			 National Forest, Arizona, and for other purposes.</official-title>

		<section display-inline="no-display-inline" id="H83CD94BF74E74687866AEE30D3D8307E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Tumacacori Highlands Wilderness Act</short-title></quote>.</text>
		</section><section id="H9A585AE4CFF6446BA0C243B5292DC7D8"><enum>2.</enum><header>Expansion of Pajarita Wilderness, Coronado National Forest, Arizona</header>
			<subsection id="HAEC26B1DA1EB4D809F02BD72CB623FD7"><enum>(a)</enum><header>Expansion</header><text display-inline="yes-display-inline">Section 101(a)(17) of the Arizona Wilderness Act of 1984 (<external-xref legal-doc="public-law" parsable-cite="pl/98/406">Public Law 98–406</external-xref>; 98 Stat. 1487; 16
			 U.S.C. 1132 note) is amended by inserting after <quote>1984,</quote> the following: <quote>and which comprise approximately 13,300 acres, as generally depicted on a map entitled <quote>Proposed Tumacacori Highlands Wilderness and Pajarita Wilderness Addition</quote> and dated February 18, 2009,</quote>.</text>
			</subsection><subsection display-inline="no-display-inline" id="H31107AF1DAA04E07A65AC4A694D0DF45"><enum>(b)</enum><header>Map and legal description</header><text display-inline="yes-display-inline">As soon as practicable after the date of the enactment of this Act, the Secretary of Agriculture
			 shall submit a copy of the map referred to in the amendment made by
			 subsection (a) and a legal description of the National Forest System land
			 included in the Pajarita Wilderness by the amendment with the Committee on
			 Energy and Natural Resources of the Senate and the Committee on Natural
			 Resources of the House of Representatives. The map and legal description
			 shall have the same force and effect as if included in the Arizona
			 Wilderness Act of 1984, except that the Secretary may correct clerical and
			 typographical errors in the map and legal description. The map and legal
			 description shall be on file and available for public inspection in the
			 appropriate offices of the Forest Service.</text>
			</subsection></section><section id="H719BB4D73F0B48449A2A57851D087258"><enum>3.</enum><header>Designation of Tumacacori Highlands Wilderness, Coronado National Forest, Arizona</header>
			<subsection id="H7436C3F5AC6C488BA074E2557B0B55CD"><enum>(a)</enum><header>Designation</header><text display-inline="yes-display-inline">In furtherance of the purposes of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), certain lands in the
			 Coronado National Forest, Arizona, which comprise approximately 70,000
			 acres, as generally depicted on a map entitled <quote>Proposed Tumacacori Highlands Wilderness and Pajarita Wilderness Addition</quote> and dated February 18, 2009, are hereby designated as wilderness and, therefore, as a component of
			 the National Wilderness Preservation System, which shall be known as the <quote>Tumacacori Highlands Wilderness</quote>.</text>
			</subsection><subsection id="H866CFDE648E547578D73E599BD0578A4"><enum>(b)</enum><header>Map and legal description</header><text display-inline="yes-display-inline">As soon as practicable after the date of the enactment of this Act, the Secretary of Agriculture
			 shall submit a copy of the map referred to in subsection (a) and a legal
			 description of the Tumacacori Highlands Wilderness with the Committee on
			 Energy and Natural Resources of the Senate and the Committee on Natural
			 Resources of the House of Representatives. The map and legal description
			 shall have the same force and effect as if included in this Act, except
			 that the Secretary may correct clerical and typographical errors in the
			 map and legal description. The map and legal description shall be on file
			 and available for public inspection in the appropriate offices of the
			 Forest Service.</text>
			</subsection></section><section id="H702963E5158B432A8265C1F9A4CCDB0D"><enum>4.</enum><header>Administration of wilderness areas</header>
			<subsection id="H8F1F1126EDA14F9EA3E17D629F6E51E3"><enum>(a)</enum><header>Covered wilderness areas</header><text>In this section, the term <term>covered wilderness area</term> means—</text>
				<paragraph id="H567875FCC9EB4AC3982C2A99E6D3B71D"><enum>(1)</enum><text display-inline="yes-display-inline">the National Forest System land included in the Pajarita Wilderness by the amendment made by
			 section 2(a); and</text>
				</paragraph><paragraph id="H2C33DB883D414033A6E737E4C10FB3F2"><enum>(2)</enum><text>the Tumacacori Highlands Wilderness designated by section 3(a).</text>
				</paragraph></subsection><subsection id="H6C83E1E85FC041A0A1984971D3DF531A"><enum>(b)</enum><header>Administration</header><text display-inline="yes-display-inline">The Secretary of Agriculture shall manage the covered wilderness area in accordance with the
			 Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>) and this section, except that,
			 with respect to a covered wilderness area, any reference in the Wilderness
			 Act to the effective date of the Wilderness Act shall be deemed to be a
			 reference to the date of the enactment of this Act.</text>
			</subsection><subsection id="H97D0D3B8F7AA4E0E8FF9A1BC0A204BE8"><enum>(c)</enum><header>Valid existing rights</header><text>Nothing in this section shall affect any valid existing right.</text>
			</subsection><subsection id="H8BC7F02C3B05410AAFA7A5DC4B6C0B78"><enum>(d)</enum><header>Buffer zones</header><text display-inline="yes-display-inline">As provided in section 101(d) of the Arizona Wilderness Act of 1984 (<external-xref legal-doc="public-law" parsable-cite="pl/98/406">Public Law 98–406</external-xref>; 98 Stat.
