		<section id="HA55D6C7B83A6454686CE2C19AE93FE10" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Propane Supply and Security Act of 2014</short-title></quote>.</text>
		</section><section id="H143C84B005814650978A817D2C1BEBE2"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="HDAF6E97996FC4F78B2B24D6D5D033166"><enum>(1)</enum><header>Administrator</header><text>The term <quote>Administrator</quote> means the Administrator of the Energy Information Administration.</text>
			</paragraph><paragraph id="H58997413747D4241B9185158FBABE40D"><enum>(2)</enum><header>Commission</header><text>The term <quote>Commission</quote> means the Federal Energy Regulatory Commission.</text>
			</paragraph><paragraph id="H8B9A8D1DF666442C88DF2D10AEE60800"><enum>(3)</enum><header>Propane pipeline</header><text>The term <quote>propane pipeline</quote> means a pipeline regulated under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/601">chapter 601</external-xref> of title 49, United States Code, that is used to
			 transport propane.</text>
			</paragraph><paragraph id="H179F040695EB437ABA88479A8A2AC0A4"><enum>(4)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Energy.</text>
			</paragraph></section><section id="HC184430A01264C429BA6E2210957AC9E"><enum>3.</enum><header>Information collection</header>
			<subsection id="H0A7B17D098AA42EDB500D8F08D1C344D"><enum>(a)</enum><header>In general</header><text>The Administrator, in coordination with other Federal and State officials, as appropriate, shall
			 publish to the maximum extent practicable and consistent with
			 confidentiality requirements, data on—</text>
				<paragraph id="H0BAF2E88B3E245238BDC7DE17465AB2A"><enum>(1)</enum><text>propane storage, including—</text>
					<subparagraph id="HD699D8D2D53241989C8495BE7FB0A0B9"><enum>(A)</enum><text>weekly inventory disaggregated below the level of the Petroleum Administration for Defense
			 Districts (PADD) including—</text>
						<clause id="H11DCE3BA806C4ECD9F2EB9C6F79F6319"><enum>(i)</enum><text>data at the State and local level; and</text>
						</clause><clause id="H71D93163BEDE438A9D9A603019E31E99"><enum>(ii)</enum><text display-inline="yes-display-inline">aggregate data at market hubs around Conway, Kansas, Mont Bellvieu, Texas, and any other market
			 hubs of significant regional scope; and</text>
						</clause></subparagraph><subparagraph id="HAE7C121A4AE2452795485EA4CBAC19B2"><enum>(B)</enum><text>weekly data to separately account for non-fuel propylene and propane for PADD 3 and other regions
			 if
			 the Administrator determines that inclusion of the nonfuel propylene
			 supply data significantly distorts propane supply and pricing data, and
			 the Administrator determines it is feasible to collect separate data and
			 nonfuel propylene and propane; and</text>
					</subparagraph></paragraph><paragraph id="HB3E722CD080E40D1B15F2CAA042402C1"><enum>(2)</enum><text>propane markets, including pricing data, for residential customers in States that voluntarily
			 choose to participate in the State Heating Oil and Propane Program (SHOPP)
			 of the Energy Information Administration.</text>
				</paragraph></subsection><subsection id="HE626BEF4B7264F61B787832F6F990E24"><enum>(b)</enum><header>Biannual working and net available storage capacity report</header><text>The Administrator shall publish data on storage at—</text>
				<paragraph id="H921384EA689047CB96A490E548B9E6CF"><enum>(1)</enum><text>major market centers, including the regions around Conway, Kansas and Mont Bellvieu, Texas; and</text>
				</paragraph><paragraph id="H4940E63288054A629CAE604D5C16951E"><enum>(2)</enum><text>to the extent practicable based on existing surveys and consistent with confidentiality
			 requirements, the regions reported in the weekly and monthly inventory
			 data under subsection (a).</text>
				</paragraph></subsection></section><section id="HD1B6124ECA7D48599EC5681135E02997"><enum>4.</enum><header>Coordinated response to emergencies</header>
			<subsection id="HEB6E8779EFE14286913D41099BD1449D"><enum>(a)</enum><header>In general</header><text>The Secretary shall lead and coordinate Federal and State emergency response efforts with respect
			 to propane supply emergencies in any State or region of the United States
			 that are characterized, as determined by the Secretary, by—</text>
				<paragraph id="H33F4EFC4997547EBAE4B115CD5712FAB"><enum>(1)</enum><text>sudden increases in consumer prices for propane; or</text>
