<section display-inline="yes-display-inline" id="HCE96BB0EE3F0454EB2549B8266B37389" section-type="undesignated-section"><text display-inline="yes-display-inline"><pagebreak/>That the following sums are appropriated, out of any money in the Treasury not otherwise appropriated, for the fiscal year ending September 30, 2014, and for other purposes, namely:</text> </section> 
<division id="H543EB97633ED44EB8227CDBB95C91703"><enum>A</enum><header>supplemental appropriations and rescissions</header> 
<title id="H45C7B44A5AB940CABE3108C0248AF37B"><enum>I</enum><appropriations-major id="HDA371CC2A44B4DFF80A7C18D8581E5ED"><header>department of homeland security</header></appropriations-major><appropriations-intermediate id="HA3783BF2EE4F4287A20DCCBC5EDAFF79"><header>U.S. customs and border protection</header></appropriations-intermediate><appropriations-small id="H46E999E89C574646A751C23CC812D39F"><header>Salaries and expenses</header><text display-inline="no-display-inline">For an additional amount for <quote>Salaries and Expenses</quote>, $71,000,000, to remain available until September 30, 2015, for necessary expenses to apprehend, transport, and provide temporary shelter associated with the significant rise in unaccompanied alien children and alien adults accompanied by an alien minor at the Southwest Border of the United States, including related activities to secure the border, disrupt transnational crime, and the necessary acquisition, construction, improvement, repair, and management of facilities: <italic>Provided</italic>, That not later than 30 days after the date of the enactment of this Act, the Secretary of Homeland Security shall submit to the Committees on Appropriations of the House of Representatives and the Senate an obligation and quarterly expenditure plan for these funds: <italic>Provided further</italic>, That the Secretary shall provide to such Committees quarterly updates on the expenditure of these funds.</text></appropriations-small><appropriations-intermediate id="H5EEB1756DD8A49A089B4D5363D4BC95F"><header>U.S. immigration and customs enforcement</header></appropriations-intermediate><appropriations-small id="HE2FDC037907B43F483107E668AFB2B30"><header>salaries and expenses</header><text display-inline="no-display-inline">For an additional amount for “Salaries and Expenses”, $334,000,000, to remain available until September 30, 2015, for necessary expenses to respond to the significant rise in unaccompanied alien children and alien adults accompanied by an alien minor at the Southwest Border of the United States, including for enforcement of immigration and customs law, including detention and removal operations, of which $262,000,000 shall be for Custody Operations and $72,000,000 shall be for Transportation and Removal operations: <italic>Provided</italic>, That not later than 30 days after the date of the enactment of this Act, the Secretary of Homeland Security shall submit to the Committees on Appropriations of the House of Representatives and the Senate an obligation and quarterly expenditure plan for these funds: <italic>Provided further</italic>, That the Secretary shall provide to such Committees quarterly updates on the expenditure of these funds.</text></appropriations-small><appropriations-major id="H964412CDF1594B97B23F45A505945BAF"><header>general provisions—this title</header></appropriations-major><appropriations-small id="H3BE11CAEB9344E318C883B246E449F77"><header>(including rescission)</header> </appropriations-small> 
<section id="H4AF2FA3CF1DF4EB689A40BEDFF96B690"><enum>101.</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of law, none of the funds provided by this title shall be available for obligation or expenditure through a reprogramming or transfer of funds that proposes to use funds directed for a specific activity by either of the Committees on Appropriations of the House of Representatives or the Senate for a different purpose than for which the appropriations were provided: <italic>Provided</italic>, That prior to the obligation of such funds, a request for approval shall be submitted to such Committees.</text> </section> 
<section id="H3A77F8963A7340E9A7C7138BBC2C3308"><enum>102.</enum><text display-inline="yes-display-inline">The Secretary of Homeland Security shall provide to the Congress quarterly reports that include: (1) the number of apprehensions at the border delineated by unaccompanied alien children and alien adults accompanied by an alien minor; (2) the number of claims of a credible fear of persecution delineated by unaccompanied alien children and alien adults accompanied by an alien minor, and the number of determinations of valid claims of a credible fear of persecution delineated by unaccompanied alien children and alien adults accompanied by an alien minor; (3) the number of unaccompanied alien children and alien adults accompanied by an alien minor granted asylum by an immigration judge, delineated by year of apprehension; (4) the number of alien adults accompanied by an alien minor in detention facilities, alternatives to detention, and other non-detention forms of supervision; and (5) the number of removals delineated by unaccompanied alien children and alien adults accompanied by an alien minor.</text> </section> 
