		<section id="HE5F871EB7FFE4AB38E16128395CE1B26" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Care Corps Act of 2014</short-title></quote>.</text>
		</section><section id="HC4839704F5C14B58888A380AD1461D9B"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this Act, the following definitions shall apply:</text>
			<paragraph id="H79F91313A5394CA6BDF817A37150351E"><enum>(1)</enum><header>Corps</header><text>The term <term>Corps</term> means the National Care Corps established under section 3 of this Act.</text>
			</paragraph><paragraph id="HE6A62576E6904103A084E0A6F6C151CF"><enum>(2)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Corps appointed under section 3(b)(1) of this Act.</text>
			</paragraph><paragraph id="H98216BC8893F41F88A971215E2FF2204"><enum>(3)</enum><header>Local Care Corps Program</header><text display-inline="yes-display-inline">The term <term>local Care Corps program</term> means a program funded with a grant awarded under section 10(b) of this Act that hosts Corps
			 members and arranges for them to provide approved services to individuals
			 in need.</text>
			</paragraph><paragraph id="H5575D152D9B94E1B964DBE454BB0FB8D"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Health and Human Services.</text>
			</paragraph></section><section id="HC83A10A11DB54770BC535B92729C8200"><enum>3.</enum><header>Establishment of National Care Corps</header>
			<subsection id="HD09D7E85BA6D4537892D248A751FC86F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">There is established in the Department of Health and Human Services a program to be known as the <quote>National Care Corps</quote> through which Corps members provide approved services to individuals in need via participation in
			 local Care Corps programs.</text>
			</subsection><subsection id="HA8E98D09ED7D41EBB1A1ACF81FB20671"><enum>(b)</enum><header>Staff</header>
				<paragraph id="H8D704BC39F984C6FBC19B0640BF2A6E2"><enum>(1)</enum><header>Appointment of Director</header><text>The Secretary, acting through the Administrator for Community Living, shall appoint a Director of
			 the Corps.</text>
				</paragraph><paragraph id="H24F2A8F0509D4237B98D200C326DD47E"><enum>(2)</enum><header>Duties of Director</header><text display-inline="yes-display-inline">The Director shall—</text>
					<subparagraph id="H0D398A304F2E435B8E605FEB4AA793DC"><enum>(A)</enum><text>design, develop, and administer Corps programs;</text>
					</subparagraph><subparagraph id="H83EF7D5930CD4B8BAE52DCCDD1357EB2"><enum>(B)</enum><text>manage the daily operations of the Corps; and</text>
					</subparagraph><subparagraph id="HD55DC3616F474FBC8EAD760C4E23F9B2"><enum>(C)</enum><text display-inline="yes-display-inline">report to the Administrator for Community Living.</text>
					</subparagraph></paragraph><paragraph id="HF3B25D8B7C2443979C3B9284A93C776B"><enum>(3)</enum><header>Authority to Employ Staff</header><text display-inline="yes-display-inline">The Director may employ such staff as is necessary to carry out this Act.</text>
				</paragraph></subsection></section><section id="HB7FE2182EE364E54853D02644B676BA9"><enum>4.</enum><header>Selection and eligibility of members</header>
			<subsection id="H1BE38B7F175743239CEACADE7C9BB722"><enum>(a)</enum><header>In General</header>
				<paragraph id="H128AC622DDFE40158D80D50A0EDB2842"><enum>(1)</enum><header>Selection</header><text>The Director shall select eligible individuals for membership in the Corps.</text>
