			 requirements relating to nonimmigrant employees, and for other purposes.</official-title>

		<section id="H8EE489DBCED948868BCF290182AAEF03" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Transparency in Reporting to Protect American Workers and Prevent Human Trafficking Act</short-title></quote>.</text>
		</section><section id="H4C361457386D46F3BE14D31D93097318"><enum>2.</enum><header>Data reporting on nonimmigrant employees</header><text display-inline="no-display-inline">Section 214(c)(8) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(c)(8)</external-xref>) is amended to read
			 as follows:</text>

				<paragraph id="H370A392F74A441EEBED6C20C1C0D42E3" indent="up1"><enum>(8)</enum>
					<subparagraph commented="no" display-inline="yes-display-inline" id="HC3FF08F0EA4845E9AB2E53CC571CD67E"><enum>(A)</enum>
						<clause commented="no" display-inline="yes-display-inline" id="HA4DCB16B98FA414A9010FA51CC87C502"><enum>(i)</enum>
							<subclause commented="no" display-inline="yes-display-inline" id="HE466B3236A094BDDB500455B3DF9C8CA"><enum>(I)</enum><text display-inline="yes-display-inline">The Secretary of Homeland Security annually shall submit to the Committees on the Judiciary of the
			 House of Representatives and of the Senate and timely upload to a public
			 website a report (along with the corresponding raw data set) with respect
			 to each of the subparagraphs of sections 101(a)(15) and 214(e) that permit
			 employment in the United States under any circumstances, including
			 cultural exchange, training, or business activities which result in
			 receiving any form of compensation, including a stipend, from any source.</text>
							</subclause><subclause display-inline="no-display-inline" id="H1FDF7AD637D447B4B77FF9FE1502CF58" indent="up3"><enum>(II)</enum><text display-inline="yes-display-inline">Each report under subclause (I) shall contain the following data regarding any nonimmigrant visa or
			 any grant of nonimmigrant status:</text>
								<item id="HF03FD8C0650646C280758CE888BB69A7"><enum>(aa)</enum><text display-inline="yes-display-inline">The number of aliens who were granted such a visa or status.</text>
								</item><item id="HF86053B4ED6B47AA884F1E94F2CB149A"><enum>(bb)</enum><text>The number of aliens who had such visas or statuses that were expired, revoked, or otherwise
			 terminated during each month of the preceding fiscal year.</text>
								</item><item id="H5E62738FE1454A57B3B8D130B0D2B68D"><enum>(cc)</enum><text>Information on the countries of origin of (including local region or state if available), age,
			 gender, and occupations of, educational levels attained by, and
			 compensation paid to aliens issued such visa or status.</text>
								</item><item id="HB8934A3EE565412AB7C8B7C31EACF66D"><enum>(dd)</enum><text display-inline="yes-display-inline">The names and addresses of employers and the number of aliens authorized per category and subclass
			 to work for each employer, including the country of origin, age, and
			 gender of each alien authorized to work for each employer, the alien’s
			 primary work location, and secondary work location if one exists.</text>
								</item></subclause><subclause id="H8354B020AE4D447B963FA6598ACDFEEE" indent="up3"><enum>(III)</enum><text display-inline="yes-display-inline">Each report under subclause (I) shall contain the following data regarding any nonimmigrant visa
			 category or status (including extensions and transfers to another visa
			 category or subclass, or request to switch to another employer) that
			 requires approval from the Secretary of Homeland Security through a
			 Petition for Nonimmigrant Worker, Form I–129 (or any successor form):</text>
								<item id="H35AA232BF467454C86452323E638432F"><enum>(aa)</enum><text display-inline="yes-display-inline">The number of petitions filed.</text>
								</item><item id="H048A04EE39184B1ABB8A1885204E1A6A"><enum>(bb)</enum><text>The number of petitions approved and the number of workers (by occupation) included in such
			 approved petitions.</text>
								</item><item id="HB333A9F92FC74DB7B85F928534327D4F"><enum>(cc)</enum><text>The number of petitions denied and the number of workers (by occupation) requested in such denied
			 petitions.</text>
