary determines that this section no longer applies
			 to such program.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</paragraph><paragraph commented="no" id="H1715497026F143E1AC6AF10A233B3C19"><enum>(3)</enum><text>in paragraph (3), as so redesignated, by amending subparagraph (A) to read as follows:</text>
						<quoted-block id="H6CEA7700D8F24E2A83A0DB03C521B095" style="OLC">
							<subparagraph commented="no" id="HC75C8363A8524456B8752F5D7E4693DF"><enum>(A)</enum><text>shall conduct an annual review of the administration of programs subject to the requirements of
			 this section to determine compliance with the requirements of this
			 section;</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
					</paragraph><paragraph commented="no" id="H249FDAC4F5E140B08C16B5C24068D98B"><enum>(4)</enum><text>by adding at the end the following:</text>
						<quoted-block id="H1E7195155BB2418E970B97B86FC8515B" style="OLC">
							<paragraph commented="no" id="H5C19377902CE4CB58A48CC0CC1A601C0"><enum>(4)</enum><text>On the date on which the President submits to Congress a budget pursuant to section 1105 of title
			 31, the Secretary shall make available on the Internet website of the
			 Department of Transportation a report that—</text>
								<subparagraph commented="no" id="H940AD09182C84C6F922AAA6065B59B18"><enum>(A)</enum><text>lists the programs that were subject to determinations made by the Secretary under paragraph (2) in
			 the preceding year; and</text>
								</subparagraph><subparagraph commented="no" id="H01638F41386D45DA8B24E17D274C906F"><enum>(B)</enum><text>describes the results of the most recent annual review required by paragraph (3)(A), including
			 identification of the departments and agencies that transported cargo in
			 violation of this section and any action the Secretary took under
			 paragraph (3) with respect to each violation.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection commented="no" id="H281FE4601C7E444C8AA401093FE190AC"><enum>(b)</enum><header>Deadline for first review</header><text>The Secretary of Transportation shall complete the first review required under the amendment made
			 by subsection (a)(1)(C) by not later than December 31, 2015.</text>
				</subsection><subsection commented="no" id="H8E1BAFB2ABC940AE844C36166AFBFF36"><enum>(c)</enum><header>Conforming amendment</header><text>Section 3511(c) of the Duncan Hunter National Defense Authorization Act for Fiscal Year 2009 (46
			 U.S.C. 55305 note) is repealed.</text>
				</subsection></section><section id="H678A6E733B8C4461B135873346185ADF"><enum>322.</enum><header>Coast Guard regulations</header>
				<subsection id="H2DFE328455384AF3938AB800C2876DA3"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date of the enactment of this Act, the Secretary of the department
			 in which the Coast Guard is operating shall submit to the Committee on
			 Commerce, Science, and Transportation of the Senate and the Committee on
			 Transportation and Infrastructure of the House of Representatives an
			 analysis of the Coast Guard’s proposed promulgation of safety and
			 environmental management system requirements for vessels engaged in Outer
			 Continental Shelf activities. The analysis shall include—</text>
					<paragraph id="H749D04D5DCF34A289C307BAAC2E40A39"><enum>(1)</enum><text>a discussion of any new operational, management, design and construction, financial, and other
			 mandates that would be imposed on vessel owners and operators;</text>
					</paragraph><paragraph id="HEEEBFE63E8A649E49C9A88E1E1477A85"><enum>(2)</enum><text>an estimate of all associated direct and indirect operational, management, personnel, training,
			 vessel design and construction, record keeping, and other costs;</text>
					</paragraph><paragraph id="HDCC91552566044F89AF6A0343FD727E4"><enum>(3)</enum><text>an identification and justification of any of such proposed requirements that exceed those in
			 international conventions applicable to the design, construction,
			 operation, and management of vessels engaging in United States Outer
			 Continental Shelf activities; and</text>
					</paragraph><paragraph id="H7F57826B80C44C8C9484D1D05BA60C6A"><enum>(4)</enum><text>an identification of exemptions to the proposed requirements, that are based upon vessel
			 classification, tonnage, offshore activity or function, alternative
			 certifications, or any other appropriate criteria.</text>
					</paragraph></subsection><subsection id="HFA8CBF5F65E34F15ACEB202D48C3FFC7"><enum>(b)</enum><header>Limitation</header><text display-inline="yes-display-inline">The Secretary may not issue proposed regulations relating to safety and environmental management
			 system requirements for vessels on the United States Outer Continental
			 Shelf for which noticed was published on September 10, 2013 (78 Fed. Reg.
