<section id="HDC532FE634034ACBABF1C2A863670FEA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Medicare Telehealth Parity Act of 2014</short-title></quote>.</text> </section>
<section id="H3D259F63CB974F5697467FF5B41C704A"><enum>2.</enum><header>Phased-in expansion of telehealth coverage under Medicare</header> 
<subsection id="H781AF4DEF47247A297DB046FD29E4132"><enum>(a)</enum><header>Initial phase</header> 
<paragraph id="H10C59F6F925A44FEBDB1B3759FEE98EB"><enum>(1)</enum><header>Expansion of originating sites</header><text display-inline="yes-display-inline">Section 1834(m)(4)(C) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(4)(C)</external-xref>) is amended—</text> 
<subparagraph id="H8D22E26A6EA8444693D9B8E7501AB17A"><enum>(A)</enum><text>in clause (i), by striking <quote>The term</quote> and inserting <quote>Subject to clause (iii), the term</quote>; and</text> </subparagraph>
<subparagraph id="H14EAA4292E2245898E83819881733ADA"><enum>(B)</enum><text>by adding at the end the following new clause:</text> 
<quoted-block display-inline="no-display-inline" id="HFCF3ED2ACFAB4954A582A53ADBCAAEC4" style="OLC"> 
<clause id="HDEC768A7913C4862AE003157ABAC1DF7"><enum>(iii)</enum><header>Additional sites</header><text display-inline="yes-display-inline">The term <quote>originating site</quote> shall also include the following sites at which the eligible telehealth individual is located at the time the service is furnished via a telecommunications system, whether or not they are located in an area described in clause (i), insofar as such sites are not otherwise included in the definition of originating site under such clause:</text> 
<subclause id="H3100CB3016144532B6F99CF11D1181E4"><enum>(I)</enum><text display-inline="yes-display-inline">In the case of such a service furnished on or after the date that is 6 months after the date of the enactment of the Medicare Telehealth Parity Act of 2014, any Federally qualified health center and any rural health clinic (as such terms are defined in section 1861(aa)).</text> </subclause>
<subclause id="HD69901EE33474A0AAAC4969E8E07B0C4"><enum>(II)</enum><text display-inline="yes-display-inline">In the case of such a service furnished on or after the date that is 6 months after the date of the enactment of the Medicare Telehealth Parity Act of 2014, any site described in clause (ii) that is located in a county within a Metropolitan Statistical Area with a population of fewer than 50,000 individuals, according to the most recent decennial census.</text> </subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block> </subparagraph></paragraph>
<paragraph id="H2017A062DD2F41ADBCEBD4D9E400E1FD"><enum>(2)</enum><header>Originating site fee not to apply to additional sites</header><text display-inline="yes-display-inline">Section 1834(m)(2)(B) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(4)(C)</external-xref>) is amended by inserting after and below clause (ii) the following:</text> 
<quoted-block display-inline="no-display-inline" id="HAA843796B3DA4352A0A4B2FCA5A2B744" style="OLC"> 
<quoted-block-continuation-text quoted-block-continuation-text-level="subparagraph">The facility fee under this subparagraph shall not apply to any site included as an originating site pursuant to clause (iii) of paragraph (4)(C) that would not otherwise be included as an originating site without application of such clause.</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph>
<paragraph id="HAB81BFC703D34CD0B1B45503B2F48B85"><enum>(3)</enum><header>Additional telehealth providers</header><text display-inline="yes-display-inline">Section 1834(m) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)</external-xref>) is amended—</text> 
<subparagraph id="H8AECA5FB4CB14A0BA84A2F4C5DDEE907"><enum>(A)</enum><text>in paragraph (1), by striking <quote>or a practitioner (described in section 1842(b)(18)(C))</quote> and inserting <quote>or a practitioner (as defined in paragraph (4)(E))</quote>; and</text> </subparagraph>
<subparagraph id="H872B61D4AF6C48F2BA872EA93435C903"><enum>(B)</enum><text>in paragraph (4), by—</text> 
<clause id="H90A238E92FD444BFBB85607EE90A3946"><enum>(i)</enum><text>striking subparagraph (E); and</text> </clause>
