			</subsection></section><section id="HEF7954F5EC7B48349125467700A14061"><enum>2.</enum><header>Software license management</header>
			<subsection id="HF6700F3F2A59426FA2707A80496C00B7"><enum>(a)</enum><header>Software license policies required</header><text display-inline="yes-display-inline">Not later than 6 months after the date of the enactment of this Act, the Director of the Office of
			 Management and Budget shall issue software licensing policies for agencies
			 to follow that include the following:</text>
				<paragraph id="H5EFCAF60CAEE46CBAC05FAEBE3E10816"><enum>(1)</enum><text display-inline="yes-display-inline">An identification of clear roles, responsibilities, and central oversight authority within each
			 agency for managing enterprise software license agreements.</text>
				</paragraph><paragraph id="H995C39002ECF4180BD527555B233091F"><enum>(2)</enum><text>A requirement that each agency establish an accurate inventory of enterprise software license
			 agreements by identifying and collecting information about software
			 license agreements using automated discovery and inventory tools.</text>
				</paragraph><paragraph id="H80C20BE1C15F4F8DBEF4036068FC5630"><enum>(3)</enum><text>A requirement that each agency regularly track and maintain software licenses to assist the agency
			 in implementing decisions throughout the software license management life
			 cycle.</text>
				</paragraph><paragraph id="H14FE730D90C3403795F65FE334E0A429"><enum>(4)</enum><text display-inline="yes-display-inline">A requirement that each agency analyze software usage and other data to make cost-effective
			 decisions.</text>
				</paragraph><paragraph id="HC5271B31C3184DDF975ECDD480E2A224"><enum>(5)</enum><text display-inline="yes-display-inline">A requirement that each agency provide training relevant to software license management.</text>
				</paragraph><paragraph id="H497B8AD2365C4CFC898B8C3E6AB34435"><enum>(6)</enum><text display-inline="yes-display-inline">A requirement that each agency establish goals and objectives to better manage enterprise software
			 license agreements.</text>
				</paragraph><paragraph id="HEEA69797EE81406E9834299B2E1978F5"><enum>(7)</enum><text display-inline="yes-display-inline">A requirement that each agency consider the software license management life-cycle phases
			 (including requisition, reception, deployment and maintenance, retirement,
			 and disposal phases) to implement effective decisionmaking and
			 incorporate existing standards, processes, and metrics.</text>
				</paragraph></subsection><subsection commented="no" id="H55E7E64B92A4455F9FA55E231F7BA804"><enum>(b)</enum><header>Agency defined</header><text display-inline="yes-display-inline">In this section, the term <term>agency</term> has the meaning given that term in <external-xref legal-doc="usc" parsable-cite="usc/5/551">section 551</external-xref> of title 5, United States Code.</text>
			</subsection></section><section id="H829FE6D2D5F74350AA4F549C1E663730"><enum>3.</enum><header>United States Postal Service fleet efficiency</header>
			<subsection id="H19ECAC565A274AAB80572CD5EC71BBD8"><enum>(a)</enum><header>Purposes</header>
				<text>The purposes of this section are to provide for the upgrade of the vehicle fleet of the United
			 States Postal Service, to improve mail delivery services to benefit
			 customers and the environment, to increase savings by reducing maintenance
			 or other costs, and to set benchmarks to maximize fuel economy and reduce
			 emissions for the Postal fleet with the goal of making the Postal Service
			 a national leader in efficiency and technology innovation.</text>
			</subsection><subsection id="HB2E746685EE44C59A388E7FB8DE662F0"><enum>(b)</enum><header>Authority To enter into energy savings performance contracts</header><text>Section 804(4) of the National Energy Conservation Policy Act (<external-xref legal-doc="usc" parsable-cite="usc/42/8287c">42 U.S.C. 8287c(4)</external-xref>) is amended—</text>
				<paragraph id="H8C1EDD811A354362B95417142526338A"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>or</quote> after the semicolon;</text>
				</paragraph><paragraph id="H12157985FBD74FCA828CDDB7C3B0D2F8"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking the period at the end and inserting <quote>; or</quote>; and</text>
				</paragraph><paragraph id="HF5814D9F45C94E5EB66FB96B5722F52D"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="H75C063F468A345D484484D7E9F466969" style="OLC">
						<subparagraph id="H1651352413C748D1959EE3DC0944D6EF"><enum>(C)</enum><text display-inline="yes-display-inline">in the case of a contract in which the United States Postal Service is a party—</text>
							<clause id="HA55F8A910082443A8C994BBE4D34B147"><enum>(i)</enum><text>the purchase or lease of low emission and fuel efficient vehicles;</text>
							</clause><clause id="HD648D7D6D9204B22A363CEA584C237E9"><enum>(ii)</enum><text display-inline="yes-display-inline">a measure to upgrade a vehicle owned, operated, leased, or otherwise controlled by or assigned to
