			<subsection commented="no" id="H1510400BA59B44E1A6E16E33B9EDAF96"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/75">Chapter 75</external-xref> of title 5, United States Code, is amended by adding after subchapter V the following:</text>
				<quoted-block display-inline="no-display-inline" id="H6DE10154B6384BB2A3C13DD8C09DFA19" style="USC">
					<subchapter commented="no" id="H6E4D03D4D48E4057A453F72690E7DF2B"><enum>VI</enum><header>Federal Records</header>
						<section commented="no" id="HF44FB71CEB0045368B020623FEFF8168"><enum>7551.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subchapter the following definitions apply:</text>
							<paragraph id="H1A2AB6CE525140A4A9D5CE03D74AB8EC"><enum>(1)</enum><header>Employee</header><text display-inline="yes-display-inline">The term <term>employee</term> means—</text>
								<subparagraph id="HE33D804FE132461EB501A342A0415E05"><enum>(A)</enum><text display-inline="yes-display-inline">an individual in the competitive service who is not serving a probationary or trial period under an
			 initial appointment or who has completed 1 year of current continuous
			 employment in the same or similar positions under other than a temporary
			 appointment limited to 1 year or less; or</text>
								</subparagraph><subparagraph id="H926325728E114452AD6C82F898216AFE"><enum>(B)</enum><text display-inline="yes-display-inline">a career appointee in the Senior Executive Service who—</text>
									<clause id="HA5E9B7E197F545CAA78FD78460860C80"><enum>(i)</enum><text>has completed the probationary period prescribed under section 3393(d) of this title; or</text>
									</clause><clause id="HC349AF80C9F04F93B5E3F15AFDF620D2"><enum>(ii)</enum><text>was covered by the provisions of subchapter II of this chapter immediately before appointment to
			 the Senior Executive Service.</text>
									</clause></subparagraph></paragraph><paragraph id="HB4BAD85116564A458771EA53908BE71C"><enum>(2)</enum><header>Suspension</header><text>The term <term>suspension</term> has the meaning given that term in section 7501 of this title.</text>
							</paragraph></section><section commented="no" id="HE185DE41A47E4ADAA3D2A5B41D501723"><enum>7552.</enum><header>Suspension and removal</header>
							<subsection id="H4E85130C681943038436EB371B592C8B"><enum>(a)</enum><header>Inspector General finding</header><text display-inline="yes-display-inline">If the Inspector General of an agency determines an employee of the agency has willfully and
			 unlawfully concealed, removed, mutilated, obliterated, falsified, or
			 destroyed any record, proceeding, map, book, document, paper, or other
			 thing in the custody of such employee, or verifies a violation under
			 section <external-xref legal-doc="usc" parsable-cite="usc/44/2208">2208</external-xref> or <external-xref legal-doc="usc" parsable-cite="usc/44/2911">2911</external-xref> of title 44, the Inspector General shall promptly
			 inform the head of the agency of that determination in writing.</text>
							</subsection><subsection commented="no" id="H2819A19D40134A67BEF90EAB08AAF8FD"><enum>(b)</enum><header>Suspension</header><text>Notwithstanding any other provision of law, the head of an agency shall suspend an employee of that
			 agency who has been determined by the Inspector General under subsection
			 (a) to have willfully and unlawfully concealed, removed, mutilated,
			 obliterated, falsified, or destroyed any record, proceeding, map, book,
			 document, paper, or other thing in the custody of such employee, or who
			 has been verified by the Inspector General to be in violation of section
			 2208 or 2911 of title 44.</text>
							</subsection><subsection commented="no" id="HF2F8C5BE80F54DC29ED0DBE11B8F693F"><enum>(c)</enum><header>Requirements after suspension</header><text display-inline="yes-display-inline">An employee suspended under subsection (b) is entitled, after suspension and before removal, to—</text>
								<paragraph id="H70CD65E16C744508A6F0BDF63F9DABFE"><enum>(1)</enum><text>be represented by an attorney or other representative;</text>
								</paragraph><paragraph commented="no" id="H59EDB8A882074837A1ABFB5017714487"><enum>(2)</enum><text>a written statement of the charges against the employee within 15 days after suspension, which may
			 be amended within 30 days thereafter;</text>