				</paragraph><paragraph id="H1976AF6EFBCC44079119EBD1187F1FBA"><enum>(2)</enum><header>Nondiscrimination</header><text display-inline="yes-display-inline">In selecting Corps members, the Director shall comply with all applicable provisions of State and
			 Federal laws and regulations pertaining to nondiscrimination and equal
			 employment opportunity.</text>
				</paragraph></subsection><subsection id="H9B5E3CBA8B6D4618B0E29459387D4AA8"><enum>(b)</enum><header>Eligible Individuals</header><text>To be eligible for membership in the Corps, an individual shall—</text>
				<paragraph id="H02E2B25656DA4BC38BA871753B6DEDEE"><enum>(1)</enum><text>be at least 18 years of age on or before December 31 of the calendar year in which the individual
			 begins participation in the Corps;</text>
				</paragraph><paragraph id="H40BB174EFA4743FB8961A8F534DDDE30"><enum>(2)</enum><text>agree to participate in the Corps for a period of not more than 24 months;</text>
				</paragraph><paragraph id="HDA3539CFD7794C4AAFB7C9CE34D226FB"><enum>(3)</enum><text>submit an application to the Director at such time, in such manner, and containing such information
			 as the Director may require;</text>
				</paragraph><paragraph id="H540CEAD8DF374D458CA23DE78DC03EEF"><enum>(4)</enum><text>pass a criminal background check as described in subsection (c); and</text>
				</paragraph><paragraph id="H4ADD25B1AB8C46AB91AB23BA1BBD8EFE"><enum>(5)</enum><text display-inline="yes-display-inline">agree to comply with such terms and conditions as the Director may require.</text>
				</paragraph></subsection><subsection id="H6E441F0C21A74864844741C33AAD3D7D"><enum>(c)</enum><header>Criminal background check</header>
				<paragraph id="HB7F603C5A54E41E4AA20462119C77B16"><enum>(1)</enum><header>In General</header><text>Before selecting any individual for membership in the Corps, the Director shall request a criminal
			 background check of such individual.</text>
				</paragraph><paragraph id="H29C1147C98894CD6B4E1823970236441"><enum>(2)</enum><header>Membership Prohibitions</header><text display-inline="yes-display-inline">An individual shall be ineligible to be a Corps member if—</text>
					<subparagraph id="H1EB360466173413980ECB6A469A20407"><enum>(A)</enum><text>such individual refuses to consent to the criminal background check; or</text>
					</subparagraph><subparagraph id="HE5AB54650A344E4D8FF12D4FA58B8DDD"><enum>(B)</enum><text>the criminal background check does not demonstrate to the Director’s satisfaction that such
			 individual is fit for Corps service.</text>
					</subparagraph></paragraph></subsection></section><section id="HDC58B9C887E6469197833432BF8E3663"><enum>5.</enum><header>Authorized Benefits for Corps Members</header>
			<subsection id="H3740FD726ECB4313A9E9CD2D2AD14150"><enum>(a)</enum><header>In General</header><text display-inline="yes-display-inline">The Director shall provide for members of the Corps to receive allowances, health insurance, and
			 post-service educational awards authorized by this section.</text>
			</subsection><subsection id="HF43DF6EBE6984E3AB1A6F9BBADA3E484"><enum>(b)</enum><header>Allowances</header><text display-inline="yes-display-inline">The Director shall provide each Corps member with such living, travel, and leave allowances, and
			 such housing transportation, supplies, equipment, and subsistence as the
			 Director may determine to be necessary for the member’s maintenance and to
			 ensure the member’s health and capacity to serve effectively.</text>
			</subsection><subsection id="HA1219219CEFA43E5BCC42EC0D0B7D6B6"><enum>(c)</enum><header>Health insurance</header>