<section display-inline="no-display-inline" id="H1D0DD4A1D18D4C059CDDA914F6512A03"><enum>103.</enum><text display-inline="yes-display-inline">Of the unobligated balance available for <quote>Department of Homeland Security—Federal Emergency Management Agency—Disaster Relief Fund</quote>, $405,000,000 is rescinded: <italic>Provided,</italic> That no amounts may be rescinded from amounts that were designated by the Congress as an emergency requirement pursuant to a concurrent resolution on a budget or the Balanced Budget and Emergency Deficit Control Act of 1985: <italic>Provided further</italic>, That no amounts may be rescinded from the amounts that were designated by the Congress as being for disaster relief pursuant to section 251(b)(2)(D) of the Balanced Budget and Emergency Deficit Control Act of 1985.</text> </section> 
<section commented="no" id="H7F836C0E9C984A62829184ABFCD25567"><enum>104.</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of law, grants awarded under sections 2003 or 2004 of the Homeland Security Act of 2002 (6 U.S.C. 604 and 605) using funds provided under the heading <quote>Federal Emergency Management Agency—State and Local Programs</quote> in division F of <external-xref legal-doc="public-law" parsable-cite="pl/113/76">Public Law 113–76</external-xref>, division D of <external-xref legal-doc="public-law" parsable-cite="pl/113/6">Public Law 113–6</external-xref>, or division D of <external-xref legal-doc="public-law" parsable-cite="pl/112/74">Public Law 112–74</external-xref> may be used by State and local law enforcement and public safety agencies within local units of government along the Southwest Border of the United States for costs incurred during the award period of performance for personnel, overtime, travel, costs related to combating illegal immigration and drug smuggling, and costs related to providing humanitarian relief to unaccompanied alien children and alien adults accompanied by an alien minor who have entered the United States.</text> </section> 
<section id="HA27F6EBD49404F3AB46627A1DFA0B9C4"><enum>105.</enum><text display-inline="yes-display-inline">Notwithstanding any other provision in this or any other Act, amounts transferred to the Department of Homeland Security pursuant to section 202 of this Act shall be provided by the Secretary of Homeland Security under the heading <quote>Federal Emergency Management Agency—State and Local Programs</quote> to States along the Southwest Border of the United States as reimbursement for necessary costs of National Guard personnel activated under the operational control of the Governors of such States and deployed for the purpose of border security.</text></section></title> 
<title id="HE8B11601866D4894B43C9C6B9B33A59C"><enum>II</enum><appropriations-major id="H5E2E4BFF5B6B4CB7BFCB2B6E82D97F57"><header>department of defense—military</header></appropriations-major><appropriations-major id="H0285FE2758A141F78D30B4E0B997F284"><header>military personnel</header></appropriations-major><appropriations-intermediate id="H016AA12CB6D44C1993675F283B26F1BC"><header>national guard personnel, army</header><text display-inline="no-display-inline">For an additional amount for <quote>National Guard Personnel, Army</quote>, $47,419,000, to remain available until September 30, 2015, for necessary expenses related to the Southwest Border of the United States.</text></appropriations-intermediate><appropriations-intermediate id="H16E3E768C5654695951DBB48B96A5038"><header>national guard personnel, air force</header><text display-inline="no-display-inline">For an additional amount for <quote>National Guard Personnel, Air Force</quote>, $2,258,000, to remain available until September 30, 2015, for necessary expenses related to the Southwest Border of the United States.</text></appropriations-intermediate><appropriations-major id="HB9858E96193B446B99014D25EAAC8D1C"><header>operation and maintenance</header></appropriations-major><appropriations-intermediate id="H0BB102161D9F4F9FBBE14CAEE945287D"><header>operation and maintenance, army national guard</header><text display-inline="no-display-inline">For an additional amount for <quote>Operation and Maintenance, Army National Guard</quote>, $15,807,000, to remain available until September 30, 2015, for necessary expenses related to the Southwest Border of the United States.</text></appropriations-intermediate><appropriations-intermediate id="H96DA86BA41814314849066D84772958E"><header>operation and maintenance, air national guard</header><text display-inline="no-display-inline">For an additional amount for <quote>Operation and Maintenance, Air National Guard</quote>, $4,516,000, to remain available until September 30, 2015, for necessary expenses related to the Southwest Border of the United States.</text></appropriations-intermediate><appropriations-major id="H3A047E88E505452FBFF19918D4D256C8"><header>general provisions—this title</header></appropriations-major><appropriations-small id="HC51CF29C6701468B983801B645BF1DA4"><header>(rescission)</header> </appropriations-small> 
<section id="HA00C388CB3D54C188F537B4CB8395E71"><enum>201.</enum><text display-inline="yes-display-inline">Of the unobligated balances of amounts appropriated in title II of division C of <external-xref legal-doc="public-law" parsable-cite="pl/113/76">Public Law 113–76</external-xref> for <quote>Operation and Maintenance, Defense-Wide</quote>, $70,000,000 is hereby rescinded to reflect excess cash balances in Department of Defense Working Capital Funds.</text> </section> 
