		<section id="H2E5217FAF9764D0B85FC43C577B4DF1B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>WaterSense Efficiency, Conservation, and Adaptation Act of 2014</short-title></quote>.</text>
		</section><section id="H17E96E61B5D64B9AB0391C057508F5D0"><enum>2.</enum><header>Water efficiency, conservation, and adaptation</header>
			<subsection id="H11B9C543C8ED4A49AB930757D65FD51C"><enum>(a)</enum><header>Findings</header><text>Congress finds that—</text>
				<paragraph id="H720189B19FE44D9DA53AC55EAB62299E"><enum>(1)</enum>
					<subparagraph commented="no" display-inline="yes-display-inline" id="H3C2E903DC9654CC38CB80DF9A68B4A79"><enum>(A)</enum><text>human-induced climate change is affecting the natural water cycle, decreasing precipitation levels
			 in the West, especially the Southwest, and making droughts and floods more
			 frequent and more intense;</text>
					</subparagraph><subparagraph id="HA0790F48BB8A45EF9ED2C85257F0DBD7" indent="up1"><enum>(B)</enum><text>declining precipitation levels will severely impact water supplies in Southwestern States; and</text>
					</subparagraph><subparagraph id="H468A2602FEF34D09AC2D8305627096DB" indent="up1"><enum>(C)</enum><text>a sharp increase in the number of days with very heavy precipitation throughout the Northeast and
			 the Midwest will stress aging water infrastructure;</text>
					</subparagraph></paragraph><paragraph id="HD7B6E4BCD15F4851B47CC2C0C644449E"><enum>(2)</enum><text>changes in the water cycle caused by climate disruptions will adversely affect water
			 infrastructure, energy production and use, human health, transportation,
			 agriculture, and ecosystems, while also aggravating water disputes across
			 the United States;</text>
				</paragraph><paragraph id="HAAC0BF48B1F048DDB157AF404801C3B9"><enum>(3)</enum>
					<subparagraph commented="no" display-inline="yes-display-inline" id="H0181A4F3F108478A86C1757E4000DB4A"><enum>(A)</enum><text>the Colorado River, which supplies water for more than 30,000,000 people, is experiencing the worst
			 drought in more than 100 years of recordkeeping; and</text>
					</subparagraph><subparagraph id="H1781C6688ACA4523894ABDBBC7D0A589" indent="up1"><enum>(B)</enum><text>the primary reservoirs of the Colorado River Basin and Lakes Mead and Powell have lost nearly half
			 of the storage waters of the reservoirs and lakes, and clean hydropower
			 generated from Hoover Dam risks reduction if the extended drought
			 persists;</text>
					</subparagraph></paragraph><paragraph id="HEECC475A2378483EA2BDF579EEDF0327"><enum>(4)</enum><text>States and local governments and water utilities can begin to address the challenges described in
			 this subsection by providing incentives for water efficiency and
			 conservation, while also planning and investing in infrastructure to adapt
			 to the impacts of climate change, particularly those impacts already
			 affecting the United States;</text>
				</paragraph><paragraph id="HF56C0887C6C1499ABB14D725CA3890E8"><enum>(5)</enum><text>residential water demand can be reduced by 25 to 40 percent using existing, cost-effective
			 technologies that also can reduce the water bills of consumers by hundreds
			 of dollars per year; and</text>
				</paragraph><paragraph id="H40B5154494024A9698FB3ABB80D193CF"><enum>(6)</enum><text>water and energy use are inseparable activities, and supplying and treating water consumes around 4
			 percent of the electricity of the United States, and electricity makes up
			 75 percent of the cost of processing and delivering municipal water.</text>
				</paragraph></subsection><subsection id="HD15EFAF3CEDC484CA92B7674092D4812"><enum>(b)</enum><header>Definition of Administrator</header><text display-inline="yes-display-inline">In this Act, the term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text>
			</subsection><subsection id="HD776287F65CF4C6982466EEA40DE62C8"><enum>(c)</enum><header>WaterSense</header>
				<paragraph id="H6D186FCF0D104C9A8AF00570896586C9"><enum>(1)</enum><header>In general</header><text>There is established within the Environmental Protection Agency a WaterSense program to identify
			 and promote water efficient products, buildings, landscapes, facilities,
			 processes, and services so as—</text>
					<subparagraph id="H84659A6D72E64D079AB00F0F7A789F02"><enum>(A)</enum><text>to reduce water use;</text>
					</subparagraph><subparagraph id="HC1B57FF38B694360B0FC58EADC8286CE"><enum>(B)</enum><text>to reduce the strain on water, wastewater, and stormwater infrastructure;</text>
					</subparagraph><subparagraph id="HEAD4B4590B554B9CBDB53C786129C0AE"><enum>(C)</enum><text>to conserve energy used to pump, heat, transport, and treat water; and</text>
