		<official-title>To amend title 5, United States Code, to enhance accountability within the Senior Executive
			 Service, and for other purposes.</official-title>

		<section id="HC269EEA4605740D8A8AD10C09BE6D5FC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Senior Executive Service Accountability Act</short-title></quote>.</text>
		</section><section id="HD5B5336E8D7D47EF82A3C2E0BB24F54C"><enum>2.</enum><header>Biennial justification of positions</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/5/3133">Section 3133(a)(2)</external-xref> of title 5, United States Code, is amended by inserting after <quote>positions</quote> the following: <quote>, with a justification for each position (by title and organizational location) and the specific
			 result expected from each position, including the impact of such result on
			 the agency mission,</quote>.</text>
		</section><section id="H8694F85A8C0D458EBAB63276750A4773"><enum>3.</enum><header>Extension of probationary period</header>
			<subsection id="HE79400049A2543E7A288AF49B5AE6030"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/5/3393">Section 3393(d)</external-xref> of title 5, United States Code, is amended by striking <quote>1-year</quote> and inserting <quote>2-year</quote>.</text>
			</subsection><subsection id="H95FDAC5831EE412FB83CDFECF4AA4B86"><enum>(b)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 3592(a)(1) of such title is amended by striking <quote>1-year</quote> and inserting <quote>2-year</quote>.</text>
			</subsection></section><section id="HF5858315C36C44A3BB441B565AFE7C36"><enum>4.</enum><header>Modification of pay retention for Senior Executive Service members removed for under performance</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/5/3594">Section 3594(c)(1)(B)</external-xref> of title 5, United States Code, is amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="H55E06268D165450EB74D481A0D1383AF" style="USC">
				<subparagraph id="H369C79FB20E742F4BB885F1B3E6381B3"><enum>(B)</enum>
					<clause commented="no" display-inline="yes-display-inline" id="H31D61E32D1DC432CA230EC3F6627BE24"><enum>(i)</enum><text display-inline="yes-display-inline">any career appointee placed under subsection (a) or (b)(2) of this section shall be entitled to
			 receive basic pay at the highest of—</text>
						<subclause id="H30F4CF8EC5AD487787FB121D17A656FF" indent="up1"><enum>(I)</enum><text>the rate of basic pay in effect for the position in which placed;</text>
						</subclause><subclause id="H825C39EFC99447DCAF6D4886ED96EB70" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">the rate of basic pay in effect at the time of the placement for the position the career appointee
			 held in the civil service immediately before being appointed to the Senior
			 Executive Service; or</text>
						</subclause><subclause id="H0BA53190286A456B8EF37584F03EAA3C" indent="up1"><enum>(III)</enum><text display-inline="yes-display-inline">the rate of basic pay in effect for the career appointee immediately before being placed under
			 subsection (a) or (b) of this section; and</text>
						</subclause></clause><clause id="HEABB6AC674E543239E247043B54A6643" indent="up1"><enum>(ii)</enum><text>any career appointee placed under subsection (b)(1) of this section shall be entitled to receive
			 basic pay at the rate of basic pay in effect for the position in which
			 placed; and</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H25C0F8E8E792414C9CFC3633AE3A4691"><enum>5.</enum><header>Requirement that performance requirements be established in advance</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/5/4312">Section 4312(b)(1)</external-xref> of title 5, United States Code, is amended—</text>
			<paragraph id="H83A160CFC1B847D1954F86BDFEB2CD12"><enum>(1)</enum><text>by striking <quote>on or</quote> and inserting <quote>not later than 30 calendar days</quote>; and</text>
			</paragraph><paragraph id="H55B699D69DA1410EA18A85F6B9E67666"><enum>(2)</enum><text>by inserting <quote>in writing</quote> after <quote>communicated</quote>.</text>
			</paragraph></section><section id="H9ACE6B60D4304B919FA8D645E7A18FF6"><enum>6.</enum><header>Amendments to adverse action provisions with respect to career appointees in the Senior Executive