								</paragraph><paragraph commented="no" id="H9374C22C44D24B3CA5B223F89A2388FF"><enum>(3)</enum><text>an opportunity within 15 days after the receipt of the written statement under paragraph (2), plus
			 an additional 15 days if the charges are amended, to answer the charges
			 and submit affidavits;</text>
								</paragraph><paragraph commented="no" id="H49DADE7DF0C94925BCE094ED8FE16985"><enum>(4)</enum><text>a hearing, at the request of the employee, by an agency authority duly constituted for this
			 purpose;</text>
								</paragraph><paragraph commented="no" id="HA069B57287374047B524DC8F6F70E72D"><enum>(5)</enum><text>a review of the employee’s case by the head of the agency or a designee, before a decision adverse
			 to the employee is made final; and</text>
								</paragraph><paragraph commented="no" id="H524827ECC92940698DC7CC68F1431A88"><enum>(6)</enum><text>a written statement of the decision of the head of the agency.</text>
								</paragraph></subsection><subsection commented="no" id="H6998F9C0B4CE477B88F4ED11A3946B5D"><enum>(d)</enum><header>Removal</header><text display-inline="yes-display-inline">Subject to subsection (c) of this section and after any investigation and review the head of the
			 agency considers necessary, the head of an agency shall remove an employee
			 suspended under subsection (b) if such head determines that the employee
			 willfully and unlawfully concealed, removed, mutilated, obliterated,
			 falsified, or destroyed any record, proceeding, map, book, document,
			 paper, or other thing in the custody of such employee.</text>
							</subsection><subsection id="HA3FFCAE1AC4F4A54B81A22153B49917E"><enum>(e)</enum><header>Appeal</header><text>An employee who is removed under subsection (d) is entitled to appeal to the Merit Systems
			 Protection Board under section 7701 of this title.</text>
							</subsection></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" id="H10E93FF279C84CF4A631B2CD0E424FC7"><enum>(b)</enum><header>Technical and conforming amendments</header>
				<paragraph id="H7B3C558D38BF4641B4407DAF586A9F00"><enum>(1)</enum><header>Table of sections</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/75">chapter 75</external-xref> of title 5, United States Code, is amended by adding at the
			 end the following new items:</text>

					<subparagraph id="H1F773CA407A64E8BA84AB4924387F2D9"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (D), by striking <quote>or</quote> at the end;</text>
					</subparagraph><subparagraph id="HFA8926CF5C184875A3F132D22A9B705C"><enum>(B)</enum><text>in subparagraph (E), by striking the period at the end and inserting <quote>, or</quote>; and</text>

					</subparagraph></paragraph></subsection></section><section id="HCF268610C32841A4A1FE56EBBD9AD26E"><enum>3.</enum><header>Use of non-official electronic messaging accounts</header>
			<subsection id="H98DBD256B5C843468D98A8E455E99264"><enum>(a)</enum><header>Presidential records act</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/22">Chapter 22</external-xref> of title 44, United States Code is amended by adding at the end the following new
			 section:</text>
				<quoted-block display-inline="no-display-inline" id="HDCDE4A76BCAB47D1B784B19E3D2C1735" style="USC">
					<section id="HEAF3E275113D43509C800AC5E3492833"><enum>2208.</enum><header>Disclosure requirement for official business conducted using non-official electronic messaging
			 accounts</header>
						<subsection id="H75B9C22901984C7F9AEC78202850D202"><enum>(a)</enum><header>In general</header><text>The President, Vice President, or covered employee may not create or send a Presidential or Vice
			 Presidential record using a non-official electronic messaging account (in
			 this section, referred to as <quote>applicable electronic message</quote>) unless the President, Vice President, or covered employee—</text>
							<paragraph id="H5BF62696D0314ADB84A517DAEC8ABAFD"><enum>(1)</enum><text display-inline="yes-display-inline">includes an official electronic messaging account of the President, Vice President, or covered
			 employee, as applicable, as a recipient in the original creation or
			 transmission of the applicable electronic message and identifies all
			 recipients of the applicable electronic message in such message;</text>