								</item><item id="H65C2C931B79C4AE093193331B7A9E7CB"><enum>(dd)</enum><text>The Standard Occupational Classification (SOC) code for each occupation in each approved petition.</text>
								</item><item id="H403AC979E8AF4C4C82C9658D1E4BE2EB"><enum>(ee)</enum><text>The number of petitions withdrawn.</text>
								</item><item id="HD725D1240879480F9A29AF1775684E31"><enum>(ff)</enum><text>The number of petitions awaiting final action.</text>
								</item></subclause></clause><clause id="H23BC99CD6DCC4554B8680E1F5EFF7104" indent="up2"><enum>(ii)</enum><text display-inline="yes-display-inline">The Secretary of Homeland Security annually shall submit to the Committees on the Judiciary of the
			 House of Representatives and of the Senate and timely upload to a public
			 website a report (along with the corresponding raw data set) that contains
			 the following:</text>
							<subclause id="HDF538D13BB1D471DB65DF7B7C5062358"><enum>(I)</enum><text>A list of all employers who petition for visas under section 101(a)(15)(H)(i)(b).</text>
							</subclause><subclause id="H6D9156A63AA447738167E7C3F4CED4C0"><enum>(II)</enum><text>The number of such petitions filed and approved for each such employer.</text>
							</subclause><subclause id="HEB7021AAB915495DBC223B19D8D003CB"><enum>(III)</enum><text>The Standard Occupational Classifications (SOC) for the approved positions.</text>
							</subclause><subclause id="H6363F80999B8487EB0E1BD05419A56FF"><enum>(IV)</enum><text>The number of nonimmigrants for whom each such employer files for adjustment to permanent resident
			 status.</text>
							</subclause><subclause id="HE3757DC8A0914A68A4F4334938E3581D"><enum>(V)</enum><text display-inline="yes-display-inline">A list of all employers who are H–1B-dependent employers (as defined in section 212(n)(3)(A)).</text>
							</subclause><subclause id="H87BE90E2BD2244C8A03278B0E4284B4C"><enum>(VI)</enum><text>A list of all employers for whom more than 30 percent of their United States workforce are
			 nonimmigrants described in subparagraph (H)(i)(b) or (L) of section
			 101(a)(15).</text>
							</subclause><subclause id="H038EDF7C913E4B63A31B5CEA0D0AEDCC"><enum>(VII)</enum><text display-inline="yes-display-inline">A list of all employers for whom more than 50 percent of their United States workforce are
			 nonimmigrants described in subparagraph (H)(i)(b) or (L) of section
			 101(a)(15).</text>
							</subclause><subclause id="H4BF7A2FABE9F4A8A93EF7C3BC53283D4"><enum>(VIII)</enum><text>A gender breakdown by occupation and by country of origin for the nonimmigrants described in
			 section 101(a)(15)(H)(i)(b).</text>
							</subclause><subclause id="HC6800582E2214A7AAAA987D88316A7B2"><enum>(IX)</enum><text display-inline="yes-display-inline">A list of all employers who conduct outplacement of nonimmigrants described in section
			 101(a)(15)(H)(i)(b).</text>
							</subclause><subclause id="HA1116CAF1A6B410AB2454F561663E0D9"><enum>(X)</enum><text display-inline="yes-display-inline">The number of nonimmigrants described in section 101(a)(15)(H)(i)(b) categorized by their highest
			 level of education and major or primary field of study, and whether such
			 education was obtained in the United States or in a foreign country.</text>
							</subclause></clause><clause id="H0E1312F5B8CC4FD19E1FB761BED8FC0E" indent="up2"><enum>(iii)</enum><text display-inline="yes-display-inline">The Secretary of Homeland Security annually shall submit to the Committees on the Judiciary of the
			 House of Representatives and of the Senate and timely upload to a public
			 website a report (along with the corresponding raw data set) that contains
			 the following:</text>
							<subclause id="H70248EA368B9406D8BFD583BA16C304A"><enum>(I)</enum><text display-inline="yes-display-inline">A list of all employers who have filed petitions with the Secretary of Homeland Security for
			 nonimmigrants under section 101(a)(15)(L).</text>
							</subclause><subclause id="H29E0A166EF33408B8D6DBCF429191B49"><enum>(II)</enum><text>The number of such petitions filed and approved for each such employer, whether each petition was
			 processed by the Department of Homeland Security or the Department of
			 State as a blanket petition under paragraph (2)(A).</text>
							</subclause><subclause id="H196534C959ED4794849F0953B7C57C06"><enum>(III)</enum><text>The Standard Occupational Classifications (SOC) code for each occupation in each approved
