<official-title display="yes">To amend the Communications Act of 1934 and title 17, United States Code, to extend expiring provisions relating to the retransmission of signals of television broadcast stations, and for other purposes.</official-title>

<section id="HAF6939DF9F5F4DF4B46A74414BB61D37"><enum>101.</enum><header>Extension of authority</header><text display-inline="no-display-inline">Section 325(b) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/325">47 U.S.C. 325(b)</external-xref>) is amended—</text> 
<paragraph id="H7F2046BEA4464BF1BB0F09BB55CD3ABD"><enum>(1)</enum><text>in paragraph (2)(C), by striking <quote>December 31, 2014</quote> and inserting <quote>December 31, 2019</quote>; and</text> </paragraph> 
<paragraph id="H6CBAE33AE4A24F3895A614D1F36130B1"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (3)(C), by striking <quote>January 1, 2015</quote> each place it appears and inserting <quote>January 1, 2020</quote>.</text> </paragraph></section> 
<section commented="no" id="H820CE0367E3143E28EE658DBFB03C5AC"><enum>102.</enum><header>Modification of television markets to further consumer access to relevant television programming</header> 
<subsection commented="no" id="HA6339AF2B1CC42C3B5093F3CEE85EAFB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 338 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/338">47 U.S.C. 338</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H3004E2FB88BE4DCF9E5746D95C0FDBA0" style="OLC"> 
<subsection commented="no" id="H2B5875C9356B43A28E212FF0B56EC8F5"><enum>(l)</enum><header>Market determinations</header> 
<paragraph commented="no" id="H04F2CD067AF64A79B6CBBB04266464E0"><enum>(1)</enum><header>In general</header><text>Following a written request, the Commission may, with respect to a particular commercial television broadcast station, include additional communities within its local market or exclude communities from such station’s local market to better effectuate the purposes of this section.</text> </paragraph> 
<paragraph commented="no" id="HDE138558E0CB44858551DD7A8D98D61D"><enum>(2)</enum><header>Considerations</header><text>In considering requests filed under paragraph (1), the Commission—</text> 
<subparagraph commented="no" id="H4BDB4958794E433DB41E4B4BB2CCB794"><enum>(A)</enum><text>may determine that particular communities are part of more than one local market; and</text> </subparagraph> 
<subparagraph commented="no" id="HC8D5A49DF7D346F4BB5C1EAD1ECE1260"><enum>(B)</enum><text>shall afford particular attention to the value of localism by taking into account such factors as—</text> 
<clause commented="no" id="HDC436AF268ED42A48F2C02F4B7F32DDD"><enum>(i)</enum><text>whether the station, or other stations located in the same area—</text> 
<subclause commented="no" id="HA592408606DA4C2282E2054EE1653653"><enum>(I)</enum><text>have been historically carried on the cable system or systems within such community; or</text> </subclause> 
<subclause commented="no" id="H4585CA6AFB1649B68CDA7BF10589F34F"><enum>(II)</enum><text>have been historically carried on the satellite carrier or carriers serving such community;</text> </subclause></clause> 
<clause commented="no" id="H63CDB8C9C1E74B3FA8CF57A7165169A5"><enum>(ii)</enum><text>whether the television station provides coverage or other local service to such community;</text> </clause> 
<clause commented="no" id="HC6ACD0584BA64630A4B2D98C8E559BF5"><enum>(iii)</enum><text>whether modifying the local market of the television station would promote consumers' access to television broadcast station signals that originate in their State of residence;</text> </clause> 
<clause commented="no" id="H399E76C3FC0947E2B7AA6B899FAE7D80"><enum>(iv)</enum><text>whether any other television station that is eligible to be carried by a satellite carrier in such community in fulfillment of the requirements of this section provides news coverage of issues of concern to such community or provides carriage or coverage of sporting and other events of interest to the community; and</text> </clause> 
<clause commented="no" id="H50DD9D111F5948FC882E2EA8B9E1C8AC"><enum>(v)</enum><text>evidence of viewing patterns in households that subscribe and do not subscribe to the services offered by multichannel video programming distributors within the areas served by such multichannel video programming distributors in such community.</text> </clause></subparagraph></paragraph> 