				</paragraph><paragraph id="HEE7559640E9A42EB9934758BC7CA4867"><enum>(2)</enum><text>propane supply shortages that threaten public safety or livestock safety.</text>
				</paragraph></subsection><subsection id="H18798848C9524A99BE9E02EEDBB77997"><enum>(b)</enum><header>Duties</header><text>In carrying out subsection (a), the Secretary shall—</text>
				<paragraph id="HF2CA6058536D4B178B67356C3E1CC6AB"><enum>(1)</enum><text>establish criteria to determine when an emergency response action would be triggered;</text>
				</paragraph><paragraph id="H3AA36DC85A8D454AA68FF189E0535FD4"><enum>(2)</enum><text>establish a system for forecasting and tracking the availability of propane, with an emphasis on
			 predicting supply shortages;</text>
				</paragraph><paragraph id="HAE6DDE207FD34116B64F4DC195AD5BD8"><enum>(3)</enum><text>establish a system for alerting other Federal agencies, States, industry groups, and appropriate
			 stakeholders of the crisis—</text>
					<subparagraph id="HDA525C1683754439A934734F97417462"><enum>(A)</enum><text>before an emergency; and</text>
					</subparagraph><subparagraph id="HEA965222EE344DF99F8DC5C2AEBB8193"><enum>(B)</enum><text>when the Secretary determines that an emergency has occurred;</text>
					</subparagraph></paragraph><paragraph id="H02C56298A7C443338FEDE8A9A3FAED61"><enum>(4)</enum><text>establish a plan for coordinated response to an emergency by Federal and State agencies using their
			 existing authorities; and</text>
				</paragraph><paragraph id="HF15904CCE6764A2BA7CF8DD1C255B304"><enum>(5)</enum><text>establish criteria to determine when the emergency has ended.</text>
				</paragraph></subsection><subsection id="H1A5D55D9555A427F91FA3128ECC9B42E"><enum>(c)</enum><header>Actions</header><text display-inline="yes-display-inline">An emergency response carried out under this section may include actions by Federal and State
			 agencies using their existing authorities—</text>
				<paragraph id="H6A49245BC3E64E12824C09246E28CAB5"><enum>(1)</enum><text>to protect consumers from unfair pricing;</text>
				</paragraph><paragraph id="H44CF2ABB4EFD4018B34F3FA68AA63319"><enum>(2)</enum><text>to expedite the distribution of propane through available transportation modes, including
			 provisions—</text>
					<subparagraph id="H5902489F20E047C7B1F4A17486942D33"><enum>(A)</enum><text>to exempt motor carriers of propane from hours-of-service restrictions;</text>
					</subparagraph><subparagraph id="H0388F6A615DE4DBEBD3DAF456DC87B35"><enum>(B)</enum><text>to prioritize propane shipments by rail;</text>
					</subparagraph><subparagraph id="HBCFD05BC2740460499DC57B204822B7D"><enum>(C)</enum><text display-inline="yes-display-inline">to exempt vessels carrying propane from United States-flag ship requirements under the Jones Act;
			 and</text>
					</subparagraph><subparagraph id="H262903FF0F8341B0B0BDFEEFF62CF890"><enum>(D)</enum><text>for actions by the Commission to prioritize propane shipments over other shipments in batched
			 pipelines; and</text>
					</subparagraph></paragraph><paragraph id="HAB37E72A6AE848359A27ABE351E61046"><enum>(3)</enum><text>expedited release of energy assistance funds.</text>
				</paragraph></subsection><subsection id="HDFFD0A3881BB42758871ECE8651D018E"><enum>(d)</enum><header>Effect</header><text>Nothing in this section limits any existing agency authority of a Federal agency.</text>
			</subsection></section><section id="H70E81D7799A94756AF318F32B5CF1B29"><enum>5.</enum><header>Definition of consumer propane prices</header>
			<subsection id="H03204C059FF3453282935E9BC9C93425"><enum>(a)</enum><header>Functions of propane education and research council</header><text>Section 5(f) of the Propane Education and Research Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/15/6404">15 U.S.C. 6404(f)</external-xref>) is amended in
			 the first sentence by inserting <quote>to train propane distributors and consumers in strategies to mitigate negative effects of future
			 propane price spikes,</quote> after <quote>to enhance consumer and employee safety and training,</quote>.</text>
			</subsection><subsection id="HABBC0D771D78448494FE80CD8A1801C9"><enum>(b)</enum><header>Market survey and consumer protection price analysis</header><text>Section 9(a) of the Propane Education and Research Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/15/6408">15 U.S.C. 6408(a)</external-xref>) is amended in
