		<official-title display="yes">To amend title 5, United States Code, to enhance accountability within the Senior Executive
			 Service, and for other purposes.</official-title>

	<legis-body id="HC6DDDE6A2FE74DE0AAB40D6E38B0E911" style="OLC">
		<section id="H91D350E432AB4CC08191B9D642E8DE7D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Senior Executive Service Accountability Act</short-title></quote>.</text>
		</section><section id="H2F8A3C04487E42CFB4C71FFC61AF7987"><enum>2.</enum><header>Biennial justification of positions</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/5/3133">Section 3133(a)(2)</external-xref> of title 5, United States Code, is amended by inserting after <quote>positions</quote> the following: <quote>, with a justification for each position (by title and organizational location) and the specific
			 result expected from each position, including the impact of such result on
			 the agency mission,</quote>.</text>
		</section><section id="H4AC27AC197E24954AA9AD2A1F51B1D59"><enum>3.</enum><header>Extension of probationary period</header>
			<subsection id="HBAB3DCE680354536AE089CB3702F7F9B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/5/3393">Section 3393(d)</external-xref> of title 5, United States Code, is amended by striking <quote>1-year</quote> and inserting <quote>2-year</quote>.</text>
			</subsection><subsection id="H931B120E62B740CA81B7C7A4CDFDC4C2"><enum>(b)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 3592(a)(1) of such title is amended by striking <quote>1-year</quote> and inserting <quote>2-year</quote>.</text>
			</subsection></section><section id="H6DEF71E3C1A4485084BF17C3CB66722E"><enum>4.</enum><header>Modification of pay retention for Senior Executive Service members removed for under performance</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/5/3594">Section 3594(c)(1)(B)</external-xref> of title 5, United States Code, is amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="HC9BD0DE08EC0419CAABEB1E157CC7A08" style="USC">
				<subparagraph id="H494F0133EF854AFDA2D0EBF8B8EC2906"><enum>(B)</enum>
					<clause commented="no" display-inline="yes-display-inline" id="H74F710E53E134036AF7AAF7D77214B9F"><enum>(i)</enum><text display-inline="yes-display-inline">any career appointee placed under subsection (a) or (b)(2) of this section shall be entitled to
			 receive basic pay at the highest of—</text>
						<subclause id="H523B995E10A440A6A4404611021EB32B" indent="up1"><enum>(I)</enum><text>the rate of basic pay in effect for the position in which placed;</text>
						</subclause><subclause id="HD868525E28214EDB98392FBE0D70B7E8" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">the rate of basic pay in effect at the time of the placement for the position the career appointee
			 held in the civil service immediately before being appointed to the Senior
			 Executive Service; or</text>
						</subclause><subclause id="H3BCEABBC44B549BE8F78B8F0CAD537D8" indent="up1"><enum>(III)</enum><text display-inline="yes-display-inline">the rate of basic pay in effect for the career appointee immediately before being placed under
			 subsection (a) or (b) of this section; and</text>
						</subclause></clause><clause id="H539689B60FC0483EB10CF22F1A3FD83E" indent="up1"><enum>(ii)</enum><text>any career appointee placed under subsection (b)(1) of this section shall be entitled to receive
			 basic pay at the rate of basic pay in effect for the position in which
			 placed; and</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H74FAE07044E642198D0DF3BA7A6FE563"><enum>5.</enum><header>Requirement that performance requirements be established in advance</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/5/4312">Section 4312(b)(1)</external-xref> of title 5, United States Code, is amended—</text>
			<paragraph id="HA167C3F4F34E443C98CB529347A42DD7"><enum>(1)</enum><text>by striking <quote>on or</quote> and inserting <quote>not later than 30 calendar days</quote>; and</text>
			</paragraph><paragraph id="H5775890D2E4943E6A1A3959E912AD6B2"><enum>(2)</enum><text>by inserting <quote>in writing</quote> after <quote>communicated</quote>.</text>
			</paragraph></section><section id="H522540BB84CC478E856ACE2E6F53C965"><enum>6.</enum><header>Amendments to adverse action provisions with respect to career appointees in the Senior Executive
			 Service</header>
			<subsection id="H80EE5B2A6D554A67A8FF279EA8242B6F"><enum>(a)</enum><header>Suspension for 14 days or less for senior executive service employee</header><text display-inline="yes-display-inline">Paragraph (1) of <external-xref legal-doc="usc" parsable-cite="usc/5/7501">Section 7501</external-xref> of title 5, United States Code, is amended to read as follows:</text>
				<quoted-block id="HFF0C1AAA75C849F2B6B52E2A05C96CE6" style="OLC">
					<paragraph id="HAE48F8C32E1E419D9D1ACEAD111D2ADC"><enum>(1)</enum><text><quote>employee</quote> means—</text>
						<subparagraph id="H935EB4768C7F4B868019D695A611F1EC"><enum>(A)</enum><text>an individual in the competitive service who is not serving a probationary period or trial period
			 under an initial appointment or who has completed 1 year of current
			 continuous employment in the same or similar positions under other than a
			 temporary appointment limited to 1 year or less; or</text>
						</subparagraph><subparagraph id="H2366C34222F847B3970010AE752B8CF4"><enum>(B)</enum><text>a career appointee in the Senior Executive Service who—</text>
