		<section id="H38A378A2914245DFACB4D553AE5E13B7" section-type="section-one"><enum>1.</enum><header>Treatment of goods exported for modification and reimported</header>
			<subsection id="HCB3AD9599BBF4B70ABAF71319338A99C"><enum>(a)</enum><header>Textile and apparel goods</header>
				<paragraph display-inline="no-display-inline" id="H75FB1F122E79479FBCBD65BB3553B0C7"><enum>(1)</enum><header>In general</header><text>Subchapter II of chapter 98 of the Harmonized Tariff Schedule of the United States is amended by
			 inserting in numerical sequence the following subheading, with the article
			 description having the same degree of indentation as the article
			 description for subheading 9802.00.60:</text>

				</paragraph><paragraph commented="no" id="H0E2F1826748D4A2A8B82AD090B76DFB4"><enum>(2)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">U.S. note 4 to subchapter II of chapter 98 of the Harmonized Tariff Schedule of the United States
			 is amended, in the matter preceding paragraph (a), by inserting <quote>and subheading 9802.00.70</quote> after <quote>9802.00.90</quote>.</text>
				</paragraph></subsection><subsection id="H068E5C74D427494996A1B8C77C50DA45"><enum>(b)</enum><header>Commingling of fungible goods exported for repairs or alterations</header><text>U.S. note 3 to subchapter II of chapter 98 of the Harmonized Tariff Schedule of the United States
			 is amended by adding at the end the following:</text>
				<quoted-block id="H53120A758D674C62A91B8B6B4DB21215" style="OLC">
					<subsection id="HDD1B1AB7C37147ADA33E6BFE1BDC88A0"><enum>(e)</enum><text>For purposes of subheadings 9802.00.40 and 9802.00.50, if an article is exported from the United
			 States for the purpose of repairing or altering the article and the
			 article is subsequently imported into the United States—</text>
						<paragraph id="HECCE236F8D094E72BFEF76358D65D262"><enum>(1)</enum><text display-inline="yes-display-inline">the article shall be considered to be the same article that was exported without regard to whether
			 the article contains 1 or more components recovered from an identical or
			 similar article that was also exported from the United States; and</text>
						</paragraph><paragraph id="HA709597572A14ABF90E25358A4B76BB2"><enum>(2)</enum><text>the cost or value of any such components shall not be included in the value of the article when the
			 article enters the United States.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HCCC7B98D472E436BA3F82DBA663504C5"><enum>(c)</enum><header>Articles previously imported</header>
				<paragraph id="H45E2E9AC96024B2EA881DC12903E38A4"><enum>(1)</enum><header>Duty treatment</header><text>The article description for heading 9801.00.20 of the Harmonized Tariff Schedule of the United
			 States is amended to read as follows: <quote>Articles, previously imported, with respect to which the duty was paid upon such previous
			 importation or which were imported previously free of duty, if (1)
			 reimported, without having been advanced in value or improved in condition
			 by any process of manufacture or other means while abroad, after having
			 been exported under lease or similar use agreements, bailment agreements,
			 or for warehousing, repackaging, or both, and (2) reimported by or for the
			 account of the person who imported it into, and exported it from, the
			 United States.</quote>.</text>
				</paragraph><paragraph id="HF840583A0F4F4E4D99795626EB498ECC"><enum>(2)</enum><header>Commingling of fungible goods</header><text>The U.S. notes to subchapter I of chapter 98 of the Harmonized Tariff Schedule of the United States
			 are amended by adding at the end the following new note:</text>
					<quoted-block display-inline="no-display-inline" id="H103AF7CD75894CD2934D8A41808B56A6" style="OLC">
						<subsection id="H154BF2E06FFB420E93606316AC38FC82"><enum>3.</enum>
							<paragraph commented="no" display-inline="yes-display-inline" id="HA10ECEF5F4884222A6EA7E695E70AB68"><enum>(a)</enum><text display-inline="yes-display-inline">For purposes of heading 9801.00.20—</text>
								<subparagraph id="H4FC1B89B7CAC40A1B496EF5AA4689738" indent="up1"><enum>(i)</enum><text>fungible goods exported from the United States may be commingled, and</text>
								</subparagraph><subparagraph id="H1A15BF44D1D44889B3D509D300A41920" indent="up1"><enum>(ii)</enum><text>the origin, value, and classification of such goods may be accounted for using an inventory
			 management method.</text>
								</subparagraph></paragraph><paragraph id="HA9607910C6FB43FDB4AA7DDA996D4637" indent="up1"><enum>(b)</enum><text>If a person chooses to use an inventory management method under paragraph (a) with respect to
