		<official-title>To amend the AIDS Housing Opportunity Act to modernize the formula and terms for allocations to
			 prevent homelessness for individuals living with HIV or AIDS.</official-title>

		<section id="H7BCBF126808B48998BB89CF6BDF6EB5A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Housing for Persons With AIDS Modernization Act of 2014</short-title></quote>.</text>
		</section><section id="H136623A59DFC4C7BA5DEA23FC820DEB5"><enum>2.</enum><header>Formula and terms for allocations to prevent homelessness for individuals living with HIV or AIDS</header>
			<subsection id="H0C047F0FE3DA4071BA54A2066EDC020D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subsection (c) of section 854 of the AIDS Housing Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12903">42 U.S.C. 12903(c)</external-xref>) is amended
			 by—</text>
				<paragraph id="HC2FB5BBB029F48B686BE28DFA6A25D6F"><enum>(1)</enum><text>redesignating paragraph (3) as paragraph (5); and</text>
				</paragraph><paragraph id="H6914BB9BC5124D0F8FF609469AC48D0A"><enum>(2)</enum><text>striking paragraphs (1) and (2) and inserting the following:</text>
					<quoted-block id="H1A6EC7C5408F47098E0E08C72BE52E6E" style="OLC">
						<paragraph id="H68CBE10147EC444F95DA230BCDE1DE9A"><enum>(1)</enum><header>Allocation of resources</header>
							<subparagraph id="HE3AEDCA3D81845A9B9C1C027BCD98F99"><enum>(A)</enum><header>Allocation formula</header><text>The Secretary shall allocate 90 percent of the amount approved in appropriations Acts under section
			 863 among States and metropolitan statistical areas as follows:</text>
								<clause id="H15BC8F8D08724307AC49458276FF12F4"><enum>(i)</enum><text>75 percent of such amounts among—</text>
									<subclause id="H775F9CBE2B8B4DF89E851DD7363DAB63"><enum>(I)</enum><text>cities that are the most populous unit of general local government in a metropolitan statistical
			 area with a population greater than 500,000, as determined on the basis of
			 the most recent census, and with more than 2,000 individuals living with
			 HIV or AIDS, using the data specified in subparagraph (B); and</text>
									</subclause><subclause id="HF827C965054349C3AE5729AB22664A26"><enum>(II)</enum><text display-inline="yes-display-inline">States with more than 2,000 individuals living with HIV or AIDS outside of metropolitan statistical
			 areas.</text>
									</subclause></clause><clause id="HDE80109E6C0A4627A5FABA4E034B105B"><enum>(ii)</enum><text>25 percent of such amounts among States and metropolitan statistical areas based on the method
			 described in subparagraph (C).</text>
								</clause></subparagraph><subparagraph id="HABB1C72139F04A6D93D7E65ED426D745"><enum>(B)</enum><header>Source of data</header><text display-inline="yes-display-inline">For purposes of allocating amounts under this paragraph for any fiscal year, the number of
			 individuals living with HIV or AIDS shall be the number of such
			 individuals as confirmed by the Director of the Centers for Disease
			 Control and Prevention, as of December 31 of the most recent calendar year
			 for which such data is available.</text>
							</subparagraph><subparagraph id="H540EE2011A5E45FEB5FF89194A8C828D"><enum>(C)</enum><header>Allocation under subparagraph <enum-in-header>(A)(ii)</enum-in-header></header><text>For purposes of allocating amounts under subparagraph (A)(ii), the Secretary shall develop a method
			 that accounts for—</text>
								<clause id="HA3D62DE68C9F4EC587DFC3870FAF3F2C"><enum>(i)</enum><text>differences in housing costs among States and metropolitan statistical areas based on the fair
			 market rental established pursuant to section 8(c) of the United States
			 Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(c)</external-xref>) or another methodology
			 established by the Secretary through regulation; and</text>