<clause id="HFF71C31FEDB9480BA6DE916B92D90BEC"><enum>(ii)</enum><text>inserting after subparagraph (D) the following new subparagraph:</text> 
<quoted-block display-inline="no-display-inline" id="HE6ABE5E960AE4216B71986744A8ECFA7" style="OLC"> 
<subparagraph id="HAEAB8640096E4E8BB420EE99A09E5041"><enum>(E)</enum><header>Practitioner</header><text display-inline="yes-display-inline">The term <quote>practitioner</quote> means—</text> 
<clause id="HB1274C7B624244C49474F4A6F9BE90ED"><enum>(i)</enum><text display-inline="yes-display-inline">a practitioner described in section 1842(b)(18)(C); and</text> </clause>
<clause id="H5EBA2D2FBAC941A0868735FE739DBB71"><enum>(ii)</enum><text display-inline="yes-display-inline">with respect to services furnished on or after the date that is 6 months after the date of the enactment of the Medicare Telehealth Parity Act of 2014, a certified diabetes educator or licensed—</text> 
<subclause id="H42B4CDA05E2D41D68A992C4E29329E7B"><enum>(I)</enum><text>respiratory therapist;</text> </subclause>
<subclause id="HE2064EAA6D9043A28278FF00B36E7B9B"><enum>(II)</enum><text>audiologist;</text> </subclause>
<subclause id="HE3EA9A741C344E78A846614C86B3E332"><enum>(III)</enum><text>occupational therapist;</text> </subclause>
<subclause id="HBBD522D237E74381AC4DCC2F0C318EBD"><enum>(IV)</enum><text>physical therapist; or</text> </subclause>
<subclause id="HD1EF219D6C08445BB2F7D091DA0B741B"><enum>(V)</enum><text>speech language pathologist.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </clause></subparagraph></paragraph>
<paragraph id="H4B686A21B8084C25983B88AD9FE91BEA"><enum>(4)</enum><header>Coverage of remote patient management services for certain chronic health conditions</header> 
<subparagraph id="H57D8132FF16C422A9AE609EC36A46921"><enum>(A)</enum><header>In general</header><text>Section 1861(s)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(s)(2)</external-xref>) is amended—</text> 
<clause id="HDABFF7C3206F4B79B3816F5833DEE400"><enum>(i)</enum><text>in subparagraph (EE), by striking <quote>and</quote> at the end;</text> </clause>
<clause id="H0024C7007E754BC99AE688D3139EA41B"><enum>(ii)</enum><text>in subparagraph (FF), by inserting <quote>and</quote> at the end; and</text> </clause>
<clause id="HC99250829E234C2BA366312A892AE15D"><enum>(iii)</enum><text>by inserting after subparagraph (FF) the following new subparagraph:</text> 
<quoted-block id="H25CE1ECCB10E46E0A12A0645FF5C4945" style="OLC"> 
<subitem id="idF48D75197528448ABD69E1267CB14A0E" indent="up5"><enum>(GG)</enum><text>remote patient management services (as defined in subsection (iii));</text></subitem><after-quoted-block>.</after-quoted-block></quoted-block> </clause></subparagraph>
<subparagraph id="HD0579B3358364CBCB1F005DB328E72A2"><enum>(B)</enum><header>Services described</header><text>Section 1861 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x</external-xref>) is amended by adding at the end the following new subsection:</text> 
<quoted-block display-inline="no-display-inline" id="H0E259F046D1E4D94A0C650C61129C5E6" other-style="archaic" style="traditional"> 
<subsection id="H3376B4D0C1DF454DA95ECE63D3C2B282"><enum>(iii)</enum><header>Remote patient management services for chronic health conditions</header> 
<paragraph commented="no" display-inline="yes-display-inline" id="HF8E0AD250DD04B7989A795F8C83E9CAB"><enum>(1)</enum><text>The term <term>remote patient management services</term> means the remote monitoring, evaluation, and management of an individual with a covered chronic health condition (as defined in paragraph (2)), insofar as such monitoring, evaluation, and management is with respect to such condition, through the utilization of a system of technology that allows a remote interface to collect and transmit clinical data between the individual and the responsible physician (as defined in subsection (r)) or practitioner or other supplier (as defined in subsection (d)) for the purposes of clinical review. Such services shall include in-home technology based professional consultations, patient monitoring, patient training services, clinical observation, assessment, treatment, and any other services that utilize technologies specified by the Secretary. Such term shall not include a telecommunication that consists solely of a telephone audio conversation, facsimile, or electronic text mail between a health care professional and patient.</text> </paragraph>
