		<section id="H65B953E9057C4FC0959484968D24DB81" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Transit Accessibility Innovation Act of 2014</short-title></quote>.</text>
		</section><section id="H15B9733DB1FC4CBF82784BC6D6458C5A"><enum>2.</enum><header>Transit accessibility innovation program</header>
			<subsection id="HAE56E980A2B6475090B7FD79067EA154"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/53">Chapter 53</external-xref> of title 49, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/49/5307">section 5307</external-xref> the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H0009B99FB8B244C2986A9E2BCF5E4967" style="USC">
					<section id="HF0ABF7A9575B4E78B33D2ECF1C247B0E"><enum>5308.</enum><header>Transit accessibility innovation program</header>
						<subsection id="H43BEA81FAAE5425582F778396E50B77B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall carry out a transit accessibility innovation program in accordance with the
			 requirements of this section to encourage public transit systems to take
			 actions to address deficiencies in service for individuals with
			 disabilities.</text>
						</subsection><subsection id="HF64CBB1E3B6C498E83C244CD2E76F2E2"><enum>(b)</enum><header>Grants authority</header>
							<paragraph id="H6B916E3AE53A4E5D9B95D15002EDD456"><enum>(1)</enum><header>In general</header><text>In carrying out the program, the Secretary shall distribute amounts made available to carry out
			 this section as competitive discretionary grants to public transit
			 agencies for eligible projects.</text>
							</paragraph><paragraph id="H8ADD95DA53E64FEE8A4B58863B667F2A"><enum>(2)</enum><header>Selection criteria</header><text display-inline="yes-display-inline">The Secretary shall develop criteria to ensure that projects receiving funding under the program
			 are innovative and replicable in other communities, and will result in a
			 substantive improvement in service for individuals with disabilities.</text>
							</paragraph></subsection><subsection id="H420CA4F9F428499D99448864EF730FDB"><enum>(c)</enum><header>Applications</header>
							<paragraph id="H5DFB7273A1D8410CB455664C76E9A2D8"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In order to be eligible to receive a grant under the program, a public transit agency shall submit
			 to the Secretary an application at such time, in such form, and containing
			 such information as the Secretary may require.</text>
							</paragraph><paragraph id="H0E09F4458ABB4221B42455EFD56FABB0"><enum>(2)</enum><header>Contents</header><text>An application for a grant under the program shall contain, at a minimum, a description of—</text>
								<subparagraph id="H2BBE02BFAB4D47C7AA13DC069E88E436"><enum>(A)</enum><text>the project for which the applicant is seeking funding;</text>
								</subparagraph><subparagraph id="H89DC253BBC4C44EAB0D9294A90C7BA8B"><enum>(B)</enum><text display-inline="yes-display-inline">the anticipated benefits the project will deliver for the following long-term outcomes: community
			 integration, safety, accessibility, quality, coordination, and customer
			 service;</text>
								</subparagraph><subparagraph id="H0B0D477EA3E24211A7D4A4C4EB91ADB0"><enum>(C)</enum><text display-inline="yes-display-inline">the expected contribution of the project to the inclusion of individuals with disabilities in the
			 delivery of public transportation and ADA paratransit service;</text>
								</subparagraph><subparagraph id="H094D250BCCFA4501B2766BAA9EC84012"><enum>(D)</enum><text>the ability of the project to facilitate innovation in providing public transportation to
			 individuals with disabilities; and</text>
								</subparagraph><subparagraph id="HDA776768C19D4BD3B247635BD86ECBAC"><enum>(E)</enum><text display-inline="yes-display-inline">the ability of the project to attract new partnerships and non-Federal funding, including State,
			 local, private, and philanthropic funding.</text>
								</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H6DC87B9110C749FA915C24C81A93111C"><enum>(3)</enum><header>Community coordination requirements</header>
								<subparagraph id="H241EC58DBDEB4628BE893FD81D32C900"><enum>(A)</enum><header>Certification</header><text display-inline="yes-display-inline">To ensure that projects receiving funding under this section address the needs of individuals with
			 disabilities in a geographic area, an application for a grant under the
			 program shall contain a certification that—</text>
