<section id="H1AE47A03331049BE9484C984C2F08F78"><enum>2.</enum><header>Amendment of Professional Boxing Safety Act</header><text display-inline="no-display-inline">Except as otherwise expressly provided, whenever in this Act an amendment or repeal is expressed in terms of an amendment to, or repeal of, a section or other provision, the reference shall be considered to be made to a section or other provision of the Professional Boxing Safety Act (<external-xref legal-doc="public-law" parsable-cite="pl/104/272">Public Law 104–272</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/15/6301">15 U.S.C. 6301 et seq.</external-xref>), as redesignated by section 21(b)(1)(A).</text></section> 
<section id="HD5BADD61871547F8AB3FC5C362E6B4C3"><enum>3.</enum><header>Definitions</header> 
<subsection id="H99F10BA1053D43A88A0072C60954F92B"><enum>(a)</enum><header>In general</header><text>Section 2 (<external-xref legal-doc="usc" parsable-cite="usc/15/6301">15 U.S.C. 6301</external-xref>) is amended to read as follows:</text>

<section id="H239FFF14BD674EED93835CB5438323E5"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H2C023864E64C4553AE951F9A9C562ED8"><enum>(1)</enum><header>Bout agreement</header><text>The term <term>bout agreement</term> means a contract between a promoter and a boxer that requires the boxer to participate in a professional boxing match for a particular date.</text></paragraph> 
<paragraph id="HC6919221A96040708EC6E9BF4C740517"><enum>(2)</enum><header>Boxer</header><text>The term <term>boxer</term> means an individual who fights in a professional boxing match.</text></paragraph> 
<paragraph id="HFAC46E987200434DAB0206D958C24242"><enum>(3)</enum><header>Boxing commission</header><text>The term <term>boxing commission</term> means an entity authorized under State or tribal law to regulate professional boxing matches.</text></paragraph> 
<paragraph id="H27FF5B5DC4D144E6920EA65CEEF5B62E"><enum>(4)</enum><header>Boxer registry</header><text>The term <term>boxer registry</term> means any entity certified by the Commission for the purposes of maintaining records and identification of boxers.</text></paragraph> 
<paragraph id="H26108401E3204ACFB2A3B34C4214860A"><enum>(5)</enum><header>Boxing service provider</header><text>The term <term>boxing service provider</term> means a promoter, manager, sanctioning body, licensee, or matchmaker.</text></paragraph> 
<paragraph id="H47C1C313A811493BB0EA49496A849262"><enum>(6)</enum><header>Commission</header><text>The term <term>Commission</term> means the United States Boxing Commission.</text></paragraph> 
<paragraph id="H8D19DB9FA2CA47A4A1401EF144364B2A"><enum>(7)</enum><header>Contract provision</header><text>The term <term>contract provision</term> means any legal obligation between a boxer and a boxing service provider.</text></paragraph> 
<paragraph id="HB79F70145B194CAD80F86BD04580C3EE"><enum>(8)</enum><header>Indian lands; Indian tribe</header><text>The terms <term>Indian lands</term> and <term>Indian tribe</term> have the meanings given such terms in section 4 of the Indian Gaming Regulatory Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2703">25 U.S.C. 2703</external-xref>).</text></paragraph> 
<paragraph id="HA3B88184D24048538252AA673153BB7F"><enum>(9)</enum><header>Licensee</header><text>The term <term>licensee</term> means an individual who serves as a trainer, corner man, second, or cut man for a boxer.</text></paragraph> 
<paragraph id="H17A1295E344B4524A50CE8C493CB6320"><enum>(10)</enum><header>Manager</header><text>The term <term>manager</term> means a person other than a promoter who, under contract, agreement, or other arrangement with a boxer, undertakes to control or administer, directly or indirectly, a boxing-related matter on behalf of that boxer, including a person who is a booking agent for a boxer.</text></paragraph> 
<paragraph id="HAA0D46F0127F4E70BC468ECBBBED0D47"><enum>(11)</enum><header>Matchmaker</header><text>The term <term>matchmaker</term> means a person that proposes, selects, and arranges for boxers to participate in a professional boxing match.</text></paragraph> 
<paragraph id="H6D6E379C4227433BB0A2261BD22455FC"><enum>(12)</enum><header>Physician</header><text>The term <term>physician</term> means a doctor of medicine legally authorized to practice medicine by the State in which the physician performs such function or action and who has training and experience in dealing with sports injuries, particularly head trauma.</text></paragraph> 
<paragraph id="H833BC2713A2C4EEFAE0EB19084800681"><enum>(13)</enum><header>Professional boxing match</header> 
<subparagraph id="HE29AC2498B134058AFD053A46C53F1DA"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the term <term>professional boxing match</term> means a boxing contest held in the United States between individuals for financial compensation.</text></subparagraph> 
<subparagraph id="H20D012FDF41A429AA7E88C4E7CA611DD"><enum>(B)</enum><header>Exception</header><text>The term <term>professional boxing match</term> does not include a boxing contest that is regulated by a duly recognized amateur sports organization, as approved by the Commission.</text></subparagraph></paragraph> 
<paragraph id="HB38481F5B8814835B4629E0123F4AEB9"><enum>(14)</enum><header>Promoter</header> 
<subparagraph id="HEB6700A732DE4B2996FE649B4AF12054"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the term <term>promoter</term> means the person primarily responsible for organizing, promoting, and producing a professional boxing match.</text></subparagraph> 
<subparagraph id="HCDE63AFB9F624009B43AEB1A94FB0670"><enum>(B)</enum><header>Exception</header><text>The term <term>promoter</term> does not include a hotel, casino, resort, or other commercial establishment hosting or sponsoring a professional boxing match unless—</text> 
<clause id="H1D422ADB558845A4AB75DF7226932A8C"><enum>(i)</enum><text>the hotel, casino, resort, or other commercial establishment is primarily responsible for organizing, promoting, and producing the match; and</text></clause> 
<clause id="H425461698C074668AB2E2283B81F7BDB"><enum>(ii)</enum><text>there is no other person primarily responsible for organizing, promoting, and producing the match.</text></clause></subparagraph></paragraph> 
<paragraph id="H6C2E24C9DB274868A122FFFB11C23DB4"><enum>(15)</enum><header>Promotional agreement</header><text>The term <term>promotional agreement</term> means a contract, for the acquisition of rights relating to a boxer's participation in a professional boxing match or series of boxing matches (including the right to sell, distribute, exhibit, or license the match or matches), with—</text> 
<subparagraph id="H1A857D0F5C97405F8C1D9ED31F3637F6"><enum>(A)</enum><text>the boxer who is to participate in the match or matches; or</text></subparagraph> 
<subparagraph id="H72187AA7A2F8402C9D09F3C56F5BD8D3"><enum>(B)</enum><text>the nominee of a boxer who is to participate in the match or matches, or the nominee is an entity that is owned, controlled or held in trust for the boxer unless that nominee or entity is a licensed promoter who is conveying a portion of the rights previously acquired.</text></subparagraph></paragraph> 
<paragraph id="HB47AC2173A91431B8D3D736635A03E49"><enum>(16)</enum><header>State</header><text>The term <term>State</term> means each of the several States of the United States, the District of Columbia, Puerto Rico, and any territory or possession of the United States, including the Virgin Islands.</text></paragraph> 
<paragraph id="H0F989109391F40EB80E0687A36D03854"><enum>(17)</enum><header>Sanctioning organization</header><text>The term <term>sanctioning organization</term> means an organization, other than a boxing commission, that sanctions professional boxing matches, ranks professional boxers, or charges a sanctioning fee for professional boxing matches in the United States—</text> 
<subparagraph id="HBB04914D35DD4799B60EB509F308D0C9"><enum>(A)</enum><text>between boxers who are residents of different States; or</text></subparagraph> 
<subparagraph id="H555D374BB4A64921B0E5FB4BA7042D4B"><enum>(B)</enum><text>that are advertised, otherwise promoted, or broadcast (including closed circuit television) in interstate commerce.</text></subparagraph></paragraph> 
<paragraph id="H5F062D9768C245AEA5432358FF6C83CA"><enum>(18)</enum><header>Suspension</header><text>The term <term>suspension</term> includes within its meaning the temporary revocation of a boxing license.</text></paragraph> 