			 55230) earlier than 6 months after the submittal of the analysis required
			 by subsection (a).</text>
				</subsection></section><section id="H529888FF757D43CBBC70C405D1528DE0" section-type="subsequent-section"><enum>323.</enum><header>Website</header>
				<subsection id="H97DB02077EBB4C24AE2D5C8B93480F4A"><enum>(a)</enum><header>Reports to Secretary of Transportation; incidents and details</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/46/3507">Section 3507(g)(3)(A)</external-xref> of title 46, United States Code, is amended—</text>
					<paragraph id="HC16D69A7B51043BDB0D972768AF67748"><enum>(1)</enum><text display-inline="yes-display-inline">in clause (ii) by striking <quote>the incident to an Internet based portal maintained by the Secretary</quote> and inserting <quote>each incident specified in clause (i) to the Internet website maintained by the Secretary of
			 Transportation under paragraph (4)(A)</quote>; and</text>
					</paragraph><paragraph id="H917C76524FE5427C9F8E3ADF06D5C2EC"><enum>(2)</enum><text display-inline="yes-display-inline">in clause (iii) by striking <quote>based portal maintained by the Secretary</quote> and inserting <quote>website maintained by the Secretary of Transportation under paragraph (4)(A)</quote>.</text>
					</paragraph></subsection><subsection id="H5BCF5C2975E54DE9B4CA7ADAF4E5ABF6"><enum>(b)</enum><header>Availability of incident data on Internet</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/46/3507">Section 3507(g)(4)</external-xref> of title 46, United States Code, is amended—</text>
					<paragraph id="H2325A9D380F64DEB829C9C2E4546284F"><enum>(1)</enum><text display-inline="yes-display-inline">by striking subparagraph (A) and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="H1EEFC04385E24B4D8CDD44C1CFEBDB2C" style="OLC">
							<subparagraph id="H9E00A68C449D4112ADCDE1128EBCA3BC"><enum>(A)</enum><header>Website</header>

			 a cruise vessel specified in paragraph (3)(A)(i) on an Internet website
			 that provides a numerical accounting of the missing persons and alleged
			 crimes reported under that paragraph without regard to the investigative
			 status of the incident.</text>
								</clause><clause id="HF2F991A3201B4AABA6C783A3EC600BD2"><enum>(ii)</enum><header>Updates and other requirements</header><text>The compilation under clause (i) shall—</text>
									<subclause id="H24D8C071713F4A63913225CE8BE5800C"><enum>(I)</enum><text>be updated not less frequently than quarterly;</text>
									</subclause><subclause id="H7AA39200EA5740448C6C18F6CDE3FD74"><enum>(II)</enum><text>be able to be sorted by cruise line;</text>
									</subclause><subclause id="H2F4B1D8AA92741C6A95222B1908BE25E"><enum>(III)</enum><text>identify each cruise line by name;</text>
									</subclause><subclause id="H0FC043C63C2041F78D56BD79E9AE6671"><enum>(IV)</enum><text>identify each crime or alleged crime committed or allegedly committed by a passenger or crewmember;
			 and</text>
									</subclause><subclause id="H57D7D794A7534A988E3186D5DD47D5B0"><enum>(V)</enum><text>identify the number of individuals alleged overboard.</text>
									</subclause></clause><clause id="H6E17F5422E444CEC97058CD2BA798F7B"><enum>(iii)</enum><header>User-friendly format</header><text display-inline="yes-display-inline">The Secretary of Transportation shall ensure that the compilation, data, and any other information
			 provided on the Internet website maintained under this subparagraph are in
			 a user-friendly format.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
					</paragraph><paragraph id="HD2C44CFB56174854BEC1D231FFA34D94"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (B) by striking <quote>Secretary</quote> and inserting <quote>Secretary of Transportation</quote>.</text>
					</paragraph></subsection></section></title><title id="H9BB92D0C375F4840A60692D311C03005"><enum>IV</enum><header>Federal Maritime Commission</header>
			<section id="HA72EA103C70B4C1588D7297EA64B9031"><enum>401.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated to the Federal Maritime Commission $24,700,000 for fiscal
			 year 2015.</text>
			</section><section id="H6E14171AE7264F3A96AD6D9B3935588F"><enum>402.</enum><header>Award of reparations</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/46/41305">Section 41305</external-xref> of title 46, United States Code, is amended—</text>
				<paragraph id="H7CB57586682E4A0D8BB0D35DF11F242D"><enum>(1)</enum><text>in subsection (b), by striking <quote>, plus reasonable attorney fees</quote>; and</text>

				<subsection id="H16D791D265374A379D1F418DE64BEC81"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/46/301">Section 301(b)</external-xref> of title 46, United States Code, is amended—</text>
					<paragraph id="H2946964BD0614FBC9AA584A47772E1BA"><enum>(1)</enum><text>by amending paragraph (2) to read as follows:</text>
						<quoted-block id="H3671C0351FDB471D9CB258A0702C5877" style="OLC">
							<paragraph id="H4DF02103F3444603BC709BF51A1E474E"><enum>(2)</enum><header>Terms</header><text>The term of each Commissioner is 5 years. When the term of a Commissioner ends, the Commissioner
			 may continue to serve until a successor is appointed and qualified, but
			 for a period not to exceed one year. Except as provided in paragraph (3),
			 no individual may serve more than 2 terms.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>

			 bonds of any entity the Commission regulates under chapter 401 of this
			 title.</text>
								</subparagraph><subparagraph id="H4595D236602D4CF99F8F0694F2B62EB2"><enum>(B)</enum><header>Limitation on other activities</header><text>A Commissioner may not engage in another business, vocation, or employment.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="H235DAAD9CFAA4A0FB076FAF4FEAD44AF"><enum>(b)</enum><header>Applicability</header><text>The amendment made by subsection (a)(1) does not apply with respect to a Commissioner of the
			 Federal Maritime Commission appointed and confirmed by the Senate before
			 the date of the enactment of this Act.</text>