<section id="H8764376C931A4591A1659D3F363446F3"><enum>202.</enum><text display-inline="yes-display-inline">Notwithstanding any other provision in this Act, of the amounts made available by this Act for <quote>National Guard Personnel, Army</quote>, the Secretary of Defense shall transfer to the Department of Homeland Security such funds as may be necessary, not to exceed $35,000,000, to reimburse the States for the cost of any units or personnel of the National Guard, to perform operations and missions under State Active Duty status, deployed in support of a southern border mission.</text></section></title>

<appropriations-major id="HCC6AA31C6329449D85DA586F8F53EF07"><header>department of justice</header></appropriations-major><appropriations-intermediate id="H732AFC33B8D140D2B5EA5E88494EC0E8"><header>general administration</header> </appropriations-intermediate><appropriations-small id="H6B61F4B61BAD4009BC0BE4BE7AEF08CD"><header>administrative review and appeals</header><text display-inline="no-display-inline">For an additional amount for <quote>Administrative Review and Appeals</quote> for necessary expenses to respond to the significant rise in unaccompanied alien children and alien adults accompanied by an alien minor at the Southwest Border of the United States, $22,000,000, to remain available until September 30, 2015, of which $12,900,000 shall be for additional temporary immigration judges and related expenses, and $9,100,000 shall be for technology for judges to expedite the adjudication of immigration cases.</text></appropriations-small><appropriations-major id="H952D78EDA48B453EB4EEB0307BDF8830"><header>general provision—this title</header></appropriations-major><appropriations-small id="H24CAF346A4C84E5A97E0F380EC40787A"><header>(rescission)</header> </appropriations-small> 
<section id="HB81EFB6A811C4AD897DB49764116090B"><enum>301.</enum><text display-inline="yes-display-inline">Of the unobligated balances available for <quote>Department of Justice—Legal Activities—Assets Forfeiture Fund</quote>, $22,000,000 is hereby permanently rescinded.</text> </section></title>

<appropriations-major id="H0E3329418EDE4ABDB2258B501D0A254B"><header>general provisions—this title</header></appropriations-major><appropriations-intermediate id="HD95D215D2D2F4BB2B1271777E40BE4CD"><header>repatriation and reintegration</header> </appropriations-intermediate> 
<section id="H4124D1C919BE40CD81E5EFDE0EC4D3D3"><enum>401.</enum> 
<subsection commented="no" display-inline="yes-display-inline" id="H95D9461372A645128780E3E434301D9C"><enum>(a)</enum><header>Repatriation and Reintegration</header><text display-inline="yes-display-inline">Of the funds appropriated in titles III and IV of division K of <external-xref legal-doc="public-law" parsable-cite="pl/113/76">Public Law 113–76</external-xref>, and in prior Acts making appropriations for the Department of State, foreign operations, and related programs, for assistance for the countries in Central America, up to $40,000,000 shall be made available for such countries for repatriation and reintegration activities: <italic>Provided</italic>, That funds made available pursuant to this section may be obligated notwithstanding subsections (c) and (e) of section 7045 of division K of <external-xref legal-doc="public-law" parsable-cite="pl/113/76">Public Law 113–76</external-xref>.</text> </subsection> 
<subsection id="HA344D3D9366E4261B1469BE647A6CB5D"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Prior to the initial obligation of funds made available pursuant to this section, but not later than 15 days after the date of enactment of this Act, and every 90 days thereafter until September 30, 2015, the Secretary of State, in consultation with the Administrator of the United States Agency for International Development, shall submit to the appropriate congressional committees a report on the obligation of funds made available pursuant to this section by country and the steps taken by the government of each country to—</text> 
<paragraph id="H79D4F47C278148F88C7F6C056547A80E"><enum>(1)</enum><text>improve border security;</text> </paragraph> 
<paragraph id="H6598CF4F8E53444F90A0268D3A37AD4F"><enum>(2)</enum><text>enforce laws and policies to stem the flow of illegal entries into the United States;</text> </paragraph> 
<paragraph id="H6C2D727E83DB4336ADD2CA540A9469BA"><enum>(3)</enum><text>enact laws and implement new policies to stem the flow of illegal entries into the United States, including increasing penalties for human smuggling;</text> </paragraph> 
<paragraph id="H5F306E0A20FD4F3EB24BE0B17F7CFBAB" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">conduct public outreach campaigns to explain the dangers of the journey to the Southwest Border of the United States, emphasize the lack of immigration benefits available, and emphasize that illegal aliens will be removed to their country; and</text></paragraph> 
<paragraph id="HCDBFF6B9E94F4E0BBA92BB00A7850692"><enum>(5)</enum><text>cooperate with United States Federal agencies to facilitate and expedite the return, repatriation, and reintegration of illegal migrants arriving at the Southwest Border of the United States.</text> </paragraph></subsection> 
