			<subsection id="H81E34EBAC4F14845A284BAE073404E03"><enum>(a)</enum><header>In general</header><text>This Act may be cited as the <quote><short-title>Federal Records Accountability Act of 2014</short-title></quote>.</text>

			<subsection commented="no" id="HBBEF2F1B22E646D3A4F1E430A129E5E4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/75">Chapter 75</external-xref> of title 5, United States Code, is amended by adding after subchapter V the following:</text>
				<quoted-block display-inline="no-display-inline" id="H1138E27AF4FF4A6A89AFD8013C5CC78A" style="USC">
					<subchapter commented="no" id="HC024F92E70AA4C88AB1C31EAAD7D6F4F"><enum>VI</enum><header>Federal Records</header>
						<section commented="no" id="HED6AD32E05AA476BA8653A19B9909A36"><enum>7551.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subchapter the following definitions apply:</text>
							<paragraph id="H3380006A601B4538BEEDD530A418147D"><enum>(1)</enum><header>Employee</header><text display-inline="yes-display-inline">The term <term>employee</term> means—</text>
								<subparagraph id="H196C843EBE50496C850A21D7238663F2"><enum>(A)</enum><text display-inline="yes-display-inline">an individual in the competitive service who is not serving a probationary or trial period under an
			 initial appointment or who has completed 1 year of current continuous
			 employment in the same or similar positions under other than a temporary
			 appointment limited to 1 year or less; or</text>
								</subparagraph><subparagraph id="HDF1396A4955A414A9D1C4444434911B3"><enum>(B)</enum><text display-inline="yes-display-inline">a career appointee in the Senior Executive Service who—</text>
									<clause id="H82C43E5E9468480881C50AAA42BB5276"><enum>(i)</enum><text>has completed the probationary period prescribed under section 3393(d) of this title; or</text>
									</clause><clause id="H9731B7ED5D534D56B27FCFC0D04EEF34"><enum>(ii)</enum><text>was covered by the provisions of subchapter II of this chapter immediately before appointment to
			 the Senior Executive Service.</text>
									</clause></subparagraph></paragraph><paragraph id="H66F53E6F4B774F51B0EB68856C5F2608"><enum>(2)</enum><header>Suspension</header><text>The term <term>suspension</term> has the meaning given that term in section 7501 of this title.</text>
							</paragraph></section><section commented="no" id="H209997966AA64EF38A67F2017DE6D3FB"><enum>7552.</enum><header>Suspension and removal</header>
							<subsection id="H70936AA753D8486187F1668802CEDEB6"><enum>(a)</enum><header>Inspector General finding</header><text display-inline="yes-display-inline">If the Inspector General of an agency determines an employee of the agency has willfully and
			 unlawfully concealed, removed, mutilated, obliterated, falsified, or
			 destroyed any record, proceeding, map, book, document, paper, or other
			 thing in the custody of such employee, or verifies a violation under
			 section <external-xref legal-doc="usc" parsable-cite="usc/44/2208">2208</external-xref> or <external-xref legal-doc="usc" parsable-cite="usc/44/2911">2911</external-xref> of title 44, the Inspector General shall promptly
			 inform the head of the agency of that determination in writing.</text>
							</subsection><subsection commented="no" id="HAE35CCB117FE46C0A5C915695CEBB765"><enum>(b)</enum><header>Suspension</header><text>Notwithstanding any other provision of law, the head of an agency shall suspend an employee of that
			 agency who has been determined by the Inspector General under subsection
			 (a) to have willfully and unlawfully concealed, removed, mutilated,
			 obliterated, falsified, or destroyed any record, proceeding, map, book,
			 document, paper, or other thing in the custody of such employee, or who
			 has been verified by the Inspector General to be in violation of section
			 2208 or 2911 of title 44.</text>
							</subsection><subsection commented="no" id="H57432A1FF4FF4B3FAAF229191A1A1E4F"><enum>(c)</enum><header>Requirements after suspension</header><text display-inline="yes-display-inline">An employee suspended under subsection (b) is entitled, after suspension and before removal, to—</text>
								<paragraph id="H4B270B44E6BD41DB87DC0FCF057BC81E"><enum>(1)</enum><text>be represented by an attorney or other representative;</text>
								</paragraph><paragraph commented="no" id="H59C448588CC24C90A8437FBB241FA44E"><enum>(2)</enum><text>a written statement of the charges against the employee within 15 days after suspension, which may
			 be amended within 30 days thereafter;</text>
								</paragraph><paragraph commented="no" id="HF23E561E51514F63856996642CD0FAD5"><enum>(3)</enum><text>an opportunity within 15 days after the receipt of the written statement under paragraph (2), plus
			 an additional 15 days if the charges are amended, to answer the charges
			 and submit affidavits;</text>
								</paragraph><paragraph commented="no" id="H161702864F68405BA2703B3ABA35A3AF"><enum>(4)</enum><text>a hearing, at the request of the employee, by an agency authority duly constituted for this
			 purpose;</text>