				<subsection id="H485733FC8CFB4D8EA335178AEB44D01D"><enum>(a)</enum><header>Arctic maritime transportation</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/14/5">Chapter 5</external-xref> of title 14, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/14/89">section 89</external-xref> the following:</text>

							<subsection id="H7E1A505724A34CC8BE74BECF3588AC65"><enum>(a)</enum><header>Purpose</header><text>The purpose of this section is to ensure safe and secure maritime shipping in the Arctic including
			 the availability of aids to navigation, vessel escorts, spill response
			 capability, and maritime search and rescue in the Arctic.</text>
							</subsection><subsection id="H7B369080E5B64AD2887FB664C558D0B8"><enum>(b)</enum><header>International Maritime Organization Agreements</header><text>To carry out the purpose of this section, the Secretary is encouraged to enter into negotiations
			 through the International Maritime Organization to conclude and execute
			 agreements to promote coordinated action among the United States, Russia,
			 Canada, Iceland, Norway, and Denmark and other seafaring and Arctic
			 nations to ensure, in the Arctic—</text>
								<paragraph id="H0031DF5958644B8494AEDE7C92F6958E"><enum>(1)</enum><text>placement and maintenance of aids to navigation;</text>
								</paragraph><paragraph id="H8ABF98E5FA1E4000AFF7703A65832FF5"><enum>(2)</enum><text>appropriate marine safety, tug, and salvage capabilities;</text>
								</paragraph><paragraph id="H1F431A1465B647A580B9FFE5DDA0CB3B"><enum>(3)</enum><text>oil spill prevention and response capability;</text>
								</paragraph><paragraph id="HA4ED053C67D04611B34AD2CE72DDA28D"><enum>(4)</enum><text>maritime domain awareness, including long-range vessel tracking; and</text>
								</paragraph><paragraph id="HBB854C86BEB243D6BAE852878C246E97"><enum>(5)</enum><text>search and rescue.</text>
								</paragraph></subsection><subsection id="HFF78F1E9062E49D28013B0820179832D"><enum>(c)</enum><header>Coordination by Committee on the Maritime Transportation System</header><text>The Committee on the Maritime Transportation System established under <external-xref legal-doc="usc" parsable-cite="usc/46/55501">section 55501</external-xref> of title 46,
			 United States Code, shall coordinate the establishment of domestic
			 transportation policies in the Arctic necessary to carry out the purpose
			 of this section.</text>
							</subsection><subsection id="H00BB4A88FA9247A5B216988367849A2E"><enum>(d)</enum><header>Agreements and contracts</header><text>The Secretary may, subject to the availability of appropriations, enter into cooperative
			 agreements, contracts, or other agreements with, or make grants to,
			 individuals and governments to carry out the purpose of this section or
			 any agreements established under subsection (b).</text>
							</subsection><subsection id="H207EF027554F4EF6BA2457183D0700B7"><enum>(e)</enum><header>Icebreaking</header><text>The Secretary shall promote safe maritime navigation by means of icebreaking where necessary,
			 feasible, and effective to carry out the purposes of this section.</text>
							</subsection><subsection id="HC20E9F40F0C74EBC820B4B17FA34C8D7"><enum>(f)</enum><header>Arctic definition</header><text>In this section, the term <quote>Arctic</quote> has the meaning given such term in section 112 of the Arctic Research and Policy Act of 1984 (15
			 U.S.C. 4111).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HFE32BE9E203141DEA3DE2AD50DED13B5"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for such chapter is amended by inserting after the item relating to section 89 the

								<paragraph id="HDF4737B7831D45B9B24D51BD7F110BAA"><enum>(1)</enum><text>by promoting interagency cooperation and coordination;</text>
								</paragraph><paragraph id="HC9481FCB3A5C44AD94CFABB484FDCFA2"><enum>(2)</enum><text>by employing joint, interagency, and international capabilities; and</text>
								</paragraph><paragraph id="H31637C4DD37F49829C7B531276B8CC4D"><enum>(3)</enum><text>by facilitating the sharing of information, intelligence, and data related to the Arctic maritime
			 domain between the Coast Guard and departments and agencies listed in
			 subsection (b).</text>
								</paragraph></subsection><subsection id="H9B08572F85014A04AA410FED046014C4"><enum>(b)</enum><header>Coordination</header><text>The Commandant shall seek to coordinate the collection, sharing, and use of information,
			 intelligence, and data related to the Arctic maritime domain between the
			 Coast Guard and the following:</text>

								</paragraph><paragraph id="H178D9CADA61445BBBE102A42ADC4D527"><enum>(5)</enum><text>The Department of the Interior.</text>

			 a reimbursable basis or otherwise, share personnel, services, equipment,
			 and facilities to carry out the requirements of this section.</text>
							</subsection><subsection id="H6FE36AF48F9642C6B427CDFA5D355B9B"><enum>(d)</enum><header>5-Year strategic plan</header><text>Not later than January 1, 2016 and every 5 years thereafter, the Commandant shall submit to the
			 Committee on Commerce, Science, and Transportation of the Senate and the
			 Committee on Transportation and Infrastructure of the House of
			 Representatives a 5-year strategic plan to guide interagency and
			 international intergovernmental cooperation and coordination for the
			 purpose of improving maritime domain awareness in the Arctic</text>
							</subsection><subsection id="H3FBAB2C0C84A41778630B3B9F5BAF694"><enum>(e)</enum><header>Definitions</header><text>In this section the term <quote>Arctic</quote> has the meaning given that term in section 112 of the Arctic Research and Policy Act of 1984 (15
			 U.S.C. 4111).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H39DBD0A1DC1B48619A12B94B5415C806"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for such chapter is amended by inserting after the item relating to section 153 the
			 following:</text>

				</subsection></section><section display-inline="no-display-inline" id="H8C0D3423E0F3406B8CC0F027418C4BB8" section-type="subsequent-section"><enum>503.</enum><header>IMO Polar Code negotiations</header><text display-inline="no-display-inline">Not later than 30 days after the date of the enactment of this Act, and thereafter with the