<subsection id="H2C979B5DDAF347F48E02B1873323714E"><enum>(c)</enum><header>Suspension of Assistance</header><text display-inline="yes-display-inline">The Secretary of State shall suspend assistance provided pursuant to this section to the government of a country if such government is not making significant progress on each item described in paragraphs (1) through (5) of subsection (b): <italic>Provided</italic>, That assistance may only be resumed if the Secretary reports to the appropriate congressional committees that subsequent to the suspension of assistance such government is making significant progress on each of the items enumerated in such subsection.</text> </subsection> 
<subsection id="HEF3C8027275449CD8906C743793D6483"><enum>(d)</enum><header>Notification requirement</header><text>Funds made available pursuant to this section shall be subject to the regular notification procedures of the Committees on Appropriations of the House of Representatives and the Senate.</text></subsection></section><appropriations-small id="H371D30A7FCCC41AC9D5EB53548F9A058"><header>(rescission)</header> </appropriations-small> 
<section id="HF4A5E46C3D574F679C27E91FC78B9713"><enum>402.</enum><text display-inline="yes-display-inline">Of the unexpended balances available to the President for bilateral economic assistance under the heading <quote>Economic Support Fund</quote> from prior Acts making appropriations for the Department of State, foreign operations, and related programs, $197,000,000 is rescinded: <italic>Provided</italic>, That no amounts may be rescinded from amounts that were designated by the Congress for Overseas Contingency Operations/Global War on Terrorism pursuant to section 251(b)(2)(A) of the Balanced Budget and Emergency Deficit Control Act of 1985 or as an emergency requirement pursuant to a concurrent resolution on the budget or the Balanced Budget and Emergency Deficit Control Act of 1985.</text> </section></title>

<section id="H76729E09B8E146CAA5E11D45766EBD1A"><enum>101.</enum><header>Repatriation of unaccompanied alien children</header><text display-inline="no-display-inline">Section 235(a) of the William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/8/1232">8 U.S.C. 1232(a)</external-xref>) is amended—</text> 
<paragraph id="HB145CE8A8AAD4C1AB88F29A61A7638A0"><enum>(1)</enum><text>in paragraph (2)—</text> 
<subparagraph id="HE3824F29FE2C483E9B40E7B7C91C4B13"><enum>(A)</enum><text>by amending the paragraph heading to read as follows: <quote><header-in-text level="paragraph" style="OLC">Rules for unaccompanied alien children.</header-in-text></quote>;</text></subparagraph> 
<subparagraph id="H510EAE9B394F44B2AA8F267EC024F277"><enum>(B)</enum><text>in subparagraph (A)—</text> 
<clause id="H15E52D87AB9844099FE0CCE0D4F06B78"><enum>(i)</enum><text>in the matter preceding clause (i), by striking <quote>who is a national or habitual resident of a country that is contiguous with the United States</quote>;</text></clause>

<clause id="H88CB21F093594D65B40DEB11D8B2618F"><enum>(i)</enum><text>by amending the subparagraph heading to read as follows: <quote><header-in-text level="subparagraph" style="OLC">Agreements with foreign countries</header-in-text>.</quote>; and</text></clause> 
<clause id="H8AB6B9C8D7EE47FAB13F3063A78739B1"><enum>(ii)</enum><text>in the matter preceding clause (i), by striking <quote>The Secretary of State shall negotiate agreements between the United States and countries contiguous to the United States</quote> and inserting <quote>The Secretary of State may negotiate agreements between the United States and any foreign country that the Secretary determines appropriate</quote>; and</text></clause></subparagraph></paragraph>

<subparagraph id="HEDBEF2A1F9BF4BA3B42325189C22AD15"><enum>(B)</enum><text>in clause (i), by inserting before the semicolon at the end the following: <quote>, which shall include a hearing before an immigration judge not later than 14 days after being screened under paragraph (4) and the unaccompanied alien child shall be detained until such hearing</quote>.</text></subparagraph></paragraph></section> 
<section id="HE1E6B21FC29447B791C217325E748605"><enum>102.</enum><header>Last in, first out</header><text display-inline="no-display-inline">In any removal proceedings under section 240 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1229a">8 U.S.C. 1229a</external-xref>) with respect to an unaccompanied alien child (as defined in section 462(g)(2) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/279">6 U.S.C. 279(g)(2)</external-xref>)), priority shall be accorded to the alien who has most recently arrived in the United States.</text></section> 
<section id="H30877C787FCA43C1A1B1BA50653FFB74"><enum>103.</enum><header>Emergency immigration judge resources</header><text display-inline="no-display-inline">Not later than 14 days after the date of the enactment of this Act, the Attorney General shall designate up to 40 immigration judges, including through the hiring of retired immigration judges, administrative law judges, or magistrate judges, or the reassignment of current immigration judges. Such designations shall remain in effect solely for the duration of the humanitarian crisis at the southern border (as determined by the Secretary of Homeland Security, in consultation with the Attorney General).</text></section> 