			 Service</header>
			<subsection id="HFAB1CABC726947F1B8DB248C5CFD79E9"><enum>(a)</enum><header>Suspension for 14 days or less for senior executive service employee</header><text display-inline="yes-display-inline">Paragraph (1) of <external-xref legal-doc="usc" parsable-cite="usc/5/7501">Section 7501</external-xref> of title 5, United States Code, is amended to read as follows:</text>
				<quoted-block id="HFA33CA51A41D42F8A92550D7A6EAA902" style="OLC">
					<paragraph id="H5BE20EAD98AE44FC81A2D63B1094E1B5"><enum>(1)</enum><text><quote>employee</quote> means—</text>
						<subparagraph id="H0A527E6A98C04BC59E822D68ECFF2605"><enum>(A)</enum><text>an individual in the competitive service who is not serving a probationary period or trial period
			 under an initial appointment or who has completed 1 year of current
			 continuous employment in the same or similar positions under other than a
			 temporary appointment limited to 1 year or less; or</text>
						</subparagraph><subparagraph id="HDD04E9B94D0E4FFE946D7D893981A2B5"><enum>(B)</enum><text>a career appointee in the Senior Executive Service who—</text>
							<clause id="HB2D81E9818D8477A9C6E5E1A9B772DC5"><enum>(i)</enum><text>has completed the probationary period prescribed under section 3393(d); or</text>
							</clause><clause id="H52F6728BF4A64E6E978870F5164E6F98"><enum>(ii)</enum><text>was covered by the provisions of subchapter II of this chapter immediately before appointment to
			 the Senior Executive Service; and</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H04D04DFE381E46AB954CCDAEB7E225D1"><enum>(b)</enum><header>Modification of cause and procedure for suspension and termination</header>
				<paragraph id="H7CA9A1B7056E479490BFBFD792C70554"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/7543">Section 7543</external-xref> of title 5, United States Code, is amended—</text>
					<subparagraph id="H06B7971C6CD6448F9505C30291A8F480"><enum>(A)</enum><text>in subsection (a), by striking <quote>misconduct,</quote> and inserting <quote>such cause as would promote the efficiency of the service, misconduct,</quote>; and</text>
					</subparagraph><subparagraph id="H4E49383FF63E44469D0EB2C78F0AE373"><enum>(B)</enum><text>in subsection (b)(1), by striking <quote>30</quote> and inserting <quote>15</quote>.</text>
					</subparagraph></paragraph><paragraph id="HBE5D507243764A83A41CD709807C1796"><enum>(2)</enum><header>Conforming amendments</header><text display-inline="yes-display-inline">Subchapter V of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/35">chapter 35</external-xref> of title 5, United States Code, is amended—</text>
					<subparagraph id="HF9B0B3D8B8E344DC8FE9D57272FA6449"><enum>(A)</enum><text display-inline="yes-display-inline">in section 3593—</text>
						<clause id="HBC75162C43034BEDA4897EB80DFCEEF8"><enum>(i)</enum><text display-inline="yes-display-inline">in subsection (a)(2), by striking <quote>misconduct,</quote> and inserting <quote>such cause as would promote the efficiency of the service, misconduct,</quote>; and</text>
						</clause><clause id="H932F1A3FCDE44150AA08C88B65A0F508"><enum>(ii)</enum><text display-inline="yes-display-inline">in subsection (b), by striking <quote>misconduct,</quote> and inserting <quote>such cause as would promote the efficiency of the service, misconduct,</quote>; and</text>
						</clause></subparagraph><subparagraph id="H536800DCA3D749D1BDFE6AD0D3153070"><enum>(B)</enum><text display-inline="yes-display-inline">in section 3594(a), by striking <quote>misconduct,</quote> and inserting <quote>such cause as would promote the efficiency of the service, misconduct,</quote>.</text>
					</subparagraph></paragraph></subsection></section><section id="HEF75CD64612C44F591DE34415AECA9F0"><enum>7.</enum><header>Mandatory leave for career appointees in the Senior Executive Service</header>
			<subsection id="H23B42697BC0E4EC581389CD3D6EE6F65"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/63">chapter 63</external-xref> of title 5, United States Code, is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H63CAB95E36E44706BC6616517757C842" style="USC">