			 submission of the budget proposal submitted for each of fiscal years 2016,
			 2017, and 2018 under <external-xref legal-doc="usc" parsable-cite="usc/31/1105">section 1105</external-xref> of title 31, United States Code, the
			 Secretary of the department in which the Coast Guard is operating shall
			 submit to the Committee on Transportation and Infrastructure of the House
			 of Representatives and the Committee on Commerce, Science, and
			 Transportation of the Senate, a report on—</text>
				<paragraph id="H47A8B900C06B4CB8B377440544D98225"><enum>(1)</enum><text>the status of the negotiations at the International Maritime Organization regarding the
			 establishment of a draft international code of safety for ships operating
			 in polar waters, popularly known as the Polar Code, and any amendments
			 proposed by such a code to be made to the International Convention for the
			 Safety of Life at Sea and the International Convention for the Prevention
			 of Pollution from Ships;</text>
				</paragraph><paragraph id="HDEADD7C5841641BDB3DC90153027EF31"><enum>(2)</enum><text display-inline="yes-display-inline">the coming into effect of such a code and such amendments for nations that are parties to those
			 conventions;</text>
				</paragraph><paragraph id="H74DB441D73754013B727A47A7632D9F7"><enum>(3)</enum><text display-inline="yes-display-inline">impacts, for coastal communities located in the Arctic (as that term is defined in the section 112
			 of the Arctic Research and Policy Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/15/4111">15 U.S.C. 4111</external-xref>)) of such a
			 code or such amendments, on—</text>
					<subparagraph id="H40A2239FAEE649F9805E88B1A7C06809"><enum>(A)</enum><text>the costs of delivering fuel and freight; and</text>
					</subparagraph><subparagraph id="HA0D6FCFC0CC74E5AAB552920FDA7B770"><enum>(B)</enum><text>the safety of maritime transportation; and</text>
					</subparagraph></paragraph><paragraph id="HD0D31906232B482FA8F26471F833A204"><enum>(4)</enum><text>actions the Secretary must take to implement the requirements of such a code and such amendments.</text>
				</paragraph></section><section id="H6AC40F7184D442978490729B8BE33473"><enum>504.</enum><header>Forward operating facilities</header><text display-inline="no-display-inline">The Secretary of the department in which the Coast Guard is operating may construct facilities in
			 the Arctic (as that term is defined in section 112 of the Arctic Research
			 and Policy Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/15/4111">15 U.S.C. 4111</external-xref>). The facilities shall—</text>
				<paragraph id="H2D4016F4419C4CF1B6AF758171B8FBE8"><enum>(1)</enum><text>support aircraft maintenance, including exhaust ventilation, heat, an engine wash system, fuel,
			 ground support services, and electrical power;</text>
				</paragraph><paragraph id="HE242B3ED339F42408F6971E9AC7B7D22"><enum>(2)</enum><text>provide shelter for both current helicopter assets and those projected to be located at Air Station
			 Kodiak, Alaska, for at least 20 years; and</text>
				</paragraph><paragraph id="H441F74393E274313ACECC5A1FE322E22"><enum>(3)</enum><text>include accommodations for personnel.</text>
				</paragraph></section><section display-inline="no-display-inline" id="H8D30E4C03308468182B82634F07B76A8" section-type="subsequent-section"><enum>505.</enum><header>Icebreakers</header>
				<subsection id="H03FFC70D55A54D58A6A7F67F0FDF8A76"><enum>(a)</enum><header>Coast Guard polar icebreakers</header><text display-inline="yes-display-inline">Section 222 of the Coast Guard and Maritime Transportation Act of 2012 (<external-xref legal-doc="public-law" parsable-cite="pl/112/213">Public Law 112–213</external-xref>; 126
			 Stat. 1560) is amended—</text>
					<paragraph id="H27FC78F90F414FC0AE61A9853AEEFB49"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (d)(2)—</text>
						<subparagraph id="HED0706A7CF7A4E51B8DAD6E80ABEE25A"><enum>(A)</enum><text>in the paragraph heading by striking <quote><header-in-text level="paragraph" style="OLC">; bridging strategy</header-in-text></quote>; and</text>
						</subparagraph><subparagraph id="H21CAA2C69D7546EE8BB591EEDDB2431F"><enum>(B)</enum><text>by striking <quote>Commandant of the Coast Guard</quote> and all that follows through the period at the end and inserting <quote>Commandant of the Coast Guard may decommission the Polar Sea.</quote>;</text>
						</subparagraph></paragraph><paragraph id="H51B29955A7984A8C93BD1755F9A4BD49"><enum>(2)</enum><text>by adding at the end of subsection (d) the following:</text>
						<quoted-block display-inline="no-display-inline" id="H2E7B2883099740BC961BED3B39BBD80D" style="OLC">
							<paragraph id="H3A6606F01416468BAC87785C63CE83E5"><enum>(3)</enum><header>Result of no determination</header><text display-inline="yes-display-inline">If in the analysis submitted under this section the Secretary does not make a determination under
			 subsection (a)(5) regarding whether it is cost effective to reactivate the
			 Polar Sea, then—</text>
								<subparagraph id="H646D83E3807B411C920658FA485EC3A5"><enum>(A)</enum><text>the Commandant of the Coast Guard may decommission the Polar Sea; or</text>
								</subparagraph><subparagraph id="H6EFE60D02E0448B4A6C75970249872DF"><enum>(B)</enum><text>the Secretary may make such determination, not later than 90 days after the date of the enactment
			 of <short-title>Howard Coble Coast Guard and Maritime Transportation Act of 2014</short-title>, and take actions in accordance with this subsection as though such determination was made in the
			 analysis previously submitted.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</paragraph><paragraph id="H1CFC110852EB472AAA712EB29A2456DE"><enum>(3)</enum><text>by redesignating subsections (e), (f), and (g) as subsections (f), (g), and (h), respectively; and</text>
					</paragraph><paragraph id="H38C9E0E13F204F71A7C3A2B228F4FBF6"><enum>(4)</enum><text>by inserting after subsection (d) the following:</text>
						<quoted-block display-inline="no-display-inline" id="H4E55AE1288F84C65A2E0502E94E6DFD0" style="OLC">
