			<subsection id="HB0A014A70A12420CA3851D27F3A13E8A"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/229">Chapter 229</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text>

						<section id="H9C601025E020425E97C67B7F30B78194"><enum>3631.</enum><header>Definitions; eligible individuals</header>
							<subsection id="HF6431DD0F57C4F24B371E10D00D5BF72"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subchapter—</text>
								<paragraph id="H20DA73208D104733885ADBBB8EC8F6E5"><enum>(1)</enum><text>the term <term>covered nonviolent offense</term> means a Federal criminal offense that is not—</text>
									<subparagraph id="HFC5F31704F4A44E9B48BE398B229A611"><enum>(A)</enum><text>a crime of violence (as that term is defined in section 16); or</text>
									</subparagraph><subparagraph id="HA88D79D2A1B742DD9A22CEC29E9CE8EE"><enum>(B)</enum><text>a sex offense (as that term is defined in section 111 of the Sex Offender Registration and
			 Notification Act (<external-xref legal-doc="usc" parsable-cite="usc/42/16911">42 U.S.C. 16911</external-xref>));</text>
									</subparagraph></paragraph><paragraph id="HABB72697AD0A4D01A0CECFC761B568D0"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>eligible individual</term> means an individual who—</text>
									<subparagraph id="HC07D3DE44682409CB5A84E1F70AB961F"><enum>(A)</enum><text display-inline="yes-display-inline">has been arrested for or convicted of a covered nonviolent offense;</text>
									</subparagraph><subparagraph id="HA5B2D4654A4C40598F7CE6FD5ABD2FB2"><enum>(B)</enum><text>in the case of a conviction described in subparagraph (A), has fulfilled each requirement of the
			 sentence for the covered nonviolent offense, including—</text>
										<clause id="HCDE101EE25544B55B6F17616D6F498C9"><enum>(i)</enum><text>completing each term of imprisonment, probation, or supervised release; and</text>
										</clause><clause id="HAA8E7B84940943C688EBA6610437080F"><enum>(ii)</enum><text>satisfying each condition of imprisonment, probation, or supervised release;</text>
										</clause></subparagraph><subparagraph id="H1568A1D1DD7C4E31BDAF927F459972E0"><enum>(C)</enum><text>subject to subsection (b), has not been convicted of more than 2 felonies that are covered
			 nonviolent offenses, including any such convictions that have been sealed;
			 and</text>
									</subparagraph><subparagraph id="HEB66653F924F43C7A43686431831D334"><enum>(D)</enum><text>has not been convicted of any felony that is not a covered nonviolent offense;</text>
									</subparagraph></paragraph><paragraph id="H9011A896A1964EE88E9A5A54F48841B0"><enum>(3)</enum><text>the term <term>petitioner</term> means an individual who files a sealing petition;</text>
								</paragraph><paragraph id="HD9A5B3254A7A4C67B37BBB7246058E63"><enum>(4)</enum><text>the term <term>protected information</term>, with respect to a covered nonviolent offense, means any reference to—</text>
									<subparagraph id="HAB50AA2461A145BDB64A40AC044953BD"><enum>(A)</enum><text>an arrest, conviction, or sentence of an individual for the offense;</text>
									</subparagraph><subparagraph id="HDC8D198CE1FE4C9BA301C4FD56730A09"><enum>(B)</enum><text>the institution of criminal proceedings against an individual for the offense; or</text>
									</subparagraph><subparagraph id="HDB688D71808C423484CB42532F97F376"><enum>(C)</enum><text>the result of criminal proceedings described in subparagraph (B);</text>
									</subparagraph></paragraph><paragraph id="HBF6B04C2D2D449C5A3FF7AC392687DA6"><enum>(5)</enum><text display-inline="yes-display-inline">the term <term>seal</term>—</text>
									<subparagraph id="HAF4CFB9C419E45BBA6C9AD1B14EC363C"><enum>(A)</enum><text>means—</text>
										<clause id="H49620996324B4070B57B9BE505F9BF60"><enum>(i)</enum><text display-inline="yes-display-inline">to close a record from public viewing so that the record cannot be examined except by court order;
			 and</text>
										</clause><clause id="H9820FFBA842E4DBAA23095A0C6EA2424"><enum>(ii)</enum><text display-inline="yes-display-inline">to physically seal the record shut and label the record <quote>SEALED</quote> or, in the case of an electronic record, the substantive equivalent; and</text>
										</clause></subparagraph><subparagraph id="H4ABDE9F201C84006B62F536919B63F80"><enum>(B)</enum><text>has the effect described in section 3633, including—</text>
										<clause id="H25DC0E9FB3BA43F8B4AF5A17E8ACE038"><enum>(i)</enum><text>the right to treat the offense to which a sealed record relates, and any arrest, criminal
			 proceeding, conviction, or sentence relating to the offense, as if it
			 never occurred; and</text>
										</clause><clause id="HC4C4459366BF4446A5891DCB259DC890"><enum>(ii)</enum><text>protection from civil and criminal perjury, false swearing, and false statement laws with respect
			 to a sealed record;</text>
										</clause></subparagraph></paragraph><paragraph id="HDD28E019B8534BBEB2304E5A1A5AD119"><enum>(6)</enum><text>the term <term>sealing hearing</term> means a hearing held under section 3632(b)(2); and</text>
								</paragraph><paragraph id="HF2570DE289294A1DB9B09E027CB8E756"><enum>(7)</enum><text>the term <term>sealing petition</term> means a petition for a sealing order filed under section 3632(a).</text>
								</paragraph></subsection><subsection id="HDF197B81E0E041D9A87A654A2B49F3F7"><enum>(b)</enum><header>Eligible individuals</header>
								<paragraph id="H3A291A71FF464C6FBD934D3821E2BDAD"><enum>(1)</enum><header>Multiple convictions deemed to be one conviction</header><text>For purposes of subsection (a)(2)(C)—</text>
									<subparagraph id="HD47966494BDA444CB01190D742C20D38"><enum>(A)</enum><text>multiple convictions shall be deemed to be 1 conviction if the convictions result from or relate
			 to—</text>
										<clause id="H748B4BD5C90B4DA8BC09F89A59D1723D"><enum>(i)</enum><text>the same act; or</text>
										</clause><clause id="H027D9FDA9B404867809212C89BF3F317"><enum>(ii)</enum><text>acts committed at the same time; and</text>
										</clause></subparagraph><subparagraph id="H9C175225DFD64819AF15FD19CE1D2DA9"><enum>(B)</enum><text>subject to paragraph (2), multiple convictions, not to exceed 3, that do not result from or relate
			 to the same act or acts committed at the same time shall be deemed to be 1
			 conviction if the convictions—</text>
										<clause id="H4706AC7CA45C4C50B845BB523B3D18A1"><enum>(i)</enum><text>result from or relate to—</text>
											<subclause id="HD2CB7F876FD9425F80062C951FFCCA74"><enum>(I)</enum><text>the same—</text>
												<item id="H40818CAFD37448B9B06723546C943B8D"><enum>(aa)</enum><text>indictment, information, or complaint;</text>
												</item><item id="HC04A6723F4244FFA8B161693DB8F70FD"><enum>(bb)</enum><text>plea of guilty; or</text>
												</item><item id="H94A93196D2C6406C844EBFDB1C7AD883"><enum>(cc)</enum><text>official proceeding; or</text>
												</item></subclause><subclause id="H7D415ADC7A3C44199867F7777FA671D0"><enum>(II)</enum><text>related criminal acts that were committed within a 3-month period; or</text>
											</subclause></clause><clause id="H8A9640CB02DA4E7DB5262BDFE4A80A48"><enum>(ii)</enum><text>are determined to be directly related to addiction or a substance use disorder.</text>
										</clause></subparagraph></paragraph><paragraph id="H53BD91F7BD524341ADF47DEEC66E82A8"><enum>(2)</enum><header>Discretion of court</header>
									<subparagraph id="H1501F3F996404B80AC7CAD852DF91CDF"><enum>(A)</enum><header>In general</header><text>A court reviewing a sealing petition may determine that it is not in the public interest to deem
			 multiple convictions described in paragraph (1)(B) to be 1 conviction.</text>
									</subparagraph><subparagraph id="H2041633B6D9E449682F1ABC479DDED44"><enum>(B)</enum><header>Reasoning</header><text>If a court makes a determination under subparagraph (A), the court shall make available to the
			 public the reasoning for the determination.</text>
									</subparagraph><subparagraph id="HE99DED9DF34D490DB68EA0270697890C"><enum>(C)</enum><header>Reporting</header><text>Not later than 2 years after the date of enactment of this subchapter, and each year thereafter,
			 each district court of the United States shall submit to the Attorney
			 General a report that describes the exercise of discretion by the court
			 under subparagraph (B).</text>
									</subparagraph></paragraph></subsection></section><section id="HCEF66F9C501D4569895B1937802B5396"><enum>3632.</enum><header>Sealing petition</header>
							<subsection id="H0F692223BBD84FB1BBC83E7023D8F66D"><enum>(a)</enum><header>Right To file sealing petition</header>
								<paragraph id="H6D24B2092D824F3D88CB75BF4833C4B5"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">On and after the date described in paragraph (2), an eligible individual may file a petition for a
			 sealing order with respect to a covered nonviolent offense in a district
			 court of the United States.</text>
								</paragraph><paragraph id="HC254E8D3AD864B3CAE067F5227656E89"><enum>(2)</enum><header>Dates</header><text>The date described in this paragraph is—</text>
									<subparagraph id="H1BA8AAA2CC51457E817B4D613AF296BC"><enum>(A)</enum><text>for an eligible individual who is convicted of a covered nonviolent offense and sentenced to a term
			 of imprisonment, probation, or supervised release, the date that is 1 year
			 after the date on which the eligible individual has completed every such
			 term of imprisonment, probation, or supervised release; and</text>
									</subparagraph><subparagraph id="HDD54D8B32C78476FA3885542D3F6424A"><enum>(B)</enum><text>for an eligible individual not described in subparagraph (A), the date on which the case relating
			 to the covered nonviolent offense is disposed of.</text>
									</subparagraph></paragraph><paragraph id="H42E918A80F794857987BE7A418312424"><enum>(3)</enum><header>Notice of opportunity to file petition</header>
									<subparagraph id="H76F8FCD27AB74D148407A646C2DE90F5"><enum>(A)</enum><header>Convicted individuals</header>
										<clause id="HB3A8DC468F014AE183D3BF6C1A6A21E0"><enum>(i)</enum><header>In general</header><text>If an individual is convicted of a covered nonviolent offense and will potentially be eligible to
			 file a sealing petition with respect to the offense upon fulfilling each
			 requirement of the sentence for the offense as described in section
			 3631(a)(2)(B), the court in which the individual is convicted shall inform
			 the individual, on each date described in clause (ii), of—</text>
											<subclause id="HA6D3C1A2D64A46748903F40FE0EAC08A"><enum>(I)</enum><text>that potential eligibility;</text>
											</subclause><subclause id="H267D0F1F61994A0D9B639E17F913873F"><enum>(II)</enum><text>the necessary procedures for filing the sealing petition; and</text>
											</subclause><subclause id="H09177B3D54C44555901882F5C84B74EB"><enum>(III)</enum><text>the benefits of sealing a record, including protection from civil and criminal perjury, false
			 swearing, and false statement laws with respect to the record.</text>
											</subclause></clause><clause id="HB7ACA95A1D06440FAB2D0BD81202D088"><enum>(ii)</enum><header>Dates</header><text>The dates described in this clause are—</text>
											<subclause id="H8EE7479BE6414B788448B5F8F052DECC"><enum>(I)</enum><text>the date on which the individual is convicted; and</text>
											</subclause><subclause id="H5546AC42FF8D4022832C144EEB67214B"><enum>(II)</enum><text>the date on which the individual has completed every term of imprisonment, probation, or supervised
			 release relating to the offense.</text>
											</subclause></clause></subparagraph><subparagraph id="H6FAD654A6740478494DBC880E1957BD4"><enum>(B)</enum><header>Individuals not convicted</header>
										<clause id="H795B9C7E3800427A989EAC258065B939"><enum>(i)</enum><header>Arrest only</header><text>If an individual is arrested for a covered nonviolent offense, criminal proceedings are not
			 instituted against the individual for the offense, and the individual is
			 potentially eligible to file a sealing petition with respect to the
			 offense, on the date on which the case relating to the offense is disposed
			 of, the arresting authority shall inform the individual of—</text>
											<subclause id="H2ADF35762CD1493FA08AFFAD5FBB3825"><enum>(I)</enum><text>that potential eligibility;</text>
											</subclause><subclause id="HAB8F5A41EC5140E2837357D9C94A32DC"><enum>(II)</enum><text>the necessary procedures for filing the sealing petition; and</text>
											</subclause><subclause id="H4D92FBE8F5D1497BB7DD755EFA4D6415"><enum>(III)</enum><text>the benefits of sealing a record, including protection from civil and criminal perjury, false
			 swearing, and false statement laws with respect to the record.</text>
											</subclause></clause><clause id="HB9409BED223E43B68A66016F3E8ACFA0"><enum>(ii)</enum><header>Court proceedings</header><text>If an individual is arrested for a covered nonviolent offense, criminal proceedings are instituted
			 against the individual for the offense, the individual is not convicted of
			 the offense, and the individual is potentially eligible to file a sealing
			 petition with respect to the offense, on the date on which the case
			 relating to the offense is disposed of, the court in which the criminal
			 proceedings take place shall inform the individual of—</text>
											<subclause id="HA337C879FAF14E208C766DD37FC2025C"><enum>(I)</enum><text>that potential eligibility;</text>
											</subclause><subclause id="H1BD3B936B5FE47A7A83A43DC75A320F8"><enum>(II)</enum><text>the necessary procedures for filing the sealing petition; and</text>
											</subclause><subclause id="H6D72410A089A4B72876CBEE6C9657BFA"><enum>(III)</enum><text>the benefits of sealing a record, including protection from civil and criminal perjury, false
			 swearing, and false statement laws with respect to the record.</text>
											</subclause></clause></subparagraph></paragraph></subsection><subsection id="HE63D0242C3EA4934BE6231313FFC9E9D"><enum>(b)</enum><header>Procedures</header>
								<paragraph id="H76780052A866489AB63A06C1947CFD38"><enum>(1)</enum><header>Notification of prosecutor and victims</header><text display-inline="yes-display-inline">If an individual files a petition under subsection (a) with respect to a covered nonviolent offense
			 or arrest for a covered nonviolent offense, the district court in which