			 positions.</text>
							</subclause><subclause id="HED31B63CA6D34D9D84D097BA44A43E17"><enum>(IV)</enum><text>The amount of compensation paid to each beneficiary.</text>
							</subclause><subclause id="H17D04EF038EF410689BDE023BAA91A75"><enum>(V)</enum><text>The number of nonimmigrants described in section 101(a)(15)(L) for whom each such employer files
			 for adjustment to permanent resident status.</text>
							</subclause><subclause display-inline="no-display-inline" id="HD1D4446DBCAE4E238FDBC7D57C79809D"><enum>(VI)</enum><text>A list of all employers for whom more than 30 percent of their United States workforce are
			 nonimmigrants described in subparagraph (H)(i)(b) or (L) of section
			 101(a)(15).</text>
							</subclause><subclause id="H1B1B2CE01A994391B10AF5F5D6B66D45"><enum>(VII)</enum><text display-inline="yes-display-inline">A list of all employers for whom more than 50 percent of their United States workforce are
			 nonimmigrants described in subparagraph (H)(i)(b) or (L) of section
			 101(a)(15).</text>
							</subclause><subclause id="HB005483ADAD144818BFE487CCE6952A7"><enum>(VIII)</enum>
								<item commented="no" display-inline="yes-display-inline" id="H6F414D584B2E4D70855CA2D27FBDA011"><enum>(aa)</enum><text>A list of all employers who have been authorized to file blanket petitions under paragraph (2)(A),
			 including those who were identified by aliens applying for a visa under
			 section 101(a)(15)(L) as the employer seeking to employ such aliens; and</text>
								</item><item id="H42BE919559644355860553F06C02EF5B" indent="up1"><enum>(bb)</enum><text>the number of such visa applications approved pursuant to each blanket petition.</text>
								</item></subclause><subclause id="HF21FA7E5A0F147CA82F3A3964B4DAC14"><enum>(IX)</enum><text display-inline="yes-display-inline">A gender breakdown by occupation and by country of origin for the nonimmigrants described in
			 section 101(a)(15)(L).</text>
							</subclause><subclause id="H0EAEFAA4960C41F9A64FE93E0AFD5961"><enum>(X)</enum><text display-inline="yes-display-inline">list of all employers who conduct outplacement of nonimmigrants described in section 101(a)(15)(L).</text>
							</subclause><subclause id="HFA851B2CBCD444B89B3E94EBA184F5B3"><enum>(XI)</enum><text display-inline="yes-display-inline">The number of nonimmigrants described in section 101(a)(15)(L) categorized by their highest level
			 of education and major or primary field of study, and whether such
			 education was obtained in the United States or in a foreign country.</text>
							</subclause><subclause id="H03E8F1319F174DFFB3D113339FEABB06"><enum>(XII)</enum><text>The number of petitions which have been authorized as blanket petitions under paragraph (2)(A).</text>
							</subclause></clause><clause id="H10715520378A459D9B8F31A7652335AB" indent="up2"><enum>(iv)</enum><text display-inline="yes-display-inline">Reporting required by this subparagraph includes information gathered on petitions for nonimmigrant
			 status or in any other manner, including consular processing, and computer
			 systems managed by the Secretary of Homeland Security for tracking
			 students and exchange visitors.</text>
						</clause><clause id="H1293CA1F7673470591CB9DE82A0A7C45" indent="up2"><enum>(v)</enum><text>The information included in the reports under this subparagraph shall be disaggregated by
			 nonimmigrant visa type and each subclass, if applicable as set forth in
			 subparagraph (C).</text>
						</clause><clause id="HCBD2619ED5134B0796E749521F7B34AA" indent="up2"><enum>(vi)</enum><text display-inline="yes-display-inline">The annual reports required under this subparagraph shall be submitted not later than 3 months
			 after the end of each fiscal year and shall contain data pertaining to the
			 requested categories from the immediately preceding fiscal year.</text>
						</clause></subparagraph><subparagraph id="H5D65F970F31F4E56B33FFE7CE035AAD9" indent="up1"><enum>(B)</enum>
						<clause commented="no" display-inline="yes-display-inline" id="HB65654B661D941FB809E87838EB61D33"><enum>(i)</enum><text>The Secretary of Homeland Security shall maintain an accurate count of the number of aliens subject
			 to numerical limitations, if any, of the visa issued or nonimmigrant
			 status provided, including under subsection (g)(1).</text>
