		<official-title>To amend title II of the Social Security Act to provide for equal treatment of individuals in
			 same-sex marriages, and for other purposes.</official-title>

		<section id="H7D06F77E7DF54DBAAE7B756A2CFA8B5E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Social Security and Medicare Parity Act of 2014</short-title></quote>.</text>
		</section><section id="H77900AA4EC494A07A4BE70702988DFED"><enum>2.</enum><header>Determination of valid marriage under the Social Security Act</header>
			<subsection id="H473EE163261A47029BFB9824228E8FF0"><enum>(a)</enum><header>In general</header><text>Section 216(h)(1)(A)(i) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/416">42 U.S.C. 416(h)(1)(A)(i)</external-xref>) is amended by
			 striking <quote>is domiciled</quote> and all that follows through <quote>the District of Columbia,</quote> and inserting <quote>and such applicant were married (or, if such insured individual and such applicant were not married
			 in any State but were validly married in another jurisdiction, the courts
			 of any State)</quote>.</text>
			</subsection><subsection id="H27E695B03A6447DFB42FD9F84005734C"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall apply to all final determinations of family status made
			 after June 26, 2013.</text>
			</subsection></section><section id="H2BCFD1CDFF5D4FA09AAAC7D513525787"><enum>3.</enum><header>Alternative method of meeting nine-month requirement for widows, stepchildren, or widowers in
			 certain cases</header><text display-inline="no-display-inline">Section 216(k) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/416">42 U.S.C. 416(k)</external-xref>) is amended—</text>
			<paragraph id="H46311FD634984D65B034980E03A1C41D"><enum>(1)</enum><text>in the section heading, by striking <quote>in Case of Accidental Death or in Case of Serviceman Dying in Line of Duty, or in Case of
			 Remarriage to the Same Individual</quote> and inserting <quote>in certain cases</quote>;</text>
			</paragraph><paragraph id="H5F27F7BE957C4F4A869E88880C7E3BBE"><enum>(2)</enum><text>in paragraph (1), by striking <quote>or</quote> at the end;</text>
			</paragraph><paragraph id="H87A0E95FE8A24B24BFE523E1E4F49001"><enum>(3)</enum><text>in paragraph (2)(B), by adding <quote>or</quote> at the end; and</text>
			</paragraph><paragraph id="HFDFDFDD93D414C3189E4E5F8CB9048D1"><enum>(4)</enum><text>by inserting after paragraph (2) the following:</text>
				<quoted-block display-inline="no-display-inline" id="H2A152D7639414D41A673E0A26C114C41" style="OLC">
					<paragraph id="HD3A18A465AC3465EA07F65E6AD8924CE"><enum>(3)</enum>
						<subparagraph commented="no" display-inline="yes-display-inline" id="H66699C5A49744E99B002C4771059FF7D"><enum>(A)</enum><text>in the case of a widow or widower of such individual whose marriage to such individual would not
			 have been treated as a marriage for purposes of Federal law prior to June
			 26, 2013, such widow or widower—</text>
							<clause id="HE6465FEEFB9B4CC3B3F6C24331E964BC" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">became the wife or husband of such individual (or was deemed to be the wife or husband of such
			 individual under subsection (h)(1)(A)(ii))—</text>
								<subclause id="HB88267489FB249F98DD926752D74780C"><enum>(I)</enum><text display-inline="yes-display-inline">if such widow or widower is domiciled in a State that recognized same-sex marriages, civil unions,
			 or registered domestic partnerships as of June 26, 2013, before March 26,
			 2014; and</text>
								</subclause><subclause id="HAB1DC229DE97489899F29BC995C91552"><enum>(II)</enum><text display-inline="yes-display-inline">if such widow or widower is domiciled in any other State—</text>
									<item id="H0A629662640F488DA8EEA6FCD089074B"><enum>(aa)</enum><text>before March 26, 2014; or</text>
									</item><item id="H10028CE9B42841F2A8729109B9D5A455"><enum>(bb)</enum><text>if applicable, during the 9-month period beginning with the 1st date on which such State recognized
			 same-sex marriages, civil unions, or registered domestic partnerships; and</text>
									</item></subclause></clause><clause id="HB9EEC50FE4234DFCB22F76BEF0D3AF28" indent="up1"><enum>(ii)</enum><text>provides a sworn affidavit that the widow or widower was married to, or in a domestic partnership
			 with, such individual throughout the 9-month period ending on the date of
			 the individual’s death; or</text>