<paragraph id="HA737500F11FA46D58402D40AA8D02281" indent="up1"><enum>(2)</enum><text>For purposes of paragraph (1), the term <term>covered chronic health condition</term> means—</text> 
<subparagraph id="H6A842620CC0C4481AA51823C4CFF79FB"><enum>(A)</enum><text>congestive heart failure;</text> </subparagraph>
<subparagraph id="HF8813B22CDC148E69BBE5451B735AD49"><enum>(B)</enum><text>chronic obstructive pulmonary disease; and</text> </subparagraph>
<subparagraph id="H3B3DDF0BDE6046DABD2696C09E9A51C7"><enum>(C)</enum><text>in the case of services furnished at a federally qualified health center, diabetes.</text> </subparagraph></paragraph>
<paragraph display-inline="no-display-inline" id="HFF63DA51F2284367AA5399AE1B8D94CE" indent="up1"><enum>(3)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="HDC042F013C044D99803422E91A95CC29"><enum>(A)</enum><text>The Secretary, in consultation with appropriate physician, practitioner, and supplier groups, shall develop guidelines on the frequency of billing for remote patient management services. Such guidelines shall be determined based on medical necessity and shall be sufficient to ensure appropriate and timely monitoring of individuals being furnished such services.</text> </subparagraph>
<subparagraph id="HC84BF78DDE3C4EAA979771D2B4448E1C" indent="up1"><enum>(B)</enum><text>The Secretary shall do the following:</text> 
<clause id="HD786D3511D0443F4B2DBDBF0CA202A17"><enum>(i)</enum><text>Not later than 2 years after the date of the enactment of this subsection, develop, in consultation with appropriate physician, practitioner, and supplier groups, standards (governing such matters as qualifications of personnel and the maintenance of equipment) for remote patient management services for the covered chronic health conditions specified in paragraph (2).</text> </clause>
<clause id="HC2572C333303494C9864BB816AFC18B8"><enum>(ii)</enum><text>Periodically review and update such standards under this subparagraph as necessary.</text> </clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subparagraph>
<subparagraph id="H6E93F9A2EE634107A16E78DCDFE6DBEF"><enum>(C)</enum><header>Payment under the physician fee schedule</header><text>Section 1848 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-4">42 U.S.C. 1395w–4</external-xref>) is amended—</text> 
<clause id="HA944D340C617429ABC4D656939D81EB8"><enum>(i)</enum><text>in subsection (c)—</text> 
<subclause id="HFB757782B8044FF6919ABEC1E3AE7A4C"><enum>(I)</enum><text>in paragraph (2)((B)—</text> 
<item id="H791F5ADECC7642768BDED50E2880104B"><enum>(aa)</enum><text>in clause (ii)(II), by striking <quote>and (v)</quote> and inserting <quote>(v), and (vii)</quote>; and</text> </item>
<item id="H3127E968B4354A04B8AE1E35CAE9783A"><enum>(bb)</enum><text>by adding at the end the following new clause:</text> 
<quoted-block id="HC19728D7FBE94C8E83B98E2796DA10F0" style="OLC"> 
<clause id="H9F362D12185C46D1AFB8A6CDFFDE948A"><enum>(vii)</enum><header>Budgetary treatment of certain services</header><text>The additional expenditures attributable to services described in section 1861(s)(2)(GG) shall not be taken into account in applying clause (ii)(II).</text> </clause><after-quoted-block>; and</after-quoted-block></quoted-block> </item></subclause>
<subclause id="H6E9FE1CD564F4D1994C2A44469657810"><enum>(II)</enum><text>by adding at the end the following new paragraph:</text> 
<quoted-block id="H253BDCABD46C4663BD3E14DF52B451C4" style="OLC"> 
<paragraph id="H1C5C67674D674E9B9F3792113E530EEF"><enum>(7)</enum><header>Treatment of remote patient management services</header> 
<subparagraph id="HBBC6D385A8C74A37B83CD11A5F13CDAD"><enum>(A)</enum><text>In determining relative value units for remote patient management services (as defined in section 1861(iii)), the Secretary, in consultation with appropriate physician groups, practitioner groups, and supplier groups, shall take into consideration—</text> 
<clause id="H0E93B8846CB6455E81FC3AF61505FAB1"><enum>(i)</enum><text>physician or practitioner resources, including physician or practitioner time and the level of intensity of services provided, based on—</text> 