			 the United States Postal Service to increase average fuel economy and
			 reduce the emissions of carbon dioxide of such vehicle; or</text>
							</clause><clause id="H687D5910750F4498B52C05F4F6416BC6"><enum>(iii)</enum><text>the construction of infrastructure, including electric vehicle charging stations, to support
			 vehicles described in clauses (i) and (ii).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" id="H44C286C0B592483EAB79DF12BCE984C8"><enum>(c)</enum><header>Upgrade of Postal fleet</header>
				<paragraph commented="no" id="H233CA26410D14482960F1C6FC961C410"><enum>(1)</enum><header>Postal fleet requirements</header>
					<subparagraph id="H08A862EAA870476086706EFE95E2CE3F"><enum>(A)</enum><header>Motor vehicle standards</header><text display-inline="yes-display-inline">The Postmaster General shall develop guidelines for contracted vehicles and vehicles purchased or
			 leased for use by the Postal Service, that, at a minimum, provide—</text>
						<clause id="H5E3A26F400B345A5AFF8714BA0046E1E"><enum>(i)</enum><text display-inline="yes-display-inline">for light-duty vehicles—</text>
							<subclause id="HB2142EFC80CC440F9FB2A4037D707870"><enum>(I)</enum><text display-inline="yes-display-inline">that emissions of carbon dioxide comply with applicable standards developed by the Environmental
			 Protection Agency under title II of the Clean Air Act (42 U.S.C. 7521 et
			 seq.) and may not exceed, on average, 250 grams per mile; and</text>
							</subclause><subclause id="HE179D9BC70E744F2B54486F7DBFA9781"><enum>(II)</enum><text display-inline="yes-display-inline">to meet applicable average fuel economy standards developed by the National Highway Traffic Safety
			 Administration under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/329">chapter 329</external-xref> of title 49, United States Code, of 34.1
			 miles per gallon; and</text>
							</subclause></clause><clause commented="no" id="HD8F2F6FFEDDB4EF681027AFD8C29FA3C"><enum>(ii)</enum><text>for medium-duty and heavy-duty vehicles, that comply with applicable standards—</text>
							<subclause commented="no" id="H332B963D3241489EB444865D653C54FC"><enum>(I)</enum><text>for emissions of carbon dioxide developed by the Environmental Protection Agency under title II of
			 the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7521">42 U.S.C. 7521 et seq.</external-xref>); and</text>
							</subclause><subclause commented="no" id="H5C86EF9C154548EA84259F67638095C1"><enum>(II)</enum><text display-inline="yes-display-inline">for average fuel economy developed by the National Highway Traffic Safety Administration under
			 <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/329">chapter 329</external-xref> of title 49, United States Code.</text>
							</subclause></clause></subparagraph><subparagraph id="H043C1B1CB27040F8B04E6BE42365B37F"><enum>(B)</enum><header>Applicability</header><text display-inline="yes-display-inline">The standards described in subparagraph (A) shall apply to contracted vehicles and vehicles
			 purchased or leased for use by the Postal Service after the date that is 1
			 year after the date of the enactment of this Act.</text>
					</subparagraph><subparagraph commented="no" id="H5C602D1276A74A57BDDBD75A056271E7"><enum>(C)</enum><header>Reduction in consumption of petroleum products</header><text display-inline="yes-display-inline">The Postmaster General shall reduce the total consumption of petroleum products by vehicles in the
			 Postal fleet by a minimum of 2 percent annually through the end of fiscal
			 year 2025, relative to the baseline established for fiscal year 2005.</text>
					</subparagraph></paragraph><paragraph commented="no" id="H0651F550B5BA4AEFB93B1D009284CFD6"><enum>(2)</enum><header>Replacing vehicles within the Postal fleet</header><text display-inline="yes-display-inline">The Postmaster General shall conduct a cost-benefit analysis of vehicles in the Postal fleet to
			 determine if the cost to maintain any such vehicle outweighs the benefit
			 or savings of replacing the vehicle.</text>
				</paragraph><paragraph commented="no" id="HDE3E00AD0D0D4119806086433FFB9663"><enum>(3)</enum><header>Route requirements</header><text display-inline="yes-display-inline">To inform and prioritize purchases, the Postmaster General shall review and identify Postal
			 delivery routes to determine if motor vehicles used on such routes can be
			 replaced with technologies that increase average fuel economy or reduce
			 emissions of carbon dioxide.</text>
				</paragraph><paragraph commented="no" id="HC18F4CE16754445A8DF94CEAEB438A1C"><enum>(4)</enum><header>Reporting requirements</header><text display-inline="yes-display-inline">The Postmaster General shall submit a report to Congress—</text>
					<subparagraph id="H54A1BCA3303B4BBBA1E3C797191E7BBA"><enum>(A)</enum><text display-inline="yes-display-inline">not later than 1 year after the date of the enactment of this Act, that contains a plan to achieve