						</clause><clause id="H03E76664D2734F73B25840544CA4EE78" indent="up1"><enum>(ii)</enum><text>The Secretary of Homeland Security shall notify, on a quarterly basis, the Committees on the
			 Judiciary of the House of Representatives and the Senate of the numbers of
			 aliens who during the preceding 3-month period were issued visas or
			 otherwise provided nonimmigrant status under section 101(a)(15)(H)(i)(b).</text>
						</clause><clause id="HC3A057E3E7A94F128734585C8FDBF9F3" indent="up1"><enum>(iii)</enum><text>The Secretary of Homeland Security shall notify, on a semiannual basis, the Committees on the
			 Judiciary of the House of Representatives and the Senate of the number of
			 aliens who during the preceding 1-year period were issued visas or
			 otherwise provided nonimmigrant status under all annually capped visas
			 enumerated in section 101(a)(15) or who had such a visa or such status
			 revoked or otherwise terminated.</text>
						</clause><clause id="H8FBEBED117DA401ABE2E2494FA2FB23B" indent="up1"><enum>(iv)</enum><text>Each notification under clause (i), and each submission under clause (ii), shall include the number
			 of aliens who were issued visas or otherwise provided nonimmigrant status
			 pursuant to petitions filed by institutions or organizations described in
			 section 212(p)(1).</text>
						</clause></subparagraph><subparagraph id="H5EED83939B6741BBAD71248A22706B65" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">The Secretary of Homeland Security shall collect and report the required data described in
			 subparagraphs (A) and (B) for nonimmigrant visas issued, or nonimmigrant
			 status granted, under any subparagraph of section 101(a)(15) and
			 disaggregate the data accordingly with respect to any particular subclass,
			 or employment-authorized exchange or training program authorized under
			 each subclass or otherwise specified in regulations or Federal agency
			 guidance or directives, including—</text>
						<clause id="H17F5D8BAE98047B5B57EBEC0BDAF8A23"><enum>(i)</enum><text>with respect to section 101(a)(15)(J), the specific program provisions enumerated in subpart B of
			 part 62 of title 22, Code of Federal Regulations;</text>
						</clause><clause id="HA6158A90CBCC4E6281BCBF25B0898EAC"><enum>(ii)</enum><text display-inline="yes-display-inline">with respect to section 101(a)(15)(B), the specific categories of business visitor activity
			 enumerated in notes 9–11 of section 41.31 of volume 9, U.S. Department of
			 State Foreign Affairs Manual; and</text>
						</clause><clause id="HFA9662F412BF4E46A9E93F761DA366D0"><enum>(iii)</enum><text display-inline="yes-display-inline">with respect to section 101(a)(15)(F), all persons granted employment authorization pursuant to the
			 provisions enumerated in <external-xref legal-doc="usc" parsable-cite="usc/8/214">section 214.2(f)(10)</external-xref> of title 8, Code of Federal
			 Regulations.</text>
						</clause></subparagraph><subparagraph id="H20AB798E37B94BB08CAFE8EBB3450A0E" indent="up1"><enum>(D)</enum><text>If the Secretary of Homeland Security determines that information maintained by either the
			 Secretary of State or the Secretary of Labor is required to make a
			 submission described in this paragraph, for example if any of the required
			 information is gathered during consular processing or during the labor
			 certification process, the Secretaries of State and Labor shall provide
			 such information to the Secretary of Homeland Security upon request.</text>
					</subparagraph><subparagraph id="H87890FC0F3E84A2BACEBD9D29F5776BC" indent="up1"><enum>(E)</enum><text>The Secretaries of Homeland Security, State, and Labor shall take such steps as are necessary to
			 revise any applications, petition forms, and databases used for
			 nonimmigrant visas or status under each subparagraph and corresponding
			 subcategory or subclass of section 101(a)(15) which permit an alien
			 beneficiary to work in the United States under any circumstances,
			 including training or business activities which result in receiving any
			 form of compensation, including a stipend, from any source, so as to
			 ensure that sufficient information is collected to report the data as
			 required under this paragraph.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