				<paragraph id="HB6F648AE4561411B97BCD75648A90BA6"><enum>(1)</enum><header>In general</header><text>The Director shall provide for each Corps member to receive health insurance coverage.</text>
				</paragraph><paragraph id="H6805DFC236FE485DA2957F79F8AB81FC"><enum>(2)</enum><header>Minimum essential coverage</header><text>The health insurance coverage described paragraph (1) shall meet the requirements of section
			 5000A(f) of the Internal Revenue Code of 1986.</text>
				</paragraph></subsection><subsection id="H5DE006D9A29943D28D075FFF72989D6C"><enum>(d)</enum><header>Post-Service Educational Award</header>
				<paragraph id="HAD6A62A3849E48F0A66202DD1CC8011E"><enum>(1)</enum><header>In General</header><text>The Director shall establish an educational award for Corps members.</text>
				</paragraph><paragraph id="H5689818DCDF643FB9AC57F2ED6E91BEE"><enum>(2)</enum><header>Amounts</header>
					<subparagraph id="H8E9A3A22D96C47E4B51CB68EBF69C8B9"><enum>(A)</enum><header>Amount for Full-Time Service</header><text display-inline="yes-display-inline">In the case of a Corps member who completes a 12-month term of full-time service as determined by
			 the Director, such member shall receive an educational award having a
			 value equal to the maximum amount of a Federal Pell Grant under section
			 401 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a">20 U.S.C. 1070a</external-xref>) that a student
			 eligible for such grant may receive in the aggregate (without regard to
			 whether the funds are provided through discretionary or mandatory
			 appropriations) for the award year. A Corps member may receive up to 2
			 such awards.</text>
					</subparagraph><subparagraph id="H50EA96D61EA94C74A6EE5D08F229FC8F"><enum>(B)</enum><header>Amount for Other Periods of Service</header><text display-inline="yes-display-inline">In the case of a Corps member who completes less than a 12-month term of full-time service as
			 determined by the Director, such member may receive a portion of the
			 educational award described in subparagraph (A) that corresponds to the
			 quantity of service actually completed by the member.</text>
					</subparagraph></paragraph><paragraph id="H80D25314D88A407AAF026204DB318CCF"><enum>(3)</enum><header>Uses of Award</header><text>An educational award shall be used to pay—</text>
					<subparagraph id="HA7E2B87FDE164520805C4B280C9AF069"><enum>(A)</enum><text>costs of attendance at an institution of higher education; or</text>
					</subparagraph><subparagraph id="H14A372C8D9E941D186C7A48E7685AFFA"><enum>(B)</enum><text display-inline="yes-display-inline">government or commercial loans received by an individual for costs of attendance at an institution
			 of higher education.</text>
					</subparagraph></paragraph><paragraph id="H179020ED2AFF4D4A9A7345D9884D3C63"><enum>(4)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this subsection, the following definitions shall apply:</text>
					<subparagraph id="HA5AC201D8D954A4EAF75B2DBD32F2B17"><enum>(A)</enum><header>Cost of Attendance</header><text display-inline="yes-display-inline">The term <term>cost of attendance</term> has the meaning given such term by section 472 of the Higher Education Act of 1965 (20 U.S.C.
			 1087ll).</text>
					</subparagraph><subparagraph id="H515969AD52584A37864D0DB4A65A5FF0"><enum>(B)</enum><header>Institution of Higher Education</header><text display-inline="yes-display-inline">The term <term>institution of higher education</term> has the meaning given such term by section 101(a) of the Higher Education Act of 1965 (20 U.S.C.