			 fungible goods, the person shall use the same inventory management method
			 for any goods with respect to which the person claims fungibility.</text>
							</paragraph><paragraph id="H7682F2406C804BF9AB391F2ED2756301" indent="up1"><enum>(c)</enum><text>For purposes of this note—</text>
								<subparagraph id="H523AC393416D47C18F89C6219B18DC84"><enum>(i)</enum><text>the term <quote>fungible good</quote> means any good that is commercially interchangeable with another good and that has properties that
			 are essentially identical to the properties of another good; and</text>
								</subparagraph><subparagraph id="HF5B664DA7335454199606CCF350E0D17"><enum>(ii)</enum><text>the term <quote>inventory management method</quote> means any method for managing inventory that is based on generally accepted accounting principles.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HED1E81294F8D483FAFACB2F82897AA3A"><enum>(d)</enum><header>Use of manufacturer’s identification code for textile and apparel products</header><text>The U.S. notes to chapter 98 of the Harmonized Tariff Schedule of the United States are amended by
			 adding at the end the following new note:</text>
				<quoted-block display-inline="no-display-inline" id="H407C1DB42E6E47219DF54E3614B245F7" style="OLC">
					<subsection id="HFE66B8A557FB46C1AC20D01CA2988639"><enum>4.</enum><text display-inline="yes-display-inline">For textile and apparel products classified in subchapter I or II of this chapter, the
			 manufacturer’s identification code (MID) of the facility that repairs,
			 alters, assembles, processes, stores, or otherwise handles the products
			 may be used on any customs entry documentation or electronic data
			 transmission that requires identification of the manufacturer.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="HE97A7EE4530944CDB61C6B6ED9786442"><enum>2.</enum><header>Effective date</header>
			<subsection id="H84C7BB8B474C49FDAF925136AA2C98DB"><enum>(a)</enum><header>In general</header><text>Subject to subsection (b), the amendments made by this Act shall apply to goods entered, or
			 withdrawn from warehouse for consumption, on or after the 15th day after
			 the date of the enactment of this Act.</text>
			</subsection><subsection id="H392DA62D505E4C73ABCCC8FAEF361296"><enum>(b)</enum><header>Retroactive application</header>
				<paragraph id="H21D4F7EC30A541329F35D79E9F5B619E"><enum>(1)</enum><header>In general</header><text>Notwithstanding section 514 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1514">19 U.S.C. 1514</external-xref>) or any other provision of
			 law, and subject to paragraph (2), the entry of any good—</text>
					<subparagraph id="H177A5EE9B19149A68323EFCB42B00B7E"><enum>(A)</enum><text>that was liquidated or made on or after January 9, 2008, and before the 15th day after the date of
			 the enactment of this Act, and</text>
					</subparagraph><subparagraph id="H58A5AE137F7648CAAFB728F3444FD15D"><enum>(B)</enum><text>with respect to which there would have been no duty if the amendment made by section 1(c)(1)
			 applied to such entry,</text></subparagraph><continuation-text continuation-text-level="paragraph">shall be liquidated or reliquidated as if such amendment applied to such entry.</continuation-text></paragraph><paragraph commented="no" id="HE2B2C9276A3B4AA7A10404A692A76E3C"><enum>(2)</enum><header>Requests</header><text>A liquidation or reliquidation may be made under paragraph (1) with respect to an entry only if a
			 request therefor is filed with U.S. Customs and Border Protection before
			 the later of the 180th day after the date of the enactment of this Act or
			 the 180th day after the date of liquidation of the entry, that contains
			 sufficient information to enable U.S. Customs and Border Protection—</text>
					<subparagraph commented="no" id="H78673F005FA24FAD82C18947DFD33ED8"><enum>(A)</enum><text>to locate the entry; or</text>
					</subparagraph><subparagraph commented="no" id="HA3EB4FD32524480EB57420BF3CAD515C"><enum>(B)</enum><text>to reconstruct the entry if it cannot be located.</text>
					</subparagraph></paragraph><paragraph commented="no" id="H1B20BD6428214C0C8C10DEC2F89B72ED"><enum>(3)</enum><header>Payment of amounts owed</header><text>Any amount owed by the United States pursuant to the liquidation or reliquidation of an entry of an
			 article under paragraph (1) shall be paid, without interest, not later
			 than 90 days after the date of the liquidation or reliquidation (as the
			 case may be).</text>
				</paragraph><paragraph id="H731544621B444247B672339564CA73A8"><enum>(4)</enum><header>Definition</header><text>In this subsection, the term <quote>entry</quote> includes a withdrawal from warehouse for consumption.</text>