<paragraph commented="no" id="HD0CBF5FE8DB6466D8FC9E7FB58A599DF"><enum>(3)</enum><header>Carriage of signals</header> 
<subparagraph commented="no" id="H643BD8E7A38C416186544E90A6B60A9F"><enum>(A)</enum><header>Carriage obligation</header><text>A market determination under this subsection shall not create additional carriage obligations for a satellite carrier if it is not technically and economically feasible for such carrier to accomplish such carriage by means of its satellites in operation at the time of the determination.</text> </subparagraph> 
<subparagraph commented="no" id="H576839D87F7846DB9893B80542A8013B"><enum>(B)</enum><header>Deletion of signals</header><text>A satellite carrier shall not delete from carriage the signal of a commercial television broadcast station during the pendency of any proceeding under this subsection.</text> </subparagraph></paragraph> 
<paragraph commented="no" id="H87A4D8B4FC79411A85500A852D37E234"><enum>(4)</enum><header>Determinations</header><text>Not later than 120 days after the date that a written request is filed under paragraph (1), the Commission shall grant or deny the request.</text> </paragraph> 
<paragraph commented="no" id="HEA240AD136B649BF94B96BD9AC2BB5CC"><enum>(5)</enum><header>No effect on eligibility to receive distant signals</header><text>No modification of a commercial television broadcast station’s local market pursuant to this subsection shall have any effect on the eligibility of households in the community affected by such modification to receive distant signals pursuant to section 339, notwithstanding subsection (h)(1) of this section.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection commented="no" id="H4D970F7C422F44BC82B68B8152E99D22"><enum>(b)</enum><header>Conforming amendments</header><text>Section 614(h)(1)(C) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/534">47 U.S.C. 534(h)(1)(C)</external-xref>) is amended—</text> 
<paragraph commented="no" id="HCD338C7E323743628F4300E35F2D4D4A"><enum>(1)</enum><text>in clause (ii)—</text> 
<subparagraph commented="no" id="H42A7AA8600EF48478A052D9D1C199554"><enum>(A)</enum><text>in subclause (I), by striking <quote>community</quote> and inserting <quote>community or on the satellite carrier or carriers serving such community</quote>;</text> </subparagraph> 
<subparagraph commented="no" id="HA6AEED70D7E449D69DFC432B6B707DD7"><enum>(B)</enum><text>by redesignating subclauses (III) and (IV) as subclauses (IV) and (V), respectively;</text> </subparagraph> 
<subparagraph commented="no" id="H7D09AF266EFB486081E9AD4D14172728"><enum>(C)</enum><text>by inserting after subclause (II) the following:</text> 
<quoted-block display-inline="no-display-inline" id="HF4442FD5F9154206BC0588291FC217AA" style="OLC"> 
<subclause commented="no" id="H5C302ACCBA604EC892E0E1D7939E00C0" indent="up1"><enum>(III)</enum><text>whether modifying the market of the television station would promote consumers' access to television broadcast station signals that originate in their State of residence;</text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block> </subparagraph> 
<subparagraph commented="no" id="H1823EB09B9504587B17FAAC7834BFA17"><enum>(D)</enum><text>by amending subclause (V), as redesignated, to read as follows:</text> 
<quoted-block display-inline="no-display-inline" id="H142F1B498CAA47DFA911416BDB3798B7" style="OLC"> 
<subclause commented="no" id="HAAE393282EC3409AA3026AB233F33CF1" indent="up1"><enum>(V)</enum><text>evidence of viewing patterns in households that subscribe and do not subscribe to the services offered by multichannel video programming distributors within the areas served by such multichannel video programming distributors in such community.</text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block> </subparagraph></paragraph> 
<paragraph commented="no" id="HE016C31617444CD38C64BA0367DB6386"><enum>(2)</enum><text>by moving the margin of clause (iv) 2 ems to the left.</text> </paragraph></subsection> 
<subsection commented="no" id="H139D56ACFD6244918DD4A24A4CF25EC8"><enum>(c)</enum><header>Market modification process</header><text>The Commission shall make information available to consumers on its website that explains the market modification process, including—</text> 
<paragraph commented="no" id="HC2A3929CA51849C196BB66E17295E59A"><enum>(1)</enum><text>who may petition to include additional communities within, or exclude communities from, a—</text> 