			 1001(a)).</text>
					</subparagraph></paragraph></subsection><subsection id="HECA2F6F5F21846D09A6538304B5D8DD6"><enum>(e)</enum><header>Regulations</header><text>The Director shall issue any regulations that the Director determines to be necessary to carry out
			 this section.</text>
			</subsection></section><section id="H4E4BE3FE9F1F4282B987EF9E8CDA34DB"><enum>6.</enum><header>Assignment of Corps Members to Seniors and Individuals with Disabilities</header>
			<subsection id="H783EC9194C3D4001B4F21F6EDF74827D"><enum>(a)</enum><header>Assignment of Corps Members</header>
				<paragraph id="HA4C1D6F6A39545A2BA53CADB92E31288"><enum>(1)</enum><header>In General</header><text>The Director shall assign each Corps member to participate in a local Care Corps program.</text>
				</paragraph><paragraph id="H53EED09F70314BCB8F579B2A5240932A"><enum>(2)</enum><header>Priority of Assignment</header><text display-inline="yes-display-inline">In assigning Corps members to local Care Corps programs, the Director shall assign not less than 20
			 percent of members to programs that serve geographic areas in which the
			 Director determines there is a shortage of approved services available to
			 individuals in need, with consideration given to low-income and minority
			 populations.</text>
				</paragraph></subsection><subsection id="HB9F791B5B39E41A6B94FC8C6CC3D31D5"><enum>(b)</enum><header>Services Provided by Corps Members</header>
				<paragraph id="HA2A8732021EC4FFFA797A598A07B8C80"><enum>(1)</enum><header>In General</header><text>Corps members may only provide approved services to individuals in need through participation in
			 local Care Corps programs.</text>
				</paragraph><paragraph id="H0A94CAEA270C4925A3E18FB00AD90867"><enum>(2)</enum><header>Approved Services</header><text>Approved services are services provided directly to individuals in need in home-based settings
			 that—</text>
					<subparagraph id="HFDBC88B4794C4E649E3B2F0F9C10C7AB"><enum>(A)</enum><text display-inline="yes-display-inline">result in person-to-person, supportive relationships with each individual served;</text>
					</subparagraph><subparagraph id="H9B3BC991E8B3446284B44363814BCB57"><enum>(B)</enum><text display-inline="yes-display-inline">support the achievement and maintenance of the highest level of independent living for each
			 individual in need;</text>
					</subparagraph><subparagraph id="H2E39CFCD9275466BB2C3712FEA62A5AC"><enum>(C)</enum><text display-inline="yes-display-inline">are meaningful to the Corps member; and</text>
					</subparagraph><subparagraph id="H13B063DF0ACA4AB6B64F90BB4144795F"><enum>(D)</enum><text display-inline="yes-display-inline">are supported by appropriate orientation, training, and supervision.</text>
					</subparagraph></paragraph><paragraph id="H71917EFE00CA4F2FBBE43931BF0FD054"><enum>(3)</enum><header>Prohibited Services</header><text display-inline="yes-display-inline">In performing duties as a Corps member, no member shall provide—</text>
					<subparagraph id="H61C4B60D4E3B4E6BAD663DAC7374D2A4"><enum>(A)</enum><text>professional medical services;</text>
					</subparagraph><subparagraph id="H8DC90418626D463EA4428D0CA0DCA0E0"><enum>(B)</enum><text>administrative support services to a local Corps program;</text>
					</subparagraph><subparagraph id="H7FE7DFD1462F4145B388CF56A5DB7B23"><enum>(C)</enum><text>care in an institutional setting;</text>
					</subparagraph><subparagraph id="H9F154573462D4754AB6380BF1710EBBF"><enum>(D)</enum><text display-inline="yes-display-inline">care prohibited under State law; or</text>
					</subparagraph><subparagraph id="HAE35B75432A048759F8C2F6805975E5B"><enum>(E)</enum><text>any other services determined by the director to be inconsistent with the purposes of the Corps.</text>
					</subparagraph></paragraph><paragraph id="H10202288D9E94D69A37B67F410DA9A84"><enum>(4)</enum><header>Guidance Regarding Scope of Services</header><text display-inline="yes-display-inline">The Director may issue guidance describing the scope of services that may be provided by Corps
			 members. In issuing such guidance, the Director shall provide for a public
			 notice and comment period of not less than 30 days before issuing the
			 guidance in final form.</text>
				</paragraph></subsection><subsection id="HCC96D329C55F47419DAF852BA6640C95"><enum>(c)</enum><header>Individual in Need</header><text>The term <term>individual in need</term> means an individual who—</text>
				<paragraph id="HFE4764A91EDE4A7CBAE84A80C639395E"><enum>(1)</enum><text display-inline="yes-display-inline">is at least 65 years of age or has a disability as defined in section 3 of the Americans With
			 Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12102">42 U.S.C. 12102</external-xref>);</text>
				</paragraph><paragraph id="H5425D2DE6FC44301AB2EB202FA6316AC"><enum>(2)</enum><text>has difficulty with self-care; and</text>
				</paragraph><paragraph id="H75D3A442FC7245FE93049FEA28A9399A"><enum>(3)</enum><text display-inline="yes-display-inline">meets such other criteria as the Director determines to be appropriate.</text>
				</paragraph></subsection></section><section id="HD4E1D7DCFE0943BCAE3DBFEA7E9DECE2"><enum>7.</enum><header>Training and Standards of Conduct</header>
			<subsection id="H4309F77792BE4D24A3B90D37F6A924BF"><enum>(a)</enum><header>Pre-Assignment Training Program</header><text display-inline="yes-display-inline">The Director shall develop a training program that provides Corps members with instruction in the
			 skills necessary to carry out an assignment in a local Care Corps program.
