				<subsection id="HA6A91AD033294B49A51B1B0A166E9C6D"><enum>(a)</enum><header>Northeast corridor improvement fund</header><text>There are authorized to be appropriated to the Secretary for the use of Amtrak for deposit into the
			 Northeast Corridor Improvement Fund account established under section
			 24319(a)(1) of title 49, United States Code (as added by section 201 of
			 this Act), the following amounts:</text>
					<paragraph id="HD97CE45030834CE4BFE77DADC72CC625"><enum>(1)</enum><text>For fiscal year 2015, $439,000,000.</text>
					</paragraph><paragraph id="HF0BA3331770046AF9CCB933B021364E5"><enum>(2)</enum><text>For fiscal year 2016, $464,000,000.</text>
					</paragraph><paragraph id="H837A7E722482418BA06759CB0FC61C94"><enum>(3)</enum><text>For fiscal year 2017, $480,000,000.</text>

					</paragraph></subsection><subsection id="H21A86F69BD1B4DC68AA4EAE77C64D909"><enum>(b)</enum><header>National network</header><text display-inline="yes-display-inline">There are authorized to be appropriated to the Secretary for the use of Amtrak for deposit into the
			 National Network account established under section 24319(a)(2) of title
			 49, United States Code (as added by section 201 of this Act), the
			 following amounts:</text>

					</paragraph></subsection><subsection id="HB94010AD3BE442B3BC5D2A8AD0498929"><enum>(c)</enum><header>Project management oversight</header><text display-inline="yes-display-inline">The Secretary may withhold up to $2,000,000 of the amount appropriated pursuant to subsection (a),
			 and up to $2,000,000 of the amount appropriated pursuant to subsection
			 (b), for the costs of management oversight of Amtrak.</text>
				</subsection></section><section id="HC91C8E0216594B4C82DF728DE2729BEB"><enum>102.</enum><header>Authorization for Amtrak Office of the Inspector General</header><text display-inline="no-display-inline">There are authorized to be appropriated to the Secretary for the Office of the Inspector General of
			 Amtrak the following amounts:</text>
				<paragraph id="H0500A8817EEA4DE9B2BDA9C745C148CA"><enum>(1)</enum><text>For fiscal year 2015, $23,000,000.</text>
				</paragraph><paragraph id="H6070749378994BDABDCB70C2CC7D78EF"><enum>(2)</enum><text>For fiscal year 2016, $24,000,000.</text>
				</paragraph><paragraph id="H3638B027BC0A46CBBBFC30777AB99A9A"><enum>(3)</enum><text>For fiscal year 2017, $24,000,000.</text>
				</paragraph><paragraph id="H29B0308D5B0940BE9C1050B34334B4FC"><enum>(4)</enum><text>For fiscal year 2018, $25,000,000.</text>
				</paragraph></section><section id="HBE0699238EFA492F95640C3DC5181C57"><enum>103.</enum><header>National infrastructure investments</header>
				<subsection id="HC803D1DCF88A436CA589B7344FED6827"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">There are authorized to be appropriated to the Secretary for capital grants under chapter 244 of
			 title 49, United States Code, the following amounts:</text>
					<paragraph id="H3C434B7558804FA69AA148E1F62A4D4D"><enum>(1)</enum><text>For fiscal year 2015, $300,000,000.</text>
					</paragraph><paragraph id="H161E38B289DF4D8E8E865EA90414038A"><enum>(2)</enum><text>For fiscal year 2016, $300,000,000.</text>
					</paragraph><paragraph id="H283F7EC00D0642118DFA6393BCAA5013"><enum>(3)</enum><text>For fiscal year 2017, $300,000,000.</text>
					</paragraph><paragraph id="H8F2B415A55E742BDA6B8FFE93AACBDDD"><enum>(4)</enum><text>For fiscal year 2018, $300,000,000.</text>
					</paragraph></subsection><subsection id="H30DA3DBBA3BE4D4192890E616EBC7115"><enum>(b)</enum><header>Federal-State partnership for Northeast Corridor development and improvement</header><text display-inline="yes-display-inline">Of the amounts authorized to be appropriated under subsection (a), 50 percent for each fiscal year
			 shall be available for carrying out <external-xref legal-doc="usc" parsable-cite="usc/49/24407">section 24407</external-xref> of title 49, United
			 States Code, as added by section 301 of this Act.</text>
				</subsection><subsection id="H51E25FB1E4ED4FB381FD8102B430A10A"><enum>(c)</enum><header>Project management oversight</header><text display-inline="yes-display-inline">The Secretary may withhold up to ½ of 1 percent of amounts appropriated pursuant to chapter 244 of
			 title 49, United States Code, for the costs of project management
			 oversight of capital projects carried out pursuant to such chapter.</text>
				</subsection></section><section id="H134CD10C47CA406C821D6B1C1339A426"><enum>104.</enum><header>Northeast Corridor</header><text display-inline="no-display-inline">For purposes of this title, the term <quote>Northeast Corridor</quote> means the Northeast Corridor main line between Boston, Massachusetts, and the District of
			 Columbia, and facilities and services used to operate and maintain that
			 line.</text>
			</section></title><title id="HC016A9E73A934C79A1F21A20845664B9"><enum>II</enum><header>Amtrak Reform</header>
			<section id="HAFF4E24505CF44FE8D94064315AED022"><enum>201.</enum><header>Amtrak planning and grant process</header>
				<subsection id="H87A56E608A0A44B183F932D38323C337"><enum>(a)</enum><header>Requirements and procedures</header>
					<paragraph id="H0C83B5D09D504B799DD8E2496530E555"><enum>(1)</enum><header>Amendment</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/243">Chapter 243</external-xref> of title 49, United States Code, is amended by adding at the end the following new
			 sections:</text>
						<quoted-block id="H818B40EE152B4356BECDF902F47C56A4" style="USC">
							<section id="H81BCC52E17C2454AA2654B20A0AC501A"><enum>24317.</enum><header>Costs and revenues</header>
								<subsection id="H4AE1FD435AFD4B2390250840259FCABD"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 60 days after the date of enactment of the <short-title>Passenger Rail Reform and Investment Act of 2014</short-title>, Amtrak shall establish and maintain internal controls to ensure Amtrak’s costs and revenues are
			 allocated to either the Northeast Corridor or the National Network,
			 including proportional shares of common and fixed costs.</text>
								</subsection><subsection id="HF0D59E26100440A4BEC0D26FE02A2D64"><enum>(b)</enum><header>Definition</header><text display-inline="yes-display-inline">For purposes of this chapter, the term <quote>Northeast Corridor</quote> means the Northeast Corridor main line between Boston, Massachusetts, and the District of
			 Columbia, and facilities and services used to operate and maintain that
			 line.</text>
								</subsection></section><section id="H59E34BF34BE54DE492A5E0C1C83EC25E"><enum>24318.</enum><header>Grant process</header>
								<subsection id="H13A48AE1878449FBB02ABFA0B7316087"><enum>(a)</enum><header>Procedures for grant requests</header><text display-inline="yes-display-inline">Not later than 30 days after the date of enactment of the <short-title>Passenger Rail Reform and Investment Act of 2014</short-title>, the Secretary of Transportation shall establish and transmit to the Committee on Transportation
			 and Infrastructure and the Committee on Appropriations of the House of
			 Representatives and the Committee on Commerce, Science, and Transportation
			 and the Committee on Appropriations of the Senate substantive and
			 procedural requirements, including schedules, for grant requests under
			 this section.</text>
								</subsection><subsection id="H4F73544CFBC14EF98D4EB5F7EB26D34F"><enum>(b)</enum><header>Grant requests</header><text>Amtrak shall transmit grant requests for Federal funds to be appropriated to the Secretary for the
			 use of Amtrak to—</text>
									<paragraph id="HD33F9FDC273F4E358C545920D3222526"><enum>(1)</enum><text>the Secretary; and</text>
									</paragraph><paragraph id="HE53980F84CD5498D9196C4DFC416ED5E"><enum>(2)</enum><text>the Committee on Transportation and Infrastructure and the Committee on Appropriations of the House
			 of Representatives and the Committee on Commerce, Science, and
			 Transportation and the Committee on Appropriations of the Senate.</text>
									</paragraph></subsection><subsection id="H7CA66B98A4DF47D394460BBCE4D8009E"><enum>(c)</enum><header>Contents</header><text>A grant request under subsection (b) shall—</text>
									<paragraph id="HEE1DCC81EB0A4689BAE4A3DE247C4D35"><enum>(1)</enum><text>provide a detailed financial analysis for the upcoming fiscal year for the Northeast Corridor,
			 State-supported routes, and long-distance routes, including projections
			 for the items listed in 24320(c)(1), as applicable, in comparison to prior
			 fiscal year projections;</text>
									</paragraph><paragraph id="H334A89913F32415E994C524326CDCD82"><enum>(2)</enum><text>include a description of the work to be funded, along with cost estimates and an estimated
			 timetable for completion of the projects covered by the request;</text>
									</paragraph><paragraph id="H3F9DC352D7A1404B965FCD3E72A51C87"><enum>(3)</enum><text>include an assessment of the continuing financial stability of Amtrak;</text>
									</paragraph><paragraph id="H05A2CF3E88334A1F89DF3900BAE0FDC5"><enum>(4)</enum><text>be displayed on Amtrak’s website within a reasonable timeframe following its submission to the
			 entities described in subsection (b); and</text>
									</paragraph><paragraph id="HA3F3302E9D0541DDAB7E6A72F3B597D6"><enum>(5)</enum><text>be in similar format and substance to those submitted by executive agencies of the Federal
			 Government.</text>
									</paragraph></subsection><subsection id="H80A3FC64A4C74CFEACE1C98C04441B06"><enum>(d)</enum><header>Review and approval</header>
									<paragraph id="HC51B34B450894432AFAB98DB6EC809FB"><enum>(1)</enum><header>30-day approval process</header><text>The Secretary shall complete the review of a grant request and approve or disapprove the request
			 not later than 30 days after the date on which Amtrak submits the grant
			 request. If the Secretary disapproves the request or determines that the
			 request is incomplete or deficient, the Secretary shall include the reason
			 for disapproval or the incomplete items or deficiencies in a notice to
			 Amtrak.</text>
									</paragraph><paragraph id="H61F98B72F1DA4A44BD6C8AE0B73CEB3F"><enum>(2)</enum><header>15-day modification period</header><text>Not later than 15 days after receiving notification from the Secretary under paragraph (1), Amtrak
			 shall submit a modified request for the Secretary’s review.</text>
									</paragraph><paragraph id="HBA8A0DC828F540A2981FEEC5A1779BD9"><enum>(3)</enum><header>Revised requests</header><text display-inline="yes-display-inline">Not later than 15 days after receiving a modified request from Amtrak, the Secretary shall either
			 approve the modified request, or, if the Secretary finds that the request
			 is still incomplete or deficient, the Secretary shall identify in writing
			 to the Committee on Transportation and Infrastructure and the Committee on
			 Appropriations of the House of Representatives and the Committee on
			 Commerce, Science, and Transportation and the Committee on Appropriations
			 of the Senate the remaining deficiencies and recommend a process for
			 resolving the outstanding portions of the request.</text>
									</paragraph></subsection><subsection id="HE39DE2423E8D4298A2485C68E223992C"><enum>(e)</enum><header>Payment to Amtrak</header>
									<paragraph id="HB4FC4C30755246B9A713C30CF9F9FF44"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), in each fiscal year for which amounts are authorized to be
			 appropriated, amounts appropriated shall be paid to Amtrak as follows:</text>
										<subparagraph id="H66822ED5ADCF44FDAA617741C3BC95F0"><enum>(A)</enum><text>50 percent on October 1.</text>
										</subparagraph><subparagraph id="H7686DE2647E4495E82C9A7EB797B1667"><enum>(B)</enum><text>25 percent on January 1.</text>
										</subparagraph><subparagraph id="H336894742AE941B6B8047BB587518A93"><enum>(C)</enum><text>25 percent on April 1.</text>
										</subparagraph></paragraph><paragraph id="HB81692C71EF947EBA65954532F324952"><enum>(2)</enum><header>Exception</header><text>The Secretary may make a payment to Amtrak of appropriated funds more frequently than once every 90
			 days if Amtrak, for good cause, requests more frequent payment before a
			 90-day period ends.</text>
									</paragraph></subsection><subsection id="H7BF6CE8ABBF944F2A12293BE69EE4F73"><enum>(f)</enum><header>Availability of amounts and early appropriations</header><text display-inline="yes-display-inline">Amounts appropriated to the Secretary for the use of Amtrak shall remain available until expended.