			 the petition is filed shall provide notice of the petition—</text>
									<subparagraph id="H52A4CDDA50C848C7AF8DE40BB6BA43C7"><enum>(A)</enum><text display-inline="yes-display-inline">to the office of the United States attorney that prosecuted or would have prosecuted the petitioner
			 for the offense;</text>
									</subparagraph><subparagraph id="HC1E7C55ADB7F484EB51F3B275C34DC0D"><enum>(B)</enum><text display-inline="yes-display-inline">to the extent reasonable and practicable, to each victim of the offense; and</text>
									</subparagraph><subparagraph id="H07ADEE4118354C61A01ADA464491802C"><enum>(C)</enum><text>upon the request of the petitioner, to any other individual that the petitioner determines may
			 testify as to the—</text>
										<clause id="H890E3A392C87460181FD7B6051D3A8C5"><enum>(i)</enum><text>conduct of the petitioner since the date of the offense or arrest; or</text>
										</clause><clause id="H4528ABA076F040928DE0588986AA329D"><enum>(ii)</enum><text>reasons that the sealing order should be entered.</text>
										</clause></subparagraph></paragraph><paragraph id="HE9D055968C4B4CCEBFBB2EFACC220F4E"><enum>(2)</enum><header>Hearing</header>
									<subparagraph id="HB53E40B0B1A54136A539F622DB5BD988"><enum>(A)</enum><header>In general</header><text>Not later than 6 months after the date on which an individual files a sealing petition, the
			 district court shall conduct a hearing to determine whether to enter a
			 sealing order for the individual.</text>
									</subparagraph><subparagraph id="H06EEF7C277304AF982DAD37B30A9D410"><enum>(B)</enum><header>Opportunity to testify and offer evidence</header>
										<clause id="H6318B1B1155A470EA914264A1FB844DE"><enum>(i)</enum><header>Petitioner</header><text>The petitioner may testify or offer evidence at the sealing hearing in support of sealing.</text>
										</clause><clause id="H8A4731ADDF9E4058AC45CC4FE2F80D6E"><enum>(ii)</enum><header>Prosecutor</header><text display-inline="yes-display-inline">The office of a United States attorney that receives notice under paragraph (1)(A) may send a
			 representative to testify or offer evidence at the sealing hearing in
			 support of or against sealing.</text>
										</clause><clause id="H89473C63B09F47CFBC62E9FC2689AF87"><enum>(iii)</enum><header>Victims</header>
											<subclause id="H5D9060D019344CD0965ADCDFE2CC61BA"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">A victim who receives notice under paragraph (1)(B) may testify or offer evidence at the sealing
			 hearing in support of or against sealing.</text>
											</subclause><subclause id="H4127CD62D76D40F493DB89DFF3926D1A"><enum>(II)</enum><header>Locating victims</header><text>The inability of a court to locate a victim shall not—</text>
												<item id="H50575A469B494D868B8CA70B4EC05995"><enum>(aa)</enum><text>delay a proceeding under this section;</text>
												</item><item id="H6E5741F4DAF84AA08B041BFD0F5B69DD"><enum>(bb)</enum><text>preclude the holding of a sealing hearing; or</text>
												</item><item id="H0E133C645B4C41C2A971A1B30D4C10F5"><enum>(cc)</enum><text>impact the issuance of a sealing order.</text>
												</item></subclause></clause><clause id="HBA46692793FC435EBD33594D33368CA1"><enum>(iv)</enum><header>Other individuals</header><text display-inline="yes-display-inline">An individual who receives notice under paragraph (1)(C) may testify or offer evidence at the
			 sealing hearing as to the issues described in clauses (i) and (ii) of that
			 paragraph.</text>
										</clause></subparagraph><subparagraph id="H6D21C2E169AF4450BC4592C68FAD233B"><enum>(C)</enum><header>Magistrate judges</header><text>A magistrate judge may preside over a hearing under this paragraph.</text>
									</subparagraph></paragraph><paragraph id="HD70F422B34264D4C8D7B13A9E1BC20CA"><enum>(3)</enum><header>Basis for decision</header>
									<subparagraph commented="no" id="HA61B125E6E824BEBB24228240ADEEF04"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">In determining whether to enter an sealing order with respect to protected information relating to
			 a covered nonviolent offense, the court—</text>
										<clause commented="no" id="HF8738CBB09C44FB6B9D69EBCF43CA931"><enum>(i)</enum><text display-inline="yes-display-inline">shall consider all the evidence and testimony presented at the sealing hearing;</text>
										</clause><clause commented="no" id="HABB392A17DE64B5AA37E07F237EB6CAD"><enum>(ii)</enum><text>may not consider any non-Federal nonviolent crimes for which the petitioner has been arrested or
			 proceeded against, or of which the petitioner has been convicted; and</text>
										</clause><clause commented="no" id="HEB898C6B9EC6438F82D811FB49F605BE"><enum>(iii)</enum><text display-inline="yes-display-inline">shall balance—</text>
											<subclause commented="no" id="H3D1DE7497055425C8410FB0AB3D3C2A6"><enum>(I)</enum>
												<item commented="no" display-inline="yes-display-inline" id="H244548286FE64AA48ADEE55B2F30E194"><enum>(aa)</enum><text display-inline="yes-display-inline">the interest of public knowledge and safety; and</text>
												</item><item commented="no" id="H6FCD2A81503B41A391D47A1D781C40AB" indent="up1"><enum>(bb)</enum><text display-inline="yes-display-inline">the legitimate interest, if any, of the Government in maintaining the accessibility of the
			 protected information, including any potential impact of sealing the
			 protected information on Federal licensure, permit, or employment
			 restrictions; against</text>
												</item></subclause><subclause commented="no" id="H44F8CE355DA547258A682E2C2D05C53D"><enum>(II)</enum>
												<item commented="no" display-inline="yes-display-inline" id="H343F545A36A245D5B89C22E509B48B7D"><enum>(aa)</enum><text display-inline="yes-display-inline">the conduct and demonstrated desire of the petitioner to be rehabilitated and positively contribute
			 to the community; and</text>
												</item><item commented="no" id="HFCB63D712F3B4F419C32728584587478" indent="up1"><enum>(bb)</enum><text display-inline="yes-display-inline">the interest of the petitioner in having the protected information sealed, including the harm of
			 the protected information to the ability of the petitioner to secure and
			 maintain employment.</text>
												</item></subclause></clause></subparagraph><subparagraph commented="no" id="H2FE0C36971F64C56878BA9E4CD14CDB0"><enum>(B)</enum><header>Burden on Government</header><text>The burden shall be on the Government to show that the interests under subclause (I) of
			 subparagraph (A)(iii) outweigh the interests of the petitioner under
			 subclause (II) of that subparagraph.</text>
									</subparagraph></paragraph><paragraph id="H45406DEA58104E5A954C9C37DCFAE7C1"><enum>(4)</enum><header>Waiting period after denial</header><text display-inline="yes-display-inline">If the district court denies a sealing petition, the petitioner may not file a new sealing petition
			 with respect to the same offense until the date that is 2 years after the
			 date of the denial.</text>
								</paragraph><paragraph id="H5C042672CD954A90836D4BFC59A8D046"><enum>(5)</enum><header>Universal form</header><text>The Attorney General shall create a universal form, available over the Internet and in paper form,
			 that an individual may use to file a sealing petition.</text>
								</paragraph><paragraph id="HF71BE8C1EB3243929F768ADC9E62EB56"><enum>(6)</enum><header>Fee waiver</header><text>The Attorney General shall by regulation establish a process under which indigent petitioners may
			 obtain a waiver of any fee for filing a sealing petition.</text>
								</paragraph><paragraph id="H8070FFB55902483499670FDEDF03DE8B"><enum>(7)</enum><header>Reporting</header><text>Not later than 2 years after the date of enactment of this subchapter, and each year thereafter,
			 each district court of the United States shall issue a public report that—</text>
									<subparagraph id="HEE0152DF630E45ECB0905A2B7A747AA7"><enum>(A)</enum><text>describes—</text>
										<clause id="H816E8AFE046140919F2B216CFD42A3B5"><enum>(i)</enum><text>the number of sealing petitions granted and denied under this section; and</text>
										</clause><clause id="H3357F46DF11140D49768B7D63197B065"><enum>(ii)</enum><text>the number of instances in which the office of a United States attorney supported or opposed a
			 sealing petition; and</text>
										</clause></subparagraph><subparagraph id="H03496AC227DC46859452EB1EBB38DEA2"><enum>(B)</enum><text>includes any supporting data that the court determines relevant and that does not name any
			 petitioner.</text>
									</subparagraph></paragraph><paragraph id="HFBA1F3FB91924F3EB441CF2C985A3809"><enum>(8)</enum><header>Public defender eligibility</header>
									<subparagraph id="H632A5BFD5982472DB6D0C46545F2C4C6"><enum>(A)</enum><header>In general</header><text>The district court may, in its discretion, appoint counsel in accordance with the plan of the
			 district court in operation under section 3006A to represent a petitioner
			 for purposes of this section.</text>
									</subparagraph><subparagraph id="H7722A829D4B740D7950FAF5749EF8338"><enum>(B)</enum><header>Considerations</header><text>In making a determination whether to appoint counsel under subparagraph (A), the court shall
			 consider—</text>
										<clause id="HC11AD31A7D084291895EB4602FA1B7CF"><enum>(i)</enum><text>the anticipated complexity of the sealing hearing, including the number and type of witnesses
			 called to advocate against the sealing of the protected information of the
			 petitioner; and</text>
										</clause><clause id="H89AC56F95EC545EF8E2513C55663FB71"><enum>(ii)</enum><text>the potential for adverse testimony by a victim or a representative of the office of the United
			 States attorney.</text>
										</clause></subparagraph></paragraph></subsection></section><section id="H457F4F75A10D41C3B52F497E29EE7D37"><enum>3633.</enum><header>Effect of sealing order</header>
							<subsection id="H536B239F7ABC4F03831EABDB6C58930A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in this section, if a district court of the United States enters a sealing order
			 with respect to a covered nonviolent offense, the offense and any arrest,
			 criminal proceeding, conviction, or sentence relating to the offense shall
			 be treated as if it never occurred.</text>
							</subsection><subsection id="HBE0E6205E8E042CB93F519316E12D8D1"><enum>(b)</enum><header>Verification of sealing</header><text>If a district court of the United States enters a sealing order with respect to a covered
			 nonviolent offense, the court shall—</text>
								<paragraph id="H9A8C4AC517614D71B551DC386BF61336"><enum>(1)</enum><text display-inline="yes-display-inline">send a copy of the sealing order to each entity or person that possesses a record containing
			 protected information that relates to the offense, including each law
			 enforcement agency, each public or private correctional, detention, or
			 treatment facility, each other public or private agency, and each person
			 who provided treatment or rehabilitation services for the petitioner under
			 an order of the court;</text>
								</paragraph><paragraph id="H65B377D8BB2441A3933D7E73BB5C06B6"><enum>(2)</enum><text>in the sealing order, require each entity or person described in paragraph (1) to—</text>
									<subparagraph id="HC89A70EFAE234C81A7FA5D97A649C2D0"><enum>(A)</enum><text display-inline="yes-display-inline">seal the record in accordance with this section; and</text>
									</subparagraph><subparagraph id="H5BDD4B159F8A4283A4DCDF76F1564D38"><enum>(B)</enum><text>submit a written certification to the court, under penalty of perjury, that the entity or person
			 has sealed each paper and electronic copy of the record;</text>
									</subparagraph></paragraph><paragraph id="H92D69A9263DA4817A05C86894FE14D81"><enum>(3)</enum><text>seal each paper and electronic copy of the record in the possession of the court; and</text>
								</paragraph><paragraph id="H788307E20E5243F68C8779DBF30485F5"><enum>(4)</enum><text>after receiving a written certification from each entity or person under paragraph (2)(B), notify
			 the petitioner that each entity or person described in paragraph (1) has
			 sealed each paper and electronic copy of the record.</text>
								</paragraph></subsection><subsection id="H44504E3B5A2B4FFEB3D8BAAA356F06FA"><enum>(c)</enum><header>Protection from perjury laws</header><text>Except as provided in subsection (f)(3)(A), a petitioner with respect to whom a sealing order has
			 been entered for a covered nonviolent offense shall not be subject to
			 prosecution under any civil or criminal provision of Federal or State law
			 relating to perjury, false swearing, or making a false statement,
			 including section 1001, 1621, 1622, or 1623, for failing to recite or
			 acknowledge any protected information with respect to the offense or
			 respond to any inquiry made of the petitioner, relating to the protected
			 information, for any purpose.</text>
							</subsection><subsection id="H52A4B54401584D2392BBF893C36049D5"><enum>(d)</enum><header>Attorney General nonpublic records</header><text display-inline="yes-display-inline">The Attorney General—</text>
								<paragraph id="HF5FCB2C3F773493089ACD27C490119AE"><enum>(1)</enum><text display-inline="yes-display-inline">shall maintain a nonpublic record of all protected information that has been sealed under this
			 subchapter; and</text>
								</paragraph><paragraph id="H2909B99A33B14B909FE0273E7FC4AF14"><enum>(2)</enum><text display-inline="yes-display-inline">may access or utilize protected information only—</text>
									<subparagraph id="HF28E216F9F784DFE87EC27ECE59CDE1A"><enum>(A)</enum><text display-inline="yes-display-inline">for legitimate investigative purposes;</text>
									</subparagraph><subparagraph id="H1E5F31572E8A4BAFB342E4F895025F6C"><enum>(B)</enum><text display-inline="yes-display-inline">in defense of any civil suit arising out of the facts of the arrest or subsequent proceedings; or</text>
									</subparagraph><subparagraph id="HF903C0CC1E6D4560A97600CCDD998FEC"><enum>(C)</enum><text display-inline="yes-display-inline">if the Attorney General determines that disclosure is necessary to serve the interests of justice,
			 public safety, or national security.</text>