							</paragraph><paragraph id="HB0BB5C010D80423CBB2469EDE3E3EAA1"><enum>(2)</enum><text>forwards a complete copy of the applicable electronic message, including a complete list of the
			 recipients of such message, to an official electronic messaging account of
			 the President, Vice President, or covered employee, as applicable, within
			 fifteen days after the original creation or transmission of the message;
			 or</text>
							</paragraph><paragraph id="HD0931FC487AA48DAB46B095160AB57E0"><enum>(3)</enum><text>prints a complete copy of the applicable electronic message, including a complete list of the
			 recipients of such message, and submits the message to the appropriate
			 location or individual for appropriate archival storage by the Executive
			 Office of the President within fifteen days after the original creation or
			 transmission of the message.</text>
							</paragraph></subsection><subsection commented="no" id="H6E548EBBE12747F8A4FFEEC50940345C"><enum>(b)</enum><header>Adverse actions</header><text display-inline="yes-display-inline">An intentional violation of subsection (a) (including any rules, regulations, or other implementing
			 guidelines) by a covered employee, as determined by the appropriate
			 supervisor, shall be forwarded to the Inspector General of the agency for
			 a verification of the violation, and upon verification, shall be subject
			 to the suspension and removal provisions under <external-xref legal-doc="usc" parsable-cite="usc/5/7552">section 7552</external-xref> of title 5.</text>
						</subsection><subsection commented="no" id="H67D72E17C0C6486FB07813F45A0E466F"><enum>(c)</enum><header>Definitions</header><text>In this section:</text>
							<paragraph commented="no" id="H0992F1F177C94DAC8A038E2F25F4AF87"><enum>(1)</enum><header>Covered employee</header><text>The term <term>covered employee</term> means—</text>
								<subparagraph commented="no" id="H76AE6E2A99864716B821592172AAE2CA"><enum>(A)</enum><text>the immediate staff of the President;</text>
								</subparagraph><subparagraph commented="no" id="H3B31CC14D3A04C9799FCECD3865CCF1B"><enum>(B)</enum><text>the immediate staff of the Vice President;</text>
								</subparagraph><subparagraph commented="no" id="H733D9A807DF8497CA352F1328DB7C652"><enum>(C)</enum><text>an individual of the Executive Office of the President whose function is to advise and assist the
			 President; or</text>
								</subparagraph><subparagraph commented="no" id="H4582AF688EE449AA8720E12EB4259D18"><enum>(D)</enum><text>an individual of the Office of the Vice President whose function is to advise and assist the Vice
			 President.</text>
								</subparagraph></paragraph><paragraph commented="no" id="H5D68D2EFB2F34527A50ACE1CEF6F99A5"><enum>(2)</enum><header>Electronic message</header><text>The term <term>electronic message</term> means electronic mail and all other means by which individuals and groups may communicate with
			 each other electronically.</text>
							</paragraph><paragraph commented="no" id="HB854FA77949D43DC9A8AE530A20020B2"><enum>(3)</enum><header>Electronic messaging account</header><text>The term <term>electronic messaging account</term> means any account that sends an electronic message.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HFF334DFFA0BE4C5D9ABC9E0064C6A37B"><enum>(b)</enum><header>Federal records</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/29">Chapter 29</external-xref> of title 44, United States Code is amended by adding at the end the following new
			 section:</text>
				<quoted-block display-inline="no-display-inline" id="H23EB3F1EC56A45B4A819953833902C79" style="USC">
					<section id="H4456044E95F045EE8FD4A88E9E1F7990"><enum>2911.</enum><header>Disclosure requirement for official business conducted using non-official electronic messaging
			 accounts</header>
						<subsection id="H242D4D2A530C49349A74FD010CC21B31"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">An officer or employee of a Federal agency may not create or send a record using a non-official
			 electronic messaging account (in this section, referred to as <quote>applicable electronic message</quote>) unless such officer or employee—</text>
							<paragraph id="HAFB22E6208784491B178542598B9F1E9"><enum>(1)</enum><text display-inline="yes-display-inline">includes an official electronic messaging account of the officer or employee as a recipient in the