<subclause id="H471822FDC58E475C96130AFF8901A5E6"><enum>(I)</enum><text>the frequency of evaluation necessary to manage the individual being furnished the services;</text> </subclause>
<subclause id="HCDAF2EB64E6C47A69F18ABD9391C22C3"><enum>(II)</enum><text>the complexity of the evaluation, including the information that must be obtained, reviewed, and analyzed; and</text> </subclause>
<subclause id="HE0DA118D6B4645CF96B2CDE6CA295EAA"><enum>(III)</enum><text>the number of possible diagnoses and the number of management options that must be considered;</text> </subclause></clause>
<clause id="HC4403D68CFF5482A8EF0E29C7B43BFA4"><enum>(ii)</enum><text>practice expense costs associated with such services, including the direct costs associated with installation and information transmission, costs of remote patient management technology (including equipment and software), device delivery costs, and resource costs necessary for patient monitoring and follow-up (but not including costs of any related item or non-physician service otherwise reimbursed under this title); and</text> </clause>
<clause id="H98B7F8797F8C48529A21134362F52D3E"><enum>(iii)</enum><text>malpractice expense resources.</text> </clause></subparagraph>
<subparagraph id="HB13CA61C93FD4A6190F7169D783D96A5"><enum>(B)</enum><text>Using the relative value units determined in subparagraph (A), the Secretary shall provide for separate payment for such services and shall not adjust the relative value units assigned to other services that might otherwise have been determined to include such separately paid remote patient management services.</text> </subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block> </subclause></clause>
<clause id="HB3EB5DEAB4754C47A3320A71B2A9F6A1"><enum>(ii)</enum><text>in subsection (j)(3), by inserting <quote>(2)(GG),</quote> after <quote>health risk assessment),</quote>.</text> </clause></subparagraph>
<subparagraph id="H3102363A7E6A42E398CCDF2FF194CBE9"><enum>(D)</enum><header>Effective date</header> 
<clause id="HC4B9BA836DB94ABDBBDCBA4BE7EF9CB0"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The amendments made by this subsection shall apply to services furnished on or after the date that is 6 months after the date of the enactment of this Act, without regard to whether the guidelines under paragraph (3)(A) or the standards under paragraph (3)(B) of section 1861(iii) of the Social Security Act, as added by subparagraph (B), have been developed.</text> </clause>
<clause id="H2788DD65DBEE48A5924B6EF7EDC3E0D7"><enum>(ii)</enum><header>Availability of codes as of date of enactment</header><text>The Secretary of Health and Human Services shall—</text> 
<subclause id="H85220D59F13B4C69B0389650EA660C65"><enum>(I)</enum><text>promptly evaluate existing codes that would be used to bill for remote patient management services (as defined in paragraph (1) of such section 1861(iii), as so added) under title XVIII of the Social Security Act; and</text> </subclause>
<subclause id="HB2298ABDE5C34511B8C9BB7096B913F4"><enum>(II)</enum><text>if the Secretary determines that new codes are necessary to ensure accurate reporting and billing of such services under such title, issue such codes so that they are available for use as of the date of the enactment of this Act.</text> </subclause></clause></subparagraph>
<subparagraph commented="no" id="H7DC15EF245C744869809966A29520C48"><enum>(E)</enum><header>GAO study and report</header> 
<clause commented="no" id="H9F8CC4CA3BBF4FB8B7CC407CC3FEE394"><enum>(i)</enum><header>Study</header><text display-inline="yes-display-inline">The Comptroller General of the United States shall conduct a study that includes, at a minimum, the following:</text> 
<subclause commented="no" id="H134EEE368989401EB9D0282BDD38F898"><enum>(I)</enum><text display-inline="yes-display-inline">The effectiveness of remote patient monitoring on decreasing hospital readmissions for the chronic conditions described in subsection (iii)(2) of section 1861 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x</external-xref>), as added by subparagraph (A).</text> </subclause>