								</clause><clause id="HC96D91F56B7F43888BE707310D9C8EEE"><enum>(ii)</enum><text display-inline="yes-display-inline">differences in poverty rates among States and metropolitan statistical areas based on area poverty
			 indexes or another methodology established by the Secretary through
			 regulation.</text>
								</clause></subparagraph></paragraph><paragraph id="H43CEEB23BAD8457EA860CCF3D380C927"><enum>(2)</enum><header>Maintaining grants</header>
							<subparagraph id="H3B6D30631FC8426EBD0ACC1E98B734A1"><enum>(A)</enum><header>Continued eligibility of fiscal year 2014 grantees</header><text>A grantee that received an allocation in fiscal year 2014 shall continue to be eligible for
			 allocations under paragraph (1) in subsequent fiscal years, subject to—</text>
								<clause id="H161F1F26EAE0477CBBA2D601DF1D6784"><enum>(i)</enum><text>the amounts available from appropriations Acts under section 863;</text>
								</clause><clause id="HCFEAE722000748E08B39939336BC8D0B"><enum>(ii)</enum><text>approval by the Secretary of the most recent comprehensive housing affordability strategy for the
			 grantee approved under section 105; and</text>
								</clause><clause id="H5C45872971104021BE16B39493E43068"><enum>(iii)</enum><text>the requirements of subparagraph (C).</text>
								</clause></subparagraph><subparagraph id="HF870A9E107B94C2FABEC01A5FFF3A9E7"><enum>(B)</enum><header>Adjustments</header><text>Allocations to grantees described in subparagraph (A) shall be adjusted annually based on the
			 administrative provisions included in fiscal year 2014 appropriations
			 Acts.</text>
							</subparagraph><subparagraph id="HAE94F96869F04072949DFBE88DABBD01"><enum>(C)</enum><header>Redetermination of continued eligibility</header><text>The Secretary shall redetermine the continued eligibility of a grantee that received an allocation
			 in fiscal year 2014 at least once during the 10-year period following
			 fiscal year 2014.</text>
							</subparagraph><subparagraph id="H6615FD97E8FB4AEF99C4F1E9D172D3EC"><enum>(D)</enum><header>Adjustment to grants</header><text>For each of fiscal years 2015, 2016, and 2017, the Secretary shall ensure that a grantee that
			 received an allocation in the prior fiscal year does not receive an
			 allocation that is 10 percent less than or 20 percent greater than the
			 amount allocated to such grantee in the preceding fiscal year.</text>
							</subparagraph></paragraph><paragraph id="H6E3C78D2585D49D09647CD0AFB7585D5"><enum>(3)</enum><header>Alternative grantees</header>
							<subparagraph id="H3979995061D64879AC07493B48641B10"><enum>(A)</enum><header>Requirements</header><text>The Secretary may award funds reserved for a grantee eligible under paragraph (1) to an alternative
			 grantee if—</text>
								<clause id="H6D06CB202F9740D2A118885645A39136"><enum>(i)</enum><text>the grantee submits to the Secretary a written agreement between the grantee and the alternative
			 grantee that describes how the alternative grantee will take actions
			 consistent with the applicable comprehensive housing affordability
			 strategy approved under section 105 of this Act;</text>
								</clause><clause id="H92D5532F865C485685999117363A5F26"><enum>(ii)</enum><text display-inline="yes-display-inline">the Secretary approves the written agreement described in clause (i) and agrees to award funds to
			 the
			 alternative grantee; and</text>
								</clause><clause id="H96AF7571FB0C4EB7A6E36A334F501279"><enum>(iii)</enum><text>the written agreement does not exceed a term of 10 years.</text>
								</clause></subparagraph><subparagraph id="H40A84951C9F342DE864EE3BB1246D496"><enum>(B)</enum><header>Renewal</header><text>An agreement approved pursuant to subparagraph (A) may be renewed by the parties with the approval
			 of the Secretary.</text>
							</subparagraph><subparagraph id="HC38939A7A8A349349C51015A40E15A6E"><enum>(C)</enum><header>Definition</header><text>In this paragraph, the term <term>alternative grantee</term> means a public housing agency (as defined in section 3(b) of the United States Housing Act of 1937
