		<official-title>To require full funding of part A of title I of the Elementary and Secondary Education Act of 1965
			 and the Individuals with Disabilities Education Act.</official-title>

		<section id="H01D93767832E456EAACFE8D24BE77AB4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Keep Our Promise to America’s Children and Teachers Act</short-title></quote> or the <quote><short-title>Keep Our PACT Act</short-title></quote>.</text>
		</section><section id="HC66012B2E4AE46E3BD69788E79888EAA"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds as follows:</text>
			<paragraph id="H2B3B1D5B204B4FA1969D5748D94762D3"><enum>(1)</enum><text>Children are our Nation’s future and greatest treasure.</text>
			</paragraph><paragraph id="HB8859C479EF64AC4AFB0A516817052AF"><enum>(2)</enum><text>A high-quality education is the surest way for every child to reach his or her full potential.</text>
			</paragraph><paragraph id="H9F4FF16E52DD4C3A84F9798BDD2B3E80"><enum>(3)</enum><text>Title I of the Elementary and Secondary Education Act of 1965 helps address inequity in education
			 in school districts across the country to provide a high-quality education
			 to every student.</text>
			</paragraph><paragraph id="HC54D2BBD1C7348938AC15E532CAC6EAC"><enum>(4)</enum><text>The Individuals with Disabilities Education Act guarantees all children with disabilities a
			 first-rate education.</text>
			</paragraph><paragraph id="H79B5D5FE6AB2412B930FB49C2A79A8BB"><enum>(5)</enum><text>The Individuals with Disabilities Education Improvement Act committed Congress to providing 40
			 percent of the national current average per-pupil expenditure for students
			 with disabilities.</text>
			</paragraph><paragraph id="H5A518EFD1C894EC4AC04E96D0BAD7378"><enum>(6)</enum><text>A promise made must be a promise kept.</text>
			</paragraph></section><section id="HBE68408DFCEA49DF9322A66C4AE36A76"><enum>3.</enum><header>Full funding of part A of title I of ESEA</header>
			<subsection id="H4F65448A19EF445E940F74CE5EA3DC14"><enum>(a)</enum><header>Funding</header><text>There are appropriated, out of any money in the Treasury not otherwise appropriated—</text>
				<paragraph id="H2D921EAD7BD842E090FFB535B2F391B2"><enum>(1)</enum><text>for fiscal year 2015, an amount that equals the difference between—</text>
					<subparagraph id="H3809B1A46AEA4C6E984924D9AD19F533"><enum>(A)</enum><text>the amount appropriated for fiscal year 2015 for programs under part A of title I of the Elementary
			 and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311 et seq.</external-xref>); and</text>
					</subparagraph><subparagraph id="H6A714314EFFC4203A90BC2E8E1F48BB7"><enum>(B)</enum><text>$16,553,821,000 or the full amount authorized to be appropriated for the fiscal year for those
			 programs, whichever is higher;</text>
					</subparagraph></paragraph><paragraph id="H3B7F054F98F94A06AAC2FEDEFC7F17EC"><enum>(2)</enum><text>for fiscal year 2016, an amount that equals the difference between—</text>
					<subparagraph id="H57E282824AB8466EBF6FC97892CC1DE4"><enum>(A)</enum><text>the amount appropriated for fiscal year 2015 for programs under part A of title I of the Elementary
			 and Secondary Education Act of 1965; and</text>
					</subparagraph><subparagraph id="HCC619763386B4A44BADA1F99E5A39F76"><enum>(B)</enum><text>$19,049,895,000 or the full amount authorized to be appropriated for the fiscal year for those
			 programs, whichever is higher;</text>
					</subparagraph></paragraph><paragraph id="HC594ABA984FF4767B8ED4E525143C8D5"><enum>(3)</enum><text>for fiscal year 2017, an amount that equals the difference between—</text>
					<subparagraph id="H1861D2A85D0E476A99D18396B093F77D"><enum>(A)</enum><text>the amount appropriated for fiscal year 2015 for programs under part A of title I of the Elementary
			 and Secondary Education Act of 1965; and</text>
					</subparagraph><subparagraph id="H911FD29AB6B1456E8D97D18EAE104A31"><enum>(B)</enum><text>$21,922,342,000 or the full amount authorized to be appropriated for the fiscal year for those
			 programs, whichever is higher;</text>