									</subparagraph></paragraph></subsection><subsection id="HAE8DBEC72F4C47D6B9CB923E969DD226"><enum>(e)</enum><header>Law enforcement access</header><text>A Federal or State law enforcement agency may access a record that is sealed under this subchapter
			 solely—</text>
								<paragraph id="H174B441517B04E20841E055CDC023233"><enum>(1)</enum><text>to determine whether the individual to whom the record relates is eligible for a
			 first-time-offender diversion program;</text>
								</paragraph><paragraph commented="no" id="HE4644C1454C64D838D7030A2F0A9CA1B"><enum>(2)</enum><text>for investigatory or prosecutorial purposes; or</text>
								</paragraph><paragraph id="H6C7AD6469B7D46BC9D9309E33FF4D0B8"><enum>(3)</enum><text>for a background check that relates to law enforcement employment or any employment that requires a
			 government security clearance.</text>
								</paragraph></subsection><subsection id="H57B2DE7A1EF8474CAF824EBFCE6E970E"><enum>(f)</enum><header>Prohibition on disclosure</header>
								<paragraph id="H7DA54AA276C047E78C456B219981A3B1"><enum>(1)</enum><header>Prohibition</header><text>Except as provided in paragraph (3), it shall be unlawful to intentionally make or attempt to make
			 an unauthorized disclosure of any protected information from a record that
			 has been sealed under this subchapter.</text>
								</paragraph><paragraph id="H36100F0629904B59B346CB7B9EF9D6FA"><enum>(2)</enum><header>Penalty</header><text>Any person who violates paragraph (1) shall be fined under this title, imprisoned for not more than
			 1 year, or both.</text>
								</paragraph><paragraph id="H403C080F659A44118979DB67E16AC514"><enum>(3)</enum><header>Exceptions</header>
									<subparagraph id="HEC7B64B006C543ECBEDC326810549693"><enum>(A)</enum><header>Background checks</header><text>An individual who is the subject of a record sealed under this subchapter shall, and a Federal or
			 State law enforcement agency that possesses such a record may, disclose
			 the record in the case of a background check for—</text>
										<clause id="HA94079F153764E798B13E463ED00CFE9"><enum>(i)</enum><text>law enforcement employment; or</text>
										</clause><clause id="H67984164031C43B1B48445EB62581156"><enum>(ii)</enum><text>any employment that requires a government security clearance.</text>
										</clause></subparagraph><subparagraph id="HE376955EC9C5400BBB154FE4691BE4E3"><enum>(B)</enum><header>Disclosure to Armed Forces</header><text>A person may disclose protected information from a record sealed under this subchapter to the
			 Secretaries of the military departments (or the Secretary of Homeland
			 Security with respect to the Coast Guard when it is not operating as a
			 service in the Navy) for the purpose of vetting an enlistment or
			 commission, or with regard to any member of the Armed Forces.</text>
									</subparagraph><subparagraph id="H63E8478EE41E414783F4BC9D8DD2C63E"><enum>(C)</enum><header>Authorization for individual to disclose own record</header><text>An individual who is the subject of a record sealed under this subchapter may choose to disclose
			 the record.</text></subparagraph></paragraph></subsection></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H2F4403539CAF4E14AFF8B1F55BFB6B52"><enum>(b)</enum><header>Applicability</header><text>The right to file a sealing petition under <external-xref legal-doc="usc" parsable-cite="usc/18/3632">section 3632(a)</external-xref> of title 18, United States Code, as
			 added by subsection (a), shall apply with respect to a covered nonviolent
			 offense (as defined in section 3631(a) of such title) that is committed
			 before, on, or after the date of enactment of this Act.</text>
			</subsection><subsection id="HBD406B8528CC4357925ECE061BBB11DE"><enum>(c)</enum><header>Transition period for hearings deadline</header><text>During the 1-year period beginning on the date of enactment of this Act, section 3632(b)(2)(A) of
			 title 18, United States Code, as added by subsection (a), shall be applied
			 by substituting <quote>1 year</quote> for <quote>6 months</quote>.</text>
			</subsection><subsection id="H2A390001F18744008801DD51EC9D7152"><enum>(d)</enum><header>Technical and conforming amendment</header><text>The table of subchapters for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/229">chapter 229</external-xref> of title 18, United States Code, is amended by adding at
			 the end the following:</text>

			</subsection></section><section id="H382BC115B588424287CACDF7FFF10BEA"><enum>3.</enum><header>Juvenile sealing and expungement</header>
			<subsection id="H711DD75577F94B8E942C3D812C810777"><enum>(a)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of this section is to—</text>
				<paragraph id="H498231FCCFED44BA8286C998A7FDC24A"><enum>(1)</enum><text>protect children and adults against damage stemming from their juvenile acts and subsequent
			 juvenile delinquency records, including law enforcement, arrest, and court
			 records; and</text>
				</paragraph><paragraph id="HD2CB117C19D64A8086D2EF9AFD9E2DA6"><enum>(2)</enum><text>prevent the unauthorized use or disclosure of confidential juvenile delinquency records and any
			 potential employment, financial, psychological, or other harm that would
			 result from such unauthorized use or disclosure.</text>
				</paragraph></subsection><subsection id="H43325BBAF6F142B5AD139F0030B95A3F"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/5031">Section 5031</external-xref> of title 18, United States Code, is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="HE733704C4D5C42AB9ADC4819D12D0CB5" style="USC">
					<section id="H521BFC07240B44CE984F53D0E4FFA944"><enum>5031.</enum><header>Definitions</header><text display-inline="no-display-inline">In this chapter—</text>
						<paragraph id="HD150A5BCEC7F403D8492B934EDA2D9C3"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>adjudication</term> means a determination by a judge that a person committed an act of juvenile delinquency;</text>
						</paragraph><paragraph id="HB568D5E549FA4EC7B411FD7700A0A280"><enum>(2)</enum><text>the term <term>conviction</term> means a judgment or disposition in criminal court against a person following a finding of guilt by
			 a judge or jury;</text>
						</paragraph><paragraph id="HB271B419A24C476FB0D4FF512F7B3079"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>destroy</term> means to render a file unreadable, whether paper, electronic, or otherwise stored, by shredding,
			 pulverizing, pulping, incinerating, overwriting, reformatting the media,
			 or other means;</text>
						</paragraph><paragraph id="HDD298DAE96614FFAB543E579130EFFC2"><enum>(4)</enum><text display-inline="yes-display-inline">the term <term>expunge</term>—</text>
							<subparagraph id="H6FB9AB71587E4AF4A9162F71337AD02C"><enum>(A)</enum><text display-inline="yes-display-inline">means to destroy a record and obliterate the name of the person to whom the record pertains from
			 each official index or public record; and</text>
							</subparagraph><subparagraph id="H60556792417E4B2D854E24003C6BF27B"><enum>(B)</enum><text>has the effect described in section 5044(c), including—</text>
								<clause id="H00CD5D957BA84BC38F1E9699CC0B8293"><enum>(i)</enum><text>the right to treat an offense to which an expunged record relates, and any arrest, juvenile
			 delinquency proceeding, adjudication, or other result of such proceeding
			 relating to the offense, as if it never occurred; and</text>
								</clause><clause id="H411869B925374DE58E83A3155216CA54"><enum>(ii)</enum><text>protection from civil and criminal perjury, false swearing, and false statement laws with respect
			 to an expunged record;</text>
								</clause></subparagraph></paragraph><paragraph id="H984E797C462C4E55B452FB75FD95FA6F"><enum>(5)</enum><text>the term <term>expungement hearing</term> means a hearing held under section 5044(b)(2)(B);</text>
						</paragraph><paragraph id="H25A771DDA2864E088B92D1C25650B836"><enum>(6)</enum><text>the term <term>expungement petition</term> means a petition for expungement filed under section 5044(b);</text>
						</paragraph><paragraph id="HFA4E5AF4387F4D37BBA08C5DF8823212"><enum>(7)</enum><text display-inline="yes-display-inline">the term <term>juvenile</term> means—</text>
							<subparagraph id="HA20E6B86D63B41B9BBC118CD6D95F1C4"><enum>(A)</enum><text display-inline="yes-display-inline">except as provided in subparagraph (B), a person who has not attained the age of 18; and</text>
							</subparagraph><subparagraph id="HF0875FAEB9DA49C4993A370F0071441E"><enum>(B)</enum><text display-inline="yes-display-inline">for the purpose of proceedings and disposition under this chapter for an alleged act of juvenile
			 delinquency, a person who has not attained the age of 21;</text>
							</subparagraph></paragraph><paragraph id="HE448DDC034964C9F9417630460167B1A"><enum>(8)</enum><text display-inline="yes-display-inline">the term <term>juvenile delinquency</term> means the violation of a law of the United States committed by a person before attaining the age
			 of 18 which would have been a crime if committed by an adult, or a
			 violation by such a person of section 922(x);</text>
						</paragraph><paragraph id="H8E181B55084F42BDB8314D32B8649303"><enum>(9)</enum><text>the term <term>juvenile nonviolent offense</term> means an act of juvenile delinquency that is not—</text>
							<subparagraph id="H04ED666FBBCC44D5AEC4BAF436C9FE57"><enum>(A)</enum><text>a violent crime (as defined in section 103 of the Juvenile Justice and Delinquency Prevention Act
			 of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5603">42 U.S.C. 5603</external-xref>)); or</text>
							</subparagraph><subparagraph id="HE8DB683F23EA43FD8715060F807E42AF"><enum>(B)</enum><text>a sex offense (as that term is defined in section 111 of the Sex Offender Registration and
			 Notification Act (<external-xref legal-doc="usc" parsable-cite="usc/42/16911">42 U.S.C. 16911</external-xref>));</text>
							</subparagraph></paragraph><paragraph id="H71B6ADB174B5473FB6005E978F638300"><enum>(10)</enum><text display-inline="yes-display-inline">the term <term>juvenile record</term>—</text>
							<subparagraph id="HEF853B093D9E446DA8151529FD958A9C"><enum>(A)</enum><text display-inline="yes-display-inline">means a record maintained by a court, the probation system, a law enforcement agency, or any other
			 government agency, of the juvenile delinquency proceedings of a person;
			 and</text>
							</subparagraph><subparagraph id="H9E6395CB1B254710B12C07E865291878"><enum>(B)</enum><text display-inline="yes-display-inline">includes—</text>
								<clause commented="no" id="H137FEFED08CE4494A7536BF8BB1AB996"><enum>(i)</enum><text>a juvenile legal file, including a formal document such as a petition, notice, motion, legal
			 memorandum, order, or decree;</text>
								</clause><clause commented="no" id="H567309047B4346A58311E375797002FE"><enum>(ii)</enum><text>a social record, including—</text>
									<subclause commented="no" id="H12E824C80B3A4E41BD6006D026939EAC"><enum>(I)</enum><text>a record of a probation officer;</text>
									</subclause><subclause commented="no" id="H6EB2B999743242728A0788BC0B6D9A53"><enum>(II)</enum><text>a record of any government agency that keeps records relating to juvenile delinquency;</text>
									</subclause><subclause commented="no" id="HE95B020627CD40E59EF2F36779DAFE46"><enum>(III)</enum><text>a medical record;</text>
									</subclause><subclause commented="no" id="HE46CC16D5B6146EBA3869734982479F1"><enum>(IV)</enum><text>a psychiatric or psychological record;</text>
									</subclause><subclause commented="no" id="H3855C6265D574AB88101FB6B2AC52BE2"><enum>(V)</enum><text>a birth certificate;</text>
									</subclause><subclause commented="no" id="HADE5C8936A9249A7A231B5937F424462"><enum>(VI)</enum><text>an education record, including an individualized education plan;</text>
									</subclause><subclause commented="no" id="H7864961E4D544AD8BCDBB6D11D713959"><enum>(VII)</enum><text>a detention record;</text>
									</subclause><subclause commented="no" id="H99EBA0439C7543B7847B673596BDE0C9"><enum>(VIII)</enum><text>demographic information that identifies a juvenile or the family of a juvenile; or</text>
									</subclause><subclause commented="no" id="H39B6D053D8B648F78598FF79678583BE"><enum>(IX)</enum><text>any other record that includes personally identifiable information that may be associated with a
			 juvenile delinquency proceeding, an act of juvenile delinquency, or an
			 alleged act of juvenile delinquency;</text>
									</subclause></clause><clause commented="no" id="H97216CD3C90F423DBF068B6F0E0E415F"><enum>(iii)</enum><text>a law enforcement record, including—</text>
									<subclause commented="no" id="H44DBE87C15E2414D9334B06F74F555A5"><enum>(I)</enum><text>fingerprints;</text>
									</subclause><subclause commented="no" id="HE725652DD8DD4556B28880D0871C5CF2"><enum>(II)</enum><text>a DNA sample; or</text>
									</subclause><subclause commented="no" id="H6D9DFFB552224A51AF2DA690665F2415"><enum>(III)</enum><text>a photograph; and</text>
									</subclause></clause><clause commented="no" id="H98A1803FD7B346828F225E9499060CAD"><enum>(iv)</enum><text>a State criminal justice information system record;</text>
								</clause></subparagraph></paragraph><paragraph id="H330D560C9DDB4690913CAB6A410EDE3F"><enum>(11)</enum><text>the term <term>petitioner</term> means a person who files an expungement petition or a sealing petition;</text>
						</paragraph><paragraph id="H50D7EE103E84445D98A78772C592CDB8"><enum>(12)</enum><text display-inline="yes-display-inline">the term <term>seal</term>—</text>
							<subparagraph id="H49D26F3E244E496696F411DC9553BA73"><enum>(A)</enum><text>means—</text>
								<clause id="H8F1A0EC579ED4F7AAB555994B785F673"><enum>(i)</enum><text display-inline="yes-display-inline">to close a record from public viewing so that the record cannot be examined except by court order;
			 and</text>
								</clause><clause id="H9E3445DC190B46B5BF5438126C3B4EF3"><enum>(ii)</enum><text display-inline="yes-display-inline">to physically seal the record shut and label the record <quote>SEALED</quote> or, in the case of an electronic record, the substantive equivalent; and</text>
								</clause></subparagraph><subparagraph id="H9577008FB89C423F9D062A76602E3833"><enum>(B)</enum><text>has the effect described in section 5043(c), including—</text>
								<clause id="HCDF3CF78CADD4B48BCDD0BBF30D6BD50"><enum>(i)</enum><text>the right to treat an offense to which a sealed record relates, and any arrest, juvenile