			 Amounts for capital acquisitions and improvements may be appropriated for
			 a fiscal year before the fiscal year in which the amounts will be
			 obligated.</text>
								</subsection><subsection id="H577D4159B9C0479BB1F06385A034E1BB"><enum>(g)</enum><header>Limitations on use</header><text display-inline="yes-display-inline">Amounts appropriated to the Secretary for the use of Amtrak may not be used to subsidize operating
			 losses of commuter rail passenger or rail freight transportation.</text>
								</subsection></section><section id="H39729BC58793484EB0BBD4317FD824FD"><enum>24319.</enum><header>Accounts</header>
								<subsection id="H62A13B9E13BF4B0E963A01BF93462AD2"><enum>(a)</enum><header>Establishment of accounts</header><text display-inline="yes-display-inline">Amtrak shall establish—</text>
									<paragraph id="H2D14299A06BF46E0B63B1046FFF391FC"><enum>(1)</enum><text>a Northeast Corridor Improvement Fund account; and</text>
									</paragraph><paragraph id="H6E5CA8E969E74AF08C6430FD06EA3006"><enum>(2)</enum><text>a National Network account.</text>
									</paragraph></subsection><subsection id="HFBF0EEFA4BFA4A18B6112681F2EE5973"><enum>(b)</enum><header>Northeast corridor improvement fund account</header>
									<paragraph display-inline="no-display-inline" id="HFA40D921D3144B6EAA6566118E735D16"><enum>(1)</enum><header>Deposits</header><text>Amtrak shall deposit in the Northeast Corridor Improvement Fund account established under
			 subsection (a)(1)—</text>
										<subparagraph id="HBF613872A87E49FEAE58B8B0A8FEBA6A"><enum>(A)</enum><text>grant funds appropriated for the Northeast Corridor Improvement Fund pursuant to section 101(a) of
			 the <short-title>Passenger Rail Reform and Investment Act of 2014</short-title> or any subsequent Act;</text>
										</subparagraph><subparagraph id="H400F23CEF7014903AC0B1EC325E67C37"><enum>(B)</enum><text>compensation received from commuter rail passenger transportation on the Northeast Corridor
			 provided to Amtrak pursuant to section 24905(c); and</text>
										</subparagraph><subparagraph id="HBEF0854AD29A48F28BAEFBA831501833"><enum>(C)</enum><text display-inline="yes-display-inline">any operating surplus of the Northeast Corridor, as allocated pursuant to section 24317.</text>
										</subparagraph></paragraph><paragraph id="HDB107CF5921E41159A5E07DFDC96992A"><enum>(2)</enum><header>Use of northeast corridor improvement fund account</header><text display-inline="yes-display-inline">Except as provided in subsection (d), amounts deposited in the Northeast Corridor Improvement Fund
			 account shall be made available for the use of Amtrak for—</text>
										<subparagraph id="H08F50A2DE3BE430D804328ADD32FDAF0"><enum>(A)</enum><text>capital projects described in section 24401(2) (A) or (B) to bring the Northeast Corridor to a
			 state-of-good-repair, including projects described in section
			 24906(a)(2)(E)(i)(I);</text>
										</subparagraph><subparagraph id="H025A4008481042ED9EFD5466335751EB"><enum>(B)</enum><text>capital projects intended to increase corridor capacity, improve service reliability, and reduce
			 travel time for rail users on the Northeast Corridor, including projects
			 described in subclauses (II) and (III) of section 24906(a)(2)(E)(i),
			 consistent with the planning process established under section 24906; and</text>
										</subparagraph><subparagraph id="HF5C9A9951DA04B0B944AA4C2445446E8"><enum>(C)</enum><text>retirement of principal and payment of interest on loans for capital equipment, or capital leases,
			 attributable to the Northeast Corridor.</text>
										</subparagraph></paragraph></subsection><subsection id="H9F5D1E04E8BA486DA4AAD99CE4B895DD"><enum>(c)</enum><header>National network account</header>
									<paragraph display-inline="no-display-inline" id="H0720AFB96C0141B0A1A3FCBFBD398273"><enum>(1)</enum><header>Deposits</header><text>Amtrak shall deposit in the account established under subsection (a)(2)—</text>
										<subparagraph id="H3885E147EBF64DB6BFEFB39CDC99AFA4"><enum>(A)</enum><text>grant funds appropriated for the National Network pursuant to section 101(b) of the <short-title>Passenger Rail Reform and Investment Act of 2014</short-title>, or any subsequent Act;</text>
										</subparagraph><subparagraph id="H8862D2C637BD4FE982DE9FA75C1E058C"><enum>(B)</enum><text>compensation received from States provided to Amtrak pursuant to section 209 of the Passenger Rail
			 Investment and Improvement Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/42/24101">42 U.S.C. 24101</external-xref> note); and</text>
										</subparagraph><subparagraph id="HEF932660759745D5B0E24940EB3DB553"><enum>(C)</enum><text>any operating surplus from the National Network, as allocated pursuant to section 24317.</text>
										</subparagraph></paragraph><paragraph id="HFC440DBCD33642E2B1C3C484D403A8A9"><enum>(2)</enum><header>Use of national network account</header><text display-inline="yes-display-inline">Except as provided in subsection (d), amounts deposited in the National Network account shall be
			 made available for the use of Amtrak for capital expenses and operating
			 costs of the National Network and retirement of principal and payment of
			 interest on loans for capital equipment, or capital leases, attributable
			 to the National Network.</text>
									</paragraph></subsection><subsection id="H2D7386D6856E421E97B09D0235CB873D"><enum>(d)</enum><header>Transfer authority</header>
									<paragraph display-inline="no-display-inline" id="HAC3F4575E6F94F1781B0BA145883223B"><enum>(1)</enum><header>Authority</header><text>Amtrak may transfer any funds appropriated pursuant to the <short-title>Passenger Rail Reform and Investment Act of 2014</short-title> or any other Act, or any surplus generated by operations, between the Northeast Corridor
			 Improvement Fund and National Network accounts upon the expiration of 60
			 days after Amtrak has notified the Amtrak Board of Directors of such
			 transfer.</text>
									</paragraph><paragraph id="H29F03B163F8F4D189AB3ADA7DCAA5B92"><enum>(2)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 30 days after the Amtrak Board of Directors receives notification from Amtrak under
			 paragraph (1), the Board shall transmit a report to the Secretary, the
			 Committee on Transportation and Infrastructure and the Committee on
			 Appropriations of the House of Representatives, and the Committee on
			 Commerce,
			 Science, and Transportation and the Committee on Appropriations of the
			 Senate, that includes—</text>
										<subparagraph id="HADDF9BBDBDBE4FC3B28C08958B504D2A"><enum>(A)</enum><text>the amount of the transfer; and</text>
										</subparagraph><subparagraph id="H6C7C78AB1F9F43DC89ADA39E9A1D4869"><enum>(B)</enum><text>a detailed explanation of the reason for the transfer, including effects on Amtrak services if no
			 transfer were made.</text>
										</subparagraph></paragraph></subsection><subsection id="H2079A5F56E7247D68FF193BB701098B3"><enum>(e)</enum><header>Letters of intent</header>
									<paragraph id="H3D78814877D047F7A658B2B5DD373BE2"><enum>(1)</enum><header>Requirement</header><text display-inline="yes-display-inline">The Secretary shall issue a letter of intent to Amtrak announcing an intention to obligate, for a
			 major capital project described in subclauses (II) and (III) of section
			 24906(a)(2)(E)(i), an amount from future available budget authority
			 specified in law that is not more than the amount stipulated as the
			 financial participation of the Secretary in the project.</text>
									</paragraph><paragraph id="H3C6812AC6D7544D48E8385AF9CA6899C"><enum>(2)</enum><header>Notice to congress</header><text>At least 30 days before issuing a letter under paragraph (1), the Secretary shall notify in writing
			 the Committee on Transportation and Infrastructure and the Committee on
			 Appropriations of the House of Representatives, and the Committee on
			 Commerce, Science, and Transportation and the Committee on Appropriations
			 of the Senate, of the proposed letter. The Secretary shall include with
			 the notification a copy of the proposed letter, the criteria used for
			 selecting the project for a grant award, and a description of how the
			 project meets criteria of this section.</text>
									</paragraph><paragraph id="H56E9E68D882A44ECB326F3DDAA8F39AF"><enum>(3)</enum><header>Contingent nature of obligation or commitment</header><text>An obligation or administrative commitment may be made only when amounts are appropriated. The
			 letter of intent shall state that the contingent commitment is not an
			 obligation of the Federal Government, and is subject to the availability
			 of appropriations under Federal law and to Federal laws in force or
			 enacted after the date of the contingent commitment.</text>
									</paragraph></subsection><subsection id="H1061B3818C4D4044B64E30D9459FC3A0"><enum>(f)</enum><header>Rolling stock purchases</header><text>Prior to entering into contracts in excess of $100,000,000 for rolling stock procurements, Amtrak
			 shall submit a business case analysis to the Secretary, the Committee on
			 Transportation and Infrastructure and the Committee on Appropriations of
			 the House of Representatives, and the Committee on Commerce, Science, and
			 Transportation and the Committee on Appropriations of the Senate, on the
			 utility of such purchase. This analysis shall—</text>
									<paragraph id="H8CFFCB9A57C94CD4A44CFC3755287A1C"><enum>(1)</enum><text display-inline="yes-display-inline">include a cost and benefit comparison that describes the total lifecycle costs and the anticipated
			 benefits related to revenue, operational efficiency, reliability, and
			 other factors;</text>
									</paragraph><paragraph id="H5D4E0C5788C442DEB20FB4DF6311DD78"><enum>(2)</enum><text display-inline="yes-display-inline">set forth the total payments by fiscal year;</text>
									</paragraph><paragraph id="HA66CCB35EEF64C1AABF5450491F3B9EA"><enum>(3)</enum><text display-inline="yes-display-inline">identify the specific source and amounts of funding for each payment, including Federal funds,
			 State funds, Amtrak profits, Federal, State, or private loans or loan
			 guarantees, and other funding;</text>
									</paragraph><paragraph id="HD52B8E0C813C4A81BA02DB4A88449381"><enum>(4)</enum><text display-inline="yes-display-inline">include whether any payment under the contract will increase Amtrak’s grant request, as required
			 under section 24318, in that particular fiscal year; and</text>
									</paragraph><paragraph id="HD66B6705E6BD4EC7A48F8480F2B474C3"><enum>(5)</enum><text display-inline="yes-display-inline">describe how Amtrak will adjust the procurement if future funding is not available.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

									<paragraph id="HE8E30C9207F640E5B4682F478A595C11"><enum>(1)</enum><header>Requirement</header><text display-inline="yes-display-inline">Not later than 12 months after the date of enactment of the <short-title>Passenger Rail Reform and Investment Act of 2014</short-title>, and annually thereafter, the Northeast Corridor Infrastructure and Operations Advisory Commission
			 established under section 24905 (referred to in this section as the <quote>Commission</quote>) shall develop a capital investment plan for the Northeast Corridor main line between Boston,
			 Massachusetts, and the District of Columbia, and the Northeast Corridor
			 branch lines connecting to Harrisburg, Pennsylvania, Springfield,
			 Massachusetts, and Spuyten Duyvil, New York, and facilities and services
			 used to operate and maintain those lines.</text>
									</paragraph><paragraph id="H5D810DAB2FF04D18A1873177B28BE34E"><enum>(2)</enum><header>Contents</header><text>Each such plan shall—</text>
										<subparagraph id="HA7D3488A3616431FBF1D73FFF42631B3"><enum>(A)</enum><text>be developed to establish a coordinated approach to capital spending on the Northeast Corridor;</text>
										</subparagraph><subparagraph id="H369160B6784E47108007606E393E06EC"><enum>(B)</enum><text>cover a period of 5 fiscal years, beginning with the first fiscal year after the date of the plan;</text>
										</subparagraph><subparagraph id="H444A5C9F37F14F4DB3742B894299081C"><enum>(C)</enum><text>notwithstanding section 24902(b), prioritize projects and investments along the Northeast Corridor
			 based on—</text>
											<clause id="H2DA3DC54A55D49F3925AA8B16ACE5E57"><enum>(i)</enum><text>the anticipated benefits and costs of projects;</text>
											</clause><clause id="H7AE555A3D1D648748EE2A03FF05404F8"><enum>(ii)</enum><text>the anticipated Federal and non-Federal funding available; and</text>
											</clause><clause id="H5E119CAD6A4E471DB5BAF0E5888EE0F7"><enum>(iii)</enum><text>the information contained in the Northeast Corridor asset management plans required under
			 subsection (b), once available;</text>
											</clause></subparagraph><subparagraph id="HC74D8270A7D6441BB655AFDCCE916BEA"><enum>(D)</enum><text>ensure coordination and optimization across the entire Northeast Corridor and among the various
			 owners and users;</text>
										</subparagraph><subparagraph id="HE1ED2DE57B5A42B4A2F047D981A6DA37"><enum>(E)</enum><text>include a financial plan for the investment period that—</text>
											<clause commented="no" id="H6C5FE4CAF9724796BFACF536AA55384B"><enum>(i)</enum><text>categorizes each capital project as being primarily associated with—</text>
												<subclause commented="no" id="HBDE8FA7F60E74B8AAB51F8982FECF4E2"><enum>(I)</enum><text>normalized capital replacement;</text>
												</subclause><subclause commented="no" id="H52F2D390123E450B870E343624F5E97D"><enum>(II)</enum><text display-inline="yes-display-inline">replacement, rehabilitation, or repair of Northeast Corridor infrastructure assets, including
			 tunnels, bridges, stations, and other assets; or</text>
												</subclause><subclause commented="no" id="H190B9058FBF04DC5AD8B9C861ACC6507"><enum>(III)</enum><text display-inline="yes-display-inline">improvement of train performance on the Northeast Corridor, including reduced trip times, increased
			 train frequencies, higher operating speeds, and other improvements;</text>
												</subclause></clause><clause id="HA5965393E39B40FB8932502DA914946E"><enum>(ii)</enum><text>identifies the anticipated funding source and financing method for each capital project described
			 in subclauses (II) and (III) of clause (i);</text>
											</clause><clause id="H7A4479C444644621B71912899958FE4A"><enum>(iii)</enum><text>describes the anticipated outcomes of each project, including—</text>
												<subclause id="H2BE15D0AC9FA40439CF28C70DE95B010"><enum>(I)</enum><text>an assessment of the potential effect on passenger accessibility, operations, safety, reliability,
			 and resiliency, and on the ability of infrastructure owners and operators
			 to meet regulatory requirements should the project not be funded; and</text>
												</subclause><subclause id="H9A98773B0D294F958ED2FEA2E59851C3"><enum>(II)</enum><text>an assessment of the benefits and costs;</text>
												</subclause></clause><clause id="H371E20576B6E4F199EEF6AD223F8ADC1"><enum>(iv)</enum><text>identifies the extent to which the capital assets are or will be jointly used by intercity
			 passenger rail service and other users, and the proportionate share of
			 that joint usage; and</text>
											</clause><clause id="H96B159783E5F4900B1A6D1D38B829321"><enum>(v)</enum><text>for projects that are expected to be fully or partially funded through Federal financial