							</clause></subparagraph><subparagraph commented="no" id="H63BC71E270D8437E8F4DDA0F5DC4ABBD" indent="up1"><enum>(B)</enum><text>the stepchild of such individual—</text>
							<clause commented="no" id="H62E37D88EC9247459E3E9B0A85E982C6"><enum>(i)</enum><text display-inline="yes-display-inline">became the stepchild of such individual as a result of a parent of the stepchild becoming the wife
			 or husband of such individual (or being deemed to be the wife or husband
			 of such individual under subsection (h)(1)(A)(ii))—</text>
								<subclause id="HAD0E537830724EA68FD40F2195949CAA"><enum>(I)</enum><text>if such parent is domiciled in a State that recognized same-sex marriages, civil unions, or
			 registered domestic partnerships as of June 26, 2013, before March 26,
			 2014; and</text>
								</subclause><subclause id="HE5B7F3D33A63433A8447E9125DE61CDC"><enum>(II)</enum><text display-inline="yes-display-inline">if such parent is domiciled in any other State—</text>
									<item id="H9EF0865127374CD7A2AE2D9B35833298"><enum>(aa)</enum><text>before March 26, 2014; or</text>
									</item><item id="H72E5337EA316466F83C2B17DE2815E47"><enum>(bb)</enum><text display-inline="yes-display-inline">if applicable, during the 9-month period beginning with the 1st date on which such State recognized
			 same-sex marriages, civil unions, or registered domestic partnerships; and</text>
									</item></subclause></clause><clause commented="no" id="HE5227A02FBBF4BDBAC925176FCAF1B6F"><enum>(ii)</enum><text display-inline="yes-display-inline">provides a sworn affidavit that such parent was married to, or in a domestic partnership with, such
			 individual throughout the 9-month period ending on the date of the
			 individual’s death;</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H82583FFFD942466A8B0EC2191DE67E00"><enum>4.</enum><header>Alternative method of meeting 1-year requirement for wives, stepchildren, or husbands in certain
			 cases</header><text display-inline="no-display-inline">The requirement in section 216(b)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/416">42 U.S.C. 416</external-xref>) and the requirement
			 in section 216(f)(2) of such Act that the spouse of an individual shall
			 have been married to such individual for a period of not less than 1 year
			 immediately preceding the day on which the spouse’s application for wife’s
			 or husband’s insurance benefits is filed in order to qualify as such
			 individual's wife or husband, and the requirement in section 216(e)(2) of
			 such Act that the stepchild of an individual shall have been such
			 stepchild for not less than 1 year immediately preceding the day on which
			 application for child's insurance benefits is filed in order to qualify as
			 such individual's child, shall be deemed to be satisfied, where such
			 application is filed within the applicable 1-year period, if—</text>
			<paragraph display-inline="no-display-inline" id="HD225DC60BE9E4B6BBA6B9459954A2E77"><enum>(1)</enum><text>in the case of a wife or husband of such individual whose marriage to such individual would not
			 have been treated as a marriage for purposes of Federal law prior to June
			 26, 2013, such wife or husband—</text>
				<subparagraph id="HD18454B3008F458DA23BDD0538BED4BE"><enum>(A)</enum><text display-inline="yes-display-inline">became the wife or husband of such individual (or was deemed to be the wife or husband of such
			 individual under subsection (h)(1)(A)(ii) of such Act)—</text>
					<clause id="HB2F053E79CC64C29ACB2E032F86957B8"><enum>(i)</enum><text display-inline="yes-display-inline">if such wife or husband is domiciled in a State that recognized same-sex marriages, civil unions,
			 or registered domestic partnerships as of June 26, 2013, before June 26,
			 2014; and</text>
					</clause><clause id="H220659E5F3924300B8470A39D63983AA"><enum>(ii)</enum><text display-inline="yes-display-inline">if such wife or husband is domiciled in any other State—</text>
						<subclause id="H86B11886264A446ABB11CA6FED8F91ED"><enum>(I)</enum><text display-inline="yes-display-inline">before June 26, 2014; or</text>
						</subclause><subclause id="HBECE478AB79641D2A2B78DD330D23EE2"><enum>(II)</enum><text>if applicable, during the 1-year period beginning with the 1st date on which such State recognized
			 same-sex marriages, civil unions, or registered domestic partnerships; and</text>