					</subparagraph></paragraph><paragraph id="HFD472D45AC4846AF80FE4C6674FED916"><enum>(4)</enum><text>for fiscal year 2018, an amount that equals the difference between—</text>
					<subparagraph id="H31DE2DF77EDE41FAB66D6E57479DD10F"><enum>(A)</enum><text>the amount appropriated for fiscal year 2015 for programs under part A of title I of the Elementary
			 and Secondary Education Act of 1965; and</text>
					</subparagraph><subparagraph id="HF8035A45FF8C4D528474943256A1047B"><enum>(B)</enum><text>$25,227,912,000 or the full amount authorized to be appropriated for the fiscal year for those
			 programs, whichever is higher;</text>
					</subparagraph></paragraph><paragraph id="H0828244553FB4B9FABAFFB40B20DDAD7"><enum>(5)</enum><text>for fiscal year 2019, an amount that equals the difference between—</text>
					<subparagraph id="HD526650B51874036933637A6B219C1FD"><enum>(A)</enum><text>the amount appropriated for fiscal year 2015 for programs under part A of title I of the Elementary
			 and Secondary Education Act of 1965; and</text>
					</subparagraph><subparagraph id="H80A46A6B5699497FBBA2725BCA927D7E"><enum>(B)</enum><text>$29,031,913,000 or the full amount authorized to be appropriated for the fiscal year for those
			 programs, whichever is higher;</text>
					</subparagraph></paragraph><paragraph id="H61AA6729F1304CC9A5F2E6071A879CA2"><enum>(6)</enum><text>for fiscal year 2020, an amount that equals the difference between—</text>
					<subparagraph id="H3B060AEC5C4B4EFFB61D47F0446C3E3B"><enum>(A)</enum><text>the amount appropriated for fiscal year 2015 for programs under part A of title I of the Elementary
			 and Secondary Education Act of 1965; and</text>
					</subparagraph><subparagraph id="H848606A26D3D41458B2A27077410F4AB"><enum>(B)</enum><text>$33,409,503,000 or the full amount authorized to be appropriated for the fiscal year for those
			 programs, whichever is higher;</text>
					</subparagraph></paragraph><paragraph id="HDABF170719A24297A68965416542C315"><enum>(7)</enum><text>for fiscal year 2021, an amount that equals the difference between—</text>
					<subparagraph id="HDEE64920B5DF425392B6AD4C77252CF2"><enum>(A)</enum><text>the amount appropriated for fiscal year 2015 for programs under part A of title I of the Elementary
			 and Secondary Education Act of 1965; and</text>
					</subparagraph><subparagraph id="H6CB5320A8E9248418020E1E1F099289E"><enum>(B)</enum><text>$38,447,168,000 or the full amount authorized to be appropriated for the fiscal year for those
			 programs, whichever is higher;</text>
					</subparagraph></paragraph><paragraph id="H8AAE577D624043179F46E39BBBEDF519"><enum>(8)</enum><text>for fiscal year 2022, an amount that equals the difference between—</text>
					<subparagraph id="H6AE9F3F7964D4EB5BDBC9AE5B97C1B2E"><enum>(A)</enum><text>the amount appropriated for fiscal year 2015 for programs under part A of title I of the Elementary
			 and Secondary Education Act of 1965; and</text>
					</subparagraph><subparagraph id="H3BB2348707F74B46AC1F2CFB45BC0700"><enum>(B)</enum><text>$44,244,442,000 or the full amount authorized to be appropriated for the fiscal year for those
			 programs, whichever is higher;</text>
					</subparagraph></paragraph><paragraph id="H6C64985E4E60454CB74CED26FE033A4E"><enum>(9)</enum><text>for fiscal year 2023, an amount that equals the difference between—</text>
					<subparagraph id="H2CA8A90133384261932D218DD96DAA5A"><enum>(A)</enum><text>the amount appropriated for fiscal year 2015 for programs under part A of title I of the Elementary
			 and Secondary Education Act of 1965; and</text>
					</subparagraph><subparagraph id="H3BAD88B5D3E74297A8DCEBBFC5598E9C"><enum>(B)</enum><text>$50,915,859,000 or the full amount authorized to be appropriated for the fiscal year for those
			 programs, whichever is higher; and</text>
					</subparagraph></paragraph><paragraph id="H09359DD8677B4FB49FDC439C8BFFAE9C"><enum>(10)</enum><text>for fiscal year 2024, an amount that equals the difference between—</text>
					<subparagraph id="HA56C288FB7174DF8908DF872286B119E"><enum>(A)</enum><text>the amount appropriated for fiscal year 2015 for programs under part A of title I of the Elementary
