<section id="H3F2D0CEEF52E42E28D39BBD1229A9B05" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Students from Worthless Degrees Act</short-title></quote>.</text></section> 
<section id="H8A71CD5A15434DDF9391AA1B29D1FC1A"><enum>2.</enum><header>Consumer protections for students</header> 
<subsection id="H6BB194FB1A2D406BB80998345305ACB9"><enum>(a)</enum><header>In general</header> 
<paragraph id="H64DEFF720244477FB58EC0798A378C0E"><enum>(1)</enum><header>Definitions</header><text>In this section:</text> 
<subparagraph id="H9B2C88025DEB46FB8174E3445AEC4AE3"><enum>(A)</enum><header>Federal financial assistance program</header><text>The term <quote>Federal financial assistance program</quote> means a program authorized and funded by the Federal Government under any of the following provisions of law:</text> 
<clause id="HF68E65C4F3534B80AF41A59585197878"><enum>(i)</enum><text>Title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070">20 U.S.C. 1070 et seq.</external-xref>).</text></clause> 
<clause id="H73C25A8FE7B44D169F386BC4BE009587"><enum>(ii)</enum><text>Title I of the Workforce Investment Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/29/2801">29 U.S.C. 2801 et seq.</external-xref>).</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H44D3E6C0A19A40578AA0EA48A115F223"><enum>(iii)</enum><text>The Adult Education and Family Literacy Act (<external-xref legal-doc="usc" parsable-cite="usc/20/9201">20 U.S.C. 9201 et seq.</external-xref>).</text></clause> 
<clause id="H54FA60E2FA2840A4B0E33AAE8F02F757"><enum>(iv)</enum><text>Chapter 30, 31, 32, 33, 34, or 35 of title 38, United States Code.</text></clause> 
<clause id="H1ED1E2A159884FC180CAEBD939C18036"><enum>(v)</enum><text>Chapter 101, 105, 106A, 1606, 1607, or 1608 of title 10, United States Code.</text></clause> 
<clause id="H6FA9F69C66A444819C103B44A22993D1"><enum>(vi)</enum><text>Section 1784a, 2005, or 2007 of title 10, United States Code.</text></clause></subparagraph> 
<subparagraph id="H110CB58F17604C8CA06A8A01B4247EBE"><enum>(B)</enum><header>Institution of higher education</header><text>The term <quote>institution of higher education</quote>—</text> 
<clause id="HD7DBAD12CB52451F980E6A20D601FF29"><enum>(i)</enum><text>with respect to a program authorized under subparagraph (A)(i), has the meaning given the term in section 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>);</text></clause> 
<clause id="H5DAFAE262BF94C7B8BD25DB3B25D9DBB"><enum>(ii)</enum><text>with respect to a program authorized under subparagraph (A)(ii), has the meaning given the term <term>postsecondary educational institution</term> as defined in section 101 of the Workforce Investment Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/29/2801">29 U.S.C. 2801</external-xref>);</text></clause> 
<clause id="H9F8B9B4CB6F040DFB8B3FF63D3DE025E"><enum>(iii)</enum><text>with respect to a program authorized under subparagraph (A)(iii), has the meaning given the term <term>postsecondary educational institution</term> as defined in section 203 of the Adult Education and Family Literacy Act (<external-xref legal-doc="usc" parsable-cite="usc/20/9202">20 U.S.C. 9202</external-xref>);</text></clause> 
<clause id="HC177EE542455409BB49EA373A0E65847"><enum>(iv)</enum><text>with respect to a program authorized under subparagraph (A)(iv), has the meaning given the term <term>educational institution</term> under <external-xref legal-doc="usc" parsable-cite="usc/38/3452">section 3452</external-xref> of title 38, United States Code;</text></clause> 
<clause id="HCF4A467096EB4A8681EB5E38DC563A64"><enum>(v)</enum><text>with respect to a program authorized under subparagraph (A)(v), means an educational institution that awards a degree or certificate and is located in any State; and</text></clause> 
<clause id="HE7B1F626A5634B2F9B71620CCFE53476"><enum>(vi)</enum><text>with respect to a program authorized under subparagraph (A)(vi), means an educational institution that awards a degree or certificate and is located in any State.</text></clause></subparagraph> 