<paragraph id="HC15367C8B0D54285A3BBAC80B4C25F1B"><enum>(19)</enum><header>Tribal organization</header><text>The term <term>tribal organization</term> has the meaning given such term in section 4 of the <act-name parsable-cite="ISDA">Indian Self-Determination and Education Assistance Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/25/450b">25 U.S.C. 450b</external-xref>).</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HF9D955DB76CF401BA5F9F9D057914AB7"><enum>(b)</enum><header>Conforming amendment</header><text>Section 21 (<external-xref legal-doc="usc" parsable-cite="usc/15/6312">15 U.S.C. 6312</external-xref>) is amended to read as follows:</text> 
<quoted-block display-inline="no-display-inline" id="H9C61CCE66C7D4432890C7ACF8CAF867A" style="OLC"> 
<section id="H4537313BBFA84612A83E3959CDA2B178"><enum>21.</enum><header>Professional boxing matches conducted on Indian lands</header> 
<subsection id="H30E9A209C39446678F4B70F2BE9AEE07"><enum>(a)</enum><header>In general</header><text>Notwithstanding any other provision of law, a tribal organization may establish a boxing commission to regulate professional boxing matches held on Indian land under the jurisdiction of that tribal organization.</text></subsection> 
<subsection id="H497F98096AC844D9A98DA9D0B2FD7380"><enum>(b)</enum><header>Standards and licensing</header><text>A tribal organization that establishes a boxing commission shall, by tribal ordinance or resolution, establish and provide for the implementation of health and safety standards, licensing requirements, and other requirements relating to the conduct of professional boxing matches that are at least as restrictive as—</text> 
<paragraph id="HBC002B2D10864AA39DB62D9469D4FBC6"><enum>(1)</enum><text>the otherwise applicable requirements of the State in which the Indian land on which the professional boxing match is held is located; or</text></paragraph> 
<paragraph id="HB061C9A18DF547EBB7E9C05CBE813DE2"><enum>(2)</enum><text>the guidelines established by the United States Boxing Commission.</text></paragraph></subsection> 
<subsection id="HD81528F91D244B0C99367361BF946A69"><enum>(c)</enum><header>Application of act to boxing matches on tribal lands</header><text>The provisions of this Act apply to professional boxing matches held on tribal lands to the same extent and in the same way as they apply to professional boxing matches held in any State.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H75973FA73655470DA8753EC1DD463620"><enum>4.</enum><header>Purposes</header><text display-inline="no-display-inline">Section 3(2) (<external-xref legal-doc="usc" parsable-cite="usc/15/6302">15 U.S.C. 6302(2)</external-xref>) is amended by striking <quote>State</quote>.</text></section> 
<section id="HBE4332E3E69D46A59FB2D75AD7271D8D"><enum>5.</enum><header>United States Boxing Commission approval, or ABC or commission sanction, required for matches</header> 
<subsection id="H47F0B996EE17430482E3AB0709A4EDD6"><enum>(a)</enum><header>In general</header><text>Section 4 (<external-xref legal-doc="usc" parsable-cite="usc/15/6303">15 U.S.C. 6303</external-xref>) is amended to read as follows:</text> 
<quoted-block display-inline="no-display-inline" id="H642B0C42FF3B4FA395D318590644993C" style="OLC"> 
<section id="H99414B0912D84F5995C0B86270322256"><enum>4.</enum><header>Approval or sanction requirement</header> 
<subsection id="HD80204903D7B4280AE5C59431AAF6BA1"><enum>(a)</enum><header>In general</header><text>No person may arrange, promote, organize, produce, or fight in a professional boxing match within the United States unless the match—</text> 
<paragraph id="HAF5A4843DEBA4FBE9E0B0347EF0D6040"><enum>(1)</enum><text>is approved by the Commission; and</text></paragraph> 
<paragraph id="H136C69C134514EF486D6A55F07B1285B"><enum>(2)</enum><text>is held in a State, or on tribal land of a tribal organization, that regulates professional boxing matches in accordance with standards and criteria established by the Commission.</text></paragraph></subsection> 
<subsection id="HAF96D7130A8C46728AFBCDDD7D8F930C"><enum>(b)</enum><header>Approval presumed</header> 
<paragraph id="HE5E73727D08A41D1967846E5B3E46443"><enum>(1)</enum><header>In general</header><text>For purposes of subsection (a), the Commission shall be presumed to have approved any match other than—</text> 
<subparagraph id="H110CE78C648B43FBBD5B3B219DFEDA3E"><enum>(A)</enum><text>a match with respect to which the Commission has been informed of an alleged violation of this Act and with respect to which it has notified the supervising boxing commission that it does not approve;</text></subparagraph> 
<subparagraph id="HF909EA87EE5042469EA19E3478D8DD59"><enum>(B)</enum><text>a match advertised to the public as a championship match;</text></subparagraph> 
<subparagraph id="H23A1930E18464DC0BE74A5626DAC3FCE"><enum>(C)</enum><text>a match scheduled for 10 rounds or more; or</text></subparagraph> 
<subparagraph id="H209D7003E6D14723A008AA5472228D14"><enum>(D)</enum><text>a match in which 1 of the boxers has—</text> 
<clause id="H2B9716AC84CE48FDA0AD0E036F0BCAF3"><enum>(i)</enum><text>suffered 10 consecutive defeats in professional boxing matches; or</text></clause> 
<clause id="HBE7574E3D5D1465285EF96DA91F57C8E"><enum>(ii)</enum><text>has been knocked out 5 consecutive times in professional boxing matches.</text></clause></subparagraph></paragraph> 
<paragraph id="HCBD1D4A073E64871BDF94CD023796A80"><enum>(2)</enum><header>Delegation of approval authority</header><text>Notwithstanding paragraph (1), the Commission shall be presumed to have approved a match described in subparagraph (B), (C), or (D) of paragraph (1) if—</text> 
<subparagraph id="H05542689752F4E88AE5CABF76ED79BE8"><enum>(A)</enum><text>the Commission has delegated its approval authority with respect to that match to a boxing commission; and</text></subparagraph> 
<subparagraph id="H74E6696765BE4A268DD10F51A953BB23"><enum>(B)</enum><text>the boxing commission has approved the match.</text></subparagraph></paragraph> 
<paragraph id="H2C90FCA59F39441086F49836CAF72922"><enum>(3)</enum><header>Knocked-out defined</header><text>Except as may be otherwise provided by the Commission by rule, in paragraph (1)(D)(ii), the term <term>knocked out</term> means knocked down and unable to continue after a count of 10 by the referee or stopped from continuing because of a technical knockout.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H3EFD67D92589499F8625B7ABB4213766"><enum>(b)</enum><header>Conforming amendment</header><text>Section 19 (<external-xref legal-doc="usc" parsable-cite="usc/15/6310">15 U.S.C. 6310</external-xref>) is hereby repealed.</text></subsection></section> 
<section id="HCE4F64613CAA4DDB89351619E16AB6B8"><enum>6.</enum><header>Safety standards</header><text display-inline="no-display-inline">Section 5 (<external-xref legal-doc="usc" parsable-cite="usc/15/6304">15 U.S.C. 6304</external-xref>) is amended—</text> 
<paragraph id="HC9BF19A14F5B45B1B6C085B0ED98B702"><enum>(1)</enum><text>in the matter preceding paragraph (1), by striking <quote>requirements or an alternative requirement in effect under regulations of a boxing commission that provides equivalent protection of the health and safety of boxers:</quote> and inserting <quote>requirements:</quote>;</text></paragraph> 
<paragraph id="H9683D5BC125D451DB32925A3BF8B4F30"><enum>(2)</enum><text>in paragraph (1), by adding at the end the following: <quote>The examination shall include testing for infectious diseases in accordance with standards established by the Commission.</quote>;</text></paragraph> 
<paragraph id="HC982F4F31D394996BB5DEB992CB3A7D1"><enum>(3)</enum><text>by striking paragraph (2) and inserting the following:</text> 
<quoted-block display-inline="no-display-inline" id="HAE89E919E7AF4DBDABC26B37479CE56B" style="OLC"> 
<paragraph id="HFABB3543A8F9439D9E00E3C40A2976F6"><enum>(2)</enum><text>An ambulance continuously present on site.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H7A9A39DB5A1C47FCAE13A09954A822A8"><enum>(4)</enum><text>by redesignating paragraphs (3) and (4) as paragraphs (4) and (5), respectively, and inserting after paragraph (2), as added by paragraph (3), the following:</text> 
<quoted-block display-inline="no-display-inline" id="HBC02A5563AB24FB3A52AE9299C008E7F" style="OLC"> 
<paragraph id="H4EB23BF7392A4108AE5518F46C29EFC5"><enum>(3)</enum><text>Emergency medical personnel with appropriate resuscitation equipment continuously present on site.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HA7F02168579847A4B45E47CBDEB7DF75"><enum>(5)</enum><text>in paragraph (5), as redesignated by paragraph (4), by striking <quote>match.</quote> and inserting <quote>match in an amount prescribed by the Commission.</quote>.</text></paragraph></section> 
<section id="H4207455A196A4A2BA125E73063A364A3"><enum>7.</enum><header>Registration</header><text display-inline="no-display-inline">Section 6 (<external-xref legal-doc="usc" parsable-cite="usc/15/6305">15 U.S.C. 6305</external-xref>) is amended—</text> 