			 and Secondary Education Act of 1965; and</text>
					</subparagraph><subparagraph id="H7685ABEA57A847E8B260FD3EC7DC4268"><enum>(B)</enum><text>$58,593,228,000 or the full amount authorized to be appropriated for the fiscal year for those
			 programs, whichever is higher.</text>
					</subparagraph></paragraph></subsection></section><section id="HF25CA7C45D6D4705ABF10966FB01A56D"><enum>4.</enum><header>Mandatory funding of the Individuals with Disabilities Education Act</header><text display-inline="no-display-inline">Section 611(i) of the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1441">20 U.S.C. 1441(i)</external-xref>) is amended to
			 read as follows:</text>

				<subsection id="H9BBF62917B4F4E2B98355147F470403D"><enum>(i)</enum><header>Funding</header>
					<paragraph id="H6D10491F15CE4CBD9E2BCAB3DC317F71"><enum>(1)</enum><header>In general</header><text>For the purpose of carrying out this part, other than section 619, there are authorized to be
			 appropriated—</text>
						<subparagraph id="HFA600AB8D6F54A029B34F4D1A52AE457"><enum>(A)</enum><text>$12,906,093,000 or 16.8 percent of the amount determined under paragraph (2), whichever is greater,
			 for fiscal year 2015, and there are hereby appropriated $1,433,245,000 or
			 1.5 percent of the amount determined under paragraph (2), whichever is
			 greater, for fiscal year 2015, which shall become available for obligation
			 on July 1, 2015, and shall remain available through September 30, 2016;</text>
						</subparagraph><subparagraph id="H720C896E2B864DCE9C84A252BA465ADB"><enum>(B)</enum><text>14,518,385,000 or 18.6 percent of the amount determined under paragraph (2), whichever is greater,
			 for fiscal year 2016, and there are hereby appropriated $3,045,437,000 or
			 3.3 percent of the amount determined under paragraph (2), whichever is
			 greater, for fiscal year 2016, which shall become available for obligation
			 on July 1, 2016, and shall remain available through September 30, 2017;</text>
						</subparagraph><subparagraph id="H7B32407E90DD49B2A1114BE7EBF748B2"><enum>(C)</enum><text>$16,332,093,000 or 20.4 percent of the amount determined under paragraph (2), whichever is greater,
			 for fiscal year 2017, and there are hereby appropriated $4,859,245,000 or
			 5.1 percent of the amount determined under paragraph (2), whichever is
			 greater, for fiscal year 2017, which shall become available for obligation
			 on July 1, 2017, and shall remain available through September 30, 2018;</text>
						</subparagraph><subparagraph id="H5482B1AB7F464775A71614CF9403B9E5"><enum>(D)</enum><text>$18,372,379,000 or 22.5 percent of the amount determined under paragraph (2), whichever is greater,
			 for fiscal year 2018, and there are hereby appropriated $6,899,531,000 or
			 7.2 percent of the amount determined under paragraph (2), whichever is
			 greater, for fiscal year 2018, which shall become available for obligation
			 on July 1, 2018, and shall remain available through September 30, 2019;</text>
						</subparagraph><subparagraph id="H8306F634221F4252A2F7C556F3453E05"><enum>(E)</enum><text>20,667,547,000 or 24.7 percent of the amount determined under paragraph (2), whichever is greater,
			 for fiscal year 2019, and there are hereby appropriated $9,194,699,000 or
			 9.4 percent of the amount determined under paragraph (2), whichever is
			 greater, for fiscal year 2019, which shall become available for obligation
			 on July 1, 2019, and shall remain available through September 30, 2020;</text>
						</subparagraph><subparagraph id="H042CEC40CE5F4E02A3D4995A9BCFB67C"><enum>(F)</enum><text>$23,249,438,000 or 27.2 percent of the amount determined under paragraph (2), whichever is greater,
			 for fiscal year 2020, and there are hereby appropriated $11,776,590,000 or
			 11.9 percent of the amount determined under paragraph (2), whichever is
			 greater, for fiscal year 2020, which shall become available for obligation
			 on July 1, 2020, and shall remain available through September 30, 2021;</text>