					<section id="H52528533BAEC49E684FF4584110BA601"><enum>6329.</enum><header>Mandatory leave for Senior Executive Service career appointees</header>
						<subsection id="HDB8F6DCC75D7406ABDBC6A99EA40A439"><enum>(a)</enum><text display-inline="yes-display-inline">In this section—</text>
							<paragraph id="HED8EB8072B1B47F6AE091500826B75BE"><enum>(1)</enum><text display-inline="yes-display-inline">the term <quote>employee</quote> means—</text>
								<subparagraph id="H6009F595CE3840F782DDBE5F26942173"><enum>(A)</enum><text>a career appointee in the Senior Executive Service who—</text>
									<clause id="H32464CBC530440DB9246CDFF8C881CF8"><enum>(i)</enum><text display-inline="yes-display-inline">has completed the probationary period prescribed under section 3393(d) of this title; or</text>
									</clause><clause id="HCC44BCABC630441E9BB9092C5ADE7975"><enum>(ii)</enum><text display-inline="yes-display-inline">was covered by the provisions of subchapter II of chapter 75 of this title immediately before
			 appointment to the Senior Executive Service; and</text>
									</clause></subparagraph><subparagraph id="HD2F66D497B0743B8BD4CFAC65D0F9F26"><enum>(B)</enum><text>who has received written notice of removal from the civil service under subchapter V of chapter 75
			 of this title; and</text>
								</subparagraph></paragraph><paragraph id="HEDF888DE78554FB9A5616D2D74078006"><enum>(2)</enum><text>the term <quote>mandatory leave</quote> means, with respect to an employee, an absence with pay but without duty during which such
			 employee—</text>
								<subparagraph id="HDF729D1EA7054B2BA067856C37E3DA28"><enum>(A)</enum><text>shall be charged accrued annual leave for the period of such absence; and</text>
								</subparagraph><subparagraph id="H0EEF11ACF04C4891841FEC8E6752F5FA"><enum>(B)</enum><text display-inline="yes-display-inline">may not accrue any annual leave under section 6303 for the period of such absence.</text>
								</subparagraph></paragraph></subsection><subsection id="H8F5B271F447A4A24A9913B0CD119E4A2"><enum>(b)</enum><text display-inline="yes-display-inline">Under regulations prescribed by the Office of Personnel Management, an agency may place an employee
			 on mandatory leave for misconduct, neglect of duty, malfeasance, or such
			 cause as would promote the efficiency of the service.</text>
						</subsection><subsection id="H1651BC61F85941AB87F47E972E88EEFE"><enum>(c)</enum><text>If an agency determines that an employee should be placed on mandatory leave under subsection (b),
			 such leave shall begin no earlier than the date on which the employee
			 received written notice of a removal under subchapter V of chapter 75.</text>
						</subsection><subsection id="HC662B6C9DBD74B99A6FC3615DCE896DC"><enum>(d)</enum><text>If a final order or decision is issued in favor of such employee with respect to removal under
			 subchapter V of chapter 75 by the agency, the Merit Systems Protection
			 Board, or the United States Court of Appeals for the Federal Circuit, any
			 annual leave that is charged to an employee by operation of this section
			 shall be restored to the applicable leave account of such employee.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H05024E1730D04713B7A39DEFFC60C14D"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/63">chapter 63</external-xref> of title 5, United States Code, is amended by adding after the
			 item relating to section 6328 the following new item:</text>
				<quoted-block display-inline="no-display-inline" id="HB7E59AAB6E5846B0892A6BC0F107FA33" style="USC">
					<toc regeneration="no-regeneration">
						<toc-entry level="section">6329. Mandatory leave for Senior Executive Service career appointees.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HD42140D39683485DA111DC96F5176954"><enum>(c)</enum><header>Regulations</header><text display-inline="yes-display-inline">Not later than 6 months after the date of enactment of this Act, the Director of the Office of
			 Personnel Management shall prescribe regulations with respect to the leave
			 provided by the amendment in subsection (a).</text>