					</subparagraph><subparagraph id="HC1F2AA15710949B79A22F1161E3ED936"><enum>(D)</enum><text>to preserve water resources for future generations, through voluntary labeling of, or other forms
			 of communications about, products, buildings, landscapes, facilities,
			 processes, and services that meet the highest water efficiency and
			 performance criteria.</text>
					</subparagraph></paragraph><paragraph id="HA8D34B7162324FC185515F44E18FF140"><enum>(2)</enum><header>Duties</header><text>The Administrator shall—</text>
					<subparagraph id="H1D8908807BE449EFA0118416AF5A74C5"><enum>(A)</enum><text>establish—</text>
						<clause id="H1C7892A58F2849E0A133BDE117C3F316"><enum>(i)</enum><text>a WaterSense label to be used for certain items; and</text>
						</clause><clause id="H5E8C3256C94C45099EC8FC38B90AAF73"><enum>(ii)</enum><text>the procedure by which an item may be certified to display the WaterSense label;</text>
						</clause></subparagraph><subparagraph id="H19F1ED4FBF88439A8855BCEDA4960FF9"><enum>(B)</enum><text>promote WaterSense-labeled products, buildings, landscapes, facilities, processes, and services in
			 the market place as the preferred technologies and services for—</text>
						<clause id="H323AFEB25ACD4874A401AE24CE930CA9"><enum>(i)</enum><text>reducing water use; and</text>
						</clause><clause id="H38172287D10F4C7BAC3290464C163242"><enum>(ii)</enum><text>ensuring product and service performance;</text>
						</clause></subparagraph><subparagraph id="H8862143E966A4A4C9EF0FBF764E0B3B4"><enum>(C)</enum><text>work to enhance public awareness of the WaterSense label through public outreach, education, and
			 other means;</text>
					</subparagraph><subparagraph id="H34EDA99517604410BED86D8674B62BDA"><enum>(D)</enum><text>preserve the integrity of the WaterSense label by—</text>
						<clause id="HA022CC74BC4541ED888C1F07034C465B"><enum>(i)</enum><text>establishing and maintaining performance criteria so that products, buildings, landscapes,
			 facilities, processes, and services labeled with the WaterSense label
			 perform as well or better than less water-efficient counterparts;</text>
						</clause><clause id="H15EF395DB96141EBBB9D2E91B5C6BFB5"><enum>(ii)</enum><text>overseeing WaterSense certifications made by third parties;</text>
						</clause><clause id="H77328649F9D84B94B2D4E411BF052F54"><enum>(iii)</enum><text>conducting reviews of the use of the WaterSense label in the marketplace and taking corrective
			 action in any case in which misuse of the label is identified; and</text>
						</clause><clause id="H51F8251016F84850ACA3F98EC2204493"><enum>(iv)</enum><text>carrying out such other measures as the Administrator determines to be appropriate;</text>
						</clause></subparagraph><subparagraph id="H91809606806A4588A0B622C57A698317"><enum>(E)</enum><text>regularly review and, if appropriate, update WaterSense criteria for categories of products,
			 buildings, landscapes, facilities, processes, and services, at least once
			 every 4 years;</text>
					</subparagraph><subparagraph id="HB09F631EC3EA4C1191F6B56223AC3EEF"><enum>(F)</enum><text>to the maximum extent practicable, regularly estimate and make available to the public the
			 production and relative market shares of, and the savings of water,
			 energy, and capital costs of water, wastewater, and stormwater
			 infrastructure attributable to the use of WaterSense-labeled products,
			 buildings, landscapes, facilities, processes, and services, at least
			 annually;</text>
					</subparagraph><subparagraph id="H804385A1FF644DB98D662A61902068AC"><enum>(G)</enum><text>solicit comments from interested parties and the public prior to establishing or revising a
			 WaterSense category, specification, installation criterion, or other
			 criterion (or prior to effective dates for any such category,
			 specification, installation criterion, or other criterion);</text>
					</subparagraph><subparagraph id="H1197CB3075634EF9BAE16F3BC70B97D1"><enum>(H)</enum><text>provide reasonable notice to interested parties and the public of any changes (including effective
			 dates), on the adoption of a new or revised category, specification,
			 installation criterion, or other criterion, along with—</text>
						<clause id="HE1EEB9E8FA2B41A181DC9EA800E4309E"><enum>(i)</enum><text>an explanation of the changes; and</text>
						</clause><clause id="HBFA994446F0544628A5402A01E43AEC4"><enum>(ii)</enum><text>as appropriate, responses to comments submitted by interested parties and the public;</text>
						</clause></subparagraph><subparagraph id="HD82C936B850547669BA68CDDA2EA8A86"><enum>(I)</enum><text>provide appropriate lead time (as determined by the Administrator) prior to the applicable
			 effective date for a new or significant revision to a category,
			 specification, installation criterion, or other criterion, taking into