			 delinquency proceeding, adjudication, or other result of such proceeding
			 relating to the offense, as if it never occurred; and</text>
								</clause><clause id="HEAE097B1A2D5485AB66CC38F0379CF49"><enum>(ii)</enum><text>protection from civil and criminal perjury, false swearing, and false statement laws with respect
			 to a sealed record;</text>
								</clause></subparagraph></paragraph><paragraph id="H5153F972D9364F3783E7A2E4360541F0"><enum>(13)</enum><text>the term <term>sealing hearing</term> means a hearing held under section 3632(b)(2)(A); and</text>
						</paragraph><paragraph id="HAA4C7A5E8E3A4B9483C08A2E43710648"><enum>(14)</enum><text>the term <term>sealing petition</term> means a petition for a sealing order filed under section 5043(b).</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" id="H549CE39DB73043F3B5DDD89F3961877B"><enum>(c)</enum><header>Confidentiality</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/5038">Section 5038</external-xref> of title 18, United States Code, is amended—</text>
				<paragraph commented="no" id="H0F139BFC192944D8956757E570214C90"><enum>(1)</enum><text>in subsection (a), in the flush text following paragraph (6), by inserting after <quote>bonding,</quote> the following: <quote>participation in an educational system,</quote>; and</text>
				</paragraph><paragraph commented="no" id="H321A1B71FEEC46BF8C202E4DAA3EAB99"><enum>(2)</enum><text>in subsection (b), by striking <quote>District courts exercising jurisdiction over any juvenile</quote> and inserting the following: <quote>Not later than 7 days after the date on which a district court exercises jurisdiction over a
			 juvenile, the district court</quote>.</text>
				</paragraph></subsection><subsection commented="no" id="H32CB2BB88D104D448B6B4AF8CDCA8D6E"><enum>(d)</enum><header>Sealing; expungement</header>
				<paragraph commented="no" id="HCEBB04650945404AA1356249B3299A38"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/403">Chapter 403</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HD49963DE85CD4C4C871F853186D6619A" style="USC">
						<section id="H4F61B9C335764BFABBF03CE2AE89AB8E"><enum>5043.</enum><header>Sealing</header>
							<subsection id="H72B620599AA14386BFC6082A0C569582"><enum>(a)</enum><header>Automatic sealing of nonviolent offenses</header>
								<paragraph id="H9D40F876B26049FE8A0D089E16A01CEC"><enum>(1)</enum><header>In general</header><text>Three years after the date on which a person who is adjudicated delinquent under this chapter for a
			 juvenile nonviolent offense completes every term of probation, official
			 detention, or juvenile delinquent supervision ordered by the court with
			 respect to the offense, the court shall order the sealing of each juvenile
			 record or portion thereof that relates to the offense if the person—</text>
									<subparagraph id="H25EF36915DFB4E8CA994B6572AFBBAC7"><enum>(A)</enum><text>has not been convicted of a crime or adjudicated delinquent for an act of juvenile delinquency
			 since the date of the disposition; and</text>
									</subparagraph><subparagraph id="H22DBB45EE0AF434BA477AA19D946618D"><enum>(B)</enum><text>is not engaged in active criminal court proceedings or juvenile delinquency proceedings.</text>
									</subparagraph></paragraph><paragraph id="H7A86377C39AC427DA195D245ECA4EE3B"><enum>(2)</enum><header>Automatic nature of sealing</header><text>The order of sealing under paragraph (1) shall require no action by the person whose juvenile
			 records are to be sealed.</text>
								</paragraph><paragraph id="HE0B25FA1D36145BAB0D7188EFE3D5240"><enum>(3)</enum><header>Notice of automatic sealing</header><text>A court that orders the sealing of a juvenile record of a person under paragraph (1) shall inform
			 the person of the sealing and the benefits of sealing the record,
			 including protection from civil and criminal perjury, false swearing, and
			 false statement laws with respect to the record.</text>
								</paragraph></subsection><subsection id="H69D7F7B65C2C40A99B8B673CC213A32B"><enum>(b)</enum><header>Petitioning for early sealing of nonviolent offenses</header>
								<paragraph id="HD185F2A61A1642249929E28B2DF0ABE3"><enum>(1)</enum><header>Right to file sealing petition</header>
									<subparagraph id="HD111CA2C40D94224801F7A35CC08084F"><enum>(A)</enum><header>In general</header><text>During the 3-year period beginning on the date on which a person who is adjudicated delinquent
			 under this chapter for a juvenile nonviolent offense completes every term
			 of probation, official detention, or juvenile delinquent supervision
			 ordered by the court with respect to the offense, the person may petition
			 the court to seal the juvenile records that relate to the offense.</text>
									</subparagraph><subparagraph id="H3B9F08028FE14005B9FBFF08615CE3A3"><enum>(B)</enum><header>Notice of opportunity to file petition</header><text>If a person is adjudged delinquent for a juvenile nonviolent offense, the court in which the person
			 is adjudged delinquent shall inform the person of the potential
			 eligibility of the person to file a sealing petition with respect to the
			 offense upon completing every term of probation, official detention, or
			 juvenile delinquent supervision ordered by the court with respect to the
			 offense, and the necessary procedures for filing the sealing petition—</text>
										<clause id="HFBA8B0D1C07F4C9A9FAB454A7A38BF33"><enum>(i)</enum><text>on the date on which the individual is adjudged delinquent; and</text>
										</clause><clause id="H95F9A15D6FFB4F21859434967C69AB38"><enum>(ii)</enum><text>on the date on which the individual has completed every term of probation, official detention, or
			 juvenile delinquent supervision ordered by the court with respect to the
			 offense.</text>
										</clause></subparagraph></paragraph><paragraph id="H45C9B42E83C84685BA2C01482F5E680E"><enum>(2)</enum><header>Procedures</header>
									<subparagraph id="HF58DF1D8BDF6433B88382A252E63749A"><enum>(A)</enum><header>Notification of prosecutor and victims</header><text>If a person files a sealing petition with respect to a juvenile nonviolent offense, the court in
			 which the petition is filed shall provide notice of the petition—</text>
										<clause id="H81456152AE04445F85A86214631687CA"><enum>(i)</enum><text>to the Attorney General;</text>
										</clause><clause id="H06F7C549A7EB454F842274A513F7B8A4"><enum>(ii)</enum><text display-inline="yes-display-inline">to the extent reasonable and practicable, to each victim of the offense; and</text>
										</clause><clause id="H4B29EAB8976744CA8C39420620B4B5C9"><enum>(iii)</enum><text>upon the request of the petitioner, to any other individual that the petitioner determines may
			 testify as to—</text>
											<subclause id="H3DCF61D9D9C1433E86A050EEA08FF4A8"><enum>(I)</enum><text>the conduct of the petitioner since the date of the offense; or</text>
											</subclause><subclause id="HD1E6E17B0B0B4F5B9CD0820F9BF31186"><enum>(II)</enum><text>the reasons that the sealing order should be entered.</text>
											</subclause></clause></subparagraph><subparagraph id="H50511EBC173B4C4E848D69E5863A60A9"><enum>(B)</enum><header>Hearing</header>
										<clause id="H536C3F917D5E454EA4DE57641888C85A"><enum>(i)</enum><header>In general</header><text>Not later than 6 months after the date on which a person files a sealing petition, the court shall
			 conduct a hearing to determine whether to enter a sealing order for the
			 person.</text>
										</clause><clause id="H52DDA28D2E46413AB94ED5DF6614C39B"><enum>(ii)</enum><header>Opportunity to testify and offer evidence</header>
											<subclause id="HC9D1CEEB31454C6CB127AB41B98DA879"><enum>(I)</enum><header>Petitioner</header><text>The petitioner may testify or offer evidence at the sealing hearing in support of sealing.</text>
											</subclause><subclause id="HB9CDE6D701A54F9691E55B8AD4431F12"><enum>(II)</enum><header>Prosecutor</header><text display-inline="yes-display-inline">The Attorney General may send a representative to testify or offer evidence at the sealing hearing
			 in support of or against sealing.</text>
											</subclause><subclause id="HEB5EF5660F30476EB8D83E4A42DE6562"><enum>(III)</enum><header>Victims</header>
												<item id="H7810A489CDE345DDA1D04D1DBBC18FA1"><enum>(aa)</enum><header>In general</header><text display-inline="yes-display-inline">A victim who receives notice under subparagraph (A)(ii) may testify or offer evidence at the
			 sealing hearing in support of or against sealing.</text>
												</item><item id="H46F94496CCD94B40859EACEA4293696A"><enum>(bb)</enum><header>Locating victims</header><text>The inability of a court to locate a victim shall not delay a proceeding under this subsection,
			 preclude the holding of a sealing hearing, or preclude the issuance of a
			 sealing order.</text>
												</item></subclause><subclause id="H5499DA568D634DD99826CB2C76B6E293"><enum>(IV)</enum><header>Other individuals</header><text display-inline="yes-display-inline">An individual who receives notice under subparagraph (A)(iii) may testify or offer evidence at the
			 sealing hearing as to the issues described in subclauses (I) and (II) of
			 that paragraph.</text>
											</subclause></clause></subparagraph><subparagraph id="H6AC95120600E48EC940C7F8B53AC0031"><enum>(C)</enum><header>Basis for decision</header><text>In conducting the hearing under subparagraph (B), the court shall determine whether to grant the
			 sealing petition after considering—</text>
										<clause id="H4B6E2F16B743460484234637BD1E97B8"><enum>(i)</enum><text>the evidence and testimony presented by the Attorney General and any victims at the hearing;</text>
										</clause><clause id="H9F2EB0BAFF9A4BB0AD9A56E230A76496"><enum>(ii)</enum><text>the best interests of the petitioner;</text>
										</clause><clause id="H1B70CDA30630476FAE1DE7999A9CD618"><enum>(iii)</enum><text>the age of the petitioner during his or her contact with the court or any law enforcement agency;</text>
										</clause><clause id="H5B78E4A0DF154880891FD69515D607EF"><enum>(iv)</enum><text>the nature of the juvenile nonviolent offense;</text>
										</clause><clause id="HB8717F7F5CE44B15BEE480F21EEDF16C"><enum>(v)</enum><text>the disposition of the case;</text>
										</clause><clause id="H0AAD26387FF449EDB5DDCC3435EE4E7B"><enum>(vi)</enum><text>the manner in which the petitioner participated in any court-ordered rehabilitative programming or
			 supervised services;</text>
										</clause><clause id="H1F90A929649E417796AF0C967780F977"><enum>(vii)</enum><text>the length of the time period during which the petitioner has been without contact with any court
			 or law enforcement agency;</text>
										</clause><clause id="HDE12758D1B914D04A9B2AAA73E28378D"><enum>(viii)</enum><text>whether the petitioner has had any criminal or juvenile delinquency involvement since the
			 disposition of the juvenile delinquency proceeding; and</text>
										</clause><clause id="H1041D29DB5E74CB3AA00019903D18C5A"><enum>(ix)</enum><text>the adverse consequences the petitioner may suffer if the petition is not granted.</text>
										</clause></subparagraph><subparagraph id="H89FB09298AC6491EBD74E41D2EF04DF4"><enum>(D)</enum><header>Waiting period after denial</header><text display-inline="yes-display-inline">If the court denies a sealing petition, the petitioner may not file a new sealing petition with
			 respect to the same juvenile nonviolent offense until the date that is 2
			 years after the date of the denial.</text>
									</subparagraph><subparagraph id="H96CEF1ECF6374288A6580BD25C91FAF2"><enum>(E)</enum><header>Universal form</header><text>The Attorney General shall create a universal form, available over the Internet and in paper form,
			 that an individual may use to file a sealing petition.</text>
									</subparagraph><subparagraph id="H8DE4098678F24E5BA6BA4A0A2228CA6C"><enum>(F)</enum><header>No fee for sealing</header><text display-inline="yes-display-inline">There shall be no cost for filing a sealing petition.</text>
									</subparagraph><subparagraph id="HBF689F296BFF41DCA37E16D21AF2A000"><enum>(G)</enum><header>Reporting</header><text>Not later than 2 years after the date of enactment of this section, and each year thereafter, each
			 district court of the United States shall issue a public report that—</text>
										<clause id="H468A21B5AC154169A25B33B22EEAC540"><enum>(i)</enum><text>describes—</text>
											<subclause id="HA3FF9E5BB0CC4678BABF328EBDABAC58"><enum>(I)</enum><text>the number of sealing petitions granted and denied under this subsection; and</text>
											</subclause><subclause id="H18764CDBBE7643C1AF18E37C55A11B98"><enum>(II)</enum><text>the number of instances in which the Attorney General supported or opposed a sealing petition; and</text>
											</subclause></clause><clause id="HCF5D521789184E7E94B580BC5319405A"><enum>(ii)</enum><text>includes any supporting data that the court determines relevant and that does not name any
			 petitioner.</text>
										</clause></subparagraph><subparagraph id="H892459A3F71F4492A53D5EA7E1248D48"><enum>(H)</enum><header>Public defender eligibility</header>
										<clause id="HEFBD0319871E489A826C53E837303413"><enum>(i)</enum><header>Petitioners under age 18</header><text>The district court shall appoint counsel in accordance with the plan of the district court in
			 operation under section 3006A to represent a petitioner for purposes of
			 this subsection if the petitioner is less than 18 years of age.</text>
										</clause><clause id="H80D7122B43BC4FF0AB4945AFD838EAE7"><enum>(ii)</enum><header>Petitioners age 18 and older</header>
											<subclause id="H21DDCDC652BD4946A08DA511DC298F6B"><enum>(I)</enum><header>Discretion of court</header><text>In the case of a petitioner who not less than 18 years of age, the district court may, in its
			 discretion, appoint counsel in accordance with the plan of the district
			 court in operation under section 3006A to represent the petitioner for
			 purposes of this subsection.</text>
											</subclause><subclause id="H3A74AD6F543D46788729FFDBBAED0E37"><enum>(II)</enum><header>Considerations</header><text>In determining whether to appoint counsel under subclause (I), the court shall consider—</text>
												<item id="H70CBD59D492D4F8E97101F1A91D6CA8D"><enum>(aa)</enum><text>the anticipated complexity of the sealing hearing, including the number and type of witnesses