<subparagraph commented="no" id="HECDDC00D6936409AADA3710E517ACF20"><enum>(A)</enum><text>local market (as defined in <external-xref legal-doc="usc" parsable-cite="usc/17/122">section 122(j)</external-xref> of title 17, United States Code); or</text> </subparagraph> 
<subparagraph commented="no" id="HFD575D7E8FCF418A9FBE328EAEC98A7B"><enum>(B)</enum><text>television market (as determined under section 614(h)(1)(C) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/534">47 U.S.C. 534(h)(1)(C)</external-xref>)); and</text> </subparagraph></paragraph> 
<paragraph commented="no" id="HC7A002153EBE4A939AB7FED775956CA0"><enum>(2)</enum><text>the factors that the Commission takes into account when responding to a petition described in paragraph (1).</text> </paragraph></subsection> 
<subsection commented="no" id="H4D0DE9C3B8F94E339256813BF5269A91"><enum>(d)</enum><header>Implementation</header> 
<paragraph commented="no" id="H41FDA88975FD4A93ACB0E6BD5240DE24"><enum>(1)</enum><header>Deadline for regulations</header><text>Not later than 9 months after the date of the enactment of this Act, the Commission shall promulgate regulations to implement this section and the amendments made by this section.</text> </paragraph> 
<paragraph commented="no" id="H55D46AC891CF48BAA9EB00CAD4F5DCB6"><enum>(2)</enum><header>Matters for consideration</header><text>As part of the rulemaking required by paragraph (1), the Commission shall ensure that procedures for the filing and consideration of a written request under sections 338(l) and 614(h)(1)(C) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/338">47 U.S.C. 338(l)</external-xref>; 534(h)(1)(C)) fully effectuate the purposes of the amendments made by this section, and update what it considers to be a community for purposes of a modification of a market under section 338(l) or 614(h)(1)(C) of the Communications Act of 1934.</text> </paragraph></subsection></section> 
<section id="H909A2932F409446A98F9400EA95EA7D3"><enum>103.</enum><header>Consumer protections in retransmission consent</header> 
<subsection id="HF8769E349A774E87AC3C7E3AF8F92318"><enum>(a)</enum><header>Joint retransmission consent negotiations</header><text>Section 325(b)(3)(C) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/325">47 U.S.C. 325(b)(3)(C)</external-xref>) is amended—</text> 
<paragraph id="H6E170DA6B6E545FB9FF7229CDC7171BA"><enum>(1)</enum><text>in clause (ii), by striking <quote>and</quote> at the end;</text> </paragraph> 
<paragraph id="H173505CC52624E42B5F2C2238AA5812D"><enum>(2)</enum><text>in clause (iii), by striking the period at the end and inserting a semicolon; and</text> </paragraph> 
<paragraph id="H6A8C06C479D3486B8DF07E093A248E88"><enum>(3)</enum><text>by adding at the end the following:</text> 
<quoted-block act-name="" id="HEFAF5F22FB2F47DD86B0B1B385997F1E" style="OLC"> 
<clause id="HFA3EF37B3A97453F9DE594E7BD6DFF73" indent="up2"><enum>(iv)</enum><text>prohibit a television broadcast station from coordinating negotiations or negotiating on a joint basis with another television broadcast station in the same local market (as defined in <external-xref legal-doc="usc" parsable-cite="usc/17/122">section 122(j)</external-xref> of title 17, United States Code) to grant retransmission consent under this section to a multichannel video programming distributor, unless such stations are directly or indirectly under common de jure control permitted under the regulations of the Commission; and</text></clause><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection> 
<subsection commented="no" id="H7B25812AAE644B57841B57171E603B43"><enum>(b)</enum><header>Protections for significantly viewed and other television signals</header><text>Section 325(b)(3)(C) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/325">47 U.S.C. 325(b)(3)(C)</external-xref>) is further amended by adding at the end the following:</text> 
<quoted-block act-name="" id="H6801D3816FF94D5EA4C8567EB88E5BEC" style="OLC"> 