			 the requirements of paragraph (1) and recommendations for vehicle body
			 design specifications for vehicles purchased for the Postal fleet that
			 would increase average fuel economy and reduce emissions of carbon dioxide
			 of any such vehicle; and</text>
					</subparagraph><subparagraph id="H16DFDC9AC18742D9BFEC8CAC53B3E2D6"><enum>(B)</enum><text display-inline="yes-display-inline">annually, that describes—</text>
						<clause id="H4725975C320445D18C0F64B78DA43348"><enum>(i)</enum><text>the progress in meeting the annual target described in paragraph (1)(C); and</text>
						</clause><clause id="HC3D1446CEF2E40A7AD022C061D0C3B64"><enum>(ii)</enum><text>any changes to Postal delivery routes or vehicle purchase strategies made pursuant to paragraph
			 (3).</text>
						</clause></subparagraph></paragraph><paragraph id="H9DE84E5AE13741939B4178CDFCE05CD9"><enum>(5)</enum><header>Restrictions</header><text display-inline="yes-display-inline">To meet the requirements of this section, the Postmaster General may not—</text>
					<subparagraph id="H13283CA2346A4D3BA5BF596A89CACE91"><enum>(A)</enum><text display-inline="yes-display-inline">reduce the frequency of delivery of mail to fewer than 6 days each week;</text>
					</subparagraph><subparagraph id="H48DFA488620C4C01B30E996DC7DF12A0"><enum>(B)</enum><text display-inline="yes-display-inline">close post offices or postal distribution facilities;</text>
					</subparagraph><subparagraph id="H506A0FF0FC5D4404953DD1AB7AAF0C8A"><enum>(C)</enum><text display-inline="yes-display-inline">take any action that would restrict or diminish a collective bargaining agreement or eliminate or
			 reduce any employee benefits; or</text>
					</subparagraph><subparagraph id="HACAFEAFCE20D46A190B78B7361657492"><enum>(D)</enum><text display-inline="yes-display-inline">enter into a contract with a private company to perform duties that, as of the date of the
			 enactment of this Act, are performed by bargaining unit employees.</text>
					</subparagraph></paragraph></subsection><subsection id="H095C8F27809044D2ADEA171225A9CF10"><enum>(d)</enum><header>Definitions</header><text>In this section:</text>
				<paragraph commented="no" id="H3CAFCD7822E5435D96826C56D3DB6085"><enum>(1)</enum><header>Contracted vehicle</header><text display-inline="yes-display-inline">The term <term>contracted vehicle</term>—</text>
					<subparagraph id="H07BE01AD6EBD4EB3AA6A1F6FB7216AA6"><enum>(A)</enum><text>means any motor vehicle used in carrying out a contract for surface mail delivery pursuant to
			 <external-xref legal-doc="usc" parsable-cite="usc/39/5005">section 5005(a)(3)</external-xref> of title 39, United States Code; and</text>
					</subparagraph><subparagraph id="H4697916C2C104F329F3458AF1F4E0223"><enum>(B)</enum><text display-inline="yes-display-inline">does not include any motor vehicle used in carrying out a contract for surface mail delivery
			 pursuant to sections 406 and 407 of such title.</text>
					</subparagraph></paragraph><paragraph id="H1E130FAFB6534DA681BCA24FB5911EFC"><enum>(2)</enum><header>Motor vehicle</header><text display-inline="yes-display-inline">The term <term>motor vehicle</term> means any self-propelled vehicle designed for transporting persons or property on a street or
			 highway.</text>
				</paragraph><paragraph id="HC8BFEB02A1BF4BF59C1462C8F092034A"><enum>(3)</enum><header>Postal delivery route</header><text display-inline="yes-display-inline">The term <term>Postal delivery route</term> means the transportation route for surface mail delivery.</text>
				</paragraph><paragraph id="H9879759736C3409183D7DAC47A4EB7FB"><enum>(4)</enum><header>Postal fleet</header><text>The term <term>Postal fleet</term> means any vehicle that is owned, operated, leased, or otherwise controlled by or assigned to the
			 Postal Service.</text>
				</paragraph><paragraph id="H11107599C97046B6B7936ADC8F2C55E3"><enum>(5)</enum><header>Postal Service</header><text>The term <term>Postal Service</term> means the United States Postal Service.</text>
				</paragraph></subsection></section><section commented="no" id="HDE7B6D76B8EF41769C640D43D91D0231"><enum>4.</enum><header>Government Computer Energy Optimization</header>
			<subsection commented="no" id="HC5697623A8CC4534AE295BFBA9A1C4AB"><enum>(a)</enum><header>Agency requirement To shut down computers</header><text display-inline="yes-display-inline">Except as provided in subsection (b), not later than 6 months after the date of the enactment of
			 this Act, the head of each agency shall make all reasonable efforts to
			 ensure that desktop computers are shut down for at least 4 hours out of
			 every 24-hour time period.</text>
			</subsection><subsection commented="no" id="H2D51C50ED37842A79FC37585B030C98A"><enum>(b)</enum><header>Exception</header><text display-inline="yes-display-inline">The requirement in subsection (a) shall not apply to—</text>