									<clause id="HB7AF75E39FAC429FACA618BE7AE758C5"><enum>(i)</enum><text display-inline="yes-display-inline">each project for which the applicant is seeking funding is included in a locally developed,
			 coordinated public transit-human services transportation plan; and</text>
									</clause><clause id="HB24CAE0AFA104BDB8EE553CB4A4E2298"><enum>(ii)</enum><text>the plan was developed and approved through a process that included community participation,
			 including by—</text>
										<subclause id="HE7DC77A9FC314D91B68D8BB295A90E9C"><enum>(I)</enum><text>seniors;</text>
										</subclause><subclause id="HE870E05A8ADC4873ADD563AAF8F566D1"><enum>(II)</enum><text>individuals with disabilities;</text>
										</subclause><subclause id="H988C5311D9D747318A926CA5B59C381F"><enum>(III)</enum><text>representatives of public, private, and nonprofit transportation and human service providers; and</text>
										</subclause><subclause id="H6B6C0D8302B44D2890BC6D9D966572CB"><enum>(IV)</enum><text>other members of the public.</text>
										</subclause></clause></subparagraph><subparagraph id="HF780BC8AA69940B1AEFFEED683DDF254"><enum>(B)</enum><header>Use of existing plans</header><text>A plan used to coordinate the funding of projects under section 5310 may be used to satisfy the
			 requirements of subparagraph (A).</text>
								</subparagraph><subparagraph id="H691512872A9247D88E35D0E5DBF12138"><enum>(C)</enum><header>Limitation</header><text>The requirements of this paragraph shall not apply to the transportation promotion pilot program
			 established under this section.</text>
								</subparagraph></paragraph></subsection><subsection id="H315A58FF81F94204802E5AD0DC9A323E"><enum>(d)</enum><header>Factors</header><text>In providing grant funds for projects under the program, the Secretary shall consider, at a
			 minimum, the ability of the project to—</text>
							<paragraph id="H53B90F986FFB4852BA7C03D15480A9A0"><enum>(1)</enum><text display-inline="yes-display-inline">enhance accessibility to rail and fixed route bus service;</text>
							</paragraph><paragraph id="HE5F6CDDEDBA141738A5738C5E5C52BAC"><enum>(2)</enum><text display-inline="yes-display-inline">promote paratransit coordination with other programs and utilize other revenue streams;</text>
							</paragraph><paragraph id="H6026E8FB541F4F8CA2CA4B65646085C5"><enum>(3)</enum><text display-inline="yes-display-inline">increase service quality to address customer complaints;</text>
							</paragraph><paragraph id="H6F9468AD74B0432A8043D80013E9D993"><enum>(4)</enum><text display-inline="yes-display-inline">provide fixed route travel training for passengers and specialized training for paratransit
			 personnel;</text>
							</paragraph><paragraph id="H4F75D9B7905A44DE85F238174C39ADC8"><enum>(5)</enum><text display-inline="yes-display-inline">reduce turnover through increased wages and benefits, and increase monitoring, in the provision of
			 ADA paratransit;</text>
							</paragraph><paragraph id="H287911B332CC470BA47926ED13CA6F37"><enum>(6)</enum><text>provide ADA complementary paratransit services in a way that maximizes quality, reliability,
			 safety, customer satisfaction, and a stable workforce by determining what
			 factors within contracting might impact the quality of ADA paratransit
			 services;</text>
							</paragraph><paragraph id="HEF31A1F908ED4706899B04B85FA85DFF"><enum>(7)</enum><text display-inline="yes-display-inline">improve ADA paratransit on-time performance and interoperability with other transportation services
			 available to people with disabilities, both public and private;</text>
							</paragraph><paragraph id="H589B8923A42B4A63BC4B1AB12C7B1B73"><enum>(8)</enum><text display-inline="yes-display-inline">delay or suspend proposed ADA paratransit service cuts triggered by the elimination or cutting of
			 fixed route bus routes;</text>
							</paragraph><paragraph id="H50724EC58E554D4C9B7133C13BEB35FD"><enum>(9)</enum><text>delay or suspend cuts for paratransit services that exceed ADA requirements, except that grant
			 funds may not be issued under this section more than once for the same
			 route (or a significantly similar route);</text>
							</paragraph><paragraph id="H41DB7D6384D94B9BAFE775183AE01DA9"><enum>(10)</enum><text display-inline="yes-display-inline">increase opportunities for community integration and independence of people with disabilities by
			 promoting access to employment and other resources; and</text>