			 assistance, identifies the most appropriate public agency or entity to
			 receive those funds and implement each capital project.</text>
											</clause></subparagraph></paragraph><paragraph id="H2E6FEB27E079499C8C433A9D4BCAC62B"><enum>(3)</enum><header>Additional contents</header><text>Any plan developed under paragraph (1) after the publication by the Secretary of Transportation of
			 the Northeast Corridor service development plan shall also—</text>
										<subparagraph id="H72C2301C455146CD851BD956AC5843BC"><enum>(A)</enum><text>be developed to identify, prioritize, and phase the implementation of projects necessary to achieve
			 the goals and findings contained in such Northeast Corridor service
			 development plan;</text>
										</subparagraph><subparagraph id="H58C45BA680254B98AF3DA4F135B22F7D"><enum>(B)</enum><text>allow for flexibility to change prioritization and programs based upon the availability of Federal
			 and non-Federal funding;</text>
										</subparagraph><subparagraph id="H7DCE383A38384DEB99B52E7434E049BE"><enum>(C)</enum><text>inform the Secretary in developing recommendations for Congress on Federal funding needs for the
			 Northeast Corridor and any corresponding Federal investments in the
			 respective capital programs for Northeast Corridor infrastructure owners
			 and users; and</text>
										</subparagraph><subparagraph id="HC8E5BD399B074C969B18524722F9BEBD"><enum>(D)</enum><text>capture the network-level anticipated outcomes associated with plan implementation, including the
			 anticipated effect on passenger accessibility, operations, safety,
			 reliability, and resiliency.</text>
										</subparagraph></paragraph></subsection><subsection id="H3372A5ABC57245BC846E382FCCE0BD74"><enum>(b)</enum><header>Northeast corridor asset management plans</header>
									<paragraph id="HD4333F14A7344EF4AFB6922A1485D150"><enum>(1)</enum><header>Contents</header><text display-inline="yes-display-inline">Amtrak, and States and public transportation entities that own infrastructure that supports or
			 provides for intercity rail passenger transportation on the Northeast
			 Corridor, shall develop and update as necessary Northeast Corridor asset
			 management plans for the Northeast Corridor main line between Boston,
			 Massachusetts, and the District of Columbia, and the Northeast Corridor
			 branch lines connecting to Harrisburg, Pennsylvania, Springfield,
			 Massachusetts, and Spuyten Duyvil, New York, and facilities and services
			 used to operate and maintain those lines, that—</text>
										<subparagraph id="H96F62B932EFA4825BB57B6E656CAF8AB"><enum>(A)</enum><text>are consistent with the Federal Transit Administration process, as authorized under section 5326,
			 when implemented;</text>
										</subparagraph><subparagraph id="H138249710C9540DD87ADA501360796C1"><enum>(B)</enum><text>include, at a minimum—</text>
											<clause id="H9651D9C4AF344C63BE0D1F4386A31AA8"><enum>(i)</enum><text>an inventory of all capital assets owned by the developer of the plan;</text>
											</clause><clause id="H5CE168088F8040F99989A5AD187599CE"><enum>(ii)</enum><text>an assessment of the condition of each of those assets;</text>
											</clause><clause id="HE01CE67855A04845864755FB1D962DA4"><enum>(iii)</enum><text>a description of how the condition of each asset has changed since the previous iteration of the
			 plan; and</text>
											</clause><clause id="H44884815417F4D04B26162D24940F61D"><enum>(iv)</enum><text display-inline="yes-display-inline">a description of the necessary resources and processes for bringing or maintaining those assets in
			 a state-of-good repair, including decision support tools and investment
			 prioritization methodologies.</text>
											</clause></subparagraph></paragraph><paragraph commented="no" id="H6F68CD577E6A4AB6B5F0243B10C64879"><enum>(2)</enum><header>Transmittal to Commission</header><text>Not later than 12 months after the date of enactment of the <short-title>Passenger Rail Reform and Investment Act of 2014</short-title>, each entity described in paragraph (1) shall transmit to the Commission a plan developed under
			 paragraph (1). Any updates to such plan shall also be transmitted to the
			 Commission.</text>
									</paragraph></subsection><subsection id="H29251071CD7E44898F98EC1F5EA71222"><enum>(c)</enum><header>Northeast corridor service development plan updates</header><text>The Commission shall, at least once every 10 years, update the Northeast Corridor service
			 development plan.</text>
								</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

			 section 101 of the <short-title>Passenger Rail Reform and Investment Act of 2014</short-title>, or any subsequent authorization of appropriations for the same purposes, the Amtrak Board of
			 Directors shall prepare and transmit to the Committee on Transportation
			 and Infrastructure and the Committee on Appropriations of the House of
			 Representatives and the Committee on Commerce, Science, and Transportation
			 and the Committee on Appropriations of the Senate a 5-year capital and
			 operating plan for the Northeast Corridor and National Network.</text>
							</subsection><subsection id="H7EB6F40B13AD45708BE3A453D4172A5B"><enum>(b)</enum><header>Consultation</header><text>Each such plan shall be prepared in consultation with—</text>
								<paragraph id="H81DBCE6A3309480FAEF129C4BBE3AB84"><enum>(1)</enum><text display-inline="yes-display-inline">the Federal Railroad Administration;</text>
								</paragraph><paragraph id="H0938EFBC10B241B3B51D639EBAB0DD86"><enum>(2)</enum><text display-inline="yes-display-inline">the Northeast Corridor Infrastructure and Operations Advisory Commission, with respect to the
			 Northeast Corridor; and</text>
								</paragraph><paragraph id="H35F2379CD9874899BB619B2B4A0F2A66"><enum>(3)</enum><text display-inline="yes-display-inline">the requisite States, with respect to the National Network.</text>
								</paragraph></subsection><subsection id="H6D57885E2107469C98EC4970DA64435C"><enum>(c)</enum><header>Contents</header><text display-inline="yes-display-inline">A plan prepared under this section shall—</text>
								<paragraph id="HB52F26D030E948D8874107E60587E5BC"><enum>(1)</enum><text>for each of the Northeast Corridor and the National Network, include—</text>
									<subparagraph id="HF8A6863359AC4DDDA1A4F983FE3E09BC"><enum>(A)</enum><text display-inline="yes-display-inline">projected revenues and expenditures for the Northeast Corridor, State-supported routes,
			 long-distance routes, and corporate development, including Federal and
			 non-Federal funding sources;</text>
									</subparagraph><subparagraph id="HE265079622F940B5856F12B774FFADFB"><enum>(B)</enum><text>projected ridership levels for the Northeast Corridor, State-supported routes, and long-distance
			 routes;</text>
									</subparagraph><subparagraph id="HBB50995E50C04DB49A2E7E284A4E22FF"><enum>(C)</enum><text>projected capital and operational funding requirements necessary to maintain passenger service in
			 order to accommodate predicted ridership levels and predicted sources of
			 Federal and non-Federal funding;</text>
									</subparagraph><subparagraph id="H8F5CD6B29ED3462086787D60A3D42EA0"><enum>(D)</enum><text>projected capital and operating requirements, ridership, revenue, and expenditures for new
			 passenger service operations or service expansions;</text>
									</subparagraph><subparagraph id="HAAF6BBF9260441469398196C18418E17"><enum>(E)</enum><text>an assessment of the continuing financial stability of Amtrak, as indicated by factors including
			 anticipated Federal funding of capital and operating costs, Amtrak's
			 ability to efficiently recruit, retain, and manage its workforce, and
			 Amtrak's ability to effectively provide passenger rail service;</text>
									</subparagraph><subparagraph id="H66A73CD181364D8FA7E5E2C0228A37E7"><enum>(F)</enum><text>estimates of long-term and short-term debt and associated principal and interest payments (both
			 current and anticipated);</text>
									</subparagraph><subparagraph id="H3C812836E9F143CAA66B1983403DA67B"><enum>(G)</enum><text>annual cash flow forecasts;</text>
									</subparagraph><subparagraph id="HFD605E7661F340D29CDD6A8DA7F50B13"><enum>(H)</enum><text>a statement describing methods of estimation and significant assumptions;</text>
									</subparagraph><subparagraph id="H7D40E9B964EF439D9BF9FEDD1F1C5AA3"><enum>(I)</enum><text>specific measures that demonstrate measurable improvement year over year in the financial results
			 of Amtrak's operations;</text>
									</subparagraph><subparagraph id="HDC1D855CBD2F48F885059F7D7122ED20"><enum>(J)</enum><text>prior fiscal year and projected—</text>
										<clause id="H6C10C8C5098D48B7A882424998EF5157"><enum>(i)</enum><text>operating ratio, cash operating loss, and cash operating loss per passenger on a route, business
			 line, and corporate basis;</text>
										</clause><clause id="H3B596EE032C74AEAB241407000525318"><enum>(ii)</enum><text>specific costs and savings estimates resulting from reform initiatives;</text>
										</clause><clause id="HD886DA95B00E4499BE054FFC6876ABF9"><enum>(iii)</enum><text>productivity statistics on a route, business line, and corporate basis; and</text>
										</clause><clause id="HE1C234A95DFA4342AF2CFBFB8370F488"><enum>(iv)</enum><text>equipment reliability statistics;</text>
										</clause></subparagraph><subparagraph id="H639CA157D7E14EB89B4A0A0F7E70AD47"><enum>(K)</enum><text>capital and operating expenditures for anticipated security needs; and</text>
									</subparagraph><subparagraph id="HDB28F1FB57724D90B8839906157542FA"><enum>(L)</enum><text>a prioritization of capital expenditures by business line; and</text>
									</subparagraph></paragraph><paragraph id="H8286A14D18A14004935E67618CA5A470"><enum>(2)</enum><text display-inline="yes-display-inline">reflect the Northeast Corridor planning, as applicable, and grant processes established under
			 sections 24906 and 24318.</text>
								</paragraph></subsection><subsection commented="no" id="H54280FF4BB324AC2B1DBA4BB7FD1F224"><enum>(d)</enum><header>Conformance to authorized funding levels</header>
								<paragraph commented="no" id="H9226C27953034EEF801F7779B5C393B0"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), any financial projection for a fiscal year that is included in
			 a plan prepared under this section shall be based on the amount of
			 dedicated funding for such fiscal year.</text>
								</paragraph><paragraph commented="no" id="H37D41ABC50FC4FC88D43CB395A2FE62B"><enum>(2)</enum><header>Absence of appropriation</header><text display-inline="yes-display-inline">In the absence of an appropriation of funds for such fiscal year, the projection shall be based on
			 the amount of funds authorized by law to be appropriated for that fiscal
			 year, plus other dedicated funding.</text>
								</paragraph><paragraph commented="no" id="H61C0CF54547743A799651A6B88A3BC8B"><enum>(3)</enum><header>Dedicated funding defined</header><text display-inline="yes-display-inline">In this subsection, the term <quote>dedicated funding</quote> means any amounts appropriated for a fiscal year and any other funding sources, including revenues
			 and other ancillary funding streams, for the Northeast Corridor or the
			 National Network.</text>
								</paragraph></subsection><subsection id="H44F747778BE24180A4F97730AD12F9EB"><enum>(e)</enum><header>Standards To promote financial stability</header><text display-inline="yes-display-inline">In preparing a plan under this section, the Board shall apply sound budgetary practices, including
			 reducing costs and other expenditures, improving productivity, increasing
			 revenues, or combinations of such practices.</text>
							</subsection><subsection id="H2BAC1E37B05448A9BF04A0D99BAC67E8"><enum>(f)</enum><header>Updates</header><text display-inline="yes-display-inline">Amtrak shall provide monthly reports for the current fiscal year in electronic format to the
			 Secretary and the Committee on Transportation and Infrastructure and the
			 Committee on Appropriations of the House of Representatives and the
			 Committee on Commerce, Science, and Transportation and the Committee on
			 Appropriations of the Senate regarding the items described in subsection
			 (c)(1), which shall include a description of the work completed to date,
			 any
			 differences from projections, and the reasons for such differences.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H02C2CC0E0B3E473DB2ED7748922ED15F"><enum>(b)</enum><header>Table of sections amendment</header><text display-inline="yes-display-inline">The table of sections for such chapter 243 is amended by adding at the end the following new item:</text>

				</subsection><subsection id="H8FA12B83B3A5449495B58AAD1E62A4B7"><enum>(c)</enum><header>Repeal</header><text>Section 204 of the Passenger Rail Investment and Improvement Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/49/24101">49 U.S.C. 24101</external-xref> note) is
			 repealed.</text>
				</subsection></section><section id="H4169505C687E41D78C78BB0B6E62CD28"><enum>203.</enum><header>State-supported routes</header>
				<subsection id="H7F67DAD376DC4BF8B978818F7599D5BC"><enum>(a)</enum><header>Amendment</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/247">Chapter 247</external-xref> of title 49, United States Code, is amended by adding at the end the following new
			 section:</text>
					<quoted-block id="H3E131A420AD34F1489740BB347F3086B" style="USC">
						<section id="HE1918F9413064B69B26FE5418249F2E2"><enum>24712.</enum><header>State-supported routes</header>
							<subsection id="H1DFE62C78B8D4A4792109AA9312B9F19"><enum>(a)</enum><header>State-Supported route advisory committee</header>
								<paragraph id="H5BED8BB9FEB74280859F6CB8F21DFC45"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of the <short-title>Passenger Rail Reform and Investment Act of 2014</short-title>, the Secretary of Transportation shall establish a State-Supported Route Advisory Committee to
			 promote mutual cooperation and planning pertaining to the rail operations
			 and related activities of trains operated on State-supported routes and to
			 further implement section 209 of the Passenger Rail Investment and
			 Improvement Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/49/24101">49 U.S.C. 24101</external-xref> note).</text>
								</paragraph><paragraph id="HC99D68616F9449F4AEC746BF7F5D66F2"><enum>(2)</enum><header>Membership</header><text>The Committee shall consist of representatives of—</text>
									<subparagraph id="H42BBC0A9A7D842B5A79682E1F3D530C7"><enum>(A)</enum><text>Amtrak;</text>
									</subparagraph><subparagraph id="HF3D295E3186C43AD9E5263159BB9E8BA"><enum>(B)</enum><text>the Department of Transportation, including the Federal Railroad Administration; and</text>
									</subparagraph><subparagraph id="H4C42348E0FC14B55B893E30830C43602"><enum>(C)</enum><text display-inline="yes-display-inline">7 States that sponsor State-supported routes, selected by the Administrator of the Federal Railroad
			 Administration on the basis of appropriate expertise and geographic
			 balance, and in a manner that ensures that all appropriate States are
			 represented periodically on the Committee.</text>
									</subparagraph></paragraph><paragraph id="H7BD40F9F41894D009AB71F74D72D497B"><enum>(3)</enum><header>Distribution of membership</header><text>The membership belonging to any of the groups described in each individual subparagraph of