				<paragraph id="H216E386679A64E12A35F82CF875AC4E6"><enum>(1)</enum><text>desktop computers that are used by a person for 16 or more hours per day; and</text>
				</paragraph><paragraph id="H71FB44A7382A409B833AAF4C23BCA2D7"><enum>(2)</enum><text>computers that perform automated functions essential to the agency for 16 or more hours per day.</text>
				</paragraph></subsection><subsection commented="no" id="HDC8365037BBE434C8521B2241B819430"><enum>(c)</enum><header>Agency defined</header><text display-inline="yes-display-inline">In this section, the term <term>agency</term> has the meaning given that term in <external-xref legal-doc="usc" parsable-cite="usc/5/551">section 551</external-xref> of title 5, United States Code.</text>
			</subsection></section><section id="H2BDBD6A85CEE46C380E1159D05285BEA" section-type="subsequent-section"><enum>5.</enum><header>Removal of benefits for Federal employee convicted of certain offenses</header>
			<subsection id="HCDC1ACAA7DDD4B02AA2A1E38C8BA1A0A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, an individual may not be paid an annuity under chapter
			 83 or 84 (as the case may be) of title 5, United States Code, if the
			 individual is convicted of an offense described under section
			 8332(o)(2)(B) of such title, committed after the date of enactment of this
			 Act, for which every act or omission of the individual that is needed to
			 satisfy the elements of the offense directly relates to the performance of
			 the individual's official duties.</text>
			</subsection><subsection id="HAF8A4147A124464EB2CC745F47949DC1"><enum>(b)</enum><header>Credit of service</header><text display-inline="yes-display-inline">Any such individual shall be entitled to be paid any amounts contributed by the individual towards
			 the annuity during the period of service covered by subsection (a),
			 pursuant to, or in a similar manner as, the terms of section 8316 of such
			 title.</text>
			</subsection><subsection id="HD107CF1C9E954D9A905C7EB9B6EEC7FE"><enum>(c)</enum><header>Thrift Savings Plan</header>
				<paragraph id="H16CE830E1D504B0DB5222DE447AD51CF"><enum>(1)</enum><header>Employing agency contributions</header><text>Any contributions made under section 8432 of such title by an employing agency for the benefit of
			 an individual convicted of an offense described in subsection (a) shall be
			 forfeited. Such contributions shall be returned to the general fund of the
			 Treasury.</text>
				</paragraph><paragraph id="HA74FA2C787544523892899817662C40A"><enum>(2)</enum><header>Employee contributions</header><text>Any contributions made by the individual pursuant to section 8432 of such title shall be payable to
			 the individual, upon application of such individual.</text>
				</paragraph><paragraph id="H20D1908EEF1E4777B568E6825F93BB27"><enum>(3)</enum><header>Computation</header><text display-inline="yes-display-inline">The computation of amounts required by paragraphs (1) and (2) shall be made on the date of the
			 conviction of the individual and shall consist of the value of the
			 contributions, including interest accrued, on such date.</text>
				</paragraph></subsection><subsection id="H1E15E9B3626D4B2D897D45DE80F2A592"><enum>(d)</enum><header>Regulations</header><text>The Director of the Office of Personnel Management shall prescribe any regulations necessary to
			 carry out this section.</text>
			</subsection></section><section id="HD032EEC79E384F29A5F4AB6003B70ACC"><enum>6.</enum><header>Codification of Office of Management and Budget criteria</header><text display-inline="no-display-inline">The Secretary of Defense shall implement the following criteria in requests for overseas
			 contingency operations:</text>
			<paragraph id="H96F8153BAAE2484EAB84A5CB4225B3C0"><enum>(1)</enum><text>For theater of operations for non-classified war overseas contingency operations funding, the
			 geographic areas in which combat or direct combat support operations occur
			 are: Iraq, Afghanistan, Pakistan, Kazakhstan, Tajikistan, Kyrgyzstan, the
			 Horn of Africa, Persian Gulf and Gulf nations, the Arabian Sea, the Indian
			 Ocean, the Philippines, and other countries on a case-by-case basis.</text>
			</paragraph><paragraph id="HD2344EFA2B124A0C947501CF5CA83DC9"><enum>(2)</enum><text>Permitted Inclusions in the Overseas Contingency Operation Budget:</text>
				<subparagraph id="H6EBE4BFBBFFD4C3CBFBC489565DB14EC"><enum>(A)</enum><text>Major Equipment:</text>
					<clause id="HC1823957ECC04EEFA2A6E266108C8971"><enum>(i)</enum><text>Replacement of losses that have occurred but only for items not already programmed for replacement
			 in the Future Years Defense Plan (FYDP), but not including accelerations,
			 which must be made in the base budget.</text>
					</clause><clause id="HE4FE65F2C88E4C73A3345726AECFBAEF"><enum>(ii)</enum><text>Replacement or repair to original capability (to upgraded capability if that is currently
			 available) of equipment returning from theater. The replacement may be a
			 similar end item if the original item is no longer in production.