							</paragraph><paragraph id="H1DBD34B5534B4541A67EA5AC3FEC5717"><enum>(11)</enum><text display-inline="yes-display-inline">augment passenger safety, without compromising passengers’ rights under the ADA.</text>
							</paragraph></subsection><subsection id="H57D58357B2BD41E3BCF507EB0D5CF955"><enum>(e)</enum><header>Practices To promote successful outcomes and sharing of information</header>
							<paragraph id="H1F8AC95DCA694D199DF49FBD855E3CE8"><enum>(1)</enum><header>Priority</header><text display-inline="yes-display-inline">In providing grant funds for eligible projects under the program, the Secretary shall give priority
			 to projects that are replicable in other communities using existing
			 resources.</text>
							</paragraph><paragraph id="H7871C928A7054CDB885727BCCB72C6C6"><enum>(2)</enum><header>Set aside for activities to promote sharing of best practices</header><text>For each fiscal year, the Secretary shall—</text>
								<subparagraph id="H52A7E8524F6149C3BF4926A497F822C5"><enum>(A)</enum><text>set aside 2 percent of the funds made available to carry out this section; and</text>
								</subparagraph><subparagraph id="H05A376ECE2F04473ADD006BC28FCA347"><enum>(B)</enum><text display-inline="yes-display-inline">use those amounts to carry out activities to ensure that innovative practices, program models, and
			 new service delivery options are collected, reviewed, and disseminated to
			 other public transit agencies, so that the practices, models, and options
			 can be replicated in other communities.</text>
								</subparagraph></paragraph><paragraph id="H4CD07B3C7F1442D8AAA93064081FB1B4"><enum>(3)</enum><header>Technical assistance</header><text>The Secretary shall provide technical assistance to recipients of grant funds under the program to
			 ensure that the projects carried out using the funds are successful.</text>
							</paragraph></subsection><subsection id="H8D62B6CBE05C42078503B7D843810FE7"><enum>(f)</enum><header>Maintenance of effort</header>
							<paragraph id="HBAFFE21B463D4C7BB490860E301E0534"><enum>(1)</enum><header>ADA minimum standards</header><text>Funds received under the program may not be used to meet the minimum standards of the ADA,
			 including ADA complementary paratransit service requirements.</text>
							</paragraph><paragraph id="HFEC4D6C2C1EE45AF86F9DD791F472075"><enum>(2)</enum><header>Certification</header><text display-inline="yes-display-inline">To ensure that grant activities are not supplanting existing, budgeted services and that public
			 transit agencies are upholding maintenance of effort on existing programs,
			 a public transit agency receiving grant funds under the program shall—</text>
								<subparagraph id="HADB0257F611C410AB46A4DC9D0150D5C"><enum>(A)</enum><text>certify that the funds will not be used to pay for existing services; or</text>
								</subparagraph><subparagraph id="H3655EA01981E4BF39323AE1CCBCF8EBE"><enum>(B)</enum><text>provide an explanation as to why the existing services are justified grant activities.</text>
								</subparagraph></paragraph></subsection><subsection id="HA625C10411D74F108067546401F65A7B"><enum>(g)</enum><header>Grant requirements</header><text display-inline="yes-display-inline">A grant under this section shall be subject to the same requirements as a grant under section 5307,
			 except that any public transit agency may use grant funds received under
			 the program for operating expenses.</text>
						</subsection><subsection id="H2C3C60888B9F4F4B81C44C34BA7F95DE"><enum>(h)</enum><header>Transportation promotion pilot program</header>
							<paragraph id="H1BE8681A55744E7DA462BBA13D4B833B"><enum>(1)</enum><header>Set aside</header><text display-inline="yes-display-inline">For each fiscal year, the Secretary shall—</text>
								<subparagraph id="H632217D9E26A4A83A0C6E0BE9D8C8DF3"><enum>(A)</enum><text display-inline="yes-display-inline">set aside 1 percent of the funds made available to carry out this section or $100,000, whichever
			 amount is greater; and</text>
								</subparagraph><subparagraph id="H482FB00FC21A4E7294671923DC02BE29"><enum>(B)</enum><text display-inline="yes-display-inline">use those amounts to carry out a transportation promotion pilot program under this subsection.</text>
								</subparagraph></paragraph><paragraph id="HB0931E198F134495B1CEB6E696837A56"><enum>(2)</enum><header>Purpose</header><text>The purpose of the transportation promotion pilot program shall be to ensure that—</text>
