		<official-title>To require servicers to establish a deed-for-lease program under which eligible mortgagors may
			 remain in their homes as renters.</official-title>

		<section id="H6913C7DBD595454C8111550BD3A9FA1A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Keeping Families Home Act of 2014</short-title></quote>.</text>
		</section><section id="H13C9D42DCE684C70A08DBC3C7D89F6CF"><enum>2.</enum><header>Deed-for-lease program</header>
			<subsection id="H3D3CD7FFC36A4BB7A27E524F99716C32"><enum>(a)</enum><header>Establishment</header>
				<paragraph id="HFE09A74B35FF46B1805A04CE7C608D4D"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Each servicer shall establish a deed-for-lease program (hereinafter referred to as the <quote>Program</quote>), which shall permit an eligible mortgagor to—</text>
					<subparagraph id="H0F3889B57F60469F84D89D7E2783973E"><enum>(A)</enum><text>enter into a deed in lieu of foreclosure agreement;</text>
					</subparagraph><subparagraph id="H4B7E950374DD496C9C1FF93A8D0B50CA"><enum>(B)</enum><text>continue to occupy and lease the property that is the subject of such agreement for a 1-year period
			 that begins on the date of such agreement; and</text>
					</subparagraph><subparagraph id="HB423B2EF0CA54156A7BDBD4157DD28C8"><enum>(C)</enum><text>have a right of first refusal to purchase such property after the end of the 1-year lease period,
			 if the owner of the property intends to sell the property at that time.</text>
					</subparagraph></paragraph><paragraph id="H7C0C2A74282D4F2CB365233DD6E3FFAA"><enum>(2)</enum><header>Exception for small servicers</header><text>The Program requirement under paragraph (1) shall not apply to a small servicer, as such term is
			 defined by the Secretary of Housing and Urban Development.</text>
				</paragraph></subsection><subsection id="HCAC5E62696C24597AEBCE8DD61143B37"><enum>(b)</enum><header>Notice requirement</header><text>Servicers shall provide each eligible mortgagor with information about the Program and how to apply
			 to participate in the Program.</text>
			</subsection><subsection id="H31E806D8DA854399B23323EFB8F2D0DC"><enum>(c)</enum><header>Lease terms</header><text>A lease entered into by an eligible mortgagor under the Program shall—</text>
				<paragraph id="H7A7A9D039C1449499563E00C32AD2763"><enum>(1)</enum><text>carry a monthly rent amount equal to the fair market rent for such property, as determined by an
			 independent private appraiser hired by and paid by the servicer; and</text>
				</paragraph><paragraph id="HB48F85508DA14A218BDAEFCC4BE16DCA"><enum>(2)</enum><text>contain all typical lease provisions for similar rental property.</text>
				</paragraph></subsection><subsection id="H561396499ECC48B492C3CE827694E1C1"><enum>(d)</enum><header>Application process</header>
				<paragraph id="H2FA5E333DCB14BDEAE64A271BC6C505B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">An eligible mortgagor may apply for the Program at any time.</text>
				</paragraph><paragraph id="HD0B7099BD1324CB38398B7AA7ACE076D"><enum>(2)</enum><header>Effect of foreclosure sale</header><text>If there is a foreclosure sale pending with respect to the property—</text>
					<subparagraph id="H2986AB85CEC44A378E69D5C49B342249"><enum>(A)</enum><text>the eligible mortgagor may only apply for the Program before the date that is 7 days before the
			 date of such foreclosure sale; and</text>
					</subparagraph><subparagraph id="HB8752BEE1E6F48028EB40086C9930521"><enum>(B)</enum><text>once the eligible mortgagor applies for the Program, the foreclosure sale shall be halted until
			 after the eligible mortgagor’s Program application has been evaluated.</text>
					</subparagraph></paragraph><paragraph id="H6D3D25484BA84DFA880F7DD28D3DED67"><enum>(3)</enum><header>Contents of application</header>