							<subsection id="HA264A0F6981D4D0EA4D6AE0D71083500"><enum>(e)</enum><header>Strategies</header>
								<paragraph id="HD7CB3FC7CAAA42DBA9A992EAD1FFD2D2"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date on which the analysis required under subsection (a) is
			 submitted, the Commandant of the Coast Guard shall submit to the Committee
			 on Transportation and Infrastructure of the House of Representatives and
			 the Committee on Commerce, Science, and Transportation of the Senate—</text>
									<subparagraph id="H9A10E7AF635844929299FB761A4A592E"><enum>(A)</enum><text display-inline="yes-display-inline">unless the Secretary makes a determination under this section that it is cost effective to
			 reactivate the Polar Sea, a bridging strategy for maintaining the Coast
			 Guard’s polar icebreaking services until at least September 30, 2024;</text>
									</subparagraph><subparagraph id="HAE4CBBF545794691A31E864A2BF6160D"><enum>(B)</enum><text>a strategy to meet the Coast Guard’s Arctic ice operations needs through September 30, 2050; and</text>
									</subparagraph><subparagraph id="H3C871190B2A349ADA92C6D408DC18AB3"><enum>(C)</enum><text display-inline="yes-display-inline">a strategy to meet the Coast Guard’s Antarctic ice operations needs through September 30, 2050.</text>
									</subparagraph></paragraph><paragraph id="HBE497AE49FE343BEA5203A5468DE5873"><enum>(2)</enum><header>Requirement</header><text display-inline="yes-display-inline">The strategies required under paragraph (1) shall include a business case analysis comparing the
			 leasing and purchasing of icebreakers to maintain the needs and services
			 described in that paragraph.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="H10B062484CCC4E66A4F2CAA9D7760E33"><enum>(b)</enum><header>Cutter <quote>Polar Sea</quote></header><text>Upon the submission of a service life extension plan in accordance with section 222(d)(1)(C) of the
			 Coast Guard and Maritime Transportation Act of 2012 (<external-xref legal-doc="public-law" parsable-cite="pl/112/213">Public Law 112–213</external-xref>;
			 126 Stat. 1560), the Secretary of the department in which the Coast Guard
			 is operating may use funds authorized under section 101 of this Act to
			 conduct a service life extension of 7 to 10 years for the Coast Guard
			 Cutter Polar Sea (WAGB 11) in accordance with such plan.</text>
				</subsection><subsection id="HA2AC667EC78F4F9BADBFA52B75873235"><enum>(c)</enum><header>Limitation</header>
					<paragraph id="HF98B8EB762E140F1828BDABED68ED117"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of the department in which the Coast Guard is operating may not expend amounts
			 appropriated for the Coast Guard for any of fiscal years 2015 through
			 2024, for—</text>
						<subparagraph id="HBAECEF13184946289D01D1025B1AD49F"><enum>(A)</enum><text display-inline="yes-display-inline">design activities related to a capability of a Polar-Class Icebreaker that is based solely on an
			 operational requirement of another Federal department or agency, except
			 for amounts appropriated for design activities for a fiscal year before
			 fiscal year 2016; or</text>
						</subparagraph><subparagraph id="H255CEBD9EA704B9F9E67908B9CF4BF29"><enum>(B)</enum><text>long-lead-time materials, production, or post-delivery activities related to such a capability.</text>
						</subparagraph></paragraph><paragraph id="HE91E1338DFAA4D3B9E033B54D4503367"><enum>(2)</enum><header>Other amounts</header><text>Amounts made available to the Secretary under an agreement with another Federal department or
			 agency and expended on a capability of a Polar-Class Icebreaker that is
			 based solely on an operational requirement of that or another Federal
			 department or agency shall not be treated as amounts expended by the
			 Secretary for purposes of the limitation established under paragraph (1).</text>
					</paragraph></subsection></section><section id="HAD43E6A8B3434638A4A87CCE13557116"><enum>506.</enum><header>Icebreaking in polar regions</header>
				<subsection id="H0DC09BC876004CBB9BC11BE7FFCA3541"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/14/5">Chapter 5</external-xref> of title 14, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/14/86">section 86</external-xref> the following:</text>

			 icebreaking operations in such regions, except for recurring incremental
			 costs associated with specific projects, to the Coast Guard.</text></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H30129F6916814FD681745EAF463358F4"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for such chapter is amended by inserting after the item relating to section 86 the

			 amended—</text>

			</section><section commented="no" id="HE79462B579824073B371250B5F69BA02"><enum>603.</enum><header>National maritime strategy</header>
				<subsection commented="no" id="H99F6E2EDB7BD41E6BAEF3884EB182C36"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 60 days after the date of the enactment of this Act, the Secretary of
			 Transportation, in consultation with the Secretary of the department in
			 which the Coast Guard is operating, shall submit to the Committee on
			 Transportation and Infrastructure of the House of Representatives and the
			 Committee on Commerce, Science, and Transportation of the Senate a
			 national maritime strategy.</text>
				</subsection><subsection commented="no" id="H0C8FC712F98A442291816EBC41272F3D"><enum>(b)</enum><header>Contents</header><text>The strategy required under subsection (a) shall—</text>
					<paragraph commented="no" id="H9021E95754E442318DAFF165498A60E9"><enum>(1)</enum><text>identify—</text>
						<subparagraph commented="no" id="HFFAF76877B1F4918A233AC26253C88C4"><enum>(A)</enum><text>Federal regulations and policies that reduce the competitiveness of United States flag vessels in
			 international transportation markets; and</text>
						</subparagraph><subparagraph commented="no" id="H28015289E341463394A381AF808AFD2B"><enum>(B)</enum><text>the impact of reduced cargo flow due to reductions in the number of members of the United States
			 Armed Forces stationed or deployed outside of the United States; and</text>