<paragraph id="HDBCB1E6B0FBA4CB195BED9AB9228F6E6"><enum>(1)</enum><text>in subsection (a)(2), by inserting <quote>or Indian tribe</quote> after <quote>State</quote> the second place it appears;</text></paragraph> 
<paragraph id="H74EEE4E675AD45CD8A668716726DA0F3"><enum>(2)</enum><text>in subsection (c)—</text> 
<subparagraph id="H3A7C6FF52F774007A3D42F839F84C0B9"><enum>(A)</enum><text>by striking the first sentence and inserting <quote>A boxing commission shall, in accordance with requirements established by the Commission, make a health and safety disclosure to a boxer when issuing an identification card to that boxer.</quote>; and</text></subparagraph> 
<subparagraph id="HD1D52E8E5BD44EA6A9366EFCFF2A6736"><enum>(B)</enum><text>in the second sentence, by striking <quote>should</quote> and inserting <quote>shall, at a minimum,</quote>; and</text></subparagraph></paragraph> 
<paragraph id="H9004E6A0F89149C1BFFA797673399402"><enum>(3)</enum><text>by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H27C9A91F1C7A4CDEA0E490E8A0B5F392" style="OLC">

<subsection id="HE40C48B0E2E642CDA41ED9829CF9E150"><enum>(a)</enum><header>In general</header><text>The Commission, in consultation with the Association of Boxing Commissions, shall develop guidelines for minimum contractual provisions that shall be included in each bout agreement, boxer-manager contract, and promotional agreement. Each boxing commission shall ensure that these minimal contractual provisions are present in any such agreement or contract submitted to it.</text></subsection> 
<subsection id="H91DF43FA5C644869957920493DE02896"><enum>(b)</enum><header>Filing and approval requirements</header> 
<paragraph id="HAC0D78A6EE0547DEBA6A5544DBCE54E3"><enum>(1)</enum><header>Commission</header><text>A manager or promoter shall submit a copy of each boxer-manager contract and each promotional agreement between that manager or promoter and a boxer to the Commission, and, if requested, to the boxing commission with jurisdiction over the bout.</text></paragraph> 
<paragraph id="HEFAB417A3A35476F943B20FEE7B5AA5A"><enum>(2)</enum><header>Boxing commission</header><text>A boxing commission may not approve a professional boxing match unless a copy of the bout agreement related to that match has been filed with it and approved by it.</text></paragraph></subsection> 
<subsection id="HE4E67E9EBF6C407581B392B77C2C89D5"><enum>(c)</enum><header>Bond or other surety</header><text>A boxing commission may not approve a professional boxing match unless the promoter of that match has posted a surety bond, cashier's check, letter of credit, cash, or other security with the boxing commission in an amount acceptable to the boxing commission.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HF11A611B7E804C47AD78B652D94B2E7B"><enum>11.</enum><header>Coercive contracts</header><text display-inline="no-display-inline">Section 10 (<external-xref legal-doc="usc" parsable-cite="usc/15/6307b">15 U.S.C. 6307b</external-xref>) is amended—</text>

<subsection id="HC11BD3F8C1244CADACDB6315F3017394"><enum>(a)</enum><header>In general</header><text>Section 11 (<external-xref legal-doc="usc" parsable-cite="usc/15/6307c">15 U.S.C. 6307c</external-xref>) is amended to read as follows:</text>

<section id="H80D5C446DE8643619E5A862B97A0CFFB"><enum>11.</enum><header>Sanctioning organizations</header> 
<subsection id="H6467E3CBD79F4DDE8768659F22F61FD1"><enum>(a)</enum><header>Objective criteria</header><text>Not later than 1 year after the date of the enactment of the <short-title>Professional Boxing Amendments Act of 2013</short-title>, the Commission shall develop guidelines for objective and consistent written criteria for the rating of professional boxers based on the athletic merits and professional record of the boxers. Not later than 90 days after the Commission's promulgation of the guidelines, each sanctioning organization shall adopt the guidelines and commence following them.</text></subsection> 
<subsection id="HA89844AF37D1402D9E16948C7740C3B9"><enum>(b)</enum><header>Notification of change in rating</header><text>A sanctioning organization shall, with respect to a change in the rating of a boxer previously rated by such organization in the top 10 boxers—</text> 
<paragraph id="H4CAF0C69A8D945F096EC1B7347B99476"><enum>(1)</enum><text>post a copy, within 7 days after the change, on its Internet website or home page, if any, including an explanation of the change, for a period of not less than 30 days;</text></paragraph> 
<paragraph id="H54845035053F4E32BA9FB2E981385BFC"><enum>(2)</enum><text>provide a copy of the rating change and a thorough explanation in writing under penalty of perjury to the boxer and the Commission;</text></paragraph> 
<paragraph id="H17A4ED1B70C64591BF49D3D6BBB2F5A1"><enum>(3)</enum><text>provide the boxer an opportunity to appeal the ratings change to the sanctioning organization; and</text></paragraph> 
<paragraph id="H1F03CD99D0B3463DB8895FBBAE2BBC25"><enum>(4)</enum><text>apply the objective criteria for ratings required under subsection (a) in considering any such appeal.</text></paragraph></subsection> 
<subsection id="H92F3B0D45288432C86F779A1037DE9A4"><enum>(c)</enum><header>Challenge of rating</header><text>If, after disposing with an appeal under subsection (b)(3), a sanctioning organization receives a petition from a boxer challenging that organization's rating of the boxer, it shall (except to the extent otherwise required by the Commission), within 7 days after receiving the petition—</text> 
<paragraph id="H1E8C5EB67BB742B1B34F2DC78CFAFFAB"><enum>(1)</enum><text>provide to the boxer a written explanation under penalty of perjury of the organization's rating criteria, its rating of the boxer, and the rationale or basis for its rating (including a response to any specific questions submitted by the boxer); and</text></paragraph> 
<paragraph id="HD8CEB9AEDD6D43C990BFBA558979CC3D"><enum>(2)</enum><text>submit a copy of its explanation to the Association of Boxing Commissions and the Commission for their review.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H76A2BE4B864642D4BCA6BC0479BCC8D5"><enum>(b)</enum><header>Conforming amendments</header><text>Section 18(e) (<external-xref legal-doc="usc" parsable-cite="usc/15/6309">15 U.S.C. 6309(e)</external-xref>) is amended—</text>

<subparagraph id="H96AE0D4A900049D297F9000ECDBEAC64"><enum>(C)</enum><text>in paragraph (3)—</text>

<subparagraph id="H37404112145A478F99822AEFB2701067"><enum>(B)</enum><text>in paragraph (1), by striking <quote>match;</quote> and inserting <quote>match, and that the promoter has paid, or agreed to pay, to any other person in connection with the match;</quote>; and</text></subparagraph></paragraph> 
<paragraph id="HF19BD19E82E74F95A53403F112A2AE11"><enum>(4)</enum><text>by adding at the end the following:</text>

<subsection id="H1481FB17153C4F509719FEED9BB4E969"><enum>(d)</enum><header>Required disclosures by broadcasters</header> 
<paragraph id="H38EC646F0D104F88B6ECCF2F6E2C2E5E"><enum>(1)</enum><header>In general</header><text>A broadcaster that owns the television broadcast rights for a professional boxing match of 10 rounds or more shall, not later than 7 days after that match, provide to the Commission—</text> 
<subparagraph id="HB87BDB2BB26149FAA5E510A0C528FB5F"><enum>(A)</enum><text>a statement of any advance, guarantee, or license fee paid or owed by the broadcaster to a promoter in connection with that match;</text></subparagraph> 
<subparagraph id="H3BAF837FF8224FCC85580C1C25114C19"><enum>(B)</enum><text>a copy of any contract executed by or on behalf of the broadcaster with—</text> 
<clause id="HCE97F180CDFD466AB4AABFDB72F20F6D"><enum>(i)</enum><text>a boxer who participated in that match; or</text></clause> 
<clause id="H24C47348EC53450991FACA7519C5F596"><enum>(ii)</enum><text>the boxer's manager, promoter, promotional company, or other representative or the owner or representative of the site of the match; and</text></clause></subparagraph> 
<subparagraph id="HB7B9F887D0C247E09F6686F4EF3BDFF7"><enum>(C)</enum><text>a list identifying sources of income received from the broadcast of the match.</text></subparagraph></paragraph> 
<paragraph id="H86A67A6FEE2E490EB611D8DBA89FB1AD"><enum>(2)</enum><header>Copy to boxing commission</header><text>Upon request from the boxing commission in the State or Indian land responsible for regulating a match to which paragraph (1) applies, a broadcaster shall provide the information described in paragraph (1) to that boxing commission.</text></paragraph> 
<paragraph id="H526E2AEF89014F5BAC3242487B3BF765"><enum>(3)</enum><header>Confidentiality</header><text>The information provided to the Commission or to a boxing commission pursuant to this subsection shall be confidential and not revealed by the Commission or a boxing commission, except that the Commission may publish an analysis of the data in aggregate form or in a manner which does not disclose confidential information about identifiable broadcasters.</text></paragraph> 