<clause commented="no" id="HFBC87CCCC9B8485585FB2E73B7E91668" indent="up2"><enum>(v)</enum><text display-inline="yes-display-inline">prohibit a television broadcast station from limiting the ability of a multichannel video programming distributor to carry into the local market (as defined in <external-xref legal-doc="usc" parsable-cite="usc/17/122">section 122(j)</external-xref> of title 17, United States Code) of such station a television signal that has been deemed significantly viewed, within the meaning of <external-xref legal-doc="regulation" parsable-cite="cfr/47/76.54">section 76.54</external-xref> of title 47, Code of Federal Regulations, or any successor regulation, or any other television broadcast signal such distributor is authorized to carry under section 338, 339, 340, or 614 of this Act, unless such stations are directly or indirectly under common de jure control permitted by the Commission.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection commented="no" id="H93A42D3EB2FD4D4CB2AFF71E8DCDAC6E"><enum>(c)</enum><header>Good faith</header><text>Not later than 9 months after the date of the enactment of this Act, the Commission shall commence a rulemaking to review its totality of the circumstances test for good faith negotiations under clauses (ii) and (iii) of section 325(b)(3)(C) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/325">47 U.S.C. 325(b)(3)(C)</external-xref>).</text> </subsection> 
<subsection id="HACD0E933EB474B23950C70ACD9EF4BE0"><enum>(d)</enum><header>Margin corrections</header><text display-inline="yes-display-inline">Section 325(b) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/325">47 U.S.C. 325(b)</external-xref>) is further amended—</text> 
<paragraph id="HC2075CF3828F4D03953E838B576B89DE"><enum>(1)</enum><text>in paragraph (3)(C), by moving the margin of clause (iii) 4 ems to the left; and</text> </paragraph> 
<paragraph commented="no" id="HBB3296BB71D74CE59C1D5B9A9EAE51BF"><enum>(2)</enum><text>by moving the margin of paragraph (7) 2 ems to the left.</text> </paragraph></subsection> 
<subsection commented="no" id="H2793AF19229F4EE3B037BCA4145F25CC"><enum>(e)</enum><header>Deadline for regulations</header><text>Not later than 9 months after the date of the enactment of this Act, the Commission shall promulgate regulations to implement the amendments made by this section.</text> </subsection></section> 
<section commented="no" id="HB8811B480A2240A588B64A765AD782F0" section-type="subsequent-section"><enum>104.</enum><header>Delayed application of JSA attribution rule</header><text display-inline="no-display-inline">A party to a joint sales agreement (as defined in Note 2(k) to <external-xref legal-doc="regulation" parsable-cite="cfr/47/73.3555">section 73.3555</external-xref> of title 47, Code of Federal Regulations) that is in effect on the effective date of the amendment to Note 2(k)(2) to such section made by the Further Notice of Proposed Rulemaking and Report and Order adopted by the Commission on March 31, 2014 (FCC 14–28), shall not be considered to be in violation of the ownership limitations of such section by reason of the application of the rule in such Note 2(k)(2) (as so amended) to such agreement before the date that is 6 months after the end of the period specified by the Commission in such Report and Order for such a party to come into compliance with such ownership limitations.</text> </section> 
<section id="HF1488DA5B2FF4AED90920FB650432E20"><enum>105.</enum><header>Deletion or repositioning of stations during certain periods</header> 
<subsection id="HD40D7E0041024E729D12942F29836925"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 614(b)(9) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/534">47 U.S.C. 534(b)(9)</external-xref>) is amended by striking the second sentence.</text> </subsection> 
<subsection id="HE187BB84D15644238F5F33DA0EC125E8"><enum>(b)</enum><header>Revision of rules</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Commission shall revise section 76.1601 of its rules (47 CFR 76.1601) and any note to such section by removing the prohibition against deletion or repositioning of a local commercial television station during a period in which major television ratings services measure the size of audiences of local television stations.</text> </subsection></section> 
<section commented="no" id="H04D2CBFE79CB43EB92D94710C97802D8"><enum>106.</enum><header>Repeal of integration ban</header> 
<subsection commented="no" id="H744B77137AF14095859E2C80EB273D2A"><enum>(a)</enum><header>Termination of effectiveness</header><text display-inline="yes-display-inline">The second sentence of <external-xref legal-doc="regulation" parsable-cite="cfr/47/76.1204">section 76.1204(a)(1)</external-xref> of title 47, Code of Federal Regulations, terminates effective on the date that is 1 year after the date of the enactment of this Act.</text> </subsection> 