<section id="H582E491502E24C3E9D3F8B53F2F04543"><enum>104.</enum><header>Protecting children from human traffickers, sex offenders, and other criminals</header><text display-inline="no-display-inline">Section 235(c)(3) of the William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/8/1232">8 U.S.C. 1232(c)(3)</external-xref>) is amended—</text> 
<paragraph id="HEE01A59168C54CDA85A6FF490F688A37"><enum>(1)</enum><text>in subparagraph (A), by inserting <quote>, including a mandatory biometric criminal history check</quote> before the period at the end; and</text> </paragraph> 
<paragraph id="H8070504E57214F2BA4894E707ACE3A0E"><enum>(2)</enum><text>by adding at the end the following—</text> 
<quoted-block display-inline="no-display-inline" id="H3B55D9760EBA42D88EF44EA82F92C089" style="OLC"> 
<subparagraph id="H813B21FEF46348CEA74CD979B3DAE12B"><enum>(D)</enum><header>Prohibition on placement with sex offenders and human traffickers</header> 
<clause id="HC674745D39994A219838EE2475D712C0"><enum>(i)</enum><header>In general</header><text>The Secretary of Health and Human Services may not place an unaccompanied alien child in the custody of an individual who has been convicted of—</text> 
<subclause id="H39C33D1AE24341FA80068BA0499E1010"><enum>(I)</enum><text>a sex offense (as defined in section 111 of the Sex Offender Registration and Notification Act (<external-xref legal-doc="usc" parsable-cite="usc/42/16911">42 U.S.C. 16911</external-xref>)); or</text> </subclause> 
<subclause id="H21372CB020B54F4EBFB0B47B0757627C"><enum>(II)</enum><text>a crime involving a severe form of trafficking in persons (as defined in section 103 of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102</external-xref>)).</text> </subclause></clause> 
<clause id="H590E25C5106547F0A0D622B7142DAA06"><enum>(ii)</enum><header>Requirements of criminal background check</header><text>A biometric criminal history check under subparagraph (A) shall be based on a set of fingerprints or other biometric identifiers and conducted through—</text> 
<subclause id="HDF5511634FBA454F868FB9A5F786A92B"><enum>(I)</enum><text>the Federal Bureau of Investigation; and</text> </subclause> 
<subclause id="HA00669DB39574153B8171ADA14816CF4"><enum>(II)</enum><text>criminal history repositories of all States that the individual lists as current or former residences.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section> 
<section id="H8F440BCA41764C3B8D6E9412488BB5EF"><enum>105.</enum><header>Inclusion of additional grounds for per se ineligibility for asylum</header><text display-inline="no-display-inline">Section 208(b)(2)(A)(iii) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1158">8 U.S.C. 1158(b)(2)(A)(iii)</external-xref>) is amended by inserting after <quote>a serious nonpolitical crime</quote> the following: <quote>(including any drug-related offense punishable by a term of imprisonment greater than 1 year)</quote>.</text> </section></title> 
<title id="H5E848A56E96F4164B89E55F713A010C4" style="OLC"><enum>II</enum><header>Use of National Guard to Improve Border Security</header> 
<section id="H242EEE3402574EB8989EEF2A23D68EF2"><enum>201.</enum><header>National Guard support for border operations</header> 
<subsection id="H38A5B0D7C9354FE9A6E0AA73CCF34DDA"><enum>(a)</enum><header>Deployment authority and funding</header><text display-inline="yes-display-inline">Amounts appropriated for the Department of Defense in this Act shall be expended for any units or personnel of the National Guard deployed to perform operations and missions under <external-xref legal-doc="usc" parsable-cite="usc/32/502">section 502(f)</external-xref> of title 32, United States Code, on the southern border of the United States.</text> </subsection> 
<subsection id="H19D4C25C19AE4A3883EEA67BDFCF9567"><enum>(b)</enum><header>Assignment of operations and missions</header> 
<paragraph id="HDE649465C2AA4CEF814A995B4848EE50"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">National Guard units and personnel deployed under subsection (a) may be assigned such operations as may be necessary to provide assistance for operations on the southern border, with priority given to high traffic areas experiencing the highest number of crossings by unaccompanied alien children.</text> </paragraph> 
<paragraph id="HC3DF6D7A42A84E8BAF6854B0149750B8"><enum>(2)</enum><header>Nature of duty</header><text>The duty of National Guard personnel performing operations and missions on the southern border shall be full-time duty under title 32, United States Code.</text> </paragraph></subsection> 
<subsection id="H3DA1A2EA9DE74CFFB794E05FFF6815F2"><enum>(c)</enum><header>Materiel and logistical support</header><text>The Secretary of Defense shall deploy such materiel and equipment and logistical support as may be necessary to ensure success of the operations and missions conducted by the National Guard under this section.</text> </subsection> 
<subsection id="H973B41DFC44F4CF98B257C8AB2A3DE2E"><enum>(d)</enum><header>Exclusion from national guard personnel strength limitations</header><text>National Guard personnel deployed under subsection (a) shall not be included in—</text> 