							<clause id="H9FA6B3C009004E41A659A9CEF1A3DD15"><enum>(i)</enum><text>has completed the probationary period prescribed under section 3393(d); or</text>
							</clause><clause id="H5BF30DE4D0554BBDB564ECA3740DE7F9"><enum>(ii)</enum><text>was covered by the provisions of subchapter II of this chapter immediately before appointment to
			 the Senior Executive Service; and</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" id="H963C58809D204DF3A9F90FE606DCB4CF"><enum>(b)</enum><header>Modification of cause and procedure for suspension and termination</header>
				<paragraph commented="no" id="H4FE8A19598154AF78C2B9B524DB90462"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/5/7543">Section 7543</external-xref> of title 5, United States Code, is amended—</text>
					<subparagraph commented="no" id="HBE51C3CADD054A58B48BAE1179AFF65C"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (a), by striking <quote>misconduct,</quote> and inserting <quote>such cause as would promote the efficiency of the service, misconduct,</quote>;</text>
					</subparagraph><subparagraph commented="no" id="H58948723215E4E60950ECDAE0B35B146"><enum>(B)</enum><text>in subsection (b)(4), by adding at the end before the period the following: <quote>, but no later than 30 days after the date that the employee’s answer was received under paragraph
			 (2)</quote>;</text>
					</subparagraph><subparagraph commented="no" id="HBBA8DCA88C2547AA8A65FE2DE40C3F9E"><enum>(C)</enum><text>by redesignating subsections (c), (d), and (e) as subsections (d), (e), and (f), respectively;</text>
					</subparagraph><subparagraph commented="no" id="H84214230F53842F492FC190ADC147627"><enum>(D)</enum><text>by inserting after subsection (b) the following:</text>
						<quoted-block display-inline="no-display-inline" id="H5E7AAF4005A544298B38C3B733ECA83D" style="USC">
							<subsection commented="no" id="H5D8943D1B7C349468206C8F5EAA1F974"><enum>(c)</enum><text display-inline="yes-display-inline">An agency head may extend the deadline for an employee to answer under subsection (b)(2) or the
			 deadline for the agency to issue a written decision under subsection
			 (b)(4) for no more than 30 days each. Any extension by the agency head
			 under this subsection must be in writing and document the reasons for
			 granting the extension.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph commented="no" id="H4CF8E5202AC3408C864634B3D66D3AE4"><enum>(E)</enum><text>by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H62D176A3FE9749D29CAF34A5ABEB18F0" style="USC">
							<subsection commented="no" id="H2545BD11D0D74EBCB7D3FD429AD2142E"><enum>(g)</enum>
								<paragraph commented="no" display-inline="yes-display-inline" id="H04361D4E1519440B916AE3DEB2CE4906"><enum>(1)</enum><text>With respect to an employee subject to removal under this subchapter, if a final order or decision
			 is issued in favor of the agency by the agency, the Merit Systems
			 Protection Board, or the applicable reviewing court under section 7703,
			 the employee—</text>
									<subparagraph commented="no" id="H59E50EB47E15467EA4CD120A97AB58EC" indent="up1"><enum>(A)</enum><text>shall pay to the agency an amount equal to any pay received by the employee during the period
			 beginning on the date that the employee received notice under subsection
			 (b)(1) and ending on the date of such final order or decision; and</text>
									</subparagraph><subparagraph commented="no" id="H5D469763679E477898EA8ADBAA7FA57F" indent="up1"><enum>(B)</enum><text>have removed from such employee’s credit any annual leave accrued during such period.</text>
									</subparagraph></paragraph><paragraph commented="no" id="HA0A791CFEF87485C9F3B99FD595DC249" indent="up1"><enum>(2)</enum><text>Paragraph (1) shall apply only to an employee who, during the period described in paragraph (1)(A),
			 is placed on administrative leave or any other type of leave whereby the
			 employee is in a status without duties but with pay.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph commented="no" id="H75288FF8405140FA927C0A8392954899"><enum>(2)</enum><header>Conforming amendments</header><text display-inline="yes-display-inline">Subchapter V of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/35">chapter 35</external-xref> of title 5, United States Code, is amended—</text>
					<subparagraph commented="no" id="H03C2DE29D6E24402BE216C8078BF2B5A"><enum>(A)</enum><text display-inline="yes-display-inline">in section 3593—</text>
						<clause commented="no" id="HF25900BCC3F0491FA0D8A379536B7235"><enum>(i)</enum><text display-inline="yes-display-inline">in subsection (a)(2), by striking <quote>misconduct,</quote> and inserting <quote>such cause as would promote the efficiency of the service, misconduct,</quote>; and</text>
						</clause><clause commented="no" id="HE090845FFA41498792528F4FB3042D98"><enum>(ii)</enum><text display-inline="yes-display-inline">in subsection (b), by striking <quote>misconduct,</quote> and inserting <quote>such cause as would promote the efficiency of the service, misconduct,</quote>; and</text>
						</clause></subparagraph><subparagraph commented="no" id="H8AF665A4DE464F86A4BC33022AF35588"><enum>(B)</enum><text display-inline="yes-display-inline">in section 3594(a), by striking <quote>misconduct,</quote> and inserting <quote>such cause as would promote the efficiency of the service, misconduct,</quote>.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