<subsection commented="no" id="HB0B15A7536594DA4A4F25CB3571EA087"><enum>(b)</enum><header>Removal from rules</header><text>Not later than 545 days after the date of the enactment of this Act, the Commission shall complete all actions necessary to remove the sentence described in subsection (a) from its rules.</text> </subsection> 
<subsection id="HA8C0D6E839E14C3A80B19E9C73579719"><enum>(c)</enum><header>Preservation of waivers</header><text display-inline="yes-display-inline">Any waiver of <external-xref legal-doc="regulation" parsable-cite="cfr/47/76.1204">section 76.1204(a)(1)</external-xref> of title 47, Code of Federal Regulations, in effect as of the date of the enactment of this Act or granted after such date shall be extended through December 31, 2015.</text> </subsection> 
<subsection id="H204047DC7FE5449EA7FDB944C04AFD84"><enum>(d)</enum><header>Working Group</header> 
<paragraph id="HC1281304FD5D49649FADACB0753B5210"><enum>(1)</enum><header>In general</header><text>Not later than 45 days after the date of the enactment of this Act, the Chairman of the Commission shall establish a working group of technical experts representing a wide range of stakeholders, to identify, report, and recommend performance objectives, technical capabilities, and technical standards of a not unduly burdensome, uniform, and technology- and platform-neutral software-based downloadable security system designed to promote the competitive availability of navigation devices in furtherance of section 629 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/549">47 U.S.C. 549</external-xref>).</text> </paragraph> 
<paragraph id="H91C9DB9DC1EC4810A32DFF3725C992B9"><enum>(2)</enum><header>Report</header><text>Not later than 9 months after the date of the enactment of this Act, the working group shall file a report with the Commission on its work under paragraph (1).</text> </paragraph> 
<paragraph id="HB19884B8D8744F97A266BB69364E0597"><enum>(3)</enum><header>Commission assistance</header><text>The Chairman of the Commission may appoint a member of the Commission's staff—</text> 
<subparagraph id="HB4A0924320AA463096E79B481779F99F"><enum>(A)</enum><text>to moderate and direct the work of the working group under this subsection; and</text> </subparagraph> 
<subparagraph id="H3A66D9E3737642C89DDA6AADEB8CA152"><enum>(B)</enum><text>to provide technical assistance to members of the working group, as appropriate.</text> </subparagraph></paragraph> 
<paragraph id="H72AAD0D2795040BC94020E9961A0687F"><enum>(4)</enum><header>Initial meeting</header><text>The initial meeting of the working group shall take place not later than 90 days after the date of the enactment of this Act.</text> </paragraph></subsection></section> 
<section id="HD74B2FC184CB4190A96A4E5D939E7A08"><enum>107.</enum><header>Report on communications implications of statutory licensing modifications</header> 
<subsection id="HF985046FEEFE4806A979ACB564627CC8"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">The Comptroller General of the United States shall conduct a study that analyzes and evaluates the changes to the carriage requirements currently imposed on multichannel video programming distributors under the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/151">47 U.S.C. 151 et seq.</external-xref>) and the regulations promulgated by the Commission that would be required or beneficial to consumers, and such other matters as the Comptroller General considers appropriate, if Congress implemented a phase-out of the current statutory licensing requirements set forth under sections 111, 119, and 122 of title 17, United States Code. Among other things, the study shall consider the impact such a phase-out and related changes to carriage requirements would have on consumer prices and access to programming.</text> </subsection> 
<subsection id="HE7ED0BC90B66480D999E0176A035E6BC"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 18 months after the date of the enactment of this Act, the Comptroller General shall submit to the appropriate congressional committees a report on the results of the study conducted under subsection (a), including any recommendations for legislative or administrative actions. Such report shall also include a discussion of any differences between such results and the results of the study conducted under section 303 of the Satellite Television Extension and Localism Act of 2010 (124 Stat. 1255).</text> </subsection></section> 
