		<section id="H3C25E834C80644618FEA04EF7DFE9373" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Metropolitan Planning Enhancement Act</short-title></quote>.</text>
		</section><section id="H299869C6E5754131A38922A2B0D39E4C"><enum>2.</enum><header>Consolidated and high performing metropolitan planning organizations</header>
			<subsection id="H078CE589C1DC4C69A9787F6B11AEC35D"><enum>(a)</enum><header>Consolidation of metropolitan planning organizations</header>
				<paragraph id="H1F98D56B606C46479ADC2A234DD57F06"><enum>(1)</enum><header>Section 134 amendment</header><text><external-xref legal-doc="usc" parsable-cite="usc/23/134">Section 134(d)(6)</external-xref> of title 23, United States Code, is amended to read as follows:</text>
					<quoted-block id="H6AF956A4625C464E956039D87A0EE73E" style="OLC">
						<paragraph id="H45DFE1762A4D4827B0FF7D09D3DF89FE"><enum>(6)</enum><header>Consolidation of metropolitan planning organizations within urbanized areas</header>
							<subparagraph id="H830AF04EC9E64EEFA7ECF34B04EDA29B"><enum>(A)</enum><header>Limitation on new metropolitan planning organization designations</header><text>A metropolitan planning organization shall not be newly designated—</text>
								<clause id="HE2215EDAF02A43A584FFD40D043D8140"><enum>(i)</enum><text>within a metropolitan statistical area if another metropolitan planning organization already exists
			 within the boundaries of the metropolitan statistical area; or</text>
								</clause><clause id="H7CAB192A4B7D4CC28DC2730AEE6F56B1"><enum>(ii)</enum><text>outside of a metropolitan statistical area.</text>
								</clause></subparagraph><subparagraph id="H6783EEB5FE0341A2A55C5F8AD43FBA03"><enum>(B)</enum><header>Multiple existing metropolitan planning organizations</header><text>If multiple existing metropolitan planning organizations are designated within a metropolitan
			 statistical area—</text>
								<clause id="H9063CEFD24DF4EC18B59DE58BD6A2DC6"><enum>(i)</enum><text>the metropolitan planning organizations may—</text>
									<subclause id="H46856F37EFC14C528A219C54CFD477A0"><enum>(I)</enum><text>retain their designation as distinct metropolitan planning organizations; or</text>
									</subclause><subclause id="H2A85ED5065B14917B7028ABB320A099D"><enum>(II)</enum><text>be consolidated by agreement between the metropolitan planning organizations;</text>
									</subclause></clause><clause id="H68091F161B864AAEBB28E4602A0A62E4"><enum>(ii)</enum><text>the Governor (or Governors) and the existing metropolitan planning organizations shall—</text>
									<subclause id="H53B5F1CCF20D48E2B3AC10B98F6EFFF5"><enum>(I)</enum><text>revisit a determination to remain unconsolidated every 10 years, beginning two years after the next
			 decennial census; and</text>
									</subclause><subclause id="H7BFF72B8E3C44107979172904E3BE0CA"><enum>(II)</enum><text>provide justification to the Secretary of the continued necessity of the designation of multiple
			 metropolitan planning organizations in the area; and</text>
									</subclause></clause><clause id="H276B44F6DA754E37A466D57A8E802C6A"><enum>(iii)</enum><text>where multiple metropolitan planning organizations exist within a single metropolitan statistical
			 area, they shall cooperate with one another to—</text>
									<subclause id="HF82F883F19FF459983EB49F5AB1868C8"><enum>(I)</enum><text>develop a single transportation improvement plan and a single long-range plan for use by all
			 metropolitan planning organizations within the metropolitan statistical
			 area when developing their individual plans; and</text>
									</subclause><subclause id="HF589C7D39F9B4111B9E9BB87CFA56C80"><enum>(II)</enum><text>establish a single set of performance targets that address the performance measures described in
			 section 150(c) for use in developing individual performance targets in
