<official-title>To amend the Terrorism Risk Insurance Act of 2002 to allow for the use of certain assets of foreign entities to satisfy certain judgments against terrorist parties, and for other purposes.</official-title>

<section id="H8CCBAECE0F6A49F3AE6EA7DC707B32F7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Bank Account Seizure of Terrorist Assets Act</short-title></quote> or <quote><short-title>BASTA Act</short-title></quote>. </text></section> 
<section id="H2B6DB7B807244F6CA3358C5A03A5733E" section-type="subsequent-section"><enum>2.</enum><header>Use of certain assets to satisfy judgments against terrorist parties</header>
<subsection id="H315A280A628646918C8F44715D311872" display-inline="no-display-inline"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 201(a) of the Terrorism Risk Insurance Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/28/1610">28 U.S.C. 1610</external-xref> note) is amended by adding at the end the following: <quote>For purposes of this section, the blocked assets of a terrorist party are subject to execution or attachment in aid of execution in order to satisfy such judgment regardless of whether the terrorist party ceases to be a terrorist party after such judgment is entered.</quote>.</text> </subsection>
<subsection id="H2B3FE26B160845E9AC75D68AA7EFC425"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 201(d) of the Terrorism Risk Insurance Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/28/1610">28 U.S.C. 1610</external-xref> note) is amended—</text> 
<paragraph id="HDF88EFFFC84041139017C3C16E95061C"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (2)—</text> 
<subparagraph id="H99513CA8FACC444CB59458846630D7E3"><enum>(A)</enum><text>in the matter preceding subparagraph (A), by striking <quote>means</quote>;</text></subparagraph> 
<subparagraph id="HCDFC9DF5BB344AF8B50FCD4004FE4B64"><enum>(B)</enum><text>by amending paragraph (2)(A) to read as follows:</text> 
<quoted-block style="OLC" id="HEE8F1C5E247B4001A70BD1801AC78BFA" display-inline="no-display-inline"> 
<subparagraph id="H952287F19117468B94251D4E465EC3FB"><enum>(A)</enum><text display-inline="yes-display-inline">means any asset seized or frozen by the United States under section 5(b) of the Trading With the Enemy Act (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/50/5">50 U.S.C. App. 5(b)</external-xref>), under sections 202 and 203 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref>; 1702), or under section 805(b) of the Foreign Narcotics Kingpin Designation Act (<external-xref legal-doc="usc" parsable-cite="usc/21/1904">21 U.S.C. 1904(b)</external-xref>); and</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HF3E9B4C8DE39456DBDB535710C6D17A0"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating paragraph (4) as paragraph (5); and</text></paragraph> 
<paragraph id="HCB996B0F7F5B43E2B0CED527B4820CBE"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after paragraph (3) the following:</text> 
<quoted-block style="OLC" id="H9FA60528DD2C46EA89B42ECF8AE5402D" display-inline="no-display-inline"> 
<paragraph id="H9B3E45804373445D9F8291B359ABD12F"><enum>(4)</enum><header>Person</header><text>In subsection (a), the term <quote>person</quote> means a person who, at the time the act of terrorism described in subsection (a) was committed upon which the judgment described in such subsection was obtained by that person, was either—</text> 
<subparagraph id="HAFF00380F61348B293A77DF5621B48EE"><enum>(A)</enum><text>a national of the United States as defined in section 101(a)(22) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(22)</external-xref>); </text></subparagraph> 
<subparagraph id="H20FF0AA617FE456E9B8CB5E855C32D1D"><enum>(B)</enum><text>a member of the Armed Forces of the United States; or</text></subparagraph> 
<subparagraph id="HB414F127DC4A4285AEC9F78CCBE479D2"><enum>(C)</enum><text>otherwise an employee of the Government of the United States, or of an individual performing a contract awarded by the United States Government, acting within the scope of the employee’s employment.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection></section> 
<section id="H78BDB03801CF494EB0C753FA131217DD"><enum>3.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this Act apply to any judgment entered before, on, or after the date of the enactment of this Act.</text></section>