						</subparagraph></paragraph><paragraph commented="no" id="H9D73192EA16D41A0AFCEB354550F3882"><enum>(2)</enum><text>include recommendations to—</text>
						<subparagraph commented="no" id="H5CA2165DDF23449C994EC5276469FC5F"><enum>(A)</enum><text>make United States flag vessels more competitive in shipping routes between United States and
			 foreign ports;</text>
						</subparagraph><subparagraph commented="no" id="HEE545D71B46B45C4A36B4DB272500F26"><enum>(B)</enum><text>increase the use of United States flag vessels to carry cargo imported to and exported from the
			 United States;</text>
						</subparagraph><subparagraph commented="no" id="H5F347C003F9640529E8BFC867D6A42CD"><enum>(C)</enum><text>ensure compliance by Federal agencies with <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/553">chapter 553</external-xref> of title 46, United States Code;</text>
						</subparagraph><subparagraph commented="no" id="H66C8055826304F66B52AA4F5C9D54D9E"><enum>(D)</enum><text>increase the use of third-party inspection and certification authorities to inspect and certify
			 vessels;</text>
						</subparagraph><subparagraph commented="no" id="HA9F2062437CB4F199DE1FB44C2F88D64"><enum>(E)</enum><text>increase the use of short sea transportation routes, including routes designated under section
			 55601(c) of title 46, United States Code, to enhance intermodal freight
			 movements; and</text>
						</subparagraph><subparagraph commented="no" id="HCDA90EE129C040FB8B90DFDF2473CEE2"><enum>(F)</enum><text>enhance United States shipbuilding capability.</text>
						</subparagraph></paragraph></subsection></section><section id="HF7B180E70C8B4318B98322A0EF49758B" section-type="subsequent-section"><enum>604.</enum><header>Waivers</header>
				<subsection id="H89A3F895B2714CB1B17C5E56F63BAC5C"><enum>(a)</enum><header><quote>John Craig</quote></header>
					<paragraph id="H2EF0B28D822D466C9BBCF2B69ED49ACD"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/46/8902">Section 8902</external-xref> of title 46, United States Code, shall not apply to the vessel John Craig (United
			 States official number D1110613) when such vessel is operating on the
			 portion of the
			 Kentucky River, Kentucky, located at approximately mile point 158, in Pool
			 Number 9, between Lock and Dam Number 9 and Lock and Dam Number 10.</text>
					</paragraph><paragraph id="HA91E8E348F6843B786E8A0E8DC04E482"><enum>(2)</enum><header>Application</header><text>Paragraph (1) shall apply on and after the date on which the Secretary of the department in which
			 the Coast Guard is operating determines that a licensing requirement has
			 been established under Kentucky State law that applies to an operator of
			 the vessel John Craig.</text>
					</paragraph></subsection><subsection id="H3FFACFCE6CE64A38A2EC646FC9E9C0B9"><enum>(b)</enum><header><quote>F/V Western Challenger</quote></header><text display-inline="yes-display-inline">Notwithstanding <external-xref legal-doc="usc" parsable-cite="usc/46/12132">section 12132</external-xref> of title 46, United States Code, the Secretary of the department in
			 which the Coast Guard is operating may issue a certificate of
			 documentation with a coastwise endorsement for the F/V Western Challenger
			 (IMO number 5388108).</text>
				</subsection></section><section id="HA9ED4C86B408435CBEF553B4FDD36716"><enum>605.</enum><header>Competition by United States flag vessels</header>
				<subsection id="HFB5A7B78F7FD46AB92F1BCD2ECC8DE4E"><enum>(a)</enum><header>In general</header><text>The Commandant of the Coast Guard shall enter into an arrangement with the National Academy of
			 Sciences to conduct an assessment of authorities under subtitle II of
			 title 46, United States Code, that have been delegated to the Coast Guard
			 and that impact the ability of vessels documented under the laws of the
			 United States to effectively compete in international transportation
			 markets.</text>
				</subsection><subsection id="HD01624BE62A94B40A8D9ABE15B7BDD41"><enum>(b)</enum><header>Review of differences with IMO standards</header><text>The assessment under subsection (a) shall include a review of differences between United States
			 laws, policies, regulations, and guidance governing the inspection of
			 vessels documented under the laws of the United States and standards set
			 by the International Maritime Organization governing the inspection of
			 vessels.</text>
				</subsection><subsection id="H82E3E382B1E548F0A8F8008A8CA8EB7D"><enum>(c)</enum><header>Deadline</header><text>Not later than 180 days after the date on which the Commandant enters into an arrangement with the
			 National Academy of Sciences under subsection (a), the Commandant shall
			 submit to the Committee on Transportation and Infrastructure of the House
			 of Representatives and the Committee on Commerce, Science, and
			 Transportation of the Senate the assessment required under such
			 subsection.</text>
				</subsection></section><section id="H0FBFD607A1C44B698FD9C0BFB6244BC3" section-type="subsequent-section"><enum>606.</enum><header>Vessel requirements for notices of arrival and departure and automatic identification system</header><text display-inline="no-display-inline">Not later than 30 days after the date of the enactment of this Act, the Secretary of the department
			 in which the Coast Guard is operating shall notify the Committee on
			 Transportation and Infrastructure of the House of Representatives and the
			 Committee on Commerce, Science, and Transportation of the Senate of the
			 status of the final rule that relates to the notice of proposed rulemaking
			 titled <quote>Vessel Requirements for Notices of Arrival and Departure, and Automatic Identification System</quote> and published in the Federal Register on December 16, 2008 (73 Fed. Reg. 76295).</text>
			</section><section id="HB7A0A9466EF7497493CC4785638CBE56"><enum>607.</enum><header>Conveyance of Coast Guard property in Rochester, New York</header>
				<subsection id="H4B18CBBD2FD345CFBEFE648300806CB4"><enum>(a)</enum><header>Conveyance authorized</header><text display-inline="yes-display-inline">The Commandant of the Coast Guard is authorized to convey, at fair market value, all right, title,