			 Such training program shall include—</text>
				<paragraph id="H24E662FF09AB44039676025681E4220D"><enum>(1)</enum><text>at least 20 hours of instruction for each Corps member; and</text>
				</paragraph><paragraph id="H32E1BCEF286647C4B367A1E4616A5B23"><enum>(2)</enum><text>any other requirements the Director determines to be appropriate.</text>
				</paragraph></subsection><subsection id="H37E6F5DE745942DF9CCA518D813A459B"><enum>(b)</enum><header>Standards of Conduct</header><text display-inline="yes-display-inline">The Director shall establish and enforce standards to promote proper conduct and discipline within
			 the Corps.</text>
			</subsection></section><section id="H7C28424BD33B4F998B33618506E180F3"><enum>8.</enum><header>Status of Corps Members Under Federal Law</header>
			<subsection id="H232D97F41C8748B7BC9E1FC0B7B1E576"><enum>(a)</enum><header>In general</header><text>Except as otherwise provided in this section, members of the Corps shall not, by reason of their
			 status as members, be treated as Federal employees or be subject to the
			 provisions of law relating to Federal employment.</text>
			</subsection><subsection id="H6AA261D088354E68B4205ABDB8AEBAD2"><enum>(b)</enum><header>Work-Related injuries</header>
				<paragraph id="HCE26ED7F51DF46919F009ABF0F80FABA"><enum>(1)</enum><header>In general</header><text>For purposes of subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/81">chapter 81</external-xref> of title 5, United States Code, relating to the
			 compensation of Federal employees for work injuries, members of the Corps
			 shall be treated as employees of the United States within the meaning of
			 the term <term>employee</term>, as defined in section 8101 of such title.</text>
				</paragraph><paragraph id="H457961CD08094E6485B9E1EE2A32C8C2"><enum>(2)</enum><header>Special rule</header><text>In the application of the provisions of subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/81">chapter 81</external-xref> of title 5, United States Code,
			 to a member of the Corps, the member shall not be treated to be in the
			 performance of duty while absent from the member’s assigned post of duty
			 unless the absence is authorized in accordance with procedures prescribed
			 by the Director.</text>
				</paragraph></subsection><subsection id="H6553E341BD2C471CAB7D8A0878D3F3A6"><enum>(c)</enum><header>Tort claims procedure</header><text>A member of the Corps shall be treated as an employee of the United States for purposes of chapter
			 171
			 of title 28, United States Code, relating to tort claims liability and
			 procedure.</text>
			</subsection></section><section id="H02892A09055D4284A80152ADEBFF3F3F"><enum>9.</enum><header>Reporting Requirements</header><text display-inline="no-display-inline">The Secretary of Health and Human Services, acting through the Administrator for Community Living,
			 shall transmit to Congress at least once in each fiscal year a report on
			 the Corps. At minimum, such report shall include—</text>
			<paragraph id="H59B1CC1069D9458FA11FF2EF2564A273"><enum>(1)</enum><text>a description of the population served by the Corps during the preceding fiscal year;</text>
			</paragraph><paragraph id="HAA94872549C04FA196D4453D32A7605F"><enum>(2)</enum><text>an evaluation of Corps operations; and</text>
			</paragraph><paragraph id="HB5058A7911724E299CF96B98A2E8AA74"><enum>(3)</enum><text>recommendations, if any, for improving Corps operations.</text>
