			 air traffic controller positions, to establish an Air Traffic Control
			 Education and Training Advisory Committee, and for other purposes.</official-title>

		<section id="H1B329B986DBA437C94ABC0799A7680E6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Standards Addressing Federal Transparency and Oversight With Evolving Recruitment Specifications
			 Act</quote> or the <quote>SAFE TOWERS Act</quote>.</text>
		</section><section id="H268FBFFA30814BC7BDBAD64C8F80E8DF"><enum>2.</enum><header>Hiring of air traffic controllers</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/44506">Section 44506</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H748CD2F704E54DA48199ABD3CA7AD230" style="OLC">
				<subsection id="H211ADD42ED9544308B1B534E4DD30A06"><enum>(f)</enum><header>Revision of hiring practices</header>
					<paragraph id="H941C0FC858BB472C8AC1F8D19DD33507"><enum>(1)</enum><header>Consideration of applicants</header>
						<subparagraph id="HB9FBD7C8C2F2480FA5FA30344B92A5FF"><enum>(A)</enum><header>Preference for AT–CTI and VRA applicants</header><text display-inline="yes-display-inline">In appointing individuals to the position of air traffic controller, the Administrator shall give
			 preferential consideration to the following applicants:</text>
							<clause id="H9A8A3CDE5F7C49648BED32C670BA93E0"><enum>(i)</enum><text display-inline="yes-display-inline">An individual who—</text>
								<subclause id="HB12B1A4D81C9441CAB27004DD2F8193C"><enum>(I)</enum><text display-inline="yes-display-inline">has successfully completed air traffic controller training and graduated from an institution
			 participating in the Collegiate Training Initiative program maintained
			 under subsection (c)(1); and</text>
								</subclause><subclause id="HC1332E174ACC476DA588AC16C61B5184"><enum>(II)</enum><text>has received an appropriate recommendation from the institution.</text>
								</subclause></clause><clause id="H86F5362C3E5F4E9FACD54AA4A24E8D94"><enum>(ii)</enum><text>A qualified individual who is eligible for a veterans recruitment appointment pursuant to section
			 4214 of title 38.</text>
							</clause><clause id="H2F20417BBD494760B040486CFCE16373"><enum>(iii)</enum><text display-inline="yes-display-inline">A qualified individual who is an eligible veteran, as such term is defined in section 4211 of title
			 38, maintaining aviation experience.</text>
							</clause></subparagraph><subparagraph id="HA9D52E82CE6740F0BDACB5176516BA64"><enum>(B)</enum><header>Consideration of general public applicants</header><text display-inline="yes-display-inline">The Administrator may consider general public applicants for the position of air traffic controller
			 only after completing consideration of the applicants described in
			 subparagraph (A).</text>
						</subparagraph></paragraph><paragraph id="HAC78603DF47440C08301F6076D070873"><enum>(2)</enum><header>Elimination of biographical assessments</header>
						<subparagraph id="H0749DFA97A7446E58D7982D5ECA4DC73"><enum>(A)</enum><header>In general</header><text>The Administrator shall revise the hiring practices of the Administration that apply to applicants
			 for the position of air traffic controller with the Department of
			 Transportation to eliminate the use of a biographical assessment or any
			 other personality test that unduly disqualifies applicants. The revision
			 under this subparagraph shall not be subject to paragraph (3).</text>
						</subparagraph><subparagraph id="H6B5270310B044B6B8568E8AA36B176E7"><enum>(B)</enum><header>Reconsideration of applicants disqualified on the basis of biographical assessments</header>
							<clause id="HCB3FBC1990644BACB2436D9F1113996F"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">If an individual applied for the position of air traffic controller with the Department in response
			 to the FG–01 Vacancy Announcement issued on February 10, 2014, and was
			 disqualified from the position as the result of a biographical assessment,
			 the Administrator shall provide the applicant an opportunity to reapply as
			 soon as practicable for the position under the revised hiring practices.</text>
							</clause><clause id="HC588B1F6777B4BAA973A87F49AFE80CF"><enum>(ii)</enum><header>Waiver of age restriction</header><text display-inline="yes-display-inline">The Administrator shall waive any maximum age restriction for the position of air traffic
			 controller with the Department that would otherwise disqualify an
			 individual from the position if the individual—</text>
								<subclause id="H7E1E57E4DC5B42A28C1333D8154CA5FA"><enum>(I)</enum><text>is reapplying for the position pursuant to clause (i) on or before December 31, 2016; and</text>
								</subclause><subclause id="H4A12732C76C6447683E26F318F650FC6"><enum>(II)</enum><text>met the maximum age requirement on the date of the individual’s previous application for the
			 position.</text>
								</subclause></clause></subparagraph></paragraph><paragraph id="H635109BD6BDB484A86356702DC798DA7"><enum>(3)</enum><header>Participation of CTI institutions in revision of hiring practices</header><text display-inline="yes-display-inline">Before making any revision to the hiring practices that apply to applicants for the position of air