						</subclause></clause></subparagraph><subparagraph id="H57D8F026A8764B27BB81F4155C61440C"><enum>(B)</enum><text display-inline="yes-display-inline">provides a sworn affidavit that the wife or husband was married to, or in a domestic partnership
			 with, such individual throughout the 1-year period ending on the date of
			 the application for wife’s or husband’s insurance benefits; or</text>
				</subparagraph></paragraph><paragraph commented="no" id="HFFD6F2FC64F046D095B93B3AEFCC8D45"><enum>(2)</enum><text>the stepchild of such individual—</text>
				<subparagraph commented="no" id="HF387A9F49F334421B7EFFF72ACF9EA0D"><enum>(A)</enum><text display-inline="yes-display-inline">became the stepchild of such individual as a result of a parent of the stepchild becoming the wife
			 or husband of such individual (or being deemed to be the wife or husband
			 of such individual under subsection (h)(1)(A)(ii) of such Act)—</text>
					<clause id="H7CC1786579D54D3EBA8433F177FC9A6A"><enum>(i)</enum><text display-inline="yes-display-inline">if such parent is domiciled in a State that recognized same-sex marriages, civil unions, or
			 registered domestic partnerships as of June 26, 2013, before June 26,
			 2014; and</text>
					</clause><clause id="H8F6F8802BC324EC48906A91EDF26A9D8"><enum>(ii)</enum><text display-inline="yes-display-inline">if such parent is domiciled in any other State—</text>
						<subclause id="H8664D7B3AA7748A59ED16564222EDCA2"><enum>(I)</enum><text display-inline="yes-display-inline">before June 26, 2014; or</text>
						</subclause><subclause id="HD80A6BA403064CE98FC8B9EC35B93742"><enum>(II)</enum><text display-inline="yes-display-inline">if applicable, during the 1-year period beginning with the 1st date on which such State recognized
			 same-sex marriages, civil unions, or registered domestic partnerships; and</text>
						</subclause></clause></subparagraph><subparagraph commented="no" id="H2074A3638D4C43A2AF3B6F199874251C"><enum>(B)</enum><text display-inline="yes-display-inline">provides a sworn affidavit that such parent was married to, or in a domestic partnership with, such
			 individual throughout the 1-year period ending on the date of the
			 application for child's insurance benefits.</text>
				</subparagraph></paragraph></section><section id="H22081BD6357C4D35B6DCCE9113DB3649"><enum>5.</enum><header>Notification of changes in law; outreach campaign</header>
			<subsection id="H03E211AE47AA46729AC76CE1E9192A60"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">As soon as practicable after the date of the enactment of this Act but not later than December 31,
			 2014, the Commissioner of Social Security shall conduct a comprehensive
			 and effective 3-year outreach campaign to encourage individuals newly
			 eligible for benefits under title II of the Social Security Act as a
			 result of changes in law relating to same-sex marriage and occurring on or
			 after June 26, 2013, including this Act and the amendments made thereby,
			 to apply for such benefits. Such outreach campaign shall include direct
			 notification regarding such changes in law to current beneficiaries and to
			 individuals approaching retirement.</text>
			</subsection><subsection id="HD8D24BC98EC04EC6B05F4AC179B5C3AD"><enum>(b)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Not later than December 31 of each of the 1st 3 calendar years beginning with 2015, the
			 Commissioner of Social Security shall submit to the Committee on Ways and
			 Means of the House of Representatives, the Committee on Finance of the
			 Senate, and the Committees on Appropriations of the House of
			 Representatives and the Senate a report that includes—</text>
				<paragraph id="H1BE8A583592D48BB8E0E6DB000D9D6DE"><enum>(1)</enum><text>a description of the educational and outreach activities conducted by the Commissioner of Social
			 Security under subsection (a) during the preceding year;</text>
				</paragraph><paragraph id="HC68D1FC8D0C447D1B1201956512FE89A"><enum>(2)</enum><text display-inline="yes-display-inline">the number of applications for benefits under title II of the Social Security Act filed as a result
			 of changes in law relating to same-sex marriage and occurring on or after
			 June 26, 2013, including this Act and the amendments made thereby, in the
			 preceding year; and</text>
				</paragraph><paragraph id="HE3CC5239E16B4B10AB7428CD50A42B56"><enum>(3)</enum><text>the number of such applications which resulted in entitlement to benefits.</text>
				</paragraph></subsection></section></legis-body>