			 and interest of the United States in and to a parcel of real property,
			 consisting of approximately 0.2 acres, that is under the administrative
			 control of the Coast Guard and located at 527 River Street in Rochester,
			 New York.</text>
				</subsection><subsection id="HC77DB8B93087471CA5BC03E0942F938C"><enum>(b)</enum><header>Right of first refusal</header><text display-inline="yes-display-inline">The City of Rochester, New York, shall have the right of first refusal with respect to the
			 purchase, at fair market value, of the real property described in
			 subsection (a).</text>
				</subsection><subsection id="H8FD32C007192496E80ECAAC9BCBF6BCD"><enum>(c)</enum><header>Survey</header><text display-inline="yes-display-inline">The exact acreage and legal description of the property described in subsection (a) shall be
			 determined by a survey satisfactory to the Commandant.</text>
				</subsection><subsection id="HACCE7A57A6E64E39B9B0F3E64EE8F5E5"><enum>(d)</enum><header>Fair market value</header><text display-inline="yes-display-inline">The fair market value of the property described in subsection (a) shall—</text>
					<paragraph id="HB430C1493B6948D1A643B5C1E4816866"><enum>(1)</enum><text>be determined by appraisal; and</text>
					</paragraph><paragraph id="HE2CDCF52AA694A9EA79591516E7751F2"><enum>(2)</enum><text>be subject to the approval of the Commandant.</text>
					</paragraph></subsection><subsection id="HAB248DFF18CC42719FBE460A191E2EA3"><enum>(e)</enum><header>Costs of conveyance</header><text display-inline="yes-display-inline">The responsibility for all reasonable and necessary costs, including real estate transaction and
			 environmental documentation costs, associated with a conveyance under
			 subsection (a) shall be determined by the Commandant and the purchaser.</text>
				</subsection><subsection id="HC4756261213B4E938119E89BBC2CC7C4"><enum>(f)</enum><header>Additional terms and conditions</header><text display-inline="yes-display-inline">The Commandant may require such additional terms and conditions in connection with a conveyance
			 under subsection (a) as the Commandant considers appropriate and
			 reasonable to protect the interests of the United States.</text>
				</subsection><subsection id="H34594A63050D4A9B9D2B89C5BD34E728"><enum>(g)</enum><header>Deposit of proceeds</header><text display-inline="yes-display-inline">Any proceeds from a conveyance under subsection (a) shall be deposited in the fund established
			 under <external-xref legal-doc="usc" parsable-cite="usc/14/687">section 687</external-xref> of title 14, United States Code.</text>
				</subsection></section><section id="H01BCC95578C84C16B53868C3190C6611" section-type="subsequent-section"><enum>608.</enum><header>Conveyance of certain property in Gig Harbor, Washington</header>
				<subsection id="H88214608E2F34342AA8799D61F652E2D"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section, the following definitions apply:</text>
					<paragraph id="H397AAFC6588745588C44FC186AA81D2C"><enum>(1)</enum><header>City</header><text>The term <term>City</term> means the city of Gig Harbor, Washington.</text>
					</paragraph><paragraph id="H7BE932A68AE64462942A405584DB920E"><enum>(2)</enum><header>Property</header><text>The term <term>Property</term> means the parcel of real property, together with any improvements thereon, consisting of
			 approximately 0.86 acres of fast lands commonly identified as tract 65 of
			 lot 1 of section 8, township 21 north, range 2 east, Willamette Meridian,
			 on the north side of the entrance of Gig Harbor, narrows of Puget Sound,
			 Washington.</text>
					</paragraph><paragraph id="H46B49D273ECF4E25A058281B0ACCDA98"><enum>(3)</enum><header>Secretary</header><text>The term “Secretary” means the Secretary of the Interior.</text>
					</paragraph></subsection><subsection id="H3C8406A2481E4D82BF2C5A56E6809947"><enum>(b)</enum><header>Conveyance</header>
					<paragraph id="H6A37CCA36E5A459387A4EC9657869EF8"><enum>(1)</enum><header>Authority to convey</header><text display-inline="yes-display-inline">Not later than 30 days after the date on which the Secretary of the department in which the Coast
			 Guard is operating relinquishes the reservation of the Property for
			 lighthouse purposes, at the request of the City and subject to the
			 requirements of this section, the Secretary shall convey to the City all
			 right, title, and interest of the United States in and to the Property,
			 notwithstanding the land use planning requirements of sections 202 and 203
			 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>,
			 1713).</text>
					</paragraph><paragraph id="H2DF76D085D284B85B475F05EDA2C4C17"><enum>(2)</enum><header>Terms of conveyance</header><text display-inline="yes-display-inline">A conveyance made under paragraph (1) shall be made—</text>
						<subparagraph id="HB1545AAEE0024B7CA5301912548AC06F"><enum>(A)</enum><text>subject to valid existing rights;</text>
						</subparagraph><subparagraph id="HE3AA6387B1344134B055466DCB896DA3"><enum>(B)</enum><text>at the fair market value as described in subsection (c); and</text>
						</subparagraph><subparagraph id="H4879FD0255094220B8DF830386A50FBC"><enum>(C)</enum><text>subject to any other condition that the Secretary may consider appropriate to protect the interests
			 of the United States.</text>
						</subparagraph></paragraph><paragraph id="HDE69CFC98D184B6099A7D73170DE99AF"><enum>(3)</enum><header>Costs</header><text display-inline="yes-display-inline">The City shall pay any transaction or administrative costs associated with a conveyance under
			 paragraph (1), including the costs of the appraisal, title searches, maps,
			 and boundary and cadastral surveys.</text>
					</paragraph><paragraph id="HDF3C60916273464AA0A158E84066F910"><enum>(4)</enum><header>Conveyance is not a major Federal action</header><text display-inline="yes-display-inline">A conveyance under paragraph (1) shall not be considered a major Federal action for purposes of
			 section 102(2) of the National Environmental Policy Act of 1969 (42 U.S.C.