<paragraph id="H33DEE4D62A3A43FA93E6CF31188F2BD5"><enum>(4)</enum><header>Television broadcast rights</header><text>In this subsection, the term <term>television broadcast rights</term> means the right to broadcast the match, or any part thereof, via a broadcast station, cable service, or multichannel video programming distributor as such terms are defined in sections 3 and 602 of the <act-name parsable-cite="CA34">Communications Act of 1934</act-name> (47 U.S.C. 153 and 522).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H83965F633A5944D1B03120F7E01C1429"><enum>15.</enum><header>Judges and referees</header> 
<subsection id="H6292F04E2D8F4F9697835D860D335C0C"><enum>(a)</enum><header>In general</header><text>Section 16 (<external-xref legal-doc="usc" parsable-cite="usc/15/6307h">15 U.S.C. 6307h</external-xref>) is amended—</text> 
<paragraph id="H62BBFE4AF449464C924B75ABD5536AD9"><enum>(1)</enum><text>by striking <quote>No person</quote> and inserting the following:</text>

<subsection id="H362C6F0871D34BB2A8D7D95509A53E3C"><enum>(b)</enum><header>Championship and 10-Round bouts</header><text>In addition to the requirements of subsection (a), no person may arrange, promote, organize, produce, or fight in a professional boxing match advertised to the public as a championship match or in a professional boxing match scheduled for 10 rounds or more unless all referees and judges participating in the match have been licensed by the Commission.</text></subsection> 
<subsection id="HAE36E51C0F3144659EDA9227C7FC9002"><enum>(c)</enum><header>Role of sanctioning organization</header><text>A sanctioning organization may provide a list of judges and referees deemed qualified by that organization to a boxing commission, but the boxing commission shall select, license, and appoint the judges and referees participating in the match.</text></subsection> 
<subsection id="H4BED574D6B60493B9A4AB8E40DE03F7F"><enum>(d)</enum><header>Assignment of nonresident judges and referees</header><text>A boxing commission may assign judges and referees who reside outside that commission's State or Indian land.</text></subsection> 
<subsection id="HD7F11BF6DDF34D128F0F4F60E8F2AC29"><enum>(e)</enum><header>Required disclosure</header><text>A judge or referee shall provide to the boxing commission responsible for regulating a professional boxing match in a State or on Indian land a statement of all consideration, including reimbursement for expenses, that the judge or referee has received, or will receive, from any source for participation in the match. If the match is scheduled for 10 rounds or more, the judge or referee shall also provide such a statement to the Commission.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HEF3A94E94E8A4F59A84E2C1C4639C9C7"><enum>(b)</enum><header>Conforming amendment</header><text>Section 14 (<external-xref legal-doc="usc" parsable-cite="usc/15/6307f">15 U.S.C. 6307f</external-xref>) is hereby repealed.</text></subsection></section> 
<section id="HBC7A8DDD9BEF432BBA784BA783CDD1F4"><enum>16.</enum><header>Medical registry</header><text display-inline="no-display-inline">The Act, as amended by section 15, is further amended by inserting after section 13 (<external-xref legal-doc="usc" parsable-cite="usc/15/6307e">15 U.S.C. 6307e</external-xref>) the following:</text> 
<quoted-block display-inline="no-display-inline" id="H358D82A9B0E84CC9A5EB5BCFD96AF3AD" style="OLC"> 
<section id="H3B9C30FBBAAD4AD59C14241269533DDB"><enum>14.</enum><header>Medical registry</header> 
<subsection id="HBEFF2A5BC9A0418B9BA1FA40ABB056F8"><enum>(a)</enum><header>In general</header><text>The Commission shall establish and maintain, or certify a third party entity to establish and maintain, a medical registry that contains comprehensive medical records and medical denials or suspensions for every licensed boxer.</text></subsection> 
<subsection id="H8669D9403B6746B9942D1BAE2DD9E7C3"><enum>(b)</enum><header>Content; submission</header><text>The Commission shall determine—</text> 
<paragraph id="H3F5B857AF5B8479E9FB2F85898AD59BF"><enum>(1)</enum><text>the nature of medical records and medical suspensions of a boxer that are to be forwarded to the medical registry; and</text></paragraph> 
<paragraph id="H74E1D6AE7DB641D6B4897786E85CC0C1"><enum>(2)</enum><text>the time within which the medical records and medical suspensions are to be submitted to the medical registry.</text></paragraph></subsection> 
<subsection id="H1AB58AE0D674478A96C6E58A6281429B"><enum>(c)</enum><header>Confidentiality</header><text>The Commission shall establish confidentiality standards for the disclosure of personally identifiable information to boxing commissions that will—</text> 
<paragraph id="H3E866CFA1F87473CA393BEBCC06C38E3"><enum>(1)</enum><text>protect the health and safety of boxers by making relevant information available to the boxing commissions for use but not public disclosure; and</text></paragraph> 
<paragraph id="H6A06DD359E3C4C19A3083A480A805605"><enum>(2)</enum><text>ensure that the privacy of the boxers is protected.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H6825955450B74B2EB857BF9929E0BBFA"><enum>17.</enum><header>Conflicts of interest</header><text display-inline="no-display-inline">Section 17 (<external-xref legal-doc="usc" parsable-cite="usc/15/6308">15 U.S.C. 6308</external-xref>) is amended—</text> 
<paragraph id="H0A2D47250DA4420CBBABEF86ACAFF84E"><enum>(1)</enum><text>in subsection (a)—</text> 
<subparagraph id="H737BE18698354CB1A0EFE4F0853CBECE"><enum>(A)</enum><text>by striking <quote>enforces State boxing laws,</quote> and inserting <quote>implements State or tribal boxing laws, no officer or employee of the Commission,</quote>;</text></subparagraph> 
<subparagraph id="H11B5B8E81E234A078A07E60B21F483BE"><enum>(B)</enum><text>by striking <quote>belong to,</quote> and inserting <quote>hold office in,</quote>; and</text></subparagraph> 
<subparagraph id="HAA33B4B450404E62A78FAC97A49468E9"><enum>(C)</enum><text>by striking the last sentence; and</text></subparagraph></paragraph>

<subsection id="H8409036B25B844CDB89E64CC5507EBB9"><enum>(a)</enum><header>In general</header><text>The Act is amended by adding at the end the following:</text>

<title id="H874198957C0F4A5DA3A40A62B1F8BCDC"><enum>II</enum><header>United States Boxing Commission</header> 
<section id="HF1F006B17B90456F96F97F9BDB73D0D0"><enum>201.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this title is to protect the health, safety, and welfare of boxers and to ensure fairness in the sport of professional boxing.</text></section> 
<section id="HBAD2152264A843B0B60DF00CAB338E20"><enum>202.</enum><header>United States Boxing Commission</header> 
<subsection id="H961AB649DB2942F5A668335BAE2EABBD"><enum>(a)</enum><header>In general</header><text>The United States Boxing Commission is established as a commission within the Department of Commerce.</text></subsection> 
<subsection id="H48DB7136024E462E976B321A6C4D2501"><enum>(b)</enum><header>Members</header> 
<paragraph id="H54E26C7EB62E43E99FE83C0671231D9C"><enum>(1)</enum><header>In general</header><text>The Commission shall consist of 3 members appointed by the President, by and with the advice and consent of the Senate.</text></paragraph> 
<paragraph id="H2703772295F3403183EB5F3A0780F5C6"><enum>(2)</enum><header>Qualifications</header> 
<subparagraph id="H9FC26CCFEACA47A3B588821191D51972"><enum>(A)</enum><header>In general</header><text>Each member of the Commission shall be a citizen of the United States who—</text> 
<clause id="HD99C97DBF53141D99C12E429C8579A44"><enum>(i)</enum><text>has extensive experience in professional boxing activities or in a field directly related to professional sports;</text></clause> 
<clause id="H3F1ACA20FB3245CF8ED49D031B29BBB1"><enum>(ii)</enum><text>is of outstanding character and recognized integrity; and</text></clause> 
<clause id="H46C946F45CD64CA3A21684A64E002AE9"><enum>(iii)</enum><text>is selected on the basis of training, experience, and qualifications and without regard to political party affiliation.</text></clause></subparagraph> 
<subparagraph id="HBB4B3452E5D14756A4FC9457F394532D"><enum>(B)</enum><header>Specific qualifications for certain members</header><text>At least 1 member of the Commission shall be a former member of a local boxing authority. If practicable, at least 1 member of the Commission shall be a physician or other health care professional duly licensed as such.</text></subparagraph> 
<subparagraph id="H67274F7A33B84F7AA4A682A827894B8C"><enum>(C)</enum><header>Disinterested persons</header><text>No member of the Commission may, while serving as a member of the Commission—</text> 
