<official-title>To amend title XVIII of the Social Security Act to provide for required Medicare hospice program surveys, and for other purposes.</official-title>

<section id="HA30B981F36D448FF9F35C30AC4EE8EAF" section-type="section-one"><enum>1</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hospice Opportunities for Supporting Patients with Integrity and Care Evaluations (HOSPICE) Act of 2014</short-title></quote>. </text></section> 
<section id="HEB99A1D7F7754C149A56DBF0C195805A"><enum>2.</enum><header>Hospice survey requirement</header> 
<subsection id="HB85BF95802384CD39F66A6CF6F9BA032"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1861(dd)(4) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(dd)(4)</external-xref>) is amended by adding at the end the following new subparagraph:</text> 
<quoted-block display-inline="no-display-inline" id="HBA13A254A9B8405D8D49EBEDCBBE67AD" style="OLC"> 
<subparagraph id="HA9146D02A5CE407B8F003FE43BBBD380" indent="up2"><enum>(c)</enum><text display-inline="yes-display-inline">Any entity that is certified as a hospice program shall be subject to a standard survey by an appropriate State or local survey agency, or an approved accreditation agency, as determined by the Secretary, not less frequently than once every 36 months beginning 6 months after the date of the enactment of this subparagraph.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HA36B300E7A5D483D81C7143A2ECD907D"><enum>(b)</enum><header>Funding</header><text display-inline="yes-display-inline">For purposes of carrying out subparagraph (C) of section 1861(dd)(4) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(dd)(4)</external-xref>), as added by subsection (a), there shall be transferred from the Federal Hospital Insurance Trust Fund under section 1817 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i">42 U.S.C. 1395i</external-xref>) $25,000,000 for the period of fiscal years 2014 through 2016, to be made available for such purposes in equal parts for each such fiscal year.</text></subsection> </section> 
<section id="HFA27E317117E48FE9C0855796718168D"><enum>3.</enum><header>Hospice program eligibility recertification technical correction to apply limitation on liability of beneficiary rules</header><text display-inline="no-display-inline">Section 1879 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395pp">42 U.S.C. 1395pp</external-xref>) is amended by adding at the end the following new subsection:</text>

<subsection id="H5966A732475B419291B20FBD247F2927"><enum>(I)</enum><text display-inline="yes-display-inline">The provisions of this section shall apply with respect to a denial of a payment under this title by reason of section 1814(a)(7)(D)(ii) in the same manner as such provisions apply with respect to a denial of a payment under this title by reason of section 1862(a)(1).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
