		<official-title>To provide requirements for the appropriate Federal banking agencies when requesting or ordering a
			 depository institution to terminate a specific customer account, to
			 provide for additional requirements related to subpoenas issued under the
			 Financial Institutions Reform, Recovery, and Enforcement Act of 1989, and
			 for other purposes.</official-title>

		<section id="H5F68B8FD124541AAADB8FD2D162DEFCE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Financial Institution Customer Protection Act of 2014</short-title></quote>.</text>
		</section><section id="HA068ADF57DBA414D8CD9497947736357"><enum>2.</enum><header>Requirements for deposit account termination requests and orders</header>
			<subsection id="H97822CB9DE7E4C27840BCC4CC3CDCEDC"><enum>(a)</enum><header>Termination requests or orders must be material</header>
				<paragraph id="HA852865E5CAD4A1FA2E63869861E2CD2"><enum>(1)</enum><header>In general</header><text>An appropriate Federal banking agency may not suggest, request, or order a depository institution
			 to terminate a specific customer account or to otherwise restrict or
			 discourage a depository institution from entering into or maintaining a
			 banking relationship with a specific customer unless—</text>
					<subparagraph id="H8ACEBEC10D964289BC28AFCE7B614C66"><enum>(A)</enum><text>the agency has a material reason for such suggestion, request, or order; and</text>
					</subparagraph><subparagraph id="HA5467D2376D545A8B5EBD5D89C303B29"><enum>(B)</enum><text>such reason is not based solely on reputation risk.</text>
					</subparagraph></paragraph><paragraph id="H5E1ACC5B6871474FB326EFD53FC9983E"><enum>(2)</enum><header>Treatment of national security threats</header><text>If an appropriate Federal banking agency believes a specific customer poses a threat to national
			 security, including any belief that such customer is involved in terrorist
			 financing, such belief shall satisfy the materiality requirement under
			 paragraph (1)(A).</text>
				</paragraph><paragraph id="HCEB62890840243DFBD14D6EBA035B7A4"><enum>(3)</enum><header>Rulemaking</header><text>Not later than the end of the 60-day period beginning on the date of the enactment of this Act, the
			 appropriate Federal banking agencies shall, jointly, issue regulations
			 defining the term <quote>reputation risk</quote> for purposes of this section.</text>
				</paragraph></subsection><subsection id="H7A7849C71F814ADA962703A78C381CCF"><enum>(b)</enum><header>Notice requirement</header>
				<paragraph id="H7E9D0F2997AE454683B12E646340DB29"><enum>(1)</enum><header>In general</header><text>If an appropriate Federal banking agency suggests, requests, or orders a depository institution to
			 terminate a specific customer account, the agency shall—</text>
					<subparagraph id="HFBB1CA9564C44E42BBD1AA2940BED937"><enum>(A)</enum><text>provide such suggestion, request, or order to the institution in writing; and</text>
					</subparagraph><subparagraph id="HBE30C7AE4E51498B995090712349F86E"><enum>(B)</enum><text>accompany such suggestion, request, or order with a justification for why such termination is
			 needed, including any specific laws or regulations the agency believes are
			 being violated by the customer, if any.</text>
					</subparagraph></paragraph><paragraph id="H45F3250DE26B4F9788A3562898DADF6B"><enum>(2)</enum><header>Justification requirement</header><text display-inline="yes-display-inline">A justification described under paragraph (1)(B) may not be based solely on the reputation risk to
			 the depository institution.</text>
				</paragraph></subsection><subsection id="HD18DB4EFEAD9408CB7EDB07368F23CA6"><enum>(c)</enum><header>Customer notice</header>
				<paragraph id="H26E1DD3C234E433C8179C7E24F02B509"><enum>(1)</enum><header>Notice not required</header><text>Nothing in this section shall be construed as requiring a depository institution or an appropriate
			 Federal banking agency to inform a customer of the justification for the
			 customer’s account termination described under subsection (b).</text>
				</paragraph><paragraph id="H29BF04B1B8224919ABAA55670DCF7EAF"><enum>(2)</enum><header>Notice prohibited in cases of national security</header><text display-inline="yes-display-inline">If an appropriate Federal banking agency suggests, requests, or orders a depository institution to
			 terminate a specific customer account based on a belief that the customer
			 poses a threat to national security, neither the depository institution
			 nor the appropriate Federal banking agency may inform the customer of the
			 justification for the customer’s account termination.</text>