<clause id="H3C384D1D733342AD96CFE1B916BE25F4"><enum>(i)</enum><text>be engaged as a professional boxer, boxing promoter, agent, fight manager, matchmaker, referee, judge, or in any other capacity in the conduct of the business of professional boxing;</text></clause> 
<clause id="H7A750374F9F74FD2BE5565674F4A793E"><enum>(ii)</enum><text>have any pecuniary interest in the earnings of any boxer or the proceeds or outcome of any boxing match; or</text></clause> 
<clause id="H92BA7CF3767C4E5CB8CBAE0DB703D791"><enum>(iii)</enum><text>serve as a member of a boxing commission.</text></clause></subparagraph></paragraph> 
<paragraph id="H6397D1F4BD504D2A9090DE784B12ACFB"><enum>(3)</enum><header>Bipartisan membership</header><text>Not more than 2 members of the Commission may be members of the same political party.</text></paragraph> 
<paragraph id="H2A8AAD36C7634A7092587FD11C606DDC"><enum>(4)</enum><header>Geographic balance</header><text>Not more than 2 members of the Commission may be residents of the same geographic region of the United States when appointed to the Commission. For purposes of the preceding sentence, the area of the United States east of the Mississippi River is a geographic region, and the area of the United States west of the Mississippi River is a geographic region.</text></paragraph> 
<paragraph id="HE8884B3AA8434E969B4B8E914B5B6E22"><enum>(5)</enum><header>Terms</header> 
<subparagraph id="H121FC8822B1D459D9EC1F4150C9E1309"><enum>(A)</enum><header>In general</header><text>The term of a member of the Commission shall be 3 years.</text></subparagraph> 
<subparagraph id="H95274AD1D2F6495DB8A01F1EE761A935"><enum>(B)</enum><header>Reappointment</header><text>Members of the Commission may be reappointed to the Commission.</text></subparagraph> 
<subparagraph id="H783E698F5DB748FEBE77154ACE49ABDC"><enum>(C)</enum><header>Midterm vacancies</header><text>A member of the Commission appointed to fill a vacancy in the Commission occurring before the expiration of the term for which the member's predecessor was appointed shall be appointed for the remainder of that unexpired term.</text></subparagraph> 
<subparagraph id="HF06127EAAA7C4740A01851EDDBF13457"><enum>(D)</enum><header>Continuation pending replacement</header><text>A member of the Commission may serve after the expiration of that member's term until a successor has taken office.</text></subparagraph></paragraph> 
<paragraph id="H88E1EB24B4A84AB8AC353D9958A35F99"><enum>(6)</enum><header>Removal</header><text>A member of the Commission may be removed by the President only for cause.</text></paragraph></subsection> 
<subsection id="H5347998F1AE14A32AA133A0574A71AED"><enum>(c)</enum><header>Executive director</header> 
<paragraph id="H17A00E636CA44E44828E0809E09E1BA1"><enum>(1)</enum><header>In general</header><text>The Commission shall employ an Executive Director to perform the administrative functions of the Commission under this Act, and such other functions and duties of the Commission as the Commission shall specify.</text></paragraph> 
<paragraph id="HFE669DB188944082B2EA02ADA8D271FC"><enum>(2)</enum><header>Discharge of functions</header><text>Subject to the authority, direction, and control of the Commission the Executive Director shall carry out the functions and duties of the Commission under this Act.</text></paragraph></subsection> 
<subsection id="HD06D52F8091A4C19B3E4BD77BE031CB6"><enum>(d)</enum><header>General counsel</header><text>The Commission shall employ a General Counsel to provide legal counsel and advice to the Executive Director and the Commission in the performance of its functions under this Act, and to carry out such other functions and duties as the Commission shall specify.</text></subsection> 
<subsection id="H9624108B9B564E3EBF8F9B3EDFE64AAE"><enum>(e)</enum><header>Staff</header><text>The Commission shall employ such additional staff as the Commission considers appropriate to assist the Executive Director and the General Counsel in carrying out the functions and duties of the Commission under this Act.</text></subsection> 
<subsection id="HAE4ACE66544E4BECB6B5F9DDD321578F"><enum>(f)</enum><header>Compensation</header> 
<paragraph id="H5CCD2DAE9095467390E7B00808C2BB65"><enum>(1)</enum><header>Members of commission</header> 
<subparagraph id="H8FD751FE933E4AB4A5EA234AFE16B429"><enum>(A)</enum><header>In general</header><text>Each member of the Commission shall be compensated at a rate equal to the daily equivalent of the annual rate of basic pay prescribed for level IV of the Executive Schedule under <external-xref legal-doc="usc" parsable-cite="usc/5/5315">section 5315</external-xref> of title 5, United States Code, for each day (including travel time) during which such member is engaged in the performance of the duties of the Commission.</text></subparagraph> 
<subparagraph id="HEBAA4C83604D4E578B35FA6302E354C4"><enum>(B)</enum><header>Travel expenses</header><text>The members of the Commission shall be allowed travel expenses, including per diem in lieu of subsistence, at rates authorized for employees of agencies under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code, while away from their homes or regular places of business in the performance of services for the Commission.</text></subparagraph></paragraph> 
<paragraph id="HB85D4360C71045CEA9A548DA615A269B"><enum>(2)</enum><header>Executive director and staff</header><text>The Commission shall fix the compensation of the Executive Director, the General Counsel, and other personnel of the Commission. The rate of pay for the Executive Director, the General Counsel, and other personnel may not exceed the rate payable for level V of the Executive Schedule under <external-xref legal-doc="usc" parsable-cite="usc/5/5316">section 5316</external-xref> of title 5, United States Code.</text></paragraph></subsection></section> 
<section id="H739B6003689947468F9EBAC8C575F253"><enum>203.</enum><header>Functions</header> 
<subsection id="H2F4CFA1F984F45D4A7455BDF15B92090"><enum>(a)</enum><header>Primary functions</header><text>The primary functions of the Commission are—</text> 
<paragraph id="H15E05843EB674D889107ED6B497ED169"><enum>(1)</enum><text>to protect the health, safety, and general interests of boxers consistent with the provisions of this Act; and</text></paragraph> 
<paragraph id="H55BB98EE0ED04DE586615A82FA4EF72F"><enum>(2)</enum><text>to ensure uniformity, fairness, and integrity in professional boxing.</text></paragraph></subsection> 
<subsection id="H0B6BE022366548089498A88C2803A724"><enum>(b)</enum><header>Specific functions</header><text>The Commission shall—</text> 
<paragraph id="H7EE7021F7C0B4ED9BF2D719D3EE40015"><enum>(1)</enum><text>administer title I of this Act;</text></paragraph> 
<paragraph id="H9890DA18077243A29A0D65EB06F1F96F"><enum>(2)</enum><text>promulgate uniform standards for professional boxing in consultation with the Association of Boxing Commissions;</text></paragraph> 
<paragraph id="HDEBA5CBA562243709EEB22B5480366C1"><enum>(3)</enum><text>except as otherwise determined by the Commission, oversee all professional boxing matches in the United States;</text></paragraph> 
<paragraph id="HCB96D60CB398403598868AA5E45B9518"><enum>(4)</enum><text>work with the boxing commissions of the several States and tribal organizations—</text> 
<subparagraph id="H255A1E88C61449B1AB11F51123824C5A"><enum>(A)</enum><text>to improve the safety, integrity, and professionalism of professional boxing in the United States;</text></subparagraph> 
<subparagraph id="H18B28F2067734A22A38B23AC8B5C987B"><enum>(B)</enum><text>to enhance physical, medical, financial, and other safeguards established for the protection of professional boxers; and</text></subparagraph> 
<subparagraph id="HD8777908571E49D0896EF0824894F4DF"><enum>(C)</enum><text>to improve the status and standards of professional boxing in the United States;</text></subparagraph></paragraph> 
<paragraph id="H090A95655201414BAFA37998DFBABDF9"><enum>(5)</enum><text>ensure, in cooperation with the Attorney General (who shall represent the Commission in any judicial proceeding under this Act), the chief law enforcement officer of the several States, and other appropriate officers and agencies of Federal, State, and local government, that Federal and State laws applicable to professional boxing matches in the United States are vigorously, effectively, and fairly enforced;</text></paragraph> 
<paragraph id="H59BF992FA2BF4B66BAFD3C7AFD947450"><enum>(6)</enum><text>review boxing commission regulations for professional boxing and provide assistance to such authorities in meeting minimum standards prescribed by the Commission under this title;</text></paragraph> 
