		<official-title>To amend the Public Health Service Act to limit rescissions of coverage under health plans in the
			 individual and group market, contingent on the enactment of legislation
			 repealing the Patient Protection and Affordable Care Act, and for other
			 purposes.</official-title>

		<section id="HF141883ABBDF4940A12DF58E6AB95371" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Insurance Coverage for Sick Americans Act of 2014</short-title></quote>.</text>
		</section><section id="HFD1D9EF5103A4B1181DC445175AD816D"><enum>2.</enum><header>Prohibition on rescissions</header>
			<subsection id="HF6B87D5A26DB4EADBBD533A3BFCDA1A2"><enum>(a)</enum><header>Group market</header><text display-inline="yes-display-inline">Subpart 1 of part A of title XXVII of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg">42 U.S.C. 300gg et seq.</external-xref>) is
			 amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HAC4F5D23A27A4E94A74AC029ABF61FC8" style="OLC">
					<section id="H2EA353E51E564B819A93B6DEFB0A5191"><enum>2703.</enum><header>Prohibition on rescissions</header><text display-inline="no-display-inline">A group health plan and a health insurance issuer offering group health insurance coverage shall
			 not rescind such plan or coverage with respect to an enrollee once the
			 enrollee is covered under such plan or coverage involved, except that this
			 section shall not apply to a covered individual who has performed an act
			 or practice that constitutes fraud or makes an intentional
			 misrepresentation of material fact as prohibited by the terms of the plan
			 or coverage. Such plan or coverage may not be cancelled except with prior
			 notice to the enrollee, and only as permitted under section 2712(b).</text>
					</section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HFE61276E23054F9DB06F5505F926294F"><enum>(b)</enum><header>Individual market</header><text display-inline="yes-display-inline">Subpart 1 of part B of title XXVII of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-41">42 U.S.C. 300gg–41 et seq.</external-xref>) is
			 amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H60B3B776B14F432DB39914596A82BF0E" style="OLC">
					<section id="HC8472592B6474D3C84EEF853D928FF16"><enum>2747.</enum><header>Prohibition on rescissions</header><text display-inline="no-display-inline">The provisions of section 2703 shall apply to health insurance coverage offered to individuals by a
			 health insurance issuer in the individual market in the same manner as it
			 applies to health insurance coverage offered by a health insurance issuer
			 in the group market.</text>
					</section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HC47D83ED701A44EDBE22BA42175DBCC9"><enum>(c)</enum><header>Effective date contingent on repeal of PPACA</header>
				<paragraph commented="no" id="HAB488138031547319471979D903586D3"><enum>(1)</enum><header>In general</header><text>Subsections (a) and (b) and the amendments made by such subsections shall take effect upon the
			 enactment of PPACA repeal legislation described in paragraph (2) and such
			 subsections and amendments shall have no force or effect if such PPACA
			 repeal legislation is not enacted.</text>
				</paragraph><paragraph id="HD81568B5C0914B13B46C4D83830A797D"><enum>(2)</enum><header>PPACA repeal legislation described</header><text display-inline="yes-display-inline">For purposes of paragraph (1), PPACA repeal legislation described in this paragraph is legislation
			 that—</text>
					<subparagraph id="H54A6A376CA9C44DCB23AD408175CBD47"><enum>(A)</enum><text>repeals <external-xref legal-doc="public-law" parsable-cite="pl/111/148">Public Law 111–148</external-xref>, and restores or revives the provisions of law amended or repealed,
			 respectively, by such Act as if such Act had not been enacted and without
			 further amendment to such provisions of law; and</text>
					</subparagraph><subparagraph id="H223C42C3E2E145F994C2299E63AE79DE"><enum>(B)</enum><text>repeals title I and subtitle B of title II of the Health Care and Education Reconciliation Act of
			 2010 (<external-xref legal-doc="public-law" parsable-cite="pl/111/152">Public Law 111–152</external-xref>), and restores or revives the provisions of law
			 amended or repealed, respectively, by such title or subtitle,
			 respectively, as if such title and subtitle had not been enacted and
			 without further amendment to such provisions of law.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