				</paragraph></subsection><subsection id="H9361D8231A044228B56117DC10BABA47"><enum>(d)</enum><header>Reporting requirement</header><text display-inline="yes-display-inline">Each appropriate Federal banking agency shall issue an annual report to the Congress stating—</text>
				<paragraph id="H5FC5EBE5DAD945A8BCAE1EB4A24FF664"><enum>(1)</enum><text>the aggregate number of specific customer accounts that the agency suggested, requested, or ordered
			 a depository institution to terminate during the previous year; and</text>
				</paragraph><paragraph id="H7E306E6C1810477A8428190238388C97"><enum>(2)</enum><text display-inline="yes-display-inline">the legal authority under which the agency made such suggestions, requests, and orders.</text>
				</paragraph></subsection><subsection id="H964F1CEBB7184EF58A61F683BB9BD6AD"><enum>(e)</enum><header>Definitions</header><text>For purposes of this section:</text>
				<paragraph id="HD3704C2867E8497EBA3355A4E327E46D"><enum>(1)</enum><header>Appropriate Federal banking agency</header><text>The term <quote>appropriate Federal banking agency</quote> means—</text>
					<subparagraph id="HE2AF4AE7312F449F8F9E2E4FF0C71069"><enum>(A)</enum><text>the appropriate Federal banking agency, as defined under section 3 of the Federal Deposit Insurance
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1813">12 U.S.C. 1813</external-xref>); and</text>
					</subparagraph><subparagraph id="H04EBFE5DAF19442184AE12C896DDDC4C"><enum>(B)</enum><text>the National Credit Union Administration, in the case of an insured credit union.</text>
					</subparagraph></paragraph><paragraph id="H8940D376259C4772A5C7E156D4E722F6"><enum>(2)</enum><header>Depository institution</header><text>The term <quote>depository institution</quote> means—</text>
					<subparagraph id="HA46EDE71F01D44458767551E3AB39FB7"><enum>(A)</enum><text display-inline="yes-display-inline">a depository institution, as defined under section 3 of the Federal Deposit Insurance Act (12
			 U.S.C. 1813); and</text>
					</subparagraph><subparagraph id="HA83BAE6DE5E94215874F2FAFEAD7214D"><enum>(B)</enum><text>an insured credit union.</text>
					</subparagraph></paragraph></subsection></section><section id="H3CA049C3882C49218CBC3072DC88CC34"><enum>3.</enum><header>Amendments to the Financial Institutions Reform, Recovery, and Enforcement Act of 1989</header><text display-inline="no-display-inline">Section 951 of the Financial Institutions Reform, Recovery, and Enforcement Act of 1989 (12 U.S.C.
			 1833a) is amended—</text>
			<paragraph commented="no" id="HD1619D3500C94890A17ED410CF0C5EED"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (c)(2), by striking <quote>affecting</quote> and inserting <quote>by or against</quote>; and</text>
			</paragraph><paragraph id="H29E15798049A49049CF8C4FB7D5690A2"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (g)—</text>
				<subparagraph id="H1C4D8312203C46D1A4ABCBECCD20EAEE"><enum>(A)</enum><text>in the header, by striking <quote><header-in-text level="subsection" style="OLC">subpoenas</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">investigations</header-in-text></quote>; and</text>
				</subparagraph><subparagraph id="HA35F8E06A35643868747889AA12A0B44"><enum>(B)</enum><text>by amending paragraph (1)(C) to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="HD35063C528004EFAAC55301F6E39018B" style="OLC">
						<subparagraph id="H5AAC8080A82843679DBC0EBF1871E19B"><enum>(C)</enum><text display-inline="yes-display-inline">summon witnesses and require the production of any books, papers, correspondence, memoranda, or
			 other records which the Attorney General deems relevant or material to the
			 inquiry, if the Attorney General—</text>
							<clause id="HC3922BDD3B5C44849DE1EE7D66BF28DE"><enum>(i)</enum><text display-inline="yes-display-inline">requests a court order from a court of competent jurisdiction for such actions and offers specific
			 and articulable facts showing that there are reasonable grounds to believe
			 that the information or testimony sought is relevant and material for
			 conducting an investigation under this section; or</text>
							</clause><clause id="H73A5E6BB24D84122993D15990FA178EA"><enum>(ii)</enum><text display-inline="yes-display-inline">either personally or through delegation no lower than the Deputy Attorney General, issues and signs
			 a subpoena for such actions and has reasonable grounds to believe that the
			 information or testimony sought is relevant for conducting an
			 investigation under this section.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subparagraph></paragraph></section></legis-body>