			 accordance with section 134(h)(2).</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H7C1A4D46967F406B9CA3788E3FCEB05F"><enum>(2)</enum><header>Section 5303 amendment</header><text><external-xref legal-doc="usc" parsable-cite="usc/49/5303">Section 5303(d)(6)</external-xref> of title 49, United States Code, is amended to read as follows:</text>
					<quoted-block id="H4DBAFAD4B51E4978A08676DEDB47F6E2" style="OLC">
						<paragraph id="H9DFEA131DDD64FB3A866FA86E3E16B4B"><enum>(6)</enum><header>Consolidation of metropolitan planning organizations within urbanized areas</header>
							<subparagraph id="H13CEFC187ECF4020B2D1DBC4C3CB9188"><enum>(A)</enum><header>Limitation on new metropolitan planning organization designations</header><text>A metropolitan planning organization shall not be newly designated—</text>
								<clause id="H7B66DEBABEF74893A37C519487AC2383"><enum>(i)</enum><text>within a metropolitan statistical area if another metropolitan planning organization already exists
			 within the boundaries of the metropolitan statistical area; or</text>
								</clause><clause id="HB64E287BF2A14FEFAC3AA0C0C7790C6E"><enum>(ii)</enum><text>outside of a metropolitan statistical area.</text>
								</clause></subparagraph><subparagraph id="H0CA83F056E73483C94F761760F0D7FA7"><enum>(B)</enum><header>Multiple existing metropolitan planning organizations</header><text>If multiple existing metropolitan planning organizations are designated within a metropolitan
			 statistical area—</text>
								<clause id="H2E46847A05324D1BB1DC9D9B4EFB07DE"><enum>(i)</enum><text>the metropolitan planning organizations may—</text>
									<subclause id="H85D67709A09C4325A03C42333FC86F4B"><enum>(I)</enum><text>retain their designation as distinct metropolitan planning organizations; or</text>
									</subclause><subclause id="H5576F46C03C24FBF8102FB7BB1A857EF"><enum>(II)</enum><text>be consolidated by agreement between the metropolitan planning organizations;</text>
									</subclause></clause><clause id="H406F9F297B914E77B63008A969CA1B1A"><enum>(ii)</enum><text>the Governor (or Governors) and the existing metropolitan planning organizations shall—</text>
									<subclause id="H9EABD1BBC82A4479A1491DE17B7B7481"><enum>(I)</enum><text>revisit a determination to remain unconsolidated every 10 years, beginning two years after the next
			 decennial census; and</text>
									</subclause><subclause id="H84BA45551A5042138943A4CD4FF9D7B7"><enum>(II)</enum><text>provide justification to the Secretary of the continued necessity of the designation of multiple
			 metropolitan planning organizations in the area; and</text>
									</subclause></clause><clause id="H0E1312EF786E4AA1BB6050D383455CD5"><enum>(iii)</enum><text>where multiple metropolitan planning organizations exist within a single metropolitan statistical
			 area, they shall cooperate with one another to—</text>
									<subclause id="H5245142BEFA642CEB634069F47E4FEBE"><enum>(I)</enum><text>develop a single transportation improvement plan and a single long-range plan for use by all
			 metropolitan planning organizations within the metropolitan statistical
			 area when developing their individual plans; and</text>
									</subclause><subclause id="HEF2BB5A5C00440D491B07B52EAD4A7ED"><enum>(II)</enum><text>establish a single set of performance targets that address the performance measures described in
			 <external-xref legal-doc="usc" parsable-cite="usc/23/150">section 150(c)</external-xref> of title 23, United States Code, for use in developing
			 individual performance targets in accordance with subsection (h)(2) and
			 <external-xref legal-doc="usc" parsable-cite="usc/49/5326">sections 5326(c)</external-xref> and <external-xref legal-doc="usc" parsable-cite="usc/49/5329">5329(d)</external-xref> of this title.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HB252F3C00FE44248ACE72A2680082623"><enum>(3)</enum><header>Definitions</header>
