		<official-title>To amend <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/44">chapter 44</external-xref> of title 18, United States Code, to require homemade firearms to have serial
			 numbers, and for other purposes.</official-title>

		<section id="H99A6AE1A11B649529CF7AA87B8D29062" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Homemade Firearms Accountability Act of 2014</short-title></quote>.</text>
		</section><section id="H36A62A4607BB482BB190D90F754BB648"><enum>2.</enum><header>Requirement that homemade firearms have serial numbers</header>
			<subsection id="HD6B2CAABEE93406899203A58798871E7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/44">Chapter 44</external-xref> of title 18, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/18/923">section 923</external-xref> the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H03C274488FC8444EA151EFC4E77C5C78" style="USC">
					<section id="HDA796EFBA4D246168C1D4AE74EA7D708"><enum>923A.</enum><header>Serial numbers for homemade firearms</header>
						<subsection id="H601B9855EE774E589A4DED3B8BF880B4"><enum>(a)</enum><header>Request</header><text display-inline="yes-display-inline">A person who has attained 18 years of age and desires to make a firearm, or obtain a unique serial
			 number or other identifying mark for a firearm made by the person after
			 1968, may request a licensed dealer to issue a unique serial number or
			 other identifying mark for the firearm, which request shall describe the
			 firearm involved, and state whether the firearm will be (or is) a handgun.</text>
						</subsection><subsection id="HB49643EC4BF94E2AA84875E21007145A"><enum>(b)</enum><header>Consideration</header>
							<paragraph id="HD6F14E52588D409488323A914AE5E997"><enum>(1)</enum><header>Treatment of request as transfer proposal</header><text display-inline="yes-display-inline">A request made of a licensed dealer pursuant to subsection (a) with respect to a firearm shall be
			 treated as a proposed transfer of the firearm from the licensed dealer to
			 the applicant, for purposes of section 922(t) of this title and section
			 103 of the Brady Handgun Violence Prevention Act.</text>
							</paragraph><paragraph id="HF2923DCC1C7249C9A978DF7CAB3ABECD"><enum>(2)</enum><header>Issuance of serial number</header><text display-inline="yes-display-inline">A licensed dealer may issue to an applicant a unique serial number and identifying mark for a
			 firearm pursuant to such a request if, applying paragraph (1) of this
			 subsection to the request, section 922(t) or other law would not prohibit
			 the licensed dealer from transferring the firearm to the applicant.</text>
							</paragraph><paragraph id="H83DF618FDF2E4AF0B6332E197EA9B50C"><enum>(3)</enum><header>Fee authority</header><text>A licensed dealer may charge an applicant a fee for each serial number and identifying mark
			 assigned and issued under this section, in an amount that is not more than
			 the actual costs associated with assigning and issuing the serial number
			 and identifying mark, and a fee for contacting the national instant
			 criminal background check system with respect to the applicant.</text>
							</paragraph></subsection><subsection id="HDE2AEABDCDA1413C9F2F853571F96235"><enum>(c)</enum><header>Prohibitions; requirements</header>
							<paragraph id="H2FEE244A043C490D82D7FBEDC90C36DE"><enum>(1)</enum><header>Ban on making firearm before obtaining serial number</header><text>It shall be unlawful for any person, in or affecting interstate or foreign commerce, to make a
			 firearm, unless the person has obtained a serial number and identifying
			 mark for the firearm under this section.</text>
							</paragraph><paragraph id="HDCB9CB61E6264D6BBD81B4701E0D1B34"><enum>(2)</enum><header>Ban on possession or transfer of firearm without serial number</header><text display-inline="yes-display-inline">It shall be unlawful for any person, in or affecting interstate or foreign commerce, to possess or
			 transfer a firearm made by the person after 1968, unless—</text>
								<subparagraph id="H26EA31DD16404062A5605805A164B94E"><enum>(A)</enum><text display-inline="yes-display-inline">a serial number and identifying mark for the firearm has been issued under this section;</text>
								</subparagraph><subparagraph id="HE4BC0A291A1646498C019F0C720CDF05"><enum>(B)</enum><text display-inline="yes-display-inline">within 10 days after the issuance, the serial number and identifying mark is stamped on or
			 otherwise permanently affixed to the firearm; and</text>
								</subparagraph><subparagraph id="HB22AA532AE8A4D42B4A2E123B555B26E"><enum>(C)</enum><text display-inline="yes-display-inline">if the firearm is made from polymer plastic, 3.7 ounces of material type 17–4 PH stainless steel,
			 on which the unique serial number or identifying mark is stamped or
			 otherwise permanently affixed, are embedded within the plastic.</text>
								</subparagraph></paragraph><paragraph id="H5AF0E398459049E18742041045045B6A"><enum>(3)</enum><header>Exceptions</header><text display-inline="yes-display-inline">This subsection shall not apply to—</text>
								<subparagraph id="H4F66FAA8F80F41EE8182FEDBB458495E"><enum>(A)</enum><text>a firearm to which a serial number has been assigned pursuant to section 923 of this title or
			 <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/53">chapter 53</external-xref> of the Internal Revenue Code of 1986; or</text>
								</subparagraph><subparagraph id="H3D868866704C431EB461175336B3950A"><enum>(B)</enum><text>a licensed manufacturer.</text>
								</subparagraph></paragraph></subsection><subsection id="H5E3159814E474913997A8AAD6F06BE4B"><enum>(d)</enum><header>Administrative provision</header><text>The Attorney General shall maintain, and make available on request, information on—</text>
							<paragraph id="H6DFF3EB9CA364C11B56CFD283870439C"><enum>(1)</enum><text>the number of serial numbers and identifying marks issued under this section; and</text>
							</paragraph><paragraph id="H12A233FA47AD4C64A452F8CD9804271B"><enum>(2)</enum><text>the number of arrests for violations of this section.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HEE481286ADE5488CBD50469B6482ACD6"><enum>(b)</enum><header>Penalties</header><text>Section 924(a) of such title is amended—</text>
				<paragraph id="H7A6E41E0856A4A9A89ECC80DCF139509"><enum>(1)</enum><text>in paragraph (5), by adding at the end the following: <quote>For purposes of this paragraph, the issuance of a serial number and identifying mark for a firearm
			 in violation of section 923A shall be considered a transfer of the firearm
			 in violation of section 922(t).</quote>; and</text>
				</paragraph><paragraph id="HB5D2D513DDBD4F6EBBC58647198F1E22"><enum>(2)</enum><text>by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H680C2ADCFDE44FB0B23AF0A7C3D119FB" style="OLC">
						<paragraph id="H42E44C60C17D4CFCB10F56F4763DBC2A" indent="up1"><enum>(8)</enum><text display-inline="yes-display-inline">Whoever knowingly violates section 923A(c) shall be fined under this title, imprisoned not more
			 than 6 months (or, if the firearm involved in the violation is a handgun,
			 1 year), or both.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HB03621E4F9F942CE9B4FD92A3037D9B1"><enum>(c)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for chapter 44 of such title is amended by inserting after the item relating
			 to section 923 the following:</text>

			</subsection><subsection id="H875BD2593AFD47E6A9574CFB558E39AA"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on January 1, 2016.</text>