<section commented="no" id="H6CFE5EE76B3F488A8CA75B9F07908886"><enum>108.</enum><header>Local network channel broadcast reports</header> 
<subsection commented="no" id="H1E826E0272364666A3299C74CD66BEFB"><enum>(a)</enum><header>Requirement</header> 
<paragraph commented="no" id="HA2D82836EF6E4236B688079E70E0CD11"><enum>(1)</enum><header>In general</header><text>On the 270th day after the date of the enactment of this Act, and on each succeeding anniversary of such 270th day, each satellite carrier shall submit an annual report to the Commission setting forth—</text> 
<subparagraph commented="no" id="H36E11A817DAE4246BD423D8C8CC0ECE5"><enum>(A)</enum><text>each local market in which it—</text> 
<clause commented="no" id="H100B9A7B8F314D9BAC275771F9B87972"><enum>(i)</enum><text>retransmits signals of 1 or more television broadcast stations with a community of license in that market;</text> </clause> 
<clause commented="no" id="H6BDEF6911754421585E743B50ED1D053"><enum>(ii)</enum><text>has commenced providing such signals in the preceding 1-year period; and</text> </clause> 
<clause commented="no" id="H09F8219F30DC489DAFEEA59BFF0198E7"><enum>(iii)</enum><text>has ceased to provide such signals in the preceding 1-year period; and</text> </clause></subparagraph> 
<subparagraph commented="no" id="H0045A6B246494374B8DE7B07DDD327BA"><enum>(B)</enum><text>detailed information regarding the use and potential use of satellite capacity for the retransmission of local signals in each local market.</text> </subparagraph></paragraph> 
<paragraph commented="no" id="H200B8499F16D4B748FEB1464FA0CDA13"><enum>(2)</enum><header>Termination</header><text>The requirement under paragraph (1) shall cease after each satellite carrier has submitted 5 reports under such paragraph.</text> </paragraph></subsection> 
<subsection commented="no" id="HD058B8EEEAFA4BAC86D460478632AB71"><enum>(b)</enum><header>Definitions</header><text>In this section—</text> 
<paragraph commented="no" id="H35CBCEDF70E1401A8939FE0253A6C0DB"><enum>(1)</enum><text>the terms <quote>local market</quote> and <quote>satellite carrier</quote> have the meaning given such terms in section 339(d) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/339">47 U.S.C. 339(d)</external-xref>); and</text> </paragraph> 
<paragraph commented="no" id="HCA8057C7EF24438C973B21CE18D17300"><enum>(2)</enum><text>the term <quote>television broadcast station</quote> has the meaning given such term in section 325(b)(7) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/325">47 U.S.C. 325(b)(7)</external-xref>).</text> </paragraph></subsection></section> 
<section commented="no" id="H27B31548B7AE45FCAED740CFB188C481"><enum>109.</enum><header>Report on designated market areas</header> 
<subsection commented="no" id="H284AD011A0D445959A2CFCE807906F99"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 18 months after the date of the enactment of this Act, the Commission shall submit to the appropriate congressional committees a report that contains—</text> 
<paragraph commented="no" id="H3ED7E427638C409182524F98CCF768C3"><enum>(1)</enum><text>an analysis of—</text> 
<subparagraph commented="no" id="H4678D0216E4D4FD9A4D271EBFFEF8F51"><enum>(A)</enum><text>the extent to which consumers in each local market have access to broadcast programming from television broadcast stations located outside their local market, including through carriage by cable operators and satellite carriers of signals that are significantly viewed (within the meaning of section 340 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/340">47 U.S.C. 340</external-xref>)); and</text> </subparagraph> 
<subparagraph commented="no" id="H6A19A838F43E46C4BC07E2AC480148E4"><enum>(B)</enum><text display-inline="yes-display-inline">whether there are technologically and economically feasible alternatives to the use of designated market areas to define markets that would provide consumers with more programming options and the potential impact such alternatives could have on localism and on broadcast television locally, regionally, and nationally; and</text> </subparagraph></paragraph> 
<paragraph commented="no" id="H0B3512AC9B59498FBDE8462B0AC84829"><enum>(2)</enum><text display-inline="yes-display-inline">recommendations on how to foster increased localism in counties served by out-of-State designated market areas.</text> </paragraph></subsection> 