					<subparagraph id="HF17CC8EBFB8D4B96B7B21030727DB1A5"><enum>(A)</enum><header>Highway definition</header><text><external-xref legal-doc="usc" parsable-cite="usc/23/134">Section 134(b)</external-xref> of title 23, United States Code, is amended by—</text>
						<clause id="HD6884DC8CE05441DADAE03C174A51DA8"><enum>(i)</enum><text>redesignating paragraphs (1) through (7) as paragraphs (2) through (8); and</text>
						</clause><clause id="HBA2A8FED039042B0AA9850A5C57DFBA3"><enum>(ii)</enum><text>inserting before paragraph (2), as redesignated, the following:</text>

								<paragraph id="H00C7A0EEF6C74056BCE13B40BAFB8042"><enum>(1)</enum><header>Consolidated metropolitan planning organization</header><text>The term <quote>consolidated metropolitan planning organization</quote> means a sole metropolitan planning organization that serves a metropolitan statistical area.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</clause></subparagraph><subparagraph id="HA35138224C7E456D82B6C1515874D1AD"><enum>(B)</enum><header>Transit definition</header><text><external-xref legal-doc="usc" parsable-cite="usc/49/5303">Section 5303(b)</external-xref> of title 49, United States Code, is amended by—</text>
						<clause id="HEACD6028918548D18DD532997DC4135D"><enum>(i)</enum><text>redesignating paragraphs (1) through (7) as paragraphs (2) through (8); and</text>
						</clause><clause id="H0DE402A77B0C4BC5992FF7392389B5AE"><enum>(ii)</enum><text>inserting before paragraph (2), as redesignated, the following:</text>

								<paragraph id="HBF454F95C28549CEBE85370C2369D700"><enum>(1)</enum><header>Consolidated metropolitan planning organization</header><text>The term <quote>consolidated metropolitan planning organization</quote> means a sole metropolitan planning organization that serves a metropolitan statistical area.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</clause></subparagraph></paragraph></subsection><subsection id="H5520866D1BF64A5B9FD938DFF4D681F3"><enum>(b)</enum><header>Designation of high-Performing metropolitan planning organizations</header>
				<paragraph id="HA878C50E73D8474296F81FFADA206B11"><enum>(1)</enum><header>Section 134 amendment</header><text><external-xref legal-doc="usc" parsable-cite="usc/23/134">Section 134</external-xref> of title 23, United States Code, as amended by this Act, is further amended by adding
			 at the end the following:</text>
					<quoted-block id="H736054F3BB6E4D5694540AC7358E8AD3" style="OLC">
						<subsection id="H08CD2BF2BD324F36939763D0FFDBCFC4"><enum>(r)</enum><header>High-Performing metropolitan planning organizations</header>
							<paragraph id="H8EDE1DD66F4D4DBE9CDF016E915CEFD2"><enum>(1)</enum><header>In general</header><text>A metropolitan planning organization that represents an urbanized area with a population of over
			 200,000 individuals may request a high-performing metropolitan planning
			 organization designation from the Secretary.</text>
							</paragraph><paragraph id="H9D59A2E3636E430889844B4D03610862"><enum>(2)</enum><header>Criteria</header><text>In making a high-performing metropolitan planning organization designation, the Secretary shall
			 consider—</text>
								<subparagraph id="HCFB52B240BBE4B45971DE2DBDF20EC8D"><enum>(A)</enum><text>the extent to which the metropolitan planning organization has an equitable and regional approach
			 to decisionmaking;</text>
								</subparagraph><subparagraph id="HFDC24665567A403B8A92DB1D1BB8CCB8"><enum>(B)</enum><text>the extent to which the metropolitan planning organization has incorporated its performance targets
			 established pursuant to section 150 of this title and sections 5303(h)(2),