<subclause commented="no" id="H9EC59907FE9747F0BE26E01B778851A1"><enum>(II)</enum><text display-inline="yes-display-inline">The savings to the Medicare program under title XVIII of such Act associated with remote patient monitoring use with respect to such chronic conditions.</text> </subclause>
<subclause commented="no" id="HD92549ADD68C443DB2AFBC103FBFF9EF"><enum>(III)</enum><text display-inline="yes-display-inline">The potential for greater use of remote patient monitoring for other chronic conditions.</text> </subclause>
<subclause commented="no" id="H4BA2B3BAB73049B581071B145D623739"><enum>(IV)</enum><text display-inline="yes-display-inline">Potential implications of greater use of remote patient monitoring with respect to payment and delivery system transformations under the Medicare program under such title.</text> </subclause></clause>
<clause id="H6255016F3F0741DBB0AF6F2A0025F664"><enum>(ii)</enum><header>Report</header><text>Not later than 2 years after the date of the enactment of this Act, the Comptroller General shall submit to Congress a report containing the results of the study conducted under clause (i).</text> </clause></subparagraph></paragraph>
<paragraph id="HC06C8E520EDE42C3A2B8228F63682F05"><enum>(5)</enum><header>Expansion of telecommunications system</header><text display-inline="yes-display-inline">The second sentence of section 1834(m)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1835m">42 U.S.C. 1835m(m)(1)</external-xref>) is amended by striking <quote>in the case of any Federal telemedicine demonstration program conducted in Alaska or Hawaii,</quote>.</text> </paragraph></subsection>
<subsection id="H29D2CDB01C6F4347A843B46754ADCF5D"><enum>(b)</enum><header>Second phase</header> 
<paragraph id="HF22AAB0B233B45F9965E1E116EF455DA"><enum>(1)</enum><header>Further expansion of originating sites</header><text display-inline="yes-display-inline">Section 1834(m)(4) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(4)</external-xref>) is amended—</text> 
<subparagraph id="HBBCB6EEB371842CA991470C539D8819D"><enum>(A)</enum><text>in clause (iii) of subparagraph (C), as added by subsection (a)(1), by adding at the end the following new subclauses:</text> 
<quoted-block display-inline="no-display-inline" id="H5F6E6E92A17E40D79F7D659D615FB606" style="OLC"> 
<subclause id="HEED9BC0A40114C9894827224F6751662"><enum>(IV)</enum><text display-inline="yes-display-inline">In the case of such a service furnished on or after the date that is 2 years after the date of the enactment of the Medicare Telehealth Parity Act of 2014, any site described in clause (ii) that is located in a county within a Metropolitan Statistical Area with a population of at least 50,000 individuals but fewer than 100,000 individuals, according to the most recent decennial census.</text> </subclause>
<subclause id="H6F59A35FF79048A7A758A0ABE9AC4C00"><enum>(V)</enum><text display-inline="yes-display-inline">In the case of such a service furnished on or after the date that is 2 years after the date of the enactment of the Medicare Telehealth Parity Act of 2014, a home telehealth site, as defined in subparagraph (G).</text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block> </subparagraph>
<subparagraph id="HADD9DDC873C2484DB8DD47CFFBFD513F"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following new subparagraph:</text> 
<quoted-block display-inline="no-display-inline" id="HB9A6B0DD1D2D4A33AF443D1D6A2B6AA5" style="OLC"> 
<subparagraph id="H5E930EFDD71644529C4DF904A14F3D09"><enum>(G)</enum><header>Home telehealth site</header> 
<clause id="H483BED49B1D843AA822B26F69D0ED5E8"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The term <quote>home telehealth site</quote> means, with respect to a telehealth service described in clause (ii) furnished to an individual, in a place of residence used as the home of such individual.</text> </clause>
<clause id="HC25C1982237049F98D4BCED7E9785AFC"><enum>(ii)</enum><header>Telehealth services described</header><text>A telehealth service described in this clause—</text> 
<subclause id="HEB79E3F1F49C493EBAA93F839E64D2CB"><enum>(I)</enum><text>is a telehealth service that is related to the provision of hospice care, home dialysis, home health services, or durable medical equipment; and</text> </subclause>