			 called to advocate against the sealing of the records of the petitioner;
			 and</text>
												</item><item id="HC27C5CD96B6D41A98F7726BD5CA1BF6B"><enum>(bb)</enum><text>the potential for adverse testimony by a victim or a representative of the Attorney General.</text>
												</item></subclause></clause></subparagraph></paragraph></subsection><subsection id="H1460D76820A0451495AFF51B462491FC"><enum>(c)</enum><header>Effect of sealing order</header>
								<paragraph id="HB8170781E2484C9498AA54DC9BED2CED"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in this subsection, if a court orders the sealing of a juvenile record under
			 subsection (a) or (b) with respect to a juvenile nonviolent offense, the
			 offense and any arrest, juvenile delinquency proceeding, adjudication, or
			 other result of such proceeding relating to the offense shall be treated
			 as if it never occurred.</text>
								</paragraph><paragraph id="H183CD76461F34B6B904256367B3039DE"><enum>(2)</enum><header>Verification of sealing</header><text display-inline="yes-display-inline">If a court orders the sealing of a juvenile record under subsection (a) or (b) with respect to a
			 juvenile nonviolent offense, the court shall—</text>
									<subparagraph id="H6A201EE5809F4ABD8B926CF32DD02895"><enum>(A)</enum><text display-inline="yes-display-inline">send a copy of the sealing order to each entity or person that possesses a record relating to the
			 offense, including each law enforcement agency, each public or private
			 correctional, detention, or treatment facility, each other public or
			 private agency, and each person who provided treatment or rehabilitation
			 services for the petitioner under an order of the court;</text>
									</subparagraph><subparagraph id="H4279A4C0460845C780B8D1E15785E8FE"><enum>(B)</enum><text>in the sealing order, require each entity or person described in paragraph (1) to—</text>
										<clause id="H4CAF1181AE72434C86D3BD172EE466DB"><enum>(i)</enum><text display-inline="yes-display-inline">seal the record; and</text>
										</clause><clause id="H79239CAEF705469DA54B1FA8DF9A27EB"><enum>(ii)</enum><text>submit a written certification to the court, under penalty of perjury, that the entity or person
			 has sealed each paper and electronic copy of the record;</text>
										</clause></subparagraph><subparagraph id="H866CE0C2C1794791BDE62B535894D4F2"><enum>(C)</enum><text>seal each paper and electronic copy of the record in the possession of the court; and</text>
									</subparagraph><subparagraph id="H139273EC0DFE434E870A5D4B74C71999"><enum>(D)</enum><text>after receiving a written certification from each entity or person under paragraph (2)(B), notify
			 the petitioner that each entity or person described in paragraph (1) has
			 sealed each paper and electronic copy of the record.</text>
									</subparagraph></paragraph><paragraph id="H3983D22A2555411481742D099DD92981"><enum>(3)</enum><header>Protection from perjury laws</header><text>Except as provided in paragraph (5)(C)(i), the person who is the subject of a juvenile record
			 sealed under subsection (a) or (b) or a parent of the person shall not be
			 subject to prosecution under any civil or criminal provision of Federal or
			 State law relating to perjury, false swearing, or making a false
			 statement, including section 1001, 1621, 1622, or 1623, for failing to
			 acknowledge the record or respond to any inquiry made of the person or the
			 parent, relating to the record, for any purpose.</text>
								</paragraph><paragraph id="H56AFEAA6A8DA4448B0C4A455B7B5E56C"><enum>(4)</enum><header>Law enforcement access to sealed records</header><text>A law enforcement agency may access a sealed juvenile record of a person solely—</text>
									<subparagraph id="HC1476301B9C843CFAC7D887541CD1228"><enum>(A)</enum><text>to determine whether the person is eligible for a first-time-offender diversion program;</text>
									</subparagraph><subparagraph id="HDE01EEE7BB844E9FA6075861BAAACAB2"><enum>(B)</enum><text>for investigatory or prosecutorial purposes within the juvenile justice system; or</text>
									</subparagraph><subparagraph id="H9AFC43DEBD3743D3AF4C52DAB2881106"><enum>(C)</enum><text>for a background check that relates to—</text>
										<clause id="H7F89AC5D5BEF4FC4B921D158B1BFA8F0"><enum>(i)</enum><text>law enforcement employment; or</text>
										</clause><clause id="H76A6D73C6E384EC19C5CB032EC616E75"><enum>(ii)</enum><text>any employment that requires a government security clearance.</text>
										</clause></subparagraph></paragraph><paragraph id="HD0134CA9D2634C378A3CF2EC13B7BF4D"><enum>(5)</enum><header>Prohibition on disclosure</header>
									<subparagraph id="H58A0A390076940608D0E88F433BDED46"><enum>(A)</enum><header>Prohibition</header><text>Except as provided in subparagraph (C), it shall be unlawful to intentionally make or attempt to
			 make an unauthorized disclosure of any information from a sealed juvenile
			 record in violation of this section.</text>
									</subparagraph><subparagraph id="HBE123A43481C490493C563DF6D6048A6"><enum>(B)</enum><header>Penalty</header><text>Any person who violates subparagraph (A) shall be fined under this title, imprisoned for not more
			 than 1 year, or both.</text>
									</subparagraph><subparagraph id="H556B6F53850545C88EB367F3A9CCC9C9"><enum>(C)</enum><header>Exceptions</header>
										<clause id="HEF81B533BB10431183DF0DD102A38C46"><enum>(i)</enum><header>Background checks</header><text display-inline="yes-display-inline">A person who is the subject of a juvenile record sealed under this section shall, and a Federal or
			 State law enforcement agency that possesses such a record may, disclose
			 the record in the case of a background check for—</text>
											<subclause id="HA738B33C01DD47ED87E8B208F2B1071F"><enum>(I)</enum><text display-inline="yes-display-inline">law enforcement employment; or</text>
											</subclause><subclause id="HAB19B252F0A54BDF8A540AC3494F0FA7"><enum>(II)</enum><text display-inline="yes-display-inline">any employment that requires a government security clearance.</text>
											</subclause></clause><clause id="H2D20B9C71B1A45B7B27983137BDA4D65"><enum>(ii)</enum><header>Disclosure to Armed Forces</header><text>A person may disclose information from a sealed juvenile record to the Secretaries of the military
			 departments (or the Secretary of Homeland Security with respect to the
			 Coast Guard when it is not operating as a service in the Navy) for the
			 purpose of vetting an enlistment or commission, or with regard to any
			 member of the Armed Forces.</text>
										</clause><clause id="H6E79EF2293664AF49DBF1A06884B213A"><enum>(iii)</enum><header>Authorization for person to disclose own record</header><text>A person who is the subject of a juvenile record sealed under this section may choose to disclose
			 the record.</text>
										</clause></subparagraph></paragraph></subsection></section><section id="HDDE94B8F40DA4BA8B8B998D1B571864E"><enum>5044.</enum><header>Expungement</header>
							<subsection id="HCF723368EF8E467F815D863060973B3F"><enum>(a)</enum><header>Automatic expungement of certain records</header>
								<paragraph id="H678BBB5AF32C4A6C9CC33C9C0FEC80EE"><enum>(1)</enum><header>Attorney General motion</header>
									<subparagraph id="HC72D179E75874367838BB418D6C8EF81"><enum>(A)</enum><header>Nonviolent offenses committed before a person turned 15</header><text>If a person is adjudicated delinquent under this chapter for a juvenile nonviolent offense
			 committed before the person attained 15 years of age, on the date on which
			 the person attains 18 years of age, the Attorney General shall file a
			 motion in the district court of the United States in which the person was
			 adjudicated delinquent requesting that each juvenile record of the person
			 that relates to the offense be expunged.</text>
									</subparagraph><subparagraph id="HD93F91D152F24650A31625B3C4C3DCA3"><enum>(B)</enum><header>Arrests</header><text>If a juvenile is arrested for an offense for which a juvenile delinquency proceeding is not
			 instituted under this subchapter, the Attorney General shall file a motion
			 in the district court of the United States that would have had
			 jurisdiction of the proceeding requesting that each juvenile record
			 relating to the arrest be expunged.</text>
									</subparagraph><subparagraph id="HC03EC9C499764526AE8816046CB7503B"><enum>(C)</enum><header>Expungement order</header><text>Upon the filing of a motion in a district court of the United States with respect to a juvenile
			 nonviolent offense under subparagraph (A) or an arrest for an offense
			 under subparagraph (B), the court shall grant the motion and order that
			 each juvenile record relating to the offense or arrest, as applicable, be
			 expunged.</text>
									</subparagraph></paragraph><paragraph id="H40D7329C4EEC40D9938266B2FC86F075"><enum>(2)</enum><header>Dismissed cases</header><text>If a district court of the United States dismisses an information with respect to a juvenile under
			 this subchapter or finds a juvenile not to be delinquent in a juvenile
			 delinquency proceeding under this subchapter, the court shall concurrently
			 order that each juvenile record relating to the applicable proceeding be
			 expunged.</text>
								</paragraph><paragraph id="H4A12876FB6604B738CB00C0ED64D6582"><enum>(3)</enum><header>Automatic nature of expungement</header><text>An order of expungement under paragraph (1)(C) or (2) shall not require any action by the person
			 whose records are to be expunged.</text>
								</paragraph><paragraph id="H98F3A5F265544CFD90B990EED1F8E03D"><enum>(4)</enum><header>Notice of automatic expungement</header><text>A court that orders the expungement of a juvenile record of a person under paragraph (1)(C) or (2)
			 shall inform the person of the expungement and the benefits of expunging
			 the record, including protection from civil and criminal perjury, false
			 swearing, and false statement laws with respect to the record.</text>
								</paragraph></subsection><subsection id="H902CCD8A5D774FEE908EABA8FA273AF4"><enum>(b)</enum><header>Petitioning for expungement of nonviolent offenses</header>
								<paragraph id="H1C994EBF051A4268B5E55B3AEA3D351D"><enum>(1)</enum><header>In general</header><text>A person who is adjudged delinquent under this chapter for a juvenile nonviolent offense committed
			 on or after the date on which the person attained 15 years of age may
			 petition the court in which the proceeding took place to order the
			 expungement of the juvenile record that relates to the offense.</text>
								</paragraph><paragraph id="HFAE4E08F09F84444BFDAC75FD2FFD27F"><enum>(2)</enum><header>Procedures</header>
									<subparagraph id="HBA8B7EBDCCED458AB9DF6EA212EEFC12"><enum>(A)</enum><header>Notification of prosecutor and victims</header><text>If a person files an expungement petition with respect to a juvenile nonviolent offense, the court
			 in which the petition is filed shall provide notice of the petition—</text>
										<clause id="H31DB051C249542A081A22FDB900FB4F9"><enum>(i)</enum><text>to the Attorney General;</text>
										</clause><clause id="H7C2C2096401C47C7A7942D5B9C14CC89"><enum>(ii)</enum><text display-inline="yes-display-inline">to the extent reasonable and practicable, to each victim of the offense; and</text>
										</clause><clause id="H1666CCFAEA014F6A83B965CC653D95AA"><enum>(iii)</enum><text>upon the request of the petitioner, to any other individual that the petitioner determines may
			 testify as to—</text>
											<subclause id="HC2253C89D4A747C9BF917F5E799D917A"><enum>(I)</enum><text>the conduct of the petitioner since the date of the offense; or</text>
											</subclause><subclause id="HEE31566883A54D9E895F15EBD4DC28A4"><enum>(II)</enum><text>the reasons that the expungement order should be entered.</text>
											</subclause></clause></subparagraph><subparagraph id="HB54DCFC4646841FC995AF62C957F5079"><enum>(B)</enum><header>Hearing</header>
										<clause id="HF00C0A87EC9949D28FD9CB1E4EA43542"><enum>(i)</enum><header>In general</header><text>Not later than 6 months after the date on which a person files an expungement petition, the court
			 shall conduct a hearing to determine whether to enter an expungement order
			 for the person.</text>
										</clause><clause id="H8BE39FDE0D324039A51538013EF97FB6"><enum>(ii)</enum><header>Opportunity to testify and offer evidence</header>
											<subclause id="H23C0BC73528B455F89301698357BCB1C"><enum>(I)</enum><header>Petitioner</header><text>The petitioner may testify or offer evidence at the expungement hearing in support of expungement.</text>
											</subclause><subclause id="HB672F169334A44EA93F50986719AE28D"><enum>(II)</enum><header>Prosecutor</header><text display-inline="yes-display-inline">The Attorney General may send a representative to testify or offer evidence at the expungement
			 hearing in support of or against expungement.</text>
											</subclause><subclause id="H0C06A1A6C0C948A59B662503F2C4ADC0"><enum>(III)</enum><header>Victims</header>
												<item id="H20BC10B94B794B7D8774FE85B1394103"><enum>(aa)</enum><header>In general</header><text display-inline="yes-display-inline">A victim who receives notice under subparagraph (A)(ii) may testify or offer evidence at the
			 expungement hearing in support of or against expungement.</text>
												</item><item id="HCFDC79D25B154EF7AC5A65EA07395CC7"><enum>(bb)</enum><header>Locating victims</header><text>The inability of a court to locate a victim shall not delay a proceeding under this subsection,
			 preclude the holding of an expungement hearing, or preclude the issuance
			 of an expungement order.</text>
												</item></subclause><subclause id="HCA3E489B5A0843D4806BB8056CB73799"><enum>(IV)</enum><header>Other individuals</header><text display-inline="yes-display-inline">An individual who receives notice under subparagraph (A)(iii) may testify or offer evidence at the
			 expungement hearing as to the issues described in subclauses (I) and (II)
			 of that paragraph.</text>
											</subclause></clause></subparagraph><subparagraph id="HD0EB79A41D0A4B3A91EFB31E29F3E36A"><enum>(C)</enum><header>Basis for decision</header><text>In conducting a hearing under subparagraph (B), the court shall determine whether to grant the
			 expungement petition after considering—</text>
