		<official-title>To amend title 10, United States Code, to require that Federal, State, and local agencies to which
			 surplus military equipment and personal property is sold or donated
			 demonstrate that agency personnel are certified, trained, or licensed, as
			 appropriate, in the proper operation of the equipment prior to the sale or
			 donation.</official-title>

		<section id="H05509B27FF784329A498E21CD763B321" section-type="section-one"><enum>1.</enum><header>Requirement that State and local agencies receive training in proper operation of surplus military
			 equipment and property prior to sale or transfer of equipment by
			 Department of Defense</header>
			<subsection id="H1F156B9BD5B34638BDA9CA0A6887143E"><enum>(a)</enum><header>Sale to State and local law enforcement, firefighting, homeland security, and emergency management
			 agencies</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/10/2576">Section 2576</external-xref> of title 10, United States Code, is amended by adding at the end the following new
			 subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H862723BE000045068DE9CF3886479541" style="USC">
					<subsection id="H150DBD40D8C74A4085E4ABBB2D8087DD"><enum>(c)</enum><text display-inline="yes-display-inline">The Secretary of Defense shall require, as a condition of the sale of any surplus military
			 equipment under this section, that the State or local law enforcement,
			 firefighting, homeland security, or emergency management agency purchasing
			 the equipment demonstrates, prior to the sale of the equipment, that
			 agency personnel have been certified, trained, or licensed, as
			 appropriate, in the proper operation of the equipment.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HBD08BE47340F4C328D02A30D18E38E41"><enum>(b)</enum><header>Sale or donation for law enforcement activities</header><text>Section 2576a(b) of such title is amended—</text>
				<paragraph id="H01CF0872D055478FB258731F217C3846"><enum>(1)</enum><text>in paragraph (3), by striking <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="H20F1232164A84632984D747CBCC62584"><enum>(2)</enum><text>in paragraph (4), by striking the period and inserting <quote>; and</quote>; and</text>
				</paragraph><paragraph id="HEBF67E1C5C674F5A896ECFE3E4735E6E"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="HFF98F2488F5B4758BC2FD5EB1980851C" style="USC">
						<paragraph display-inline="no-display-inline" id="HD2B5EC8441A745FD9C47057765BF3EE3"><enum>(5)</enum><text display-inline="yes-display-inline">the recipient agency demonstrates, prior to the transfer, that agency personnel have been
			 certified, trained, or licensed, as appropriate, in the proper operation
			 of the property.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H2A247BBEC9B341AFA14735F050C01CA8"><enum>(c)</enum><header>Sale or donation To assist firefighting agencies</header><text>Section 2576b of such title is amended—</text>
				<paragraph id="H46DE62359311485983CC3A2974C4B851"><enum>(1)</enum><text>in paragraph (3), by striking <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="H25B67B8818CD4F7DBF3E4832EA440DF8"><enum>(2)</enum><text>in paragraph (4), by striking the period and inserting <quote>; and</quote>; and</text>
				</paragraph><paragraph id="H3B6EF65E99E34A59A5932510328BE56A"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H276905DF446A453294A4773D3AFE3EFD" style="USC">
						<paragraph display-inline="no-display-inline" id="H12138818E4AF4E97838E81B415E3452C"><enum>(5)</enum><text display-inline="yes-display-inline">the recipient agency demonstrates, prior to the transfer, that agency personnel have been
			 certified, trained, or licensed, as appropriate, in the proper operation
			 of the property.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H65E6F047E725474D98B22AEAC029C133"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this Act shall apply with respect to the sale, transfer, or donation of
			 property or equipment made after the date of the enactment of this Act.</text>