<paragraph id="H0407A64761924D93BA7DA8A7AA807841"><enum>(1)</enum><text>the calculation to determine compliance with limits on end strength for National Guard personnel; or</text> </paragraph> 
<paragraph id="H09615836A25D4623AF28863F9E7D9493"><enum>(2)</enum><text>limits on the number of National Guard personnel that may be placed on active duty for operational support under <external-xref legal-doc="usc" parsable-cite="usc/10/115">section 115</external-xref> of title 10, United States Code.</text> </paragraph></subsection> 
<subsection id="H78C92F6C1776484CA7EFCDC3821E612B"><enum>(e)</enum><header>High traffic areas defined</header><text display-inline="yes-display-inline">In this section:</text> 
<paragraph id="HA59EB48D270145D0A9C558DFD1C8DDA3"><enum>(1)</enum><text>The term <quote>high traffic areas</quote> means sectors along the northern and southern borders of the United States that are within the responsibility of the Border Patrol that have the most illicit cross-border activity, informed through situational awareness.</text> </paragraph> 
<paragraph id="H3A5BEF006BFB4B5E85AE033787993805"><enum>(2)</enum><text display-inline="yes-display-inline">The term <quote>unaccompanied alien child</quote> means a child who—</text> 
<subparagraph id="H9015BEAAB82B4C6A9C503AD7F291DCB6"><enum>(A)</enum><text>has no lawful immigration status in the United States;</text> </subparagraph> 
<subparagraph id="HE9C56DF4A34D430BA941961EA5BDC795"><enum>(B)</enum><text>has not attained 18 years of age; and</text> </subparagraph> 
<subparagraph id="HC4F93F05AEED43E8B991FE194F4355CB"><enum>(C)</enum><text>with respect to whom—</text> 
<clause id="H783249ECF7AD40CB8C49042A6E0BF972"><enum>(i)</enum><text>there is no parent or legal guardian in the United States; or</text> </clause> 
<clause id="HFC6A212871BB41D48E21A2F8A104AFED"><enum>(ii)</enum><text>no parent or legal guardian in the United States is available to provide care and physical custody.</text> </clause></subparagraph></paragraph></subsection></section></title> 
<title id="HEC149F090A954DD29363C7AD9850AEAE" section-style="olc-section-style" style="OLC"><enum>III</enum><header>National Security and Federal Lands Protection</header> 
<section id="HF776F0DEA82D45C194C5109155E660A4"><enum>301.</enum><header>Prohibition on actions that impede border security on certain Federal land</header> 
<subsection id="HFD77852B5C4640BDBD43D99599F7D8E5"><enum>(a)</enum><header>Prohibition on secretaries of the interior and agriculture</header><text display-inline="yes-display-inline">The Secretary of the Interior or the Secretary of Agriculture shall not impede, prohibit, or restrict activities of U.S. Customs and Border Protection on Federal land located within 100 miles of the United States border with Mexico that is under the jurisdiction of the Secretary of the Interior or the Secretary of Agriculture, to execute search and rescue operations, and to prevent all unlawful entries into the United States, including entries by terrorists, other unlawful aliens, instruments of terrorism, narcotics, and other contraband through such international land border of the United States. These authorities of U.S. Customs and Border Protection on such Federal land apply whether or not a state of emergency exists.</text> </subsection> 
<subsection id="H1DC8553B5FF340FE823ECEF93B13247F"><enum>(b)</enum><header>Authorized activities of U.S. customs and border protection</header><text display-inline="yes-display-inline">U.S. Customs and Border Protection shall have immediate access to Federal land within 100 miles of the United States border with Mexico that is under the jurisdiction of the Secretary of the Interior or the Secretary of Agriculture for purposes of conducting the following activities on such land that prevent all unlawful entries into the United States, including entries by terrorists, other unlawful aliens, instruments of terrorism, narcotics, and other contraband through such international land border of the United States:</text> 
<paragraph id="HB86C0DC674FE4845B730C53321B56A72"><enum>(1)</enum><text>Construction and maintenance of roads.</text> </paragraph> 
<paragraph id="H959E2E0FE7864B35A5533FCB89060B77"><enum>(2)</enum><text>Construction and maintenance of barriers.</text> </paragraph> 
<paragraph id="H57E1D6CFE86946F4B04B6C055E940789"><enum>(3)</enum><text>Use of vehicles to patrol, apprehend, or rescue.</text> </paragraph> 
<paragraph id="H3E40FE8564474074A42DBA2C5F403F1F"><enum>(4)</enum><text>Installation, maintenance, and operation of communications and surveillance equipment and sensors.</text> </paragraph> 
<paragraph id="H32B820B756DD42709A85B9FD4FF5C81D"><enum>(5)</enum><text>Deployment of temporary tactical infrastructure.</text> </paragraph></subsection> 
<subsection id="H7C6BBDEBC9084DF4985CB7439E4B1BDC"><enum>(c)</enum><header>Clarification relating to waiver authority</header> 
