<official-title>To amend the Public Health Service Act to prohibit application of preexisting condition exclusions and to guarantee availability of health insurance coverage in the individual and group market, contingent on the enactment of legislation repealing the Patient Protection and Affordable Care Act, and for other purposes.</official-title>

<section id="HE129599DED8748D785AFBDB9D7360152" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Guaranteed Health Coverage for Pre-Existing Conditions Act of 2014</short-title></quote>.</text></section> 
<section id="HA0880935F49948DB902962E770B57A82"><enum>2.</enum><header>Prohibition of preexisting condition exclusions</header> 
<subsection id="H55C50FB6304542D1B5208FC0B43BFD6E"><enum>(a)</enum><header>Group market</header><text display-inline="yes-display-inline">Subpart 1 of part A of title XXVII of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg">42 U.S.C. 300gg et seq.</external-xref>) is amended by striking section 2701 and inserting the following:</text>

<section id="HE96581D1EE034AA684A6266C3E7C21ED"><enum>2701.</enum><header>Prohibition of preexisting condition exclusions</header> 
<subsection id="HEA1623014C474C02811E8B970517E40A"><enum>(a)</enum><header>In General</header><text>A group health plan or a health insurance issuer offering group health insurance coverage may not impose any preexisting condition exclusion with respect to such plan or coverage.</text> </subsection> 
<subsection id="H942DA181F1184E9793D1565A10467EB3" commented="no"><enum>(b)</enum><header>Definitions</header><text>For purposes of this section:</text> 
<paragraph id="H40D6E43369E14E78BB19C42BFE661A3F" commented="no"><enum>(1)</enum><header>Preexisting condition exclusion</header> 
<subparagraph id="H9A7BD39814854A4CAF9FFF57DC5B5870" commented="no"><enum>(A)</enum><header>In general</header><text>The term <term>preexisting condition exclusion</term> means, with respect to a group health plan or health insurance coverage, a limitation or exclusion of benefits relating to a condition based on the fact that the condition was present before the date of enrollment in such plan or for such coverage, whether or not any medical advice, diagnosis, care, or treatment was recommended or received before such date.</text> </subparagraph> 
<subparagraph id="HA8306C66274D4AE4982C95A094193AD0" commented="no"><enum>(B)</enum><header>Treatment of genetic information</header><text>Genetic information shall not be treated as a preexisting condition in the absence of a diagnosis of the condition related to such information.</text> </subparagraph></paragraph> 
<paragraph id="H4D29A06BD80946EF933C1A254A578004" commented="no"><enum>(2)</enum><header>Date of enrollment</header><text>The term <term>date of enrollment</term> means, with respect to an individual covered under a group health plan or health insurance coverage, the date of enrollment of the individual in the plan or coverage or, if earlier, the first day of the waiting period for such enrollment.</text> </paragraph> 
<paragraph id="H021E7E7944324AE291F8F3978033100E" commented="no"><enum>(3)</enum><header>Waiting period</header><text>The term <term>waiting period</term> means, with respect to a group health plan and an individual who is a potential participant or beneficiary in the plan, the period that must pass with respect to the individual before the individual is eligible to be covered for benefits under the terms of the plan.</text> </paragraph></subsection> </section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection display-inline="no-display-inline" id="H432626333A2845B0A9C28B4DBB675CBE"><enum>(b)</enum><header>Individual market</header><text display-inline="yes-display-inline">Subpart 1 of part B of title XXVII of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-41">42 U.S.C. 300gg–41 et seq.</external-xref>) is amended by adding at the end the following:</text>

<section id="HDA6CCDD107784E6E8E7066CF58B012FF"><enum>2746.</enum><header>Prohibition of preexisting condition exclusions or other discrimination based on health status</header><text display-inline="no-display-inline">The provisions of section 2701 shall apply to health insurance coverage offered to individuals by a health insurance issuer in the individual market in the same manner as it applies to health insurance coverage offered by a health insurance issuer in the group market.</text> </section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section> 
<section id="H7C7BBD55E62F4B429FF6D672D4C226C7"><enum>3.</enum><header>Guaranteed availability of coverage</header> 
<subsection id="H9B7468D93CA24A3E85EB7AF987DBA682"><enum>(a)</enum><header>Group market</header><text display-inline="yes-display-inline">Subpart 3 of part A of title XXVII of the Public Health Service Act is amended by striking section 2711 (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-11">42 U.S.C. 300gg–11</external-xref>) and inserting the following:</text>

