		<section id="H03A06EC188CE435FB86B9C83C46B96BF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Indian River Lagoon Nutrient Removal Assistance Act of 2014</short-title></quote>.</text>
		</section><section id="HE2E4025E632442B3A7E581E08CA3DC6A"><enum>2.</enum><header>Indian River Lagoon Nutrient Removal Assistance Grant Program</header>
			<subsection id="HA979D66EE2A44D2487C7B0801441FF84"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Administrator of the
			 Environmental Protection Agency shall establish an Indian River Lagoon
			 Nutrient Removal Assistance Grant Program (in this section referred to as
			 the <quote>Program</quote>) to assist projects related to the protection and restoration of the Indian River Lagoon in
			 Florida.</text>
			</subsection><subsection id="HDA29C9D26C09451DA79A870CA549E902"><enum>(b)</enum><header>Grant authority</header><text>In carrying out the Program, the Administrator may make a grant, on a competitive basis, to any of
			 the following:</text>
				<paragraph id="HEB67DFC3FBA942BCAF5B791DD5F2BCF0"><enum>(1)</enum><text>A State government entity.</text>
				</paragraph><paragraph id="HE861BEA2F5F246499F64292FDE787262"><enum>(2)</enum><text>A local government entity.</text>
				</paragraph><paragraph id="H2F775C67E0F041A98C5055C0C1093F6B"><enum>(3)</enum><text>A nonprofit organization.</text>
				</paragraph><paragraph id="H1B8ECA760E4D41E7926C1B0F733FABD8"><enum>(4)</enum><text>The Indian River Lagoon Program.</text>
				</paragraph></subsection><subsection id="HB06A8410DB954124AC44FA8554F04EDC"><enum>(c)</enum><header>Applications</header><text>To be eligible for a grant under the Program, an entity specified in subsection (b) shall submit to
			 the Administrator an application with respect to a proposed project at
			 such time, in such form, and containing such information as the
			 Administrator determines is appropriate, which shall include at least a
			 description of the proposed project and the communities to be served by
			 the proposed project.</text>
			</subsection><subsection id="H699F4C22A72E400EA8EF65CB53B5162F"><enum>(d)</enum><header>Selection criteria</header><text display-inline="yes-display-inline">The Administrator shall issue regulations with respect to the criteria to be utilized to select
			 projects for grants under the Program, which shall prioritize projects
			 that—</text>
				<paragraph id="HBEC34CA27906435193D2573E489C649A"><enum>(1)</enum><text display-inline="yes-display-inline">produce the greatest nutrient load reductions;</text>
				</paragraph><paragraph id="H25FEC446B3E24B7187A2D8E4E05103EA"><enum>(2)</enum><text>result in the greatest environmental benefits to the Indian River Lagoon; and</text>
				</paragraph><paragraph id="HD127AB93BBDA4DF1A1CE350BCB6FF4C2"><enum>(3)</enum><text>advance the goals and objectives of the comprehensive plan.</text>
				</paragraph></subsection><subsection id="HA0AF2EFE11DD491BB6EAB884C79C88A2"><enum>(e)</enum><header>Consultation</header><text>In selecting projects for grants under the Program, the Administrator shall consult with—</text>
				<paragraph id="HA15D2519101F48BB9525B72856CE95A8"><enum>(1)</enum><text display-inline="yes-display-inline">the Indian River Lagoon Program;</text>
				</paragraph><paragraph id="H323756A0D46342979D9D8BD37240C6C1"><enum>(2)</enum><text>the State of Florida and local governments in the Indian River Lagoon watershed; and</text>
				</paragraph><paragraph id="HBA0FA0296761483DBE79FC031681626B"><enum>(3)</enum><text>other relevant stakeholders involved with the protection and restoration of the Indian River
			 Lagoon.</text>
				</paragraph></subsection><subsection id="H2D6B66868DE1465682DFE69BC343C6EC"><enum>(f)</enum><header>Federal share</header>
				<paragraph id="H3230156EA32642C68C08887C3EF6B910"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), the Federal share of the cost of a project assisted with a
			 grant under the Program shall be 75 percent.</text>
				</paragraph><paragraph id="H0D7307A8E492454AAACABF80794E74C3"><enum>(2)</enum><header>Exception</header><text display-inline="yes-display-inline">At the request of a grant recipient, the recipient may lower the Federal share of the cost for a
			 project carried out by the recipient to an amount that is less than 75
			 percent.</text>
				</paragraph></subsection><subsection id="H117ECDF8F57E49B5BC94422E094779B2"><enum>(g)</enum><header>Definitions</header><text>In this section, the following definitions apply:</text>
				<paragraph id="H773BC5FB7ED94672BC455AFAD710F59D"><enum>(1)</enum><header>Comprehensive plan</header><text display-inline="yes-display-inline">The term <term>comprehensive plan</term> means—</text>
					<subparagraph id="H8FD21A5F165A485C9FEFCD46E1310196"><enum>(A)</enum><text>the conservation and management plan approved under section 320 of the Federal Water Pollution
			 Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1330">33 U.S.C. 1330</external-xref>) for the Indian River Lagoon; and</text>
					</subparagraph><subparagraph id="H182E183F2FA5436BB101DFD4E93E75A7"><enum>(B)</enum><text>any amendments to that plan.</text>
					</subparagraph></paragraph><paragraph id="H0A555B62897940E4A45672CEFC376B98"><enum>(2)</enum><header>Indian River Lagoon Program</header><text display-inline="yes-display-inline">The term <term>Indian River Lagoon Program</term> means the Indian River Lagoon National Estuary Program convened as the management conference under