					<subparagraph id="HA5729315719B452E8412AD649F25359E"><enum>(A)</enum><header>In general</header><text>In applying for the Program, an eligible mortgagor shall provide the servicer with proof of the
			 following information:</text>
						<clause id="HCEEEFE7B28284B77929B3F7AE3A9EE15"><enum>(i)</enum><text>The eligible mortgagor is subject to a financial hardship that makes the eligible mortgagor unable
			 to continue making timely payments on the eligible mortgage loan.</text>
						</clause><clause id="HA8CC454BB3F34B7D9FE73CDBA5296DA7"><enum>(ii)</enum><text>The eligible mortgagor is eligible to pay the monthly rent amount described under subsection (c)(1)
			 and such amount is no more than 31 percent of the eligible mortgagor’s
			 monthly income.</text>
						</clause><clause id="HE186F4074FA840D09D087C57937396CA"><enum>(iii)</enum><text>The eligible mortgagor currently lives in the property and intends to continue doing so during the
			 1-year lease term.</text>
						</clause></subparagraph><subparagraph id="H56C6E526BEAA437EB8EBA4355825CF22"><enum>(B)</enum><header>Ability to pay higher percentage of income in rent</header><text display-inline="yes-display-inline">Notwithstanding subparagraph (A)(ii), if an eligible mortgagor believes they are able pay the
			 monthly rent amount despite such amount exceeding 31 percent of the
			 eligible mortgagor’s monthly income, the eligible mortgagor may request
			 that the Department of Housing and Urban Development review their
			 information, along with any contributing factors the eligible mortgagor
			 may have (such as a low debt burden) and, if the Department notifies the
			 eligible mortgagor that the Department agrees that the eligible mortgagor
			 is able to pay a monthly rent amount that is equal to a percentage of
			 their monthly income that is higher than 31 percent, such higher
			 percentage shall be used for purposes of subparagraph (A)(ii).</text>
					</subparagraph></paragraph><paragraph id="H791155B91FFB41D3B17073F3D05C886C"><enum>(4)</enum><header>Effect of junior liens</header><text display-inline="yes-display-inline">If an eligible mortgagor applies for a Program with respect to a single family property subject to
			 a junior lien—</text>
					<subparagraph id="H6DCB7DC851DB4A2A82C1942D736147E3"><enum>(A)</enum><text>if the servicer of the Program is also the holder of the junior lien, the servicer shall release
			 the junior lien and, subject to the other requirements of this section,
			 the eligible mortgagor shall be eligible to participate in the Program;
			 and</text>
					</subparagraph><subparagraph id="H50B0905721EE4BD790BB62696C408FD0"><enum>(B)</enum><text>if the servicer of the Program is not the holder of the junior lien, the servicer shall contact
			 such junior lien holder and request that the holder release the lien,
			 and—</text>
						<clause id="H10BE9C829EA143739AD2469EE21451C6"><enum>(i)</enum><text display-inline="yes-display-inline">if the holder releases the lien, then, subject to the other requirements of this section, the
			 eligible mortgagor shall be eligible to participate in the Program; and</text>
						</clause><clause id="H2A45AD2D5C9F4F6E8FF57B6516BCC51A"><enum>(ii)</enum><text>if the holder does not release the lien, then the eligible mortgagor shall not be eligible to
			 participate in the Program.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="H8142DE2DBF194DBE9CF0DA43A9C5B2B2"><enum>(e)</enum><header>Evaluation and notification</header>
				<paragraph id="H67106847C4B74C929C795F909BB3CC80"><enum>(1)</enum><header>Deadline for evaluation</header><text>The servicer shall evaluate the eligible mortgagor’s application within 30 days of receiving such
			 application and shall accept an eligible mortgagor into the Program if the
			 eligible mortgagor has provided the proof described under subsection