			 paragraph (2) shall not constitute a majority of the Committee’s
			 memberships.</text>
								</paragraph><paragraph id="H499235C1D0BE4EA8A45D1DFC36F6A7F5"><enum>(4)</enum><header>Meetings; rules and procedures</header><text>The Committee shall establish a schedule and location for convening meetings, but shall meet no
			 less than 2 times every fiscal year. The Committee shall develop rules and
			 procedures to govern the Committee’s proceedings.</text>
								</paragraph></subsection><subsection id="HF9B53AC797144DAF9ADF0A5E7E2D008C"><enum>(b)</enum><header>Cost, service, and ridership forecasts</header>
								<paragraph display-inline="no-display-inline" id="HB8A20B14F37940C09AA2054525A449F8"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than January 31, 2015, and annually thereafter, Amtrak shall transmit to each State that
			 sponsors a State-supported route, and to the Committee on Transportation
			 and Infrastructure and the Committee on Appropriations of the House of
			 Representatives and the Committee on Commerce, Science, and Transportation
			 and the Committee on Appropriations of the Senate—</text>
									<subparagraph id="H4777770DF205463F94FD89E2299703EE"><enum>(A)</enum><text>a final statement of costs, revenues, ridership, and other information determined appropriate by
			 the Committee established under subsection (a), pertaining to each such
			 route for the prior fiscal year; and</text>
									</subparagraph><subparagraph id="HEBC1C2BA21CB428F90BCEC33D28EAAC0"><enum>(B)</enum><text>a cost, service, and ridership forecast for each such route for the upcoming fiscal year, developed
			 pursuant to the methodology established under section 209 of the Passenger
			 Rail Investment and Improvement Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/49/24101">49 U.S.C. 24101</external-xref> note).</text>
									</subparagraph></paragraph><paragraph id="H7F801D6F48974A579DEC52C9933308FC"><enum>(2)</enum><header>Exception</header><text>The Committee may establish a different deadline than is required under paragraph (1) for
			 submission of final financial statements and cost, service, and ridership
			 forecasts.</text>
								</paragraph><paragraph id="H81F3DAA8E9014060BB088EC3F7D96D26"><enum>(3)</enum><header>Quarterly updates</header><text display-inline="yes-display-inline">Beginning in 2015, and each year thereafter, Amtrak shall transmit to each State that sponsors a
			 State-supported route quarterly updates of the cost, service, and
			 ridership forecast described in paragraph (1)(B) to enable States to pace
			 costs against State budgets, plan effectively, and address unexpected
			 changes in costs in a timely manner, on the following dates:</text>
									<subparagraph id="HEE171BCA123C427387EFFE2F00D3B04F"><enum>(A)</enum><text>April 30, for the period encompassing January through March of such year.</text>
									</subparagraph><subparagraph id="HA9D1F9E3466442CE9EB84C356850F12A"><enum>(B)</enum><text>July 31, for the period encompassing April through June of such year.</text>
									</subparagraph><subparagraph id="HE05A669B99134695A3BD9230E8C4D119"><enum>(C)</enum><text>October 31, for the period encompassing July through September of such year.</text>
									</subparagraph></paragraph></subsection><subsection id="H8A19A26FA9E2431B95998C163EE3E269"><enum>(c)</enum><header>Invoices</header><text display-inline="yes-display-inline">Not later than February 15, 2015, and monthly thereafter, Amtrak shall provide to each State that
			 sponsors a State-supported route a monthly invoice of the cost of
			 operating such route, including fixed costs and third-party costs.</text>
							</subsection><subsection id="HFB1517A7BE2E4B66A59626E8ADDF0FDC"><enum>(d)</enum><header>Dispute resolution</header>
								<paragraph id="HB1BDCCB95C6D4D889462E20D493D2DC3"><enum>(1)</enum><header>Request for expedited resolution</header><text display-inline="yes-display-inline">If a dispute arises with respect to a forecast developed under subsection (b), an invoice developed
			 under subsection (c), or the terms of a contract for operation of a
			 State-supported route negotiated between Amtrak and a State that sponsors
			 the route, either Amtrak or the State may request that the Surface
			 Transportation Board conduct expedited dispute resolution under this
			 subsection.</text>
								</paragraph><paragraph id="HF56B38BABFCD4CA0A61FF4D1A062BF8C"><enum>(2)</enum><header>Procedures</header><text>The Surface Transportation Board shall establish procedures for expedited resolution of disputes
			 brought before it under this subsection.</text>
								</paragraph><paragraph id="H15B4834A61394740BE12F7CF6CEB6FCA"><enum>(3)</enum><header>Binding effect</header><text>The decision of the Surface Transportation Board under this subsection shall be binding on the
			 parties to the dispute.</text>
								</paragraph></subsection><subsection id="H29540A995EB847C0A07903C3F5F965FF"><enum>(e)</enum><header>FRA assistance</header><text>The Federal Railroad Administration may provide assistance to the parties in the course of
			 negotiations for a contract for operation of a State-supported route.</text>
							</subsection><subsection id="H53D6936C5AFA453FA0199ECB1192FA1D"><enum>(f)</enum><header>Performance metrics</header><text display-inline="yes-display-inline">In negotiating a contract for operation of a State-supported route, Amtrak and the State or States
			 that sponsor the route shall consider including provisions that provide
			 penalties and incentives for performance based on metrics that take into
			 account only those factors within the control of Amtrak or the State or
			 States.</text>
							</subsection><subsection id="H0AD0AE9ED1D24BB2BE69A93BDF6FC56F"><enum>(g)</enum><header>Definition of State</header><text display-inline="yes-display-inline">In this section, the term <quote>State</quote> means each of the 50 States and the District of Columbia.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H719AB7D0363F4285A4BE227656350944"><enum>(b)</enum><header>Table of sections amendment</header><text>The table of sections for such chapter 247 is amended by adding at the end the following new item:</text>

				</subsection></section><section id="H1B5D6274EF5541C2856B87E59D0AB526"><enum>204.</enum><header>Route and service planning decisions</header><text display-inline="no-display-inline">Section 208 of the Passenger Rail Investment and Improvement Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/49/24101">49 U.S.C. 24101</external-xref> note) is
			 amended to read as follows:</text>
				<quoted-block id="HEE61267F1B264FB8A3D13F2F657AD9F5" style="OLC">
					<section id="H6E259C5AB3794858890C3372BB74F8E2"><enum>208.</enum><header>Methodologies for Amtrak route and service planning decisions</header>
						<subsection id="HD4EC708BF08A4F8EA67F9CF7762FB172"><enum>(a)</enum><header>Methodology development</header><text>Not later than 180 days after the date of enactment of the <short-title>Passenger Rail Reform and Investment Act of 2014</short-title>, as a condition of receiving a grant under section 101 of such Act, Amtrak shall obtain the
			 services of an independent entity to develop and recommend objective
			 methodologies for Amtrak to use in determining what intercity rail
			 passenger transportation routes and services it should provide, including
			 the establishment of new routes, the elimination of existing routes, and
			 the contraction or expansion of services or frequencies over such routes.</text>
						</subsection><subsection id="H9AA98907523342529634A5604F6406D4"><enum>(b)</enum><header>Considerations</header><text>Amtrak shall require the entity, in developing the methodologies described in subsection (a), to
			 consider—</text>
							<paragraph id="H809CBA6D956A42089CDBC515D86CC4E7"><enum>(1)</enum><text>the current and expected performance and service quality of intercity rail passenger transportation
			 operations, including cost recovery, on-time performance, ridership,
			 on-board services, stations, facilities, equipment, and other services;</text>
							</paragraph><paragraph id="H97A1B14126234AAF81A38E2007A1D2DE"><enum>(2)</enum><text>connectivity of a route with other routes;</text>
							</paragraph><paragraph id="H0279C01491C6456A9035513226AA2EB7"><enum>(3)</enum><text>the transportation needs of communities and populations that are not well served by intercity rail
			 passenger transportation service or by other forms of intercity
			 transportation;</text>
							</paragraph><paragraph id="H8D47AB1C1CAD4FDB97982F2903C505CB"><enum>(4)</enum><text>the methodologies of Amtrak and major intercity rail passenger transportation service providers in
			 other countries for determining intercity passenger rail routes and
			 services;</text>
							</paragraph><paragraph id="H15BD27D6C32B444AAC8834A59D7F1AA2"><enum>(5)</enum><text>the views of States, rail carriers that own infrastructure over which Amtrak operates, Amtrak
			 employee representatives, and other interested parties; and</text>
							</paragraph><paragraph id="HA4AACF78F71443D39A4330489E8A9C51"><enum>(6)</enum><text>the funding levels that will be available under authorization levels that have been enacted into
			 law.</text>
							</paragraph></subsection><subsection id="HD9930C6BECB24A4A9536A7D89F4D269D"><enum>(c)</enum><header>Recommendations</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of the <short-title>Passenger Rail Reform and Investment Act of 2014</short-title>, Amtrak shall transmit to the Committee on Transportation and Infrastructure of the House of
			 Representatives, and the Committee on Commerce, Science, and
			 Transportation of the Senate the recommendations developed by the entity
			 pursuant to subsection (a).</text>
						</subsection><subsection id="H057B2E7E08EE4BE4A9FA9C081A5BCDDA"><enum>(d)</enum><header>Consideration of recommendations</header><text>Not later than 90 days after transmitting the recommendations pursuant to subsection (c), the
			 Amtrak Board of Directors shall consider the adoption of the
			 recommendations and transmit to the Committee on Transportation and
			 Infrastructure of the House of Representatives and the Committee on
			 Commerce, Science, and Transportation of the Senate a report containing an
			 explanation of any reasons for adopting or not adopting the
			 recommendations.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HA5DAF339209E473E9D2CA08840894EBC"><enum>205.</enum><header>Competition</header>
				<subsection display-inline="no-display-inline" id="idDF3FA4B08D63432A89F3D3D9D07D74C7"><enum>(a)</enum><header>Amendment</header><text><external-xref legal-doc="usc" parsable-cite="usc/49/24711">Section 24711</external-xref> of title 49, United States Code, is amended to read as follows:</text><quoted-block id="HC39E2C7BF2F744BCABF785D931DD7236" style="USC">
						<section id="HA34C1ECF234149C58EB0225ECB7F97FB"><enum>24711.</enum><header>Alternate passenger rail service pilot program</header>
							<subsection id="HB3B0650324DD48B59149EFB9510EA969"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of the <short-title>Passenger Rail Reform and Investment Act of 2014</short-title>, the Federal Railroad Administration shall complete a rulemaking proceeding to develop a pilot
			 program that—</text>
								<paragraph id="H492C1FC86A0D473C946F7F6597051B06"><enum>(1)</enum><text>permits a rail carrier or rail carriers that own infrastructure over which Amtrak operates a
			 passenger rail service route described in subparagraph (B), (C), or (D) of
			 section 24102(5) or in section 24702(a) to petition the Federal Railroad
			 Administration to be considered as a passenger rail service provider over
			 that route in lieu of Amtrak for an operations period of 5 years;</text>
								</paragraph><paragraph id="HF6F4EF90E555484A9445FAC266263712"><enum>(2)</enum><text>requires the Federal Railroad Administration to notify Amtrak within 30 days after receiving a
			 petition under paragraph (1) and establish a deadline by which both the
			 petitioner and Amtrak would be required to submit a bid to provide
			 passenger rail service over the route to which the petition relates;</text>
								</paragraph><paragraph id="HEB23456FD7A74AB3970F50FCD827298F"><enum>(3)</enum><text>requires that each bid describe how the bidder would operate the route, what Amtrak passenger
			 equipment would be needed, if any, and what sources of non-Federal funding
			 the bidder would use, including any State subsidy, among other things;</text>
								</paragraph><paragraph id="HC03B209A58FD4128934A1838165F92EA"><enum>(4)</enum><text>requires the Federal Railroad Administration to execute a contract within a specified, limited time
			 after the deadline established under paragraph (2) and award to the
			 winning bidder—</text>
									<subparagraph id="H217DDFF83EB647FDB86F32FA9E69FAE4"><enum>(A)</enum><text>the right and obligation to provide passenger rail service over that route subject to such
			 performance standards as the Federal Railroad Administration may require;
			 and</text>
									</subparagraph><subparagraph id="HFFCF14C655224DB09292815EF0BC151F"><enum>(B)</enum><text>an operating subsidy—</text>
										<clause id="H4C526189B1C94410B82FB6CFCEDEC72D"><enum>(i)</enum><text>for the first year at a level not in excess of 90 percent of the level in effect for that specific
			 route during the fiscal year preceding the fiscal year in which the
			 petition was received, adjusted for inflation; and</text>
										</clause><clause id="H18939756D47A48C1865646476C6DF2D1"><enum>(ii)</enum><text>for any subsequent years at the level calculated under clause (i), adjusted for inflation; and</text>
										</clause></subparagraph></paragraph><paragraph id="H8DFAB59EEA2E448D9A1585BA6F1C4920"><enum>(5)</enum><text>requires that each bid contain a staffing plan describing the number of employees needed to operate
			 the service, the job assignments and requirements, and the terms of work
			 for prospective and current employees of the bidder for the service
			 outlined in the bid, and that such staffing plan be made available by the
			 winning bidder to the public after the bid award.</text>
								</paragraph></subsection><subsection id="H3087E003C60E4F29B452FD5A2642226B"><enum>(b)</enum><header>Route limitations</header><text>The Federal Railroad Administration may not make the program available with respect to more than 2
			 Amtrak intercity passenger rail routes.</text>
							</subsection><subsection id="HE662673C36B3496A8E5ABE7229B763CB"><enum>(c)</enum><header>Performance standards; access to facilities; employees</header><text>If the Federal Railroad Administration awards the right and obligation to provide passenger rail
			 service over a route under this section to a rail carrier or rail
			 carriers—</text>
								<paragraph id="HE24E2DDD9E064CADAEC3347C90EEED28"><enum>(1)</enum><text>it shall execute a contract with the rail carrier or rail carriers for rail passenger operations on
			 that route that conditions the operating and subsidy rights on—</text>
									<subparagraph id="H32F2644B6AE148C3B056A20BBE5B76DB"><enum>(A)</enum><text>the service provider continuing to provide passenger rail service on the route that is no less
			 frequent, nor over a shorter distance, than Amtrak provided on that route
			 before the award; and</text>
									</subparagraph><subparagraph id="H695021511847475EB7CDC9A14F27F8C3"><enum>(B)</enum><text>the service provider’s compliance with the standards established under subsection (a)(4)(A), and