			 account the timing requirements of the manufacturing, marketing, training,
			 and distribution process for the specific product, building and landscape,
			 or service category addressed;</text>
					</subparagraph><subparagraph id="H4F0856FD4AA042AA9BF89FAEBC555C9F"><enum>(J)</enum><text>identify and, if appropriate, implement other voluntary approaches in commercial, institutional,
			 residential, industrial, and municipal sectors to encourage recycling and
			 reuse technologies to improve water efficiency or lower water use; and</text>
					</subparagraph><subparagraph id="H395A0C80939A42579B7308BC1E3C3E87"><enum>(K)</enum><text>if appropriate, apply the WaterSense label to water-using products that are labeled by the Energy
			 Star program implemented by the Administrator and the Secretary of Energy.</text>
					</subparagraph></paragraph><paragraph id="H0B10FB1B883F4439AA74E564B733880E"><enum>(3)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this subsection—</text>
					<subparagraph id="HDC722C54C1C5423294A22DEED5E48E37"><enum>(A)</enum><text>$7,500,000 for fiscal year 2015;</text>
					</subparagraph><subparagraph id="HCEE87BCCF3AF4C838B94C9955B002EAF"><enum>(B)</enum><text>$10,000,000 for fiscal year 2016;</text>
					</subparagraph><subparagraph id="H676217D6A35A45C4B805E7C07E188652"><enum>(C)</enum><text>$20,000,000 for fiscal year 2017;</text>
					</subparagraph><subparagraph id="H5D6A988FB2A842CFBBDD548995912809"><enum>(D)</enum><text>$50,000,000 for fiscal year 2018; and</text>
					</subparagraph><subparagraph id="H686A21E1860040F6BD509A1CBCAA011C"><enum>(E)</enum><text>for each subsequent fiscal year, the applicable amount for the preceding fiscal year, as adjusted
			 to reflect changes for the 12-month period ending the preceding November
			 30 in the Consumer Price Index for All Urban Consumers published by the
			 Bureau of Labor Statistics of the Department of Labor.</text>
					</subparagraph></paragraph></subsection><subsection id="HDA6E9CA894584070B2A29C766D45E447"><enum>(d)</enum><header>State residential water efficiency and conservation incentives program</header>
				<paragraph id="HA43A998004114D15B7CB4953EC679C37"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text>
					<subparagraph id="H66E6E5037074452DB06E6161F7483D9F"><enum>(A)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means a State government, local or county government, tribal government, wastewater or sewerage
			 utility, municipal water authority, energy utility, water utility, or
			 nonprofit organization that meets the requirements of paragraph (2).</text>
					</subparagraph><subparagraph id="HF94798A8CFEB47D9ABB063E79ECB0950"><enum>(B)</enum><header>Incentive program</header><text>The term <term>incentive program</term> means a program for administering financial incentives for consumer purchase and installation of
			 water-efficient products, buildings (including new water-efficient homes),
			 landscapes, processes, or services described in paragraph (2)(A).</text>
					</subparagraph><subparagraph id="H1CD6671FAE324735801E0A11DD53C0F8"><enum>(C)</enum><header>Residential water-efficient product, building, landscape, process, or service</header>
						<clause id="H2615EDA0177E4496A944D4D91660E089"><enum>(i)</enum><header>In general</header><text>The term <term>residential water-efficient product, building, landscape, process, or service</term> means a product, building, landscape, process, or service for a residence or its landscape that is
			 rated for water efficiency and performance—</text>
							<subclause id="H3C46DACFAAB1425ABC6AB1E215CF738C"><enum>(I)</enum><text>by the WaterSense program; or</text>
							</subclause><subclause id="H677D786E25C2434E9593A86BBEB3745C"><enum>(II)</enum><text>if a WaterSense specification does not exist, by the Energy Star program or an incentive program
			 approved by the Administrator.</text>
							</subclause></clause><clause id="H065ADCEE90FB4A2EA78F03B97E997AB6"><enum>(ii)</enum><header>Inclusions</header><text>The term <term>residential water-efficient product, building, landscape, process, or service</term> includes—</text>
							<subclause id="H3C101D7784D149B980D2D56722B3F367"><enum>(I)</enum><text>faucets;</text>
							</subclause><subclause id="H4AE9F3259D5E49D098634EFA9232946B"><enum>(II)</enum><text>irrigation technologies and services;</text>
							</subclause><subclause id="HD00F31BE26A9480B8140DABF5BD6FD4E"><enum>(III)</enum><text>point-of-use water treatment devices;</text>
							</subclause><subclause id="H509F3BF7B8944C90AC6C8F1787A74C82"><enum>(IV)</enum><text>reuse and recycling technologies;</text>
							</subclause><subclause id="H06E4B7D53E6D4DF486BE4928586C044A"><enum>(V)</enum><text>toilets;</text>