			 original creation or transmission of the applicable electronic message and
			 identifies all recipients of the applicable electronic message in such
			 message;</text>
							</paragraph><paragraph id="H740DF00D45E84760AB786C6849E20641"><enum>(2)</enum><text>forwards a complete copy of the applicable electronic message, including a complete list of the
			 recipients of such message, to an official electronic messaging account of
			 the officer or employee within fifteen days after the original creation or
			 transmission of the record; or</text>
							</paragraph><paragraph id="HEC373EF47AB44F1CA7E2FD5F8CF8B381"><enum>(3)</enum><text display-inline="yes-display-inline">prints a complete copy of the applicable electronic message, including a complete list of the
			 recipients of such message, and submits it to the appropriate location or
			 individual for appropriate archival storage by the Federal agency within
			 fifteen days after the original creation or transmission of the message.</text>
							</paragraph></subsection><subsection commented="no" id="HF28485F16FE4470DB9E25CCA85A3965C"><enum>(b)</enum><header>Adverse actions</header><text display-inline="yes-display-inline">An intentional violation of subsection (a) (including any rules, regulations, or other implementing
			 guidelines) by an officer or employee of a Federal agency, as determined

				</paragraph></subsection></section><section id="HE166F56CC36147F5B100FA16ECA9288B"><enum>4.</enum><header>Reporting of the loss or potential loss of records</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/44/3106">Section 3106</external-xref> of title 44, United States Code, is amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="H77CEA4690AD9468C826C42F69F5261EF" style="USC">
				<section id="H61F4A1B6193445C590AE1DF8F839428F"><enum>3106.</enum><header>Unlawful removal, destruction of records</header>
					<subsection id="HAB77A28FE58F426881A0D7AFE4F254EF"><enum>(a)</enum><header>Notification</header>
						<paragraph id="HADE09D35F21D4CCAADCEB71D07FE94C8"><enum>(1)</enum><header>Archivist and public notification</header><text display-inline="yes-display-inline">Whenever the actual, impending, or threatened unlawful concealment, removal, mutilation,
			 obliteration, falsification, or destruction of any record, proceeding,
			 map, book, document, paper, or other thing in the custody of an agency
			 comes to the attention of the head of the Federal agency, the head of the
			 agency shall—</text>
							<subparagraph id="H86CDC826D12F4CBBA4981325BAD11E26"><enum>(A)</enum><text>notify the Archivist; and</text>
							</subparagraph><subparagraph id="H62079CC80837493B853264C0292960A3"><enum>(B)</enum><text>publish a general description of the records at risk or that have been lost on the website of the
			 agency.</text>
							</subparagraph></paragraph><paragraph commented="no" id="H0CD7328487F441ACB2B5B882FB771FD6"><enum>(2)</enum><header>Agency notification</header><text display-inline="yes-display-inline">Whenever the actual, impending, or threatened unlawful concealment, removal, mutilation,
			 obliteration, falsification, or destruction of any record, proceeding,
			 map, book, document, paper, or other thing in the custody of an agency
			 comes to the attention of a Senior Agency Official for Records Management,
			 such official shall immediately notify the head of the agency.</text>
						</paragraph></subsection><subsection id="H200557789D154DF9BCAAB339B2FE1F44"><enum>(b)</enum><header>Reclamation of records</header><text display-inline="yes-display-inline">With the assistance of the Archivist, the head of a Federal agency shall initiate action through
			 the Attorney General for the recovery of records the head knows or has
			 reason to believe have been unlawfully removed from the agency, or from
			 another Federal agency whose records have been transferred to the legal
			 custody of such head.</text>
					</subsection><subsection id="H6495C318166A4CB2B1D5189952C705A5"><enum>(c)</enum><header>Action by the Archivist</header><text>In any case in which the head of the agency does not initiate an action for the recovery of records
			 described in subsection (b) or other redress within a reasonable period of
			 time after being notified of any such unlawful removal, the Archivist