								</paragraph><paragraph commented="no" id="H22BE08BF8CE749B5A3F83B8C972084CC"><enum>(5)</enum><text>a review of the employee’s case by the head of the agency or a designee, before a decision adverse
			 to the employee is made final; and</text>
								</paragraph><paragraph commented="no" id="H71FC5ECF61A04A03A663CF7FCA50DDC9"><enum>(6)</enum><text>a written statement of the decision of the head of the agency.</text>
								</paragraph></subsection><subsection commented="no" id="HD3146F282CDB4E088F6C2D9E74C077B7"><enum>(d)</enum><header>Removal</header><text display-inline="yes-display-inline">Subject to subsection (c) of this section and after any investigation and review the head of the
			 agency considers necessary, the head of an agency shall remove an employee
			 suspended under subsection (b) if such head determines that the employee
			 willfully and unlawfully concealed, removed, mutilated, obliterated,
			 falsified, or destroyed any record, proceeding, map, book, document,
			 paper, or other thing in the custody of such employee.</text>
							</subsection><subsection id="H4FB5B668244B44788F46FED3D964BD05"><enum>(e)</enum><header>Appeal</header><text>An employee who is removed under subsection (d) is entitled to appeal to the Merit Systems
			 Protection Board under section 7701 of this title.</text>
							</subsection></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" id="H2EB0FFE58658469E899199970925CFE0"><enum>(b)</enum><header>Technical and conforming amendments</header>
				<paragraph id="H405BE49046214BFEA8AB5B24CC21FDB1"><enum>(1)</enum><header>Table of subchapters</header><text>The table of subchapters for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/75">chapter 75</external-xref> of title 5, United States Code, is amended by adding at the
			 end the following new items:</text>

					<subparagraph id="H56413CA34E5B49E2B7992FEADF4EE804"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (D), by striking <quote>or</quote> at the end;</text>
					</subparagraph><subparagraph id="H5AE1B3F83AB544639BF52F16386A5BD4"><enum>(B)</enum><text>in subparagraph (E), by striking the period at the end and inserting <quote>, or</quote>; and</text>
					</subparagraph><subparagraph id="H4A09DC61152141059F59D1B09CE09185"><enum>(C)</enum><text>by adding at the end the following:</text>

					</subparagraph></paragraph></subsection></section><section id="HE85F6B0BB0894DA984B330B8EEB6DA41"><enum>3.</enum><header>Use of non-official electronic messaging accounts</header>
			<subsection id="HAB2E808DC7F34239BF0F042E3F2AE558"><enum>(a)</enum><header>Presidential records act</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/22">Chapter 22</external-xref> of title 44, United States Code is amended by adding at the end the following new
			 section:</text>
				<quoted-block display-inline="no-display-inline" id="H86CE1178D6424546A9D079B5A2B40CAF" style="USC">
					<section id="HA210BC82BA1141B4855D32648D2A9D67"><enum>2208.</enum><header>Disclosure requirement for official business conducted using non-official electronic messaging
			 accounts</header>
						<subsection id="HCF95E13C1F674D84BD71FABF3DE4B923"><enum>(a)</enum><header>In general</header><text>The President, Vice President, or covered employee may not create or send a Presidential or Vice
			 Presidential record using a non-official electronic messaging account (in
			 this section, referred to as <quote>applicable electronic message</quote>) unless the President, Vice President, or covered employee—</text>
							<paragraph id="H36AF6744154A4D3D860AD665BA1CC0AF"><enum>(1)</enum><text display-inline="yes-display-inline">includes an official electronic messaging account of the President, Vice President, or covered
			 employee, as applicable, as a recipient in the original creation or
			 transmission of the applicable electronic message and identifies all
			 recipients of the applicable electronic message in such message;</text>
							</paragraph><paragraph id="H81F804DFF5004460A6E227ABA24B3EDA"><enum>(2)</enum><text>forwards a complete copy of the applicable electronic message, including a complete list of the
			 recipients of such message, to an official electronic messaging account of
			 the President, Vice President, or covered employee, as applicable, within
			 fifteen days after the original creation or transmission of the message;
			 or</text>
							</paragraph><paragraph id="H9A24C200C3F9495AAE836080B278BA3C"><enum>(3)</enum><text>prints a complete copy of the applicable electronic message, including a complete list of the
			 recipients of such message, and submits the message to the appropriate
			 location or individual for appropriate archival storage by the Executive
			 Office of the President within fifteen days after the original creation or
			 transmission of the message.</text>
							</paragraph></subsection><subsection commented="no" id="H0E80B33B536C46BBA6DEF2DCB21B5651"><enum>(b)</enum><header>Adverse actions</header><text display-inline="yes-display-inline">An intentional violation of subsection (a) (including any rules, regulations, or other implementing