<subparagraph id="HCAB07BEBF0E3450DA387378C682A4FD9"><enum>(C)</enum><header>State</header> 
<clause id="H509E51C1571E4586A1186BB88290D898"><enum>(i)</enum><header>State</header><text>The term <term>State</term> includes, in addition to the several States of the United States, the Commonwealth of Puerto Rico, the District of Columbia, Guam, American Samoa, the United States Virgin Islands, the Commonwealth of the Northern Mariana Islands, and the freely associated States.</text></clause> 
<clause id="HF34A6A41595F4658863B29DFC0C59EFF"><enum>(ii)</enum><header>Freely associated States</header><text>The term <term>freely associated States</term> means the Republic of the Marshall Islands, the Federated States of Micronesia, and the Republic of Palau.</text></clause></subparagraph></paragraph> 
<paragraph id="H977AF1BCACFB47C4A5DCA9202A0D5045"><enum>(2)</enum><header>Consumer protections</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, an institution of higher education is not eligible to participate in a Federal financial assistance program with respect to any program of postsecondary education or training, including a degree or certificate program, that is designed to prepare students for entry into a recognized occupation or profession that requires licensing or other established requirements as a pre-condition for entry into such occupation or profession, unless—</text> 
<subparagraph id="H4E6DEE5917044630A57755C60E74EDA1"><enum>(A)</enum><text>the successful completion of the program fully qualifies a student, in the Metropolitan Statistical Area and State in which the student resides (and in any State in which the institution indicates, through advertising or marketing activities or direct contact with potential students, that a student will be prepared to work in the occupation or profession after successfully completing the program), to—</text> 
<clause id="H5B9669DAB7F54E179A8B4B35F3A296A8"><enum>(i)</enum><text>take any examination required for entry into the recognized occupation or profession in the Metropolitan Statistical Area and State in which the student resides, including satisfying all Federal, State, or professionally mandated programmatic and specialized accreditation requirements, if any; and</text></clause> 
<clause id="H0819837A5DB94886AE65E159C8A74DA3"><enum>(ii)</enum><text>be certified or licensed or meet any other academically related pre-conditions that are required for entry into the recognized occupation or profession in the State; and</text></clause></subparagraph> 
<subparagraph id="H343FB78598444BF2BE807614A3C8A70B"><enum>(B)</enum><text>the institution offering the program provides timely placement for all of the academically related pre-licensure requirements for entry into the recognized occupation or profession, such as clinical placements, internships, or apprenticeships.</text></subparagraph></paragraph> 
<paragraph id="H4DE1C6297DBE4381B6FBF18533E8574D"><enum>(3)</enum><header>Regulations on pre-accredited programs</header><text>The Secretary of Education shall promulgate regulations on requirements of an institution of higher education with respect to any program of the institution that is in a pre-accredited status, including limitations on, or requirements of, advertisement of the program to students. Such regulations shall be consistent with the provisions of paragraph (2).</text></paragraph> 
<paragraph id="H803A38CAD1534BBCB1E863449F3E972C"><enum>(4)</enum><header>Loan discharge</header><text>The Secretary of Education shall promulgate regulations that condition eligibility for an institution of higher education to participate in any Federal financial assistance program on the institution signing with each student enrolled in any program of the institution that is in a pre-accredited status, a loan discharge agreement.</text></paragraph></subsection> 
<subsection id="H6916486D837946D48E4D9B0A171D3E5A"><enum>(b)</enum><header>Effective date</header><text>This section shall be effective on the date that is 1 year after the date of enactment of this Act.</text></subsection></section>