										<clause id="HC7C7E04477164CA3A7677C6B85BFEE9A"><enum>(i)</enum><text>the evidence and testimony presented by the Attorney General and any victims at the hearing;</text>
										</clause><clause id="H77857902F0024EFFAD5E0B5AA35D1F85"><enum>(ii)</enum><text>the best interests of the petitioner;</text>
										</clause><clause id="HBCB05EC6A7EB42629F1AD872780B4093"><enum>(iii)</enum><text>the age of the petitioner during his or her contact with the court or any law enforcement agency;</text>
										</clause><clause id="HFA6C64C0452645559571436968E6BFB9"><enum>(iv)</enum><text>the nature of the juvenile nonviolent offense;</text>
										</clause><clause id="HACDB4EA4A31F480B8E70CCE7588E8EE3"><enum>(v)</enum><text>the disposition of the case;</text>
										</clause><clause id="HE6C8E5B0223C440AB233E6B414712EB7"><enum>(vi)</enum><text>the manner in which the petitioner participated in any court-ordered rehabilitative programming or
			 supervised services;</text>
										</clause><clause id="H29C29CA376834199BEA62246F9568E40"><enum>(vii)</enum><text>the length of the time period during which the petitioner has been without contact with any court
			 or any law enforcement agency;</text>
										</clause><clause id="HF542BD905CAB42F395D237C8910E0A8D"><enum>(viii)</enum><text>whether the petitioner has had any criminal or juvenile delinquency involvement since the
			 disposition of the juvenile delinquency proceeding; and</text>
										</clause><clause id="HE1C1A22DE1584CEB88C3185DD0829710"><enum>(ix)</enum><text>the adverse consequences the petitioner may suffer if the petition is not granted.</text>
										</clause></subparagraph><subparagraph id="HD4DDDF61BBC4408CA037C81C6B1EA6AC"><enum>(D)</enum><header>Waiting period after denial</header><text display-inline="yes-display-inline">If the court denies an expungement petition, the petitioner may not file a new expungement petition
			 with respect to the same offense until the date that is 2 years after the
			 date of the denial.</text>
									</subparagraph><subparagraph id="HFAA8E2CADE1E428EA0E20D2880BA2787"><enum>(E)</enum><header>Universal form</header><text>The Attorney General shall create a universal form, available over the Internet and in paper form,
			 that an individual may use to file an expungement petition.</text>
									</subparagraph><subparagraph id="H0E46A9A5A1DF4886B607946617AE4BA0"><enum>(F)</enum><header>No fee for expungement</header><text display-inline="yes-display-inline">There shall be no cost for filing an expungement petition.</text>
									</subparagraph><subparagraph id="H6CE79DA084BD4103A872E6DFB9E04FF9"><enum>(G)</enum><header>Reporting</header><text>Not later than 2 years after the date of enactment of this section, and each year thereafter, each
			 district court of the United States shall issue a public report that—</text>
										<clause id="H3F25B6F6B8B64A72A45C8A672C58992C"><enum>(i)</enum><text>describes—</text>
											<subclause id="HDE9F8B12C79C4BE0A6CAEF92073DCEC3"><enum>(I)</enum><text>the number of expungement petitions granted and denied under this subsection; and</text>
											</subclause><subclause id="H5B79636A063E4C7DAF5A74B24B2397B0"><enum>(II)</enum><text>the number of instances in which the Attorney General supported or opposed an expungement petition;
			 and</text>
											</subclause></clause><clause id="H2837FA91B6DB46DFB1E1B9C81FD4D46E"><enum>(ii)</enum><text>includes any supporting data that the court determines relevant and that does not name any
			 petitioner.</text>
										</clause></subparagraph><subparagraph id="HF5D4C6D408E94C8188BABAA9E7798599"><enum>(H)</enum><header>Public defender eligibility</header>
										<clause id="HE48B89FF6C8B485B97CF048E752D2E87"><enum>(i)</enum><header>Petitioners under age 18</header><text>The district court shall appoint counsel in accordance with the plan of the district court in
			 operation under section 3006A to represent a petitioner for purposes of
			 this subsection if the petitioner is less than 18 years of age.</text>
										</clause><clause id="HCB4694F3813D46D389AF7D4182F3853B"><enum>(ii)</enum><header>Petitioners age 18 and older</header>
											<subclause id="H14E46B8DD04347E8AE20A5C83780E651"><enum>(I)</enum><header>Discretion of court</header><text>In the case of a petitioner who not less than 18 years of age, the district court may, in its
			 discretion, appoint counsel in accordance with the plan of the district
			 court in operation under section 3006A to represent the petitioner for
			 purposes of this subsection.</text>
											</subclause><subclause id="HCFD99B43FDE44E78A048C4A43EA7A089"><enum>(II)</enum><header>Considerations</header><text>In determining whether to appoint counsel under subclause (I), the court shall consider—</text>
												<item id="H9F30D8E23F6F4634BE669B4F906FBF37"><enum>(aa)</enum><text>the anticipated complexity of the expungement hearing, including the number and type of witnesses
			 called to advocate against the expungement of the records of the
			 petitioner; and</text>
												</item><item id="HD64495B98B164CBC8C51D4BF63C4A9BC"><enum>(bb)</enum><text>the potential for adverse testimony by a victim or a representative of the Attorney General.</text>
												</item></subclause></clause></subparagraph></paragraph></subsection><subsection id="HC443E0128D8342818C70CE85B3EF89E3"><enum>(c)</enum><header>Effect of expunged juvenile record</header>
								<paragraph id="H7329D2E03CD4459BA60C25D5ABA9D632"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in this subsection, if a court orders the expungement of a juvenile record under
			 subsection (a) or (b) with respect to a juvenile nonviolent offense—</text>
									<subparagraph id="H15126228DDA1496385F4B6844AF6DFB8"><enum>(A)</enum><text display-inline="yes-display-inline">the offense and any arrest, juvenile delinquency proceeding, adjudication, or other result of such
			 proceeding relating to the offense shall be treated as if it never
			 occurred; and</text>
									</subparagraph><subparagraph id="H4B887CEED6534540AD60A0661ECA475F"><enum>(B)</enum><text>the person to whom the record pertains shall not be required to disclose the existence of the
			 record.</text>
									</subparagraph></paragraph><paragraph id="H4633F8723C1C4649970375D4FF14C393"><enum>(2)</enum><header>Verification of expungement</header><text>If a court orders the expungement of a juvenile record under subsection (a) or (b) with respect to
			 a juvenile nonviolent offense, the court shall—</text>
									<subparagraph id="HD1AF5FD2B4C94BC19141B2CA0A3D076D"><enum>(A)</enum><text display-inline="yes-display-inline">send a copy of the expungement order to each entity or person that possesses a record relating to
			 the offense, including each law enforcement agency, each public or private
			 correctional, detention, or treatment facility, each other public or
			 private agency, and each person who provided treatment or rehabilitation
			 services for the petitioner under an order of the court;</text>
									</subparagraph><subparagraph id="H77D50F4A0E174B87B46A0811286392EF"><enum>(B)</enum><text>in the expungement order, require each entity or person described in paragraph (1) to—</text>
										<clause id="HB677F37E3DA54F59BC8EE97BBF2EE86B"><enum>(i)</enum><text display-inline="yes-display-inline">destroy the record; and</text>
										</clause><clause id="H3BB2E9D43357445D8E119467F517C82E"><enum>(ii)</enum><text>submit a written certification to the court, under penalty of perjury, that the entity or person
			 has destroyed each paper and electronic copy of the record;</text>
										</clause></subparagraph><subparagraph id="H093101993CDE42B7B43A35BD9FE5CA09"><enum>(C)</enum><text>destroy each paper and electronic copy of the record in the possession of the court; and</text>
									</subparagraph><subparagraph id="H6EDCB3F69C6A45169330B9B4A93D3E66"><enum>(D)</enum><text>after receiving a written certification from each entity or person under paragraph (2)(B), notify
			 the petitioner that each entity or person described in paragraph (1) has
			 destroyed each paper and electronic copy of the record.</text>
									</subparagraph></paragraph><paragraph id="H4F2B4F13BC724D02B99E23904D10785C"><enum>(3)</enum><header>Reply to inquiries</header><text>In the case of an inquiry relating to a juvenile record of a person that is expunged under this
			 section, the court in which the proceeding took place, each law
			 enforcement officer, any agency that provided treatment or rehabilitation
			 services to the person, and the person (except as provided in paragraph
			 (6)) shall reply to the inquiry that no such juvenile record exists.</text>
								</paragraph><paragraph id="H999936986AC54547B781910FB872C841"><enum>(4)</enum><header>Protection from perjury laws</header><text>Except as provided in paragraph (5), if a juvenile record of a person is expunged under this
			 section, the person who is the subject of the record or a parent of the
			 person shall not be subject to prosecution under any civil or criminal
			 provision of Federal or State law relating to perjury, false swearing, or
			 making a false statement, including section 1001, 1621, 1622, or 1623, for
			 failing to acknowledge the record or respond to any inquiry made of the
			 person or the parent, relating to the record, for any purpose.</text>
								</paragraph><paragraph id="HCF0A2CC99B134BCC81F751E1E0C4FD07"><enum>(5)</enum><header>Civil actions</header>
									<subparagraph id="H991C7AD7A37F495189302FE476F76545"><enum>(A)</enum><header>In general</header><text>If a person whose juvenile record is expunged under this section brings an action that might be
			 defended with the contents of the record, there shall be a rebuttable
			 presumption that the defendant has a complete defense to the action.</text>
									</subparagraph><subparagraph id="HFE28A30935534E76A6CB7575E9A6D168"><enum>(B)</enum><header>Showing by plaintiff</header><text>In an action described in subparagraph (A), the plaintiff may rebut the presumption of a complete
			 defense by showing that the contents of the expunged record would not
			 prevent the defendant from being liable.</text>
									</subparagraph><subparagraph id="HB1659A975CCD40D4AB8FF6920C9AE9B9"><enum>(C)</enum><header>Duty to testify as to existence of record</header><text>The court in which an action described in subparagraph (A) is filed may require the plaintiff to
			 state under oath whether the plaintiff had a juvenile record and whether
			 the record was expunged.</text>
									</subparagraph><subparagraph id="H93D123822B384AB1A893175025BBC5F7"><enum>(D)</enum><header>Proof of existence of juvenile record</header><text>If the plaintiff in an action described in subparagraph (A) denies the existence of a juvenile
			 record, the defendant may prove the existence of the record in any manner
			 compatible with the applicable laws of evidence.</text>
									</subparagraph></paragraph><paragraph id="H5C8ACB8D7FC24A8A8CBE5D4C7935125F"><enum>(6)</enum><header>Authorization for person to disclose own record</header><text>A person who is the subject of a juvenile record expunged under this section may choose to disclose
			 the record.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" id="H9202D66C75E94D2984478EFDA46C98DF"><enum>(2)</enum><header>Technical and conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/403">chapter 403</external-xref> of title 18, United States Code, is amended by adding at the
			 end the following:</text>

				</paragraph></subsection><subsection commented="no" id="H6F057B1A471C43AE819743242264A689"><enum>(e)</enum><header>Juvenile solitary confinement</header>
				<paragraph commented="no" id="HF2BC7405A92E442F89C873CD090414A5"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/403">Chapter 403</external-xref> of title 18, United States Code, as amended by subsection (d), is amended by adding at
			 the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HEE0090DFD74D4F9C94AAA385CFDED39A" style="USC">
						<section id="H11F903B6A7DB423481337A04D651E46B"><enum>5045.</enum><header>Juvenile solitary confinement</header>
							<subsection id="H4E897AF83E3648969154E784B5FA7FC6"><enum>(a)</enum><header>Definitions</header><text>In this section—</text>
								<paragraph id="H4A785710E1D8429BAC3C539727C6B5EB"><enum>(1)</enum><text>the term <term>juvenile detention facility</term> means any facility to which juveniles are committed, whether pursuant to an adjudication of
			 delinquency under this subchapter or conviction for an offense; and</text>
								</paragraph><paragraph id="H4EA98B095CD04EC1929559ABC9813D7D"><enum>(2)</enum><text>the term <term>room confinement</term> means the involuntary restriction of a juvenile alone in a cell, room, or other area for any
			 reason.</text>
								</paragraph></subsection><subsection id="H2961404729CC4AFDB87F305CA4867ED3"><enum>(b)</enum><header>Prohibition</header>
								<paragraph id="H8D0A4D218FEE4E00AD2E4DD2EB3AD025"><enum>(1)</enum><header>In general</header><text>The use of room confinement at a juvenile detention facility for discipline, punishment,
			 retaliation, staffing shortages, administrative convenience, or any reason
			 other than as a temporary response to the behavior of a juvenile that
			 poses a serious and immediate risk of physical harm to the juvenile or
			 others is prohibited.</text>
								</paragraph><paragraph id="HADA5D8946C114CFCA7788690F1058624"><enum>(2)</enum><header>Juveniles posing risk of harm to others or to self and others</header>
									<subparagraph id="H869E2110587E4620BCF98BF3DEAEA412"><enum>(A)</enum><header>Requirement to use least restrictive techniques</header>
										<clause id="HFA7ACE6729F4406DA5E01BC1779935DF"><enum>(i)</enum><header>In general</header><text>Before an employee of a juvenile detention facility places a juvenile in room confinement, the
			 employee shall attempt to use less restrictive techniques, including—</text>
											<subclause id="H6D5D5FD58E00444DBA1B8A2F3B5B4133"><enum>(I)</enum><text>talking with the juvenile to de-escalate the situation; and</text>
											</subclause><subclause id="H424788AFBA7D45168EC461F64470F2A1"><enum>(II)</enum><text>when possible, bringing in other employees, qualified mental health professionals, or other
			 juveniles to talk with the juvenile.</text>
