		<official-title>To amend the Defense Base Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1651">42 U.S.C. 1651 et seq.</external-xref>) to require death benefits to be paid to a
			 deceased employee’s designated beneficiary or next of kin in the case of
			 death resulting from a war-risk hazard or act of terrorism occurring on or
			 after September 11, 2001.</official-title>

		<section id="HF467C8B474F34F109908001997122470" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Overseas Security Personnel Fairness Act</short-title></quote>.</text>
		</section><section id="H63686FA8346248F0A60C63FC456FA6F4" section-type="subsequent-section"><enum>2.</enum><header>Defense Base Act amendments relating to death benefits</header><text display-inline="no-display-inline">The Defense Base Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1651">42 U.S.C. 1651 et seq.</external-xref>) is amended by adding at the end the following new
			 section:</text>
			<quoted-block display-inline="no-display-inline" id="H77BD7320AB0046F7B7BD4DBDC3B1C26F" style="OLC">
				<section id="HD87E257E45314988BE31B11BD8A40962"><enum>6.</enum><header>Death benefits</header>
					<subsection id="H7C792D058A124C3284F525DDBB0E6AAB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of a person covered by this Act who dies as a result of a war-risk hazard or act of
			 terrorism, if there is no person eligible for a death benefit of the
			 deceased under section 9 of the Longshore and Harbor Workers’ Compensation
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/33/909">33 U.S.C. 909</external-xref>), then the benefits provided under section 9(b) of such
			 Act to a widow or widower of the deceased shall be paid—</text>
						<paragraph id="H273DA1B4058343EEBDD77CAEC8ED19DC"><enum>(1)</enum><text>to a beneficiary designated by the deceased; or</text>
						</paragraph><paragraph id="H3F7FC6C41E9449488CEC1690BE72BD91"><enum>(2)</enum><text>if there is no designated beneficiary, to the next of kin or the estate of the deceased under
			 applicable State law.</text>
						</paragraph></subsection><subsection id="H4D02B7CFC4FA46A6ACF860CA36C0FD0A"><enum>(b)</enum><header>Payment of benefits</header><text display-inline="yes-display-inline">Benefits found to be due under this section shall be paid from the compensation fund established
			 pursuant to <external-xref legal-doc="usc" parsable-cite="usc/5/8147">section 8147</external-xref> of title 5, United States Code.</text>
					</subsection><subsection id="H496CDE13243C40D2965B558CD8D90E3A"><enum>(c)</enum><header>War-Risk hazard defined</header><text>In this section, the term <quote>war-risk hazard</quote> has the meaning provided in section 201(b) of the War Hazards Compensation Act (42 U.S.C.
			 1711(b)).</text>
					</subsection><subsection id="HB93F65560EB246ACAE536E72FA2C1199"><enum>(d)</enum><header>Effective date</header><text>The death benefit payable under this section shall apply with respect to deaths occurring on or
			 after September 11, 2001.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