<subsection commented="no" id="H794E877C18784CB88D8CAC5C6A7F12F1"><enum>(b)</enum><header>Considerations for fostering increased localism</header><text>In making recommendations under subsection (a)(2), the Commission shall consider—</text> 
<paragraph commented="no" id="H421250029B6A4146AC48BEB8A33B0765"><enum>(1)</enum><text>the impact that designated market areas that cross State lines have on access to local programming;</text> </paragraph> 
<paragraph commented="no" id="HEFCA6A0C0A894142BB3640F85768D0B9"><enum>(2)</enum><text>the impact that designated market areas have on local programming in rural areas; and</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HF125D13F2B3844EE90EDD4BC26CB61BF"><enum>(3)</enum><text>the state of local programming in States served exclusively by out-of-State designated market areas.</text> </paragraph></subsection></section> 
<section commented="no" id="H6E2C2C3F50A7444D89106C3C8B7D4692"><enum>110.</enum><header>Update to cable rates report</header><text display-inline="no-display-inline">Section 623(k) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/543">47 U.S.C. 543(k)</external-xref>) is amended to read as follows:</text>

<subsection commented="no" id="H1AC6D4042D784442AE6BD50ABBCA959A"><enum>(k)</enum><header>Reports on average prices</header> 
<paragraph commented="no" id="HD7FC95494C9D4170B8B0A70F41C00BB8"><enum>(1)</enum><header>In general</header><text>The Commission shall annually publish statistical reports on the average rates for basic cable service and other cable programming, and for converter boxes, remote control units, and other equipment of cable systems that the Commission has found are subject to effective competition under subsection (a)(2) compared with cable systems that the Commission has found are not subject to such effective competition.</text> </paragraph> 
<paragraph commented="no" id="H82E715BCBE144AB8820A523460EA5B52"><enum>(2)</enum><header>Inclusion in annual report</header> 
<subparagraph commented="no" id="HBF3A35FAE78C403E9ED937CDF74048FC"><enum>(A)</enum><header>In general</header><text>The Commission shall include in its report under paragraph (1) the aggregate average total amount paid by cable systems in compensation under section 325.</text> </subparagraph> 
<subparagraph commented="no" id="HC18FA89A388944BE821787089D2F3597"><enum>(B)</enum><header>Form</header><text>The Commission shall publish information under this paragraph in a manner substantially similar to the way other comparable information is published in such report.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section> 
<section commented="no" id="H0AC94A94C1FC401B86E54AE9BD827150"><enum>111.</enum><header>Administrative reforms to effective competition petitions</header><text display-inline="no-display-inline">Section 623 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/543">47 U.S.C. 543</external-xref>) is amended by adding at the end the following:</text>

<paragraph commented="no" id="H74B035FF4D9848E99DCC343C6F0635E9"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this subsection, the Commission shall complete a rulemaking to establish a streamlined process for filing of an effective competition petition pursuant to this section for small cable operators, particularly those who serve primarily rural areas.</text> </paragraph> 
<paragraph commented="no" id="H9183D3945A024C54A8E6B7B712B4996B"><enum>(2)</enum><header>Construction</header><text>Nothing in this subsection shall be construed to have any effect on the duty of a small cable operator to prove the existence of effective competition under this section.</text> </paragraph> 
<paragraph commented="no" id="H70F30B26CA9949C697B06B13CDABA32F"><enum>(3)</enum><header>Definition of small cable operator</header><text>In this subsection, the term <term>small cable operator</term> has the meaning given the term in subsection (m)(2).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section>

<section id="HE3E4E58FF0594CF188D3C5C334847146"><enum>301.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act, an amendment made by this Act, or the application of such provision or amendment to any person or circumstance is held to be unconstitutional, the remainder of this Act, the amendments made by this Act, and the application of such provision or amendment to any person or circumstance shall not be affected thereby.</text> </section></title>