<paragraph id="HC4C0A579698045EBBCD8F56474B9F2D4"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law (including any termination date relating to the waiver referred to in this subsection), the waiver by the Secretary of Homeland Security on April 1, 2008, under section 102(c)(1) of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1103">8 U.S.C. 1103</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/104/208">Public Law 104–208</external-xref>) of the laws described in paragraph (2) with respect to certain sections of the international border between the United States and Mexico shall be considered to apply to all Federal land under the jurisdiction of the Secretary of the Interior or the Secretary of Agriculture within 100 miles of such international land border of the United States for the activities of U.S. Customs and Border Protection described in subsection (b).</text> </paragraph> 
<paragraph id="HDB26A4481273475DBC7B65F8EA711C76"><enum>(2)</enum><header>Description of laws waived</header><text>The laws referred to in paragraph (1) are limited to the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>), the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>), the National Historic Preservation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/470">16 U.S.C. 470 et seq.</external-xref>), <external-xref legal-doc="public-law" parsable-cite="pl/86/523">Public Law 86–523</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/16/469">16 U.S.C. 469 et seq.</external-xref>), the Act of June 8, 1906 (commonly known as the <quote>Antiquities Act of 1906</quote>; <external-xref legal-doc="usc" parsable-cite="usc/16/431">16 U.S.C. 431 et seq.</external-xref>), the Wild and Scenic Rivers Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1271">16 U.S.C. 1271 et seq.</external-xref>), the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>), the National Wildlife Refuge System Administration Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/16/668dd">16 U.S.C. 668dd et seq.</external-xref>), the Fish and Wildlife Act of 1956 (<external-xref legal-doc="usc" parsable-cite="usc/16/742a">16 U.S.C. 742a et seq.</external-xref>), the Fish and Wildlife Coordination Act (<external-xref legal-doc="usc" parsable-cite="usc/16/661">16 U.S.C. 661 et seq.</external-xref>), subchapter II of chapter 5, and chapter 7, of title 5, United States Code (commonly known as the <quote>Administrative Procedure Act</quote>), the National Park Service Organic Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1">16 U.S.C. 1 et seq.</external-xref>), the General Authorities Act of 1970 (<external-xref legal-doc="public-law" parsable-cite="pl/91/383">Public Law 91–383</external-xref>) (<external-xref legal-doc="usc" parsable-cite="usc/16/1a-1">16 U.S.C. 1a–1 et seq.</external-xref>), sections 401(7), 403, and 404 of the National Parks and Recreation Act of 1978 (<external-xref legal-doc="public-law" parsable-cite="pl/95/625">Public Law 95–625</external-xref>, 92 Stat. 3467), and the Arizona Desert Wilderness Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/1132">16 U.S.C. 1132</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/101/628">Public Law 101–628</external-xref>).</text> </paragraph></subsection> 
<subsection id="H9B7A6F776B98417DABBF18DEF81BAE31"><enum>(d)</enum><header>Protection of legal uses</header><text>This section shall not be construed to provide—</text> 
<paragraph id="H478CA29FA04044ABAFD158B23FF2054E"><enum>(1)</enum><text>authority to restrict legal uses, such as grazing, hunting, mining, or public-use recreational and backcountry airstrips on land under the jurisdiction of the Secretary of the Interior or the Secretary of Agriculture; or</text> </paragraph> 
<paragraph id="HB39166FFE6C34ED5A749521813B1E379"><enum>(2)</enum><text>any additional authority to restrict legal access to such land.</text> </paragraph></subsection> 
<subsection id="HF2D149AD5CB642F4A08A335BBC4A4EA2"><enum>(e)</enum><header>Effect on state and private land</header><text>This Act shall—</text> 
<paragraph id="H64A40726AE0A43E2921A56A93F2F3BFD"><enum>(1)</enum><text>have no force or effect on State or private lands; and</text> </paragraph> 
<paragraph id="HCC28865B18D9425CA231A9F765653D9C"><enum>(2)</enum><text>not provide authority on or access to State or private lands.</text> </paragraph></subsection> 
<subsection id="H557FDE9FA23C45F495027AB48A841219"><enum>(f)</enum><header>Tribal sovereignty</header><text>Nothing in this section supersedes, replaces, negates, or diminishes treaties or other agreements between the United States and Indian tribes.</text> </subsection></section> 
<section id="HA1584153448342929BB224B984DB0D04" section-type="subsequent-section"><enum>302.</enum><header>Sense of Congress on placement of unauthorized aliens at military installations</header> 
<subsection id="H73A0FC20EF5847E0808CAA37AD5A7256"><enum>(a)</enum><header>Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that—</text> 
<paragraph id="H15E477607B314DF1B71CF24522A2D063"><enum>(1)</enum><text>the Secretary of Defense should not allow the placement of unauthorized aliens at a military installation unless—</text> 
<subparagraph id="HAFDC902D9CB94BA1B16C05C3A39ED415"><enum>(A)</enum><text>the Secretary submits written notice to the congressional defense committees and each Member of Congress representing any jurisdiction in which an affected military installation is situated; and</text> </subparagraph> 
<subparagraph id="H55549A94A9C54B67B1807849F470DA51"><enum>(B)</enum><text>the Secretary publishes notice in the Federal Register;</text> </subparagraph></paragraph> 