						</subparagraph><subparagraph id="HE57B76598B844D19BA6C3E073BFBD6EE"><enum>(G)</enum><text>$26,153,872,000 or 30 percent of the amount determined under paragraph (2), whichever is greater,
			 for fiscal year 2021, and there are hereby appropriated $14,681,024,000 or
			 14.7 percent of the amount determined under paragraph (2), whichever is
			 greater, for fiscal year 2021, which shall become available for obligation
			 on July 1, 2021, and shall remain available through September 30, 2022;</text>
						</subparagraph><subparagraph id="H50037DDE18234F42852B26C84BE55AE0"><enum>(H)</enum><text>$29,421,143,000 or 33 percent of the amount determined under paragraph (2), whichever is greater,
			 for fiscal year 2022, and there are hereby appropriated $17,948,295,000 or
			 17.7 percent of the amount determined under paragraph (2), whichever is
			 greater, for fiscal year 2022, which shall become available for obligation
			 on July 1, 2022, and shall remain available through September 30, 2023;</text>
						</subparagraph><subparagraph id="H9EAC32EF3AB945219A17BF89547068C3"><enum>(I)</enum><text>$33,096,577,000 or 36.3 percent of the amount determined under paragraph (2), whichever is greater,
			 for fiscal year 2023, and there are hereby appropriated $21,623,729,000 or
			 21 percent of the amount determined under paragraph (2), whichever is
			 greater, for fiscal year 2023, which shall become available for obligation
			 on July 1, 2023, and shall remain available through September 30, 2024;
			 and</text>
						</subparagraph><subparagraph id="HEED64F2650EB4290B3A7C8DCC2A03557"><enum>(J)</enum><text>$37,231,164,000 or 40 percent of the amount determined under paragraph (2), whichever is greater,
			 for fiscal year 2024 and each subsequent fiscal year, and there are hereby
			 appropriated $37,231,164,000 or 40 percent of the amount determined under
			 paragraph (2), whichever is greater, for fiscal year 2024 and each
			 subsequent fiscal year, which—</text>
							<clause id="H67614124473E486BA535B1F6DDD2AD2A"><enum>(i)</enum><text>shall become available for obligation with respect to fiscal year 2024 on July 1, 2024, and shall
			 remain available through September 30, 2025; and</text>
							</clause><clause id="HA405496480474C3D8B8113FA8022D629"><enum>(ii)</enum><text>shall become available for obligation with respect to each subsequent fiscal year on July 1 of that
			 fiscal year and shall remain available through September 30 of the
			 succeeding fiscal year.</text>
							</clause></subparagraph></paragraph><paragraph id="HEE7EFDBE0A9048019FDF5E53CFC918F3"><enum>(2)</enum><header>Amount</header><text>With respect to each subparagraph of paragraph (1), the amount determined under this paragraph is
			 the product of—</text>
						<subparagraph id="H519E1B33D7A84144A6BAE159AE9872C1"><enum>(A)</enum><text>the total number of children with disabilities in all States who—</text>
							<clause id="H0F1CB04434AB4B9885BC119A6112E876"><enum>(i)</enum><text>received special education and related services during the last school year that concluded before
			 the first day of the fiscal year for which the determination is made; and</text>
							</clause><clause id="H6FF7DF782E7B45E2B0780D4E6A006862"><enum>(ii)</enum><text>were aged—</text>
								<subclause id="H030F5A19B602438DA3D130CA492E6FCE"><enum>(I)</enum><text>3 through 5 (with respect to the States that were eligible for grants under section 619); and</text>
								</subclause><subclause id="HC69E76DCA38644BDBF8AD2B0A2A3F15E"><enum>(II)</enum><text>6 through 21; and</text>
								</subclause></clause></subparagraph><subparagraph id="H4CA4A4AD6AE14FF2A89884621B6FCFB2"><enum>(B)</enum><text>the average per-pupil expenditure in public elementary schools and secondary schools in the United
			 States.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H0DCE7776DFAD4E57A4BD52CF89C0DFAE"><enum>5.</enum><header>Offset</header><text display-inline="no-display-inline">The amounts appropriated by this Act and the amendments made by this Act shall be expended
			 consistent with pay-as-you-go requirements.</text>