			 section 320 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1330">33 U.S.C. 1330</external-xref>)
			 for the Indian River Lagoon, and includes the Policy Board, Management
			 Committee, Technical Advisory Committee, and Citizens Advisory Committee
			 of that Program.</text>
				</paragraph></subsection><subsection id="H3884B709C3644BFFA907F757F546869D"><enum>(h)</enum><header>Authorization of appropriations</header>
				<paragraph id="H04799FD584CA40B69BE44CC97FB9035C"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Administrator to carry out the Program each fiscal
			 year the amounts available in the Indian River Lagoon Nutrient Removal
			 Assistance Trust Fund established under section 9512 of the Internal
			 Revenue Code of 1986.</text>
				</paragraph><paragraph id="H9C9CA2989FCB438698A5BB167FC5AA19"><enum>(2)</enum><header>Administrative expenses</header><text display-inline="yes-display-inline">The Administrator may not use more than 5 percent of the amounts made available to carry out the
			 Program each fiscal year to pay administrative expenses incurred in
			 carrying out the Program.</text>
				</paragraph><paragraph id="HDF5111540BDB4947B5D7100345634B08"><enum>(3)</enum><header>Prohibition</header><text display-inline="yes-display-inline">No amounts made available to carry out the Program may be used for the administrative expenses of a
			 management conference convened under section 320 of the Federal Water
			 Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1330">33 U.S.C. 1330</external-xref>).</text>
				</paragraph><paragraph id="H149B615C60124EA4B9B2A375E160148F"><enum>(4)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section may be construed to limit the eligibility of the Indian River Lagoon
			 Program to receive funding under section 320(g) of the Federal Water
			 Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1330">33 U.S.C. 1330(g)</external-xref>).</text>
				</paragraph></subsection></section><section id="HF33BCD758F974697BF9540D7BB8F2030"><enum>3.</enum><header>Increase in certain civil penalties</header>
			<subsection id="H1FD7DEB0442A45BBBA029B9C8EB715DB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law and not later than 90 days after the date of enactment
			 of this Act, the Administrator of the Environmental Protection Agency
			 shall issue regulations to increase by 5 percent each civil penalty amount
			 established for a violation of the Federal Water Pollution Control Act (33
			 U.S.C. 1251 et seq.).</text>
			</subsection><subsection id="HF05AC1F774F24598B3EFD2513AC0EE86"><enum>(b)</enum><header>Applicability</header><text display-inline="yes-display-inline">The regulations issued under subsection (a) shall only apply to violations of the Federal Water
			 Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>) occurring after the date of
			 enactment of this Act.</text>
			</subsection></section><section id="HEF45B396F9E649A38E9D53627A4C85CA"><enum>4.</enum><header>Indian River Lagoon Nutrient Removal Assistance Trust Fund</header>
			<subsection id="H1AD99A5FFA784D17A631CBAA2B1C1169"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/98">chapter 98</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the
			 following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H7292DB334D4D4433B435C05FD85B31FA" style="OLC">
					<section id="HF9AB4BD3748B45CAABF06BCE1FF3161E"><enum>9512.</enum><header>Indian River Lagoon Nutrient Removal Assistance Trust Fund</header>
						<subsection id="H2FF389D7AAE84085A7F7C3FBA76811A5"><enum>(a)</enum><header>Creation of Trust Fund</header><text display-inline="yes-display-inline">There is hereby established in the Treasury of the United States a trust fund to be known as the <quote>Indian River Lagoon Nutrient Removal Assistance Trust Fund</quote>, consisting of such amounts as may be appropriated or credited to such Trust Fund as provided in
			 this section and section 9602(b).</text>
						</subsection><subsection id="H8AD2972654DC484592313F877CB2AD84"><enum>(b)</enum><header>Transfers to Trust Fund</header><text display-inline="yes-display-inline">There are hereby appropriated to the Indian River Lagoon Nutrient Removal Assistance Trust Fund
			 such amounts as the Secretary determines from time to time are equivalent
			 to the increase in civil penalties under section 3(a) of the Indian River
			 Lagoon Nutrient Removal Assistance Act of 2014 for violations of the
			 Federal Water Pollution Control Act.</text>
						</subsection><subsection id="HF22935C17FD0481C9B6CA5B0DC9AD17D"><enum>(c)</enum><header>Expenditures</header><text display-inline="yes-display-inline">Amounts in the Indian River Lagoon Nutrient Removal Assistance Trust Fund shall be available as
			 provided in appropriations Acts only for making expenditures to make
			 grants under the Indian River Lagoon Nutrient Removal Assistance Grant
			 Program under section 2(a) of the Indian River Lagoon Nutrient Removal
			 Assistance Act of 2014.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H60D48EF19C7147A88A03ED3FFC87449F"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for subchapter A of chapter 98 of such Code is amended by adding at the end
			 the following new item:</text>