			 5326(c), and 5329(d) of title 49 into its planning process;</text>
								</subparagraph><subparagraph id="H0BA9BE9B03324F72A7ADE3B92D1115FA"><enum>(C)</enum><text>whether the metropolitan planning organization is a consolidated metropolitan planning
			 organization;</text>
								</subparagraph><subparagraph id="H1E4DB486647D4B369D195BA31D44B2C2"><enum>(D)</enum><text>if the metropolitan planning organization is not a consolidated metropolitan planning organization,
			 the extent to which the metropolitan planning organization is coordinating
			 with all other metropolitan planning organizations designated for the same
			 metropolitan statistical area;</text>
								</subparagraph><subparagraph id="H66908493DA744580811D1C22FD702264"><enum>(E)</enum><text>the technical capacity of the metropolitan planning organization; and</text>
								</subparagraph><subparagraph id="H7B02A93F407A4E76B4A8EBF53AA9DF27"><enum>(F)</enum><text>other criteria established by the Secretary in guidance.</text>
								</subparagraph></paragraph><paragraph id="HA93E70E40332428C838C7499175CD195"><enum>(3)</enum><header>Review</header><text>A designation under paragraph (1) shall stay in effect for 10 years from the date of designation.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H309B7D92677545F89E5CD798690C6DF2"><enum>(2)</enum><header>Section 5303 amendment</header><text><external-xref legal-doc="usc" parsable-cite="usc/49/5303">Section 5303</external-xref> of title 49, United States Code, as amended by this Act, is further amended by adding
			 at the end the following:</text>
					<quoted-block id="HD24680D3B12C4019A196F63610768C52" style="OLC">
						<subsection id="H03105D1349C74B24848F0661F6C41D3D"><enum>(r)</enum><header>High-Performing metropolitan planning organizations</header>
							<paragraph id="H608D4EE8CED94CB1946282F7D1B094DB"><enum>(1)</enum><header>In general</header><text>A metropolitan planning organization that represents an urbanized area with a population of over
			 200,000 individuals may request a high-performing metropolitan planning
			 organization designation from the Secretary.</text>
							</paragraph><paragraph id="H8BFE152EE2A74C9D95990784DF5B2B38"><enum>(2)</enum><header>Criteria</header><text>In making a high-performing metropolitan planning organization designation, the Secretary shall
			 consider—</text>
								<subparagraph id="H008BA9AE791E46CEA676EB273410F616"><enum>(A)</enum><text>the extent to which the metropolitan planning organization has an equitable and regional approach
			 to decisionmaking;</text>
								</subparagraph><subparagraph id="H1F969A0A47164DC18002DF09B58E425F"><enum>(B)</enum><text>the extent to which the metropolitan planning organization has incorporated its performance targets
			 established pursuant to <external-xref legal-doc="usc" parsable-cite="usc/23/150">section 150</external-xref> of title 23, United States Code,
			 subsection (h)(2), and sections 5326(c) and 5329(d) of this title into its
			 planning process;</text>
								</subparagraph><subparagraph id="HB8745CCCC9DE45C9853CDA29809925F6"><enum>(C)</enum><text>whether the metropolitan planning organization is a consolidated metropolitan planning
			 organization;</text>
								</subparagraph><subparagraph id="H759DE5E2DF6B4CB69611761B29EAEC5C"><enum>(D)</enum><text>if the metropolitan planning organization is not a consolidated metropolitan planning organization,
			 the extent to which the metropolitan planning organization is coordinating
			 with all other metropolitan planning organizations designated for the same
			 metropolitan statistical area;</text>
								</subparagraph><subparagraph id="H4490AB204D914C0A9AD362C08471DF3D"><enum>(E)</enum><text>the technical capacity of the metropolitan planning organization; and</text>