							</subclause><subclause id="HAFAE3751AD3B4746986E763BB443BA7B"><enum>(VI)</enum><text>clothes washers;</text>
							</subclause><subclause id="HAA55697E9E2D4AF1AE6E00F5C365DAA6"><enum>(VII)</enum><text>dishwashers;</text>
							</subclause><subclause id="H1065FDC64BDA4BAE8AA609A96027A842"><enum>(VIII)</enum><text>showerheads;</text>
							</subclause><subclause id="H9E23B52FD2D94373A911F9DFB1592CDA"><enum>(IX)</enum><text>xeriscaping and other landscape conversions that replace irrigated turf; and</text>
							</subclause><subclause id="H6206F7945B744EB5B98182D867FE1F73"><enum>(X)</enum><text>new water-efficient homes certified under the WaterSense program.</text>
							</subclause></clause></subparagraph><subparagraph id="H78DFFB5596B04FB19B05CC30A71FF02B"><enum>(D)</enum><header>WaterSense program</header><text>The term <term>WaterSense program</term> means the program established by subsection (c).</text>
					</subparagraph></paragraph><paragraph id="H88274407CF3944A1BCB415ED6CC1398B"><enum>(2)</enum><header>Eligible entities</header><text>An entity shall be eligible to receive an allocation under paragraph (3) if the entity—</text>
					<subparagraph id="HE21EF000D70940C392719FC12001DE15"><enum>(A)</enum><text>establishes (or has established) an incentive program to provide financial incentives to
			 residential consumers for the purchase of residential water-efficient
			 products, buildings, landscapes, processes, or services;</text>
					</subparagraph><subparagraph id="HBBE439C6BB504B31864E3A29108CF1EB"><enum>(B)</enum><text>submits an application for the allocation at such time, in such form, and containing such
			 information as the Administrator may require; and</text>
					</subparagraph><subparagraph id="H2CC21706F4154B87981420907A6F6E7C"><enum>(C)</enum><text>provides assurances satisfactory to the Administrator that the entity will use the allocation to
			 supplement, but not supplant, funds made available to carry out the
			 incentive program.</text>
					</subparagraph></paragraph><paragraph id="H6AAAD42058694FE6A4A0E2D7E612C509"><enum>(3)</enum><header>Amount of allocations</header><text>For each fiscal year, the Administrator shall determine the amount to allocate to each eligible
			 entity to carry out paragraph (4), taking into consideration—</text>
					<subparagraph id="H230761533BE14D60888648451FFA4DA3"><enum>(A)</enum><text>the population served by the eligible entity during the most recent calendar year for which data
			 are available;</text>
					</subparagraph><subparagraph id="HAF38088C87934EA4884F73F3AEA91474"><enum>(B)</enum><text>the targeted population of the incentive program of the eligible entity, such as general
			 households, low-income households, or first-time homeowners, and the
			 probable effectiveness of the incentive program for that population;</text>
					</subparagraph><subparagraph id="H16764A8906814890A3DE468D6F14BE50"><enum>(C)</enum><text>for existing programs, the effectiveness of the program in encouraging the adoption of
			 water-efficient products, buildings, landscapes, facilities, processes,
			 and services;</text>
					</subparagraph><subparagraph id="HD8700356611B45CD8B97A4842A3B37B3"><enum>(D)</enum><text>any allocation to the eligible entity for a preceding fiscal year that remains unused; and</text>
					</subparagraph><subparagraph id="H326F3CA32C5E4D52BFDF5DAAB2457820"><enum>(E)</enum><text>the per capita water demand of the population served by the eligible entity during the most recent
			 calendar year for which data are available and the accessibility of water
			 supplies to the eligible entity.</text>
					</subparagraph></paragraph><paragraph id="H3D21A34F269E4D0999F94F4EBC4814DE"><enum>(4)</enum><header>Use of allocated funds</header><text>Funds allocated to an eligible entity under paragraph (3) may be used to pay up to 50 percent of
			 the cost of establishing and carrying out an incentive program.</text>
				</paragraph><paragraph id="HFF5BF53513CB40A7B42636C0923960D8"><enum>(5)</enum><header>Fixture recycling</header><text>Eligible entities are encouraged to promote or implement fixture recycling programs to manage the
			 disposal of older fixtures replaced due to the incentive program under
			 this subsection.</text>
				</paragraph><paragraph id="H88877669F7D244A697EAF9FD61683641"><enum>(6)</enum><header>Issuance of incentives</header>
					<subparagraph id="H5F49D51E38C545ABB8E089BF0FF24F77"><enum>(A)</enum><header>In general</header><text>Financial incentives may be provided to residential consumers that meet the requirements of the
			 applicable incentive program.</text>
					</subparagraph><subparagraph id="HA812B1B350B348C68222AE0D34F02ED4"><enum>(B)</enum><header>Manner of issuance</header><text>An eligible entity may—</text>