			 (d)(3)(A).</text>
				</paragraph><paragraph id="H48BABEEBF9CE495F8F0E28DEB00979F5"><enum>(2)</enum><header>Notification</header><text>Promptly after making a determination under paragraph (1), the servicer shall notify the eligible
			 mortgagor of such determination in writing and, if the servicer determines
			 that the eligible mortgagor may not be accepted into the Program, the
			 servicer shall specifically explain in writing why the eligible mortgage
			 was not accepted.</text>
				</paragraph></subsection><subsection id="HEE743380FB2547CDA8D62DB47424C2AB"><enum>(f)</enum><header>Subsequent owners follow Program requirements</header><text>Any subsequent owner of the property being leased pursuant to the Program shall—</text>
				<paragraph id="HCB6587BFFADB4242A4B2937FEE06A775"><enum>(1)</enum><text>maintain the Program and abide by the terms of the Program to the same extent as the servicer of
			 the eligible mortgage; and</text>
				</paragraph><paragraph id="HA916964D12A944BC8A65860CAC648D55"><enum>(2)</enum><text>certify to the Department of Housing and Urban Development, before finalizing any purchase of the
			 property, that they will abide by the terms of the Program.</text>
				</paragraph></subsection><subsection id="H989420D71C3C4B569634A39F5BEB7D79"><enum>(g)</enum><header>Rulemaking; compliance evaluation</header><text display-inline="yes-display-inline">The Department of Housing and Urban Development shall—</text>
				<paragraph id="H012E50B266B0484D9208B3E176E94A81"><enum>(1)</enum><text>issue such regulations as may be necessary to carry out this section;</text>
				</paragraph><paragraph id="H65DDF6E6F4FB4EB49DD9C2220F972459"><enum>(2)</enum><text>evaluate the compliance by servicers and owners with the requirements of this section; and</text>
				</paragraph><paragraph id="H96E0628112844F43ABD7733673558ED2"><enum>(3)</enum><text>enforce the requirements of this section.</text>
				</paragraph></subsection><subsection id="H8B757BB324104B7AB2B48120716BBE36"><enum>(h)</enum><header>Definitions</header><text>For purposes of this section:</text>
				<paragraph id="H9697C413669D4159A9C110A09AAAFC9A"><enum>(1)</enum><header>Eligible mortgagor</header><text>The term <term>eligible mortgagor</term> means a mortgagor under an eligible mortgage.</text>
				</paragraph><paragraph id="HC924AD444911485AA1C9A3CDFFCA1A87"><enum>(2)</enum><header>Eligible mortgage</header><text>The term <term>eligible mortgage</term> means a first or subordinate mortgage on a property that—</text>
					<subparagraph id="HAC36D2243FD04CC490D8E4BC7683648F"><enum>(A)</enum><text>is a single family property; and</text>
					</subparagraph><subparagraph id="HBCCFED5F375C4CFF881A09C70B9FFDFB"><enum>(B)</enum><text>is currently being used as the principal residence of the eligible mortgagor.</text>
					</subparagraph></paragraph><paragraph id="HE6D54347B27B43458910DFA7877512E7"><enum>(3)</enum><header>Single family property</header><text>The term <term>single family property</term> means—</text>
					<subparagraph id="H4ACC5568F5CD4FD5B90A438498648F77"><enum>(A)</enum><text>a structure consisting of 1 to 4 dwelling units;</text>
					</subparagraph><subparagraph commented="no" id="H88E2035765FA42A3953601596C2F3BD2"><enum>(B)</enum><text>a dwelling unit in a multi-unit condominium property together with an undivided interest in the
			 common areas and facilities serving the property;</text>
					</subparagraph><subparagraph id="HB86E364560944EDFA52578129A3B8D0C"><enum>(C)</enum><text>a dwelling unit in a multi-unit project for which purchase of stock or a membership interest
			 entitles the purchaser to permanent occupancy of that unit; or</text>
					</subparagraph><subparagraph id="HE700FC2BF3B74A8AB3656480254684C8"><enum>(D)</enum><text>a manufactured housing unit.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