<paragraph id="H0B07F22EC9424DD782CE7B1F23E377B9"><enum>(7)</enum><text>serve as the coordinating body for all efforts in the United States to establish and maintain uniform minimum health and safety standards for professional boxing;</text></paragraph> 
<paragraph id="H88A2AC7F36AC4ECD8043B979615D0E3F"><enum>(8)</enum><text>if the Commission determines it to be appropriate, publish a newspaper, magazine, or other publication and establish and maintain a website consistent with the purposes of the Commission;</text></paragraph> 
<paragraph id="H24891A97AFD14AB59F277F37C8CCBBD2"><enum>(9)</enum><text>procure the temporary and intermittent services of experts and consultants to the extent authorized by <external-xref legal-doc="usc" parsable-cite="usc/5/3109">section 3109(b)</external-xref> of title 5, United States Code, at rates the Commission determines to be reasonable; and</text></paragraph> 
<paragraph id="HF478954416D048B1BBB3BFF1043114B8"><enum>(10)</enum><text>promulgate rules, regulations, and guidance, and take any other action necessary and proper to accomplish the purposes of, and consistent with, the provisions of this title.</text></paragraph></subsection> 
<subsection id="H8231DE8E84164CA99D567948ADDA9B95"><enum>(c)</enum><header>Prohibitions</header><text>The Commission may not—</text> 
<paragraph id="H0E1995FD5B324F84A7F96C451788FF6B"><enum>(1)</enum><text>promote boxing events or rank professional boxers; or</text></paragraph> 
<paragraph id="H6EBE7239C0934A09863D26EEAE94F16D"><enum>(2)</enum><text>provide technical assistance to, or authorize the use of the name of the Commission by, boxing commissions that do not comply with requirements of the Commission.</text></paragraph></subsection> 
<subsection id="H832DE21256C5439685CE8BD6A04E48E8"><enum>(d)</enum><header>Use of name</header><text>The Commission shall have the exclusive right to use the name <quote>United States Boxing Commission</quote>. Any person who, without the permission of the Commission, uses that name or any other exclusive name, trademark, emblem, symbol, or insignia of the Commission for the purpose of inducing the sale or exchange of any goods or services, or to promote any exhibition, performance, or sporting event, shall be subject to suit in a civil action by the Commission for the remedies provided in the Act of July 5, 1946 (commonly known as the <quote>Trademark Act of 1946</quote>; <external-xref legal-doc="usc" parsable-cite="usc/15/1051">15 U.S.C. 1051 et seq.</external-xref>).</text></subsection></section> 
<section id="H77FA1EA3ABC74AE796592C5F670F132A"><enum>204.</enum><header>Licensing and registration of boxing personnel</header> 
<subsection id="H8F5B8CB42D2B4CE7B14157D47B3ADF54"><enum>(a)</enum><header>Licensing</header> 
<paragraph id="H1FC2BB6642E248E5876A71DD4CF79CA7"><enum>(1)</enum><header>Requirement for license</header><text>No person may compete in a professional boxing match or serve as a boxing manager, boxing promoter, or sanctioning organization for a professional boxing match except as provided in a license granted to that person under this subsection.</text></paragraph> 
<paragraph id="HFC211DD7004E41EA95004EFBE05B693E"><enum>(2)</enum><header>Application and term</header> 
<subparagraph id="H9B3C695BC4D64AEEB53FB167AF757C33"><enum>(A)</enum><header>In general</header><text>The Commission shall—</text> 
<clause id="H63A1DAF1F97147D596C4177CB1A3AA01"><enum>(i)</enum><text>establish application procedures, forms, and fees;</text></clause> 
<clause id="HA899AB25D85C442C9EC6131DBFAB1F72"><enum>(ii)</enum><text>establish and publish appropriate standards for licenses granted under this section; and</text></clause> 
<clause id="HB134D419EF184B83BF104C143CBC966B"><enum>(iii)</enum><text>issue a license to any person who, as determined by the Commission, meets the standards established by the Commission under this title.</text></clause></subparagraph> 
<subparagraph id="H68C70762CC584EEBB635CDE89D47638E"><enum>(B)</enum><header>Duration</header><text>A license issued under this section shall be for a renewable—</text> 
<clause id="H114827F50E9144A686F01E2B3EA02B36"><enum>(i)</enum><text>4-year term for a boxer; and</text></clause> 
<clause id="HFD030E77C48449EABD6AB4F15D9CE510"><enum>(ii)</enum><text>2-year term for any other person.</text></clause></subparagraph> 
<subparagraph id="H9D53D4C19F704972A2FFEF6F77253DD6"><enum>(C)</enum><header>Procedure</header><text>The Commission may issue a license under this paragraph through boxing commissions or in a manner determined by the Commission.</text></subparagraph></paragraph></subsection> 
<subsection id="HCDB2352D15504E1ABA10BDEF50BDA108"><enum>(b)</enum><header>Licensing fees</header> 
<paragraph id="HF1A47D9E20184933B70C0B848CCFEEDB"><enum>(1)</enum><header>Authority</header><text>The Commission may prescribe and charge reasonable fees for the licensing of persons under this title. The Commission may set, charge, and adjust varying fees on the basis of classifications of persons, functions, and events determined appropriate by the Commission.</text></paragraph> 
<paragraph id="HFC80BB9E77904417A76CD8C5F09F4D2D"><enum>(2)</enum><header>Limitations</header><text>In setting and charging fees under paragraph (1), the Commission shall ensure that, to the maximum extent practicable—</text> 
<subparagraph id="HAB70345EB09F478894EC55C398CEF8EF"><enum>(A)</enum><text>club boxing is not adversely affected;</text></subparagraph> 
<subparagraph id="H511E14F147B14EF0B39E0AE32886C626"><enum>(B)</enum><text>sanctioning organizations and promoters pay comparatively the largest portion of the fees; and</text></subparagraph> 
<subparagraph id="H0158736B4B1F42DBBCD828ADCF8EE801"><enum>(C)</enum><text>boxers pay as small a portion of the fees as is possible.</text></subparagraph></paragraph> 
<paragraph id="HE87120D2D4AA41E394F7ECECB7216C4A"><enum>(3)</enum><header>Collection</header><text>Fees established under this subsection may be collected through boxing commissions or by any other means determined appropriate by the Commission.</text></paragraph></subsection></section> 
<section id="H7B0F59A1AEC04E6298B90DC82EF470FB"><enum>205.</enum><header>National registry of boxing personnel</header> 
<subsection id="H9BAEFFB6ABC3447D87FE4045A4E059AF"><enum>(a)</enum><header>Requirement for registry</header><text>The Commission shall establish and maintain (or authorize a third party to establish and maintain) a unified national computerized registry for the collection, storage, and retrieval of information related to the performance of its duties.</text></subsection> 
<subsection id="H8F3181F64E9446B681256EBDC9783B51"><enum>(b)</enum><header>Contents</header><text>The information in the registry shall include the following:</text> 
<paragraph id="H23B1F8D57EFE4E2A8835A51D71FFF76E"><enum>(1)</enum><header>Boxers</header><text>A list of professional boxers and data in the medical registry established under section 114 of this Act, which the Commission shall secure from disclosure in accordance with the confidentiality requirements of section 114(c).</text></paragraph> 
<paragraph id="H04AEF9CD4E69441AA9EE58A290F42652"><enum>(2)</enum><header>Other personnel</header><text>Information (pertinent to the sport of professional boxing) on boxing promoters, boxing matchmakers, boxing managers, trainers, cut men, referees, boxing judges, physicians, and any other personnel determined by the Commission as performing a professional activity for professional boxing matches.</text></paragraph></subsection></section> 
<section id="HEB6E55C1C25341E789002E14A5A372DE"><enum>206.</enum><header>Consultation requirements</header><text display-inline="no-display-inline">The Commission shall consult with the Association of Boxing Commissions—</text> 
<paragraph id="H396A2FB2E0FC4306856C2D483A4CFDB9"><enum>(1)</enum><text>before prescribing any regulation or establishing any standard under the provisions of this title; and</text></paragraph> 
<paragraph id="H85AD7F71DEA542F9AA6995754A19B457"><enum>(2)</enum><text>not less than once each year regarding matters relating to professional boxing.</text></paragraph></section> 
<section id="HF802D76B05CC4A28B9092F8721622723"><enum>207.</enum><header>Misconduct</header> 
<subsection id="HFADF46B053984830833CBFF2574BDD24"><enum>(a)</enum><header>Suspension and revocation of license or registration</header> 
<paragraph id="H4E67A1CA8C124843B43F8C9DD5E8CB25"><enum>(1)</enum><header>Authority</header><text>The Commission may, after notice and opportunity for a hearing, suspend or revoke any license issued under this title if the Commission finds that—</text> 
<subparagraph id="H7720A6B7EBAC4FD6AB51C6578202F091"><enum>(A)</enum><text>the license holder has violated any provision of this Act;</text></subparagraph> 