			 traffic controller with the Department, the Administrator shall provide
			 the Air Traffic Control Education and Training Advisory Committee
			 established under subsection (g) and institutions of higher education
			 participating in the Collegiate Training Initiative program with notice of
			 the revision and an opportunity to comment.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HC1E903E15C6A453B808EA53BA9BE1233"><enum>3.</enum><header>Collegiate Training Initiative</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/44506">Section 44506(c)(1)</external-xref> of title 49, United States Code, is amended—</text>
			<paragraph id="H5935A5F4347E4BE1B37344A232F3A738"><enum>(1)</enum><text>in the first sentence by striking <quote>may maintain</quote> and inserting <quote>shall maintain</quote>; and</text>
			</paragraph><paragraph id="H5E209CE2515C4BA6B9B879018F03E7DA"><enum>(2)</enum><text>in the second sentence by striking <quote>may establish</quote> and inserting <quote>, in consultation with the Air Traffic Control Education and Training Advisory Committee
			 established under subsection (g), shall establish</quote>.</text>
			</paragraph></section><section id="HACCED1CD2A2049D688A80102A8C7E3BE"><enum>4.</enum><header>Air Traffic Control Education and Training Advisory Committee</header>
			<text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/44506">Section 44506</external-xref> of title 49, United States Code, is further amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="H769CB81292454AF3A68A65E8DB92AA1F" style="OLC">
				<subsection id="HC00B13D344484642AAA8E7DDFB0B86D1"><enum>(g)</enum><header>Air Traffic Control Education and Training Advisory Committee</header>
					<paragraph id="H66B32640BE66476E82D5C0F91A83AC43"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Administrator shall establish an Air Traffic Control Education and Training Advisory Committee
			 (in this subsection referred to as the <quote>Committee</quote>).</text>
					</paragraph><paragraph id="H3913F845E1E94C06AD4C912814389D23"><enum>(2)</enum><header>Duties</header><text>The Committee shall—</text>
						<subparagraph id="HCB1AF733B0CA4452BB2D0BE50B223B1A"><enum>(A)</enum><text display-inline="yes-display-inline">provide advice and recommendations to the Administrator about the needs, objectives, plans, and
			 content of air traffic controller training programs;</text>
						</subparagraph><subparagraph id="H4BF536A4CE2D48BBA3A16A73040DEB72"><enum>(B)</enum><text display-inline="yes-display-inline">review the operations of the Collegiate Training Initiative program maintained under subsection
			 (c)(1);</text>
						</subparagraph><subparagraph id="H62E2777BB6F24B9E9536B651FB1B9ED8"><enum>(C)</enum><text display-inline="yes-display-inline">establish standardized curriculum, required outcomes, and accreditation standards for the
			 Collegiate Training Initiative program; and</text>
						</subparagraph><subparagraph id="H699F1893987D45D29B91A691DFCAA812"><enum>(D)</enum><text display-inline="yes-display-inline">annually review the air traffic controller training initiatives carried out by the Administration
			 and provide advice and recommendations to the Administrator on whether
			 such initiatives are appropriate to meet the needs of the air traffic
			 controller workforce.</text>
						</subparagraph></paragraph><paragraph id="H8BD60FE1C1CD4034990C1294E8342364"><enum>(3)</enum><header>Membership</header>
						<subparagraph id="H69BECD4D5FE7418E807A1CD7ECABD2C0"><enum>(A)</enum><header>Number and appointment</header><text display-inline="yes-display-inline">The Committee shall be composed of 9 members appointed by the Administrator as follows:</text>
							<clause id="HB682EA3965EC4C13B2520EA2F1D565BA"><enum>(i)</enum><text display-inline="yes-display-inline">2 individuals based on recommendations of the Association of Collegiate Training Institutions.</text>
							</clause><clause id="HE18418FF6C3E4D41B8DE66C368B9CEE8"><enum>(ii)</enum><text display-inline="yes-display-inline">2 individuals based on recommendations of the National Air Traffic Controllers Association.</text>
							</clause><clause id="H7D3B103900BA46D3B66D7455FF04ACBE"><enum>(iii)</enum><text display-inline="yes-display-inline">2 individuals based on recommendations of the University Aviation Association.</text>
							</clause><clause id="H220F942BC7B44533BDBDD3546B9112E8"><enum>(iv)</enum><text>3 individuals selected by the Administrator who meet the requirements of subparagraph (B).</text>
							</clause></subparagraph><subparagraph id="H8F624FA6A1E74574B643BB86E7F6B260"><enum>(B)</enum><header>Qualifications</header><text>Individuals appointed pursuant to subparagraph (A)(iv)—</text>
							<clause id="H45604D3696474D60B7DE6AA1DB719EBA"><enum>(i)</enum><text>may not be employees of the Federal Aviation Administration; and</text>
							</clause><clause id="H20CC99075BC6403A8DDC99C8BF9D77DF"><enum>(ii)</enum><text display-inline="yes-display-inline">shall be specifically qualified to serve on the Committee as a result of their education, training,
			 and experience.</text>
							</clause></subparagraph><subparagraph id="H7603A6C54DFC4CD59487D6A3168E7BAB"><enum>(C)</enum><header>Terms</header>