						<clause id="H7DAFFF637D17475183788576F9D5A981"><enum>(i)</enum><text>issue all financial incentives directly to residential consumers; or</text>
						</clause><clause id="H569C693FE57B4C78AA43B74D0B9D3B81"><enum>(ii)</enum><text>with approval of the Administrator, delegate all or part of financial incentive administration to
			 other organizations, including local governments, municipal water
			 authorities, water utilities, and nonprofit organizations.</text>
						</clause></subparagraph><subparagraph id="H400314CC439C42CEBDEE2C9F3165BEAF"><enum>(C)</enum><header>Amount</header><text>The amount of a financial incentive shall be determined by the eligible entity, taking into
			 consideration—</text>
						<clause id="H9127DA5154174BAAA8489DFE5118D0E0"><enum>(i)</enum><text>the amount of any Federal or State tax incentive available for the purchase of the residential
			 water-efficient product or service;</text>
						</clause><clause id="H77646D96E51C4063907BE8DBF94583EC"><enum>(ii)</enum><text>the amount necessary to change consumer behavior to purchase water-efficient products and services;
			 and</text>
						</clause><clause id="H41494E0C4F494AEBB4B2CAC1DCA5946E"><enum>(iii)</enum><text>the consumer expenditures for onsite preparation, assembly, and original installation of the
			 product.</text>
						</clause></subparagraph></paragraph><paragraph id="HF862EB86ECBB40D6B9E9217614DC7E0B"><enum>(7)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Administrator to carry out this section—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="HC626E5B62FD74FBC945C7C30E58A0C53"><enum>(A)</enum><text display-inline="yes-display-inline">$100,000,000 for fiscal year 2015;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H68F432B7B92D467DA32993ED7120BB5A"><enum>(B)</enum><text display-inline="yes-display-inline">$150,000,000 for fiscal year 2016;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H626FE1A8A5444E63B5107489ADDDF697"><enum>(C)</enum><text display-inline="yes-display-inline">$200,000,000 for fiscal year 2017;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H66F50D15B9CE44EF826169208A2E980F"><enum>(D)</enum><text display-inline="yes-display-inline">$150,000,000 for fiscal year 2018;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H712CF644DE234F1D9B34C8B56F79C0AC"><enum>(E)</enum><text>$100,000,000 for fiscal year 2019; and</text>
					</subparagraph><subparagraph id="H54A05B141F894D6BA37F9E8106D707B7"><enum>(F)</enum><text>for each subsequent fiscal year, the applicable amount for the preceding fiscal year, as adjusted
			 to reflect changes for the 12-month period ending the preceding November
			 30 in the Consumer Price Index for All Urban Consumers published by the
			 Bureau of Labor Statistics of the Department of Labor.</text>
					</subparagraph></paragraph></subsection><subsection id="HA8A93D6EA108415A88616A3ECCD552A8"><enum>(e)</enum><header>Blue bank for water system mitigation and adaptation</header>
				<paragraph id="HCCB25F737CD240D6B1E1D13214C58165"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text>
					<subparagraph id="H7A19D403CC074CF18EA97C81F0212947"><enum>(A)</enum><header>Abrupt climate change</header><text>The term <term>abrupt climate change</term> means a large-scale change in the climate system that—</text>
						<clause id="H47EB26068D8D4099914D3C2E32B55486"><enum>(i)</enum><text>takes place over a few decades or less;</text>
						</clause><clause id="HF53FD88F7EC6493A8B3B710CA85A87CC"><enum>(ii)</enum><text>persists (or is anticipated to persist) for at least a few decades; and</text>
						</clause><clause id="H207ECB32917A479788932D3B76C949D8"><enum>(iii)</enum><text>causes substantial disruptions in human and natural systems.</text>
						</clause></subparagraph><subparagraph id="H35F64C5D53FB4049901F968C60BC0366"><enum>(B)</enum><header>Owner or operator</header>
						<clause id="HDE32A0A8463A422B97BC828CE404445B"><enum>(i)</enum><header>In general</header><text>The term <term>owner or operator</term> means a person (including a regional, State, local, municipal, or private entity) that owns or
			 operates a water system.</text>
						</clause><clause id="HD8E15BE8A7CA43B69C7EB2F1027836C3"><enum>(ii)</enum><header>Inclusion</header><text>The term <term>owner or operator</term> includes a non-Federal entity that has operational responsibilities for a federally owned water
			 system.</text>
						</clause></subparagraph><subparagraph id="H8E8E3575671C4BAB912DA91127202D95"><enum>(C)</enum><header>Water system</header><text>The term <term>water system</term> means—</text>
						<clause id="H4D5C8D2869B64C22B5D5ED35FF2EAC8D"><enum>(i)</enum><text>a community water system (as defined in section 1401 of the Safe Drinking Water Act (42 U.S.C.