			</paragraph></section><section id="H24FA481675A14753873B1A783E05B75E"><enum>10.</enum><header>Local Care Corps Programs</header>
			<subsection id="H82CF65134CA443FC9BD832D539346C7B"><enum>(a)</enum><header>Functions of Local Care Corps Programs</header><text>Local Care Corps programs shall—</text>
				<paragraph id="H2DB9949683D94EF482799B03CEAEDACC"><enum>(1)</enum><text>conduct in-person orientation and training for Corps members;</text>
				</paragraph><paragraph id="H7AA8AD7C056A4EE9A7C307BDB94A9DB5"><enum>(2)</enum><text>develop and monitor member assignments, which shall include selecting the individuals in need to be
			 served by Corps members, matching members to assignments, and supervising
			 members;</text>
				</paragraph><paragraph id="HEC48C0CFF6DD47FCA432543F4B95F918"><enum>(3)</enum><text display-inline="yes-display-inline">maintain records and prepare reports as required by the Director; and</text>
				</paragraph><paragraph id="H92C773B17C694B3EB4570782C70B8926"><enum>(4)</enum><text>carry out any other activities determined to be appropriate by the Director.</text>
				</paragraph></subsection><subsection id="H66EE3802922F49769DA476A88607A747"><enum>(b)</enum><header>Grants for Local Care Corps Programs</header><text display-inline="yes-display-inline">The Director may award grants to qualified entities for the operation of local Care Corps programs.</text>
				<paragraph id="HB3225DDBCAD149D182E9DEA50F27A544"><enum>(1)</enum><header>Qualified Entity</header><text>The term <term>qualified entity</term> means a public or private nonprofit entity that is—</text>
					<subparagraph id="H2639C3FD7E7A4611B83144FBBC062861"><enum>(A)</enum><text>part of an aging network, as defined by section 102(5) of the Older Americans Act of 1965 (42
			 U.S.C. 3002(5));</text>
					</subparagraph><subparagraph id="H5959410ACCEB46948647665D99E0B2DB"><enum>(B)</enum><text>a time-banking or volunteer organizing agency;</text>
					</subparagraph><subparagraph id="H9C0AD21F090D4E15A4197D147AD602AB"><enum>(C)</enum><text>a State, county, or local government; or</text>
					</subparagraph><subparagraph id="H176A05F921A8484E837BCC0570CAFE3D"><enum>(D)</enum><text>any other entity determined to be appropriate by the Director.</text>
					</subparagraph></paragraph><paragraph id="H6A21AC8F8F80467A8676718A560C5700"><enum>(2)</enum><header>Application Process</header><text display-inline="yes-display-inline">To be eligible for a grant under this subsection, a qualified entity shall—</text>
					<subparagraph id="HA8F8B5F2C95D4B9E83BBE143AE5E8C3F"><enum>(A)</enum><text>submit an application to the Director at such time, in such manner, and containing such information
			 as the Director may require; and</text>

			<subsection id="H3B0F224EE58340528CF7F417C75158D7"><enum>(a)</enum><header>In General</header><text display-inline="yes-display-inline">There is authorized to be appropriated $350,000,000 for each of the fiscal years beginning after
			 the date of the enactment of this Act.</text>
			</subsection><subsection id="H5D7EF5FA9A3043E7A9E4780A31F5CC28"><enum>(b)</enum><header>Continued Availability of Funds</header><text>Amounts authorized to be appropriated under subsection (a) for a fiscal year are authorized to
			 remain available for that fiscal year and the subsequent fiscal year.</text>