			 the first sentence by striking <quote>only data provided by the Energy Information Administration</quote> and inserting <quote>the refiner price to end users of consumer grade propane, as published by the Energy Information
			 Administration</quote>.</text>
			</subsection></section><section id="H709C32B6A13445EA98ED88C501FCCFAB"><enum>6.</enum><header>Regional propane reserve study</header>
			<subsection id="H5AFB6632349B403A864A303CF6701D18"><enum>(a)</enum><header>Study</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall conduct a
			 study to determine the effectiveness and feasibility of establishing 1 or
			 more propane storage facilities, to be operated separately from the
			 Strategic Petroleum Reserve established under part B of title I of the
			 Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6231">42 U.S.C. 6231 et seq.</external-xref>).</text>
			</subsection><subsection id="H2DAE28CB362F44D294E8C0107EEC39FE"><enum>(b)</enum><header>Plan</header><text>Following completion of the study under subsection (a), the Secretary may submit to Congress and
			 the President a plan describing—</text>
				<paragraph id="HB14F5FF5D10947D99D1DB0266DA311B2"><enum>(1)</enum><text>the proposed acquisition of storage and related facilities or storage services, including—</text>
					<subparagraph id="H57912DCC994F4CF4807263EC67175C3F"><enum>(A)</enum><text>the potential use of storage facilities not currently in use; and</text>
					</subparagraph><subparagraph id="HFB91A833815E43E88229EBBA89ADCA3B"><enum>(B)</enum><text>a determination of the combination of primary, secondary, and tertiary storage facilities that will
			 be used;</text>
					</subparagraph></paragraph><paragraph id="HB66B4184C7224E15868CBD31A1F4C307"><enum>(2)</enum><text>the proposed acquisition of propane for storage;</text>
				</paragraph><paragraph id="H2B3A7025639F4680A2E0375D0B28AEC8"><enum>(3)</enum><text>the proposed methods of disposition of propane;</text>
				</paragraph><paragraph id="HA61D630257BE44D09FC60B81C7C6B9CF"><enum>(4)</enum><text>the estimated costs of establishment, maintenance, and operation;</text>
				</paragraph><paragraph id="H39DD6700F324436BB24CF0CC519B4FF1"><enum>(5)</enum><text>the efforts the Secretary will make—</text>
					<subparagraph id="HB61FDB2CF79C43BB9F52057796B695FA"><enum>(A)</enum><text>to minimize any potential need for future drawdowns; and</text>
					</subparagraph><subparagraph id="HB02A7C0525C5493AAF90C0B708B6894A"><enum>(B)</enum><text>to ensure the distributors and importers are not discouraged from maintaining and increasing
			 supplies of propane;</text>
					</subparagraph></paragraph><paragraph id="H0141AE2010A645ACA3BD4E789D6421B8"><enum>(6)</enum><text>the proposed actions to ensure the quality of the propane; and</text>
				</paragraph><paragraph id="H9E51D412048142EE86E10DC04633D989"><enum>(7)</enum><text>the proposed accounts and funding structures required for acquisition of propane and propane
			 storage facilities.</text>
				</paragraph></subsection></section><section id="H31C72ED73AA8435088814EFAD0E9A02D"><enum>7.</enum><header>Storage facility loans for propane storage</header><text display-inline="no-display-inline">Section 1614(a) of the Food, Conservation, and Energy Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/8789">7 U.S.C. 8789(a)</external-xref>) is amended by
			 inserting <quote>, including facilities for propane that is used for drying and heating</quote> before the period at the end.</text>
		</section><section id="H58CC6AEB1B9F4F4CB5C0207778390882"><enum>8.</enum><header>Study of jurisdiction</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, the Comptroller General of the
			 United States shall complete a study of facilities appurtenant to propane
			 pipelines (such as terminals and storage facilities) that are not subject
			 to the jurisdiction of the Commission (as of the date on which the study
			 commences) to determine—</text>
			<paragraph id="H4C7DB4DE0185414C983C1A2E67D98147"><enum>(1)</enum><text>whether and to what degree the nonjurisdictional nature of the facilities had an impact on the
			 propane price spike during the winter of 2013 to 2014; or</text>
			</paragraph><paragraph id="HE401A8B8805342DF98C9AF4EED78E8C7"><enum>(2)</enum><text>whether findings described in paragraph (1) demonstrate whether it would be in the public interest
			 to enact a change in law to place such facilities under the jurisdiction
			 of the Commission.</text>