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437a">42 U.S.C. 1437a(b)</external-xref>)), a unified funding agency (as defined in section 401
			 of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11360">42 U.S.C. 11360</external-xref>)), a State,
			 a unit of general local government, or an instrumentality of State or
			 local government.</text>
							</subparagraph></paragraph><paragraph id="HBC2459E8DF9F46B9821D1AC64DEA1F97"><enum>(4)</enum><header>Reallocations</header><text display-inline="yes-display-inline">If a State or metropolitan statistical area declines an allocation under paragraph (1)(A), or the
			 Secretary determines, in accordance with criteria specified in regulation,
			 that a State or metropolitan statistical area that is eligible for an
			 allocation under paragraph (1)(A) is unable to properly administer such
			 allocation, the Secretary shall reallocate any funds reserved for such
			 State or metropolitan statistical area as follows:</text>
							<subparagraph id="H55F336054E884DC28232DE87D0BE976C"><enum>(A)</enum><text>For funds reserved for a State—</text>
								<clause id="H41D781FC11F34A19954719CEFAB5B648"><enum>(i)</enum><text>to eligible metropolitan statistical areas within the State on a pro rata basis; or</text>
								</clause><clause id="H7C05F0568A94443B8ECF7044544268E5"><enum>(ii)</enum><text>if there is no eligible metropolitan statistical areas within a State, to metropolitan cities and
			 urban counties within the State that are eligible for grant under section
			 106 of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5306">42 U.S.C. 5306</external-xref>),
			 on a pro rata basis.</text>
								</clause></subparagraph><subparagraph id="H8AEAD88323D14EC186708EB05583F72B"><enum>(B)</enum><text display-inline="yes-display-inline">For funds reserved for a metropolitan statistical area, to the State in which the metropolitan
			 statistical area is located.</text>
							</subparagraph><subparagraph id="H815E112FD0D04B91B3BD63FA2EBE8203"><enum>(C)</enum><text>If the Secretary is unable to make a reallocation under subparagraph (A) or (B), the Secretary
			 shall make such funds available on a pro rata basis under the formula in
			 paragraph (1)(A).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H3BC4C4CD001045059F5A9FB2D1B58312"><enum>(b)</enum><header>Amendment to definitions</header><text display-inline="yes-display-inline">Section 853 of such Act is amended—</text>
				<paragraph id="HF6CBB6AD2C1F428582CDE3AAC0D400B6"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by inserting <quote>or <quote>AIDS</quote></quote> before <quote>means</quote>; and</text>
				</paragraph><paragraph id="H8BB863EEB4294C8C9D45A6B095568936"><enum>(2)</enum><text>by inserting at the end the following new paragraphs:</text>
					<quoted-block display-inline="no-display-inline" id="H421271AAEBFD466FACF752E81BB0B723" style="OLC">
						<paragraph id="H0176C07AD26A49FFB4B729241DE8D0E5"><enum>(15)</enum><text display-inline="yes-display-inline">The term <term>HIV</term> means infection with the human immunodeficiency virus.</text>
						</paragraph><paragraph id="H327D8ADC448A414BAAE8D49E7FA24C3A"><enum>(16)</enum><text display-inline="yes-display-inline">The term <term>individuals living with HIV or AIDS</term> means, with respect to the counting of cases in a geographic area during a period of time, the sum
			 of—</text>
							<subparagraph id="HFE635E5E398243ED83F24D2C538DBD6C">
								<enum>(A)</enum>
								<text>the number of living non-AIDS cases of HIV in the area; and</text>
							</subparagraph><subparagraph id="HA4543C4BB3A2448EA9D2DDC9949F997E">
								<enum>(B)</enum>
								<text>the number of living cases of AIDS in the area.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