							<clause id="H40EA71D3B1D04046B43E0FF428B891EC"><enum>(i)</enum><header>In general</header><text>A member shall be appointed for a term of 2 years.</text>
							</clause><clause id="HE78086DDB2774DDEBD083E82E60F16C3"><enum>(ii)</enum><header>Terms of initial appointees</header><text>As designated by the Administrator at the time of appointment—</text>
								<subclause id="HA3D110255301455084251681C5FA5D5F"><enum>(I)</enum><text>1 of the members first appointed under each of subparagraphs (A)(i), (A)(ii), and (A)(iii) shall be
			 appointed for a term of 3 years; and</text>
								</subclause><subclause id="HA21E44FCAC0E4664BC73890B9D77D566"><enum>(II)</enum><text>2 of the members first appointed under subparagraph (A)(iv) shall be appointed for terms of 3
			 years.</text>
								</subclause></clause></subparagraph><subparagraph id="HB9A642A2008D4E2CA15959B5B5FDA6F6"><enum>(D)</enum><header>Vacancies</header>
							<clause id="HD9C2E15AF4A54EA4830A13A506BBA8D5"><enum>(i)</enum><header>In general</header><text>Any member appointed to fill a vacancy occurring before the expiration of the term for which the
			 member’s predecessor was appointed shall be appointed only for the
			 remainder of that term.</text>
							</clause><clause id="H9150280CD62F46948D524371EDDA8C7C"><enum>(ii)</enum><header>Interim service</header><text display-inline="yes-display-inline">A member may serve after the expiration of that member’s term until a successor has taken office.</text>
							</clause><clause id="H431BC84BD39A40A8B81AEA3C6F92A678"><enum>(iii)</enum><header>Manner of appointment</header><text display-inline="yes-display-inline">A vacancy in the Committee shall be filled in the manner in which the original appointment was
			 made.</text>
							</clause></subparagraph><subparagraph id="H74B8D2D438C248FF94E2C92F990340E9"><enum>(E)</enum><header>Pay; travel expenses</header><text display-inline="yes-display-inline">Members shall serve without pay but may receive travel expenses, including per diem in lieu of
			 subsistence, when attending meetings of the Committee in accordance with
			 applicable provisions under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5.</text>
						</subparagraph><subparagraph id="H808341A9E95C4CD6841BC3919770EDD3"><enum>(F)</enum><header>Chairperson</header><text display-inline="yes-display-inline">The Chairperson of the Committee shall be elected by a majority of the members.</text>
						</subparagraph><subparagraph id="HA19FF86A425E4758A172B72DB47228B4"><enum>(G)</enum><header>Meetings</header><text display-inline="yes-display-inline">The Committee shall meet quarterly and may have additional meetings at the call of the Chairperson.</text>
						</subparagraph></paragraph><paragraph id="H813778A9B9EC402FA2B0369ABCA6BC6C"><enum>(4)</enum><header>Annual report</header>
						<subparagraph id="HCC625779A0C44D21BFC3EA11DD9B0CC9"><enum>(A)</enum><header>In general</header><text>Not later than May 31st of each year, the Committee shall submit to Congress and the Administrator
			 an annual report containing—</text>
							<clause id="H7A0322D0C745404C824123A9DDA3BFCA"><enum>(i)</enum><text>the findings and recommendations of the Committee; and</text>
							</clause><clause id="H17FCDE19D1954C81AC5628FDE5D13A87"><enum>(ii)</enum><text display-inline="yes-display-inline">beginning with the second annual report, an assessment of whether or not the Administrator has
			 complied with the Committee’s recommendations from the previous year.</text>
							</clause></subparagraph><subparagraph commented="no" id="HD94401223EB7403E949AB03612322D00"><enum>(B)</enum><header>FAA comments</header><text display-inline="yes-display-inline">Not later than 60 days after the date of submission of an annual report that includes an assessment
			 described in subparagraph (A)(ii), the Administrator shall submit to
			 Congress and the Committee a report containing the Administrator’s written
			 response to the assessment, including an explanation as to why the
			 Administrator did or did not comply with each recommendation of the
			 Committee.</text>
						</subparagraph></paragraph><paragraph id="H74BF0F08E8EE4374A4F33B2B44AB41F8"><enum>(5)</enum><header>Termination</header><text display-inline="yes-display-inline">Section 14(a)(2)(B) of the Federal Advisory Committee Act (5 U.S.C. App.; relating to the
			 termination of advisory committees) shall not apply to the Committee.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HC32CD9B2B1C243859DAD8883C3C7677B"><enum>5.</enum><header>Best practices for training air traffic controllers</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/44506">Section 44506</external-xref> of title 49, United States Code, is further amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="H0490968B1F7943A0AD4795112D3439BE" style="OLC">
				<subsection id="H27F1EB6BAFD44B7A9CB5357DDC0D0906"><enum>(h)</enum><header>Best practices for training</header><text display-inline="yes-display-inline">The Administrator, in consultation with the Air Traffic Control Education and Training Advisory
			 Committee established under subsection (g), shall take into consideration
			 any locally developed training initiatives for air traffic controllers for
			 use in establishing best practices nationwide.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