<subparagraph id="HA914668D8A534901B5CD2D7B5977552C"><enum>(B)</enum><text>there are reasonable grounds for belief that a standard prescribed by the Commission under this title is not being met, or that bribery, collusion, intentional losing, racketeering, extortion, or the use of unlawful threats, coercion, or intimidation have occurred in connection with a license; or</text></subparagraph> 
<subparagraph id="H4DF62DA13851491B99819696946095AC"><enum>(C)</enum><text>the suspension or revocation is necessary for the protection of health and safety or is otherwise in the public interest.</text></subparagraph></paragraph> 
<paragraph id="HF273976680E74330B573FA6F57A75208"><enum>(2)</enum><header>Period of suspension</header> 
<subparagraph id="H1B20330276F940D18EB8C17B931846E7"><enum>(A)</enum><header>In general</header><text>A suspension of a license under this section shall be effective for a period determined appropriate by the Commission except as provided in subparagraph (B).</text></subparagraph> 
<subparagraph id="H1551E7B05D354D76B1AF2F5B21ED06BA"><enum>(B)</enum><header>Suspension for medical reasons</header><text>In the case of a suspension or denial of the license of a boxer for medical reasons by the Commission, the Commission may terminate the suspension or denial at any time that a physician certifies that the boxer is fit to participate in a professional boxing match. The Commission shall prescribe the standards and procedures for accepting certifications under this subparagraph.</text></subparagraph></paragraph> 
<paragraph id="H7B2C32A732BF42F4AB92361C06A7D499"><enum>(3)</enum><header>Period of revocation</header><text>In the case of a revocation of the license of a boxer, the revocation shall be for a period of not less than 1 year.</text></paragraph></subsection> 
<subsection id="HA7EE5EC66B7D4586BFC02DD4AE8700D2"><enum>(b)</enum><header>Investigations and injunctions</header> 
<paragraph id="HABB5F046514F4FB59BE5A63BD3DFB5D9"><enum>(1)</enum><header>Authority</header><text>The Commission may—</text> 
<subparagraph id="HB85BA927FE064C1EA29C552E51785EA4"><enum>(A)</enum><text>conduct any investigation that it considers necessary to determine whether any person has violated, or is about to violate, any provision of this Act or any regulation prescribed under this Act;</text></subparagraph> 
<subparagraph id="H548725A22ABC4706B4F4BBE77DA4F5FA"><enum>(B)</enum><text>require or permit any person to file with it a statement in writing, under oath or otherwise as the Commission shall determine, as to all the facts and circumstances concerning the matter to be investigated;</text></subparagraph> 
<subparagraph id="H8E35EEAA54794F3CBA36B3CA3446C6EF"><enum>(C)</enum><text>in its discretion, publish information concerning any violations; and</text></subparagraph> 
<subparagraph id="H3F757F2CDC66459AAE933657A0D89E17"><enum>(D)</enum><text>investigate any facts, conditions, practices, or matters to aid in the enforcement of the provisions of this Act, in the prescribing of regulations under this Act, or in securing information to serve as a basis for recommending legislation concerning the matters to which this Act relates.</text></subparagraph></paragraph> 
<paragraph id="H766D7C7BBF4F4C69BC675C5EB1749A38"><enum>(2)</enum><header>Powers</header> 
<subparagraph id="H9EB43CCB36B94AF391ED6C767F31A8F9"><enum>(A)</enum><header>In general</header><text>For the purpose of any investigation under paragraph (1) or any other proceeding under this title—</text> 
<clause id="H2522B28CF5584FC19CED62014EC0844C"><enum>(i)</enum><text>any officer designated by the Commission may administer oaths and affirmations, subpoena or otherwise compel the attendance of witnesses, take evidence, and require the production of any books, papers, correspondence, memoranda, or other records the Commission considers relevant or material to the inquiry; and</text></clause> 
<clause id="H8D10CC81AC3F49188A72A746E3AACB5E"><enum>(ii)</enum><text>the provisions of sections <external-xref legal-doc="usc" parsable-cite="usc/18/6002">6002</external-xref> and <external-xref legal-doc="usc" parsable-cite="usc/18/6004">6004</external-xref> of title 18, United States Code, shall apply.</text></clause></subparagraph> 
<subparagraph id="H303A74A878B94749B3E2FC24B6574CD4"><enum>(B)</enum><header>Witnesses and evidence</header><text>The attendance of witnesses and the production of any documents under subparagraph (A) may be required from any place in the United States, including Indian land, at any designated place of hearing.</text></subparagraph></paragraph> 
<paragraph id="H212E00888AA5428F8852DD6D2F6C1661"><enum>(3)</enum><header>Enforcement of subpoenas</header> 
<subparagraph id="HC7B1716A7F9D434288C2F0E2F8ED773F"><enum>(A)</enum><header>Civil action</header><text>In case of contumacy by, or refusal to obey a subpoena issued to, any person, the Commission may file an action in any district court of the United States within the jurisdiction of which an investigation or proceeding is carried out, or where that person resides or carries on business, to enforce the attendance and testimony of witnesses and the production of books, papers, correspondence, memorandums, and other records. The court may issue an order requiring the person to appear before the Commission to produce records, if so ordered, or to give testimony concerning the matter under investigation or in question.</text></subparagraph> 
<subparagraph id="HC2756D5B3F7941C3B6CBC1E22C0755B5"><enum>(B)</enum><header>Failure to obey</header><text>Any failure to obey an order issued by a court under subparagraph (A) may be punished as contempt of that court.</text></subparagraph> 
<subparagraph id="HC9F2C270289B47B888C464281AC91D29"><enum>(C)</enum><header>Process</header><text>All process in any contempt case under subparagraph (A) may be served in the judicial district in which the person is an inhabitant or in which the person may be found.</text></subparagraph></paragraph> 
<paragraph id="H125AE65DD4E7433B8AECF17BB97519DD"><enum>(4)</enum><header>Evidence of criminal misconduct</header> 
<subparagraph id="HDF4E98A34E524604874A578002083BF0"><enum>(A)</enum><header>In general</header><text>No person may be excused from attending and testifying or from producing books, papers, contracts, agreements, and other records and documents before the Commission, in obedience to the subpoena of the Commission, or in any cause or proceeding instituted by the Commission, on the ground that the testimony or evidence, documentary or otherwise, required of that person may tend to incriminate the person or subject the person to a penalty or forfeiture.</text></subparagraph> 
<subparagraph id="HBCF30E123CED4C549A384346086651DE"><enum>(B)</enum><header>Limited immunity</header><text>No individual may be prosecuted or subject to any penalty or forfeiture for, or on account of, any transaction, matter, or thing concerning the matter about which that individual is compelled, after having claimed a privilege against self-incrimination, to testify or produce evidence, documentary or otherwise, except that the individual so testifying shall not be exempt from prosecution and punishment for perjury committed in so testifying.</text></subparagraph></paragraph> 
<paragraph id="HB52B8BC275374D6E85192181CD061B49"><enum>(5)</enum><header>Injunctive relief</header><text>If the Commission determines that any person is engaged or about to engage in any act or practice that constitutes a violation of any provision of this Act, or of any regulation prescribed under this Act, the Commission may bring an action in the appropriate district court of the United States, the United States District Court for the District of Columbia, or the United States courts of any territory or other place subject to the jurisdiction of the United States, to enjoin the act or practice, and upon a proper showing, the court shall grant without bond a permanent or temporary injunction or restraining order.</text></paragraph> 
<paragraph id="HCA1468CAE98F40B49CF5AB20303B1E0C"><enum>(6)</enum><header>Mandamus</header><text>Upon application of the Commission, the district courts of the United States, the United States District Court for the District of Columbia, and the United States courts of any territory or other place subject to the jurisdiction of the United States, shall have jurisdiction to issue writs of mandamus commanding any person to comply with the provisions of this Act or any order of the Commission.</text></paragraph></subsection> 
<subsection id="HB4F940C1654146D39834EEC766E4A678"><enum>(c)</enum><header>Intervention in civil actions</header> 