			 300f));</text>
						</clause><clause id="H461F74C79E1642DDBA7AD5A601F58169"><enum>(ii)</enum><text>a publicly owned treatment works (as defined in section 212 of the Federal Water Pollution Control
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1292">33 U.S.C. 1292</external-xref>)), including a municipal separate storm sewer system;</text>
						</clause><clause id="H9696F3F665C042AEB20AB34E0D9532A7"><enum>(iii)</enum><text>a decentralized wastewater treatment system for domestic sewage;</text>
						</clause><clause id="H41674319F823480B8E133333ABE490F4"><enum>(iv)</enum><text>a groundwater storage and replenishment system; or</text>
						</clause><clause id="H54C08A01A931404393ACD5306FBB0CB5"><enum>(v)</enum><text>a system for transport and delivery of water for irrigation or conservation.</text>
						</clause></subparagraph></paragraph><paragraph id="H2F0DD2BFD94E4C81A0E423A56D222770"><enum>(2)</enum><header>Grants</header><text>Beginning in fiscal year 2015, the Administrator shall make grants to owners or operators of water
			 systems to address any ongoing or forecasted (based on the best available
			 research and data) climate-related impact on the water quality or quantity
			 of a region of the United States, for the purposes of mitigating or
			 adapting to the impacts of climate change.</text>
				</paragraph><paragraph id="H7DB06E93B3824A2199902FEE903A412D"><enum>(3)</enum><header>Eligible uses</header><text>In carrying out this subsection, the Administrator shall make grants to assist in the planning,
			 design, construction, implementation, or maintenance of any program or
			 project to increase the resilience of a water system to climate change by—</text>
					<subparagraph id="HF958B4BC2C224809B4BD987456A168FF"><enum>(A)</enum><text>conserving water or enhancing water use efficiency, including through the use of water metering to
			 measure the effectiveness of a water efficiency program;</text>
					</subparagraph><subparagraph id="H68274F12143E4853AF4A25D4EC95803B"><enum>(B)</enum><text>modifying or relocating existing water system infrastructure made or projected to be made
			 inoperable by climate change impacts;</text>
					</subparagraph><subparagraph id="HDCC716CB8261461FBD43C6D0A6D558D9"><enum>(C)</enum><text>preserving or improving water quality, including through measures to manage, reduce, treat, or
			 reuse municipal stormwater, wastewater, or drinking water;</text>
					</subparagraph><subparagraph id="H6AB235CE8D5946B489F2C97FE2006AF9"><enum>(D)</enum><text>investigating, designing, or constructing groundwater remediation, recycled water, or desalination
			 facilities or systems;</text>
					</subparagraph><subparagraph id="H1911612D543A45208E5DB5E23745D71F"><enum>(E)</enum><text>enhancing water management by increasing watershed preservation and protection, such as through the
			 use of natural or engineered green infrastructure in the management,
			 conveyance, or treatment of water, wastewater, or stormwater;</text>
					</subparagraph><subparagraph id="HB4E1B83E29524BF29FB1BCF855A2AE73"><enum>(F)</enum><text>enhancing energy efficiency or the use and generation of renewable energy in the management,
			 conveyance, or treatment of water, wastewater, or stormwater;</text>
					</subparagraph><subparagraph id="HAF9F7284D87A468BBC26B90FAD419FC2"><enum>(G)</enum><text>supporting the adoption and use of advanced water treatment, water supply management (such as
			 reservoir reoperation), or water demand management technologies, projects,
			 or processes (such as water reuse and recycling or adaptive conservation
			 pricing) that maintain or increase water supply or improve water quality;</text>
					</subparagraph><subparagraph id="H569FD327716A4E628DDB361944951D60"><enum>(H)</enum><text>modifying or replacing existing systems or constructing new systems for existing communities or
			 land currently in agricultural production to improve water availability,
			 storage, or conveyance in a manner that—</text>
						<clause id="HACFC6551DEC14CFAADF7F980CF069E29"><enum>(i)</enum><text>promotes more efficient use of available water supplies; and</text>
						</clause><clause id="HEF87E0609B604105B4C3541E1914E9D2"><enum>(ii)</enum><text>does not further exacerbate stresses on ecosystems;</text>
						</clause></subparagraph><subparagraph id="H19BEEC7C6B4343AEAFFCA01B76E8E62C"><enum>(I)</enum><text>supporting practices and projects, such as improved irrigation systems, water banking and other
