		<section id="HDB2838098C9C4ADAB56480DFFD0352D0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Exercise and Fitness For All Act</short-title></quote>.</text>
		</section><section id="H27B7A74F54D04EDDB3B0E752F06775FC"><enum>2.</enum><header>Findings and purpose</header>
			<subsection id="H282C0280B2544BC5BFDC5190C1C79FF3"><enum>(a)</enum><header>Findings</header><text>Congress finds the following:</text>
				<paragraph id="H16D6F5EEE05F4EB3B86CB7BFEDC6ED97"><enum>(1)</enum><text>Individuals with disabilities can maintain and improve their health through appropriate physical
			 activity.</text>
				</paragraph><paragraph id="HA36B5C63F0BE4E37BEDBC9D36A6FB6D6"><enum>(2)</enum><text>In the 2008 Physical Activity Guidelines for Americans (referred to as the <quote>Guidelines</quote>), the Department of Health and Human Services recommends that individuals with disabilities, who
			 are able, participate in regular aerobic activity.</text>
				</paragraph><paragraph id="HDFFB2891578041D6B0041DD0259AD400"><enum>(3)</enum><text>The Guidelines also recommend that adults with disabilities, who are able, do muscle-strengthening
			 activities of moderate or high intensity on 2 or more days a week, as
			 these activities provide additional health benefits.</text>
				</paragraph><paragraph id="H4479D699A9F2495988536F0807CE387E"><enum>(4)</enum><text>The Guidelines recommend that when adults with disabilities are not able to meet the Guidelines,
			 they should engage in regular physical activity according to their
			 abilities and avoid inactivity.</text>
				</paragraph><paragraph id="HDC38C45B90C449779F7714F4D8C897D8"><enum>(5)</enum><text>Unfortunately, many individuals with disabilities are unable to engage in the recommended exercise
			 or fitness activities due to the inaccessibility of exercise or fitness
			 equipment.</text>
				</paragraph><paragraph id="HFD03EE2285FC450494892C18D0D8C1FF"><enum>(6)</enum><text>Physical inactivity by adults with disabilities can lead to increased risk for functional
			 limitations and secondary health conditions.</text>
				</paragraph></subsection><subsection id="HF2358FA62EC0414B87A9A9447D5F3F68"><enum>(b)</enum><header>Purpose</header><text>The purposes of this Act are—</text>
				<paragraph id="H1AE9C58FCB9D45F5928B3F79CBE0FFB7"><enum>(1)</enum><text>to encourage exercise and fitness service providers to provide accessible exercise and fitness
			 equipment for individuals with disabilities; and</text>
				</paragraph><paragraph id="HF23CB66384654684ACE58F51259D36DD"><enum>(2)</enum><text>to provide guidance about the requirements necessary to ensure that such exercise and fitness
			 equipment is accessible to, and usable by, individuals with disabilities.</text>
				</paragraph></subsection></section><section id="H1AC9D93B37F249D29007FDE0E6AE113B"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H3772C504CC904F0B80DB6F6AEC759FFD"><enum>(1)</enum><header>Access Board</header><text>The term <term>Access Board</term> means the Architectural and Transportation Barriers Compliance Board established under section 502
			 of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/792">29 U.S.C. 792</external-xref>).</text>
			</paragraph><paragraph id="H2B3AD0F122D04D788934272186065FDB"><enum>(2)</enum><header>Accessible exercise or fitness equipment</header><text>The term <term>accessible exercise or fitness equipment</term> means exercise or fitness equipment that is accessible to, and can be independently used and
			 operated by, individuals with disabilities.</text>
			</paragraph><paragraph id="H74CBA47BAAED4E0489191B6BAB29934F"><enum>(3)</enum><header>Exercise or fitness equipment</header><text>The term <term>exercise or fitness equipment</term> means devices such as motorized treadmills, stair climbers or step machines, stationary bicycles,
			 rowing machines, weight machines, circuit training equipment,
			 cardiovascular equipment, strength equipment, or other exercise or fitness
			 equipment.</text>
			</paragraph><paragraph id="H95435D738365439091C2E4C04CC2E5DE"><enum>(4)</enum><header>Exercise or fitness service provider</header><text>The term <term>exercise or fitness service provider</term> means a gymnasium, health spa, health club, college or university facility, or other similar place
			 of exercise or fitness that—</text>
				<subparagraph id="HECA0C8FDC5634535B33E361FF85B367E"><enum>(A)</enum><text>is considered a public accommodation under section 301 of the Americans with Disabilities Act of
			 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12181">42 U.S.C. 12181</external-xref>) or is considered a public entity under section 201
			 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12131">42 U.S.C. 12131</external-xref>); and</text>
				</subparagraph><subparagraph id="H422BED7A931F4580B9238626416AE9D6"><enum>(B)</enum><text>provides exercise or fitness equipment for the use of its patrons.</text>
				</subparagraph></paragraph><paragraph id="HAC22D2F25C8F4BD6AA27F63E023F7BDC"><enum>(5)</enum><header>Individual with a disability</header><text>The term <term>individual with a disability</term> means any person with a disability as defined in section 3 of the Americans with Disabilities Act
			 of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12102">42 U.S.C. 12102</external-xref>).</text>
			</paragraph><paragraph id="HAB608B72137D43E0B379F239AA86F248"><enum>(6)</enum><header>Individuals with disabilities</header><text>The term <term>individuals with disabilities</term> means more than one individual with a disability.</text>