			 Incremental cost of non-war related upgrades, if made, should be included
			 in the base.</text>
					</clause><clause id="HCD6548E08FD043CDBC13A30C7D6ED8C4"><enum>(iii)</enum><text>Purchase of specialized, theater-specific equipment.</text>
					</clause><clause id="H6FCB5322104244CF9442E4C5A7CB402C"><enum>(iv)</enum><text>Funding for major equipment must be obligated within 12 months.</text>
					</clause></subparagraph><subparagraph id="H02B76BBBE68A4B18BFD61F6354F1F7AB"><enum>(B)</enum><text>Ground Equipment Replacement:</text>
					<clause id="HC49C815336D64A2FB9D3AE8FEB72A837"><enum>(i)</enum><text>For combat losses and returning equipment that is not economical to repair, the replacement of
			 equipment may be given to coalition partners, if consistent with approved
			 policy.</text>
					</clause><clause id="HF38869A78F55411D989DA05BD7B6C951"><enum>(ii)</enum><text>In-theater stocks above customary equipping levels on a case-by-case basis.</text>
					</clause></subparagraph><subparagraph id="H2073AF46E591462A9A4C4D9D3D98CE80"><enum>(C)</enum><text>Equipment Modifications:</text>
					<clause id="H8EDAECF2CEDD429698D4EC6FACB75A8F"><enum>(i)</enum><text>Operationally required modifications to equipment used in theater or in direct support of combat
			 operations and that is not already programmed in FYDP.</text>
					</clause><clause id="HDC2FD5E431DF4A6A87ECEAEF062E3F31"><enum>(ii)</enum><text>Funding for equipment modifications must be able to be obligated in 12 months.</text>
					</clause></subparagraph><subparagraph id="HEC823EB9F0CC44F4917128EDAF6DBA86"><enum>(D)</enum><text>Munitions:</text>

					</clause><clause id="HD8169CB9CF0C45C8A1DE0DC4A2E84F8F"><enum>(iii)</enum><text>While forecasted expenditures are not permitted, a case-by-case assessment for munitions where
			 existing stocks are insufficient to sustain theater combat operations.</text>
					</clause></subparagraph><subparagraph id="H75B99FF04DA34673AC9B2C4812B19676"><enum>(E)</enum><text>Aircraft Replacement:</text>

					<clause id="H88444D1846C5458AB4DECBF77B0B33CF"><enum>(i)</enum><text>Facilities and infrastructure in the theater of operations in direct support of combat operations.
			 The level of construction should be the minimum to meet operational
			 requirements.</text>
					</clause><clause id="HB5E0043400984406AE9F0CC19CDBC985"><enum>(ii)</enum><text>At non-enduring locations, facilities and infrastructure for temporary use.</text>
					</clause><clause id="HE0BEC611424A43C8BEA760CAA3DC78D5"><enum>(iii)</enum><text>At enduring locations, facilities and infrastructure for temporary use.</text>
					</clause><clause id="H2D53C4FCA3764273A872292DFB2B1921"><enum>(iv)</enum><text>At enduring locations, construction requirements must be tied to surge operations or major changes
			 in operational requirements and will be considered on a case-by-case
			 basis.</text>
					</clause></subparagraph><subparagraph id="H30A1C83E2F5449069441D6BC2820009B"><enum>(G)</enum><text>Research and development projects for combat operations in these specific theaters that can be
			 delivered in 12 months.</text>

					<clause id="H5411EE53D8CC4F0585E1333A9CACB96C"><enum>(i)</enum><text>Direct war costs:</text>
						<subclause id="H830B80F7A26340378DA745DA97B676B6"><enum>(I)</enum><text>Transport of personnel, equipment, and supplies to, from and within the theater of operations.</text>
						</subclause><subclause id="H8F84854C5E1844958DD73EECE1FEF2CF"><enum>(II)</enum><text>Deployment-specific training and preparation for units and personnel (military and civilian) to
			 assume their directed missions as defined in the orders for deployment
			 into the theater of operations.</text>
						</subclause></clause><clause id="HEAF9A9B28D5143F3B1DE5BA06843E516"><enum>(ii)</enum><text>Within the theater, the incremental costs above the funding programmed in the base budget to:</text>

					</clause></subparagraph><subparagraph id="id074982E7AA104EF9A09A0995AC46D837"><enum>(I)</enum><text>Health:</text><clause id="H3AEC2CDEAFA44012B9E5FE61417E3D7A"><enum>(i)</enum><text>Short-term care directly related to combat.</text>
					</clause><clause id="H78DF256458514273B5AC6B3D791DF29B"><enum>(ii)</enum><text>Infrastructure that is only to be used during the current conflict.</text>
					</clause></subparagraph><subparagraph id="H9B9A6DDF5DCA4092BFAC1F31261FA942"><enum>(J)</enum><text>Personnel:</text>
					<clause id="HEEBF6A2ABE4C475C8AC28059114921F4"><enum>(i)</enum><text>Incremental special pays and allowances for servicemembers and civilians deployed to a combat

			 on-hand cash for the Defense Working Capital Funds to cover seven days