			 forms of water transactions, groundwater recharge, stormwater capture, and
			 reuse or recycling of drainage water, to improve water quality or promote
			 more efficient water use, including on land currently in agricultural
			 production;</text>
					</subparagraph><subparagraph id="H68BFE5CBA91447D0A80AD910C24D0027"><enum>(J)</enum><text>conducting and completing studies or assessments to project how climate change may impact the
			 future operations and sustainability of water systems; or</text>
					</subparagraph><subparagraph id="H532923052DAC44C59C3ED3C4955573B4"><enum>(K)</enum><text>developing and implementing mitigation measures to rapidly address impacts on water systems most
			 susceptible to abrupt climate change, including those in the Colorado
			 River Basin and coastal regions at risk from rising sea levels.</text>
					</subparagraph></paragraph><paragraph id="HEAB369D267654967A565528DC2E46E35"><enum>(4)</enum><header>Application</header><text>To be eligible to receive a grant from the Administrator under paragraph (2), the owner or operator
			 of a water system shall submit to the Administrator an application that—</text>
					<subparagraph id="H4FDB07557DFD4C91A765B2B0EE73E428"><enum>(A)</enum><text>includes a proposal of the program, strategy, or infrastructure improvement to be planned,
			 designed, constructed, implemented, or maintained by the water system;</text>
					</subparagraph><subparagraph id="H4F5A5B20914A46A989A3FB4FCF25521C"><enum>(B)</enum><text>cites the best available research or data that demonstrates—</text>
						<clause id="H89043C5340E04C42960576EFB353451E"><enum>(i)</enum><text>the risk to the water resources or infrastructure of the water system as a result of ongoing or
			 forecasted changes to the hydrological system brought about by factors
			 arising from climate change, including rising sea levels and changes in
			 precipitation levels; and</text>
						</clause><clause id="H70328B7B8DF04A6DA09786DD64C26488"><enum>(ii)</enum><text>how the proposed program, strategy, or infrastructure improvement would perform under the
			 anticipated climate conditions;</text>
						</clause></subparagraph><subparagraph id="H1E8B3A20D94F460BB6A10A7B884DEE42"><enum>(C)</enum><text>explains how the proposed program, strategy, or infrastructure improvement is expected to enhance
			 the resiliency of the water system, including source water protection for
			 community water systems, to these risks or reduce the direct or indirect
			 greenhouse gas emissions of the water system; and</text>
					</subparagraph><subparagraph id="H43B59B6232E34A7E841805FF132EF533"><enum>(D)</enum><text>demonstrates that the program, strategy, or infrastructure improvement is—</text>
						<clause id="HA56633B8ADBE477BB8CB25F812DCF413"><enum>(i)</enum><text>consistent with any approved State and tribal climate adaptation plan; and</text>
						</clause><clause id="H2C2921E1855C464D9067BFD3F76293B2"><enum>(ii)</enum><text>not inconsistent with any approved natural resources plan.</text>
						</clause></subparagraph></paragraph><paragraph id="H69CBA52EF0F74B8EAEE1E8221433CA53"><enum>(5)</enum><header>Competitive process</header>
					<subparagraph id="H8A6D242DA6DD4549B044D2C35E4BD27A"><enum>(A)</enum><header>In general</header><text>Each calendar year, the Administrator shall conduct a competitive process to select and fund
			 applications under this subsection.</text>
					</subparagraph><subparagraph id="HC63D6A5B0E39412DB79BA1CE49480342"><enum>(B)</enum><header>Priority requirements and weighting</header><text>In carrying out the process, the Administrator shall—</text>
						<clause id="HE91D856ED0B04447A5012BB91DDC17FA"><enum>(i)</enum><text>prioritize funding of applications that are submitted by the owners or operators of water systems
			 that are, based on the best available research and data, at the greatest
			 and most immediate risk of facing significant climate-related negative
			 impacts on water quality or quantity;</text>
						</clause><clause id="H31B13F4A3F504AC28D13519ACC5A4D7D"><enum>(ii)</enum><text>in selecting among the priority applications determined under clause (i), ensure that the final
			 list of applications funded for each year includes a substantial number
			 that, to the maximum extent practicable, includes each eligible use
			 described in paragraph (3);</text>
						</clause><clause id="H6D8B27A854E24C80B7631E41A313CC32"><enum>(iii)</enum><text>solicit applications from water systems that are—</text>