								</subparagraph><subparagraph id="H2C8A990D8666435CA641D37218037B6E"><enum>(F)</enum><text>other criteria established by the Secretary in guidance.</text>
								</subparagraph></paragraph><paragraph id="H8C96B4793CB74B39BB3708DAE58A9143"><enum>(3)</enum><header>Review</header><text>A designation under paragraph (1) shall stay in effect for 10 years from the date of designation.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HE0A785466A744DC6AAFDAFE06E6CC2E7"><enum>(c)</enum><header>Surface transportation incentive funds</header><text><external-xref legal-doc="usc" parsable-cite="usc/23/133">Section 133(d)(1)</external-xref> of title 23, United States Code is amended to read as follows:</text>
				<quoted-block id="HEF486A464D2F46AC88D9C8138ECEB02F" style="OLC">
					<paragraph id="H0EDB34949140462AB4E644F070B71B9B"><enum>(1)</enum><header>Calculation</header><text>The funds apportioned to a State under section 104(b)(2) shall be obligated as follows:</text>
						<subparagraph id="H4B042E5C45BE42E8AEC8B0E2FCE4C212"><enum>(A)</enum><header>Suballocated funds</header><text>50 percent of the funds for a fiscal year shall be obligated under this section, in proportion to
			 their relative shares of the population of the State—</text>
							<clause id="H009C31A6403C40F8A7616417B71DF5B9"><enum>(i)</enum><text>in urbanized areas of the State with an urbanized area population over 200,000;</text>
							</clause><clause id="H131A8EF9D6C64845887E5C72CF7E6D72"><enum>(ii)</enum><text>in urban areas of the State with a population of 5,000 to 200,000; and</text>
							</clause><clause id="H8D7A3C3382B64775A97FF3CAC568C6DA"><enum>(iii)</enum><text>in areas of the State with a population of fewer than 5,000.</text>
							</clause></subparagraph><subparagraph id="HE57806AF353A407DA6E9DA384A9BD87B"><enum>(B)</enum><header>Statewide funds</header><text>25 percent of the funds for a fiscal year may be obligated in any area of the State.</text>
						</subparagraph><subparagraph id="H27301BDCA68E42B8AE05685CDD2DAD39"><enum>(C)</enum><header>High-performing metropolitan planning organizations</header>
							<clause id="H49142172E92442E7AA9FD75EDA7D49E1"><enum>(i)</enum><header>In general</header><text>25 percent of the funds for a fiscal year shall be obligated under this section in urbanized areas
			 under subparagraph (A)(i) that are served by high-performing metropolitan
			 planning organizations (as designated by the Secretary under section
			 134(r) or <external-xref legal-doc="usc" parsable-cite="usc/49/5303">section 5303(r)</external-xref> of title 49, United States Code). Any funds
			 remaining under this clause shall be obligated in any area of the State
			 under subparagraph (B).</text>
							</clause><clause id="H2B66114927E84249B6A0B8E6E9A43438"><enum>(ii)</enum><header>Amount</header><text>The amount to be obligated under clause (i) in an urbanized area served by a high-performing
			 metropolitan planning organization shall equal 50 percent of the amount to
			 be obligated in that urbanized area under paragraph (4) and is in addition
			 to the amount under such paragraph.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H979A33651F13462993A03C46568CA045"><enum>(d)</enum><header>Transportation alternatives incentive funds</header><text>Section 213(c)(1) of such title is amended to read as follows:</text>
				<quoted-block id="HF35FB03F72144613B4E0ECE8A0E44877" style="OLC">
					<paragraph id="HB9C325235A1740BFAC090B195B164697"><enum>(1)</enum><header>Calculation</header><text>The funds reserved to a State shall be obligated as follows:</text>
						<subparagraph id="HC6EEB419219F4A968A118355388E4066"><enum>(A)</enum><header>Suballocated funds</header><text>50 percent of the funds for a fiscal year shall be obligated under this section to any eligible