			 such additional performance standards as the Administration may establish;</text>
									</subparagraph></paragraph><paragraph id="H4BB24967458440868B7C968B988691B3"><enum>(2)</enum><text>it shall, if the award is made to a rail carrier other than Amtrak, require Amtrak to provide
			 access to its reservation system, stations, and facilities directly
			 related to operations to any rail carrier or rail carriers awarded a
			 contract under this section, in accordance with subsection (d), necessary
			 to carry out the purposes of this section;</text>
								</paragraph><paragraph id="H339A910ABFA842C780F12835A70C2FC7"><enum>(3)</enum><text>an employee of any person used by such rail carrier or rail carriers in the operation of a route
			 under this section shall be considered an employee of that carrier or
			 carriers and subject to the applicable Federal laws and regulations
			 governing similar crafts or classes of employees of Amtrak, including
			 provisions under section 121 of the Amtrak Reform and Accountability Act
			 of 1997 (<external-xref legal-doc="usc" parsable-cite="usc/49/4312">49 U.S.C. 4312</external-xref> note) relating to employees that provide food and
			 beverage service; and</text>
								</paragraph><paragraph id="H7F97A44E34B444FDB588A01C3CE9974F"><enum>(4)</enum><text>the winning bidder shall provide hiring preference to qualified Amtrak employees displaced by the
			 award of the bid, consistent with the staffing plan submitted by the
			 bidder, and shall be subject to the grant conditions under section 24405
			 of this title.</text>
								</paragraph></subsection><subsection id="HB458952544E249ED976692E697A552EB"><enum>(d)</enum><header>Disputes</header><text display-inline="yes-display-inline">If Amtrak and the rail carrier or rail carriers awarded a route under this section cannot agree
			 upon terms to carry out subsection (c)(2), and the Surface Transportation
			 Board finds that access to Amtrak’s facilities or equipment, or the
			 provision of services by Amtrak, is necessary to carry out subsection
			 (c)(2) and that the operation of Amtrak’s other services will not be
			 impaired thereby, the Surface Transportation Board shall, within 120 days
			 after submission of the dispute, issue an order that the facilities and
			 equipment be made available, and that services be provided, by Amtrak, and
			 shall determine reasonable compensation, liability, and other terms for
			 use of the facilities and equipment and provision of the services.</text>
							</subsection><subsection id="H889327243A174FF0B908E9B1BC56EAC6"><enum>(e)</enum><header>Cessation of service</header><text>If a rail carrier or rail carriers awarded a route under this section cease to operate the service
			 or fail to fulfill their obligations under the contract required under
			 subsection (c), the Federal Railroad Administration, in collaboration with
			 the Surface Transportation Board, shall take any necessary action
			 consistent with this title to enforce the contract and ensure the
			 continued provision of service, including the installment of an interim
			 service provider and rebidding the contract to operate the service. The
			 entity providing service shall either be Amtrak or a rail carrier defined
			 in subsection (a)(1).</text>
							</subsection><subsection id="HB77882CF55894AD39512FAB47FA6D047"><enum>(f)</enum><header>Adequate resources</header><text display-inline="yes-display-inline">Before taking any action allowed under this section, the Secretary shall certify that the Federal
			 Railroad Administration has sufficient resources appropriated under
			 section 101(b) of <short-title>Passenger Rail Reform and Investment Act of 2014</short-title>, or any subsequent appropriation, for that purpose that are adequate to undertake the program
			 established under this section.</text>
							</subsection><subsection id="H4CBF57FF99074F54826F50DA306EEF01"><enum>(g)</enum><header>Budget authority</header><text>The Secretary of Transportation may provide to a winning bidder selected under this section
			 appropriations authorized under sections 101(b) of the <short-title>Passenger Rail Reform and Investment Act of 2014</short-title>, or any subsequent appropriation for the same purposes, necessary to cover the operating subsidy
			 described in subsection (a)(4)(B).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HA000E0FD9C964AB9B596EB6BBE83EE18"><enum>(b)</enum><header>Report</header><text>Not later than 1 year after the conclusion of the pilot program established under the amendment
			 made by subsection (a), the Federal Railroad Administration shall submit
			 to the Committee on Transportation and Infrastructure of the House of
			 Representatives and the Committee on Commerce, Science, and Transportation
			 of the Senate a report on the results on the pilot program established
			 under <external-xref legal-doc="usc" parsable-cite="usc/49/24711">section 24711</external-xref> of title 49 United States Code, and any
			 recommendations for further action.</text>
				</subsection></section><section id="H1D32E42D770446908DAF237C27F498DE"><enum>206.</enum><header>Food and beverage reform</header>
				<subsection id="H5D03D123BA994160AAEDAE44BC5036E9"><enum>(a)</enum><header>Amendment</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/243">Chapter 243</external-xref> of title 49, United States Code, is further amended by adding at the end the following
			 new section:</text>
					<quoted-block display-inline="no-display-inline" id="H38DBED2CB05E47FE81A3A883A7EBE912" style="USC">
						<section id="HCDE63193D8FF471888DE418B12357F7C"><enum>24321.</enum><header>Food and beverage reform</header>
							<subsection id="HA5BF5C0CA5A34F958490CC83DE519D00"><enum>(a)</enum><header>Plan</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of the <short-title>Passenger Rail Reform and Investment Act of 2014</short-title>, Amtrak shall develop and begin implementing a plan to eliminate, within 5 years of such date of
			 enactment, the operating loss associated with providing food and beverage
			 service on board Amtrak trains.</text>
							</subsection><subsection id="H76109085011448C2A5D936C9F72C933A"><enum>(b)</enum><header>Considerations</header><text>In developing and implementing the plan, Amtrak shall consider a combination of cost management and
			 revenue generation initiatives, including—</text>
								<paragraph id="H21291B9F79A344D9AA004A1B1C0660B2"><enum>(1)</enum><text>scheduling optimization;</text>
								</paragraph><paragraph id="HDE7E1B20742F4137886A213BD7B08806"><enum>(2)</enum><text>on-board logistics;</text>
								</paragraph><paragraph id="H03206A6271A8437CABF671F3338F2324"><enum>(3)</enum><text>product development and supply chain efficiency;</text>
								</paragraph><paragraph id="HC4AC82F8F5DB48AF8997C10A2E2A1C53"><enum>(4)</enum><text>training, awards, and accountability;</text>
								</paragraph><paragraph id="H1A7EB10025F444EA8A1A31FF6DAD8814"><enum>(5)</enum><text>technology enhancements and process improvements; and</text>
								</paragraph><paragraph id="H81B3DAA1D36148449CC00440BEA52195"><enum>(6)</enum><text>ticket revenue allocation.</text>
								</paragraph></subsection><subsection id="H0CD864371CFA4BE8A29B981037109664"><enum>(c)</enum><header>Savings clause</header><text>Amtrak shall ensure that no Amtrak employee holding a position as of the date of enactment of the <short-title>Passenger Rail Reform and Investment Act of 2014</short-title> is involuntarily separated because of—</text>
								<paragraph id="H210FB1B10AD74F3A85AEB190021512BC"><enum>(1)</enum><text>the development and implementation of the plan required under subsection (a); or</text>
								</paragraph><paragraph id="HC0D5AABE188D43198A936284DC946F11"><enum>(2)</enum><text>any other action taken by Amtrak to implement this section.</text>
								</paragraph></subsection><subsection id="H9AADDC04A62C4220AEFB8710E243E127"><enum>(d)</enum><header>No Federal funding for operating losses</header><text display-inline="yes-display-inline">Beginning on the date that is 5 years after the date of enactment of the <short-title>Passenger Rail Reform and Investment Act of 2014</short-title>, no Federal funds may be used to cover any operating loss associated with providing food and
			 beverage service on a route operated by Amtrak or an alternative passenger
			 rail service provider that operates a route in lieu of Amtrak pursuant to
			 section 24711.</text>
							</subsection><subsection id="H4E9FF602EE8249E1A90E74832434E88B"><enum>(e)</enum><header>Report</header><text>Not later than 120 days after the date of enactment of the <short-title>Passenger Rail Reform and Investment Act of 2014</short-title>, and annually thereafter for 5 years, Amtrak shall transmit to the Committee on Transportation and
			 Infrastructure of the House of Representatives and the Committee on
			 Commerce, Science, and Transportation of the Senate a report containing
			 the
			 plan developed pursuant to subsection (a) and a description of progress in
			 the implementation of the plan.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H81ED17A6EA4149E48B637B505352538A"><enum>(b)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/243">chapter 243</external-xref> of title 49, United States Code, is amended by adding at the
			 end the following new item:</text>
					<quoted-block display-inline="no-display-inline" id="HA9B5B64594CB479BAA16B75ADE32C1A7" style="USC">
						<toc regeneration="no-regeneration">
							<toc-entry level="section">24321. Food and beverage reform.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="H6C45D2BF8CF443328F1419095D262A0D"><enum>207.</enum><header>Right of way leveraging</header>
				<subsection id="H13852311F19046BBAC99030DB8DB50A1"><enum>(a)</enum><header>Request for proposals</header><text>Not later than 180 days after the date of enactment of this Act, Amtrak shall issue a Request for
			 Proposals seeking private sector persons or entities to utilize
			 Amtrak-owned right-of-way for telecommunications systems, energy
			 distribution systems, and other activities considered appropriate by
			 Amtrak. The Request for Proposals shall provide sufficient information on
			 Amtrak’s right-of-way real estate assets to enable respondents to propose
			 an arrangement that will monetize such assets through revenue sharing
			 agreements with Amtrak.</text>
				</subsection><subsection id="HD7B2690473274A73825ED74128D2FC69"><enum>(b)</enum><header>Consideration of proposals</header><text>Not later than 1 year after the date of enactment of this Act, the Amtrak Board of Directors shall
			 review and consider each proposal submitted pursuant to subsection (a).
			 Amtrak may enter into such agreements as are necessary to implement any
			 such proposal or proposals.</text>
				</subsection><subsection id="HD70570A175484EECB91AB49B0D45E260"><enum>(c)</enum><header>Report to Congress</header><text>Not later than 18 months after the date of enactment of this Act, Amtrak shall transmit to the
			 Committee on Transportation and Infrastructure of the House of
			 Representatives and the Committee on Commerce, Science, and Transportation
			 of the Senate a report on the Request for Proposals required by this
			 section, including summary information of any proposals submitted to
			 Amtrak and any proposals accepted by the Amtrak Board of Directors.</text>
				</subsection></section><section id="H61094A8A2F9D4989A42DCBBB12E7DCCA"><enum>208.</enum><header>Station development</header>
				<subsection id="H40B63F10324D40DDA0D42AD50EBFDBA9"><enum>(a)</enum><header>Report on development options</header><text>Not later than 1 year after the date of enactment of this Act, Amtrak shall transmit to the
			 Committee on Transportation and Infrastructure of the House of
			 Representatives and the Committee on Commerce, Science, and Transportation
			 of the Senate a report on options to enhance development around Amtrak
			 stations, including—</text>
					<paragraph id="HB68432C6C68E482D8EF37DB86A8A8505"><enum>(1)</enum><text>strengthening multimodal connections, including intercity buses;</text>
					</paragraph><paragraph id="H3E7C376C621241EA8B7B3EF209A0880C"><enum>(2)</enum><text>options for capturing development-related revenue streams; and</text>
					</paragraph><paragraph id="HB8F9018A7C1A41D890FCF50EC1C20C69"><enum>(3)</enum><text>other opportunities to better leverage station assets.</text>
					</paragraph></subsection><subsection commented="no" id="HE4070C5E17FC420A950FE9B51815278B"><enum>(b)</enum><header>Proposals</header>
					<paragraph commented="no" display-inline="no-display-inline" id="HE8CEC572F6AB45EBB874A1F736C6063D"><enum>(1)</enum><header>Request for proposals</header><text>Not later than 18 months after the date of enactment of this Act, Amtrak shall issue a Request for
			 Proposals seeking persons or entities, where appropriate, to carry out the
			 options identified under subsection (a).</text>
					</paragraph><paragraph commented="no" id="HCDF722511E804A3DAFE1C7F037C7DA15"><enum>(2)</enum><header>Consideration of proposals</header><text display-inline="yes-display-inline">Not later than 24 months after the date of enactment of this Act, the Amtrak Board of Directors
			 shall review and consider each proposal submitted pursuant to paragraph
			 (1). Amtrak may enter into such agreements as are necessary to implement
			 any such proposal or proposals.</text>
					</paragraph></subsection><subsection id="H3BDD22EFB17F46868414ED0A74D1D96E"><enum>(c)</enum><header>Report to Congress</header><text>Not later than 30 months after the date of enactment of this Act, Amtrak shall transmit to the
			 Committee on Transportation and Infrastructure of the House of
			 Representatives and the Committee on Commerce, Science, and Transportation
			 of the Senate a report on the Request for Proposals required by this
			 section, including summary information of any proposals submitted to
			 Amtrak and any proposals accepted by the Amtrak Board of Directors.</text>
				</subsection></section><section id="H2A458F790B3446659E7911A06F500A4C"><enum>209.</enum><header>Amtrak debt</header><text display-inline="no-display-inline">Section 205 of the Passenger Rail Investment and Improvement Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/49/24101">49 U.S.C. 24101</external-xref> note) is
			 amended—</text>
				<paragraph id="HD8F6D6B5155646DB9BB69AFE8EB6F747"><enum>(1)</enum><text>in subsection (a), by inserting <quote>, to the extent provided in advance in appropriations Acts</quote> after <quote>Amtrak’s indebtedness</quote>;</text>
				</paragraph><paragraph id="HD53B7D1C9F88410B892F1DBBA8F83674"><enum>(2)</enum><text>by striking <quote>as of the date of enactment of this Act</quote> each place it appears;</text>
				</paragraph><paragraph id="HB5460A8EE91342F1A3A2B9AC0FC472B9"><enum>(3)</enum><text>in subsection (a), by striking the second sentence;</text>
				</paragraph><paragraph id="H64E525370B934719819D4E105AAC9609"><enum>(4)</enum><text display-inline="yes-display-inline">in subsection (e)(1), by striking <quote>by section 102 of this division</quote>; and</text>
				</paragraph><paragraph id="H13CD10A9808648228985A23D5AFE4D50"><enum>(5)</enum><text>in subsection (e)(2), by striking <quote>by section 102</quote> and inserting <quote>for Amtrak</quote>.</text>
				</paragraph></section><section id="H700619D8F0E340449C9FE38F13307C48"><enum>210.</enum><header>Amtrak pilot program for passengers transporting domesticated cats and dogs</header>