			 1488), Congress does not intend that designation of a covered wilderness
			 area lead to the creation of protective perimeters or buffer zones around
			 the covered wilderness area. The fact that nonwilderness activities or
			 uses can be seen or heard from areas within a covered wilderness area
			 shall not, of itself, preclude such activities or uses up to the boundary
			 of the covered wilderness area.</text>
			</subsection><subsection id="H348783E975D441789D87BA604CE653FB"><enum>(e)</enum><header>Grazing</header><text display-inline="yes-display-inline">Grazing of livestock and maintenance of existing facilities related to grazing in a covered
			 wilderness area, where established before the date of the enactment of
			 this Act, shall be permitted to continue in accordance with—</text>
				<paragraph id="H1E8731EE87454B6A9DC4C3A2FD41F289"><enum>(1)</enum><text>section 4(d)(4) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(4)</external-xref>); and</text>
				</paragraph><paragraph id="H94E2434C7FDC4A35AE1C44F9A2DD780C"><enum>(2)</enum><text>the guidelines set forth in House Report 96–617 to accompany H.R. 5487 of the 96th Congress.</text>
				</paragraph></subsection><subsection id="HBFCB0F63B54A4A8E939311F90F3DC952"><enum>(f)</enum><header>Hunting, fish and wildlife</header>
				<paragraph id="H53A92B9D9F474FEC92077EE872AB51BF"><enum>(1)</enum><header>Hunting</header><text display-inline="yes-display-inline">Nothing in this section or the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>) shall affect hunting, under
			 applicable State and Federal laws and regulations, within a covered
			 wilderness area.</text>
				</paragraph><paragraph id="H081CDE31658C468F9C2459E0D5DA7FA7"><enum>(2)</enum><header>Jurisdiction</header><text>As provided in section 4(d)(7) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(7)</external-xref>), nothing in this
			 section or the Wilderness Act shall be construed as affecting the
			 jurisdiction or responsibilities of the State of Arizona with respect to
			 fish and wildlife in the State.</text>
				</paragraph><paragraph id="H9FFC74172DCA4C86BD9457FD374C2A4D"><enum>(3)</enum><header>Wildlife management</header><text display-inline="yes-display-inline">Management activities to maintain or restore fish and wildlife populations and the habitats to
			 support such populations may be carried out within a covered wilderness
			 area, where consistent with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>)
			 and other applicable laws.</text>
				</paragraph><paragraph id="H3C60F16CD325489FA59361941CF559D9"><enum>(4)</enum><header>Cooperative agreement</header><text display-inline="yes-display-inline">The Secretary shall enter into a cooperative agreement with the State of Arizona for management of
			 fish and wildlife within a covered wilderness area. The cooperative
			 agreement shall specify the terms and conditions under which the State or
			 a designee of the State may use wildlife management activities in a
			 covered wilderness area consistent with the Wilderness Act (16 U.S.C.
			 1131 et seq.), and other applicable laws.</text>
				</paragraph></subsection><subsection id="HB574E022C41745948711F0FBC38DBC74"><enum>(g)</enum><header>Protection of tribal rights</header><text>Nothing in this section shall be construed to diminish the existing rights of any Indian tribe.
			 Nothing in this section shall be construed to diminish tribal rights
			 regarding access to Federal lands for tribal activities, including
			 spiritual, cultural, and traditional food gathering activities.</text>
			</subsection><subsection id="H22D220CD855C4102862ECC3EE75662C1"><enum>(h)</enum><header>Military activities</header><text display-inline="yes-display-inline">Nothing in this section shall preclude low level overflights of military aircraft, the designation
			 of new units of special airspace, or the use or establishment of military
			 flight training routes over a covered wilderness area.</text>
			</subsection><subsection id="H5A2D9FD9274D4EFF8B6E52FF0A12BB68"><enum>(i)</enum><header>Border enforcement and drug interdiction</header><text display-inline="yes-display-inline">Because of the proximity of the covered wilderness areas to the United States-Mexico international
			 border, drug interdiction and border enforcement operations are common
			 management actions throughout the area encompassing the covered wilderness
			 areas. This Act recognizes the need to continue such management actions so
			 long as such management actions are conducted in accordance with the
			 Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>) and existing inter-agency
			 agreements.</text>
			</subsection><subsection id="H80179DF9168F49E0857AA6CCDB3526D9"><enum>(j)</enum><header>Maintenance of existing communications facilities</header><text display-inline="yes-display-inline">The provisions of the Wilderness Act shall not be construed to prevent—</text>
				<paragraph id="H4E411E8908D84E939BF2AF41E4D9BD6E"><enum>(1)</enum><text>the maintenance of communications facilities, in existence on the date of the enactment of this Act
			 and located in a covered wilderness area; or</text>
				</paragraph><paragraph id="HDAF78CA069054F60A83545F27C7495FD"><enum>(2)</enum><text>limited motorized access to such facilities when nonmotorized access means are not reasonably
			 available or when time is of the essence, subject to such conditions as
			 the Secretary of Agriculture considers to be desirable.</text>
				</paragraph></subsection></section></legis-body>