			 shall request the Attorney General to initiate an action described in
			 subsection (b), and shall notify the Congress not later than 5 days after
			 the date on which such a request has been submitted to the Attorney
			 General.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" id="HEB201789031445428BA2D9EDEABE0B8E"><enum>5.</enum><header>Senior Agency Official for Records Compliance</header>
			<subsection commented="no" id="H18CCC9F7F03741E0BBFEB8FC155C9230"><enum>(a)</enum><header>Senior agency official</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/31">Chapter 31</external-xref> of title 44, United States Code, is amended by adding at the end the following new
			 section:</text>
				<quoted-block display-inline="no-display-inline" id="H21FEED60D10140B7A17E38CA434E5686" style="USC">
					<section commented="no" id="H29535B5572BB41E5A959A141FABCBB27"><enum>3108.</enum><header>Senior Agency Official for Records Compliance</header>
						<subsection commented="no" id="HFB5030AF59714E9B89308A29F2FD0C09"><enum>(a)</enum><header>Designation</header><text>Not later than November 15, 2014, the head of each Federal agency shall designate a Senior Agency
			 Official for Records Management, and not later than November 15 of each
			 year thereafter the head of each Federal agency shall reaffirm or
			 designate a new Senior Agency Official for Records Management.</text>
						</subsection><subsection commented="no" id="HDFA722C1075A45F9B2162CE71CD21DB7"><enum>(b)</enum><header>Authorities and responsibilities</header><text>The Senior Agency Official for Records Management shall—</text>
							<paragraph commented="no" id="H32ECFDCE417C4B1083117A08166099C7"><enum>(1)</enum><text>be at least at the level of an Assistant Secretary or the equivalent; and</text>
							</paragraph><paragraph commented="no" id="H4EE291BDB1CC4457AED098774C229DE5"><enum>(2)</enum><text>be responsible for the coordinating with the appropriate Agency Records Officer and appropriate
			 agency officials to ensure compliance with all applicable records
			 management statutes, regulations, and any guidance issued by the
			 Archivist.</text>
							</paragraph></subsection><subsection commented="no" id="H1D307C98847F404FB57EAF652BCF708C"><enum>(c)</enum><header>Federal agency coordination</header><text>In addition to the designation made pursuant to subsection (a), the head of a Federal agency may
			 designate additional Senior Agency Officials for Records Management as the
			 head of the agency determines to be necessary.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" id="HA2A09262B2B74366ADB3909CCF067230"><enum>(b)</enum><header>Technical and conforming amendment</header><text>The table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/31">chapter 31</external-xref> of title 44, United States Code, is amended by
			 adding at the end the following new item:</text>

			<subsection id="H0724E38BE37246F68464B58B64DE4F40"><enum>(a)</enum><header>Requirement for Preservation of Electronic Messages</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/29">Chapter 29</external-xref> of title 44, United States Code, as amended by section 3(b), is further amended by
			 adding at the end the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H30D8F12EA4F544FE97D8AE1AD4F3F175" style="USC">
					<section id="HE992B620CA1741BA94B3D8F8A27D65AE"><enum>2912.</enum><header>Preservation of electronic messages and other records</header>
						<subsection id="H52C52498F09A4E1D8D261F6B70B1F0A9"><enum>(a)</enum><header>Regulations required</header><text display-inline="yes-display-inline">Not later than 18 months after the date of the enactment of this section, the Archivist shall
			 promulgate regulations governing Federal agency preservation of electronic
			 messages that are determined to be records (as such term is defined under
			 section 3301 of this title). Such regulations shall, at a minimum—</text>
							<paragraph id="HE8A70C6FC6DD4F35B6453559780D52A4"><enum>(1)</enum><text>require the electronic capture, management, and preservation of such electronic records in
			 accordance with the records disposition requirements of chapter 33 of this
			 title;</text>
							</paragraph><paragraph id="HDD4EF90D65D746C9A36EEFE00CE0271C"><enum>(2)</enum><text>require that such electronic records are readily accessible for retrieval through electronic