				<subsection id="HEC17C4A315F14CAC8B1DC5A6614A8BED"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, Amtrak shall develop a pilot program
			 that allows passengers to transport domesticated cats or dogs on certain
			 trains operated by Amtrak.</text>
				</subsection><subsection id="H3D680172A8794A4A84759E4CC89878CA"><enum>(b)</enum><header>Pet policy</header><text>In developing the pilot program required under subsection (a), Amtrak shall—</text>
					<paragraph id="HAB4413A973E44D57B81829C5379655C7"><enum>(1)</enum><text>in the case of a passenger train that is comprised of more than 1 car, designate, where feasible,
			 at least 1 car in which a ticketed passenger may transport a domesticated
			 cat or dog in the same manner as carry-on baggage if—</text>
						<subparagraph id="H7ACE94C74681497D85D84EA365713D5F"><enum>(A)</enum><text>the cat or dog is contained in a pet kennel;</text>
						</subparagraph><subparagraph id="H697BEABC987044378CF99F3D707A4287"><enum>(B)</enum><text>the pet kennel is stowed in accordance with Amtrak size requirements for carriage of carry-on
			 baggage;</text>
						</subparagraph><subparagraph id="HD446EB8D5A174F72A0FF7A51213F40A8"><enum>(C)</enum><text>the passenger is traveling on a train operating on a route described in subparagraph (A), (B), or
			 (D) of <external-xref legal-doc="usc" parsable-cite="usc/49/24102">section 24102(5)</external-xref> of title 49, United States Code; and</text>
						</subparagraph><subparagraph id="H1FFAE1DE76574B13B0DE352DC7C6C110"><enum>(D)</enum><text>the passenger pays a fee described in paragraph (3);</text>
						</subparagraph></paragraph><paragraph id="H996D9CEF19864BF9881DD3DEBBA403BC"><enum>(2)</enum><text>allow a ticketed passenger to transport a domesticated cat or dog on a train in the same manner as
			 cargo if—</text>
						<subparagraph id="HCFBBCD0051E04B5CA3EAB639F926D55C"><enum>(A)</enum><text>the cat or dog is contained in a pet kennel;</text>
						</subparagraph><subparagraph id="H24C983B2B61F4DE6ADBC690949419F6A"><enum>(B)</enum><text>the pet kennel is stowed in accordance with Amtrak requirements for cargo stowage;</text>
						</subparagraph><subparagraph id="HAE7498AA41B24362B4D0D376DBAF74E5"><enum>(C)</enum><text display-inline="yes-display-inline">the passenger is traveling on a train operating on a route described in subparagraph (A), (B), or
			 (D) of <external-xref legal-doc="usc" parsable-cite="usc/49/24102">section 24102(5)</external-xref> of title 49, United States Code;</text>
						</subparagraph><subparagraph id="H6CC879AEEB5D4C9DBF444A54A3B52E63"><enum>(D)</enum><text>the cargo area is temperature controlled in a manner protective of cat and dog safety and health;
			 and</text>
						</subparagraph><subparagraph id="HD66321F72282485AAEE23C499ADB9845"><enum>(E)</enum><text>the passenger pays a fee described in paragraph (3); and</text>
						</subparagraph></paragraph><paragraph id="HBACE32EC892F4BC9941A180AB0B19D94"><enum>(3)</enum><text>collect fees for each cat or dog transported by a ticketed passenger in an amount that, in the
			 aggregate and at a minimum, covers the full costs of the pilot program.</text>
					</paragraph></subsection><subsection id="H5A0077FAD0BD4EE7A2AF5B6F6375A828"><enum>(c)</enum><header>Report</header><text>Not later than 1 year after the pilot program required under subsection (a) is first implemented,
			 Amtrak shall transmit to the Committee on Transportation and
			 Infrastructure of the House of Representatives and the Committee on
			 Commerce, Science, and Transportation of the Senate a report containing an
			 evaluation of the pilot program.</text>
				</subsection><subsection id="H41C5208334DC4017A24AE1B967240B72"><enum>(d)</enum><header>Limitation on statutory construction</header>
					<paragraph id="H349D46836301499B86FEB58829D9FF97"><enum>(1)</enum><header>Service animals</header><text>The pilot program required under subsection (a) shall be separate from and in addition to the
			 policy governing Amtrak passengers traveling with service animals. Nothing
			 in this section may be interpreted to limit or waive the rights of
			 passengers to transport service animals.</text>
					</paragraph><paragraph id="H1E5B90AA3AD24C608C89045CE5154C8E"><enum>(2)</enum><header>Additional train cars</header><text>Nothing in this section may be interpreted to require Amtrak to add additional train cars or modify
			 existing train cars.</text>
					</paragraph><paragraph id="H0484B9DB438E4847AB565A327B268758"><enum>(3)</enum><header>Federal funds</header><text>No Federal funds may be used to implement the pilot program required under this section.</text>
					</paragraph></subsection></section><section id="H61C5155BA8E24F679141A2748CE1750D"><enum>211.</enum><header>Amtrak boarding procedures</header>
				<subsection id="H6668838A782642F1AD716173670D9981"><enum>(a)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 6 months after the date of enactment of this Act, the Amtrak Office of Inspector
			 General shall transmit to the Committee on Transportation and
			 Infrastructure of the House of Representatives and the Committee on
			 Commerce, Science, and Transportation of the Senate a report that—</text>
					<paragraph id="HDACD8E8C82694DBE9F17BBC7C833D53A"><enum>(1)</enum><text>evaluates Amtrak’s boarding procedures at its 10 stations through which the most people pass;</text>
					</paragraph><paragraph id="H79CA255C019140B0A211F7A373274853"><enum>(2)</enum><text>compares Amtrak’s boarding procedures to—</text>
						<subparagraph id="H7659F359CAF8449E9382C188F223950C"><enum>(A)</enum><text>commuter railroad boarding procedures at stations shared with Amtrak;</text>
						</subparagraph><subparagraph id="H8C99B5EC469D4C45858A2772BC519E63"><enum>(B)</enum><text>international intercity passenger rail boarding procedures; and</text>
						</subparagraph><subparagraph id="H1AB95FAE572C4B24B207B72F3959CFB1"><enum>(C)</enum><text>fixed guideway transit boarding procedures; and</text>
						</subparagraph></paragraph><paragraph id="H8185A75E10AF49A986F5668F5DE4D68E"><enum>(3)</enum><text>makes recommendations, as appropriate, to improve Amtrak’s boarding procedures, including
			 recommendations regarding the queuing of passengers and free-flow of all
			 station-users.</text>
					</paragraph></subsection><subsection id="HC8EF9090463745BB8BFF8C4650DE80BB"><enum>(b)</enum><header>Consideration of recommendations</header><text>Not later than 6 months after the release of the report required under subsection (a), the Amtrak
			 Board of Directors shall consider each recommendation provided under
			 subsection (a)(3) for implementation across the Amtrak system.</text>
				</subsection></section></title><title id="HABD7C7713E664C5FA9828F262D86E1BA"><enum>III</enum><header>Intercity Passenger Rail Policy</header>
			<section id="H738099F9C6604A649BA9B7EB7827DECC"><enum>301.</enum><header>Federal-State partnership for Northeast Corridor development and improvement</header>
				<subsection id="HE116EB5C7390464F92A3E792ACF2170D"><enum>(a)</enum><header>Amendment</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/244">Chapter 244</external-xref> of title 49, United States Code, is amended by adding at the end the following new
			 section:</text>
					<quoted-block id="H4D48B3B200A548F0ABB4D90D2C5F9E5E" style="USC">
						<section id="HCB16D557A3004FD987ABA9E1352E7B62"><enum>24407.</enum><header>Federal-State partnership for Northeast Corridor rehabilitation and improvement</header>
							<subsection id="HD78AD0F0A7C54F70A8B69220D6F51F0F"><enum>(a)</enum><header>In general</header><text>The Secretary of Transportation shall develop and implement a program for issuing grants to
			 applicants, on a competitive basis, for the purpose of financing the
			 capital projects included in the Northeast Corridor Priority Project List
			 developed under subsection (c).</text>
							</subsection><subsection id="H461883F054754785B026E3DB3E12D50C"><enum>(b)</enum><header>Definitions</header><text>In this section, the following definitions apply:</text>
								<paragraph id="HC37A81DF0CBA42C88EDD5CB13C7FBA10"><enum>(1)</enum><header>Applicant</header><text display-inline="yes-display-inline">The term <quote>applicant</quote> means a State (including the District of Columbia), a group of States, an Interstate Compact, or a
			 public agency established by one or more States and having responsibility
			 for providing intercity passenger or commuter rail service.</text>
								</paragraph><paragraph id="HB7EB3011CA0444F793D7BE11C92E3C17"><enum>(2)</enum><header>Major state-of-good-repair project</header><text display-inline="yes-display-inline">The term <quote>major state-of-good-repair project</quote> means a capital project primarily intended to replace, rehabilitate or repair major Northeast
			 Corridor infrastructure assets utilized for providing intercity rail
			 passenger transportation, including tunnels, bridges, stations, and other
			 assets as determined by the Secretary.</text>
								</paragraph><paragraph id="H546D47B611D84DCBBE846B082A57EFE8"><enum>(3)</enum><header>Improvement project</header><text display-inline="yes-display-inline">The term <quote>improvement project</quote> means a capital project primarily intended to improve intercity passenger rail performance on the
			 Northeast Corridor, including reduced trip times, increased train
			 frequencies, higher operating speeds, and other improvements as determined
			 by the Secretary.</text>
								</paragraph></subsection><subsection id="HEDDABE7B0400437D9D4D0B5DB2C616FD"><enum>(c)</enum><header>Northeast Corridor priority project list</header><text>The Northeast Corridor Infrastructure and Operations Advisory Commission, established under section
			 24905, shall develop and approve a Northeast Corridor Priority Project
			 List that shall include—</text>
								<paragraph id="H0762E913D2B44BB6A18FA03F89D1EA1B"><enum>(1)</enum><text>a list of prioritized individual major state-of-good-repair projects and improvement projects along
			 the Northeast Corridor that—</text>
									<subparagraph id="HBFA84A3B047A4FB599704ADB496FD3EC"><enum>(A)</enum><text>can be completed based on—</text>
										<clause id="H0B38B082BCDF4DFBAFA345E2EB282612"><enum>(i)</enum><text>the funding authorized under section 103(b) of the <short-title>Passenger Rail Reform and Investment Act of 2014</short-title>;</text>
										</clause><clause commented="no" id="H2CAB924E11C249D3B2617EA39AB0B6C8"><enum>(ii)</enum><text>any subsequent applicable authorization in effect;</text>
										</clause><clause id="HA1116504D978424485399B9D6FA1C90C"><enum>(iii)</enum><text>in the absence of such an authorization, a 5-year funding amount based on the most recent
			 appropriation; or</text>
										</clause><clause commented="no" id="H95CAB4FB0B5A4902955BA73C3A265474"><enum>(iv)</enum><text>the requirements of subsection (d); and</text>
										</clause></subparagraph><subparagraph id="HCEBDA32B6D014C5FAFA6372B86B2A94F"><enum>(B)</enum><text>are consistent with the Northeast Corridor capital investment plan required under section 24906(a);</text>
									</subparagraph></paragraph><paragraph id="H0C104B122707415AA2C6D20AE3ABDC63"><enum>(2)</enum><text>an identification of the applicant for each individual project;</text>
								</paragraph><paragraph id="H51A596BBE82C4C3F8BD757B813A6E01C"><enum>(3)</enum><text>an identification of the sources of non-Federal matching funds for each project; and</text>
								</paragraph><paragraph id="H37ECBB65C11D43408A4A2FFF0749AB91"><enum>(4)</enum><text>a description of the benefits each project will bring to intercity rail passenger services.</text>
								</paragraph></subsection><subsection id="H397804E326314BC9AA6A17E57B59B0AD"><enum>(d)</enum><header>Use of funds</header><text>The Federal grants authorized under this section shall be for no more than 50 percent of the net
			 project cost of the project involved.</text>
							</subsection><subsection id="HDD646CC50230408B99FA04AF1629E461"><enum>(e)</enum><header>Applicability of capital grant requirements</header><text>Except as specifically provided in this section, the use of any amounts appropriated for grants
			 under this section shall be subject to the requirements of this chapter.</text>
							</subsection><subsection id="H2B91F864992D4EF9BA64433930D831AE"><enum>(f)</enum><header>Match requirements</header><text display-inline="yes-display-inline">No grants may be obligated to an applicant under this section unless the applicant has transmitted
			 to the Secretary of Transportation a binding written commitment to provide
			 all amounts necessary for the purpose of matching Federal contributions as
			 required by this section.</text>
							</subsection><subsection id="HC4CFE353A0CC44B4BB7B077698E4992E"><enum>(g)</enum><header>Updates to list</header><text>The Northeast Corridor Infrastructure and Operations Advisory Commission shall revise the NEC
			 Priority Project List as necessary to reflect—</text>
								<paragraph id="HA1CFF31F1E204A429E12D2C69821153B"><enum>(1)</enum><text>any differences in the availability of Federal funding from the levels assumed for purposes of
			 subsection (c)(1)(A) (i) and (ii);</text>
								</paragraph><paragraph id="HDD1FB7DF3F81448FAC81618023C206D5"><enum>(2)</enum><text>any elimination or addition of projects; and</text>
								</paragraph><paragraph id="HDFBB5E6279014F079FBB8B23389C47BC"><enum>(3)</enum><text>any reduction or increase in benefits to be derived from a project.</text>
								</paragraph></subsection><subsection id="HABA14ED20BA547C79935BB3368EDB978"><enum>(h)</enum><header>Availability</header><text>Amounts appropriated for carrying out this section shall remain available until expended.</text>
							</subsection><subsection id="HBD4844612943492E90036848F28A67B7"><enum>(i)</enum><header>Savings Clause</header><text>Nothing in this section shall supplant the requirement of applicants to compensate Amtrak for the
			 use of Amtrak facilities or services pursuant to section 24905(c).</text>
							</subsection><subsection id="H41D7B536F26248989953F4A54D771180"><enum>(j)</enum><header>Definition</header><text display-inline="yes-display-inline">For purposes of this section, the term <quote>Northeast Corridor</quote> means the Northeast Corridor main line between Boston, Massachusetts, and the District of
			 Columbia, and the Northeast Corridor branch lines connecting to
			 Harrisburg, Pennsylvania, Springfield, Massachusetts, and Spuyten Duyvil,
			 New York, and facilities and services used to operate and maintain those
			 lines.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H2EE3FAF417C042F4A218318ABBA32F09"><enum>(b)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/244">chapter 244</external-xref> of title 49, United States Code, is amended by adding at the
			 end the following new item:</text>

				</subsection></section><section id="H69C93649A47B4FF5A92743ADC3387250"><enum>302.</enum><header>RRIF improvements</header>
				<subsection id="H9D395DEE82534495B5A763540E12EC06"><enum>(a)</enum><header>Regulations</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary of Transportation
			 shall issue regulations implementing the amendments made by this section.</text>
				</subsection><subsection id="H739223564EA244F680F97E11B33C6102"><enum>(b)</enum><header>Collateral</header><text display-inline="yes-display-inline">Section 502(h)(2) of the Railroad Revitalization and Regulatory Reform Act of 1976 (45 U.S.C.