							<subclause id="HEFD1251778984F39AC8B674A22C78B0C"><enum>(I)</enum><text>located in all regions of the United States; and</text>
							</subclause><subclause id="H18D8B76160C94A18ADEC2458B8875953"><enum>(II)</enum><text>facing varying risks as a result of climate change; and</text>
							</subclause></clause><clause id="H9F4CD35DC1C14E94BC364547C16A83DD"><enum>(iv)</enum><text>provide for solicitation and consideration of public input in the development of criteria used in
			 evaluating applications.</text>
						</clause></subparagraph></paragraph><paragraph id="HBE33A9148ED642B782603F9D155A1B4F"><enum>(6)</enum><header>Cost sharing</header>
					<subparagraph id="H54A437487C3C4BD28110D7279B08C973"><enum>(A)</enum><header>Federal share</header><text>The Federal share of the cost of any program, strategy, or infrastructure improvement that is the
			 subject of a grant awarded by the Administrator to a water system under
			 paragraph (2) shall not exceed 50 percent of the cost of the program,
			 strategy, and infrastructure improvement.</text>
					</subparagraph><subparagraph id="H76F04ADAB2FB46BEA9B998EF034C3704"><enum>(B)</enum><header>Calculation of non-Federal share</header><text>In calculating the non-Federal share of the cost of a program, strategy, or infrastructure
			 improvement proposed by a water system through an application submitted by
			 the water system under paragraph (4), the Administrator shall—</text>
						<clause id="H4FDCB6D4BE5B49C5BC26B738DFDEB016"><enum>(i)</enum><text>include the value of any in-kind services that are integral to the completion of the program,
			 strategy, or infrastructure improvement, as determined by the
			 Administrator; and</text>
						</clause><clause id="HE3BFDD55B98D4CEC8E2F7B17973A9ABC"><enum>(ii)</enum><text>not include any other amount that the water system receives from a Federal agency.</text>
						</clause></subparagraph></paragraph><paragraph id="H474486FBA1D847368690253C734AB1FA"><enum>(7)</enum><header>Labor standards</header>
					<subparagraph id="HB2A9102DB96A40368FDED0618F78A1DA"><enum>(A)</enum><header>In general</header><text>All laborers and mechanics employed on infrastructure improvements funded directly by or assisted
			 in whole or in part by this subsection shall be paid wages at rates not
			 less than those prevailing for the same type of work on similar
			 construction in the immediate locality, as determined by the Secretary of
			 Labor in accordance with subchapter IV of chapter 31 of part A of subtitle
			 II of title 40, United States Code.</text>
					</subparagraph><subparagraph id="H805771E1A70944AFA5A07B83E60DEAED"><enum>(B)</enum><header>Authority and functions</header><text>With respect to the labor standards in this paragraph, the Secretary of Labor shall have the
			 authority and functions set forth in Reorganization Plan Numbered 14 of
			 1950 (64 Stat. 1267; 5 U.S.C. App.) and <external-xref legal-doc="usc" parsable-cite="usc/40/3145">section 3145</external-xref> of title 40, United
			 States Code.</text>
					</subparagraph></paragraph><paragraph id="H328530E09C774A4CA5DF0974EC715329"><enum>(8)</enum><header>Regulations</header>
					<subparagraph id="H874BB5FE796B400782152119641ADE3D"><enum>(A)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Administrator shall promulgate
			 final regulations to carry out this subsection.</text>
					</subparagraph><subparagraph id="H875E4610F9764B12A4C5271CD0090E07"><enum>(B)</enum><header>Special rule for the construction of treatment works</header><text>In carrying out this paragraph, the Administrator shall incorporate all relevant and appropriate
			 requirements of title VI of the Federal Water Pollution Control Act (33
			 U.S.C. 1381 et seq.) applicable to the construction of treatment works
			 that are carried out under this subsection.</text>
					</subparagraph></paragraph><paragraph id="HCE082790D5DE49E994FCCFF2F0F29B3B"><enum>(9)</enum><header>Report to Congress</header><text>Not later than 3 years after the date of enactment of this Act, and every 3 years thereafter, the
			 Administrator shall submit to the Congress a report on progress in
			 implementing this subsection, including information on project
			 applications received and funded annually.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1EC5256FFB6041C9858ED2AB999A514B"><enum>(10)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this subsection such sums as are necessary.</text>
