		<official-title>To amend the Consumer Financial Protection Act of 2010 to require the Bureau of Consumer Financial
			 Protection to develop a model form for a disclosure notice that shall be
			 used by depository institutions and credit unions, and for other purposes.</official-title>

		<section id="H3D96E20BCDC04424945A4E4638CD5F83" section-type="section-one"><enum>1.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that:</text>
			<paragraph id="H1737384423D842F998C2B0C1B85E8F7C"><enum>(1)</enum><text display-inline="yes-display-inline">Depository institutions and credit unions have an obligation to provide consumers with policy and
			 fee information in a concise and easy to understand format.</text>
			</paragraph><paragraph id="HB5ED7DE4ABF9489F92198894C137F200"><enum>(2)</enum><text display-inline="yes-display-inline">Because the length of disclosure forms ranges from 21 to 153 pages for depository institutions and
			 9 to 53 pages for credit unions, consumers have a difficult time
			 understanding how much they are paying for their checking accounts and
			 other financial products. Consumers should be able to compare account
			 terms and conditions among depository institutions and credit unions.</text>
			</paragraph><paragraph id="H78D6C5177C274E35A4A3BB103E097C0D"><enum>(3)</enum><text>A simplified, standardized disclosure form would reduce consumer confusion and make it easier for
			 institutions to compete on price and quality of financial products.</text>
			</paragraph></section><section id="H19281A41938F4F02B60BAB2D3F3D210B"><enum>2.</enum><header>Model disclosures for depository institutions and credit unions</header><text display-inline="no-display-inline">Section 1032 of the <short-title>Consumer Financial Protection Act of 2010</short-title> (<external-xref legal-doc="usc" parsable-cite="usc/12/5532">12 U.S.C. 5532</external-xref>) is amended by adding at the end the following new subsection:</text>
			<quoted-block display-inline="no-display-inline" id="H75B8E4BDEF734175942B107A6FC18C20" style="OLC">
				<subsection id="HF9D54A02337341F3B5EAAC9869852A7C"><enum>(g)</enum><header>Model disclosures for depository institutions and credit unions</header>
					<paragraph id="HB37404F724A6480C9877A14F1C85EC41"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Bureau, by rule, shall develop a model form for a disclosure notice that shall be used by
			 depository institutions and credit unions for provision of disclosures to
			 be given to a consumer before that consumer opens a checking account.</text>
					</paragraph><paragraph id="H796E1647948F461AA066EC8F72E5327E"><enum>(2)</enum><header>Stakeholder input</header><text display-inline="yes-display-inline">Prior to issuing a rule pursuant to paragraph (1), the Bureau shall solicit input from
			 representatives of depository institutions and credit unions, non-profit
			 consumer protection entities, and organizations that represent the
			 interests of depository institutions and credit unions.</text>
					</paragraph><paragraph id="HFE90430F6CCA410DBC18B7ED9FE50D4C"><enum>(3)</enum><header>Requirements</header><text>A model form developed pursuant to paragraph (1) shall—</text>
						<subparagraph id="H26B21DFE4F9540F6AA843E5CDDAB4F63"><enum>(A)</enum><text>comply with the format requirements of subsection (b)(2);</text>
						</subparagraph><subparagraph id="H269A7ADFAC954D489B5617CFC651D5C6"><enum>(B)</enum><text>when practicable, be made available on the website of the depository institution or credit union;
			 and</text>
						</subparagraph><subparagraph id="H4BFC433AE4AF480B800EAA24CD5358F7"><enum>(C)</enum><text>include disclosures relating to—</text>
							<clause id="H842624D210E84CAEA73D956AC3425C7F"><enum>(i)</enum><text>opening a checking account and use of such account;</text>
							</clause><clause commented="no" id="H99E08CAC82174645B7B0595A18979C71"><enum>(ii)</enum><text>consequences of overdraft on such account, including any fees related to overdraft;</text>
							</clause><clause id="HD5DD9D5313464D248409FDA4A19087B6"><enum>(iii)</enum><text>processing policies of the depository institution or credit union; and</text>
							</clause><clause id="H5D46629E76AB4AFCB996C0417AFDE595"><enum>(iv)</enum><text>procedures for resolving a dispute between the consumer and the depository institution or credit
			 union.</text>
							</clause></subparagraph></paragraph><paragraph commented="no" id="HFF194CAC50154CDB9C500D017BFC2A76"><enum>(4)</enum><header>Exemption for certain banks</header><text>Any depository institution or credit union with total assets of less than $2,000,000,000 shall be
			 exempt from the requirements of this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