			 searches;</text>
							</paragraph><paragraph id="HBEA4F13125EA4C0FB6CE913D0A38B70A"><enum>(3)</enum><text>establish mandatory minimum functional requirements for electronic records management systems to
			 ensure compliance with the requirements in paragraphs (1) and (2);</text>
							</paragraph><paragraph id="H290C878AA3584D4F8E26A9207A1B7C0E"><enum>(4)</enum><text>establish a process to certify that Federal agencies’ electronic records management systems meet
			 the functional requirements established under paragraph (3); and</text>
							</paragraph><paragraph id="H15264D1336E54718A3245DD7F651E26C"><enum>(5)</enum><text>include timelines for Federal agency compliance with the regulations that ensure compliance as
			 expeditiously as practicable but not later than 2 years after the date of
			 the enactment of this section.</text>
							</paragraph></subsection><subsection id="H59A678DDC66145C194D14635F8F71B1C"><enum>(b)</enum><header>Coverage of other electronic records</header><text display-inline="yes-display-inline">To the extent practicable, the regulations promulgated under subsection (a) shall also include
			 requirements for the capture, management, and preservation of other
			 electronic records.</text>
						</subsection><subsection id="H2856071D09C644CF8BAB0247F55BD1CC"><enum>(c)</enum><header>Compliance by Federal agencies</header><text display-inline="yes-display-inline">Each Federal agency shall comply with the regulations promulgated under subsection (a).</text>
						</subsection><subsection id="H02FCB87607AA4C16BB859A3F4F74B08C"><enum>(d)</enum><header>Review of regulations required</header><text display-inline="yes-display-inline">The Archivist shall periodically review and, as necessary, amend the regulations promulgated under
			 subsection (a).</text>
						</subsection><subsection id="HB0B5952C65854872A170A65BB747981D"><enum>(e)</enum><header>Reports on implementation of regulations</header>
							<paragraph id="HAE0D43C3FC2847D6BAE7F9D60FBD86F8"><enum>(1)</enum><header>Agency report to Archivist</header><text display-inline="yes-display-inline">Not later than 3 years after the date of the enactment of this section, the head of each Federal
			 agency shall submit to the Archivist a report on the agency’s compliance
			 with the regulations promulgated under this section.</text>
							</paragraph><paragraph id="H605259A7CF6D4D39B12F81842EF51E7C"><enum>(2)</enum><header>Archivist report to Congress</header><text display-inline="yes-display-inline">Not later than 90 days after receipt of all reports required by paragraph (1), the Archivist shall
			 submit to the Committee on Homeland Security and Governmental Affairs of
			 the Senate and the Committee on Oversight and Government Reform of the
			 House of Representatives a report on Federal agency compliance with the
			 regulations promulgated under subsection (a).</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H2FA0968F6BE8495392F6C3D447C7F2B6"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/29">chapter 29</external-xref> of title 44, United States Code, as amended by
			 section 3(c)(2), is further amended by adding after the item relating to
			 section 2911 the following new item:</text>

				</paragraph><paragraph id="H682A49331A9A42F68DF3ACF330CA4FA8"><enum>(2)</enum><text>by striking paragraph (15) and inserting the following new paragraphs:</text>

							<subparagraph id="HBF9AE4D33C2641A2AAB285FFA21A0AFB"><enum>(A)</enum><text>categorizing and locating records;</text>
							</subparagraph><subparagraph id="H6F08D81B390F47F5B4041988836882B9"><enum>(B)</enum><text>ensuring that records are retained as long as necessary;</text>
							</subparagraph><subparagraph id="H3A20E9E18B89435AB8DAAE547DC5F7CB"><enum>(C)</enum><text>identifying records that are due for disposition; and</text>
							</subparagraph><subparagraph id="H6F0DF9B609844C35A66DD756B110ABE5"><enum>(D)</enum><text>ensuring the storage, retrieval, and disposition of records.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="H7AF7A2DCFB964793B254B9C7458D0E6B"><enum>7.</enum><header>Presidential records</header>
			<subsection display-inline="no-display-inline" id="H7669D5D2EB134B34A6CFE090CE7C6F9F"><enum>(a)</enum><header>Additional Regulations Relating to Presidential Records</header>