			 guidelines) by a covered employee, as determined by the appropriate
			 supervisor, shall be forwarded to the Inspector General of the agency for
			 a verification of the violation, and upon verification, shall be subject
			 to the suspension and removal provisions under <external-xref legal-doc="usc" parsable-cite="usc/5/7552">section 7552</external-xref> of title 5.</text>
						</subsection><subsection commented="no" id="HE62F4D224DCD4B75A7C56D2FA6EA7945"><enum>(c)</enum><header>Definitions</header><text>In this section:</text>
							<paragraph commented="no" id="H3171C52FA3B2460D85A5EC04116F10F5"><enum>(1)</enum><header>Covered employee</header><text>The term <term>covered employee</term> means—</text>
								<subparagraph commented="no" id="HD205B45260F14BDE8148C83DC35A1457"><enum>(A)</enum><text>the immediate staff of the President;</text>
								</subparagraph><subparagraph commented="no" id="H774422DFDB7D41FE855EA36CE62FC534"><enum>(B)</enum><text>the immediate staff of the Vice President;</text>
								</subparagraph><subparagraph commented="no" id="HFFFC614B4A9E497297C34AB5D25FBCB6"><enum>(C)</enum><text>an individual of the Executive Office of the President whose function is to advise and assist the
			 President; or</text>
								</subparagraph><subparagraph commented="no" id="HD864356D5A4141819CE991EB7470E7EA"><enum>(D)</enum><text>an individual of the Office of the Vice President whose function is to advise and assist the Vice
			 President.</text>
								</subparagraph></paragraph><paragraph commented="no" id="H619E9DC8DA2D4EEAA7589B4472C26368"><enum>(2)</enum><header>Electronic message</header><text>The term <term>electronic message</term> means electronic mail and all other means by which individuals and groups may communicate with
			 each other electronically.</text>
							</paragraph><paragraph commented="no" id="HDCF23FB8D0584238AECDDD34A023A117"><enum>(3)</enum><header>Electronic messaging account</header><text>The term <term>electronic messaging account</term> means any account that sends an electronic message.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H4C58CB3D86BC4ECAAA662844527FA79E"><enum>(b)</enum><header>Federal records</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/29">Chapter 29</external-xref> of title 44, United States Code is amended by adding at the end the following new
			 section:</text>

					<section id="H24726EF5693B466B88FD8BFFCD4A805F"><enum>2911.</enum><header>Disclosure requirement for official business conducted using non-official electronic messaging
			 accounts</header>
						<subsection id="H0F08141F51FA4C54A012015277706A3A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">An officer or employee of a Federal agency may not create or send a record using a non-official
			 electronic messaging account (in this section, referred to as <quote>applicable electronic message</quote>) unless such officer or employee—</text>
							<paragraph id="H3C417AD4705B49C79BFAC8CEDEFFA80D"><enum>(1)</enum><text display-inline="yes-display-inline">includes an official electronic messaging account of the officer or employee as a recipient in the
			 original creation or transmission of the applicable electronic message and
			 identifies all recipients of the applicable electronic message in such
			 message;</text>
							</paragraph><paragraph id="HA16A7197C8504D49B1C1C42453ABD19D"><enum>(2)</enum><text>forwards a complete copy of the applicable electronic message, including a complete list of the
			 recipients of such message, to an official electronic messaging account of
			 the officer or employee within fifteen days after the original creation or
			 transmission of the record; or</text>
							</paragraph><paragraph id="H68A2D1D3462045E086EB5CB48428C682"><enum>(3)</enum><text display-inline="yes-display-inline">prints a complete copy of the applicable electronic message, including a complete list of the
			 recipients of such message, and submits it to the appropriate location or
			 individual for appropriate archival storage by the Federal agency within
			 fifteen days after the original creation or transmission of the message.</text>
							</paragraph></subsection><subsection commented="no" id="H537F153288354C8AB1034C9F433A8E2B"><enum>(b)</enum><header>Adverse actions</header><text display-inline="yes-display-inline">An intentional violation of subsection (a) (including any rules, regulations, or other implementing

				</paragraph></subsection></section><section id="H00C72723678344D8AC71C3F53C3DA767"><enum>4.</enum><header>Reporting of the loss or potential loss of records</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/44/3106">Section 3106</external-xref> of title 44, United States Code, is amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="H67D459057D054F6DA1A9CABD99123F95" style="USC">
				<section id="H2EF591B39A9A41B79ECF0A0DEA8A2BF2"><enum>3106.</enum><header>Unlawful removal, destruction of records</header>
					<subsection id="HA8EC6D515E9145D0A3B8E01ED2C79C50"><enum>(a)</enum><header>Notification</header>