											</subclause></clause><clause id="H720662045641436A8D5AE76D805C3E14"><enum>(ii)</enum><header>Explanation</header><text>Before an employee of a juvenile facility places a juvenile in room confinement, or immediately
			 after doing so, the employee shall explain to the juvenile—</text>
											<subclause id="HFC32B7E0CFA5403299D31AD08F31D738"><enum>(I)</enum><text>the reasons for the room confinement; and</text>
											</subclause><subclause id="HC196A66433524AF4BEBFFA07A194644A"><enum>(II)</enum><text>the fact that the juvenile will be released from room confinement upon regaining self-control.</text>
											</subclause></clause></subparagraph><subparagraph id="H4051E797A5BD4DD6B33A3447BFC35D36"><enum>(B)</enum><header>3-hour maximum</header><text>Except as provided in paragraph (3), if a juvenile is placed in room confinement because the
			 juvenile poses a serious and immediate risk of physical harm to others or
			 to the juvenile and others, the juvenile shall not remain in room
			 confinement for more than 3 hours.</text>
									</subparagraph><subparagraph id="H60FBFD4305D645BE9CD6BF456290F79B"><enum>(C)</enum><header>Release</header><text>As soon as a juvenile placed in room confinement under subparagraph (A) is sufficiently under
			 control so as to no longer pose a serious and immediate risk of physical
			 harm to the juvenile or others, the juvenile shall be released from room
			 confinement.</text>
									</subparagraph><subparagraph id="H4A9076C471E74960A34E5F6F2C0413FA"><enum>(D)</enum><header>Spirit and purpose</header><text>The use of consecutive periods of room confinement to evade the spirit and purpose of this
			 subsection shall be prohibited.</text>
									</subparagraph><subparagraph id="H50A0808F186C404B91B39C3FC050F006"><enum>(E)</enum><header>Conditions</header><text>A room used for room confinement for a juvenile shall—</text>
										<clause id="H05E6EA846B61478BA48335914573F0E8"><enum>(i)</enum><text>have not less than 80 square feet of floor space;</text>
										</clause><clause id="H4C5C603111964BAD85BA49546C8AB21D"><enum>(ii)</enum><text>have adequate lighting, heating or cooling (as applicable), and ventilation for the comfort of the
			 juvenile;</text>
										</clause><clause id="HE3C7900FB20E4B99A306C67E3C63DD2F"><enum>(iii)</enum><text>be suicide-resistant and protrusion-free; and</text>
										</clause><clause id="HAD910EA0BA9646F595E8683BC15D540E"><enum>(iv)</enum><text>have reasonable access to water, toilet facilities, and hygiene supplies.</text>
										</clause></subparagraph><subparagraph id="H2D17692611D441E398E867A2EAC7F0D5"><enum>(F)</enum><header>Access to services</header><text>A juvenile placed in room confinement shall—</text>
										<clause id="H8942E45B93524B2C9FF0FD2A8A232867"><enum>(i)</enum><text>have access to appropriate medical and psychological services; and</text>
										</clause><clause id="H6FAC9CE9EE8E41FCB7EDDEED1DB4DAA8"><enum>(ii)</enum><text>receive crisis intervention and one-on-one observation.</text>
										</clause></subparagraph><subparagraph id="HF1C512E0D39048DF98A93BAE67F8C2B1"><enum>(G)</enum><header>Risk of harm after 3 hours</header><text>If, after 3 hours of room confinement, a juvenile continues to pose a serious and immediate risk of
			 physical harm to others or to the juvenile and others—</text>
										<clause id="H4FE28E9A9CC24BBCB87A62D0EA9FB60A"><enum>(i)</enum><text>the juvenile shall be transferred to another juvenile detention facility or internal location where
			 services can be provided to the juvenile without relying on room
			 confinement; or</text>
										</clause><clause id="H7FA573F9FC7F4D33A2C228A78BB3BDCC"><enum>(ii)</enum><text>if the juvenile cannot be transferred to another juvenile detention facility or internal location
			 in accordance with clause (i), an employee of the juvenile detention
			 facility shall initiate a referral to a mental health facility that can
			 meet the needs of the juvenile.</text>
										</clause></subparagraph></paragraph><paragraph id="HCE1F7150154148EBB53FB9398DA04DEC"><enum>(3)</enum><header>Juveniles posing risk of harm to self</header>
									<subparagraph id="H517BA4F80E2D4C819203FD6FA234EDFA"><enum>(A)</enum><header>In general</header><text>A juvenile may be placed in room confinement to protect the juvenile from a serious and immediate
			 risk of physical harm that the juvenile poses to himself or herself.</text>
									</subparagraph><subparagraph id="H7F49CF3BF48A4054B09B9BF8806FC44D"><enum>(B)</enum><header>Release</header><text>A juvenile placed in room confinement under subparagraph (A) shall be released—</text>
										<clause id="H7C7B5BE58748422FB4C683B519F9B561"><enum>(i)</enum><text>immediately when the juvenile no longer poses a serious and immediate risk of physical harm to
			 himself or herself; and</text>
										</clause><clause id="H57E94FBE617346898F294FE9CD92E88E"><enum>(ii)</enum><text>not later than 30 minutes after being placed in room confinement.</text>
										</clause></subparagraph><subparagraph id="H10902D96FF9C444AB2143C5032BE7698"><enum>(C)</enum><header>Explanation</header><text>Before placing a juvenile in room confinement under subparagraph (A) or immediately after doing so,
			 an employee of a juvenile detention facility shall explain to the
			 juvenile—</text>
										<clause id="H560C6894111E420195DF9FA05BF77A55"><enum>(i)</enum><text>the reasons for the room confinement; and</text>
										</clause><clause id="H1B2601FA83F94B31886111E9FFC2CB77"><enum>(ii)</enum><text>the fact that the juvenile will be released within 30 minutes.</text>
										</clause></subparagraph></paragraph></subsection><subsection id="HF9C05712656A4F28937F46D760726349"><enum>(c)</enum><header>Study and report</header><text>Not later than 2 years after the date of enactment of this section, and each year thereafter, the
			 Attorney General shall submit to Congress a report that—</text>
								<paragraph id="HB9D5041AAB14430580CB34322115BE7D"><enum>(1)</enum><text>contains a detailed description of the type of physical force, restraints, and room confinement
			 used at juvenile detention facilities; and</text>
								</paragraph><paragraph id="HB944B898AE954805AAE014CC8D79F953"><enum>(2)</enum><text>describes the number of instances physical force, restraints, or room confinement are used at
			 juvenile detention facilities, disaggregated by race, ethnicity, and
			 gender.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" id="HFCA930D4BAF347E3A1BB4EC9A392F68C"><enum>(2)</enum><header>Technical and conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/403">chapter 403</external-xref> of title 18, United States Code, as amended by subsection
			 (d), is amended by adding at the end the following:</text>

							<toc-entry level="section">5045. Juvenile solitary confinement.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section commented="no" id="HA79D3B66F9F143C9A524F8B8C221E3E4"><enum>4.</enum><header>Study and report on cost savings from sealing and expungement provisions</header>
			<subsection commented="no" id="H168959E0CD374463A5AFA3AA01D7426C"><enum>(a)</enum><header>Study</header>
				<paragraph commented="no" id="HC63FAB6F47D148A49E0E785E54211771"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 5 years after the date of enactment of this Act, the Attorney General, in
			 consultation with the Secretary of Labor and the Director of the Office of
			 Management and Budget, shall conduct a study on the cost savings and
			 broader economic impact of the sealing and expungement provisions in the
			 amendments made by sections 2, 3, and 6 of this Act.</text>
				</paragraph><paragraph commented="no" id="H4B6208318C254231B80637EDF6526BF8"><enum>(2)</enum><header>Considerations</header><text>In conducting the study under paragraph (1), the Attorney General shall consider—</text>
					<subparagraph commented="no" id="HFD7C27CC8AE74326A75F24B6671CDBA6"><enum>(A)</enum><text>the reduction in recidivism and associated cost savings related to corrections and public safety;</text>
					</subparagraph><subparagraph commented="no" id="H1317C43E6F704B9FA27F2550CF3724C9"><enum>(B)</enum><text>increased economic activity by former offenders, including by conducting an analysis of the tax
			 revenue generated by that activity; and</text>
					</subparagraph><subparagraph commented="no" id="H906978E0CED14257A8DE20BC2DBD1168"><enum>(C)</enum><text>the economic impact on the household of former offenders and the children of former offenders.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H93E9B79ED2624F029DA7DF8E40CD01FA"><enum>(b)</enum><header>Report</header><text>Not later than 5 years after the date of enactment of this Act, the Attorney General shall submit
			 to Congress a report on the study conducted under subsection (a).</text>
			</subsection></section><section id="HA3550C0AB0814CAC8880089491C87A00"><enum>5.</enum><header>TANF assistance and SNAP benefits</header>
			<subsection id="HB0950D9A640444E49725D69755E7C525"><enum>(a)</enum><header>Amendment to ban on assistance</header><text>Section 115 of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (21
			 U.S.C. 862a) is amended—</text>
				<paragraph id="HA99DD4CBCC5B4724A972939B87973E6B"><enum>(1)</enum><text>in subsection (a)—</text>
					<subparagraph id="HC504B2FA874243FA80CCEC3A51A7A146"><enum>(A)</enum><text>by redesignating paragraphs (1) and (2) as subparagraphs (A) and (B), respectively, and adjusting
			 the margins accordingly;</text>
					</subparagraph><subparagraph id="H683655E372214167A406B82A6F6D8361"><enum>(B)</enum><text>in the matter preceding subparagraph (A), as redesignated—</text>
						<clause id="HF5E7474D115B4227BED7D242205518EB"><enum>(i)</enum><text>by striking <quote>An individual</quote> and inserting the following:</text>
							<quoted-block display-inline="no-display-inline" id="HA8AD715E0D8144A8B2E5BE352EC58D70" style="OLC">
								<paragraph id="H701A628DA00149CA9D0B244ED5473905"><enum>(1)</enum><header>Denial of assistance and benefits</header><text>Except as provided in paragraph (2), an individual</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
						</clause><clause id="HFB400A2623F04D5CB33FADA1EFAD9723"><enum>(ii)</enum><text>by striking <quote>possession, use, or</quote>; and</text>
						</clause></subparagraph><subparagraph id="H76744C826FE5424CBC278ED47C3BFBC8"><enum>(C)</enum><text>by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="HE8753C4167CF4D79BC0B9282E424FEE8" style="OLC">
							<paragraph id="H84563E87A4A74F07A1F0D8E6FDAC414B"><enum>(2)</enum><header>Exception for individuals who receive treatment and other individuals</header><text>The prohibition under paragraph (1) shall not apply to an individual convicted of an offense
			 described in paragraph (1) who—</text>
								<subparagraph id="HCB6FC19334224B87826605809A129087"><enum>(A)</enum><text>has committed an offense that the court in which the individual is convicted (referred to in this
			 paragraph as the <quote>court</quote>) determines is rationally related to a substance abuse disorder;</text>
								</subparagraph><subparagraph id="H27EF659F41D44C46BC334A24E2538862"><enum>(B)</enum>
									<clause commented="no" display-inline="yes-display-inline" id="HBDCBD580BD9D4AC3B693BFBA626B7EC4"><enum>(i)</enum><text>is on a waiting list for, is accepted for, successfully participates in, or has satisfactorily
			 completed a substance abuse treatment program approved by the court; or</text>
									</clause><clause id="HC37B97632668432CB1918C0874F82169" indent="up1"><enum>(ii)</enum><text>has been determined by the court to not need substance abuse treatment; and</text>
									</clause></subparagraph><subparagraph id="H1CEEE2E3C4174169AA3BDC843BB0157B"><enum>(C)</enum><text>complies with all obligations imposed by the court.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H77ECEC0A746C4FDA90D69E56E0F15650"><enum>(2)</enum><text>in subsection (d), by striking <quote>the date of the enactment of this Act</quote> each place that term appears and inserting <quote>the date of enactment of the <short-title>Record Expungement Designed to Enhance Employment Act of 2014</short-title></quote>; and</text>
				</paragraph><paragraph id="HAA7F5CBA19A44991841127034FB58DAC"><enum>(3)</enum><text>in subsection (f), by striking paragraph (5) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="HE2178594D7A042E99385139EC32F8C78" style="OLC">
						<paragraph id="HE4673C784DBA498583AA93F8AD9B7B16"><enum>(5)</enum><text>Employment services, including job training programs and any other employment services that are
			 funded using assistance or benefits referred to in subsection (a).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" id="H2179A552B0024CFFA0692E20AC8BF9D9"><enum>(b)</enum><header>Effect on State elections To opt out or limit period of prohibition</header>
				<paragraph commented="no" id="H8E117AA556FF4835A070DE12DB13C937"><enum>(1)</enum><header>Definition</header><text>In this subsection, the term <term>TANF assistance or SNAP benefits</term> means assistance or benefits referred to in section 115(a) of the Personal Responsibility and Work
			 Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/21/862a">21 U.S.C. 862a(a)</external-xref>).</text>
				</paragraph><paragraph commented="no" id="H2D0A748F2DE84F6995312E3305E3A7DB"><enum>(2)</enum><header>Effect</header><text>A law enacted by a State under the authority under subparagraph (A) or (B) of subsection (d)(1) of
			 section 115 of the Personal Responsibility and Work Opportunity
			 Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/21/862a">21 U.S.C. 862a</external-xref>) (as in effect on the day
			 before the date of enactment of this Act), and any State law or regulation
			 enacted to carry out the requirements of such section (as in effect on the
			 day before the date of enactment of this Act), that imposes conditions on
			 eligibility for TANF assistance or SNAP benefits that are more restrictive
			 than the conditions on eligibility for TANF assistance or SNAP benefits
			 under such section as amended by subsection (a) shall have no force or
			 effect.</text>
				</paragraph></subsection></section><section id="HA193725DD34F484D88381D601E7E45B5"><enum>6.</enum><header>State incentives</header>
			<subsection id="HFD86B3592E984856B15A8E29FBA1BDEB"><enum>(a)</enum><header>COPS grants priority</header><text display-inline="yes-display-inline">Section 1701(c) of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3796dd">42 U.S.C. 3796dd(c)</external-xref>) is
