		<official-title>To require the holder of a subordinate lien on the property that secures a federally related
			 mortgage loan, upon a request by the homeowner for a short sale, to make a
			 timely decision whether to allow the sale.</official-title>

		<section id="HCEBA157A8E76422F8DF4E36771912913" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fast Help For Homeowners Act</short-title></quote>.</text>
		</section><section id="H80E52899ADF5454E9FCEC9FDD777E7B2"><enum>2.</enum><header>Requirement for prompt decision</header>
			<subsection id="H480D8BE31B4940DC8E930634227F6E32"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Chapter 2 of the Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1631">15 U.S.C. 1631 et seq.</external-xref>) is amended by inserting before
			 section 130 (<external-xref legal-doc="usc" parsable-cite="usc/15/1640">15 U.S.C. 1640</external-xref>) the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H7E82E272B542425B8E427C81A8FB30DD" style="OLC">
					<section id="HD66BC8B63A3A45A09BFECFE0913A991E"><enum>129I.</enum><header>Prompt decisionmaking regarding short sale</header>
						<subsection id="H53C72079709D4BABB944F6F283A8EE37"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than the end of the 10-calendar-day period beginning on the date of receipt of a written
			 request from a mortgagor of a federally related mortgage loan that meets
			 the requirements of subsection (c), a servicer shall—</text>
							<paragraph id="HA76F7E3552C14FBB8195F5758FFCC6C7"><enum>(1)</enum><text>notify in writing each holder of a subordinate lien on the residential real property that secures
			 such loan of such request; and</text>
							</paragraph><paragraph id="HB1F09A7C4EEC4DBD97DE8C087EA3FB78"><enum>(2)</enum><text>submit to each such holder a copy of such request.</text>
							</paragraph></subsection><subsection id="HFF4859AB69654754A0D849B3580A99E4"><enum>(b)</enum><header>Timely response to servicer notification required</header>
							<paragraph id="HA8B5560B42434B5D90DB7B262572CC3B"><enum>(1)</enum><header>In general</header>
								<subparagraph id="HAE1699058EA54E3DB4ED1AB6B98D6D37"><enum>(A)</enum><header>Timely response required</header><text>Except as provided in subsection (d) and notwithstanding any other provision of law or of any
			 contract, including a contract between a servicer of a federally related
			 mortgage loan and a securitization vehicle or other investment vehicle, a
			 holder of a subordinate lien that is notified by a servicer under
			 subsection (a) shall respond in writing to such servicer not later than
			 the end of the 45-calendar-day period beginning on the date of receipt of
			 such notification.</text>
								</subparagraph><subparagraph id="HB31567B14DE24F619BF21076412F1169"><enum>(B)</enum><header>Failure to respond</header><text display-inline="yes-display-inline">If the holder of a subordinate lien that is notified by a servicer under subsection (a) does not
			 respond within the 45-calendar-day period described in subparagraph (A),
			 the request from a mortgagor described in subsection (a) shall be
			 considered to have been approved by the such holder.</text>
								</subparagraph></paragraph><paragraph id="HA0DC44BD78DD40118C7E84014620A631"><enum>(2)</enum><header>Content</header><text display-inline="yes-display-inline">A written response by such holder under subsection (a) shall specify a decision on whether the
			 request described in such subsection has been denied, approved, or that
			 such request has been approved subject to specified changes.</text>
							</paragraph></subsection><subsection id="HE9664DCFB30B41B6B97203E9541E8CE8"><enum>(c)</enum><header>Mortgagor submission</header><text display-inline="yes-display-inline">Subsection (a) shall apply in any case in which the mortgagor of a federally related mortgage loan
			 submits to the servicer thereof—</text>
							<paragraph id="H410C05DB26BD4DD3AED1513F06B1DD79"><enum>(1)</enum><text display-inline="yes-display-inline">a written offer for a short sale of the dwelling or residential real property that is subject to a
			 mortgage, deed of trust, or other security interest that secures the
			 mortgage loan; and</text>
							</paragraph><paragraph id="H77E485EFFC0049898333854A29B6C921"><enum>(2)</enum><text display-inline="yes-display-inline">all information required by the servicer in connection with such a request (including a copy of an
			 executed contract between the owner of the dwelling or property and the
			 prospective buyer that is subject to approval by the servicer).</text>
							</paragraph></subsection><subsection id="H0452E0E1733A4B638F41DE5012A57516"><enum>(d)</enum><header>Inapplicability to certain existing mortgages</header><text display-inline="yes-display-inline">This section shall not apply to any federally related mortgage loan with respect to which the
			 mortgagor and the mortgagee or servicer have entered into a written
			 agreement before the date of the enactment of the <short-title>Fast Help For Homeowners Act</short-title> explicitly providing a procedure or terms for approval of a short sale.</text>
						</subsection><subsection id="H3D34FAF3C4F84965910A3CB4A830FAD1"><enum>(e)</enum><header>Treatment of other time limits</header><text>This section may not be construed to preempt, annul, or otherwise affect any other provision of law
			 or of any contract or program that provides a shorter period than is
			 provided under subsection (b) for a decision to be made by a holder of a
			 subordinate lien described in subsection (a)(1) regarding a short sale.</text>
						</subsection><subsection id="H1BB012ADF70E4ECB99EED2F2388B976F"><enum>(f)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this section, the following definitions shall apply:</text>
							<paragraph id="HAE0802C7BC524E37A82CE2A396054F11"><enum>(1)</enum><header>Federally related mortgage loan</header><text display-inline="yes-display-inline">The term <term>federally related mortgage loan</term> has the same meaning as is given in section 3 of the Real Estate Settlement Procedures Act of 1974
			 (<external-xref legal-doc="usc" parsable-cite="usc/12/2602">12 U.S.C. 2602</external-xref>).</text>
							</paragraph><paragraph id="HCB533F13CC154DC29F3528054328522A"><enum>(2)</enum><header>Securitization vehicle</header><text>The term <term>securitization vehicle</term> means a trust, special purpose entity, or other legal structure that is used to facilitate the
			 issuing of securities, participation certificates, or similar instruments
			 backed by or referring to a pool of assets that includes federally related
			 mortgage loans (or instruments that are related to federally related
			 mortgage loans, such as credit-linked notes).</text>
							</paragraph><paragraph id="H881CAC845BBB461BB3B1DEFB84EFB291"><enum>(3)</enum><header>Servicer</header><text>The term <term>servicer</term> has the same meaning as in section 129A, except that such term includes a person who makes or
			 holds a federally related mortgage loan (including a pool of federally
			 related mortgage loans), if such person also services the loan.</text>
							</paragraph><paragraph id="H6184FC491DA04B4B8C684D612D34A4A9"><enum>(4)</enum><header>Short sale</header><text>The term <term>short sale</term> means the sale of the dwelling or residential real property that is subject to the mortgage, deed
			 or trust, or other security interest that secures a federally related
			 mortgage loan that—</text>
								<subparagraph id="H859FCD0E8B64441F8A929CFE76B718CF"><enum>(A)</enum><text>will result in proceeds in an amount that is less than the remaining amount due under the mortgage
			 loan; and</text>
								</subparagraph><subparagraph id="HDD7705A471324436AA2C791AEAF56EAA"><enum>(B)</enum><text>requires authorization by the securitization vehicle or other investment vehicle or holder of the
			 mortgage loan, or the servicer acting on behalf of such a vehicle or
			 holder.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HA5A54853F9024456BE73E4722D51D220"><enum>(b)</enum><header>Applicability</header><text>The amendment made by subsection (a) shall apply to any written request for a short sale made after
			 the date of the enactment of this Act.</text>
