<section id="HC3C598854A1B46E3B8EFA14A762EFC25" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Donbass People’s Militia Terrorist Designation Act of 2014</short-title></quote>.</text></section>
<section id="H2E9A6326D7DA4FCEB01EC9D8618268A9"><enum>2.</enum><header>Sense of Congress on designation of the Donbass People’s Militia as a foreign terrorist organization</header>
<subsection id="HEB5FE38982B1439484A91E0B00FE1DFF"><enum>(a)</enum><header>Findings</header><text>Congress finds the following:</text>
<paragraph id="H6EFE7387C43C4969B4B67397BC9A6146"><enum>(1)</enum><text display-inline="yes-display-inline">The Donbass People’s Militia (DPM) is an armed militia with allegiance to the Donestsk People’s Republic, a self-proclaimed State in Eastern Europe. </text></paragraph>
<paragraph id="HF44873485F004DFAB2D4016CF40528D0"><enum>(2)</enum><text>The organization consists of pro-Russian separatists that have taken up arms against the Ukrainian Armed Forces and the Government of Ukraine. </text></paragraph>
<paragraph id="HA4BBE3F766F744E2AD98F32371476802"><enum>(3)</enum><text>The Government of Ukraine has concluded that the DPM is responsible for shooting down Malaysian Airlines Flight 17 on July 17, 2014. </text></paragraph>
<paragraph id="H6279128A95E74CA39F7980924A4A22A0"><enum>(4)</enum><text>The actions of the DPM resulted in the deaths of 283 passengers, 80 of them children, and 15 crew members. </text></paragraph>
<paragraph id="H86C51B3242FA4F71B72D384EDAAAF4BD"><enum>(5)</enum><text>A United Nations report released May 15, 2014, concluded that <quote>in eastern Ukraine, freedom of expression is under particular attack through the harassment of, and threats to, journalists and media outlets and the increasing prevalence of hate speech is further fuelling tensions (Section I, Article 5, Section vi).</quote>.</text></paragraph>
<paragraph id="H5FC85F5F35E84238B33499FE3BD5C0A5"><enum>(6)</enum><text>According to the United Nations report, <quote>Armed groups continue to illegally seize and occupy public and administrative buildings in cities and towns of the eastern regions and proclaim <quote>self-declared regions</quote></quote>.</text></paragraph>
<paragraph id="H7C1F21806BF54B7FB0DC0D842FB3F823"><enum>(7)</enum><text>Leaders and members of these armed groups commit an increasing number of human rights abuses, such as abductions, harassment, unlawful detentions, in particularly of journalists. This is leading to a breakdown in law and order and a climate of intimidation and harassment (Section I, Article 5, Section ii). </text></paragraph>
<paragraph id="H77BE29C472BE4C019D5FEFC4F46AEB6B"><enum>(8)</enum><text>A report by the highly respected human rights advocacy organization, Human Rights Watch, found that <quote>Anti-Kiev forces in eastern Ukraine are abducting, attacking, and harassing people they suspect of supporting the Ukrainian government or consider undesirable.</quote>.</text></paragraph>
<paragraph id="H0B15E30895554B49BE6358ADBCCE6CE0"><enum>(9)</enum><text>Militants in the self-proclaimed Donestsk People’s Republic have taken hostages and have yet to release them.</text></paragraph>
<paragraph id="H4394BB6C2AD2493A9F122C3E94255EB2"><enum>(10)</enum><text>According to a report by the United Nations High Commissioner for Refugees, the actions of DPM and other militant groups have caused over 100,000 Ukrainians to flee their country as refugees and have also displaced approximately 54,000 citizens internally.</text></paragraph></subsection>
<subsection id="H6B1554C5532B475580FEA5DCB2E9FBB7"><enum>(b)</enum><header>Criteria</header><text>Section 219(a)(1) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1189">8 U.S.C. 1189(a)(1)</external-xref>) provides the 3 criteria for the designation of an organization as a foreign terrorist organization:</text>
<paragraph id="HD46439D11D4344C4A7D7ECA6B71C3C9F"><enum>(1)</enum><text>The organization must be a foreign organization.</text></paragraph>
<paragraph id="H9C39AD27AC314EBE8F888A53A5E1CCF2"><enum>(2)</enum><text>The organization must engage in terrorist activity, as defined in section 212(a)(3)(B) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(3)(B)</external-xref>), or terrorism, as defined in section 140(d)(2) of the Foreign Relations Authorization Act, Fiscal Years 1988 and 1989 (<external-xref legal-doc="usc" parsable-cite="usc/22/2656f">22 U.S.C. 2656f(d)(2)</external-xref>), or retain the capability and intent to engage in terrorist activity or terrorism.</text></paragraph>