			</paragraph></section><section id="HA8341C2C445340B983D1767D700BD7B1"><enum>4.</enum><header>Exercise and fitness accessibility guidelines</header>
			<subsection id="H93F9E88029AB4EC3A057EB9BD30A25F5"><enum>(a)</enum><header>Establishment of guidelines</header><text>Not later than 18 months after the date of enactment of this Act, the Access Board shall develop
			 and publish guidelines for exercise or fitness service providers regarding
			 the provision of accessible exercise or fitness equipment, including
			 relevant personnel training.</text>
			</subsection><subsection id="HD99AF93C471A4D47A90A729EFCDFFE89"><enum>(b)</enum><header>Contents of guidelines</header><text>The guidelines described in subsection (a) shall—</text>
				<paragraph id="H7198897ABCCE405D88030B9C07B83D5B"><enum>(1)</enum><text>be consistent with the Standard Specification for Universal Design of Fitness Equipment for
			 Inclusive Use by Persons with Functional Limitations and Impairments of
			 the American Society for Testing and Materials (ASTM F3021–13) (and any
			 future revisions thereto);</text>
				</paragraph><paragraph id="HB530AD1A94E2435F9E14527766AEEFC5"><enum>(2)</enum><text>ensure that—</text>
					<subparagraph id="HE1B455DD1A3B4641B3475856218858AF"><enum>(A)</enum><text>exercise or fitness equipment is accessible to, and usable by, individuals with disabilities; and</text>
					</subparagraph><subparagraph id="HE10F9401632543E18AA102F0A9A465A7"><enum>(B)</enum><text>individuals with disabilities have independent entry to, use of, and exit from the exercise or
			 fitness equipment, to the maximum extent possible; and</text>
					</subparagraph></paragraph><paragraph id="H49D0BAE3FB974EA3A1F13582415DE669"><enum>(3)</enum><text>take into consideration the following:</text>
					<subparagraph id="HFEF2BF8548A04E63BAA690149EDD83D6"><enum>(A)</enum><text>Whether the exercise or fitness service provider is a new or existing facility.</text>
					</subparagraph><subparagraph id="HEE283C41A94346E4B6228B65BE07EB9C"><enum>(B)</enum><text>Whether the exercise or fitness service provider is staffed or not.</text>
					</subparagraph><subparagraph id="H28A35941C0174A0F8EE5704E88C18E6C"><enum>(C)</enum><text>Instruction and additional assistance on the use of the accessible exercise or fitness equipment
			 (including specific accessibility features) for individuals with
			 disabilities.</text>
					</subparagraph><subparagraph id="H316A2A034184496C89BB79228ACE9A82"><enum>(D)</enum><text>The size and overall financial resources of the exercise or fitness service provider.</text>
					</subparagraph><subparagraph id="H76765F223C1E423D88642B76C7471A93"><enum>(E)</enum><text>The availability of closed captioning of video programming displayed on equipment and televisions
			 provided by an exercise or fitness service provider.</text>
					</subparagraph></paragraph></subsection><subsection id="H4B09420EB2FB404588BE7D0CD218CF4B"><enum>(c)</enum><header>Review and amendment</header><text>The Access Board shall periodically review and, as appropriate, amend the guidelines, and shall
			 issue the resulting guidelines as revised guidelines.</text>
			</subsection></section><section id="HE1062162B9F24FB792D630E912BA1162"><enum>5.</enum><header>Tax credit for expenditures to provide accessible exercise or fitness equipment</header>
			<subsection id="HC43D9590F813416F954BDE214B3200F8"><enum>(a)</enum><header>In general</header><text>Paragraph (1) of <external-xref legal-doc="usc" parsable-cite="usc/26/44">section 44(c)</external-xref> of the Internal Revenue Code of 1986 is amended—</text>
				<paragraph id="HAA96858875E24453B685E6D509E9C936"><enum>(1)</enum><text>by striking <quote>paid or incurred by an eligible small business</quote> and inserting</text>
					<quoted-block display-inline="yes-display-inline" id="H9C1FCFC1B8B94983A7C38F6F3A53A045" style="OLC"><text>paid or incurred—</text><subparagraph id="H1656A73D7D9B401897DB004E3550C294"><enum>(A)</enum><text>by an eligible small business</text></subparagraph><after-quoted-block>,</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HA348B50FFDE9441BBF3ED8456176A857"><enum>(2)</enum><text>by striking <quote>section).</quote> and inserting <quote>section), and</quote>, and</text>
				</paragraph><paragraph id="H006D154719524A4D9630A63EE1D25D9F"><enum>(3)</enum><text>by inserting at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H2361205A5B04436EB8960294D6257C85" style="OLC">
						<subparagraph id="H90356443845F402CAC16F2C9FAC17464"><enum>(B)</enum><text>by an eligible small business which is an exercise or fitness service provider for the purpose of
			 providing for use by individuals with disabilities accessible exercise or
			 fitness equipment that meets the guidelines established by the Access
			 Board under section 4 of the Exercise and Fitness for All Act.</text>
						</subparagraph><quoted-block-continuation-text quoted-block-continuation-text-level="paragraph">Any term used in subparagraph (B) which is defined in section 3 of the Exercise and Fitness for All
			 Act shall have the meaning given such term in such section, as in effect
			 on the date of the enactment of such subparagraph.</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H9BC468CBBC26453793920142B680D356"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall apply to expenses paid or incurred in taxable years
			 beginning after the date of the enactment of this Act.</text>