						<paragraph id="H66E9FCAC979545E88244197DD01BFA15"><enum>(1)</enum><header>Archivist and public notification</header><text display-inline="yes-display-inline">Whenever the actual, impending, or threatened unlawful concealment, removal, mutilation,
			 obliteration, falsification, or destruction of any record, proceeding,
			 map, book, document, paper, or other thing in the custody of an agency
			 comes to the attention of the head of the Federal agency, the head of the
			 agency shall—</text>
							<subparagraph id="H1CDC777FFD5C458493232D5E1FA2B7BD"><enum>(A)</enum><text>notify the Archivist; and</text>
							</subparagraph><subparagraph id="H0D32D6B310A649BE958A49C55174978B"><enum>(B)</enum><text>publish a general description of the records at risk or that have been lost on the website of the
			 agency.</text>
							</subparagraph></paragraph><paragraph commented="no" id="HB9F50516653A429DA3F828A3F9129C72"><enum>(2)</enum><header>Agency notification</header><text display-inline="yes-display-inline">Whenever the actual, impending, or threatened unlawful concealment, removal, mutilation,
			 obliteration, falsification, or destruction of any record, proceeding,
			 map, book, document, paper, or other thing in the custody of an agency
			 comes to the attention of a Senior Agency Official for Records Management,
			 such official shall immediately notify the head of the agency.</text>
						</paragraph></subsection><subsection id="HDD118E1304B24323A94B8BB890831306"><enum>(b)</enum><header>Reclamation of records</header><text display-inline="yes-display-inline">With the assistance of the Archivist, the head of a Federal agency shall initiate action through
			 the Attorney General for the recovery of records the head knows or has
			 reason to believe have been unlawfully removed from the agency, or from
			 another Federal agency whose records have been transferred to the legal
			 custody of such head.</text>
					</subsection><subsection id="H02B27549DB88406680B6383643C8263B"><enum>(c)</enum><header>Action by the Archivist</header><text>In any case in which the head of the agency does not initiate an action for the recovery of records
			 described in subsection (b) or other redress within a reasonable period of
			 time after being notified of any such unlawful removal, the Archivist
			 shall request the Attorney General to initiate an action described in
			 subsection (b), and shall notify the Congress not later than 5 days after
			 the date on which such a request has been submitted to the Attorney
			 General.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" id="H044C5731FE6C4AFCBC915ED239C78385"><enum>5.</enum><header>Senior Agency Official for Records Compliance</header>
			<subsection commented="no" id="H1B04306398FC40D98D3D3B10ACF9C258"><enum>(a)</enum><header>Senior agency official</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/31">Chapter 31</external-xref> of title 44, United States Code, is amended by adding at the end the following new
			 section:</text>
				<quoted-block display-inline="no-display-inline" id="HA98091D14B814CF19731A811F930C790" style="USC">
					<section commented="no" id="H5BB46D1C0C1F4B11817756015E89A002"><enum>3108.</enum><header>Senior Agency Official for Records Compliance</header>
						<subsection commented="no" id="H51A880BBB19D45DABA756CA54B788851"><enum>(a)</enum><header>Designation</header><text>Not later than November 15, 2014, the head of each Federal agency shall designate a Senior Agency
			 Official for Records Management, and not later than November 15 of each
			 year thereafter the head of each Federal agency shall reaffirm or
			 designate a new Senior Agency Official for Records Management.</text>
						</subsection><subsection commented="no" id="H4AA0D204BFAA44A3BF02C4D677E916F3"><enum>(b)</enum><header>Authorities and responsibilities</header><text>The Senior Agency Official for Records Management shall—</text>
							<paragraph commented="no" id="HE93DDE63099C4C4C97E7136E6E45E0BA"><enum>(1)</enum><text>be at least at the level of an Assistant Secretary or the equivalent; and</text>
							</paragraph><paragraph commented="no" id="HD30D1401611C4F29A55BC16CC26D7D3B"><enum>(2)</enum><text>be responsible for coordinating with the appropriate Agency Records Officer and appropriate
			 agency officials to ensure compliance with all applicable records
			 management statutes, regulations, and any guidance issued by the
			 Archivist.</text>
							</paragraph></subsection><subsection commented="no" id="H20346B7EF5484FA783E47129FEF9C090"><enum>(c)</enum><header>Federal agency coordination</header><text>In addition to the designation made pursuant to subsection (a), the head of a Federal agency may
			 designate additional Senior Agency Officials for Records Management as the
			 head of the agency determines to be necessary.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" id="HE1E53E714D4846BC95F7091C39DCB9DC"><enum>(b)</enum><header>Technical and conforming amendment</header><text>The table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/31">chapter 31</external-xref> of title 44, United States Code, is amended by
			 adding at the end the following new item:</text>