								<subparagraph id="HBD72253001074BB5A7C9B59D5CAB109F"><enum>(A)</enum><text>public transit agencies fulfill their requirements under the ADA; and</text>
								</subparagraph><subparagraph id="H3F7829244B804FC482559D8E8759136F"><enum>(B)</enum><text>individuals with disabilities have advocates to ensure greater opportunities for integration and
			 access into transit systems.</text>
								</subparagraph></paragraph><paragraph id="HD213F9E6B3034F709745B075706A5B0C"><enum>(3)</enum><header>Grant authority</header>
								<subparagraph id="H0A750038FB32410FBFBE983CF61D7E00"><enum>(A)</enum><header>In general</header><text>In carrying out the transportation promotion pilot program, the Secretary shall make grants to—</text>
									<clause id="H05F4123C351A4CCB90D08DDE37953036"><enum>(i)</enum><text display-inline="yes-display-inline">agencies implementing a system established under section 143 of the Developmental Disabilities
			 Assistance and Bill of Rights Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/15043">42 U.S.C. 15043</external-xref>) that have
			 demonstrated histories of transportation expertise or advocacy; and</text>
									</clause><clause id="H977E2346FEB54891B6CC249507F26990"><enum>(ii)</enum><text>nonprofit organizations that have demonstrated histories of transportation expertise or advocacy.</text>
									</clause></subparagraph><subparagraph id="H23024D23FD124CE5AAAAB68EE857FBF7"><enum>(B)</enum><header>Eligibility</header><text>To be eligible to receive a grant under this paragraph, an agency or organization shall demonstrate
			 to the Secretary that the agency or organization—</text>
									<clause id="HA4053119D4F9441DA45062ABE6A9EC9C"><enum>(i)</enum><text>has a mission that includes individual or systemic advocacy and monitoring to address the
			 transportation needs of individuals with disabilities; and</text>
									</clause><clause id="H6B5D299EBCCE4B618525DFF4A348852E"><enum>(ii)</enum><text>has the support of other organizations in the disability community.</text>
									</clause></subparagraph><subparagraph id="HB08E0B77A92B4FF5A281B4E0E83CDCB6"><enum>(C)</enum><header>Use of grants</header><text>Grants funds received under this paragraph shall be used to fund individual or systemic advocacy
			 and monitoring to address the transportation needs of people with
			 disabilities.</text>
								</subparagraph></paragraph></subsection><subsection id="H5C8E07558061404FB472351A7A7C3258"><enum>(i)</enum><header>Limitation on statutory construction</header><text>Nothing in this section may be construed to affect projects or activities carried out under section
			 5310 or the funding of such projects or activities.</text>
						</subsection><subsection id="HA44B122E80AB448AB777210F539EFD14"><enum>(j)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section, the following definitions apply:</text>
							<paragraph id="H711862C928FA4F8883DE2C5FB47986A0"><enum>(1)</enum><header>ADA</header><text display-inline="yes-display-inline">The term <quote>ADA</quote> means the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12101">42 U.S.C. 12101 et seq.</external-xref>).</text>
							</paragraph><paragraph id="HFFDD99950D7340819C2BAF8A7734014E"><enum>(2)</enum><header>ADA paratransit</header><text display-inline="yes-display-inline">The term <quote>ADA paratransit</quote> means the provision of nonfixed route paratransit transportation services in accordance with
			 section 223 of the ADA (<external-xref legal-doc="usc" parsable-cite="usc/42/12143">42 U.S.C. 12143</external-xref>).</text>
							</paragraph></subsection><subsection id="HC07F935AEA8E4D1A9C5B3C507ED0ACFA"><enum>(k)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $100,000,000 for each of fiscal
			 years 2015 through 2020.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HFD864CBA102841CC83D1D1DA3DC9B3AA"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for such chapter is amended by inserting after the item relating to section 5307 the
			 following:</text>

			</subsection></section><section id="H5712F7D5C47A42AB88EC91C21F3E4D5C"><enum>3.</enum><header>Raising caps on use of formula funds for provision of nonfixed route paratransit transportation
			 services</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/5302">Section 5302(3)(I)</external-xref> of title 49, United States Code, is amended by striking <quote>10 percent</quote> and inserting <quote>15 percent</quote>.</text>