<paragraph id="H8C1D0508F4CD4A2395CCB01E2A18C5D3"><enum>(1)</enum><header>In general</header><text>The Commission, on behalf of the public interest, may intervene of right as provided under rule 24(a) of the Federal Rules of Civil Procedure in any civil action relating to professional boxing filed in a district court of the United States.</text></paragraph> 
<paragraph id="H9F7751F382EF4697B2F81FBB60A59A9F"><enum>(2)</enum><header>Amicus filing</header><text>The Commission may file a brief in any action filed in a court of the United States on behalf of the public interest in any case relating to professional boxing.</text></paragraph></subsection> 
<subsection id="H091EF9A7968D43A8B040E60B93604692"><enum>(d)</enum><header>Hearings by commission</header><text>Hearings conducted by the Commission under this Act shall be public and may be held before any officer of the Commission. The Commission shall keep appropriate records of the hearings.</text></subsection></section> 
<section id="HD42B732A4DFD49E19517F6E74A95EE66"><enum>208.</enum><header>Noninterference with boxing commissions</header> 
<subsection id="H528CC8D66E4C48529CF2308A7D835C84"><enum>(a)</enum><header>Noninterference</header><text>Nothing in this Act prohibits any boxing commission from exercising any of its powers, duties, or functions with respect to the regulation or supervision of professional boxing or professional boxing matches to the extent not inconsistent with the provisions of this Act.</text></subsection> 
<subsection id="H6597680675724E94B59B5A6EDA4885A2"><enum>(b)</enum><header>Minimum standards</header><text>Nothing in this Act prohibits any boxing commission from enforcing local standards or requirements that exceed the minimum standards or requirements promulgated by the Commission under this Act.</text></subsection></section> 
<section id="HB9CDC964786D42F8AFDCDAD000D8B096"><enum>209.</enum><header>Assistance from other agencies</header><text display-inline="no-display-inline">Any employee of any executive department, agency, bureau, board, commission, office, independent establishment, or instrumentality may be detailed to the Commission, upon the request of the Commission, on a reimbursable or nonreimbursable basis, with the consent of the appropriate authority having jurisdiction over the employee. While so detailed, an employee shall continue to receive the compensation provided pursuant to law for the employee's regular position of employment and shall retain, without interruption, the rights and privileges of that employment.</text></section> 
<section id="H17CD60DD747D4144B32231A529F3480B"><enum>210.</enum><header>Reports</header> 
<subsection id="HE19679D2B3BA41E495751E0D6CDDBF4D"><enum>(a)</enum><header>Annual report</header><text>Not less frequently than once each year, the Commission shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives a report on its activities. The annual report shall include—</text> 
<paragraph id="H4FB69D372CDD417AB69B42B04BF9252B"><enum>(1)</enum><text>a detailed discussion of the activities of the Commission for the year covered by the report; and</text></paragraph> 
<paragraph id="H1ABE69B85A3A445BA7E73A0F02C22E40"><enum>(2)</enum><text>an overview of the licensing and enforcement activities of the State and tribal organization boxing commissions.</text></paragraph></subsection> 
<subsection id="H8DE8696FF8134165B0F272DB3C5C07D8"><enum>(b)</enum><header>Public report</header><text>Not less frequently than once each year, the Commission shall issue and publicize a report of the Commission on the progress made at Federal and State levels and on Indian lands in the reform of professional boxing, which shall include comments on issues of continuing concern to the Commission.</text></subsection> 
<subsection id="HA173F29F6C8E4586AD18E6A109AF2D8F"><enum>(c)</enum><header>First annual report on the commission</header><text>The first annual report under this title shall be submitted not later than 2 years after the effective date of this title.</text></subsection></section> 
<section id="HE3238C473C944CFEBFDB341857040A9E"><enum>211.</enum><header>Initial implementation</header> 
<subsection id="HBCCBFC439C0E4A0D9CDAD055BC291081"><enum>(a)</enum><header>Temporary exemption</header><text>The requirements for licensing under this title do not apply to a person for the performance of an activity as a boxer, boxing judge, or referee, or the performance of any other professional activity in relation to a professional boxing match, if the person is licensed by a boxing commission to perform that activity as of the effective date of this title.</text></subsection> 
<subsection id="H323BAC48C59542B298B37D2A0CDD3C53"><enum>(b)</enum><header>Expiration</header><text>The exemption under subsection (a) with respect to a license issued by a boxing commission expires on the earlier of—</text> 
<paragraph id="H997A6819F3574D4688402BBACF20024C"><enum>(1)</enum><text>the date on which the license expires; or</text></paragraph> 
<paragraph id="HE3448B9972654B218E9EE283DC621953"><enum>(2)</enum><text>the date that is 2 years after the date of the enactment of the <short-title>Professional Boxing Amendments Act of 2013</short-title>.</text></paragraph></subsection></section> 
<section id="H944EE0562D104203BAE77F8948B236BC"><enum>212.</enum><header>Authorization of appropriations</header> 
<subsection id="H65F8C88DE9204F749DE479318F95778B"><enum>(a)</enum><header>In general</header><text>There are authorized to be appropriated for the Commission for each fiscal year such sums as may be necessary for the Commission to perform its functions for that fiscal year.</text></subsection> 
<subsection id="H9753BFFE18B64489B8CAB904ECFF3E3C"><enum>(b)</enum><header>Receipts credited as offsetting collections</header><text>Notwithstanding <external-xref legal-doc="usc" parsable-cite="usc/31/3302">section 3302</external-xref> of title 31, United States Code, any fee collected under this title—</text> 
<paragraph id="H3FED08879F1D4593A1FFADD8894E20AE"><enum>(1)</enum><text>shall be credited as offsetting collections to the account that finances the activities and services for which the fee is imposed;</text></paragraph> 
<paragraph id="H681257351EB34EC38ED122CAFB5AC5EF"><enum>(2)</enum><text>shall be available for expenditure only to pay the costs of activities and services for which the fee is imposed; and</text></paragraph> 
<paragraph id="H0501BB02891B46DFBA60D29E1397D813"><enum>(3)</enum><text>shall remain available until expended.</text></paragraph></subsection></section></title><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<subsection id="H4D58EE84DA984394928C37EADE17337E"><enum>(a)</enum><header>Study</header><text>The United States Boxing Commission shall conduct a study on how the term <term>promoter</term> should be defined for purposes of the Professional Boxing Safety Act, as redesignated by section 21(b)(1)(A).</text></subsection> 
<subsection id="HA5CF34051C69418FA85D6EE813F6C311"><enum>(b)</enum><header>Hearings</header><text>As part of that study, the Commission shall hold hearings and solicit testimony at those hearings from boxers, managers, promoters, premium, cable, and satellite program service providers, hotels, casinos, resorts, and other commercial establishments that host or sponsor professional boxing matches, and other interested parties with respect to the definition of that term as it is used in the Professional Boxing Safety Act, as so redesignated.</text></subsection> 
<subsection id="H393883898DEA48079B7D1F7D686B364B"><enum>(c)</enum><header>Report</header><text>Not later than 1 year after the date of the enactment of this Act, the Commission shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives a report on the study conducted under subsection (a). The report shall—</text> 
<paragraph id="H094290471E04439E9ED112723B6ECD53"><enum>(1)</enum><text>set forth a proposed definition of the term <term>promoter</term> for purposes of the Professional Boxing Safety Act, as redesignated; and</text></paragraph> 
<paragraph id="HF850ED8BB4624474BA4D56EA02BF8450"><enum>(2)</enum><text>describe the findings, conclusions, and rationale of the Commission for the proposed definition, together with any recommendations of the Commission, based on the study.</text></paragraph></subsection></section>

<subsection id="HC8AACDA2603B495BB508416B93AE8466"><enum>(a)</enum><header>In general</header><text>Except as provided in subsection (b), the amendments made by this Act shall take effect on the date of enactment of this Act.</text></subsection> 
<subsection id="H85192E833DE84DADB326FBA65935DC5D"><enum>(b)</enum><header>1-Year delay for certain title II provisions</header><text>Sections 205 through 212 of the Professional Boxing Safety Act (as redesignated by section 21(b)(1)(A)), as added by section 21(a), shall take effect 1 year after the date of enactment of this Act.</text></subsection></section>