<paragraph id="H4D79FEC9B9D446B4A2886F59AE06527F"><enum>(3)</enum><text>The organization’s terrorist activity or terrorism must threaten the security of United States nationals or the national security (national defense, foreign relations, or the economic interests) of the United States.</text></paragraph></subsection>
<subsection id="HD3B87698AA2E446DAEDBBEF1A6F934DA"><enum>(c)</enum><header>Sense of Congress</header><text>It is the sense of Congress that—</text>
<paragraph id="H3F0210F1DDF94C52804511ECE373D71F"><enum>(1)</enum><text>the Donbass People’s Militia has met the criteria for designation as a foreign terrorist organization under section 219 of the Immigration and Nationality Act (as described in subsection (b)); and</text></paragraph>
<paragraph id="HA0EDB0C2204949EE90A4691B1A6E7093"><enum>(2)</enum><text>the Secretary of State, in consultation with the Attorney General and the Secretary of the Treasury, should exercise the Secretary of State’s statutory authority and designate the Donbass People’s Militia as a foreign terrorist organization.</text></paragraph></subsection>
<subsection id="HFE94EC1AD3CA40C6B2E2BD50CF5ACB2E"><enum>(d)</enum><header>Report</header><text>If the Secretary of State does not designate the Donbass People’s Militia as a foreign terrorist organization under section 219 of the Immigration and Nationality Act within 60 days after the date of the enactment of this Act, the Secretary of State shall submit to Congress a report that contains the reasons therefor.</text></subsection></section>
<section id="H12BFF7CE5BC54F7A9A974575083BADBD"><enum>3.</enum><header>Sanctions against persons who knowingly provide material support or resources to the Donbass People’s Militia or its affiliates, associated groups, or agents</header>
<subsection id="H62B90D52269B4AC2958D7E8D511DEEE5"><enum>(a)</enum><header>Sanctions</header>
<paragraph id="H060A84C8008E40838A3192EBB31DC4BE"><enum>(1)</enum><header>In general</header><text>The President shall subject to all available sanctions any person in the United States or subject to the jurisdiction of the United States who knowingly provides material support or resources to the Donbass People’s Militia or its affiliates, associated groups, or agents.</text></paragraph>
<paragraph id="HB3C8B7CA9EA043E098FA1D4FC4CFFB7F"><enum>(2)</enum><header>Definition</header><text>In this paragraph, the term <term>material support or resources</term> has the meaning given such term in <external-xref legal-doc="usc" parsable-cite="usc/18/2339A">section 2339A(b)(1)</external-xref> of title 18, United States Code.</text></paragraph></subsection>
<subsection id="HD5CC9EC3C0A345328DC8E2CE86586955"><enum>(b)</enum><header>Inadmissibility and removal</header>
<paragraph id="HCE9411EDB8724CA28E6B00935DDBDFB0"><enum>(1)</enum><header>Inadmissability</header><text>Notwithstanding any other provision of law, the Secretary of State may not issue any visa to, and the Secretary of Homeland Security shall deny entry to the United States of, any member or representative of the Donbass People’s Militia or its affiliates, associated groups, or agents.</text></paragraph>
<paragraph id="HF8F976DEA98F49BDB7D1EF2994D29071"><enum>(2)</enum><header>Removal</header><text>Any alien who is a member or representative of the Donbass People’s Militia or its affiliates, associated groups, or agents may be removed from the United States in the same manner as an alien who is inadmissible under sections 212(a)(3)(B)(i)(IV) or (V) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(3)(B)(i)(IV)</external-xref> or (V)).</text></paragraph></subsection>
<subsection id="HF402C849D5044D55AAC2569E954D9EC5"><enum>(c)</enum><header>Funds</header><text>Any United States financial institution (as defined under <external-xref legal-doc="usc" parsable-cite="usc/31/5312">section 5312</external-xref> of title 31, United States Code) that knowingly has possession of or control over funds in which the Donbass People’s Militia or its affiliates, associated groups, or agents have an interest shall retain possession of or control over the funds and report the funds to the Office of Foreign Assets Control of the Department of the Treasury.</text></subsection></section>
