		<section id="HDEEA21B668154FF9A43485DDA036D40A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Charlotte’s Web Medical Hemp Act of 2014</short-title></quote>.</text>
		</section><section id="HCD1E44ACAD2F49F994F8B11EB266D317"><enum>2.</enum><header>Exclusion of therapeutic hemp and cannabidiol from definition of marihuana</header>
			<subsection id="H51C06930A2534C3ABB72101D0DB66229"><enum>(a)</enum><header>In General</header><text display-inline="yes-display-inline">Section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>) is amended in paragraph (16)—</text>
				<paragraph id="H58EFFBB5006E4A9EAB0F7E0D5A6304E5"><enum>(1)</enum><text>by striking <quote>(16) The</quote> and inserting <quote>(16)(A) The</quote>; and</text>
				</paragraph><paragraph id="HE5C474D27AA74446B9640927E2266F3A"><enum>(2)</enum><text>by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H1A45B9300F1042C88B85C11465678989" style="OLC">
						<subparagraph id="H67695A0B745B4E4BA843AAB4DEC5FF9E" indent="up1"><enum>(B)</enum><text>Therapeutic hemp and cannabidiol—</text>
							<clause id="HA761955D423E42439FABD60CCF73B300" indent="up1"><enum>(i)</enum><text>are excluded from the definition of marihuana under subparagraph (A); and</text>
							</clause><clause id="HA8B8E1A59168469C99683D945B79E071" indent="up1"><enum>(ii)</enum><text>shall not be treated as controlled substances under this Act.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H68928C7A51A3422998B12B6288B2171D"><enum>(b)</enum><header>Definition</header><text display-inline="yes-display-inline">Section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>), as amended, is further amended by
			 adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H4FFD8CF12652498F9B6D550E9EF51C34" style="OLC">
					<paragraph id="HA6E464F775BD4CE187EEB04318E85149" indent="up1"><enum>(57)</enum><text display-inline="yes-display-inline">The term ‘therapeutic hemp’ means the plant Cannabis sativa L. and any part of such plant, whether
			 growing or not, with a delta-9 tetrahydrocannabinol concentration of not
			 more than 0.3 percent on a dry weight basis.</text>
					</paragraph><paragraph id="H63BD9E1CF8F1455F8129F9A15A40DEEE" indent="up1"><enum>(58)</enum><text display-inline="yes-display-inline">The term <term>cannabidiol</term> means the substance cannabidiol, as derived from therapeutic hemp.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H1F13987B194A4287AE98463136BD7BCF"><enum>3.</enum><header>Other Limitations</header>
			<subsection id="H4F32030838DF432EBA3C6F778E1C4A1C"><enum>(a)</enum><header>Non-Applicability of Federal Food, Drug, and Cosmetic Act</header><text display-inline="yes-display-inline">The Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/301">21 U.S.C. 301 et seq.</external-xref>) shall not apply to therapeutic
			 hemp or cannabidiol as those terms are defined in section 102 of the
			 Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>) as amended by this Act.</text>
			</subsection><subsection id="HA707543770C4410884BF78417457EBA7"><enum>(b)</enum><header>State Law</header><text display-inline="yes-display-inline">Nothing in this Act shall prohibit or otherwise restrict any activities related to the use,
			 production, or distribution of marijuana in a State in which such
			 activities are legal under State law.</text>
