		<section id="H1F87C180BC254D11A9B20A6E2BA2FD4A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fair Local Adjustment for Tenant Rents Act of 2014</short-title></quote>.</text>
		</section><section id="H220D80C3B73B40E2AA22C9D41C044C0C" section-type="subsequent-section"><enum>2.</enum><header>Public housing flat rents</header>
			<subsection id="H56ED09ACFDB148D9A450804DB5D69102"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Clause (i) of section 3(a)(2)(B) of the United States Housing Act of 1937 (42 U.S.C.
			 1437a(a)(2)(B)(i)) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H64918071AFFE4DB18348BF1B7543A48F" style="OLC">
					<clause id="HF46F2C7764064903A6D0936FE0B62F43"><enum>(i)</enum><header>Flat rents</header>
						<subclause id="H2F2D3232F50448119ADA7F6864910246"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">Each public housing agency shall establish, for each dwelling unit in public housing owned or
			 operated by the agency, a flat rental amount for the dwelling unit, which
			 shall—</text>
							<item id="HC20403B440F44A239D13A10371B7822A"><enum>(aa)</enum><text>be based on the rental value of the unit, as determined by the public housing agency, but may not
			 be an amount that is less than 80 percent of the applicable fair market
			 rental established under section 8(c) of this Act; or</text>
							</item><item id="HDACEE42338984CE89A3006CA2DE28E9E"><enum>(bb)</enum><text>be established using another factor as determined by the Secretary.</text>
							</item></subclause><subclause id="H7A104D35C73246C9B6BA7AB59CA3175A"><enum>(II)</enum><header>Exceptions</header><text>A public housing agency may request that the Secretary may establish a flat rent for a dwelling in
			 an amount that is less than the minimum amount established pursuant to
			 subclause (I) for the unit, if the public housing agency demonstrates that
			 such minimum amount is not an accurate measure of the rental value for the
			 unit.</text>
						</subclause><subclause id="H52138169787A4CF397925D0F70B61B5D"><enum>(III)</enum><header>Rent increases</header><text display-inline="yes-display-inline">If a new flat rental amount established pursuant to this clause for a dwelling unit would increase
			 the existing rental payment of any family residing in public housing as of
			 implementation of such flat rent by more than 35 percent, the new flat
			 rental amount shall be phased in as necessary to ensure that the family’s
			 existing rental payment does not increase by more than 35 percent
			 annually.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H5C9DFE620F1D4C2BBFB4A1F12EB1296D"><enum>(b)</enum><header>Implementation</header><text display-inline="yes-display-inline">The Secretary of Housing and Urban Development shall implement section 3(a)(2)(B)(i) of the United
			 States Housing Act of 1937, as amended by subsection (a) of this section,
			 not later than the expiration of the 6-month period beginning on the date
			 of the enactment of this Act.</text>
			</subsection></section><section id="HDF4D6F129E1845298DE05853B0C1FCD2"><enum>3.</enum><header>Minimum rents for public housing and section 8 rental assistance programs</header>
			<text display-inline="no-display-inline">Subparagraph (A) of section 3(a)(3) of the United States Housing Act of 1937 (42 U.S.C.
			 1437a(a)(3)(A)) is amended, in the matter preceding clause (i), by
			 striking <quote>more than</quote> and inserting <quote>less than</quote>.</text>
