		<section id="H0544FDA13458439D9FFE84DAECE1ED11" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safer Trucks and Buses Act of 2014</short-title></quote>.</text>
		</section><section id="H384F5A8DF1DF41A2AECF5D468986A420"><enum>2.</enum><header>Compliance, Safety, Accountability initiative</header>
			<subsection id="H829E039CB2394557BBCD2486ED8F7645"><enum>(a)</enum><header>Data availability and use</header>
				<paragraph id="H24725A20DE134C28929A12768B76E5D4"><enum>(1)</enum><header>Availability</header><text>The Secretary of Transportation shall ensure that covered motor carrier data is not made available
			 to the public.</text>
				</paragraph><paragraph id="H292EBF045E104F168718F66EB02B3482"><enum>(2)</enum><header>Use</header><text>Covered motor carrier data may not be admitted into evidence or otherwise used in a civil action
			 for damages resulting from an incident involving a motor carrier.</text>
				</paragraph><paragraph id="H27386EE0F98D4DFFAFED4197FBD6A084"><enum>(3)</enum><header>Termination</header><text>Paragraphs (1) and (2) shall cease to have effect on the date on which the Secretary submits to
			 Congress the report required under subsection (d).</text>
				</paragraph></subsection><subsection id="HC52248E0C4B841B8A973D52100D32E00"><enum>(b)</enum><header>Initial report</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall submit to
			 Congress a report that contains recommendations on how to improve the
			 Compliance, Safety, Accountability initiative of the Federal Motor Carrier
			 Safety Administration, including recommendations to ensure that the
			 initiative—</text>
				<paragraph id="HBFB0868BB6844449B944731A80C22208"><enum>(1)</enum><text>utilizes and generates only safety data and scores, including Safety Measurement System scores,
			 determined to be predictive of motor carrier accidents;</text>
				</paragraph><paragraph id="HAE720EF01B0E451994E1FF4F287B568F"><enum>(2)</enum><text>appropriately addresses concerns relating to the age of utilized safety data, including violations;</text>
				</paragraph><paragraph id="HB8B2D0984C6F4602BF8763D27D843E98"><enum>(3)</enum><text display-inline="yes-display-inline">does not unfairly harm small motor carriers as a result of limited safety data availability;</text>
				</paragraph><paragraph id="H300A9EAC513B4B2F8C0E204DD2E8303F"><enum>(4)</enum><text display-inline="yes-display-inline">appropriately addresses differences between motor carriers transporting passengers and motor
			 carriers transporting freight;</text>
				</paragraph><paragraph id="HF470B1F811EA43E5B6986D1D46E582FC"><enum>(5)</enum><text>generates safety data that allows individual motor carriers, including safety scores assigned to
			 individual motor carriers, to be effectively compared; and</text>
				</paragraph><paragraph id="H0447A4804F0D4E349510CA1D9249F8A1"><enum>(6)</enum><text>utilizes accurate safety data, including—</text>
					<subparagraph id="HC666A43A83C041B38C25528F2F919622"><enum>(A)</enum><text>by appropriately addressing variations between State- and self-reported data;</text>
					</subparagraph><subparagraph id="H724C2970DDF7482CA2E3E8D4FBD06B47"><enum>(B)</enum><text>by accounting for geographic disparities with respect to enforcement; and</text>
					</subparagraph><subparagraph id="H6C76A41744DF432C836E32E28FEBDCD2"><enum>(C)</enum><text>by utilizing only crash data from crashes with respect to which a motor carrier was at fault.</text>
					</subparagraph></paragraph></subsection><subsection id="HE7C7DA8014C146CCB9F2A43FDF96A0A8"><enum>(c)</enum><header>Implementation of recommendations</header><text display-inline="yes-display-inline">Not later than 90 days after the date on which the Secretary submits to Congress the report
			 required under subsection (b), the Secretary shall begin implementing the
			 recommendations included in that report.</text>
			</subsection><subsection id="HBF61616643764A33BB68E6A3515CEB24"><enum>(d)</enum><header>Certification of implementation</header><text display-inline="yes-display-inline">Not later than 1 year after the date on which the Secretary begins implementing recommendations
			 under subsection (c), the Secretary shall complete the implementation of
			 such recommendations and shall submit to Congress a report that—</text>
				<paragraph id="H40ABF2F7569D424C807BF2221642371C"><enum>(1)</enum><text>describes the implementation of such recommendations;</text>
				</paragraph><paragraph id="H147784FCD1104FCCB4B8DD078F1BADEA"><enum>(2)</enum><text>contains a document in which the Secretary certifies that such implementation is complete; and</text>
				</paragraph><paragraph id="H9FDEACF914F74A898792BE7DA4491216"><enum>(3)</enum><text>contains a document in which the Inspector General of the Department of Transportation certifies
			 that such implementation is complete.</text>
				</paragraph></subsection><subsection id="H7A05768855EE4EA09550C82DF43AC0DF"><enum>(e)</enum><header>Definitions</header><text>In this section, the following definitions apply:</text>
				<paragraph id="H74F5706EE0674BA891CF527B5B725026"><enum>(1)</enum><header>Covered motor carrier data</header><text>The term <term>covered motor carrier data</term> means data generated with respect to a motor carrier under the Compliance, Safety, Accountability
			 initiative of the Federal Motor Carrier Safety Administration, including
			 any ranking, rating, score, or other measurement.</text>
				</paragraph><paragraph id="H3AA19EF2E975436081DDC3812FAA501A"><enum>(2)</enum><header>Motor carrier</header><text>The term <term>motor carrier</term> has the meaning given that term in <external-xref legal-doc="usc" parsable-cite="usc/49/13102">section 13102</external-xref> of title 49, United States Code.</text>