			 entity in proportion to its relative share of the population of the State—</text>
							<clause id="HE513AD553A7B4D9D8A7D6072A9E14D70"><enum>(i)</enum><text>in urbanized areas of the State with an urbanized area population over 200,000;</text>
							</clause><clause id="H910AA73AF7C84CC587C043E1B30D58E3"><enum>(ii)</enum><text>in urban areas of the State with a population of 5,000 to 200,000; and</text>
							</clause><clause id="H4819DB1CF0A7451E8989ADFF7577A8C6"><enum>(iii)</enum><text>in areas of the State with a population of fewer than 5,000.</text>
							</clause></subparagraph><subparagraph id="HF410F092D4684016950285974AF3A09C"><enum>(B)</enum><header>Statewide funds</header><text>25 percent of the funds for a fiscal year may be obligated in any area of the State.</text>
						</subparagraph><subparagraph id="H24E35B43F879437792193B0D917D8EA3"><enum>(C)</enum><header>High-performing metropolitan planning organizations</header>
							<clause id="HEBDC69B9EEAF4CA5A4F0357649544E5A"><enum>(i)</enum><header>In general</header><text>25 percent of the funds for a fiscal year shall be obligated under this section in urbanized areas
			 under subparagraph (A)(i) that are served by high-performing metropolitan
			 planning organizations (as designated by the Secretary under section
			 134(r) or <external-xref legal-doc="usc" parsable-cite="usc/49/5303">section 5303(r)</external-xref> of title 49, United States Code). Any funds
			 remaining under this clause shall be obligated in any area of the State
			 under subparagraph (B).</text>
							</clause><clause id="H5C9346216EFC4C018DCE408BF57E4B54"><enum>(ii)</enum><header>Amount</header><text>The amount to be obligated under clause (i) in an urbanized area served by a high-performing
			 metropolitan planning organization shall equal 50 percent of the amount to
			 obligated in that urbanized area under paragraph (3) and is in addition to
			 the amount under such paragraph.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H3AFC6AD9313E43CFB2DF28F99F588293"><enum>(e)</enum><header>Obligation authority</header><text>Section 133(f) of such title is amended—</text>
				<paragraph id="HD4FE320E214140678110E145F39C75D5"><enum>(1)</enum><text>in paragraph (1), by—</text>
					<subparagraph id="H0001FADADD8744D09B18508F44D089C9"><enum>(A)</enum><text>striking <quote>A State</quote> and inserting <quote>Except as provided in paragraph (2), a State</quote>; and</text>
					</subparagraph><subparagraph id="H9E67DD2FF01A4DC2B05D73ABAE144362"><enum>(B)</enum><text>striking <quote>fiscal years 2011 through 2014</quote> and inserting <quote>fiscal years after fiscal year 2014</quote>;</text>
					</subparagraph></paragraph><paragraph id="H5F6E7684AD144F6EAB0F884B5C1DA940"><enum>(2)</enum><text>by redesignating paragraph (2) as paragraph (3) and inserting after paragraph (1) the following:</text>

						<paragraph id="HC17B79FB2BF040FA9128BD441963A2DD"><enum>(2)</enum><header>High-performing metropolitan planning organizations</header>
							<subparagraph id="H99B9D7A949D24DB69E4FF6F63BA3F764"><enum>(A)</enum><header>In general</header><text>A State that is required to obligate in an urbanized area under subsections (d)(1)(A)(i) and
			 (d)(1)(C)(i) shall make available to such urbanized area on an annual
			 basis an amount of obligation authority distributed to the State for
			 Federal-aid highways and highway safety construction programs for use in
			 the area that is equal to the amount obtained by multiplying—</text>
								<clause id="H6CD72710105544C2B63531A2C312EFA7"><enum>(i)</enum><text>the amount of funds that the State is required to obligate in the area under such subsections; and</text>
								</clause><clause id="HF336D199734840B08FF091DEDD0C93D7"><enum>(ii)</enum><text>the ratio specified in paragraph (1)(B).</text>
