		<section id="H62560A4200914EF9B67D20B4C0487D1F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Civil Asset Forfeiture Reform Act of 2014</short-title></quote>.</text>
		</section><section id="H2CDB883C0AFB4FFCAA281EECE084DFC6" section-type="subsequent-section"><enum>2.</enum><header>Representation by attorney</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/983">Section 983(a)(1)(A)(i)</external-xref> of title 18, United States Code, is amended by adding at the end the
			 following: <quote>The Government shall include in any such notice that the person receiving the notice may be able to
			 obtain free or reduced rate legal representation under subsection (b).</quote>.</text>
		</section><section id="H9D7023ACE0AD4773A227E2675673D33D"><enum>3.</enum><header>Burden of proof</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/983">Section 983(c)</external-xref> of title 18, United States Code, is amended—</text>
			<paragraph id="HCF769101C16D467BB59AF33BDBE3E529"><enum>(1)</enum><text>in paragraph (1), by striking <quote>by a preponderance of the evidence</quote> and inserting <quote>by clear and convincing evidence</quote>; and</text>
			</paragraph><paragraph id="H1BD116BEFB3C477B82B271EB4F50C6F5"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking <quote>by a preponderance of the evidence</quote> and inserting <quote>by clear and convincing evidence</quote>.</text>
			</paragraph></section><section id="H114DA05034F947048C647BAE881A34FC"><enum>4.</enum><header>Innocent owner defense</header>
			<subsection id="H6C0609780371468BAE6540FC8039B50B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/983">Section 983(d)</external-xref> of title 18, United States Code, is amended so that paragraph (1) reads as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H2F8362B5F5974B47B680CF9956AC952E" style="OLC">
					<paragraph id="H56ACC4DC66D8429CB491D4A6595F1AB4"><enum>(1)</enum><text display-inline="yes-display-inline">The innocent owner defense shall be available to a claimant. Where a prima facie case is made for
			 such a defense, the Government has the burden of proving that the claimant
			 knew or reasonably should have known that the property was involved in the
			 illegal conduct giving rise to the forfeiture.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H9DAB41E1F8FF47C08E8391BE949421E0"><enum>(b)</enum><header>Knowledge by owner of criminal activity</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/983">Section 983(d)(2)(B)</external-xref> of title 18, United States Code, is amended—</text>
				<paragraph id="HE36E597091A5409FBAA54ADF9778C80C"><enum>(1)</enum><text>in clause (i), by striking <quote>a person may show that such person did all that reasonably could be expected may include
			 demonstrating that such person to the extent permitted by law</quote> and inserting <quote>the Government may show that the property owner should have had knowledge of the criminal activity
			 by demonstrating that the property owner did not</quote>;</text>
				</paragraph><paragraph id="H1C051889A0EC4163B01448D84A5F1699"><enum>(2)</enum><text>in clause (i)(I), by striking <quote>gave</quote> and inserting <quote>give</quote>; and</text>
				</paragraph><paragraph id="HA171207C3FE14D07AAFE888A3C166EAE"><enum>(3)</enum><text>in clause (i)(II)—</text>
					<subparagraph id="HD725F2C8A06148EBA2B9DCD18A2A54AB"><enum>(A)</enum><text>by striking <quote>revoked or made</quote> and inserting <quote>revoke or make</quote>; and</text>
					</subparagraph><subparagraph id="HE5844E78347A41EABF3F0EB40C1F065E"><enum>(B)</enum><text>by striking <quote>took</quote> and inserting <quote>take</quote>.</text>
					</subparagraph></paragraph></subsection></section><section id="H87663B06CED44A09934CF373CB20DE60"><enum>5.</enum><header>Proportionality</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/983">Section 983(g)</external-xref> of title 18, United States Code, is amended so that paragraph (2) reads as follows:</text>
			<quoted-block display-inline="no-display-inline" id="HCCDD684F9E4C4F1BBC9941F6F9E46276" style="USC">
				<paragraph id="H4EEE5165EB284A2498CD043A6C7F13EF"><enum>(2)</enum><text display-inline="yes-display-inline">In making this determination, the court shall consider such factors as the seriousness of the
			 offense, the extent of the nexus of the property to the offense, the range
			 of sentences available for the offense giving rise to forfeiture, the fair
			 market value of the property, and the hardship to the property owner and
			 dependents</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H9C4DF0415B3142C7A881DB0ACBBA6A21"><enum>6.</enum><header>Increased visibility</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/28/524">Section 524(c)(6)(i)</external-xref> of title 28, United States Code, is amended by inserting <quote>from each type of forfeiture, and specifically identifying which funds were obtained from including
			 criminal forfeitures and which were obtained from civil forfeitures,</quote> after <quote>deposits</quote>.</text>
		</section><section id="HD757CCEC614F4CAEB7314EB06F9F461F"><enum>7.</enum><header>Equitable Sharing Agreements</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/28/524">Section 524(c)</external-xref> of title 28, United States Code, is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H80CC8DA3E58D4D44B8584509667FAB2B" style="USC">
				<paragraph id="H1414313EA69E4C29A251D4AF5F8758F4" indent="up1"><enum>(12)</enum><text display-inline="yes-display-inline">The Attorney General shall assure that any equitable sharing between the Department of Justice and
			 a local or State law enforcement agency was not initiated for the purpose
			 of circumventing any State law that prohibits civil forfeiture or limits
			 use or disposition of property obtained via civil forfeiture by State or
			 local agencies.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