			</paragraph></section><section id="HEF6E7D8254AD405780881215EC368D9E"><enum>7.</enum><header>Increase energy efficiency of Federal buildings</header>
			<subsection display-inline="no-display-inline" id="HCA673E2C6F2143AE956213FD4BD02F5F"><enum>(a)</enum><header>Findings</header><text>Congress finds the following:</text>
				<paragraph id="H104DEAEF26B947A6A89C18F3956F6998"><enum>(1)</enum><text display-inline="yes-display-inline">Private sector funding and expertise can help address the energy efficiency challenges facing the
			 United States.</text>
				</paragraph><paragraph id="H909D602ECEC44C25BFC0524CCBF71A54"><enum>(2)</enum><text display-inline="yes-display-inline">The Federal Government spends more than $6 billion annually in energy costs.</text>
				</paragraph><paragraph id="HD3F4B0F8BAC54E74B09783A0206264FE"><enum>(3)</enum><text display-inline="yes-display-inline">Reducing Federal energy costs can help save money, create jobs, and reduce waste.</text>
				</paragraph><paragraph id="HCAC57D0CC383452CBA759FC3F2ACBDC6"><enum>(4)</enum><text display-inline="yes-display-inline">Energy savings performance contracts and utility energy savings contracts are tools for utilizing
			 private sector investment to upgrade Federal facilities without any
			 up-front cost to the taxpayer.</text>
				</paragraph><paragraph id="H1934A6ED2C1E4C95B5785E0FD3E1C325"><enum>(5)</enum><text display-inline="yes-display-inline">Performance contracting is a way to retrofit Federal buildings using private sector investment in
			 the absence of appropriated dollars. Retrofits seek to reduce energy use,
			 improve infrastructure, protect national security, and cut facility
			 operations and maintenance costs.</text>
				</paragraph></subsection><subsection id="HEBD694FD17BB400AA9831610CFE52C05"><enum>(b)</enum><header>Use of energy and water efficiency measures in Federal buildings</header>
				<paragraph id="HCBD7FC4DAF1E4B8FB91156B349F75832"><enum>(1)</enum><header>Implementation of identified energy and water efficiency measures</header><text display-inline="yes-display-inline">Section 543(f)(4) of the National Energy Conservation Policy Act (<external-xref legal-doc="usc" parsable-cite="usc/42/8253">42 U.S.C. 8253(f)(4)</external-xref>) is amended
			 to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H01BFDBDC19CF4F03A8E97C1D07A30945" style="OLC">

							<enum>(4)</enum>
							<header>Implementation of identified energy and water efficiency measures</header>
							<subparagraph id="H8907AB4238A24EB3B125DC5E7066C30A"><enum>(A)</enum><header>In general</header><text>Not later than 2 years after the completion of each evaluation under paragraph (3), each energy
			 manager shall consider—</text>
								<clause id="HC006DF0B5B4242A893363FC3315F9DFE">
									<enum>(i)</enum>
									<text>implementing any energy- or water-saving or conservation measure that the Federal agency identified
			 in the evaluation conducted under paragraph (3) that is life cycle
			 cost-effective; and</text>
								</clause><clause id="H98AA6CB214F74E799AEE75E193C16DEF">
									<enum>(ii)</enum>
									<text>bundling individual measures of varying paybacks together into combined projects.</text>
								</clause></subparagraph><subparagraph id="H78D65F5605284F57A19B3AAC74E08390"><enum>(B)</enum><header>Measures not implemented</header><text display-inline="yes-display-inline">The energy manager, as part of the certification system under paragraph (7) and using guidelines
			 developed by the Secretary, shall provide reasons for not implementing any
			 life cycle cost-effective measures under subparagraph (A).</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HF875E84CB2F14C95B42F5C8B8AD687E5"><enum>(2)</enum><header>Annual contracting goal</header><text display-inline="yes-display-inline">Section 543(f)(10)(C) of the National Energy Conservation Policy Act (<external-xref legal-doc="usc" parsable-cite="usc/42/8253">42 U.S.C. 8253(f)(10)(C)</external-xref>) is
			 amended—</text>
					<subparagraph id="HF4E4C9B9E2AB4D3C960EA79B0E2A4A75"><enum>(A)</enum><text>by striking <quote>Each Federal agency</quote> and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="H877FF7362A944B9C951D6ECCE325DD67" style="OLC">
							<clause id="H45AEF3F020C24812827833E86A24E01C"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Each Federal agency</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H5C57EEC2D58E4A468E3B693B94D6823C"><enum>(B)</enum><text>by adding at the end the following new clauses:</text>
						<quoted-block display-inline="no-display-inline" id="H7D22D7FB64C440FAA5EA38DD664A1E9B" style="OLC">