<section id="H48968A7601134893AE57262B52B04F23"><enum>2711.</enum><header>Guaranteed availability of coverage</header> 
<subsection id="H561ACE8C468B4531918FED70F66EBCE7"><enum>(a)</enum><header>Guaranteed issuance of coverage in the group market</header><text display-inline="yes-display-inline">Subject to subsection (b), each health insurance issuer that offers health insurance coverage in the group market in a State shall accept every employer and every individual in a group in the State that applies for such coverage.</text> </subsection> 
<subsection id="H6294BA2BAFAC44B6AA395371803385BA"><enum>(b)</enum><header>Enrollment</header> 
<paragraph id="H6E9A55E5A7234E13B0A1F9678312CCF5"><enum>(1)</enum><header>Restriction</header><text>A health insurance issuer described in subsection (a) may restrict enrollment in coverage described in such subsection to open or special enrollment periods.</text> </paragraph> 
<paragraph id="HC473BA00AE31449AA7A595F9126DF224"><enum>(2)</enum><header>Establishment</header><text>A health insurance issuer described in subsection (a) shall establish special enrollment periods for qualifying events (as such term is defined in section 603 of the Employee Retirement Income Security Act of 1974).</text> </paragraph> </subsection> </section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="HEA3F179563B74F34B4EF2AAA04EB152C"><enum>(b)</enum><header>Individual market</header><text display-inline="yes-display-inline">Subpart 1 of part B of title XXVII of the Public Health Service Act is amended by striking section 2741 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-41">42 U.S.C. 300gg–41</external-xref>) and inserting the following:</text> 
<quoted-block display-inline="no-display-inline" id="H1997F0B9BA0547E79C699077506527BA" style="OLC"> 
<section id="HDC4D82F7B7C345728868F1EA4737C681"><enum>2741.</enum><header>Guaranteed availability of coverage</header><text display-inline="no-display-inline">The provisions of section 2711 shall apply to health insurance coverage offered to individuals by a health insurance issuer in the individual market in the same manner as such provisions apply to health insurance coverage offered to employers by a health insurance issuer in connection with health insurance coverage in the group market. For purposes of this section, the Secretary shall treat any reference of the word <term>employer</term> in such section as a reference to the term <term>individual</term>.</text> </section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section> 
<section id="H90EE8D48017E4B2A89406FFC45E12F7B"><enum>4.</enum><header>Effective date contingent on repeal of PPACA</header> 
<subsection commented="no" id="H2F90B0751DFF4B61AE3F64561F5A9939"><enum>(a)</enum><header>In general</header><text>Sections 2 and 3 and the amendments made by such section shall take effect upon the enactment of PPACA repeal legislation described in subsection (b) and such sections and amendments shall have no force or effect if such PPACA repeal legislation is not enacted.</text> </subsection> 
<subsection id="H8FE9177220114B3784DE694E71A9E476"><enum>(b)</enum><header>PPACA repeal legislation described</header><text display-inline="yes-display-inline">For purposes of subsection (a), PPACA repeal legislation described in this subsection is legislation that—</text> 
<paragraph id="H8BDD3C7B547D4245A75D441B4D8C744A"><enum>(1)</enum><text>repeals <external-xref legal-doc="public-law" parsable-cite="pl/111/148">Public Law 111–148</external-xref>, and restores or revives the provisions of law amended or repealed, respectively, by such Act as if such Act had not been enacted and without further amendment to such provisions of law; and</text> </paragraph> 
<paragraph id="H767971C5C2DC44E6B9A2F2D28211EAB9"><enum>(2)</enum><text>repeals title I and subtitle B of title II of the Health Care and Education Reconciliation Act of 2010 (<external-xref legal-doc="public-law" parsable-cite="pl/111/152">Public Law 111–152</external-xref>), and restores or revives the provisions of law amended or repealed, respectively, by such title or subtitle, respectively, as if such title and subtitle had not been enacted and without further amendment to such provisions of law.</text> </paragraph></subsection></section>