			 822(h)(2)) is amended—</text>
					<paragraph id="HA130F4BD8D9A4FFBAC4970B9BA40E19A"><enum>(1)</enum><text>by striking <quote>(2) The Secretary</quote> and inserting <quote>(2)(A) The Secretary</quote>;</text>
					</paragraph><paragraph id="HB3235AE722344A078DCE346548D61A0D"><enum>(2)</enum><text>by inserting <quote>The Secretary may subordinate rights of the Secretary under any provision of title 49 or title 23
			 of the United States Code, to the rights of the Secretary under this
			 section and section 503.</quote> after <quote>from another source.</quote>; and</text>
					</paragraph><paragraph id="H8298FFC67F5B403D80EE504B99A63986"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text>
						<quoted-block id="H797E7292953441C8A035B5423DF4354A" style="OLC">
							<subparagraph id="H799CFE305B9248508410E0C80E202219" indent="up2"><enum>(B)</enum><text>The Secretary shall, for purposes of making a finding under subsection (g)(4), accept the net
			 present value on a future stream of State or local subsidy income or
			 dedicated revenue as collateral offered to secure the loan.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="HE1F458305A694CA7965D31D32F47E467"><enum>(c)</enum><header>Office of Management and Budget review</header><text>Section 502(i) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/45/822">45 U.S.C. 822(i)</external-xref>) is amended by inserting <quote>In order to enable compliance with such time limit, the Office of Management and Budget shall take
			 any actions required with respect to the application within such 90-day
			 period.</quote> after <quote>disapprove the application.</quote>.</text>
				</subsection><subsection id="H1B398D07BAFC4F679A2401838AE35F00"><enum>(d)</enum><header>RRIF application</header><text>Section 502(i) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/45/822">45 U.S.C. 822(i)</external-xref>) is further amended—</text>
					<paragraph id="H30BEF999054A46E399246E9702E6B00E"><enum>(1)</enum><text>by striking <quote><header-in-text level="subsection" style="OLC">Disapproval</header-in-text>.—Not later than 90 days after receiving</quote> and inserting</text>
						<quoted-block display-inline="yes-display-inline" id="H10EF21A853134931AF272B976C3EB517" style="OLC"><text><header-in-text level="subsection" style="OLC">Disapproval.—</header-in-text></text><paragraph id="HF33A9393BBBA41CEAADF3BD31D5BB668"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after an application is determined pursuant to paragraph (2) to be</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
					</paragraph><paragraph id="HEFE11FB149BD4036AE82F0F28CB11815"><enum>(2)</enum><text>by adding at the end the following new paragraphs:</text>
						<quoted-block id="H3C55A419DAE84BAD94A7A573E84EEF64" style="OLC">
							<paragraph id="HE291183B2C284E4A94F1C84155CD97F6"><enum>(2)</enum><header>Completion of application</header><text>The Secretary shall establish procedures for making a determination, not later than 45 days after
			 submission of an application under this section, whether the application
			 is complete. Such procedures shall—</text>
								<subparagraph id="HD744FE93372D4BD3AC705BBBC0308D7D"><enum>(A)</enum><text>provide for a checklist of the required components of a complete application;</text>
								</subparagraph><subparagraph id="H4279444155414E11A061ACF11002924C"><enum>(B)</enum><text>require the Secretary to provide to the applicant a description of the specific components of the
			 application that remain incomplete if an application is determined to be
			 incomplete; and</text>
								</subparagraph><subparagraph id="HEE4D35754EF846C48D04F7D8D0E967BC"><enum>(C)</enum><text>permit reapplication without prejudice for applications determined to be incomplete.</text>
								</subparagraph></paragraph><paragraph id="HE9A3AB74AF3A4FFC8DFC3B2DCE88D64F"><enum>(3)</enum><header>Independent Financial Analyst</header><text>The Secretary shall assign an independent financial analyst within 45 days of submittal of a
			 complete application.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="H0C4E4DA1D77A483FB269A9C5AB8A53F1"><enum>(e)</enum><header>Positive train control</header><text>Section 502(c)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/45/822">45 U.S.C. 822(c)(1)</external-xref>) is amended by inserting <quote>, including projects for the installation of a positive train control (as defined in section
			 20157(i) of title 49, United States Code) system</quote> after <quote>public safety</quote>.</text>
				</subsection><subsection id="H0249F7CBD61C4FFD9310AF9071ED38DA"><enum>(f)</enum><header>Report to congress</header><text>Section 502 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/45/822">45 U.S.C. 822</external-xref>) is further amended by adding at the end the following new
			 subsection:</text>
					<quoted-block id="HEEC9361B83164CF3986C20D2A54AA05E" style="OLC">
						<subsection id="H6426282E26184AF39F02724FA6A5DE00"><enum>(k)</enum><header>Report to Congress</header><text>Not later than 1 year after the date of enactment of the <short-title>Passenger Rail Reform and Investment Act of 2014</short-title>, and annually thereafter, the Secretary shall transmit to Congress a report on the program under
			 this section that provides information on loans approved and disapproved
			 by the Secretary during the previous year. Such report shall not disclose
			 the identity of direct loan or loan guarantee recipients. The report shall
			 describe—</text>
							<paragraph id="H832CAD43389E43E6968DA9725F954553"><enum>(1)</enum><text>the number of pre-application meetings with potential applicants;</text>
							</paragraph><paragraph id="HEAD1CFF71E3F40679FBBA323B54A3636"><enum>(2)</enum><text>the number of applications received and determined complete under subsection (i)(2), including the
			 requested loan amounts;</text>
							</paragraph><paragraph id="H80902AA060C94E069C9094198C8EEF63"><enum>(3)</enum><text>the dates of receipt of applications;</text>
							</paragraph><paragraph id="HEEE5942FE05A46F186246EA52745EBD4"><enum>(4)</enum><text>the dates applications were determined complete under subsection (i)(2);</text>
							</paragraph><paragraph id="H6D802BD5864D4B97A2946267C1CABD27"><enum>(5)</enum><text>the number of applications determined incomplete under subsection (i)(2);</text>
							</paragraph><paragraph id="H656249A5B25948B885612A37E987CC67"><enum>(6)</enum><text>the final decision dates for both approvals and disapprovals of applications;</text>
							</paragraph><paragraph id="HFA9A67F37C154024BBFC71EFB8B44F4B"><enum>(7)</enum><text>the number of applications withdrawn from consideration; and</text>
							</paragraph><paragraph id="HDBDB3646D0CA4AD1A4889C29C0BC6983"><enum>(8)</enum><text>the annual loan portfolio asset quality.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="HBCB33B0CDC514AE19DB99E497CF28B71"><enum>303.</enum><header>NEC fast forward</header>
				<subsection id="H5C4CD0247F4D4EB7A7E2DBFD2A74108B"><enum>(a)</enum><header>Northeast corridor authority</header><text>Section 502(d) of the Railroad Revitalization and Regulatory Reform Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/45/822">45 U.S.C. 822(d)</external-xref>)
			 is amended by inserting <quote>40 percent shall be available solely for projects described in subsection (l)(1), and</quote> after <quote>Of this amount,</quote>.</text>
				</subsection><subsection id="H634D26BACBD340C6B213B9C7EE359F1C"><enum>(b)</enum><header>Northeast corridor fast forward program</header><text>Section 502 of such Act is further amended by adding at the end the following new subsection:</text>
					<quoted-block id="HB67D5245F0974DA18A7F5B8FCD8CB3D1" style="OLC">
						<subsection id="H3EFE9795551F4C568F65DD892F0FBB65"><enum>(l)</enum><header>Northeast corridor fast forward</header>
							<paragraph id="H71E75D7210474896836F7D8867EB10A9"><enum>(1)</enum><header>Purpose</header><text>The Secretary, as part of the Railroad Rehabilitation and Improvement Financing program, shall
			 provide direct loans and loan guarantees to eligible entities described in
			 subsection (a) for capital projects to improve the Northeast Corridor (as
			 used in <external-xref legal-doc="usc" parsable-cite="usc/49/24906">section 24906</external-xref> of title 49, United States Code).</text>
							</paragraph><paragraph commented="no" id="HD163C1BE0D1741308441F929F05EC083"><enum>(2)</enum><header>Collateral</header><text>Loans made or guaranteed under this subsection shall require collateral equal to the loan amount
			 requested.</text>
							</paragraph><paragraph id="H040A2CC3499041EDA12EBA703272FC16"><enum>(3)</enum><header>Investment grade rating</header><text>A direct loan or loan guarantee shall be made under this subsection only if a rating agency has
			 assigned an investment grade rating of BBB minus, Baa3, bbb minus, BBB
			 (low), (or equivalent) or higher to the project obligation. For purposes
			 of this paragraph, the term <quote>rating agency</quote> means a credit rating agency registered with the Securities and Exchange Commission as a
			 nationally recognized statistical rating organization (as that term is
			 defined in section 3(a) of the Securities Exchange Act of 1934 (15 U.S.C.
			 78c(a))).</text>
							</paragraph><paragraph id="H32F52246C5544D39ADFACE7449DD7B7D"><enum>(4)</enum><header>Inclusion in NEC planning</header><text>Loans and loan guarantees made under this subsection shall be for projects that are included in the
			 most recent 5-year budget and business plan prepared pursuant to section
			 24906(a) of title 49, United States Code.</text>
							</paragraph><paragraph id="H47D1EB75801F471786F0457AF8206CA7"><enum>(5)</enum><header>Refinancing</header><text>Loans made or guaranteed under this subsection shall not be used for the refinancing of outstanding
			 debt incurred.</text>
							</paragraph><paragraph id="H1EE01576AF0F40A18DA971436F812EDA"><enum>(6)</enum><header>Cohort of loans</header><text>Subsection (f)(4) shall not apply to loans made or guaranteed under this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H6327AFC9C24E4E189B0798F8B8BA6F8F"><enum>(c)</enum><header>Report on leveraging RRIF</header><text>Not later than 180 days after the date of enactment of this Act, the Comptroller General shall
			 transmit to the Committee on Transportation and Infrastructure of the
			 House of Representatives and the Committee on Commerce, Science, and
			 Transportation of the Senate a report identifying potential revenue
			 sources, projects, and service improvements that could be achieved by the
			 amendments made by subsections (a) and (b).</text>
				</subsection><subsection id="H5B73033253284C6CB17E16508FFC28AD"><enum>(d)</enum><header>Conditions of funding</header>
					<paragraph display-inline="no-display-inline" id="H4E991B74D21843A89471AFB02DAB3C7E"><enum>(1)</enum><header>Grants</header><text><external-xref legal-doc="usc" parsable-cite="usc/49/24405">Section 24405</external-xref> of title 49, United States Code, is amended—</text>
						<subparagraph id="H9DEE794719A643FBAF5515510F67C74F"><enum>(A)</enum><text>by striking <quote>15 days</quote> and inserting <quote>30 days</quote> in subsection (a)(4)(B); and</text>
						</subparagraph><subparagraph id="H52C154D9549D4330B8433C4BADAD5DAE"><enum>(B)</enum><text>by adding at the end the following:</text>
							<quoted-block id="H0142242413F04C63B8D964A437A9852F" style="OLC">
								<paragraph id="H62C24FAB637346EEA8BB9F40B71C562C" indent="up1"><enum>(12)</enum><text>Not later than 1 year after the date of enactment of the <short-title>Passenger Rail Reform and Investment Act of 2014</short-title>, and annually thereafter, the Secretary shall transmit to the Committee on Commerce, Science, and
			 Transportation of the Senate and the Committee on Transportation and
			 Infrastructure of the House of Representatives a report listing any waiver
			 issued under this section during the preceding year.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph id="H4C67B807F3A7425EB1C86B45EABD2165"><enum>(2)</enum><header>RRIF</header><text>Section 502(h)(3) of the Railroad Revitalization and Regulatory Reform Act of 1976 (45 U.S.C.
			 822(h)(3)) is amended—</text>
						<subparagraph id="HA3C0912907F140758C3B8BCC7A5BF641"><enum>(A)</enum><text>by striking <quote>and</quote> at the end of subparagraph (A);</text>
						</subparagraph><subparagraph id="H3FBFE59BDCBE4D188BD595C362B18FC6"><enum>(B)</enum><text>by striking the period at the end of subparagraph (B) and inserting <quote>; and</quote>; and</text>
						</subparagraph><subparagraph id="H0CEE96C266244C56934C6C07142E8EB9"><enum>(C)</enum><text>by adding at the end the following:</text>

								<subparagraph id="HB78C8BD1221346C1BAA049F5D6CD906A" indent="up1"><enum>(C)</enum><text>the requirements of <external-xref legal-doc="usc" parsable-cite="usc/49/24405">section 24405(a)</external-xref> of title 49, United States Code.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph></subsection></section><section id="H2E560E553256400C85AD12A10B94A476"><enum>304.</enum><header>Large capital project requirements</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/24402">Section 24402</external-xref> of title 49, United States Code, is amended by adding at the end the following
			 subsection:</text>
				<quoted-block id="HE317921B271E403DA7DAFED628CDD8B6" style="OLC">
					<subsection id="H0DECDA6C060D4F57885DEB6358E63FC5"><enum>(m)</enum><header>Large capital project requirements</header>
						<paragraph id="H0DE52C05CF3A444CB4FBE55B884BDA5C"><enum>(1)</enum><header>In general</header><text>For a grant awarded under this chapter for an amount in excess of $1,000,000,000, the following
			 conditions shall apply:</text>
							<subparagraph id="H85FCB0D34126426F84055692952EF84B"><enum>(A)</enum><text display-inline="yes-display-inline">The Secretary of Transportation shall not obligate any funding unless the applicant demonstrates to
			 the satisfaction of the Secretary that it has committed and will be able
			 to fulfill the non-Federal share required for the grant within the
			 applicant’s proposed project completion timetable.</text>
							</subparagraph><subparagraph id="H1296284D7C22405DA54C57999952FD7A"><enum>(B)</enum><text display-inline="yes-display-inline">The Secretary shall not obligate any funding for work activities that occur after the completion of
			 final design unless—</text>
								<clause id="HE7CE85F8BDD849D186C7BF042C924F0D"><enum>(i)</enum><text>the applicant transmits to the Secretary a financial plan that generally identifies the sources of
			 the non-Federal funding required for any subsequent segments or phases of
			 the corridor service development program covering the project for which
			 the grant is made;</text>
								</clause><clause id="H1BC06A545A5E4382A7A0CA82CEE7BDF1"><enum>(ii)</enum><text>the grant will result in a useable segment, a transportation facility, or equipment, that has
			 operational independence; and</text>
								</clause><clause id="H63E4C9A2ADAE401ABD101A561BD657F2"><enum>(iii)</enum><text>the intercity passenger rail benefits anticipated to result from the grant, such as increased
			 speed, improved on-time performance, reduced trip time, increased
			 frequencies, new service, safety improvements, improved accessibility, or
			 other significant enhancements are detailed by the grantee and approved by
			 the Secretary.</text>
								</clause></subparagraph><subparagraph id="HEE037C82B9264B6B8A4CDC8EA8310586"><enum>(C)</enum><text display-inline="yes-display-inline">The Secretary shall ensure that the project is maintained to the level of utility that is necessary
			 to support the benefits approved under subparagraph (B)(iii) for a period
			 of 20 years from the date the useable segment, transportation facility, or
			 equipment described in subparagraph (B)(ii) is placed in service. If the
			 project property is not maintained as required by this subparagraph for a
			 period of time in excess of 12 months, then a pro-rata share of the
			 Federal contribution, based upon the percentage remaining of the 20-year
			 period that commenced when the project property was placed in service,
			 shall be refunded.</text>
							</subparagraph></paragraph><paragraph commented="no" id="HB7BB6ADDFC1E4027BB3F668B78D29490"><enum>(2)</enum><header>Early work</header><text>The Secretary may allow a grantee subject to this subsection to engage in at-risk work activities
			 subsequent to the conclusion of final design where the Secretary
			 determines that such work activities are reasonable and necessary.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H4C68B245E0BD470195C222DF648FE01E"><enum>305.</enum><header>Small business participation study</header>
				<subsection id="HB974B6315DD7400C9181FA1DE66A795D"><enum>(a)</enum><header>Study</header><text>The Secretary of Transportation shall conduct a nationwide disparity and availability study on the
			 availability and use of small business concerns owned and controlled by
			 socially and economically disadvantaged individuals in publically funded
			 intercity rail passenger transportation (as defined in section 24102 of
			 title 49, United States Code) projects administered by the Federal
			 Railroad Administration.</text>
				</subsection><subsection id="H3C797032698C44B5A427D920CE2317C2"><enum>(b)</enum><header>Report</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary shall transmit to the
			 Committee on Transportation and Infrastructure of the House of
			 Representatives and the Committee on Commerce, Science, and Transportation
			 of the Senate a report containing the results of the study conducted under
			 subsection (a).</text>
				</subsection><subsection id="HE689E3A5F51A4B4A8D4BE6AAB0904DB5"><enum>(c)</enum><header>Definitions</header><text>In this section:</text>
					<paragraph id="H52FCB645082D46089DD490DB8E93F722"><enum>(1)</enum><header>Small business concern</header>