				<paragraph id="H33436BB671E143CDAC6475012BC380EC"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/44/2206">Section 2206</external-xref> of title 44, United States Code, is amended—</text>
					<subparagraph id="HF80E2497A09648B0B3339AF81401E167"><enum>(A)</enum><text>by striking <quote>and</quote> at the end of paragraph (3);</text>
					</subparagraph><subparagraph id="H1E00AB18E1DD4304B833B8AB3DBE82F1"><enum>(B)</enum><text>by striking the period at the end of paragraph (4) and inserting <quote>; and</quote>; and</text>

			 electronic Presidential records during the President’s term of office,

								<subparagraph id="H6B0CE4EBD0E74AB2B710218837D45F4C"><enum>(A)</enum><text>records management controls necessary for the capture, management, and preservation of electronic
			 messages;</text>
								</subparagraph><subparagraph id="H7364AD14D0FA41FCA5755491DF50DEDB"><enum>(B)</enum><text>records management controls necessary to ensure that electronic messages are readily accessible for
			 retrieval through electronic searches; and</text>
								</subparagraph><subparagraph id="H093BB853D11B4020A00AEBFB72506865"><enum>(C)</enum><text>a process to certify the electronic records management system to be used by the President for the
			 purposes of complying with the requirements in subparagraphs (A) and (B).</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H1E625FA4659743A4BA9D015785256F9C"><enum>(2)</enum><header>Definitions</header><text><external-xref legal-doc="usc" parsable-cite="usc/44/2201">Section 2201</external-xref> of title 44, United States Code, is amended by adding at the end the following new
			 paragraphs:</text>

				<paragraph id="H6ADD47D8B1EC4E5CBA29BBC9F75CD91B"><enum>(1)</enum><header>Certification required</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/22">Chapter 22</external-xref> of title 44, United States Code, as amended by section 3(a), is further amended by
			 adding at the end the following new section:</text>

						<section id="H8DE123C103F044D79BAAD416FA4E308C"><enum>2209.</enum><header>Certification of the President’s management of Presidential records</header>
							<subsection id="H6E1B3AA7959146239CD99B6948C564DB"><enum>(a)</enum><header>Annual Certification</header><text>The Archivist shall annually certify whether the electronic records management controls established
			 by the President meet requirements under sections 2203(a) and 2206(5) of
			 this title.</text>
							</subsection><subsection id="H489C4D3E004C44B2A9010C302EA798DE"><enum>(b)</enum><header>Report to Congress</header><text>The Archivist shall report annually to the Committee on Homeland Security and Governmental Affairs
			 of the Senate and the Committee on Oversight and Government Reform of the
			 House of Representatives on the status of the certification.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H7B8CE6BE0A7243FA8A7FF98571F14C0A"><enum>(2)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/22">chapter 22</external-xref> of title 44, United States Code, as amended by
			 section 3(c)(1), is further amended by adding at the end the following new
			 item:</text>

			 Archivist shall submit to the Committee on Homeland Security and
			 Governmental Affairs of the Senate and the Committee on Oversight and
			 Government Reform of the House of Representatives a report on—</text>
						<subparagraph id="H83070399812449D09F8BC35D33E6C6DE"><enum>(A)</enum><text>the volume and format of electronic Presidential records deposited into that President’s
			 Presidential archival depository; and</text>
						</subparagraph><subparagraph id="HD11A61E5BC81420CA25A960795BECDF6"><enum>(B)</enum><text>whether the electronic records management controls of that President met the requirements under
			 subsection (a) and <external-xref legal-doc="usc" parsable-cite="usc/44/2206">section 2206(5)</external-xref> of this title.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" id="HCEFCC7F506CC49C8B60C9EF58E71B03A"><enum>(d)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall take effect one year after the date of the enactment of
			 this Act.</text>
			</subsection></section><section id="HC73974341F964BC8894281781FA543AC"><enum>8.</enum><header>Retention of electronic correspondence</header>