			 4332(2)).</text>
					</paragraph></subsection><subsection id="HF99F83D2BFD1474AB83B41BFF9AA8D8C"><enum>(c)</enum><header>Fair market value</header>
					<paragraph id="H983CAA52DFF346B4B1B63186F0DEB5E0"><enum>(1)</enum><header>Determination</header><text display-inline="yes-display-inline">The fair market value of the Property shall be—</text>
						<subparagraph id="HCD525A1305D9451992DD40770FE3B3E7"><enum>(A)</enum><text>determined by an appraisal conducted by an independent appraiser selected by the Secretary; and</text>
						</subparagraph><subparagraph id="HBEC3269BD5A945678D2E6CBC1C948E94"><enum>(B)</enum><text>approved by the Secretary in accordance with paragraph (3).</text>
						</subparagraph></paragraph><paragraph id="H286C39B73DB645BF829D958DB8AADE17"><enum>(2)</enum><header>Requirements</header><text display-inline="yes-display-inline">An appraisal conducted under paragraph (1) shall—</text>
						<subparagraph id="HD76C4F1C40674658841939303B2E9334"><enum>(A)</enum><text>be conducted in accordance with nationally recognized appraisal standards, including—</text>
							<clause id="HB31969A47B0C44D5BAA31EFCEDF0A62F"><enum>(i)</enum><text>the Uniform Appraisal Standards for Federal Land Acquisitions; and</text>
							</clause><clause id="H008FFA0B79EF43C094DF056C7CFE75F0"><enum>(ii)</enum><text>the Uniform Standards of Professional Appraisal Practice; and</text>
							</clause></subparagraph><subparagraph id="HBDFA70F3FE074DCCAF2A3157EF323490"><enum>(B)</enum><text>shall reflect the equitable considerations described in paragraph (3).</text>
						</subparagraph></paragraph><paragraph id="H2910CB09D2AF4676A461D2A1F0DBA107"><enum>(3)</enum><header>Equitable considerations</header><text display-inline="yes-display-inline">In approving the fair market value of the Property under this subsection, the Secretary shall take
			 into consideration matters of equity and fairness, including the City’s
			 past and current lease of the Property, any maintenance or improvements by
			 the City to the Property, and such other factors as the Secretary
			 considers appropriate.</text>
					</paragraph></subsection><subsection id="HF935A35F470F4F30A42AA1759C93D599"><enum>(d)</enum><header>Revocation; reversion</header><text display-inline="yes-display-inline">Effective on and after the date on which a conveyance of the Property is made under subsection
			 (b)(1)—</text>
					<paragraph id="HC80DDECFAF2A4120B237EB947F72C353"><enum>(1)</enum><text>Executive Order 3528, dated August 9, 1921, is revoked; and</text>
					</paragraph><paragraph id="H0DF7A4B6F1194FC9B23ADD0417827022"><enum>(2)</enum><text>the use of the tide and shore lands belonging to the State of Washington and adjoining and
			 bordering the Property, that were granted to the Government of the United
			 States pursuant to the Act of the Legislature, State of Washington,
			 approved March 13, 1909, the same being chapter 110 of the Session Laws of
			 1909, shall revert to the State of Washington.</text>
					</paragraph></subsection></section><section id="HBD6341EE7CD94DC68DFBF756F5FE2E0C"><enum>609.</enum><header>Vessel determination</header><text display-inline="no-display-inline">The vessel assigned United States official number 1205366 is deemed a new vessel effective on the
			 date of delivery of the vessel after January 1, 2012, from a privately
			 owned United States shipyard, if no encumbrances are on record with the
			 Coast Guard at the time of the issuance of the new certificate of
			 documentation for the vessel.</text>
			</section><section id="H7497E75B48FA4B71B534051D8344B008" section-type="subsequent-section"><enum>610.</enum><header>Safe vessel operation in Thunder Bay</header><text display-inline="no-display-inline">The Secretary of the department in which the Coast Guard is operating and the Administrator of the
			 Environmental Protection Agency may not prohibit a vessel operating within
			 the existing boundaries and any future expanded boundaries of the Thunder
			 Bay National Marine Sanctuary and Underwater Preserve from taking up or
			 discharging ballast water to allow for safe and efficient vessel operation
			 if the uptake or discharge meets all Federal and State ballast water
			 management requirements that would apply if the area were not a marine
			 sanctuary.</text>
			</section><section id="H3D0D0219A48B4F08BEF3A8F8969C4DA7" section-type="subsequent-section"><enum>611.</enum><header>Parking facilities</header>
				<subsection id="H89E54F8A0C1C4F1688D8ECDBB07225A2"><enum>(a)</enum><header>Allocation and assignment</header>
					<paragraph id="H55A5D4A0935243E3A891F362A4145364"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to the requirements of this section, the Administrator of General Services, in coordination
			 with the Commandant of the Coast Guard, shall allocate and assign the
			 spaces in parking facilities at the Department of Homeland Security St.
			 Elizabeths Campus to allow any member or employee of the Coast Guard, who
			 is assigned to the Campus, to use such spaces.</text>
					</paragraph><paragraph id="HC3A7B82561B348C989B83D8C8042D51F"><enum>(2)</enum><header>Timing</header><text display-inline="yes-display-inline">In carrying out paragraph (1), and in addition to the parking spaces allocated and assigned to
			 Coast Guard members and employees in fiscal year 2014, the Administrator
			 shall allocate and assign not less than—</text>
						<subparagraph id="H1D4B4C7C1EB840B5A9A8A483FA968A28"><enum>(A)</enum><text>300 parking spaces not later than September 30, 2015;</text>
						</subparagraph><subparagraph id="H37D92D359CA34B1AAA5A90F564600F3C"><enum>(B)</enum><text>700 parking spaces not later than September 30, 2016; and</text>
						</subparagraph><subparagraph id="H93BB7C0D8840474BB6A00D71C3C8D383"><enum>(C)</enum><text>1,042 parking spaces not later than September 30, 2017.</text>
						</subparagraph></paragraph></subsection><subsection id="H9781881C2EB7418A9AF351E40154C094"><enum>(b)</enum><header>Transportation management report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, and each fiscal year thereafter
			 in which spaces are allocated and assigned under subsection (a)(2), the
			 Administrator shall provide to the Committee on Commerce, Science, and
			 Transportation of the Senate and the Committee on Transportation and
			 Infrastructure of the House of Representatives a report on—</text>
					<paragraph id="HEE8FDDA7104B4824B6C4FA8D7D8B6C56"><enum>(1)</enum><text>the impact of assigning and allocating parking spaces under subsection (a) on the congestion of
			 roads connecting the St. Elizabeths Campus to the portions of Suitland
			 Parkway and I–295 located in the Anacostia section of the District of
			 Columbia; and</text>
					</paragraph><paragraph id="HD996560E7599453CB0B64FC6378210C0"><enum>(2)</enum><text>progress made toward completion of essential transportation improvements identified in the
			 Transportation Management Program for the St. Elizabeths Campus.</text>
					</paragraph></subsection><subsection id="HC610EDB60D0946468A332DB27A1CE00F"><enum>(c)</enum><header>Reallocation</header><text display-inline="yes-display-inline">Notwithstanding subsection (a), the Administrator may revise the allocation and assignment of
			 spaces to members and employees of the Coast Guard made under subsection
			 (a) as necessary to accommodate employees of the Department of Homeland
			 Security, other than the Coast Guard, when such employees are assigned to
			 the St. Elizabeths Campus.</text>
				</subsection></section></title></legis-body>
