		<official-title>To amend title 5, United States Code, to provide that for purposes of computing the annuity of
			 certain law enforcement officers, any hours worked in excess of the
			 limitation applicable to law enforcement availability pay shall be
			 included in such computation, and for other purposes.</official-title>

		<section id="HC7E6662FB2DD498795572D2306D9910F" section-type="section-one"><enum>1.</enum><header>Short title; findings</header>
			<subsection id="H9D12D5F07E1C4CEE8B95F87516BA4932"><enum>(a)</enum><header>Short title</header><text display-inline="yes-display-inline">This Act may be cited as the <quote><short-title>LEO Fair Retirement Act of 2014</short-title></quote>.</text>
			</subsection><subsection id="H0676D12FE0984D0A8E4EFD5D054284BA"><enum>(b)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text>
				<paragraph id="HBAE31D7DC249420285436990157B7C6F"><enum>(1)</enum><text display-inline="yes-display-inline">Federal law enforcement officers are never <quote>off-duty</quote>. They are counted on to respond at any time of the day or night, regardless of their official duty
			 status, to protect the public safety. Outside of our Nation’s armed
			 forces, theirs is the only occupation comprised of individuals who are
			 routinely called upon to put their lives on the line to keep America safe.</text>
				</paragraph><paragraph id="H4654BCE1D51F45E3A2506C05DFC13F9C"><enum>(2)</enum><text>Though the Federal Government may house the largest variety of occupations of any U.S. employer
			 across its panoply of agencies and entities, Federal law enforcement is
			 absolutely unique among them, and the Federal law enforcement officer has
			 no counterpart in the private sector. It is one of the most stressful,
			 most dangerous, and most rewarding careers for those who meet the rigorous
			 requirements of the job.</text>
				</paragraph><paragraph id="H375476334B14405B9C70010BE77E3DA2"><enum>(3)</enum><text>It was in recognition of the unique nature of the occupation, and the demanding schedules required
			 of those who fill its ranks, that Congress established distinct pay and
			 benefit systems for Federal law enforcement positions. This includes basic
			 pay, retirement, and even overtime compensation, in the form of either Law
			 Enforcement Availability Pay (<quote>LEAP</quote>) or Administratively Uncontrollable Overtime (<quote>AUO</quote>).</text>
				</paragraph><paragraph id="H2331A1ED3B9345F8893A8D5ABA477AF8"><enum>(4)</enum><text>Under current law, LEAP by its very nature is provided to law enforcement officers to ensure that
			 they are <quote>available</quote>, that they will be <quote>generally and reasonably accessible by the agency</quote> in excess of the 40-hour workweek to perform unscheduled duty based on the agency’s needs.</text>
				</paragraph><paragraph id="H469E4FEFFF544A5BB6E60DAECBB33706"><enum>(5)</enum><text>Similarly, AUO was established to provide overtime to certain law enforcement officers in positions
			 where <quote>the hours of duty cannot be controlled administratively</quote> and that require <quote>substantial amounts of irregular, unscheduled overtime duty</quote>.</text>
				</paragraph><paragraph id="H0EE2062369D84E3C94F213B45C8D65C3"><enum>(6)</enum><text>Because both LEAP and AUO compensation are subject to the pay caps, they are payable to a Federal
			 law enforcement officer only to the extent that the payments do not cause
			 the aggregate of the employee’s basic pay and premium pay to exceed the
			 established caps.</text>
				</paragraph><paragraph id="HE196AD4914634122A7C9A59CED6D1BCB"><enum>(7)</enum><text>In light of the continuing homeland and national security threats facing our Nation, and after a
			 three-year Federal pay freeze, it is in the interest of the Federal
			 Government to ensure that it can continue to recruit and retain the
			 highest caliber personnel by guaranteeing Federal law enforcement officers
			 full credit in retirement for overtime hours worked but never paid.</text>
				</paragraph></subsection></section><section id="HF549838E9E6E4E349238CF85EC87EC9A"><enum>2.</enum><header>Computation of annuity for hours worked in excess of law enforcement availability pay and
			 administratively uncontrollable overtime limitations</header>
			<subsection id="HBB1442A4576F47C295DDC5208F72C363"><enum>(a)</enum><header>CSRS</header>
				<paragraph id="HEB33B7C2515140EFB8C3B0FECA7C1E7C"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/8339">Section 8339</external-xref> of title 5, United States Code, is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H80A2EED4AB7C4280A437D1B1CD149006" style="USC">
						<subsection id="H837BD1FD8C7A41C49AF7E87CCF4B1296"><enum>(v)</enum>
							<paragraph commented="no" display-inline="yes-display-inline" id="H36AF2BD79BDC47DF841555A3AB11296E"><enum>(1)</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of this title, including sections 5545a and 5547, any law
			 enforcement availability pay under section 5545a that would have been
			 received by an individual described under section 8331(3)(E) (i) or (ii)
			 but for the limitation provided in such section 5547 shall be included in
			 the average pay of such an individual for purposes of computing the
			 annuity of such an individual under this section.</text>
							</paragraph><paragraph id="HDED14408F99447B7A8690D8D30220480" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of this title, including section 5545(c)(2), any
			 administratively uncontrollable overtime pay under such section that would
			 have been received by an employee but for the limitation provided in such
			 section shall be included in the average pay of such employee for purposes
			 of computing the annuity of such employee under this section.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HAC5C0F3CEEDE4A33B1DA724BC958B054"><enum>(2)</enum><header>Clarification with respect to annuity limit</header><text display-inline="yes-display-inline">The limitation provided in <external-xref legal-doc="usc" parsable-cite="usc/5/8339">section 8339(f)</external-xref> of title 5, United States Code, shall apply to any
			 annuity calculated pursuant to subsection (v) of such section (as added by
			 paragraph (1)).</text>
				</paragraph></subsection><subsection id="HABBBCBC25F8C43CB9BAEF42760E86267"><enum>(b)</enum><header>FERS</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/5/8415">Section 8415</external-xref> of title 5, United States Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H221E6274374A4043BADE6772E84BD2FC" style="USC">
					<subsection id="H33BD362BE36E4B2A8AACBECEE92A8E4A"><enum>(o)</enum>
						<paragraph commented="no" display-inline="yes-display-inline" id="HE6740E3EDB854B01B3040AECB0676E78"><enum>(1)</enum><text>Notwithstanding any other provision of this title, including sections 5545a and 5547, any law
			 enforcement availability pay under section 5545a that would have been
			 received by any individual described under section 8331(3)(E) (i) or (ii)
			 but for the limitation provided in such section 5545a or 5547 shall be
			 included in the average pay of such an individual for purposes of
			 computing the annuity of such an individual under this section.</text>
						</paragraph><paragraph id="H22C4AC2E42614278B1EF8C40FF00927A" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of this title, including section 5545(c)(2), any
			 administratively uncontrollable overtime pay under such section that would
			 have been received by an employee but for the limitation provided in such
			 section shall be included in the average pay of such employee for purposes
			 of computing the annuity of such employee under this section.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H165555564BB342DAB5F33F1C75151C17"><enum>(c)</enum><header>Application</header><text>The amendments made by this section shall apply to any applicable annuity calculated on or after
			 the date that is one year after the date of enactment of this Act.</text>