						<subparagraph id="H1D6009E14D354FACB7594B4476241434"><enum>(A)</enum><header>In general</header><text>The term <quote>small business concern</quote> means a small business concern as the term is used in section 3 of the Small Business Act (15
			 U.S.C. 632).</text>
						</subparagraph><subparagraph id="H20C11DBDF5CE4DD7A67B97DE31784E98"><enum>(B)</enum><header>Exclusions</header><text>The term <quote>small business concern</quote> does not include any concern or group of concerns controlled by the same socially and economically
			 disadvantaged individual or individuals that have average annual gross
			 receipts during the preceding 3 fiscal years in excess of $22,410,000, as
			 adjusted annually by the Secretary for inflation.</text>
						</subparagraph></paragraph><paragraph id="HA9E4AD9D609E4FBD9EA0160C8BB9390D"><enum>(2)</enum><header>Socially and economically disadvantaged individual</header><text>The term <quote>socially and economically disadvantaged individual</quote> has the meaning given the term in section 8(d) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/637">15 U.S.C. 637(d)</external-xref>) and
			 relevant subcontracting regulations issued pursuant to that Act, except
			 that women shall be presumed to be socially and economically disadvantaged
			 individuals for purposes of this section.</text>
					</paragraph></subsection><subsection id="H319DD7CA4642416CB8392CB26531E03A"><enum>(d)</enum><header>Funding</header><text>Of the total amount made available to the Office of the Secretary of the Department of
			 Transportation and the Federal Railroad Administration, for each of fiscal
			 years 2015 and 2016, $3,000,000 shall be used to implement the
			 requirements of this section.</text>
				</subsection></section><section id="H19042717834347B084EC60F35F89D76F"><enum>306.</enum><header>Gulf Coast rail service working group</header>
				<subsection id="HB8BE4C1482AE42FF996B0421CFC7B97D"><enum>(a)</enum><header>In general</header><text>Not later than 90 days after the date of enactment of this Act, the Federal Railroad Administration
			 shall convene a working group to evaluate the restoration of intercity
			 rail passenger service in the Gulf Coast region between New Orleans,
			 Louisiana, and Orlando, Florida.</text>
				</subsection><subsection id="HE95B96B37EB04AF88631638E78F786E7"><enum>(b)</enum><header>Membership</header><text>The working group shall consist of representatives of—</text>
					<paragraph id="H8CF36613A8FF46AC8CC2D34C1DB0DFDA"><enum>(1)</enum><text>Amtrak;</text>
					</paragraph><paragraph id="HF045755B59064DD2B6ACBC73FA5FC591"><enum>(2)</enum><text>the States along the proposed route or routes;</text>
					</paragraph><paragraph id="H138BDA3B65A54C97BB03A74A331F2FE2"><enum>(3)</enum><text>regional transportation planning organizations and metropolitan planning organizations,
			 municipalities, and communities along the proposed route or routes,
			 selected by the Administrator of the Federal Railroad Administration;</text>
					</paragraph><paragraph id="H55FBC01B7DC843D9BB17E322C34D9E9E"><enum>(4)</enum><text>the Southern Rail Commission;</text>
					</paragraph><paragraph id="HB088AA5F3E7844D6A24C8E1AD6E43CAB"><enum>(5)</enum><text>freight railroad carriers whose tracks may be used for such service; and</text>
					</paragraph><paragraph id="H6FC1EECA1E1247F0B64FB8C6A83B4C68"><enum>(6)</enum><text>other entities determined appropriate by the Administrator.</text>
					</paragraph></subsection><subsection id="H599D9AC7B7B94BDE88BE8CDA0CB2FA9E"><enum>(c)</enum><header>Responsibilities</header><text>The working group shall—</text>
					<paragraph id="H534360B4CD2A4E49928301FC66937AF1"><enum>(1)</enum><text>evaluate all options for restoring intercity rail passenger service in the Gulf Coast region,
			 including options outlined in the report transmitted to Congress pursuant
			 to section 226 of the Passenger Rail Investment and Improvement Act of
			 2008 (<external-xref legal-doc="public-law" parsable-cite="pl/110/432">Public Law 110–432</external-xref>);</text>
					</paragraph><paragraph id="HDB4D225FF09F42D7B23167A870F3506D"><enum>(2)</enum><text>select a preferred option for restoring such service;</text>
					</paragraph><paragraph id="H84360768E4144ACB8486DD68F2C505E2"><enum>(3)</enum><text>develop a prioritized inventory of capital projects and other actions required to restore such
			 service and cost estimates for such projects or actions; and</text>
					</paragraph><paragraph id="H2F03425993454B86996703DE5E4305C5"><enum>(4)</enum><text>identify Federal and non-Federal funding sources required to restore such service, including
			 options for entering into public-private partnerships to restore such
			 service.</text>
					</paragraph></subsection><subsection id="HE7BBEBCF378642D5ACB10C4503572EC0"><enum>(d)</enum><header>Report</header><text>Not later than 9 months after the date of enactment of this Act, the working group shall transmit
			 to the Committee on Transportation and Infrastructure in the House of
			 Representatives and the Committee on Commerce, Science, and Transportation
			 in the Senate a report that includes—</text>
					<paragraph id="H08E234959D08494AAA2D20D4B0E88523"><enum>(1)</enum><text>the preferred option selected under subsection (c)(2) and the reasons for selecting such option;</text>
					</paragraph><paragraph id="HD4288379584A4F5D9EF499D327288C12"><enum>(2)</enum><text>the information described in subsection (c)(3);</text>
					</paragraph><paragraph id="H202B7DDB7B734909A879C414393E467D"><enum>(3)</enum><text display-inline="yes-display-inline">the funding sources identified under subsection (c)(4);</text>
					</paragraph><paragraph id="HA5CC0255252E41998FED736AFC654BDD"><enum>(4)</enum><text>the costs and benefits of restoring intercity rail passenger transportation in the region; and</text>
					</paragraph><paragraph id="HC43B434B0F6040BAB045BA18BD90AB8F"><enum>(5)</enum><text>any other information the working group determines appropriate.</text>
					</paragraph></subsection></section><section id="HF5C4E8C9A7EE4B38B9A9CB02C61E9B41"><enum>307.</enum><header>Miscellaneous</header>

					</paragraph></subsection></section></title><title id="H9DF482E6D1E447B98A76C4B6241DCA16"><enum>IV</enum><header>Project Delivery</header>
			<section id="H7EB45AA5A7594C19A55FB256B59A3CBF"><enum>401.</enum><header>Project delivery rulemaking</header>
				<subsection commented="no" id="HCB71516168D64A97AA1B357B96C2F801"><enum>(a)</enum><header>Rulemaking</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall begin a
			 rulemaking to govern the Federal review, permitting, and approval or
			 disapproval of—</text>
					<paragraph commented="no" id="H6352660985F746D3BF51BD69ACF0A403"><enum>(1)</enum><text>freight railroad and intercity rail passenger transportation infrastructure projects, including
			 those that are carried out or planned to be carried out with the use of
			 Federal funds administered by the Department of Transportation through a
			 grant, contract, loan, or other financing instrument; and</text>
					</paragraph><paragraph commented="no" id="H9188CC1A30C144D796A6EDDA0940362F"><enum>(2)</enum><text>commuter rail passenger transportation (as defined in <external-xref legal-doc="usc" parsable-cite="usc/49/24102">section 24102(3)</external-xref> of title 49, United States
			 Code) infrastructure projects that are funded in whole or in part through
			 a direct loan or loan guarantee under title V of the Railroad
			 Revitalization and Regulatory Reform Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/45/801">45 U.S.C. 801 et seq.</external-xref>).</text>
					</paragraph></subsection><subsection id="H6971391143E444E6B0F60D482FAF95F3"><enum>(b)</enum><header>Deadline</header><text>The Secretary shall complete the rulemaking required under subsection (a) not later than 2 years
			 after the date of enactment of this Act.</text>
				</subsection><subsection id="HC67F550FA02640EDB97D8E34D645773A"><enum>(c)</enum><header>Requirements and Considerations</header><text>The rulemaking under subsection (a) shall include procedures that—</text>
					<paragraph id="HFCD00C91A9944E31BB73B49280C18A32"><enum>(1)</enum><text>reduce the aggregate time for review and permitting of infrastructure projects described under
			 subsection (a) while preserving existing statutory requirements for public
			 comment or assessing the impact of a proposed project;</text>
					</paragraph><paragraph id="H734FD72F21624410A1809CF28A03A94E"><enum>(2)</enum><text>institutionalize or expand best practices or process improvements that agencies are already
			 implementing to improve the efficiency of reviews;</text>
					</paragraph><paragraph id="H324D953526EB457FB25E82BF0CE24EC9"><enum>(3)</enum><text>identify high-performance attributes of infrastructure projects described under subsection (a) that
			 demonstrate how projects seek to advance existing statutory and policy
			 objectives, thereby facilitating a more efficient review and permitting
			 process;</text>
					</paragraph><paragraph id="HC3BEE9A3A2C14812AF4A4AAF1B0C0DF4"><enum>(4)</enum><text>create a process to invite Federal agencies and State, local, and tribal governments to participate
			 in the review process, expand coordination with such agencies and
			 governments, and require the identification as early as practicable in the
			 process of any—</text>
						<subparagraph id="H0B479A231B7E448C8595851A1747C0F5"><enum>(A)</enum><text display-inline="yes-display-inline">Federal agency or State, local, or tribal government with jurisdiction over the project or required
			 by law to conduct or issue a review or make a determination with regard to
			 the project; and</text>
						</subparagraph><subparagraph id="H5CD3579B16734F9D87757480E277F3F2"><enum>(B)</enum><text>review, analysis, opinion, and permit, license, or approval required for the project;</text>
						</subparagraph></paragraph><paragraph id="H9B63766A8E684BB18C5B0C3B8F629207"><enum>(5)</enum><text>create process efficiencies, including—</text>
						<subparagraph id="H1956C49D308B4E45B88B8810B8F35314"><enum>(A)</enum><text>designating Federal agencies and State, local, and tribal governments as cooperating and
			 participating agencies;</text>
						</subparagraph><subparagraph id="H583942CC21D34F499182D74B3CD0544A"><enum>(B)</enum><text>conducting concurrent and integrated reviews, analyses, opinions, and permits, licenses, or
			 approvals to the maximum extent practicable;</text>
						</subparagraph><subparagraph id="HB42D88C8341A413582F681F72429C06B"><enum>(C)</enum><text display-inline="yes-display-inline">establishing timelines, in coordination with affected Federal agencies, for completion of those
			 reviews, analyses, opinions, and permits, licenses, or approvals;</text>
						</subparagraph><subparagraph id="H9EE3611B08B648AA8BD2D850C4F074CE"><enum>(D)</enum><text display-inline="yes-display-inline">developing a coordination plan and schedule, in coordination with affected Federal agencies, for
			 participation in the review by Federal agencies, State, local, and tribal
			 governments, and the public; and</text>
						</subparagraph><subparagraph id="H696A5AE7D94F4936A0D3EF82AD8B82E1"><enum>(E)</enum><text>implementing a process to effectively identify and resolve issues that may affect completion of
			 reviews in a timely manner;</text>
						</subparagraph></paragraph><paragraph id="H810AB51AF4C64F28A7945577E3D673BE"><enum>(6)</enum><text>effectively engage the public and interested stakeholders as early in the review process as
			 possible;</text>
					</paragraph><paragraph id="H0B4AB9FAB7D74D7EBFD67F54E779E1CC"><enum>(7)</enum><text>include opportunities to use existing share-in-cost authorities and other nonappropriated funding
			 sources to support early coordination and project review;</text>
					</paragraph><paragraph id="HCA8831CBD52C4FC5849E65A673FC6B9C"><enum>(8)</enum><text>expand the use of information technology tools and identify priority areas for information
			 technology investment to replace paperwork processes, enhance effective
			 project siting decisions, enhance interagency collaboration, and improve
			 the monitoring of project impacts and mitigation commitments;</text>
					</paragraph><paragraph id="H1025D58D639F42E3846601395A52F8DC"><enum>(9)</enum><text>ensure that documents developed under the procedures are adopted and used by other Federal
			 agencies, and State, local, and tribal governments, to the maximum extent
			 practicable, to eliminate redundancy and duplicative reviews;</text>
					</paragraph><paragraph id="H77D76957C8F44318A54DC1EDCF9C45AD"><enum>(10)</enum><text>include improvements to mitigation policies to provide added predictability, facilitate
			 landscape-scale mitigation based on conservation plans and regional
			 environmental assessments, facilitate interagency mitigation plans where
			 appropriate, ensure accountability and long-term effectiveness of
			 mitigation activities, and utilize innovative mechanisms where
			 appropriate; and</text>
					</paragraph><paragraph id="H8802F9DC5BD744DCB4050FEE37E31C5D"><enum>(11)</enum><text>develop a process for periodically considering expansion of categorical exclusions for
			 infrastructure projects described under subsection (a) that conform to
			 those of other modal administrations.</text>
					</paragraph></subsection></section><section id="HD5703FFB10FD4596B5EAE07FD3CD8147"><enum>402.</enum><header>Historic preservation of railroads</header>
				<subsection id="H0469AB9E697049D0AB34F3E611E13241"><enum>(a)</enum><header>In General</header><text>Not later than 12 months after the date of enactment of this Act, the Secretary, in consultation
			 with appropriate Federal agencies, including the Advisory Council on
			 Historic Preservation, the National Conference of State Historic
			 Preservation Officers, the National Association of Tribal Historic
			 Preservation Officers, and nongovernmental stakeholders representing the
			 railroad industry and historic preservation concerns, shall—</text>
					<paragraph id="HC58DAF1D171E4D1E84DF83F2E8B76EF2"><enum>(1)</enum><text>administratively pursue program alternatives (as that term is used in 36 C.F.R. 800.14) to promote
			 a consistent approach in the treatment of railroad and rail-related
			 properties for historic preservation review under section 106 of the
			 National Historic Preservation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/470f">16 U.S.C. 470f</external-xref>); and</text>
					</paragraph><paragraph id="H65317E3BA2B14BCFAA74FD6CFD0CBE7E"><enum>(2)</enum><text>develop mechanisms for streamlining compliance with the requirements of <external-xref legal-doc="usc" parsable-cite="usc/49/303">section 303</external-xref> of title 49,
			 United States Code, for railroad and rail-related properties.</text>
					</paragraph></subsection><subsection id="H39611E038E71454BB2BF6FBBCADA2799"><enum>(b)</enum><header>Considerations</header><text>In carrying out subsection (a), the Secretary shall—</text>
					<paragraph id="HD1337AA341F14D7B8E5EFF6D529C3505"><enum>(1)</enum><text>consider, among other options, the development of—</text>
						<subparagraph id="H31173005E794452B8C2378846A28A18F"><enum>(A)</enum><text display-inline="yes-display-inline">programmatic agreements, program comments, exempted categories of undertakings, and guidance for
			 historic reviews under section 106 of the National Historic Preservation
			 Act (as those terms are used in 36 C.F.R. 800.14); and</text>
						</subparagraph><subparagraph id="HD499C13E0EA9431A91A8F80BC7FD47BA"><enum>(B)</enum><text display-inline="yes-display-inline">programmatic evaluations, de minimis impact determinations, and regulatory guidance for reviews
			 under <external-xref legal-doc="usc" parsable-cite="usc/49/303">section 303</external-xref> of title 49, United States Code (as those terms are used
			 in 23 C.F.R. 774); and</text>
						</subparagraph></paragraph><paragraph id="H19137E57B967400190D84351E817A385"><enum>(2)</enum><text>take into account, at a minimum—</text>
						<subparagraph id="HC43D587BD2814A73BA610398B8AE0C01"><enum>(A)</enum><text>maintenance and repair of railroad and rail-related property;</text>
						</subparagraph><subparagraph id="H7B669D310C7E46D8BA6A7D50BEC77223"><enum>(B)</enum><text>repair and replacement of bridges, structures, or facilities in a like-for-like manner, or when the
			 bridge, structure, or facility is not a contributing element of a historic
			 district;</text>
						</subparagraph><subparagraph id="HCDBEE4E8CD27435B8B62E4265AAC2B78"><enum>(C)</enum><text>safety-related projects, including installation, maintenance, and repair of positive train control
			 systems;</text>
						</subparagraph><subparagraph id="H43C1DC5BC0C347D48CB443C8C40A9EFE"><enum>(D)</enum><text>management of railroad and rail-related properties that include both historic and non-historic
			 components;</text>
						</subparagraph><subparagraph id="HA482615E06EE464D8BFCF5443BB6356F"><enum>(E)</enum><text display-inline="yes-display-inline">integration of reviews under section 106 of the National Historic Preservation Act, reviews under
			 <external-xref legal-doc="usc" parsable-cite="usc/49/303">section 303</external-xref> of title 49, United States Code, and environmental reviews;
			 and</text>
						</subparagraph><subparagraph id="HB4C0FC937D1C4BA4A8DAFCE94AB624F2"><enum>(F)</enum><text>consistency in treatment of railroads nationwide for historic preservation purposes.</text>
						</subparagraph></paragraph></subsection></section></title><title id="H17E87AD3BD544F87BCFA31D69DF2D242"><enum>V</enum><header>Miscellaneous</header>
			<section commented="no" id="H68E1AD0B8FDE45B29B9AEC9ED068653E"><enum>501.</enum><header>Definition</header><text display-inline="no-display-inline">For purposes of this Act, the term <quote>Secretary</quote> means the Secretary of Transportation.</text>
			</section><section id="H0C13E6C1B4C6491798877628463A346E"><enum>502.</enum><header>Title 49 definitions</header>