							<clause id="HFE0E0033368045CA882F1B1BEE98C916"><enum>(ii)</enum><header>Tracking</header><text>Each Federal agency shall use the benchmarking systems selected or developed for the agency under
			 paragraph (8) to track energy savings realized by the agency through the
			 implementation of energy- or water-saving or conservation measures
			 pursuant to paragraph (4), and shall submit information regarding such
			 savings to the Secretary to be published on a public website of the
			 Department of Energy.</text>
							</clause><clause id="H929F80C3E8E44E54BF931EC21CD5996E"><enum>(iii)</enum><header>Consideration</header><text display-inline="yes-display-inline">Each Federal agency shall consider using energy savings performance contracts or utility energy
			 service contracts to implement energy- or water-saving or conservation
			 measures pursuant to paragraph (4).</text>
							</clause><clause commented="no" id="H1DFFB93E9B4B4AE9AB1A6F3CC2CFD921"><enum>(iv)</enum><header>Contracting goal</header><text display-inline="yes-display-inline">It shall be the goal of the Federal Government, in the implementation of energy- or water-saving or
			 conservation measures pursuant to paragraph (4), to enter into energy
			 savings performance contracts or utility energy service contracts equal to
			 $1,000,000,000 in each year during the 5-year period beginning on January
			 1, 2014.</text>
							</clause><clause commented="no" id="H16C8A6C8F2364ACFAC6AF375931D9AC5"><enum>(v)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Not later than September 30 of each year during the 5-year period referred to in clause (iv), each
			 Federal agency shall submit to the Secretary information regarding
			 progress made by the agency towards achieving the goal described in such
			 clause. Not later than 60 days after each such September 30, the
			 Secretary, acting through the Federal Energy Management Program, shall
			 submit to the Committee on Energy and Commerce of the House of
			 Representatives and the Committee on Energy and Natural Resources of the
			 Senate a report describing the progress made by the Federal Government
			 towards achieving such goal.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection></section><section commented="no" id="HEA74F951D2844076BDF6042B16CF6D6D"><enum>8.</enum><header>Reduce redundant health payments for seniors</header>
			<subsection commented="no" id="H8CD585EC39BE4F2783697037BAE8A1A2"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services, in cooperation with the Secretary of Veterans Affairs
			 and the Secretary of Defense, shall conduct a study examining the extent
			 to which payments may be made under both the Medicare Advantage program
			 and under the veterans health care system or the TRICARE program for
			 health care furnished to individuals who are eligible under such Medicare
			 Advantage program and the veterans health care system or the TRICARE
			 program.</text>
			</subsection><subsection commented="no" id="H567E708541BB44509DC9F31C766BC7DB"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">The Secretary shall submit a report to Congress on the study conducted under subsection (a). The
			 report shall contain recommendations that—</text>
				<paragraph commented="no" id="H01456586D9CF4941ACA88A3C5A0C89AF"><enum>(1)</enum><text>preserve access to benefits under the Medicare program for individuals eligible for such benefits;</text>
				</paragraph><paragraph commented="no" id="HC191F67F7F9B4114ADB38EEBA42463B5"><enum>(2)</enum><text>focus on satisfaction and health outcomes of such individuals with respect to such benefits;</text>
				</paragraph><paragraph commented="no" id="H580B5BBA589E401A9D046F3837489F43"><enum>(3)</enum><text>provide for the efficient use of Federal funds;</text>
				</paragraph><paragraph commented="no" id="H00EB8650695949CDA94B651B7E136995"><enum>(4)</enum><text display-inline="yes-display-inline">account for the adequacy of the veterans health care system and the TRICARE program; and</text>
				</paragraph><paragraph commented="no" id="HDD37CA6AB07B4F1E8729673F482F0C67"><enum>(5)</enum><text>minimize disruption to the availability of Medicare Advantage plans and networks of providers
			 participating in such plans.</text>
				</paragraph></subsection><subsection id="H08A00AF45E024FFDB1FF8EDD9783BCA3"><enum>(c)</enum><header>Definitions</header><text>In this section:</text>
				<paragraph id="HB8B33E1A12AA43A1BA950C1719D11E2F"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>Medicare Advantage program</term> means the program under part C of title XVIII of the Social Security Act.</text>