<subclause id="H5447482195BD4525A32C6249CE16E9B7"><enum>(II)</enum><text>shall include the use of video conferencing.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </subparagraph></paragraph>
<paragraph id="H9727FDF3037A4D09B1D27D9FAC94ABAC"><enum>(2)</enum><header>Additional covered telehealth services</header><text display-inline="yes-display-inline">Section 1834(m)(4)(F)(i) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/139m">42 U.S.C. 139m(m)(4)(F)(i)</external-xref>) is amended by adding at the end the following new sentence: <quote>Beginning on the date that is 2 years after the date of the enactment of the Medicare Telehealth Parity Act of 2014, such term shall include respiratory services, audiology services (as defined in section 1861(ll)), and outpatient therapy services, including physical therapy, occupational therapy, and speech-language pathology services.</quote></text> </paragraph>
<paragraph id="HD1DE91CE800C450EBB5B6B65192C0046"><enum>(3)</enum><header>GAO study and report</header> 
<subparagraph id="HA02CA9BCABCF4DC28D9036CA12BB7705"><enum>(A)</enum><header>Study</header><text display-inline="yes-display-inline">The Comptroller General of the United States shall conduct a study that includes, at a minimum, the following:</text> 
<clause id="H58AB72DDEA2043C38D85C1F33162E10B"><enum>(i)</enum><text display-inline="yes-display-inline">The effectiveness of using telehealth services described in the second sentence of section 1834(m)(4)(F)(i) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(4)(F)(i)</external-xref>), as added by paragraph (2), between therapy providers and patients.</text> </clause>
<clause id="HF45F8105909246DBA07C4D27B78D5A8C"><enum>(ii)</enum><text>The savings to the Medicare program under title XVIII of such Act associated with telehealth services utilization for therapy for such services described in such sentence.</text> </clause>
<clause id="H3D826D6927964B1AAF7CE549E2F1D6C9"><enum>(iii)</enum><text>The potential for greater use of telehealth services for forms of therapy not described in such sentence.</text> </clause></subparagraph></paragraph></subsection>
<subsection id="HAEEBB37B221449739559DB08E7333417"><enum>(c)</enum><header>Final phase</header> 
<paragraph id="HBCB47902E13D445A8639F2F27E1E91D8"><enum>(1)</enum><header>Further expansion of originating sites</header><text display-inline="yes-display-inline">Clause (iii) of section 1834(m)(4)(C) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(4)</external-xref>), as added by subsection (a)(1) and amended by subsection (b)(1), is further amended by adding at the end the following new subclause:</text>

<subclause id="H7A16D6404A7C4C55BD2BD8D0A4806FA2"><enum>(VI)</enum><text display-inline="yes-display-inline">In the case of such a service furnished on or after the date that is 4 years after the date of the enactment of the Medicare Telehealth Parity Act of 2014, any site described in clause (ii) that is located in a county within a Metropolitan Statistical Area with a population of at least 100,000 individuals, according to the most recent decennial census.</text> </subclause><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph>
<paragraph id="H8BD018A7915342EBA70B12FEF98927F6"><enum>(2)</enum><header>Payment methods for other patient sites</header><text display-inline="yes-display-inline">Section 1834(m)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(2)</external-xref>) is amended by adding at the end the following new subparagraph:</text>

<subparagraph id="H8ABC680E7B1A4381B36DFBCEE72C67F2"><enum>(D)</enum><header>Payment methods for other patient sites</header><text display-inline="yes-display-inline">With respect to services furnished on or after the date that is 4 years after the date of the enactment of the Medicare Telehealth Parity Act of 2014, the Secretary may develop and implement payment methods that would apply under this subsection in the case of an individual who would be an eligible telehealth individual except that the telehealth services are furnished at a site other than an originating site. Such methods shall be designed to take into account the costs related to the site involved and reduced costs for the distant site.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection></section>