<paragraph id="HA1BD88144E1C4424B6EEF5DFFDEFF86B"><enum>(2)</enum><text>the placement of unauthorized aliens at a military institution should not displace active members of the Armed Forces;</text> </paragraph> 
<paragraph id="H535097F1BD224E3499E7CAFE4CB0F386"><enum>(3)</enum><text>the placement of unauthorized aliens at a military institution should not interfere with any mission of the Department of Defense;</text> </paragraph> 
<paragraph id="H3449026BAAF641498C4FF94A0095DF2D"><enum>(4)</enum><text>the Secretary of Health and Human Services should not use a military installation for the placement of unauthorized aliens unless all other facilities of the Department of Health and Human Services are unavailable;</text> </paragraph> 
<paragraph id="HC9DDF125F95C4C9C832D5C361CA72625"><enum>(5)</enum><text>the Secretary of Health and Human Services should not use a military installation for the placement of unauthorized aliens for more than 120 days;</text> </paragraph> 
<paragraph id="H845DA3F163054A18B0968530C4122005"><enum>(6)</enum><text>the Secretary of Health and Human Services should ensure that all unauthorized alien children are vaccinated upon arrival at a military installation as set forth in the guidelines of the Office of Refugee Resettlement;</text> </paragraph> 
<paragraph id="HF9476CF46FB4441588BB075CAE184E75"><enum>(7)</enum><text>the Secretary of Health and Human Services should ensure that all individuals under the supervision of the Secretary with access to unauthorized alien children at a military installation are properly cleared according to the procedures set forth in the Victims of Child Abuse Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/13001">42 U.S.C. 13001 et seq.</external-xref>);</text> </paragraph> 
<paragraph id="HBFBD482C99C24EA189E41E86CB5B27F9"><enum>(8)</enum><text display-inline="yes-display-inline">the Secretary of Health and Human Services should fully comply with the provisions of the Victims of Child Abuse Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/13001">42 U.S.C. 13001 et seq.</external-xref>) with respect to background checks and should retain full legal responsibility for such compliance; and</text> </paragraph> 
<paragraph id="H7C37E27E8FC94D1AB8C70A403A70B7D6"><enum>(9)</enum><text display-inline="yes-display-inline">in accordance with <external-xref legal-doc="usc" parsable-cite="usc/31/1535">section 1535</external-xref> of title 31, United States Code (commonly referred to as the <quote>Economy Act</quote>), the Secretary of Health and Human Services should reimburse the Secretary of Defense for all expenses incurred by the Secretary of Defense in carrying out the placement of unauthorized aliens at a military installation.</text> </paragraph></subsection> 
<subsection id="H2A7BB6F1EF3D4A32BFB3D4D4ED46C3C8"><enum>(b)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HCFB89FA56A34453D94E774B6B292A385"><enum>(1)</enum><text>The term <quote>congressional defense committees</quote> has the meaning given that term in <external-xref legal-doc="usc" parsable-cite="usc/10/101">section 101(a)(16)</external-xref> of title 10, United States Code.</text> </paragraph> 
<paragraph id="H86827ECEE3CF47F39E3A4F478082566F"><enum>(2)</enum><text>The term <quote>Member of Congress</quote> has the meaning given that term in <external-xref legal-doc="usc" parsable-cite="usc/10/1591">section 1591(c)(1)</external-xref> of title 10, United States Code.</text> </paragraph> 
<paragraph id="H3356E514EA8A43769B39E86E839F979C"><enum>(3)</enum><text>The term <quote>military installation</quote> has the meaning given that term in <external-xref legal-doc="usc" parsable-cite="usc/10/2801">section 2801(c)(4)</external-xref> of title 10, United States Code, but does not include an installation located outside of the United States.</text> </paragraph> 
<paragraph id="HC50783177065404DAA63FA6E334887A2"><enum>(4)</enum><text>The term <quote>placement</quote> means the placement of an unauthorized alien in either a detention facility or an alternative to such a facility.</text> </paragraph> 
<paragraph id="HEB545DC83142495D89D4CA430FC94391"><enum>(5)</enum><text>The term <quote>unauthorized alien</quote> means an alien unlawfully present in the United States, but does not include a dependent of a member of the Armed Forces.</text> </paragraph></subsection></section> 
<section id="HC61A7E09E08A4B2B82C256539EF3A791" section-type="subsequent-section"><enum>303.</enum><header>Limitation on placement of unauthorized aliens at military installations</header> 
<subsection id="HFDE2B025DF7A4F46BACE8F7DA37CE898"><enum>(a)</enum><header>Limitation</header><text display-inline="yes-display-inline">The Secretary of Defense may not allow the placement of unauthorized aliens at a military installation in the United States if the use of the military institution to house or care for unauthorized aliens would—</text> 
<paragraph id="H224535393C1641C88DE4483D95FA2681"><enum>(1)</enum><text>displace members of the Armed Forces serving on active duty or in a reserve or Guard status; or</text></paragraph> 
<paragraph id="H546AC62AB6F740C9970646975C7A53CB"><enum>(2)</enum><text>interfere with activities of the Armed Forces, including reserve components thereof, at the installation.</text></paragraph></subsection>