			<subsection id="H5DD869E34D6F416292BDAF34645D92AD"><enum>(a)</enum><header>Retention of records of high level officials</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/44/3102">Section 3102</external-xref> of title 44, United States Code, is amended—</text>
				<paragraph id="H0017F6F0320E467A942859E85D5C9F21"><enum>(1)</enum><text>in paragraph (2), by striking <quote>; and</quote> and inserting a semicolon;</text>
				</paragraph><paragraph id="HF1AAA1A0C1514EFCBE6B7AC7C622DE52"><enum>(2)</enum><text>in paragraph (3), by striking the period at the end and inserting <quote>; and</quote>; and</text>
				</paragraph><paragraph id="HC7E3447913F040C2A7A42B5DAAB77C5A"><enum>(3)</enum><text>by adding at the end the following:</text>

			 preserved because such accounts are most likely to contain records that
			 should be preserved as permanent Federal records and the automatic
			 retention of those records, including the accounts of each head of a
			 Federal agency, the deputies and assistants of such head, the head of each
			 program office and staff office, each assistant secretary, each
			 administrator, each commissioner, each director of an office, bureau, or
			 the equivalent, each principal regional official, each staff assistant to
			 such official (such as a special assistant, confidential assistant, and
			 administrative assistant), each career Federal employee, each political
			 appointee, and each member of the Armed Forces serving in equivalent or
			 comparable positions; and</text>
						</paragraph><paragraph id="H138541D754744575A902A313A05F65B4"><enum>(5)</enum><text display-inline="yes-display-inline">electronic capture, management, and preservation of the electronic messaging accounts (as defined
			 in section 2911) described in paragraph (4), in accordance with the
			 records disposal requirements of chapter 33 of this title such that—</text>
							<subparagraph id="H6367E8D596D44ABAA11FCD60B5DC537A"><enum>(A)</enum><text display-inline="yes-display-inline">electronic records are readily accessible for retrieval through electronic searches; and</text>
							</subparagraph><subparagraph id="H2CE89916624846BA8A4C9850581A24E5"><enum>(B)</enum><text display-inline="yes-display-inline">there are mandatory minimum functional requirements for electronic records management systems to
			 ensure compliance with this section.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H008EE04E2A8941D58CE89EBF0214A3E5"><enum>(b)</enum><header>Review by the Comptroller General of the United States</header><text><external-xref legal-doc="usc" parsable-cite="usc/44/3107">Section 3107</external-xref> of title 44, United States Code, is amended—</text>
				<paragraph id="H0922548637A248A5B8952B62E06EB054"><enum>(1)</enum><text>by striking <quote>Chapters 21</quote> and inserting <quote>(a) <header-in-text level="subsection" style="USC">In general.—</header-in-text>Chapters 21</quote>; and</text>
				</paragraph><paragraph id="HEE760A987D604D9D8B9A4E4D1A564218"><enum>(2)</enum><text>by adding at the end the following:</text>

			 agency management of electronic mail records required under paragraphs (4)
			 and (5) of section 3102.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H591D4D1C073A4BE9877726ECEE928732"><enum>(c)</enum><header>Review by Inspector General</header><text>Section 4(a) of the Inspector General Act (5 U.S.C. App) is amended—</text>
				<paragraph id="H09490D24484145C4BB9A85B9ECF9BFEE"><enum>(1)</enum><text>in paragraph (4), by striking <quote>; and</quote> and inserting a semicolon;</text>
				</paragraph><paragraph id="H5DDA0BE5E7A7480584719F2B3EA4295B"><enum>(2)</enum><text>in paragraph (5), by striking the period at the end and inserting <quote>; and</quote>; and</text>
				</paragraph><paragraph id="H2603707EBD7F44019F77C6A70C2AA582"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text>

			 requirements under the chapters 21, 29, 31 and 33 of title 44, United
			 States Code (commonly referred to as the Federal Records Act) for programs
			 and operations of such establishment and to make recommendations in the
			 semiannual reports required by section 5(a) concerning compliance with
			 records retention requirements.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H49442EE7B8804DB0B70A7F92030A9C78"><enum>(d)</enum><header>Effective date</header><text>This section and the amendments made by this section shall take effect on December 31, 2016.</text>