			 amended—</text>
				<paragraph id="H94877AFDCF3D47D083E4EB440CEE4E19"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>In</quote> and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="H32F659400F2C4CE29131CE8B2AF3F91C" style="OLC">
						<paragraph id="HEA039473A80E4225957F9410B5D1B281"><enum>(1)</enum><header>In general</header><text>In</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H6BBB58F4E2B74E7786ED5CE9A4E745B2"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>where feasible</quote> and all that follows, and inserting the following:</text>
					<quoted-block display-inline="yes-display-inline" id="H38B77703943A4ACEA3E10FB0D005C6F1" style="OLC"><text>where feasible, to an application—</text><subparagraph id="H9D5FBF6DF8C94EED9F55ACAFA0706091"><enum>(A)</enum><text display-inline="yes-display-inline">for hiring and rehiring additional career law enforcement officers that involves a non-Federal
			 contribution exceeding the 25 percent minimum under subsection (g); or</text>
						</subparagraph><subparagraph id="HB136ED5C38CA468F941B991AD640DE9A"><enum>(B)</enum><text>from an applicant in a State that has in effect—</text>
							<clause id="H8C5D5131A9D548BFB1FB56ECEB829F9B"><enum>(i)</enum><text>a law relating to the confidentiality, sealing, and expungement of juvenile records that is
			 substantially similar to, or more generous to the former offender than,
			 the amendments made by subsections (b) through (d) of section 3 of the <short-title>Record Expungement Designed to Enhance Employment Act of 2014</short-title>;</text>
							</clause><clause id="HACCE07190698445B9D6CDB3830E8EDEE"><enum>(ii)</enum><text display-inline="yes-display-inline">a law prohibiting juvenile solitary confinement that is substantially similar to, or more
			 restrictive than, the amendment made by subsection (e) of section 3 of the <short-title>Record Expungement Designed to Enhance Employment Act of 2014</short-title>;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="H67228D1D3EF54DA3804A51B65C26E22C"><enum>(iii)</enum><text display-inline="yes-display-inline">a law relating to the sealing of adult records that is substantially similar to, or more generous
			 to the former offender than, the amendments made by section 2 of the <short-title>Record Expungement Designed to Enhance Employment Act of 2014</short-title>;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="H205E4A90E35048BABDAE199970FA5F05"><enum>(iv)</enum><text display-inline="yes-display-inline">subject to paragraph (2), a law that establishes that an adult criminal court may not have original
			 jurisdiction over an individual who was less than 18 years of age when the
			 individual committed an offense;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="H093FA9A3551D4B278767CA4E6577094C"><enum>(v)</enum><text display-inline="yes-display-inline">a law that allows an individual who has successfully sealed or expunged a criminal record to be
			 free from civil and criminal perjury laws; or</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="HF7FE5D7F496645A58DC51BDF990D7D1A"><enum>(vi)</enum><text display-inline="yes-display-inline">a law relating to the eligibility of individuals for assistance or benefits referred to in
			 subsection (a) of section 115 of the Personal Responsibility and Work
			 Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/21/862a">21 U.S.C. 862a(a)</external-xref>) that is no more
			 restrictive than such section, as amended by section 5 of the <short-title>Record Expungement Designed to Enhance Employment Act of 2014</short-title>.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H2932D3F08A36474B97153D8BAFA61E70"><enum>(3)</enum><text>by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H3CB8ED2A08B84362894F265BD86F811D" style="OLC">
						<paragraph id="H866844E6A5D9482A858941AA34CCA08E"><enum>(2)</enum><header>Juvenile transfer provisions</header><text>Paragraph (1)(B)(iv) shall not be construed to preclude from preferential consideration an
			 application from an applicant in a State that—</text>
							<subparagraph id="HB60B40B343704F938586D50C9DAA22C8"><enum>(A)</enum><text>has in effect a law that authorizes the transfer of an individual who is less than 18 years of age
			 to adult criminal court if the individual commits a specified offense or
			 an offense that falls under a specified category of offenses; or</text>
							</subparagraph><subparagraph id="H803F51C74BCC4DD5B00CDA66A2DB757F"><enum>(B)</enum><text>exercises other case-specific transfer mechanisms.</text>
							</subparagraph></paragraph><paragraph id="H0164D27D1D5248CFB06D4693D77DF3EC"><enum>(3)</enum><header>Degree of priority commensurate with degree of compliance</header><text>If the Attorney General, in awarding grants under this part, gives preferential consideration to
			 any application as authorized under paragraph (1)(B), the Attorney General
			 shall base the degree of preferential consideration given to an
			 application from an applicant in a particular State on the number of
			 clauses under paragraph (1)(B) that the State has satisfied, relative to
			 the number of such clauses that each other State has satisfied.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H1593641F7A3C4A2DA343E27C6E5BE861"><enum>(b)</enum><header>Attorney General guidelines and technical assistance</header><text>The Attorney General shall issue guidelines and provide technical assistance to assist States in
			 complying with the incentive under section 1701(c)(1)(B) of the Omnibus
			 Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3796dd">42 U.S.C. 3796dd(c)(1)(B)</external-xref>), as
			 added by subsection (a).</text>
			</subsection></section><section commented="no" id="H7F1567952D714F35B74D8091C1915C5D"><enum>7.</enum><header>Ensuring accuracy in the FBI background check system</header>
			<subsection id="H6D2D86EF0A994BE1B920EE9C73BCE566"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/28/534">Section 534</external-xref> of title 28, United States Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HB222F9012B8B41BD904B7EEF78CD17DC" style="OLC">
					<subsection id="H2F557FBA71344714967CB2400AE1B898"><enum>(g)</enum><header>Ensuring accuracy in the FBI background check system</header>
						<paragraph id="H97822EF4F7CA4BE6B5F94B0DDDCDA9C4"><enum>(1)</enum><header>Definitions</header><text>In this subsection—</text>
							<subparagraph id="H0679316D70674AD7B1E3C6850D035052"><enum>(A)</enum><text>the term <term>applicant</term> means the individual to whom a record sought to be exchanged pertains;</text>
							</subparagraph><subparagraph id="H74CE2C694AF346D99A857DC36B628D34"><enum>(B)</enum><text>the term <term>incomplete</term>, with respect to a record, means the record—</text>
								<clause id="HF4F404D8D44A420B88C1439EC1479C6C"><enum>(i)</enum><text>indicates that an individual was arrested but does not describe the offense for which the
			 individual was arrested; or</text>
								</clause><clause id="H3B345CB5E38341CB8539BBA8281A34C4"><enum>(ii)</enum><text>indicates that an individual was arrested or criminal proceedings were instituted against an
			 individual but does not include the final disposition of the arrest or of
			 the proceedings if a final disposition has been reached;</text>
								</clause></subparagraph><subparagraph id="H4CBCDCBD57F84A7296D3C0179AAB1CB7"><enum>(C)</enum><text>the term <term>record</term> means a record or other information collected under this section;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFBBF8796F93245219AB571664B039BE0"><enum>(D)</enum><text>the term <term>reporting jurisdiction</term> means any person or entity that provides a record to the Attorney General under this section; and</text>
							</subparagraph><subparagraph id="H9AA7FE36496340E180E990546F084F2D"><enum>(E)</enum><text>the term <term>requesting entity</term>—</text>
								<clause id="HEDD2DE34FBE743518D430634A1C39D3C"><enum>(i)</enum><text>means a person or entity that seeks the exchange of a record for civil purposes that include
			 employment, housing, credit, or any other type of application; and</text>
								</clause><clause id="H1B48B46248D64CE181F39A19348B18A6"><enum>(ii)</enum><text>does not include a law enforcement or intelligence agency that seeks the exchange of a record for—</text>
									<subclause id="HBB5FF61A24C44CBDB0EC4DB6618D3041"><enum>(I)</enum><text>investigative purposes; or</text>
									</subclause><subclause id="H1CAE0FAE0C734B8DB03AA36D58E45EB5"><enum>(II)</enum><text>purposes relating to—</text>
										<item id="H6B4F9DF7DD1D4AFD90F50F4E4DDD4214"><enum>(aa)</enum><text>law enforcement employment; or</text>
										</item><item id="H09EB01647D3F4E9C901D194DFA6C1FAF"><enum>(bb)</enum><text>employment that requires a government security clearance.</text>
										</item></subclause></clause></subparagraph></paragraph><paragraph id="H691101B1025442DAAF6CA73C2159B94C"><enum>(2)</enum><header>Periodic review and update of records</header><text>Not later than 1 year after the date of enactment of the <short-title>Record Expungement Designed to Enhance Employment Act of 2014</short-title>, and every 2 years thereafter, the Attorney General shall—</text>
							<subparagraph id="H0A0F6EE1535B4478912880117B4B77F9"><enum>(A)</enum><text>review each record for completeness and accuracy; and</text>
							</subparagraph><subparagraph id="H3D61526C04BA4129ACFED8E5DAB51ED6"><enum>(B)</enum><text>to the extent feasible, update or correct each incomplete or inaccurate record.</text>
							</subparagraph></paragraph><paragraph id="H86688237E2734CA0AC11B95711819B2B"><enum>(3)</enum><header>Incomplete or inaccurate records</header><text>If the Attorney General determines under paragraph (2)(A) that a record is incomplete or
			 inaccurate, the Attorney General—</text>
							<subparagraph id="HDA36C2D0929A40A6894E1E8E5CD8289F"><enum>(A)</enum><text>shall notify each relevant reporting jurisdiction that the record is incomplete or inaccurate; and</text>
							</subparagraph><subparagraph id="HD2351EC0C611408893E242C33D85C7B9"><enum>(B)</enum><text>may not exchange the record with a requesting entity until the Attorney General updates or corrects
			 the record.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" id="H7FD97FF59B804EF8AC23690F6D07ED48"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act, the Attorney General shall submit
			 to Congress a report on the implementation of <external-xref legal-doc="usc" parsable-cite="usc/28/534">section 534(g)</external-xref> of title 28,
			 United States Code, as added by subsection (a), that includes—</text>
				<paragraph id="H9D6830564D874769B9BBD3157F83DC86"><enum>(1)</enum><text>the number of exchanges of records or information for employment-related purposes made with
			 entities in each State through the records system created under section
			 534 of title 28, United States Code;</text>
				</paragraph><paragraph id="H4BB942DD949444C2B3279695415819A4"><enum>(2)</enum><text>appropriate statistical information to determine whether the exchange of records or information
			 about arrests that did not result in convictions is affecting the
			 employment opportunities of employees to whom those records or information
			 pertain;</text>
				</paragraph><paragraph id="H23D87D302E874C17A48A5C4C3175DAE4"><enum>(3)</enum><text>any prolonged failure of a reporting jurisdiction to comply with a request by the Attorney General
			 for information about dispositions of arrests; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HEEE98F5E27784FB4A6585C18C7360904"><enum>(4)</enum><text>the numbers of successful and unsuccessful challenges to the accuracy and completeness of records
			 or information, by State where the records and information originated.</text>
				</paragraph></subsection></section><section id="H5F7EA4730A9F4470ABF3E53E05454875"><enum>8.</enum><header>Report on statutory and regulatory restrictions and disqualifications based on criminal records</header>
			<subsection id="H058B1408AE5D47CA99AFA5FD4ABFF2FD"><enum>(a)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, the Attorney General, in
			 consultation with the Secretary of Labor and the Director of the Office of
			 Personnel Management, shall submit to Congress a report on each Federal
			 statute, regulation, or policy that authorizes a restriction on, or
			 disqualification of, an applicant for employment or for a Federal license
			 or permit based on the criminal record of the applicant.</text>
			</subsection><subsection id="HB784A2F4F3774B5F8013F78ACEF8BE7E"><enum>(b)</enum><header>Identification of information</header><text display-inline="yes-display-inline">In the report submitted under subsection (a), the Attorney General shall—</text>
				<paragraph id="H3DB983D26CAC48E0B5B170C291B75B9F"><enum>(1)</enum><text display-inline="yes-display-inline">identify each occupation, position, license, or permit to which a restriction or disqualification
			 described in subsection (a) applies; and</text>
				</paragraph><paragraph id="H177A28A0B00E4F70B28B5BD247ECB47D"><enum>(2)</enum><text display-inline="yes-display-inline">for each occupation, position, license, or permit identified under paragraph (1), include—</text>
					<subparagraph display-inline="no-display-inline" id="H6C567CA25D964A2EB085B8F3FFB07374"><enum>(A)</enum><text>a description of the restriction or disqualification;</text>
					</subparagraph><subparagraph id="H9D9833E7FEC941B18B8507ED363DCA3C"><enum>(B)</enum><text>the duration of the restriction or disqualification;</text>
					</subparagraph><subparagraph id="HF24242E8A07644B9AEE5F4DCAD627BE5"><enum>(C)</enum><text>an evaluation of the rationale for the restriction or disqualification and its continuing
			 usefulness;</text>
					</subparagraph><subparagraph id="HE2FA3520DD4647CD981AA14818EA8DA7"><enum>(D)</enum><text>the procedures, if any, to appeal, waive or exempt the restriction or disqualification based on a
			 showing of rehabilitation or other relevant evidence;</text>
					</subparagraph><subparagraph id="H8955320D067D4A0BAD2427CCAD49FE59"><enum>(E)</enum><text>any information available about the numbers of individuals restricted or disqualified on the basis
			 of a criminal record; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H035A0D461CC04C9494F663BD6C8BF39D"><enum>(F)</enum><text>the identity of the Federal agency with jurisdiction over the restriction or disqualification.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