								</clause></subparagraph><subparagraph id="H27B3BD515E0F4B5DA28A78372B611718"><enum>(B)</enum><header>Availability</header><text>The obligation authority that a State makes available to an urbanized area under subparagraph (A)
			 shall remain available for a period of four fiscal years.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H4A3387CD832346D0B078A83ACEF30992"><enum>(3)</enum><text>in paragraph (3), as redesignated, by striking <quote>paragraph (1)</quote> and inserting <quote>paragraphs (1) and (2)</quote>.</text>
				</paragraph></subsection><subsection id="H5BC505BCA2F048BF8E8209983114D78B"><enum>(f)</enum><header>Distribution of metropolitan planning funds</header><text>Section 104(d)(2)(A) of such title is amended—</text>
				<paragraph id="H48CFB8E876DE4F2884BD9F8F3C26847D"><enum>(1)</enum><text>in clause (i), by striking <quote>; and</quote> and inserting <quote>;</quote>;</text>
				</paragraph><paragraph id="HC008C9ED6B1B4CE4B932B3831800CBA1"><enum>(2)</enum><text>by redesignating clause (ii) as clause (iii); and</text>
				</paragraph><paragraph id="HAC850E91797940A4929A4E62E709228C"><enum>(3)</enum><text>by inserting after clause (i) the following:</text>

				</paragraph></subsection><subsection id="HA63D1823804C4D0A9ED469173B602C9F"><enum>(g)</enum><header>Technical correction</header><text>Subsection 133(h)(1) of such title is amended by striking <quote>for each of fiscal years 2013 through 2014</quote> and inserting <quote>each fiscal year</quote>.</text>

			<subsection id="H41B3C8DC16A64DBD85061C0570704894"><enum>(a)</enum><header>Section 135 amendment</header><text><external-xref legal-doc="usc" parsable-cite="usc/23/135">Section 135</external-xref> of title 23, United States Code, is amended—</text>
				<paragraph id="H193BE48911BC453BB01B770435928901"><enum>(1)</enum><text>in subsection (f)(5) by striking <quote>may</quote> and inserting <quote>shall</quote>;</text>

			 metropolitan planning processes.</text>
								</clause></subparagraph><subparagraph id="HED2A9CB5415B46789DD41CC9775F18D8"><enum>(B)</enum><header>Failure to meet certification</header><text>If a State does not meet such certification, the Secretary may withhold up to 20 percent of the
			 funds attributable to such State for projects funded under this title and
			 <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/53">chapter 53</external-xref> of title 49.</text>
							</subparagraph><subparagraph id="H08B4F5FBE6D54C679694D59655CC4AC9"><enum>(C)</enum><header>Restoration of funds</header><text>The withheld funds shall be restored to the State at such time as the State process is certified by
			 the Secretary.</text>
							</subparagraph><subparagraph id="H9FD10D86B6594A80B91A74A4A0F6559C"><enum>(D)</enum><header>Public involvement</header><text>In making the certification determinations under this paragraph, the Secretary shall provide for
			 public involvement appropriate to the State under review.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H403B3BF6C9C74658BD6E5F8692C47BA8"><enum>(b)</enum><header>Section 5304 amendment</header><text><external-xref legal-doc="usc" parsable-cite="usc/49/5304">Section 5304</external-xref> of title 49, United States Code, is amended—</text>
				<paragraph id="H8C8DEC968E35466F9BED374DCF3B8FB0"><enum>(1)</enum><text>in subsection (f)(5) by striking <quote>may</quote> and inserting <quote>shall</quote>;</text>

			 metropolitan transportation plan by the metropolitan planning organization
			 in accordance with subsection (h)(2)(B).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H45373E6FC8764D9A8E78BA37295E2975"><enum>(b)</enum><header>Section 135 amendment</header><text><external-xref legal-doc="usc" parsable-cite="usc/23/135">Section 135(g)(4)</external-xref> of title 23, United States Code, is amended to read as follows:</text>