				</paragraph><paragraph id="H84E63D435B554F4A80230990FC01E95D"><enum>(2)</enum><text>The term <term>TRICARE program</term> has the meaning given that term in <external-xref legal-doc="usc" parsable-cite="usc/10/1072">section 1072(7)</external-xref> of title 10, United States Code.</text>
				</paragraph><paragraph id="H1FAC6CDC7985489E9DB2573CBC60D734"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>veterans health care system</term> means the health care system established under <external-xref legal-doc="usc" parsable-cite="usc/38/1705">section 1705</external-xref> of title 38, United States Code.</text>
				</paragraph></subsection></section><section commented="no" id="H88513121EA8743D0BEBD4D6C94547683"><enum>9.</enum><header>Efficient Medicare billing</header>
			<subsection commented="no" id="HE4C05EC15EF54127BA7A99402214BE2B"><enum>(a)</enum><header>Option To receive Medicare Summary Notice electronically</header>
				<paragraph commented="no" id="HE2CA87E1AA31421788A00DFD524B879C"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1806 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395b-7">42 U.S.C. 1395b–7</external-xref>) is amended by adding at the end the
			 following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="HF3DE9CDE71CA489B97083A866DD7E6E2" style="OLC">
						<subsection commented="no" id="H787F5760C02D456B852F5615549E31EC"><enum>(c)</enum><header>Format of statements from Secretary</header>
							<paragraph commented="no" id="H4489DC55CAC745EB89D2CB090A74F2F8"><enum>(1)</enum><header>Electronic option beginning in 2015</header><text display-inline="yes-display-inline">Subject to paragraph (2), for statements described in subsection (a) that are furnished for a
			 period in 2015 or a subsequent year, in the case that an individual
			 described in subsection (a) elects, in accordance with such form, manner,
			 and time specified by the Secretary, to receive such statement in an
			 electronic format, such statement shall be furnished to such individual
			 for each period subsequent to such election in such a format and shall not
			 be mailed to the individual.</text>
							</paragraph><paragraph commented="no" id="H96E95FC6B4854DB2BBB2B55B9348AF7C"><enum>(2)</enum><header>One-time revocation option</header><text>An individual who makes an election described in paragraph (1) may revoke such election once.</text>
							</paragraph><paragraph commented="no" id="H0719768125E242978050CFB44AE08369"><enum>(3)</enum><header>Notification</header><text display-inline="yes-display-inline">The Secretary shall ensure that, in the most cost effective manner and beginning January 1, 2017, a
			 clear notification of the option to elect to receive statements described
			 in subsection (a) in an electronic format is made available, such as
			 through the notices distributed under section 1804, to individuals
			 described in subsection (a). <inline-comment display="no">For notices distributed under section 1804 on or after January 1, 2017, the Secretary shall ensure
			 that such notice includes a clear notification of the option to elect to
			 receive statements described in subsection (a) in an electronic format.</inline-comment></text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" id="H755F6FC5EFCA495B882A71DDF0658193"><enum>(2)</enum><header>Encouraged expansion of electronic statements</header><text display-inline="yes-display-inline">To the extent to which the Secretary of Health and Human Services determines appropriate, the
			 Secretary shall—</text>
					<subparagraph commented="no" id="H10EA96CD78D94E3492313A19D3D0B49E"><enum>(A)</enum><text display-inline="yes-display-inline">apply an option similar to the option described in subsection (c)(1) of section 1806 of the Social
			 Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395b-7">42 U.S.C. 1395b–7</external-xref>) (relating to the provision of the
			 Medicare Summary Notice in an electronic format), as added by subsection
			 (a), to other statements and notifications under title XVIII of such Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395 et seq.</external-xref>); and</text>
					</subparagraph><subparagraph commented="no" id="H8E5B6D6F75464849826AA9B1F3ACCD19"><enum>(B)</enum><text display-inline="yes-display-inline">provide such Medicare Summary Notice and any such other statements and notifications on a more
			 frequent basis than is otherwise required under such title.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" id="HC1264B7B319B4B56A4E9EABED739746E"><enum>(b)</enum><header>Renewal of MAC contracts</header><text>Section 1874A(b)(1)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395kk-1">42 U.S.C. 1395kk–1(b)(1)(B)</external-xref>) is amended by
			 striking <quote>5 years</quote> and inserting <quote>10 years</quote>.</text>
